Polish gov’t approves two minimum wage hikes in 2024

from 1 January, the minimum wage will be PLN 4,242

The minimum wage will increase in two stages next year. From 1 January, the lowest salary will be PLN 4,242, and from 1 July - PLN 4,300.

In 2024, the minimum hourly rate for certain civil law contracts will also increase - from 1 January it will be PLN 27.70 and from 1 July - PLN 28.10.

What impact do these changes have on the procedure for legalizing a foreigner's stay in Poland on the basis of work? If he or she applies for such residence permit on or after Jan 1, 2024, his or her contract of employment/ mandate must follow above new rules regarding salary.

Office for Foreigners started a series of meetings aimed at providing information on the legalization of stay. Next information Saturday will be held on March 25 from 9 - 15 at their Head office in Warsaw at Taborowa 33.

During information Saturdays, foreigners will be able to

obtain information on their proceedings at the office,
view case files, pick the letters and summons or
make statements for the record.

Advice will be provided by experts from the Department of Legalization of Stay.

In order to arrange individual consultations (information on a specific case, review of files) it is necessary to book in advance by calling 47 721 76 75. In other cases, reservations are not necessary.

Note - you can come to the meeting with accompanying persons, but the condition of service is the personal participation of a foreigner.

Submit your annual tax declaration (PIT)

Each year between February and April 30th, all employees who have worked in Poland in the previous year, have to submit their annual Personal Income Tax declarations (PIT) to the fiscal authorities. Currently, it’s time to submit your PIT for the year 2022.

There are various PIT forms marked with different numbers but the most common form is PIT-37 for employees who do not run their own business and did not have any income from other countries in 2020. Detailed information on taxes is published in English on podatki.gov.pl

The most convenient way of submitting your PIT is on-line via e-Urząd Skarbowy (eng. e-Tax Office) – the official government platform. The system is available now both in Polish and in English. The platform works in such a way that you don’t have to make any calculations by yourself because your tax information should already be available in your profile (based on the information provided by your employer).

What you should do is just verify your personal details and tax data (compare with PIT-11 received from your employer) and submit the PIT declaration. If you have children living with you, you can also add a tax relief by adding your children’s information. You may also submit the declaration together with your spouse.

You can also decide to allocate 1.5% of your tax to a non-profit organization (foundation, association) which collects donations e.g. for the benefit of someone's health. This option is available in the system together with a list of non-profit organizations.

How to use the system

You can log in to the system via:

1. your electronic bank account – a service called ‘Trusted Profile’ (pl. Profil Zaufany) made available by the following banks or service providers:

your PESEL* or NIP** number,

your income from 2021 tax declaration,

your income for 2022 (you can check it in the PIT-11 form),

amount of due/overpaid tax from 2021 (if this amount is 0, you cannot log in this way).

If you did not work in 2021 in Poland and so you are not able to provide the required data ( „0” is not accepted by the system), you will need to log in via your bank.

After successfully submitting your PIT, you should download the confirmation, called UPO, and keep it as a proof of submission.

Other ways of submitting tax declarations

If you cannot use the above on-line system, you can also submit your PIT in the following ways:

3. on-line via e-declaration form (e-deklaracje) - it calculates the amounts automatically but you need to provide some amounts from your PIT-11. The declaration can be submitted on-line, again, after providing the above authorization data, however, this time it is possible to put „0” if you did not have any income in 2019.

4. in paper - you can also fill in your PIT in the e-declaration system, print it out and submit in person in your tax office competent for your residence address. Do not forget to sign your PIT! It is highly recommended to print the PIT declaration twice in order to have it stamped by the tax officer as a proof of submission.

Note: due to coronavirus restrictions, the tax offices may require prior reservation of the appointment.

Unpaid/overpaid tax

When filling in your tax declaration on-line, you will be able to see any overpaid or due tax. The overpaid amount will be paid back to you by the tax authorities to the provided bank account number. The due tax has to be paid to the tax authorities before the end of April.

What if you fail to submit your PIT

If you unintentionally fail to submit your PIT before the deadline, you can still do it after April but you will have to attach an explanation note stating that it was not intentional and explaining the reason.

However, if you do not submit PIT at all and you do not pay any resulting due tax, you will become a deptor in the Polish tax system, which might result in you not being able to legalise your stay in Poland (receive the residence permit) and paying a fine.

*** PESEL number is issued automatically when registering in the municipality which is obligatory

*** NIP number is issued when registering in the tax office, for example for the purpose of requesting a document confirming that you do not owe any tax in Poland, which might be needed for a residence permit

The mobility of the student - Mobilność studenta

The mobility of the student means the right of a foreigner to enter and to stay in the territory of the European Union for the purpose of studies, resulting from the possession of a valid residence permit or long-term visa issued for the above-mentioned purpose by a Member State other then the one in which the foreigner would be entitled to use this right. The mobility of the student in the territory of Poland takes place when a third-country national who is a full-time student or a doctoral student intends to continue or complete in Poland studies undertaken in the territory of another EU country under the program or an agreement providing for intra-EU mobility measures.

Student may enjoy the mobility on the territory of the Republic of Poland under certain conditions:

the purpose of the stay on the territory of Poland is to continue or complete studies taken up in the territory of another European Union Member State;
the foreign national is covered by an EU programme or a multilateral programme including mobility measures or an agreement between at least two higher education institutions providing for intra-EU mobility;
the residence permit or the long-stay visa issued by another Member State of the European Union (*this does not apply to residence permits issued by Great Britain, Ireland and Denmark) held by the foreign national has the annotation “student;” and is valid for the whole period mobility
the period of stay in Poland does not exceed 360 days.

The condition for a foreign national to make use of the student mobility on the territory of Poland is that the Head of the Office for Foreigners receives a notice of intention of the foreign national to benefit from this mobility from the University. The full list of documents: here

Labor contract verification

Following are the requirements for contract verification for OFWs working on site in Poland (nandito na at nagtatrabaho na sa Poland):

Employment contract in English signed by employer and worker; (all pages, especially those reflecting the date of commencement, actual position, salary, and other amendment pages when available) (Note: Non-English version will not be verified)

Addendum (see below link) both signed by employer and worker.

If the employer is not amenable to sign said addendum, worker has to submit personal insurance which includes repatriation of frail body or human remains in case of disability or death. If you do not have an existing repatriation insurance, you may search for licensed Philippine insurance companies e.g. Pioneer, Paramount, Mapfre etc. which offer such products. Some even allow online registration and payment.

Copy of passport valid for at least 6 months (full data page showing photo and signature on Page 3)

Copy of valid working visa/residence card/permit or karta pobytu (front and back of ID)

No, hindi po. Prague PE Labor lamang ang maka VERIFY ng labor contracts mula sa anim (6) na bansa na nabanggit sa itaas. At hindi Apostille ang kailangan ninyo, VERIFICATION OF LABOR CONTRACT po ang kailangan ninyo.

Pag may verified labor contract na ako, paano ako makakuha ng OEC?

Bisitahin ang website ng dmw.gov.ph, i click ang online services at piliin ang BM Online Processing/Balik Mangagawa. Maaring ilipat ang existing BM record o kumuha ng appointment kung kelan makakapunta ang OFW sa POEA upang kumuha ng OEC.

Sa araw ng appointment ng pagkuha ng OEC ay dahalin ang mga requirements na nakasaad sa confirmation email ng inyong petsa at oras ng appointment sa POEA.

Tandaan ninyo, kakailanganin nyo lang ang OEC pag kayo ay lalabas na ng Pilipinas, at 60 days lang valid ang OEC. Kaya huwag agahan ng husto ang pag apply ng OEC dahil magiging expired at hindi na magagamit ang OEC ninyo sa araw ng inyong paglipad.

Will the verification of my labor contract not expire? Pag na verify na ang labor contract ko, hindi ba mag expire ang verification na ginawa ng Prague PE Labor?

Hindi po mag expire yang verified contract ninyo kung hindi kayo magbago ng employer (returning to same employer kayo). Pero kung nag change employer na kayo, kailangan nyong magpa-verify ulit, kasi nagbago na and labor contract ninyo.

New Minimum Wage 2023

Poland’s council of ministers approved two increases to the minimum wage in 2023, the office of Prime Minister Mateusz Morawiecki said Sept. 13.

The Polish government has approved the amount of minimum wage for 2023. Starting from January 2023 the minimum remuneration for work will amount to PLN 3 490 (gross). This means an increase by PLN 480 compared to the lowest wage that is in force in 2022 (PLN 3 010).

In turn, the minimum hourly rate for specific civil law contracts in 2023 will be PLN 22.80 (gross) / PLN 16.45 (net). This means an increase by PLN 3.10 compared to 2022 (PLN 19.70).

What impact do these changes have on the procedure for legalizing a foreigner's stay in Poland on the basis of work? If he or she applies for such residence permit on or after Jan 1, 2023, his or her contract of employment/ mandate must follow above new rules regarding salary.

The near victim volunteered to compose some lines about his personal experience, to serve as warning to fellow kababayans. ------------------------------------ I am one of the Filipinos who dreamed of going abroad for a greener pasture. I have known for a fact that working overseas means a lot of money in terms of salary or compensation. And with that, we can provide a better life and future for our family.

The advancement of technology has many advantages, these advantages make our lives more convenient and comfortable, especially in transacting business, work from home, bank transactions, applying for jobs, etc., and these could be done online. And, suffice it to say that the INTERNET became the way of life of most of Filipinos.

However, the INTERNET becomes an opportunity for criminally minded individuals to dupe and scam their would-be victims by way of transacting unscrupulous activities to online job seekers. They (predators) will offer jobs abroad with hefty pay and allowances and other benefits just to entice their potential prey.

And I personally experienced the said modus, I received an email urging me to submit a RESUME to the Human Resource Manager of a certain Hospital in POLAND, which I obliged. A series of emails ensued starting from 20 August 2022 until the first week of September of this year. I was surprised for the Job Appointment Letter, Immigration Authorization, Contract Agreement, and other documents that they sent seemed to be genuine and authentic. Moreover, HR instructed me to coordinate with the POLAND Ambassador here in the Philippines. The latter thru an email advised me to immediately pay the VISA fee amounting to PHP 28,200.00 so that they can start my visa processing. The HR on the other hand kept on demanding my visa updates and advised me to fast-track it to secure the job; because according to them, there are many applicants applying for the same position I am being offered.

I was about to pay the said amount, however, the Land Bank of the Philippine (LBP) and Bank of Philippine Islands (BPI) where I was supposed to withdraw and deposit the money, respectively, were on a bank holiday. So, the payment was deferred. My son, upon learning of my intention, advised me to verify with the concerned entity as to the legitimacy and authenticity of the said transaction. Kaya, naki pag reach out ako sa Philippine Embassy sa Poland at POLO sa Prague thru email. Within 24 hours, may sagot na sila at sinabing “FAKE” ang job offer sa Poland.

Right there and then, I immediately terminated my application.

My advice to fellow Filipinos, please don’t entertain those individuals who are offering good job opportunity abroad lalo na yung DIRECT HIRING. In case of doubt, ask the POEA, DMW or other government agencies in charge of labor concerns. Sabi nga nila, IF IT IS TOO GOOD TO BE TRUE, THEN IT’S NOT TRUE. I think there is also a divine intervention sa kaso ko kasi two (2) days na pending yung pag bayad ko sa bangko. Kung may plano mag abroad, deretso sa POEA para makasiguradong hindi maloloko. Mag research din pag may time.

Maraming maraming salamat sa Philippine Embassy sa POLAND at POLO sa Prague sa pagsagot sa tanong ko. Dahil dito, nakaiwas ako sa posibleng panloloko ng mga halang ang kaluluwa na nag lipana kahit saan. KUDOS to you SIRS.

Compulsory insurance secured from the Philippines. You may choose from among the list of accredited insurance providers in the Philippines which is available at the POEA website (www.dmw.gov.ph). How to Get Your OEC Online via POPS-BaM

What is POPS-BaM?

POPS-BaM is the new BM online system for returning OFWS who will need to get their OEC online. It has replaced the old BM online system since June 30, 2021.

When you have a POPS-BaM account, you don’t have to visit the Philippine Overseas Labor Office (POLO) in your country of employment or the POEA office in the Philippines for the processing of your OEC. This particular online service is available to vacationing OFWs who are returning to their same employer and have a record with the POEA.

You can access the POPS-BaM platform via the Online Services Portal of the Department of Migrant Workers (DMW) at https://onlineservices.dmw.gov.ph/OnlineServices.

How to Register for a POPS-BaM Account

Before you get an OEC online, you need to create a POPS-BaM account. Here are the things that you need to do to register for a new BM online account.

Go to the DMW Online Services Portal. Click the “Let’s Go” button.
A pop-up box will appear. Click the “Register” link.
On the next page, read and accept the Terms of Use and Privacy Statement.
You’ll then be directed to an online form. Supply your personal details. Then click the “Register” button.
At the final stage of the process, you’ll be asked to check your personal details once again. If they’re correct, click “Yes” to complete the process.

A temporary password will be sent to your email. Log in to your POPS-BaM account to change your password. Here are the steps to do so:

On the DMW’s Online Services Portal, click the “Let’s Go” button. Once the pop-up box appears, enter your email address and temporary password.
Nominate a new password.
While you’re inside your new BM online account, update your information by going to the “My Profile” section.

NOTE: The system will match your name and birthday from your previous BM online records. As such, you’ll be asked to wait for 24 hours for the records to match.

How to Get Your OEC Online via POPS-BaM

Now that you have your new BM online account at POPS-BaM, you can get your OEC online. Here are the important details that you need to take into account:

OEC Requirements

Make sure that you have the following before you get your OEC via POPS-BaM. If you don’t have them, you’ll be required to set an appointment for physical processing of the OEC at the POEA office.

A work visa or work permit
An existing record of your employment in the POEA database
Previously issued OEC while you’re under the same employer

Steps for Processing Your OEC via POPS-BaM

The process is straightforward and just follows a few steps:

Log in to your POPS-BaM account via the DMW Online Services Portal.
On your dashboard, click “Balik Manggagawa,” which is found on the right side of the screen.
If you’ve already supplied all the necessary data, just click the “Next” button. Otherwise, you’ll see an error message.
Input your flight schedule. Then click “Next.”
Review your contract details. This information will appear if it’s already recorded in the system.
You’ll then be asked the following questions: “Are you returning to this employer?” and “Are your returning to this jobsite?” If you answer yes to both, carry out the next step.
You’ll then see your OEC. Save a copy and print it.

How to Get an OEC Online Appointment via POPS-BaM

You’re considered not qualified for online processing of OEC if you don’t have an existing record with POEA or a valid work visa or permit. Similarly, you won’t be allowed to get your OEC via POPS-BaM if you have changed your employer or job site.

This means that you’ll need to process your OEC at a POEA office. But before you go there, you need to set an appointment through the new BM online system. Here’s what you need to do.

Log in to your POPS-BaM account via the DMW Online Services Portal.
On your dashboard, click “Balik Manggagawa,” which is found on the right side of the screen.
If you’ve already supplied all the necessary data, just click the “Next” button. Otherwise, you’ll see an error message.
Input your flight schedule. Then click “Next.”
On the contract page, enter the updated details of your contract with your employer abroad. Pick the appropriate transaction type on the dropdown menu.
On the BM appointment page, select a processing location. Pick the one that’s most convenient for you.
On the next page, pick your desired appointment date and time.
After reviewing the details of your appointment, click the “Print Appointment” button. If you need to change something, click the “Cancel Appointment” button to proceed with the do-over.
