<p><strong>DECATUR, GA, May 28<em>, </em>2026:<em> Shannon Pawley, Owner of The Estate &amp; Asset Protection Law Firm, </em></strong>has posted a new blog on the law firm’s website entitled<strong><em> “</em></strong><strong><em>Why a Will Alone May Not Protect Your Family</em></strong><strong>.” </strong>In which Ms. Pawley points out the pitfalls.</p>
<p>Pawley writes, “Once there was a time when a Last Will and Testament was all many people would have needed to pass on moderate assets and protect loved ones upon their passing. She continues emphasizing, “But times have changed dramatically and while a Will is still an important estate planning tool, relying on a Will alone can leave your loved ones exposed to delays, legal costs, and unexpected complications.”</p>
<p>As Pawley notes, “It’s important to understand that some assets are not controlled by a Will. For instance, retirement accounts, life insurance policies, and jointly owned property often pass directly to named beneficiaries, regardless of what a Will states.” She explains, “If beneficiary designations are outdated, assets may unintentionally go to the wrong person.”</p>
<p>Additionally, a Will does not automatically protect assets from disputes or challenges. Family disagreements over inheritance, unclear wording, or claims from creditors can create emotional and financial strain for surviving relatives. In blended families or situations involving minor children, these issues can become even more complicated.</p>
<p>According to Pawley, “A Will is an essential first step, but it should always be part of a complete estate planning strategy designed to safeguard your family’s future and reduce uncertainty during difficult times.”</p>

<p><strong>DECATUR, GA, May 22<em>, </em>2026:<em> Shannon Pawley, Owner of The Estate &amp; Asset Protection Law Firm, </em></strong>has posted a new article on the law firm’s website entitled<strong><em> “</em></strong><strong><em>The Difference Between a POLST and a DNR,” </em></strong>in which Ms. Pawley describes the differences, the importance of each and how they related to an advance directive.</p>
<p>“In my law practice,” Pawley states, “I meet many prospective clients who have heard of a DNR (Do Not Resuscitate). However,” she adds, “most people have never heard of a POLST, which stands for Physician Orders for Life-Sustaining Treatment.” She emphasizes, “The fact is that both are medical documents used in end-of-life and emergency care planning, but they serve different purposes and apply in different situations. Understanding the distinction between the two,” Pawley writes, “can help patients, caregivers, and families make informed decisions about medical treatment and personal wishes.”</p>
<p>As Pawley points out, “A DNR order, is a medical order that instructs healthcare providers not to perform CPR (cardiopulmonary resuscitation) if a person’s heart stops beating or if they stop breathing. CPR may include chest compressions, electric shocks, medications, or artificial ventilation intended to restart the heart or breathing. In general,” she continues, “a DNR is used by people who are seriously ill, elderly, or who do not wish to undergo aggressive life-saving measures that may not improve their quality of life.”</p>
<p>“Unlike a DNR,” Pawley explains, “a POLST covers a broad range of medical decisions beyond CPR. It is designed for those with serious illnesses, advanced frailty, or life-limiting conditions.” Importantly, Pawley states, “A POLST is completed after a detailed conversation between the patient and a healthcare professional. The document is then signed by both the patient (or legal representative) and the clinician, making it an actionable medical order.”</p>
<p>Pawley continues adding that it’s important for families to know the difference and to choose the right option for “one’s health condition, goals, and desired level of medical intervention. Someone who only wants to avoid CPR may choose a DNR alone while someone with a complex or advanced illness may benefit from a POLST because it provides more detailed instructions.”</p>

<p><strong>DECATUR, GA, May 19<em>, </em>2026:<em> Shannon Pawley, Owner of The Estate &amp; Asset Protection Law Firm, </em></strong>has posted a new blog on the law firm’s website entitled<strong><em> “</em></strong><strong><em>Why Adding Your Child to Your Deed Can Backfire</em></strong><strong>.” </strong>Ms. Pawley explains the many reasons why what seems so simple can end up being expensive and complicated.</p>
<p>Pawley writes, “Many people think that adding their child to their property deed is a simple way to ensure a smooth transfer of ownership later in life.” She continues adding, “They also think that this will allow them to avoid probate, reduce legal fees, and make inheritance easier. However,” Pawley states, “this well-meaning decision often creates more problems than it solves.”</p>
<p>According to Pawley, “One of the biggest risks involves loss of control.” She elaborates, “Once your child is added to the deed as a co-owner, they legally have a stake in the property. This means you may need their consent to refinance, sell, or make significant decisions about the home. If disagreements arise,” Pawley adds, “it can complicate what should be straightforward choices about your own property.”</p>
<p>Pawley goes on to say that “adding a child to your deed does not always avoid probate. This is particularly so if the ownership structure isn’t set up correctly.”</p>

<p><strong>DECATUR, GA, May 12<em>, </em>2026:<em> Shannon Pawley, Owner of The Estate &amp; Asset Protection Law Firm, </em></strong>has posted a new article on the law firm’s website entitled<strong><em> “What Happens If Your Power of Attorney Refuses to Follow Your Wishes?”</em></strong> Ms. Pawley explains that when trust is broken the consequences can be serious.</p>
<p>Pawley writes, “A power of attorney (POA) is a legal document that gives someone — known as the “agent” or “attorney-in-fact”—the authority to act on your behalf in financial, medical, or personal matters. This arrangement,” she explains, “is built on trust and the expectation is that your agent will follow your wishes and act in your best interest. But,” she asks, “what happens if they don’t?”</p>
<p>According to Pawley, “If your power of attorney refuses to follow your instructions, the situation can quickly become serious. For instance,” she illustrates, “you discover that your bills are not being paid. Or your bank questions the withdrawal of large sums from your bank account.  Legally,” Pawley states, “your agent has a fiduciary duty, meaning they are required to act loyally, honestly, and in accordance with your stated preferences. Ignoring your wishes, acting for personal gain, or making decisions that contradict your instructions is considered a breach of that duty.”</p>
<p>Pawley emphasizes, “If you are of sound mind, you have the right to cancel a POA at any time. This involves creating a written revocation document and notifying your agent, as well as any institutions (like banks or healthcare providers) that relied on the original POA. Once revoked,” she adds, “the agent no longer has legal authority to act on your behalf.”</p>
<p>“If you are no longer mentally competent,” Pawley writes, and your agent is not acting in your best interest, the situation becomes more complex. In this case,” she states, “concerned family members or loved ones may need to petition a court for intervention. This could involve asking the court to remove the agent and appoint a guardian or conservator to take over decision-making responsibilities.”</p>

<p>Pawley starts with an explanation, writing, “Guardianship and conservatorship are court processes where a judge chooses someone to make decisions for a person who cannot make decisions on their own.”  “Guardianship,” Pawley explains, “focuses the court appointed authority to make the healthcare decisions and conservatorship focuses on the court appointed authority to manage contract, money, and property affairs.” She continues, “While it may sound helpful, and sometimes can be, guardianship comes with significant drawbacks which I will explain. <p>Pawley elaborates, “Typically, guardianship and conservatorship come into play when someone becomes injured or ill and can no longer make important financial and or healthcare decisions for themselves. And we all know from recent experience that life has a way of presenting any number of accidents and illnesses unexpectedly.” Pawley emphasizes, “If there is no plan in place for these unexpected circumstances, families are faced with navigating the complex, expensive and emotionally taxing guardianship and conservative processes through the courts.”</p>
<p>Pawley notes, “The process can be time-consuming, expensive, and public. Families must petition the court, provide medical evidence, attend hearings, and potentially face disputes among relatives. Even after a court appointment, the guardian is subject to ongoing court oversight, reporting requirements, and limitations on decision-making authority.”</p>

<p>Pawley writes, “According to the Alzheimer’s Association, more than 500,000 people in the U.S, are diagnosed with Alzheimer’s every year. The expectation is that that number will reach 1 million by 2060.” She continues, “Along with increasing life expectancy driven by improved healthcare, nutrition, and sanitation, paying for dementia care is already a major concern for many families. There is no question that the cost of long-term care can quickly become overwhelming. Fortunately,” Pawley states, “several government programs can help offset these expenses while also providing ways to protect important assets such as the family home.”</p>
<p>As Pawley notes, “Medicaid is the primary government program that pays for long-term care for individuals with limited income and assets.” She continues, “While Medicare typically covers only short-term medical needs, Medicaid can cover long-term nursing home care and, in many states, certain in-home care services. To qualify, individuals must meet strict financial eligibility requirements. Because of these limits,” Pawley emphasizes, “families often work with elder law professionals to structure assets in a way that allows a loved one to qualify for Medicaid while preserving as much of the family’s financial stability as possible.”</p>
