			<p>Mentoring refers to one-on-one relationships between a mentor and mentee, where the mentor shares their knowledge, skills, and experience with the mentee to assist in their development professionally and personally. Typically, these relationships are centered around professional interests, but can also cover and expand into one’s personal life.</p>
<p><a href="https://www.forbes.com/sites/janicegassam/2019/09/26/the-key-to-diversity-and-inclusion-is-mentorship/?sh=43295617fbd7">Research</a> supports the notion that mentoring is a vital component when steering towards an inclusive work culture and retaining diverse talent. A <a href="https://www.women-ahead.org/press/turning-the-dial">study from Moving Ahead</a> found that 87 percent of mentors and mentees feel empowered by their mentoring relationships and have developed greater confidence in both the workplace and in their personal lives. Additionally, multiple studies prove the <a href="https://doi.org/10.1016/j.ijwd.2019.08.001">benefits of successful mentoring programs</a>, including greater career success for individuals and higher levels of employee engagement, retention, and knowledge-sharing for organizations.</p>

			<p>From a DEI lens, mentorship programs can substantially benefit marginalized employee groups. According to a Forbes <a href="https://www.forbes.com/sites/janicegassam/2019/09/26/the-key-to-diversity-and-inclusion-is-mentorship/?sh=43295617fbd7">study</a>, women and underrepresented groups were more likely to say that mentoring was an important aspect of their career. Mentors play a valuable role in the career progression of diverse talent. In one article from <a href="https://hbr.org/2001/04/race-matters">Harvard Business Review</a>, the career progressions of minorities at U.S. corporations were examined and found a distinct result. “People of color who advance the furthest all share one characteristic—a strong network of mentors and corporate sponsors who nurture their professional development,” says the author. This research demonstrates that mentorship may be a crucial element to the career progression for minorities. Bringing a mentorship program to your organization could be a fundamental element missing from your DEI program.</p>
<p>According to an American Psychological Association <a href="https://www.apa.org/topics/women-girls/female-leaders-make-work-better">article</a>, I/O psychologist Victoria Mattingly, PhD, founder and CEO of Mattingly Solutions, stated when it comes to mentors, it’s important that women seek out both mentors, who can provide career guidance, support, feedback, and knowledge, as well as sponsors, who go beyond the role of mentor and use their position and influence to proactively advocate for a junior employee’s advancement. “Research shows that <a href="https://hbr.org/2021/06/dont-just-mentor-women-and-people-of-color-sponsor-them">sponsorship is more effective at helping advance into leadership positions than mentorship</a>,” Mattingly said. “Mentors are great as a sounding board and to provide guidance, but when the rubber hits the road, you need someone who will speak up for you when you’re not in the room.”</p>

A <a href="https://www.td.org/insights/4-ways-mentoring-can-empower-your-diversity-and-inclusion-initiatives">study</a> found that mentoring, in comparison to other corporate tactics (such as mandatory diversity training, grievance systems or job tests), increased marginalized employee representation among managers in the workplace anywhere from nine to 24 percent.</li>

			<p><strong>Medicaid renewals are returning!</strong></p>
<p>Prior to the COVID-19 pandemic, Medicaid redeterminations/recertifications were annually performed. Since the COVID-19 public health emergency order has ended, Medicaid renewals will restart on an annual basis. This change began April 1, 2023. Read below for detailed information on this update and share it with your employees.</p>
<p><strong>Medicaid status </strong></p>
<p>If you or your employees are enrolled in Medicaid, maintaining your eligibility can depend on several factors, including changes in income, household size, age, and disability status. State Medicaid agencies started processing eligibility redeterminations on February 1, 2023 and began terminating coverage for people who no longer qualify on April 1, 2023. If you are enrolled in Medicaid, the exact date of your renewal will depend on your state. Your state Medicaid agency should contact you with instructions on any action steps you may need to complete.</p>
<p><strong>Coverage options</strong></p>
<p>If you no longer qualify for Medicaid and your enrollment is being terminated, there are ways to stay covered. Losing Medicaid coverage is known as a “qualifying life event” because it may impact your health insurance. Experiencing a qualifying life event means you can enroll in a new health plan right away as part of a special enrollment period.</p>
<p>Most people have 3 options:</p>
<ol>
<li>A health plan through work</li>
<li>A health plan offered through the Health Insurance Marketplace at healthcare.gov</li>
<li>Medicare, if you are 65 or older</li>
</ol>
<p>If you need to sign up for another health plan, the special enrollment period is typically 30 or 60 days.</p>
<p><strong>Special enrollment</strong></p>
<p>If you miss your special enrollment period, you’ll have to wait until the next annual open enrollment period to sign up for coverage. These typically start on November 1, for start dates of January 1. Once enrolled in a new health plan due to a special enrollment period, your coverage typically starts on the first day of the month following eligibility.</p>

			<p>Congress recently enacted the Providing Urgent Maternal Protections for Nursing Mothers Act (PUMP), as part of the Consolidated Appropriations Act, 2023. The PUMP Act amends the Fair Labor Standards Act (FLSA), requiring all FLSA-covered employers to provide <strong>(1) a reasonable break time, as needed, and (2) a private space to express milk for up to 1 year after the child&#8217;s birth</strong>. In addition, employers must provide a private space shielded from view, which co-workers cannot access, and that space cannot be a restroom. Teleworkers are also covered under PUMP. Unlike the old FLSA rule, this law protects exempt and non-exempt employees.</p>
<p><strong>Who must comply with PUMP?</strong></p>
<p>All employers that FLSA covers are subject to PUMP. But, if the business has fewer than 50 employees and the company can show that compliance will create an undue hardship, it may be exempt from complying. The law does not currently apply to employers of flight attendants, pilots, or railway workers.</p>
<p><strong>Do employers have to pay for pumping breaks?</strong></p>
<p>It depends. If your business does not already provide paid breaks, the law does not require that pumping breaks be paid. But, if your business does provide paid breaks, then the employee may use that paid break time for pumping.</p>
<p><strong>When does enforcement of the law begin?</strong></p>
<p>April 28, 2023.</p>
<p><strong>What happens if the employer doesn&#8217;t comply?</strong></p>
<p>Unlike the old FLSA rules, employees can now directly sue the employer. Employees may also file a complaint through the Department of Labor. Remedies include employment reinstatement, promotion, and payment of lost wages and can also include liquidated damages, compensatory damages, and punitive damages.</p>

			<p>The Department of Labor recently released new guidance on how the Family Medical Leave Act (FMLA) applies to remote employees and teleworkers.</p>
<p>As a reminder, FMLA eligibility requirements are:</p>
<ol>
<li>The employee has worked for a covered employer for 12 months or more;</li>
<li>The employee has worked at least 1,250 hours for that employer during the 12 months immediately preceding the leave; and</li>
<li>The employer has 50 or more employees within a 75-mile radius of the employee&#8217;s worksite.</li>
</ol>
<p>The new DOL guidance focuses on the 3rd eligibility requirement: the employer has 50 or more employees within a 75-mile radius of the employee&#8217;s worksite. Importantly, DOL considers &#8220;employee&#8217;s worksite&#8221; to be where their work assignments <em>originate</em>, not where the employee is physically located. For example, if the employee works from home, but the employee&#8217;s assignments come from their supervisor, who works in the corporate office, then the &#8220;worksite&#8221; is the corporate office. If the worksite where their assignments originate from has 50 or more employees within 75 miles, the 50-employee threshold has been met.</p>

			<p>The Department of Labor (DOL) has recently provided guidance to ensure that remote employees and teleworkers are adequately paid and receive reasonable break time in compliance with the Federal Labor Standards Act (FLSA).</p>
<p><strong>Breaks of 20 mins or less count as compensable hours worked. </strong></p>
<p>Employers must treat this time as worked hours, regardless of whether the employee has worked from home, the employer&#8217;s job site, or another location not controlled by the employer.</p>
<p><strong>Breaks longer than 20 mins and meal breaks, which are typically 30 mins or more, are not considered hours worked. </strong></p>
<p>Periods of 20+ minutes in which employees are completely relieved from all work duties are not considered paid time under the FLSA. But, if the employee is not considered free from all work duties, then the time is still counted as hours worked.</p>
<p>Employers should review their pay practices to ensure that they are not improperly deducting employee breaks which are less than 20 minutes.</p>

<p>Melville, NY, March 9, 2023 – <a href="https://www.prestigepeo.com/">PrestigePEO</a> announced that Robyn Rusignuolo has been appointed new COO of the Company. An experienced business leader, Robyn has assumed responsibilities as of March 6, 2023.</p>
<p>Robyn has extensive experience in the PEO and HR technology industries. She is joining the Company from Gale Healthcare Solutions, a private equity-backed staffing platform with over 50,000 employees, where she held the position of Chief Legal Officer and Corporate Secretary. She previously spent 9 years with Modern Business Associates, a 30,000-employee national PEO, where she held roles including Chief Operating Officer, Chief Legal Officer, and member of its Board of Directors.</p>
<p>Her additional PEO experience includes serving as Executive Vice President and subsequently Vice President with the Premier Family of Companies, which included PEOple Premier Inc. &amp; Community Health Solutions of America. While there, she ran multiple business units, including a PEO, and helped lead M&amp;A efforts, including both acquisitions and two significant sales to Fortune 500 companies. Robyn also co-founded and built SoleVenture, a technology platform that delivers automated HR and compliance support to gig economy workers.</p>
<p>“Robyn brings incredible knowledge and experience to PrestigePEO and specifically this role. She is a great fit for Chief Operating Officer because of her organizational leadership and her experience in managing large scale teams as well as mergers and acquisitions. Since the Company’s goal is to further extend our reach through acquisition, we are confident that Robyn can take us there,” said Andrew Lubash, founder, and CEO of PrestigePEO.</p>

			<p><em>Last week, I joined PrestigePEO as its Chief Operating Officer, relocating to Long Island from Tampa Bay, Florida. I am proud to become a part of the Prestige team – a company I have long admired for its innovative leadership, exceptional customer service, and commitment to helping businesses grow.</em></p>
<p><em>I first joined the professional employer organization (PEO) industry in 2007 after starting my career as a labor and employment law attorney. In my initial industry role, I worked as in-house counsel for a national PEO. Afterward I transitioned into roles including Vice President of Human Resources, Chief Legal Officer, Chief Operating Officer, and founder. I have worn several hats and delivered a variety of service models in the industry, but the core value proposition remains the same, and it is why I love this industry: PEOs help their clients grow faster, stay in business longer, attract and retain better talent, and reduce HR expenses. I am grateful to have the opportunity to leverage the power of the PEO model to help Prestige’s clients expand and scale their businesses while delivering excellent service and a rich HR experience to their employees.</em></p>

			<p>PrestigePEO has been working diligently to monitor and respond to the closure of Silicon Valley Bank (SVB) and the seizure of Signature Bank by federal regulators. Importantly, Prestige does not bank directly with either bank, and as such, its business continuity and service delivery are not impacted by these events.</p>
<p>Prestige has been in ongoing communication with the National Association of Professional Employer Organizations, the U.S. Chamber of Commerce, and applicable federal agencies, including the Treasury Department, to ensure that we are informed of all material updates. The Treasury Department, the Federal Reserve, and the Federal Deposit Insurance Corporation (FDIC) released a joint statement announcing that the FDIC will take action to complete its resolution of Silicon Valley Bank “in a manner that fully protects all depositors.” The announcement stated that depositors “will have access to all of their money starting Monday, March 13.” The joint statement also protects Signature Bank depositors. As troubling as the past few days have been, the government has indicated that all depositors will be protected and made whole.</p>
<p>At this time, we are working with impacted clients to ensure that their business operations continue without disruption. If you bank with SVB or Signature Bank and are processing payroll this week, we likely have been in communication already. If you have not yet been in contact with a member of the Payroll, Client Services, or Accounting Teams, please contact your representative directly.</p>

<li><strong>Office dress code:</strong> There has been a trend of more relaxed dress codes over recent years, and now with remote and hybrid work schedules, the trend continues. If your company’s dress code does not match the reality of what has become normal for your employees, it might be time to update your policy.</li>

			<p>Effective April 10, 2023, the NJ WARN Act will require employers with 100 or more employees to give a 90-day notice to employees affected by a mass layoff, termination of operations, or transfer of operations. Employers are mandated to give notice before discharging the first affected employee. Note that under the existing NJ WARN, only a 60-day notice is required.</p>
<p>Further, all affected employees must receive severance, even if they were given a 90-day notice. Under the existing NJ WARN Act, only those employees who were not provided an advanced notice must be given severance.</p>
<p><strong>How much should my business pay in severance? </strong></p>
<p>Severance paid is equal to one week&#8217;s pay for each full year worked. However, employers must be mindful of outstanding severance agreements in employment contracts, including collective bargaining agreements since businesses will be required to pay the greater severance amount.</p>
<p><strong>You qualify as a covered employer if you meet the following criteria: </strong></p>
<ol>
<li>You have at least 100 employees, including both full-time and part-time employees; and</li>
<li>50 or more New Jersey employees are affected by a mass layoff, transfer of operations, or termination of operations, this includes full-time, part-time, and remote employees.</li>
</ol>
<p><strong>What is a Mass Layoff?</strong></p>
<p>A mass layoff is a reduction in force impacting 50 or more employees at or reporting to (e.g. remote employees, field employees, etc.) an establishment located in New Jersey.</p>
<p><strong>The Penalty is Additional Severance Pay</strong></p>
<p>Failure to provide an affected employee with a 90 days&#8217; notice will require your business to pay an additional payment of 4 weeks of regular pay.</p>
<p><strong>This Change Becomes Effective April 10, 2023</strong></p>
<p>This change becomes effective April 10, 2023, meaning that an employee whose last day falls on or after April 10, 2023, must be given a 90-day notice of the layoff and is subject to all requirements of the NJ WARN Act.</p>

			<p>On February 21, 2023, the National Labor Relations Board (NLRB) issued a decision prohibiting employers from offering severance agreements with broad confidentiality and non-disparagement clauses. This ruling applies to both unionized and non-unionized workplaces. Furthermore, it is no longer sufficient for employers to claim that they wouldn&#8217;t seek to enforce these types of clauses. The Board sees the mere act of offering this as an unfair labor practice. Therefore, severance agreements with overly broad confidentiality and non-disparagement clauses may be deemed unenforceable.</p>
<p><strong>This decision applies to covered National Labor Relations Act (NLRA) employers. Are you a covered NLRA employer? </strong></p>
<p>&#8220;The NLRA applies to almost all private employers, therefore it is highly likely that your business is covered. The NLRA does not apply to:</p>
<ul>
<li>Federal, state, or local governments;</li>
<li>Employers subject to the Railway Labor Act; or</li>
<li>Employers that only employee agricultural workers.&#8221;</li>
</ul>
<p><strong>Are there workers whose severance agreements do not fall under this new requirement? </strong></p>
<p>Yes. Note that the NLRA does not protect all workers, and therefore the recent ruling does not apply to severance agreements for all workers. The NLRA protections do not apply to independent contractors, managers, most supervisors, public sector employees, and some agricultural workers.</p>
<p><strong>Review your severance agreements to avoid being charged for unfair labor practices</strong>.</p>
<p>The NLRA may charge employers covered by the NLRA with unfair labor practices for offering severance agreements that contain non-disparagement or confidentiality clauses deemed overly broad, however, if the severance agreement was drafted when the law allowed these provisions, that could be a potential defense.</p>

<p>Yes, every single one. If the client does not wish to contest, they can let their Human Resources Client Partner know.</p>
<p><strong>2. Does PrestigePEO notify the client about every unemployment claim that they handle?</strong></p>
<p>No. If the question is sent by the Department of Labor and it can be answered with the information already in PrestigePRO, Prestige will not reach out.</p>
<p><strong>3. Why does Prestige sometimes send the client an email with an unemployment question? And why do the questions seem so random?</strong></p>
<p>The state generates questions for every unemployment claim. Prestige makes no judgments about those questions, but they do sometimes seem random. Prestige does its best to answer all the state’s questions. If information related to the questions is not in PrestigePRO, Prestige will email the client to get the most accurate information for the unemployment claims. These questions should be answered in a timely fashion as the state implements strict deadlines for every claim!</p>
