The Mobile apps trend is growing tremendously around the world. Entrepreneurial businesses and companies, restaurants, and the entertainment industry are using mobile apps to help market, advertise, or use it as a tool for customers to purchase items from their websites. Most people use the internet on their phones. Having a mobile app downloaded on their phones, makes it easier for them to get their business done by using these apps. It can also increase sales and traffic to their website for their companies or businesses. “Techcrunch.com’s website article written by Robin Wauters, “Report: Mobile App Market Will Be Worth $25 Billion By 2015 – Apple's Share: 20%”, states that the research firm’s ‘World Mobile Applications Market (2010 – 2015) reports, the total global mobile applications market is expected to be worth $25 billion by 2015 (up from about $6.8 billion in 2010). Also, MarketsandMarkets projects Apple’s App Store are to hold nearly 20.5 percent of that particular cake, while the global market is forecast to record a CAGR (compound annual growth rate) of 29.6 percent from 2009 to 2014. In addition, the research firm reiterates the various factors that will be contributing to that growth, from advancements in network technologies to the lowering of mobile data usage cost, growing adoption of smartphones around the world, and a continuous increase in application usability” (Wauters, R., 2011).

If you are planning on starting your own film and television business or company in the entertainment industry, please think about consumer privacy rights before you create your app for your business or company. The best thing I would suggest to any business or company owner in the entertainment industry is to write the information on what you want in your mobile application for the privacy of the consumers. Write this infomation down on paper or in your business plan before you start doing this. It is very important that you follow the consumer rights act laws and your state laws using mobile apps for consumers who will download your apps from your business or company’s website. In the article, “Marketing Your Mobile App: Get It Right from the Start” written by the Federal Trade Commission’s, the Bureau of Consumer Protection Business Center, gives information on “advertising your mobile app to consumers and what you need to follow when doing this, secure privacy for your consumers”, and other information that will be helpful to you before you create a mobile app for your company or business (Federal Trade Commission, 2013). Also, if you own an entertainment business or company in the film and television industry in the state of California, please read the “Privacy Enforcement and Protection” information that the “state of California Attorney General Kamala D. Harris has put on her list as top priority. Then, read the “Privacy On The Go Recommendations for the Mobile Ecosystem” information in 2013, concerning “Privacy rights for the consumers” in your state pdf handbook on this website” (California Department Of Justice, 2013).

As a recent graduate at Full Sail University with a Master Of Science Degree in Entertainment Business, I believe the mobile app trend will be useful for me to use to get a job in the entertainment industry. Also, I believe I have an opportunity to work in the digital media part in a film and television company anywhere in the world and will excel in it. In addition, I believe the mobile app trend is being used even more now for business or company owners in the film and television industry to plan and schedule their business or company meetings for their employees on their jobs to tell them what assignments they want them to accomplish during the day.

Identity theft and identity fraud are terms used to refer to all types of crime in which someone wrongfully obtains and uses another persons personal data in some way that involves fraud or deception, typically for economic gain. It can be your bank account or credit card number, your telephone calling card number, and other valuable identifying data can be used, if it falls into the wrong hands, to personally profit at your expense” (The United States Department of Justice, 2013).

Identity Theft has been a crime that has caused many businesses or companies to loose money because of private information that was stolen from their businesses or companies. The article, “Industry Statistics”, taken from the Identity Theft Resource Center of the Javelin Strategy & Research 2012 Identity Theft Fraud Report, states that the total dollar fraud amount in 2011 equaled $18 billion. Also, the key findings of the 2012 Association for Financial Professionals Payments Fraud and Control Survey include: two-thirds of organizations experienced attempted or actual payments fraud in 2011, Large organizations were significantly more likely to have experienced payments fraud than were smaller ones. Eighty-one percent of organizations with annual revenues over $1 billion were victims of payments fraud in 2011 compared with 55 percent of organizations with annual revenues under $1 billion” (Identity Theft Resource Center, 2013).

Some employers may know how to protect their businesses or companies from identity theft (ID theft). On the other hand, some employers may not be doing enough to protect their private information from ID theft that may be happening now in their businesses or companies. Also, entrepreneurs who want to start their own businesses or companies really need to understand that this is a key factor to take in consideration before hiring employees and advertising their services or products to customers. How do employers protect their businesses or companies from Identity Theft? Well, “according to the article, “How to Prevent and Detect Business Identity Theft” by Marco Carbajo, a CEO of Business Credit Insiders Circle, gives five strategies that can help businesses or companies to prevent and detect business identity theft:

1). Develop a Protection plan- Design a step by step plan to protect your company’s

identity at the same time while putting together you business plan if you

become a victim.

2). Protect company information and documents- Keep all your company’s documents in

a safe and secure place. Shred all important documents. Do not give out information

pertaining to your company’s federal tax identification number, bank statements, etc.

Use prepaid cards instead of a traditional business card so you can set limits on the

card so you will know how much is on it. If a criminal happens to steal a card from an

employee, you can quickly take action.

3). Protect company information online- You can put your company at risk by using

or putting sensitive information like your Employer Identification Number (EIN),

account numbers, financial documents, or personal information via email or on the

web or internet. If you provide this information for a specific reason such as

applying for a credit card, make sure the site is secure and its security certificate is up

to date.

4). Monitor Credit Business reports- One of the fastest ways of detecting id theft is to

monitor your company’s profiles by all three major business credit bureaus.

Subscribe to their monitoring services.

5). Avoid the “master”: user- Avoid creating any type of master user account and

password where an employee or individual can gain access to all your company

information” ( Carbajo, M., 2013).

Business Plan Experts and How Their Business Plan Key Elements Have Helped Me To Write My Business Plan

Guy Kawasaki

There has been good information provided by Mr. Guy Kawasaki on how to write a successful business plan that I have used to help me to write my business plan in the previous blog article below that I posted on my blog website. Since I have almost completed writing my business plan, there is one key element or component that I have added to and changed in my business plan that Mr. Kawasaki suggested is to have a “solution” according to the article Silicon Valley beast Guy Kawasaki on writing a business plan” quoted by the author Luke, who gives excerpts from Guy Kawasaki’s book “ The Art of the Start”

(Luke, 2012). Also, I have added and changed in my business plan some of the solutions I will resolve on the different problems that might occur in my business while it is in operation. These additions ad changes are under the Company Operation section in my business plan.

Oteia Bruce

Ms. Oteia Bruce is another business expert that provided some good information about how to write a good business plan on the previous blog article that I posted below on my blog website. Although I have not gotten to this section in my business plan, I will add the Executive Summary and summarize it by giving a brief analysis of my business and its background according to the article by Ms. Bruce called “10 Key Components to Writing a Winning Business Plan” (Bruce, O. 2011). After reading the article by Ms. Bruce, I changed my business plan by adding the Financial Plan to my business plan that shows the amount of money that I will pay my employees and the amount of income that will come into my business shown from my proforma spreadsheet.

I feel that all of my business plan sections are important to me. However, I know investors will find my Executive Summary and the Financial Projections of my business plan to be the most important sections to them. In addition, this will determine how much money they will invest into my business after reading my business plan.

Guy Kawaski is a well- known business expert from the Silicon Valley area in California. “He is the co-founder of Alltop.com, online magazine rack. Kawaski is also the founding partner at Garage Technology Ventures, where they help people to start –up their business in the innovations of technology. Also, Kawaski has written numerous books which are The Art of the Start, The Macintosh Way, Selling the Dream and others. He received his BA degree in Psychology from Stanford University in Stanford California. In addition, Mr. Kawaski has an MBA degree from UCLA in Los Angeles, California” (Kawasaki, G, 2012).

Guy Kawaski gives great advice on to how to write an effective business plan. In the article, “Silicon Valley beast Guy Kawasaki on writing a business plan” by the author Luke, he gives great excerpts of Guy Kawaski’s book, “The Art of the Start”. The key areas or components Mr. Kawaski writes in his book and wants us to focus on when writing a business plan are:

Another expert on writing a good business plan is Ms. Oteia Bruce. “Ms. Bruce is the president of Team Network at www.teambiz.biz. She has published several books. Also, some positions and jobs Ms. Bruce has worked on are as Senior Vice President for Perks Group, Regional Vice President for GE Finance, Corporate Banker for J.P. Morgan Chase and Stockbroker for Morgan Stanley” (Bruce, O., 2010). In Ms. Bruce’s article, she gives 10 “Key Components to Writing a Winning Business Plan”. The 10 key components are:

These are the major components that need to be in your business plan. “Ms. Bruce explains in her article that it is critical to write a good business plan to secure funding. No investor or banker will not give you any funding if your business plan is not explained in detail as to how they will gain profits from your business or they may not give you the money to start your business” (Bruce, O., 2010). Moreover, I agree with Ms. Bruce that it is important to write a good business plan so you will get the funds you need to start your business. Furthermore, writing your business plan thoroughly and in detail will help you to better prepare for your business when you are ready to start it before you present it to investors or bankers.

I believe that this social media tool for the $1 texting may do well. The outcome of this service will depend on how the customers will respond to texting someone for a fee. Most customers may want to text someone without paying a fee within their network and have unlimited texting. In addition, this is a good digital marketing tool to use on face book.

For the authors who want to really publish their books without going to a traditional publishing company, self-publishing companies are waiting to take the authors work and help them get their work published. In addition, there are many publishing companies that the authors can use to self- publish their books. The self-publishing companies are CreateSpace, Xulon, Blurb, Lulu, iuniverse, Outskirts Press, Tate Publishing, Xlibris, and more. “According to an article by Bowker, the article states that, “ The number of self-published books produced annually in the U.S. has nearly tripled, growing 287 percent since 2006, and now tallies more than 235,000 print and “e” titles, according to a new analysis of data from Bowker, Books In Print and Bowker, and Identifer Services. The growth increases in both print and e-book format” (Bowker, 2012). Also, Beat Barblan, Director of Identifier Services for Bowker, an affiliate of information powerhouse ProQuest says,“ Self- Publishing is now supported by a sophisticated and highly accessible support structure. Notable success stories include a number of self-published authors landing their titles onto the prestigious New York Times bestseller list for ebook fiction” (Barblan, B., 2012). Also, “Bowker is the official ISBN Agency for the United States and its territories” (Bowker, 2012).

The best thing about the book authors who want to publish their books through a self-publishing company is that they can have control of their work in writing their books, than the authors who publish their books through a traditional publishing company. No one can take the originality out of their work before they publish their books. By taking the originality out of someone’s work, it can take the uniqueness out of the authors’ book that they are writing that holds dear to the authors’ heart. In other words, they have put the time and effort into writing their books that can really reach a massive audience of readers that could be a best time seller for them.

What is so great about book authors profiting money from their books? Well, the self-publishing company called Outskirts Press, “allows the authors to maintain 100% of their profits” (Outskirts Press, 2012). Normally, traditional publishing companies do not allow the authors to keep 100% of their profits. Furthermore, authors who use self -publishing companies can be very successful in accomplishing their goals in making a great profit from their books even if they do not publish their work through a traditional publishing company. Law Cases in the Entertainment Industry and information on Intellectual Property

There are four podcasts that people can hear on the internet that have great information on entertainment law cases and intellectual property. These four podcasts will help people to understand copyright information, trademark information, information on what to be careful of when using the internet and webcasting, intellectual property, and other information that you can avoid when launching your own business. Moreover, in this blog, there are three podcast that I will write about concerning what I learned from listening to Entertainment Attorney, Gordon P. Firemark’s podcasts. Also, Attorney Firemark is an entertainment attorney in the Los Angeles, California area who also owns law offices as well. Second, the next podcast I will write on will be from Professor Andrew Beckman-Rodau from Suffolk University in Boston, Massachusetts discussing the IP Law Concentration program at Suffolk University and explains in detail what is intellectual property.

Entertainment Attorney, Gordon P. Firemark discussed in his podcast on Episode 33 with Entertainment Attorney Tamera H. Bennett on the Trademark 50/50 case of Lionsgate Entertainment vs. Eastland Music Group. Apparently, the Eastland Music Group felt that if Lionsgate releases the dvd movie of 50/50, then it will cause confusion for the consumers from their products (Firemark, G., 2012). “Judge George Lindberg, watched some of the movie and clearly states that the movie does focus on the cancer diagnosis of a rare spine cancer of the character Adam Levine and that he will have a 50/50 chance of survival according to article from Mr. Garner about this case” (Gardner,

E., 2012). Also, Judge Lindberg dismisses the case and Lionsgate Defeats 50/50 Trade Mark Lawsuit against Eastland Music Group (Gardner, E., 2012).

The second podcast by Entertainment Attorney Gordon P. Firemark’s Episode 30 for the “Music royalty settlement of mechanical royalties between the record music industry, publishers and songwriters, and the digital media association have come to an agreement that they will decide the mechanical rates according to the copyright 115 on how much a company will make in mechanical rate of royalties from a song given to the publisher” (Bennett,T., 2012). Moreover, the third podcasts by Gordon Firemark is in Episode 33 on ABC v. Aero, Inc. ABC claims that Aereo, Inc., who is an internet company, broadcast live television copyright programs over the internet owned ABC owns. In addition, Aereo, Inc. did not copyright any programs from ABC because they use one antenna for one subscriber or customer so it will not be a copyright issue and it is not considered a public performance.

The last podcast that I will write about is by Professor Andrew Beckman-Rodau who explains the IP law Concentration program at Suffolk University. Also, he explains the information on intellectual property as well. Professor Rodau explained areas that come under intellectual property. The areas he explained in this podcast are "patent law, copyright law, trademark law, and trade secret law" ( Rodau, A., 2012). These areas fall under IP concentration program. Professor Rodau also explains how most of their students in this program become intellectual property attorneys.

I learned very valuable information when listening to all the podcasts from Entertainment Attorney Gordon E. Firemark. Also, I learned how to protect my information from copyright infringement in the entertainment cases in the entertainment industry. Furthermore, I learned very valuable information by listening to the podcast from Professor Andrew Beckman-Rodau on intellectual property, the IP concentration at Suffolk University program. By listening to these podcasts, I have found this information very helpful by knowing more of how to protect my business and business plan in the different areas of intellectual property. Legal Cases in the Entertainment Industry

There are three legal cases that I felt that are important to discuss in my blog. The three legal cases are A&E Television Faces Lawsuit Over Copyright of 3D Jesus Christ (Exclusive), Elton John Loses Libel Case to Murdoch-Owned Newspaper, and How a Legal Fight Over Ray Charles’ Song Rights Might Impact the Music Industry. Legal case number one, is about “Raymond Downing, a New York –based 3D digital illustrator, who is suing A&E Television Networks, owner of the History Channel, and Left Right Inc., a production company, for infringing the copyright of his virtual reproduction of Jesus by overusing material subject to a licensing agreement” (Gardner, E., 2012).. I believe that Downing has the right to do this as long as he has the evidence to prove it. Also, he did copyright his work as well.

The second legal case is “Elton John Loses Libel Cases to Murdoch-Owned Newspaper” (Gardner, E., 2012). In this case, “Murdoch-Owned newspaper claimed that Elton John’s former accountant, Patrick McKenna, is a part of a film investment scheme in the UK” (Gardner, E., 2012). Although Elton John lost this case, I believe he had the right to express his opinion and he did not want people to think that he has something to do with a tax scheme and a person that he did not know that was not his accountant.

The third case is How a Legal Fight Over Ray Charles’ Song Rights Might Impact the Music Industry (Gardner, 2012). In this case, Ray Charles’ children are fighting to terminate the grant rights of the publisher of Ray Charles songs so that the rights will be given to them (Gardner, 2012). The problem is that his children are not in the will to receive his publishing rights” (Gardner, 2012). His children feel that the Ray Charles Foundation should not receive any royalties if he was not hired by Warner/Chappell Music” (Gardner, 2012). Moreover, the Ray Charles foundation says that Ray Charles was not hired at Warner/Chappell Music and they feel that they should have the publishing rights to the song. I believe that if the evidence show that Ray Charles was not hired by Warner/Chappell Music then the Ray Charles Foundation can reap the benefits. Furthermore, I do understand why the children would like the royalties of their father’s music. May the best one win!

Marketing Strategies for New Indie Artists to Promote and sell their Music

There are several marketing strategies for new indie artists to sell and promote their music by booking venues in their local area and in other areas; therefore, promoting their music on their local television stations or radios shows, and promoting their music online. Since most new indie artists want to find ways to make money in their career, I believe these marketing strategies will help them.

New indie artists who book their own venues is a great marketing strategy for them to promote and sell their music. Because they are just starting out in their music career, I would suggest that new indie artists network with people in their community or in other places that they know that the people are willing to allow them to perform their music concerts there. In addition, “Indie on the Move is a free music database and show booking resource that has over 5,500 plus U.S. music venues.”

Another marketing strategy that new indie artists can do to promote and sell their music is by going to their local television stations or radio shows to talk about their music. Most of the time, if there is a major event going in your area, television stations and radio stations are more apt to at least promote their own artists in their area. I have seen this happen at television stations and radio stations.

Last, a marketing strategy that new indie artists can use to promote and sell their music is by promoting their music online. There are social media sites new indie artists can use that may be free and some require a low cost fee are myspace, facebook, you tube, twitter and, ReverbNation. Furthermore, “ReverbNation has over 2 million artists who use this database to power digital distribution, promotion, and more on its website.”

Why Music Artists Need To License And Publish Their Music?

It is very important that artists today who are songwriters need to license and publish their music. If music artists write their own songs and do not understand the music industry, I would advise them to consult an entertainment lawyer who understands the music industry before they sign a contract with any record label. Music artists need to have their entire music licensed in order for them to receive royalties and money from their music. This way, the music artists will not have the record labels taking their hard earned work from them and taking credit for it. If your music is played in a television commercial, a television show, a film, on the internet, on the radio, or any where else without the person asking your permission to use your music, you have a right to get your money from them because they are using your music illegally and making money for themselves.

What is music licensing? According to Corbin Bell Associates website, "music licensing, is the granting by the owner of the right to publicly perform copyright music to another. In return, the recipient of the right-the licensee-pays the owner a royalty fee.” In other words, this protects your music from other people taking credit for something that is not their music. You can receive the benefits of your royalties that you receive from all the music you have written and it will be in your pocket.

It would also be good for music artists to either own their own music publishing company or have a music publishing company to market their songs for them. A "music publishing company, will help you get your royalties for your songs. They will help place your songs in television, films, advertising or any other media outlets.” This will help many artists.

Moreover, I e-mailed Attorney Cooper my questions after speaking with him over the phone. Here are the interview questions below and the answers he gave me in my blog interview.

1). How do you separate the people from the problem when you are negotiating a film

making deal for an actor or actress in the television and film industry?

Attorney Keith E.Cooper

“I don't. Or, rather, I should say this concept doesn't apply. When negotiating a film deal, there is no "problem" per se. Both people want to make the agreement and both have good reasons to do so. Rather than separating the person from the deal, I try to personalize the deal as much as possible. In making a favorable deal, it is important to emphasize the actor's or actress's unique qualities and what their personality can bring to the project. I try to paint a picture of how much better the project will be with my client and how much they will enjoy working with him/her. The entertainment business is extremely competitive and, consequently, successful people are rarely willing to work with someone they don't like.”

2). How do you negotiate film making deals when a film maker is pitching his or her

film to a film distribution company in an effort to make a profit for his or her film

without the film making company taking more of the profits from the person’s film?

“In order to make a successful deal, both sides need to feel that they are getting what they want. Generally, there are industry standards for what a distributor will get and what a filmmaker will give up. It's important to keep abreast of trends and know what the market will bear. Where filmmakers and inexperienced negotiators mess up is in asking for too much or settling for too little. It's also important to help the filmmaker understand that the distributor must incur a number of expenses to help the film become successful. Without proper marketing and publicity, neither the filmmaker nor the distributor makes money, so it is in the filmmaker's interest to make sure the distributor is allowed a reasonable fee plus expenses. In connection with that, I try to set minimum standards of what the distributor is required to do to promote the film.”

3). How do you control your emotions when the other party you are negotiating with has

an arrogant attitude and they are not willing to negotiate a contract deal for

one of your clients in the television and film industry?

Attorney Keith E. Cooper

“Often, negotiations take the form of exchanging comments to an agreement. When I get comments that I find especially offensive and enraging, I don't respond right away. I might write out an angry response to clarify for myself what points I want to make, but don't send it. Then, after I've had a few days to mull over the salient issues of why the remarks are offensive, I respond in a manner that focuses in a precise way on what my client is willing to do. I've found that using a precise vocabulary that expresses my views exactly is important. Calling people names or making general rude comments like "that's crazy" or "we won't do that" doesn't move the negotiations forward. Being clear about your needs can help bring your opponent to your point of view”.

4). How would having good listening skills and a good understanding of the other party’s

perception will help you to negotiate a deal with a film and television company

for one of your clients?

Attorney Keith E. Cooper

“As I mentioned above, being clear about your needs is important. Having good listening skills will help you quickly understand the other side's needs. If they're not being clear, or you think there's something important they aren't expressing, you need to ask follow-up questions, which is an important part of active listening. Making sure the other party feels "heard" and getting to their underlying needs can be very useful. The best deals come when the two sides have complementary needs--they want different things that fit together. If the two sides are truly at odds, and they both want things that conflict, it is unlikely they will ever make a deal. In the film and television industry, if you can't make a deal with this person, there is always someone else who would take your deal. If you're listening and understanding the other person, you'll find out sooner that the deal isn't happening and waste less time on a negotiation that's going nowhere.”

Protecting Your Business Plan

When writing a business plan, it is very important that you protect it. In order for entrepreneurs to protect their business plans in the entertainment industry, they need to protect their intellectual property. “According to the World Intellectual Property Organization website, intellectual property refers to creations of the mind: inventions, literary and artistic works, symbols, images, and design used in commerce. Also, intellectual property is divided into two categories: Industrial property, which includes the inventions (patents), trademarks, and industrial designs, and geographic indicators of source and copyright, which includes literary and artistic works such as novels, poems, plays, films, musical works, artistic works, such as drawings, paintings, photographs, sculptures, and architectural designs.” If entrepreneurs do not protect their intellectual rights, other people can take their ideas or works and use them for their own business.

The entertainment industry is a very competitive market. Most people in the entertainment industry such as an actor, actress, producer, director, screenwriter, musician, a television host, or even a news anchor are normally entrepreneurs looking for ideas or products as to how to generate money for their own business. It could be a perfume product, a make-up line, a hair product, a film, a song, a script, or a technology product that can make them millions once it has been pitched to the right company to help them get their inventions to the consumers so they can buy their products. For example, most singers in the entertainment industry have their own fragrances in major retail stores across the world because they are so popular among their fans, but they have to be very careful that they get all of their intellectual property ventures taken care of by paying an entertainment lawyer; otherwise, people will make money from their products. Because they are celebrities, they cannot afford to take any chances in loosing money for their own business.

If there are entrepreneurs who want to get investors to invest in their business, they need to have them to sign a non-disclosure agreement. “A non-disclosure agreement (NDA) or a confidential disclosure agreement (CDA) is a legal contract that protects entrepreneurs against the theft of their intellectual property since sensitive information may be disclosed over the course of a meeting or presentation with potential investors.” In other words, this is another way to protect your intellectual property before the investors steal or use your information for their own business endeavors. The best advice I believe that I can give to entrepreneurs that will be helpful to them is to treat their business plan as if their products or ideas are already making money for them now in the marketplace and their consumers are buying their products. Furthermore, getting an entertainment lawyer to draw up a non- disclosure contract for them will help them to protect their business products and ideas before they pitch their business plans to investors.

Why TV and Film Ratings are important in the Entertainment Industry?

It is very important that parents monitor the television programs and films that their children watch in their households. “According to the MPPA website, Movie ratings provide parents with the advance information about the content of films, so they can determine what movies are appropriate for their young children to see.” So many children behaviors are influenced in a negative way by watching television shows and movies that are inappropriate for them on television and in the movie theater. For example, a child may watch a movie that has a lot of violence in it and the negative affects of it may cause his or her behavior to endanger other people. Also, it is very important that children get the proper amount of rest and not be consumed with watching too much tv everyday.

On the other hand in a positive way, the television can stimulate a child’s intellect in learning educational programs that can help improve their studies in school. This is why I believe parents want to make sure their children are focused on school than on things that can distract them from their studies.

Film ratings are much needed for parents to know what type of films their children should not watch. “According to film ratings.com's website, the ratings are rated in more than four different categories for television and film. Rated G, PG-13, R, and NC-17. Rated PG parents may not like some thing s that their children watch. Second, rated PG-13 may have some thngs that parents may not want their teenagers to watch. Third, rated R is really only appropriate for adults and NC-17.” I believe the best ratings that children can watch freely would be rated G if they are under age. Rated G movies and television programs are more for cartoons and things. Furthermore, parents need to keep monitoring their programs in their households.

Joseph Lekuton, An Inspirational Speaker

I chose to write the summary on the Ted Speaker, Joseph Lekuton , from Ted.com’s website because his story really did inspire me and he is making a difference in his country, Kenya, and is changing the lives of his people there. The event that most inspired me, and I am sure the people in the audience, about Lekuton is that when an elder asked him, “What are you going to do about your education in America? What are you going to do for us? We want you to be our eyes, we’ll give you the legs. We’ll walk you, you lead us” (Lekuton, 2007). “So Lekuton, told the elder that he would leave America and run for office in his country” (Lekuton, 2007). “He moved to Kenya last July, ran for office and won the election as a member of the Parliament in Kenya” (Lekuton, 2007). He wanted to help his people so he can change things around his country. Right now, Lekuton is working on making sure that his people have clean water to drink. Also, he is having health care facilities built so that doctors and nurses from America and from his country can provide health care for his people (Lekuton, 2007).

Lekuton really inspires me because he grew up in poverty and he understands the importance of helping his people in his country to improve the living conditions of his people. Plus, Lekuton completed graduate school at Harvard University where he received his degree (Lekuton, 2007). By listening to Lekuton’s story, I really understand his passion for helping his people in his country. The things that he has been through really touched my heart. Because his parents were nomads, they had to put him in different schools, but he continued and finished his education despite the living conditions he was exposed to in Kenya (Lekuton, 2007). This took a lot of courage. I am proud of Lekuton and the things he has accomplished in his life, considering the fact that he went back to Kenya to help his people to have a better life in his country. In addition, the knowledge of what he knows about his country impressed me and he really is passionate about his desires to make his country a better place for his people. Furthermore, I understood his story and he explain his topic well.

As I listened to Lekuton’s story, it really inspired me in moving aggressively toward finishing my master’s degree in Business Entertainment at Full Sail University. Also, I want to make a positive difference in the lives of people in my country and other countries as well. I really believe that, if we as a people, can make a positive impact in the lives of people in our society, a positive change can take place in our own country. This is the reason why I give donations to different charities for the betterment of our people especially when it comes to people who do not have enough food to eat, either in our country or other countries. It breaks my heart to see people suffering and dying because of a lack of food and healthcare not provided in their country. In addition, these people are like you and me; that is, they are only human beings who need food and education to function in their country. The difference is that they live in poverty and do not have any food, water, and healthcare to help them live. Furthermore, this is one reason why I volunteer to support different organizations to help people who do not have enough food to eat. Again, the more we help people with these types of living conditions, we can make a positive change in their lives.

The Motion Picture Association Of America and Its Public Awareness Campaigns

The Motion Picture Association Of America (MPAA) is known all over the world. It is one of the biggest associations for the film and television industry. Also, “The MPAA is over the U.S. motion picture, home video, and television industries.” “Chris Dodd is the Chairman and CEO over MPAA and he protects the creative and artistic freedoms of filmmakers, while working to rally public and private institutions around the world to cause of safeguarding intellectual property rights, advancing technology-driven innovation, and opening markets to the uniquely powerful and increasingly global medium of film”. In other words, this association helps protect the rights of filmmakers. Also, they want to make sure that filmmakers work is not copied illegally by someone who sells their products by breaking the law of intellectual property.

The Motion Picture Association of America has created many public awareness campaigns to protect the jobs of its people in the entertainment industry. There have been several people in the entertainment industry who have loss their jobs because some people sold their films illegally to other people. “The Public Awareness Campaigns of the MPAA are taking a stand for film makers by working with government agencies and law enforcement to stop film theft by raising an awareness about this problem in the cities, states, and countries around the world.”

Film theft is really a big problem for filmmakers in the entertainment industry. I have seen people who will literally record movies in the movie theaters so they can sell the film to other people and make a profit off of it. This is not right. I am so glad that MPAA is doing something about this. In addition, this violation in the film industry can cause me to loose money when I make my own films one day.

Are filmmakers really making the full amount of money when their films hit the box office? Honestly, I do not think so. I believe there have been large amounts of money stolen because there are some people who are bootlegging a lot of their films. According to the box office mojo website, Steven Spielberg grossed worldwide from the first movie, “ Jurassic Park” in 1993, “ $ 914,691,118.” Steven Spielberg certainly made a lot of money from this film. How much more money do you think he could have made from his movie if there were not people bootlegging his film? Probably, he would have reached the billion-dollar range. This is why it is so important that the MPAA is doing something about protecting the rights of filmmakers.

The Motion Picture Association Of America has been very active in making sure that the rights of filmmakers are protected. Also, I believe that this association is really helping the entertainment industry because it will allow more film makers to have more hope in their movies and will not be taken for granted. Furthermore, there should be more advocates in the entertainment industry to voice their opinions and actively get involved in protecting the rights of filmmakers and their own movies.

Invasion Of Privacy, Celebrities, Paparazzi, and the News Media

The invasion of privacy has been a problem for celebrities because they are considered public figures in the entertainment industry. Wherever they go, paparazzi photographers and the news media are always taking pictures and videos of them to publish in either a magazine or for a newscast to make a profit from them or to get a news story. What does invasion of privacy mean? “Invasion of privacy is the intrusion into the personal life of another, without just cause, which can give the person whose privacy has been invaded a right to bring a lawsuit for damages against the person or entity that is intruded. It encompasses workplace monitoring, internet privacy, data collection, and other means of disseminating private information.”

Although most celebrities have a career that is considered high status in our society, there can be a huge sacrifice of some of their rights being invaded by the paparazzi and the news media. “Former Governor Arnold Schwarzenegger signed an anti-paparazzi bill in California, making it easier to sue media outlets that use photos that invade celebrities’ privacy.” By Governor Schwarzenegger being a celebrity in the entertainment business himself, he understands the importance of having his own right to privacy invaded; therefore, he is sensitive to the privacy of other celebrities in any industry.

It is essential for celebrities to fight for the rights of their privacy. The part that concerns me the most is when the celebrities have their families with them out in a public place with their children. The children are not use to the news media and paparazzi photographers snapping pictures that may scare them because their parents are in positions as public figures. Will celebrities and their families actually have a normal life like other families do while raising their children? No. Unfortunately, celebrities and their families will always be harassed by the paparazzi and news media.

Defamation Of Character in the Entertainment Industry

There are so many people in the entertainment industry who have been falsely accused of negative information against them that may ruin their reputation. This kind of malicious act is called defamation of character. “Defamation of character involves written or spoken harm against a person or organization’s reputation. Defamation of character includes libel and slander. Libel is written defamation of character. Slander is spoken defamation of character.”

Falsely accusing someone or an organization is just not right. So many celebrities and other people go through negative accusations whether this happens to them on the internet, television, in the newspaper, neighborhood, community, workforce, or anywhere in a public place that can damage their reputation. For example, “Actress Cameron Diaz won libel damages over the British Sun because they published an article stating that she was caught cheating with a married man while being with her boyfriend Justin Timberlake.” I believe Ms. Diaz did the right thing by suing the British Sun because she did not want to be considered as an actress having an affair with a married man.

Having a good reputation is very important to a person or any celebrity in the entertainment industry because people base their opinions of celebrities on their character, integrity, and attitude towards the public. Because they are considered public figures, celebrities do not want their names smeared by negative innuendos. Also, celebrities may be role models not just in the entertainment industry, but to the public as well.

Defamation of character can affect celebrities’ reputation in a negative way in the entertainment industry. Although celebrities may file a suit against such malicious acts, it may take some months or even years to restore their reputation. Therefore, celebrities must be mindful and careful about how they carry themselves before the public because one negative act may cost them their career.

Social Media Users and Copyright Infringement

It is so important that social media users understand that copying someone’s work is illegal. According to the United States Government’s website, the definition “Copyright occurs when a copyrighted work is reproduced, distributed, performed, publicly displayed, or made into a derivative work without the permission of the copyright owner”Copyright. So why is it important for social media users to be careful not to post anything that is not their own work? Well, there have been reports on the Social Media tool, Pinterest, that “There are concerns of some users and copyright laws according to Steve Eder of the Wall Street Journal. Steve states in his blog that some lawyers say that there could potentially lead Pinterest users vulnerable to lawsuits — if they don’t have permission to use the content.”

The internet is a great device to advertise, market, and use to promote your products in order to get clients or followers to your website. In addition, social media users must be aware that once information is posted on the website it is going to be there for a long time. So be careful as to what you post on the internet. Also, social media users, if you are going to use any of the social media tools and post pictures of yourself, make sure it is appropriate so you will not cause yourself an embarrassment. For example, if you are wanting to get employed at a company, employers are now looking up your information to find out more about you. The same thing goes for the self- employed people. Make sure you represent your business well so people will be more interested in your products or the services you can provide them. Make sure media users use the information that you post on your website, blog, or whatever you are doing on the internet that it is copy written if it is not your own work.

Pinterest did respond back to Steve Eder’s law blog and stated, “The protection of copyrighted content is by no means unique to Pinterest — virtually every site on the web that allows users to express themselves contends with copyright complexities. As a company, we care about respecting the rights of copyright holders and have outlined on our site the best practices that people should abide by when adding pins to make them useful to themselves, the community, and the content”

Pintrest is very aware of social media users who are putting information on their website that is not their own work. I believe the copywriting regulations have already been established on their website; however, social media users are ignoring these regulations. For example, some social media users take credit when written materials are posted on Pintrest website without referencing the authors’ information. Social media users should always be careful not to make this mistake. Think about it this way, what if someone used your information without your consent and did not give you the credit for the material you published.

Although we are free to post information on the internet, we still have to remember that we must abide by the copy right laws. Copyright infringement is a crime. Moreover, there are serious consequences that will be enforced if you do not adhere to these laws.
