Where price is within or lower then average fixed cost, variable or marginal cost, revenues from those quantities are recorded as an industrial monopolization recovery value for FTC discovery.

Consumer Recovery Subset 1; kick back, in violation of Sherman Act Section 1, Section 2, Clayton Act Section 2, 3, 4, 5, 13e, 13c, 13d, Title 48, 1986 anti kickback act

Of the $26.442 billion subset of consumer recovery documented from Intel production estimates (where $42 billion total set is documented by contract), $22.657 billion or 85% is associated with Intel Inside tied charge back sum misrepresented in Intel and PC Dealer financials.

That sum is split between Intel and PC Companies 50:50 for the purpose of this analysis based on the Intel Inside monopoly system metric.

Yet Intel’s portion is known to increase, and PC Companies decrease, over the 15 year duration of this Intel Insider operation.

Intel financials associate Intel Inside as a marketing cost credited to PC Company micro- processor sales. When this commissionable sales value is actually an accrued Dealer rebate passed through Intel as a sales reward for Media Sales Agents taken as their fee, to sustain the supply chain’s product distribution ties between Intel, PC Dealers and Media Agent’s sales channels.

Sales Channels include PC Week, PC Magazine, Computer Shopper, Family Computing, PC World, Windows Magazine, other PC and some general media.

Rebate Values are Sustained from back in time with
forward time purchase agreements.

Production short run to short run, Dealer’s microprocessor purchases are unnaturally weighted to benefit them guiding Media Agents sales preferences.

Intel 1st tier Dealers purchase microprocessors in excess of end demand solely to strip margin values, including consumer transport charge, prior to reselling overage into secondary broker channels.

PC Dealers who are Intel’s 1st tier brokers monopolize majority of Intel margin values, including tied charge back, sustaining their Media Sales Agent artificial attractor and the cross industry distribution tie in total.

This relationship is a financially driven one, planned and implemented for Media Sales Agents to register, meter, report level’s of Intel microprocessor flows through PC dealer channels back to Intel.

That is the nature of the charge back;
for media registering and reporting back channel sales flows
through PC Companies to Intel.

Over time the system evolved into one which accelerated Dealer Product Flows artificially from one Intel product generation to the next, on the weight of Intel kickback placements meant to discharge certain Dealer inventory, to end market buyers, on an Intel time schedule. ""

"A nineteen-count lawsuit has been filed by former attorney Bill A. Corbin against the Florida Bar and the Florida Supreme Court for damages of more than $100 million.

The lawsuit claims that corrupt judicial officials are involved in a massive cover-up to abuse power and obstruct justice, that when revealed, could rock the foundation of the U.S. judicial system.

Presented is documented evidence that a well-orchestrated conspiracy involving local, state and federal judges has maliciously denied former attorney Corbin access to the courtroom for over ten years.

Main Charges of the Lawsuit:

In the lawsuit, Corbin alleges that the Florida Bar, assisted by the Florida Supreme Court, falsely accused him in 1998 of stealing clients' trust funds. Then, without lawfully required investigation, evidence, witness, complaint by anyone, or a hearing of any kind, his law license was summarily stripped, based only on unsworn false paper charges despite his sworn denial of the charges two days after their filing.

He says no evidence of any kind ever proved the serious charges, including no witnesses. He has never had his day in court.

After losing his good name, reputation, marriage, career, home, offices, and most other assets, plus the shame and humiliation of becoming a pauper, Corbin is adamant about getting the whole truth out in the open.

“The Bar has since admitted false charges were filed, yet I was illegally disbarred with no reason given,’ Corbin says, "and, other than a recently-discovered conspiracy of disgruntled lawyers, I still don’t know why this happened, but I have fought it since the beginning and I now hope to finally tell my side of the story to a jury in open court.”

BRIEF SUMMARY OF EVENTS
1. Without lawfully required investigation, witness, or evidence, on April 13, 1998, at the urging of some conspiring disgruntled lawyers who lost a suit Corbin had won, but sought revenge for their loss and bragged that they had connections with the Florida Bar and could get him back by having his license taken, the Bar falsely charged Corbin with stealing clients' trust funds.

Rather than evidence, the charges were based only on bookkeeping ledger cards, the bar admitting knowing they were incomplete and other documents could show the truth, but, incredibly, contended they had "absolutely no duty" to learn the truth before filing their false charges and taking his license.

2. Based only on unsworn false paper charges, without a court hearing, trial, witness, or evidence, and regardless of Corbin's sworn denial of the charges two days after the Bar filing, begging that no action take place that would harm his family, on April 22, 1998 his license was summarily suspended and all funds in his trust account plus unlimited earned fees that might be indefinitely collected later were frozen.

Only $5500 of $26,000 in the account belonged to clients; another $18,000 was collected during the prosecution but frozen and unavailable for family support.

3. While his license was "temporarily" suspended [for over three years], two trials of the charges were held, during which Corbin repeatedly asked who he had supposedly stolen from and how much, but no would or could answer him.

He learned during the case that sloppy bookkeeping had occurred in his office, but no evidence of stealing was ever shown.

During the trials, the Bar admitted false charges were filed, but regardless, no retraction was made to clear Corbin's name and he was disbarred, no reason given, and still unknown.

4. Destroyed in every way, including losses of good name, reputation, marriage, career, home, offices, and most other assets, plus the shame and humiliation of becoming a pauper, Corbin appealed the Bar's actions, asking the Florida Supreme Court, based on its past decisions, to correct the injustices occurring since 1996, but the requests fell on deaf ears. The U.S. Supreme Court refused to review the case.

5. Though essentially destroyed and unemployed since April 22, 1998 and now drawing Social Security, Corbin continues trying to clear his name and right the wrongs that have so severely affected him, his family, friends, and former clients.

His lawsuit to obtain justice names the Florida Governor, Attorney General, Supreme Court, Florida Bar, and others.

After ten years of devastation and professional and personal limbo, Corbin continues looking forward to his first day in court and the verdict of an impartial jury after the whole truth is made known.

3. Did the Florida Supreme Court err in denying the motion for rehearing, clarification and certification?

4. Did the Florida Supreme Court not only err in decisions but in fact take actions to aid and abet members of that court and its disciplinary agencies and agents from escaping prosecution of violations of public office and conflicts of interests?

5. Did the Florida Supreme Court err in denying the petition for relief and did it also err in failing to provide an opinion or explanation?

6. Did the Florida Supreme Court err in refusing Petitioner's request for conflict of interest checks prior to considering the original petition?

7. Did the Florida Supreme Court err in failing to seek Judicial Qualifications Commission approval as requested by Petitioner prior to the ruling on the motion for rehearing, clarification and certification, in evaluating if their order to destroy the records pertinent to conflicts of interests and violation of public offices of its members, prior to record retention policies, was an attempt to obstruct due process and procedure in effort to aid and abet its members caught in conflict and does this Court have power to levy such charges against them?

8. Does the order to destroy the work product files of The Florida Bar and only return Petitioner filings to Petitioner constitute the basis for charges of obstruction of justice by this Court, as that courts efforts were designed to deny this Court all the facts and evidence in the matters now before this Court?

9. Was the Florida Supreme Court obligated to report the conflicts of interest, violations of public offices at The Florida Bar they oversight, asserted and confirmed conflicts of interests, to the proper authorities?

10. Does the failure to report constitute basis for charges by this Court against that court for failure to uphold justice and follow state law and procedure?

11. Was the Florida Supreme Court obligated to review the merits of attorney misconduct pursuant to their exclusive jurisdiction to regulate and discipline attorneys in the state of Florida?

12. Did the Florida Supreme Court err and further act as accomplice by not allowing Petitioners' complaints to be filed against public office members of Respondent caught in conflict of interest and abuse of public office?

Is such refusal of complaints against public officers against the intent of the Florida and United State constitutions when creating a complaint process to protect the public's interest from conflict of interests and abuses of public offices?

13. Did the Florida Supreme Court fail to follow judicial cannons and attorney conduct codes, in its refusal to make disclosed conflicts of interest at the Florida Supreme Court, and at the Florida civil court.

Did you obtain the consent of the People after full disclosure of the implications before you took the money for your own personal campaign interests?2. A special prosecutor?3. Is your defense, Spitzer did it first?

By letter dated January 27, 2009, the Grievance Committee for the Tenth Judicial
District informed the court that the respondent was convicted on September 26, 2008, of criminal contempt pursuant to Federal Rules of Criminal Procedure rule 42 in the United States District Court, Eastern District of New York.

She was sentenced by the Honorable Allyne R. Ross to unsupervised probation for a period of two years and suspended from the practice of law in the Eastern District of New York for a period of 45 days.

The Grievance Committee submitted certified copies of the judgment dated September 26, 2008, the memorandum and verdict dated September 19, 2008, and the sentencing minutes dated September 26, 2008, and took the position that the respondent’s conviction qualifies as a serious crime within the meaning of Judiciary Law § 90(4)(d) and 22 NYCRR 691.7(b). Notwithstanding that order of suspension, the respondent continued to practice law in the United States District Court, Eastern District of New York.

Accordingly, by order dated December 31, 2008, the Committee on Grievances for the Eastern District of New York suspended the respondent from the practice of law before that court for a period of two years.

The Grievance Committee for the Tenth Judicial District also submitted a certified copy of that order to the court and served the respondent with a notice pursuant to 22 NYCRR 691.3 informing her of her right to file a verified statement setting forth defenses to the imposition of reciprocal discipline.

The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on October 26, 1983, under the name Ruth Marie Pollack.

Upon the papers submitted to the court, it is ORDERED that on the court’s own motion, the respondent Ruth M. Pollack, admitted as Ruth Marie Pollack, is immediately suspended from the practice of law pursuant to Judiciary Law § 90(4)(f) as a result of her conviction of a serious crime, continuing until further order of this court;

and it is further, ORDERED that the respondent, Ruth M. Pollack, admitted as Ruth Marie Pollack, shall promptly comply with this court's rules governing the conduct of disbarred, suspended, and resigned attorneys (see 22 NYCRR 691.10); and it is further,

ORDERED that pursuant to Judiciary Law § 90, during the period of suspension and
until further order of this court, the respondent, Ruth M. Pollack, admitted as Ruth Marie Pollack, is commanded to desist and refrain from

(1) practicing law in any form, either as principal or agent, clerk, or employee of another,

(2) appearing as an attorney or counselor-at-law before any court, Judge, Justice, board, commission or other public authority,

(3) giving to another an opinion as to the law or its application or any advice in relation thereto, and

(4) holding herself out in any way as an attorney and counselor-at-law; and it is further,

ORDERED that on the court's own motion, the Grievance Committee for the Tenth
Judicial District is hereby authorized to institute and prosecute a disciplinary proceeding in this court, as petitioner, against the said Ruth M. Pollack, admitted as Ruth Marie Pollack, based on her conviction of a serious crime; and it is further,

ORDERED that Rita E. Adler, Chief Counsel to the Grievance Committee for the Tenth Judicial District, 150 Motor Parkway, Suite 102, Hauppauge, N.Y. 11788, is hereby appointed as attorney for the petitioner in such proceeding; and it is further,

ORDERED that the petitioner Grievance Committee shall serve upon the respondent and the Special Referee and file with this court a petition within 30 days after receipt of a copy of this decision and order on motion; and it is further,

ORDERED that the respondent shall serve an answer to the petition upon the petitioner and the Special Referee and file the original answer with this court within 20 days after service upon her of the petition; and it is further,

ORDERED that the issues raised by the petition and any answer thereto are referred
to the Honorable James A. Gowan, a retired Justice of the Supreme Court, Suffolk County, 90 Sequams Lane East, West Islip, N.Y. 11795, as Special Referee to expeditiously hear and report, together with his findings on the issues, and to submit a report within 60 days after the conclusion of the hearing or the submission of post-hearing memoranda; and it is further,

ORDERED that if the respondent, Ruth M. Pollack, admitted as Ruth Marie Pollack,
has been issued a secure pass by the Office of Court Administration, it shall be returned forthwith to the issuing agency and the respondent shall certify to the same in her affidavit of compliance pursuant to 22 NYCRR 691.10(f); and it is further,

ORDERED that the Grievance Committee’s application pursuant to 22 NYCRR 691.3
to impose reciprocal discipline upon the respondent is denied as academic.

" Imagine being in a situation in which you knew you had to be quiet in order to advance your own personal career, rather than speaking up and blowing the whistle on irregularities and improprieties within your firm.

(6). Defendant Local 74 moves separately to dismiss the Complaint pursuant to Rule 12(c). Plaintiff opposes both of the motions. For the reasons set forth herein, the Court GRANTS in part and DENIES in part the District Defendants’ motion and GRANTS in full Defendant Local 74’s motion.1

BACKGROUND
The following summary of facts is drawn from the Amended Complaint.

Plaintiff resides in Valley Stream, New York, with his wife, Lorraine Chesney. Valley Stream Union Free School District (“District”) is a municipal corporation for public education that receives state and federal funding and has its administrative offices in Valley Stream, New York. The District’s Board of Education (“Board”) was comprised of Joseph Conrad, President; Carole Meaney, Vice President; Henrietta Carbonaro, Paul DePace, Anthony Iadevaio, Frank Nuara, and Lawrence Trogel at the times relevant to the present dispute.

Joan DeBell was the Disrict Clerk; Andrea DiFusco was the District Treasurer; and Edward M. Fale, Ph.D., was the Superintendent of Schools for the District; Lisa K. Conte was the Principal of District No. 24. Plaintiff also noted, somewhat curiously, that “the motto of the District was and is ‘WE TAKE PRIDE IN OUR SCHOOLS.’” (Am. Compl. ¶ 6.)

Defendant Local 74, with its principle offices in Long Island City, New York, had a
collective bargaining agreement with the District. Chesney was a member of Local 74.

The N.C.C.S.C., located in Hempstead, New York, was “united in interest with the New York State Civil Service Commission.” (Id. ¶ 10.) Such is Plaintiff’s description of the various defendants in this dispute.

Plaintiff worked for the District from “October 3, 2004, to May 17, 2004,”2 as an “ablebodied
man.” (Id. ¶ 13.) On March 18, 2004, the Board approved Plaintiff’s permanent
appointment as a “cleaner” at the Robert W. Carbonaro School, effective April 5, 2004. This
approval conferred upon Plaintiff the designation of a “permanent” civil service employee.

The appointment was the result of the successful completion of Plaintiff’s probationary appointment.

On May 17, 2004, Chesney was “breaking down” the gym, which had been the location
of a school event the night before. While he was performing this task, he felt a “pop” in his back,
and could “barely get out of bed the following day.”

(Id. ¶¶ 22, 23.) “Nevertheless, plaintiff Chesney traveled to the District and duly filed an accident report in accordance with District policy.” (Id. ¶ 24.)

Plaintiff missed several days of work due to the injury, and “learned he had a herniated disc, which was causally related to the accident of May 17, 2004.”

(Id. ¶ 26.) Plaintiff submitted a Worker’s Compensation claim on May 25, 2004, and he did not return to his job “for a period of time.”

(Id. ¶ 29.) At this point, the Amended Complaint is somewhat vague and difficult to follow. It appears that Plaintiff did return to work shortly thereafter, but “[o]n or about June 9, 2004, he left work early and did not return at that time due to his disability.” (Id.

¶31.) On June 11, 2004, Defendant Haramis, “plaintiff’s co-worker and shop steward contacted
Superintendent Fale to ascertain whether or not Plaintiff was driving a cab on June 11, 2004.”

(Id. ¶ 49.) The District and Superintendent Fale instructed Defendant Broceaur, Supervisor of
Maintenance, to “initiate an ‘investigation’ of Chesney’s second job as a taxi driver.”

Upon confirming that Plaintiff was indeed employed and working as a taxi driver, while he was
receiving Worker’s Compensation benefits, Superintendent Fale held a meeting with a union
representative, a co-worker, Principal Conte, and Plaintiff. Superintendent Fale said to Plaintiff:

You were seen driving a cab at about 6:30 p.m. on June 11; you cannot be employed or receive any income while receiving workers’ compensation benefits; that is insurance fraud, working your second job and being out sick while I’m paying for overtime is theft of services.

We are terminating you, but if you resign right now, you will leave with a good recommendation, clean record, and I will allow you to pursue your compensation claim.

(Id. ¶ 58.) Plaintiff was terminated shortly thereafter.

Without filing an EEOC complaint, an action with any corresponding state agency, or a
notice of claim, Plaintiff brought the present lawsuit in New York state court on fourteen causes
of action, and seeking $26,000,000.00 for “pain and suffering, inability to obtain critical surgery,
and damages as yet undetermined.” (Id. ¶ 64.)

The suit was first filed in the Supreme Court of the State of New York County of Nassau on June 12, 2005.

District Defendants subsequently removed the suit to this court on November 1, 2005, on the basis of federal question jurisdiction.

Defendant Local 74 submitted an answer on November 4, 2005.

Plaintiff filed that Amended Complaint with this Court on December 8, 2005. District
Defendants moved to dismiss the Amended Complaint. Defendant Local 74 moved separately to
dismiss the claims against it, but in so doing announced its rejection of the Amended Complaint
as untimely, as it was filed without leave after Defendant Local 74 had filed its answer.

(See Def. Local 74’s Reply Mem. at 5-6.) Nonetheless, all Defendants’ moving papers address the claims against it in the Amended Complaint, and the Court addresses the following opinion to the
Amended Complaint. Plaintiff opposed both motions. ""

A Lot of Folks are Out there Googling "Cardio Cocktail Sucks" and "Cardio Cocktail Scam" - So I Thought I Would Give Them a Cardio Cocktail Scam to Look at.

My name is Crystal L. Cox and I am an Ex - Formor International Distributor. I was taking Cardio Cocktail a few years back, and tried to build an online business selling Cardio Cocktail, however Formor International had different ideas and prevented me, at every turn in the road from make money selling Cardio Cocktail on my Cardio Cocktail Websites.

I still stuck in there selling Cardio Cocktail with Formor International even though they were constantly hurting my Cardio Cocktail Business and keeping me from succeeding at Selling Cardio Cocktail.

When Formor International Brought Dan Hobbs on board it became and even worse nightmare trying to do anything to get ahead. Plus Formor International Changed the Cardio Cocktail Pay Plan. Dan Hobbs is a very discriminating and judgemental man and even did a Formor International Video that was directing hate at people he did not "approve" of. It was a real turn off, that on top of the Cardio Cocktail pay Slash...

Well the Cardio Cocktail Scam was becoming undeniably obvious.

We were on top of the search engines for "Cardio Cocktail" within 5 weeks of joining Formor International selling Cardio Cocktail. Formor International did not like that so they quietly broker our Cardio Cocktail links and re-directed our Cardio Cocktail internet Traffic.

When We Complained to Formor International about our Cardio Cocktail links and told Formor International what was happening when our customers clicked on our Cardio Cocktail links.. well
Formor International would Flat Out Lied and tell us that we were not allowed to have Cardio Cocktail websites and that no one at Formor International had a Cardio Cocktail Website.

Yet Our Upline and their Upline certainly did have a Cardio Cocktail Website and even advertised their Formor International Cardio Cocktail in Google Adwords.

Apparently it was a Cardio Cocktail Secret ... like Not being able to sign up your spouse but they do anyway. Turns out the Real Cardio Cocktail - Formor International secret was they steal your BV, another words your Cardio Cocktail Money.

Formor International steals your internet traffic in selling Cardio Cocktail and breaks your Cardio Cocktail links constantly.

If you Complain about Formor International's Cardio Cocktail Scam - they break out the good ol' policies and procedures to say that your not allowed to have a Cardio Cocktail website, yet Formor International knows full well that ALL the Formor International Distributor's do in Fact have a Cardio Cocktail Website.

Formor International just lets their Formor International Distributor's get lots of money and business coming in and then they pull out the Lord Formor Rule Book and Bring the Hammer Down, meanwhile they let you build up an awesome Cardio Cocktail business for them, You Lose... and 3 years later at Formor International - this Cardio Cocktail Scam is still going on.

Since quitting Formor International in Selling Cardio Cocktail and Yes I did Quit Selling Cardio Cocktail by Formor International but Formor International would not release me.. so I put up FormorSucks.com and they fired me.. gee Can't Quit but they love to Fire Their Formor International Distributors.

Anyway since quitting selling Cardio Cocktail I found out that Dr. Joseph Prendergast left Formor International years ago because he found out that Formor International did not really put 5 Grams of L-Arginine in Cardio Cocktail, as Formor International stated that was and is in Cardio Cocktail.

Cox in his emails to her.. that he was given advice from his own attorney that he better jump in bed with Kevin Padrick.

What if the ONE or ALL of the Summit Principles ALL ALONG or at ANY point over the last 15 months... did actually get into bed with "Kevin Padrick" - "Obsidian Finance Group"?

What if the Umpqua Lawsuit was staged somehow to make Obsidian Really Look outside of it all?

Why Did Mark Neuman NOT send me a link to the breaking news on the Summit Settlement on March 4th, and well Neither Did Bankruptcy Whistleblower Stephanie DeYoung as far as that goes. You can see that he was like.. Yeah Crystal, and even fed me stuff, and then after the Settlement it was Screw you Crystal.. and then he went to deal with STOPPING the Friendship I had built with his Bankruptcy Whistleblower daughter Stephanie DeYoung, Why?

Makes no sense really, I had never even met her.. and was certainly not brainwashing her. He fed me information on the family and all the relatives and then convinced her mom that I knew to much about everybody.. yet he was the one who told me.. you can see in eMails..

Since you now have an email address at the OAG, presumably with office space, staff, and expenses paid with tax dollars (courtesy of Andrew Cuomo), I will be resending the three emails I previously sent you at your private law office on 3/12/10 to your OAG email address.

As to your own lack of monetary compensation, the financial arrangement you made with Andrew Cuomo to work pro bono appears to be a generous offer to an uninformed public and a sleeping and non-inquisitive NY press.

I am not in either category. Therefore, I am insisting that you accept $1.00 from NYS funds--not a penny more or less--in payment for your services as independent counsel to the OAG. Informed individuals and lawyers know the legal significance of either offering or accepting state funds--even $1.00--in a situation rife with the possibility of potential criminal charges later being sought.

I would also request that you go on public record that you have accepted $1.00 as salary to serve as independent counsel. Andrew Cuomo's refusal to offer $1.00 from state funds and your refusal to accept $1.00 from state funds could be very telling re: what you knew before agreeing to be independent counsel and what Andrew Cuomo expects from you as independent counsel.

My instincts are hardly ever wrong.

Andrew Cuomo has already gone on public record claiming that his appointment of you as independent counsel was to insure the public of the integrity of the investigation. I believe otherwise--that he had an ulterior and improper motive for appointing you.

Andrew Cuomo is first and foremost a politician and politicians are infamous for granting favors now and collecting payment later. Andrew Cuomo's appointment of you can reasonably and legitimately be viewed as his collecting a delayed payment that was still owed to his father by you..

Governor Paterson has known for some time about the Cuomo family's dirty little secrets. He may be legally blind, but he's not dumb. Rest assured, he knew exactly what he was doing when he asked Andrew Cuomo to investigate any charges against him.

I would venture that he's not laying awake at night worrying whether there will be any criminal charges brought against him.

As to your own predicament and for your own consideration, I acknowledge that claims of appearance of impropriety/conflict of interest do not arise simply out of mere friendship. However, your relationship with the Cuomo family goes well beyond that standard, as even you should be willing to admit. To be blunt, your professional standing and social status is undeniably associated with Mario Cuomo.

Who would Andrew Cuomo be if his father wasn't Mario Cuomo?

Like most attorneys, he would most likely be toiling away in relative obscurity at some non-prestigious law firm or employed by some government agency in an equally obscure position--similar to the career path you possibly would have suffered except for the same Mario Cuomo.

Please don't take this last comment as a personal insult--it's just a recognition of reality, even for myself. There is always someone more intelligent, more capable, more insightful, more principled, more connected, etc. when it comes to filling any position.

Given the Cuomo family dirty little secrets, doesn't it seem strange to you that Andrew Cuomo would ask you to be independent counsel when there are thousands of NY lawyers with prosecutorial experience who have no indebtedness to the Cuomo family or connection to any of NY's hidden political scandals?

Doesn't instinctively knowing that Andrew Cuomo will very possibly expect you to remain silent about crimes and misconduct not connected to David Paterson but linked to the OAG and the NYSP cause you any angst?

Wouldn't any deliberate decision to look the other way be in violation of certain provisions of the Lawyer's Code of Professional Conduct? As a former chief judge for NYS who has written books on ethics, you very likely know this code forward and backward.

Additionally and perhaps irrelevant, you most likely are aware of Christine Anderson's lawsuit claiming that the disciplinary committee for the 1st department of the NY OCA whitewashed and covered up charges made against politically connected attorneys. If you recall, this suit was filed during the last years of your service as chief judge.

Furthermore, any future claim by you that you were only appointed to investigate the Booker matter and World Series tickets matter and, therefore, can ignore any damaging information re: your main benefactor, his son, and others would be subject to justifiable ridicule.

I would hope that you, as a former NYS chief judge, would hold yourself to the highest ethical standards possible and won't resort to "lawyer speak" in defense of your actions if ever questioned.

Andrew Cuomo, and not me, has placed you in a compromising position that should mandate your own withdrawal as independent counsel.

It would be naive to believe that attorneys representing various targets of your investigation who have already been sent the three emails you were sent would not want concessions for their clients or input into any of your findings in return for their own silence.

The fact that each side knows of the Cuomo family's dirty little secrets need not be verbalized, knowledge alone being sufficient enough to cast doubt on the credibility and integrity of any investigation.and its findings.

It would seem to me that there is only one available option if you wish to continue as independent counsel, i,e., to make a full and public disclosure of the compromising position Andrew Cuomo has chosen to put you in--something, I doubt, you would be willing to do.

In the event that you are not a true liberal like myself who can stand on principle, this insignificant nobody and ordinary US citizen would offer this advice: Use your Jimmy Choo high heels and presumed arthritic knees to run as fast as possible to the nearest OAG exit. Prince Andrew, who would be king, is not worthy enough for you to risk the potential damage to your own public reputation. ""

Eric Kolchinsky was an executive at Moody's, the credit rating company, when he called a top official at the Securities and Exchange Commission in September to warn that his firm might be violating securities law. He reported that Moody's was blessing mortgage-backed investments that it knew were dangerous, according to a person familiar with the conversation.

The SEC official assured Kolchinsky that someone from the agency would call him back shortly. But the call never came, Kolchinsky later told congressional investigators who were examining how the credit rating industry's failures contributed to the financial crisis. He had gone to Congress after losing patience with the SEC.

Kolchinsky is one in a series of whistleblowers who in recent years tried to tip off the SEC to potential wrongdoing, only to be ignored, misunderstood or left to wonder whether they were being listened to. The SEC has no system in place to guide how officials should handle tips and complaints from outsiders, making it difficult for investigators to take advantage of an invaluable source of information.

This failure helped to continue two of the most celebrated frauds of the last decade for several years, potentially costing unwitting investors millions of dollars. Countless others may have been left vulnerable to shysters because of warnings that went unheeded.

Since SEC Chairman Mary L. Schapiro took office last year, she has said that fixing the holes in the process for handling tips and complaints has been a top priority. But improving the way hundreds of thousands of tips are analyzed and pursued has proven difficult.

The SEC's enforcement division got back in touch with Kolchinsky about his allegations only after he told the story publicly to a congressional committee last fall, according to a person familiar with the matter.

The SEC said it responded to Kolchinsky's concerns but declined to provide details or to say how fast it did so. Moody's said it examined his allegations and found nothing improper.
The SEC has a haphazard, decentralized system for analyzing outsider information.

Tips arrive by phone, mail and e-mail to officials throughout the agency -- investor education to enforcement divisions. A study commissioned by the SEC last year and conducted by Mitre, a nonprofit group that does research for the federal government, found that the SEC lacks technology to analyze tips and complaints, as well as cohesive policies for what officials should do when they get information.

Whistleblower complaints are one of the main ways that investigators should be tipped to wrongdoing, SEC officials say, along with inconsistencies in financial filings and alerts from financial exchanges about suspicious trading patterns. But the SEC lags behind some other federal agencies in handling tips.

The Internal Revenue Service, for instance, pays reward money to whistleblowers who provide credible information about tax fraud. The Federal Trade Commission has set up a call center for tips and complaints.

On top of structural problems at the SEC, agency officials individually made mistakes in handling several recent cases, sometimes violating agency rules.

Members of Schapiro's management team said they recognized problems with the system for handling whistleblowers shortly after taking over.

"There was no uniformity to it. Every division and office had its own system of recording, tracking or handling tips and complaints. That system was pretty rudimentary," said Steve Cohen, the official tasked by Schapiro to overhaul the agency's tips, complaints and whistleblower program. "We're already working to acquire and deploy technology that centralizes all of the agency's tips and complaints so they can be sorted, reviewed, analyzed and tracked."

No shortage of witnesses

The SEC's struggles were underlined over the past two years with the revelation of two huge Ponzi schemes.

In the case of Bernard L. Madoff, whistleblowers had provided credible information to various SEC units for years.

The most prominent of these informants, a Boston financial analyst named Harry Markopolos, contacted the enforcement division on numerous occasions, according to the SEC's inspector general.

In one instance, Markopolos provided a detailed explanation of why Madoff's business was probably a fraud. Enforcement officials listened, but they dismissed him in their internal discussions. Two former enforcement officials told the inspector general that they discounted Markopolos's information because he was not an insider in Madoff's company.

Then, a few months after the Madoff scheme exploded into the headlines, the SEC exposed a second large Ponzi scheme, run by R. Allen Stanford. But that happened five years after an insider went to the SEC, warning that Stanford might be conducting a fraudulent business.

Leyla Wydler had been a vice president at Stanford's Houston-based company when she first started asking her supervisors tough questions about what the firm did with clients' money, according to her testimony before Congress last year. Her superiors were evasive, and she ultimately was fired.

After that, she went to the National Association of Securities Dealers, a private industry regulator overseen by the SEC. The NASD dismissed her concerns. Then in September 2004, she contacted the SEC's Fort Worth office, according to her congressional testimony. She followed up with a letter to an official there, questioning whether clients' money had been invested in the way Stanford said.

She never heard from the SEC again -- until January 2009, days before the SEC finally filed a case against Stanford, according to her testimony. The agency wanted to know more about her allegations. An inspector general report from June 2009 said the SEC began looking into Stanford years earlier but struggled to build a case against him.

Turning in the Tipster

In one case, it was the SEC that blew the whistle on Peter Sivere, an informant.

Sivere worked in the compliance office of New York investment bank J.P. Morgan Chase. As part of a team helping the bank furnish documents related to a 2004 SEC probe into suspected illegal trading, he found an e-mail that he thought was incriminating.

According to a subsequent report by the SEC inspector general, the e-mail said J.P. Morgan was knowingly providing hundreds of millions of dollars in credit to a firm "in the business of day trading mutual funds" -- which is illegal.

Sivere asked his superiors if this e-mail had been turned over to the SEC but did not get an answer. Instead, he was taken off the SEC project, according to the inspector general report. Sivere accessed his superiors' e-mail accounts to retrieve relevant e-mails, then contacted the SEC. He told the agency that he had relevant documents and asked whether he could receive a reward. He was told he was not eligible, but he turned over the documents anyway.

Sivere informed J.P. Morgan that he had contacted the SEC.

The company fired him, partly on the grounds that he had "sought payment from the SEC to provide documents and information to them outside of the normal scope of their investigation," according to a letter company lawyers wrote defending his dismissal. J.P. Morgan declined to comment for this article.

Sivere was shocked to learn that J.P. Morgan knew he had inquired about a bounty. He had been promised that his discussions with the SEC were confidential.

An SEC internal probe found that an investigator working on the case disclosed Sivere's information to J.P. Morgan's lawyers, violating the agency's confidentiality rules. The inspector general recommended that the SEC official who made the disclosure be referred for disciplinary action. None was taken, according to agency documents.

Retraining the Watchdog

Cohen, who is overhauling the SEC's whistleblower practices, said a database, jury-rigged from existing technology, will be in place this month to centralize all tips and complaints. Officials said that by the end of 2010, they hope to develop technology that would not only centralize the data but also automatically analyze them for patterns to help officials prioritize cases.

Currently, the SEC is setting procedures for responding to whistleblowers and is creating an office of market intelligence to coordinate how the agency's various units respond to tips.

The agency also wants to be able to reward whistleblowers, which it can only do now for insider-trading cases. The SEC has requested that Congress pass legislation giving it the ability to offer financial rewards to people who provide evidence of violations of securities law. ""

By this date eight years ago, the then-new U.S. attorney in Philadelphia, Patrick Meehan, had been on the job almost four months, after being confirmed by the U.S. Senate in September 2001.

Now, almost a year into President Obama's term, there is not even a nominee for the post. And the appointment of a new U.S. attorney, which is considered a plum assignment, is not believed to be imminent, sources familiar with the process say.

Some blame the ambling pace on unusual political circumstances.

Traditionally, the state's senior senator of the president's party, in this case Sen. Bob Casey, makes a recommendation to the White House. However, when longtime Republican Sen. Arlen Specter switched parties last April and became a Democrat, that complicated the selection process, sources said.

Sources said that Casey and Specter could not agree on a single candidate to recommend to Obama, who makes the formal nomination.

An initial screening process last summer produced a list of 20 names for U.S. attorney here.
With Casey and Specter unable to settle on one, several names were jointly submitted to the White House last month, sources said.

A source with knowledge of the matter declined to say how many names were submitted or to identify them.

Among those thought to be on a short list, sources said, are Cheryl A. Krause, a partner at Dechert LLP; James J. Eisenhower, a partner at Schnader Harrison Segal and Lewis LLP; and J. Huntley Palmer of JP Morgan Chase & Co. All were once federal prosecutors here.
Krause, Eisenhower and Palmer declined to comment for this story.

Justice Department spokeswoman Melissa Schwartz would neither confirm nor deny whether the Justice Department had received any names from the White House or begun vetting any candidates.

Larry Smar, a spokesman for Casey, said, "As of right now, I don't have a sense of when a nomination will be made."

A spokeswoman for Specter declined to comment.

The U.S. attorney here - one of 93 in the country - brings criminal and civil actions on behalf of the federal government in the nine-county area of southeastern Pennsylvania.

The office has prosecuted a number of high-profile public-corruption cases in recent years, including that of former state Sen. Vince Fumo and former City Councilman Rick Mariano.
Former U.S. Attorney Meehan resigned his post in July 2008. The current U.S. attorney, Michael L. Levy, was named by the Justice Department on an interim basis last May to serve as U.S. attorney until Obama nominated a successor.

When the White House receives a senatorial recommendation, it is sent to the Justice Department for vetting.

Schwartz said the vetting process - which includes background checks and interviews by political and career officials - can typically take up to three months.
Once a finalist is determined, that person is interviewed by Attorney General Eric Holder, who makes a recommendation to Obama.

After Obama makes the formal nomination, it is sent to the Senate for confirmation.
And there's no certainty that a nominee - given the current partisan rancor in the Senate - will win timely confirmation.

Case in point: New Jersey's new U.S. attorney, Paul Fishman, was recommended to Obama last February and was nominated by the White House in May, but not confirmed by the Senate until Oct. 7.

According to the Web site Main Justice, an independent news organization that covers the Justice Department, 31 new U.S. attorneys have been confirmed by the Senate, 12 more have been nominated by Obama and another 23 names have been recommended by senators to Obama for U.S. attorney posts throughout the country.

None of those confirmed or nominated to date are holdovers from the Bush administration, although two Bush holdovers have been recommended to Oba-ma. ""
