They are from Section 3, the religion section of Article VIII, the Bill of Rights.&amp;nbsp;This last sentence of Section 3, which addresses education, is taken directly from a statement in the Northwest Ordinance, passed by the Continental Congress July 13, 1787, which provided the framework for the admission of Ohio to the Union.&amp;nbsp;It is the contention of this paper that these words express widely-held attitudes in regard to church and state, as well as religion and education, in the early days of the United States... Equal Employment Opportunity Commission&lt;/em&gt;.&amp;nbsp;The case involved a fourth-grade teacher, Cheryl Perich, suing her employer, a church-based school, alleging retaliation for having asserted her rights under the Americans with Disability Act (ADA).&amp;nbsp;The Equal Employment Opportunity Commission filed the original suit, and the teacher intervened as a party. In the lower federal courts Hosanna-Tabor raised the &amp;ldquo;ministerial exception,&amp;rdquo; which recognizes that under the First Amendment religious organizations have the authority to select their own ministers&amp;mdash;which necessarily entails not just initial hiring but also promotion, retention, and other terms and conditions of employment. Over the last forty years the ministerial exception has been recognized by every federal circuit to have considered it. In 2000 Californians passed an initiative statute (Proposition 22) reaffirming that understanding. The California legislature then enacted a law authorizing domestic partnerships for same-sex couples that offer the same legal treatment as marriage under a different name. In 2008 the California Supreme Court nullified Proposition 22 and construed the state constitution to mandate that marriage be redefined to be available to same-sex couples. Italy" width="120" height="150" style="float: left;" /&gt;&lt;/a&gt;Religion can be an intensely personal activity. However, the idea that religion is &lt;em&gt;only &lt;/em&gt;a private, personal devotion with no public political consequences is relatively new. For many nations in Europe, religion, in particular Catholicism, exerted an important influence over government and politics for centuries. The remnants of this influence still remain in anthems, oaths, and ideologies, not to mention architecture. However, with the rise of an ideology of &amp;ldquo;strict separation of church and state&amp;rdquo; in the European Union and the Council of Europe, it has been unclear how countries may incorporate their religious influences and histories into public life and expression. The case of &lt;em&gt;Lautsi v. Italy&lt;/em&gt; in the European Court of Human Rights illustrates this struggle between secular ideology and religious faith and affiliation in the European context. The ultimate decision in the case acknowledges that &amp;ldquo;freedom of religion&amp;rdquo; need not result in, as the late Richard John Neuhaus put it, the naked public square. Speakers at our conference on November 4 addressed the prevalence of trends concerning hate speech and blasphemy laws, and whether they pose a serious threat to the freedoms of citizens of the West, including Muslims, as well as people in OIC member states. This keynote address by former member of the Danish Parliament Naser Khader on "Where Are the Muslim Moderates?" was followed by commentary from Ms. Manda Zand Ervin of the Alliance of Iranian Women and the American Islamic Leadership Coalition. Mr. David B. Saunders&lt;/a&gt;&lt;br /&gt;&lt;p&gt;Before the European Court of Human Rights (&amp;ldquo;ECHR&amp;rdquo; or &amp;ldquo;the Court&amp;rdquo;) delivered its decision in the case of &lt;em&gt;A. B. and C. v. Ireland&lt;/em&gt; (&amp;ldquo;&lt;em&gt;ABC&lt;/em&gt;&amp;rdquo; or &amp;ldquo;&lt;em&gt;ABC v. Ireland&lt;/em&gt;&amp;rdquo;) on December 16, 2010, there had been widespread speculation as to the potential breadth of the decision and its implications for the sovereignty of nation states that are members of the Council of Europe. These small, sometimes ancient, sometimes immigrant, sometimes newly converted communities are the &amp;ldquo;canaries in the coal mine&amp;rdquo; of human rights. Attempting to exercise the freedoms of the individual human conscience guaranteed in universally recognized international covenants, Egyptian Copts, Venezuelan Jews, Ahmadiyya Muslims, Pentecostal Christians, Bahai, humanist non-believers, and numerous others in many lands suffer imprisonment, intimidation, denial of sustenance and employment, and death. Conflicts arise over the treatment of minorities: conflict prevention and conflict resolution often turn upon the credible redress of their grievances. The regulation would require employers, with an exception for certain religious organizations, to provide to employees preventive care, including domestic violence screening and breast-feeding support, but also including contraception, some of which acts as an abortifacient. The Organization of Islamic Cooperation (OIC) within the United Nations and in the European Union has been a visible proponent of hate speech restrictions and other measures. Meanwhile, Secretary of State Hillary Clinton has announced that the U.S. government will sponsor a conference with the OIC on how to implement a U.N. resolution combating "negative stereotyping" of Islam, the focus of a recent U.N. resolution. Speakers at our conference on November 4 will address the prevalence of trends concerning hate speech and blasphemy laws, and whether they pose a serious threat to the freedoms of citizens of the West, including Muslims, as well as people in OIC member states. These small, sometimes ancient, sometimes immigrant, sometimes newly converted communities are the &amp;ldquo;canaries in the coal mine&amp;rdquo; of human rights. Attempting to exercise the freedoms of the individual human conscience guaranteed in universally recognized international covenants, Egyptian Copts, Venezuelan Jews, Ahmadiyya Muslims, Pentecostal Christians, Bahai, humanist non-believers, and numerous others in many lands suffer imprisonment, intimidation, denial of sustenance and employment, and death. Conflicts arise over the treatment of minorities: conflict prevention and conflict resolution often turn upon the credible redress of their grievances. Mart&amp;iacute;nez" width="110" height="95" align="right" /&gt;&lt;/a&gt;The Federalist Society&amp;#39;s Religious Liberties Practice Group, the Becket Fund for Religious Liberty, and the Cato Institute present a panel discussion on &lt;em&gt;Christian Legal Society v. Mart&amp;iacute;nez&lt;/em&gt;. In 2004, the Christian Legal Society filed suit against the University of California Hastings College of the Law after being denied recognition and the benefits of recognition, including student activity fee funding, because the chapter requires its officers and voting members to adhere to the CLS Statement of Faith.&amp;nbsp; In its lawsuit, CLS alleges that UC Hastings&amp;#39; exclusion of its chapter violates, among other constitutional rights, CLS&amp;#39; right of expressive association and CLS&amp;#39; right to be free from viewpoint discrimination.&amp;nbsp; The district court ruled in favor of defendants, and a panel of the Ninth Circuit Court of Appeal, in March 2009, affirmed the district court&amp;#39;s opinion.&amp;nbsp; On December 7, 2009, the U.S. Supreme Court granted CLS&amp;#39;s petition for certiorari, and oral arguments in &lt;em&gt;Christian Legal Society v. &lt;p&gt;Church autonomy issues are at the forefront of contemporary debates in church/state law.&amp;nbsp; Such issues arise whenever the government seeks to impose a regulatory burden on a church or any religious organization.&amp;nbsp; Often the regulatory burden comes in the form of generally applicable legislation that is facially neutral with respect to religion.&amp;nbsp; The regulation may also take place through developments in the common law, such as claims sounding in tort, contract, trust, or real property.&lt;/p&gt;&lt;p&gt;To explore these issues in detail, the Federalist Society has gathered some of the leading law and religion scholars in America.&amp;nbsp; Among the topics addressed at the conference will be the theological and historical roots of church autonomy in both the Catholic and Protestant traditions, the constitutional basis for the church autonomy doctrine in the First Amendment, and particular applications of church autonomy in torts, employment, and other areas of law.&lt;/p&gt;&lt;img src="http://feeds.feedburner.com/~r/ReligiousLiberties/~4/BJsSdc1rlj4" height="1" width="1"/&gt;</description>

Carhart: Its Aftermath and Implications for Abortion Regulation and Jurisprudence"&gt;&lt;img src="http://www.fed-soc.org/imgLib/20070607_ultrasound.jpg" border="0" alt=" " title="ultrasound" width="96" height="78" align="left" /&gt;&lt;/a&gt;On April 18, 2007, the Supreme Court ruled that the Federal Partial-Birth Abortion Ban Act of 2003 does not violate a constitutional right to abortion. The 5-4 decision in the case, &lt;em&gt;Gonzales v. Carhart,&lt;/em&gt; upheld, for the first time, a law that bans a specific abortion method, even though it does not contain an explicit exception for considering the mother&amp;rsquo;s health. The action now moves to the states, where many legislatures are expected to consider new abortion restrictions and strengthen old ones. This whirlwind of action in state legislatures will likely produce accompanying activity before the nation&amp;rsquo;s courts, since new abortion restrictions are likely to be challenged. Join our panel of prominent experts as they discuss the recent ruling and examine how it might ultimately affect the abortion debate as well as abortion jurisprudence.
