Ever since Barack Obama declared himself a Supreme Court Justice and decided that he would no longer defend federal law he disagreed with, the Defense of Marriage Act, or DOMA has been defended by private attorneys tapped by Republican lawmakers. This post is not about your position or whether you agree with this law or not. If you disagree, there are channels to change that if the will exists. This post is about the integrity of the federal government, the responsibilities of the Justice Department, and especially the activist judges, who’s transparent decisions are so weak that I can easily tear them apart…Like I’m going to do right now.

The First Circuit Court in Boston <a href="http://news.yahoo.com/blogs/lookout/defense-marriage-act-unconstitutional-federal-appeals-court-rules-175257996.html" target=_blank">has ruled that DOMA is unconstitutional, but not for the reasons you might think-on the surface that is. Their logic is that the feds have no right to interfere with state law, although they themselves can apparently interfere with any law they want. This is the same court that blocked the deportation of a gay man so he could stay shacked up with his American partner. The ruling was despite howls of protest from ICE. Hmmm, can’t deport a gay guy in love, nor is DOMA constitutional. I see a pattern here.

Here’s where the First Circuit shoot themselves in the proverbial foot. DOMA doesn’t ban gay marriage, it just states that gay couples are ineligible for federal benefits as a heterosexual couple would be. Well…I see no interference with state law there. I see the feds doling out benefits as they see fit. Using the First Circuit’s logic, it is the feds that must comply with state laws. You are correct, that is the Constitution backasswards, but unless opponents have a truckload of time and money to bring this thing to the Supreme Court-assuming the court would even hear the challenge, the decision will stand. The court didn’t address the constitutionality of gay marriage itself though, just the states rights issue. I agree that the feds need to stay the hell out of states’ business, but they have no obligation to conform to the laws of individual states. The First Circuit begs to differ, although in the end they admitted they were full of crap and were not even pretending they were the final word.

The judges admitted that the decision rested on navigating difficult and thorny precedents. “Only the Supreme Court can finally decide this unique case,” they wrote.

Then why make a decision at all? Using the First Circuit’s logic, medical marijuana should be legal because some states have passed laws legalizing sale and distribution. How about immigration? California has basically legalized illegal aliens, but the feds stand in the way of full legalization. Americans have a legal right to work in the country, but illegal aliens do not. Is that unconstitutional as well? Is every special interest beef unconstitutional? I don’t know, let somebody else decide. I’ll just decide whatever I want and make you work to overturn it.

So we have the Obama regime refusing to enforce federal law, and an activist court ruling that the feds must capitulate to state laws that they agree with. We’ve heard the term broken system thrown around in recent years, and if this isn’t an example of that I don’t know what is.

Again, this isn’t about where you stand on the issue. This post is about the process of challenging a statute and the responsibilities of the feds and the courts. Both have dropped the ball here, and as a result the average citizen has absolutely no power and no say as to how their government operates in this case.

The demographic time bomb has already been set, and Republicans are seeing the writing on the wall. If they’re lucky Mitt Romney will squeak by Barack Obama in November, although it won’t be easy with the illegal alien vote in Obama’s corner. Republicans want to change that, and thus accelerate the demise of the United States.

The DREAM Act has died numerous times in congress for one simple reason: The voters didn’t want to reward illegal behavior. The government has already admitted they can’t even keep track of who is here legally, much less illegally. In fact, a Homeland Security Inspector General has warned that the system in place just couldn’t handle an amnesty tidal wave. But some Republicans see what the new America is going to look like, and they want to get on the bandwagon while they can. Their fatal mistake is thinking that immigrants-and many of their offspring have such an overwhelming allegiance to the United States that it will be business as usual politically. We can see already that isn’t going to be the case.

Freshman congressman David Rivera has introduced a bill that would offer a path to citizenship amnesty to those kids that were allegedly brought to the United States before age 16. …And a few other hoops to jump through.

His bill, which he deemed the Studying Towards Adjusted Residency Status Act, or Stars Act, would apply to students who were brought to the U.S. before age 16, who got their diploma, kept out of trouble and were accepted to a four-year college or university.

Remember, the DHS IG said that the system is cracking at the seams now. Now Rivera is talking amnesty to those who can use any number of ways to “prove” they’ve been here all along. Those kids shouldn’t have gotten a diploma, and certainly shouldn’t have been accepted at any college. We know that universities around the country consider race a major factor when accepting applicants. Welcome to class. Si se puede. That means that an American kid will not get in. Colleges aren’t a bottomless pit. There’s a limit as to how many students can enroll in a given year.

But this isn’t really about school. This is about pandering for the Hispanic vote-yes, don’t think it’s about illegals in general-it is not. We go back to exploding birth rates, and indeed, this is the future of America. Unfortunately, many of those that rise to the top in this community, are anti-American, pro-Mexican socialists. We see how that is working out down South. We see it here as well. Expect more of it.

There are those in this country that want to see America become something else. We saw that with the occupods, we see it in the White House, we see it in our schools, the media-and we see it coming across the border. The numbers are here already, and now we see the Republicans start to merge with the left in an effort to prolong their terminal lives. When sovereignty goes, the country goes, and now the Republicans want to speed up the process through legislation.

And why not? The reconquista is the future of this country, not flag waving Americans. The numbers are already in place. Nobody is going to pop out four or five kids in a declining economy to counter the surge in folks that have no allegiance to the United States. Well, no Americans anyway.

On the verge of bankruptcy, illegal aliens running free-including vicious gang members that comprise 95 percent of all murder warrants in the city, crumbling streets, a grossly ineffective school system that is hopelessly in debt, the highest unemployment rate in the state and traffic snarls that are second to none, and the Los Angeles City Council has decided to take up an issue they deem critical. The scourge of plastic bags is in the crosshairs of the city council, and as a result, the new green movement is going to do away with the old green movement.

The Los Angeles City Council has passed a ban on plastic shopping bags citing the bags comprise up to 30 percent of waste in Los Angeles. Refuse experts put that number at 0.3 percent. That’s point 3 not 30. Kind of a strange number considering 99.9 percent of my trash goes into those same bags. It doesn’t matter. The green goons have once again discovered their inner nanny and have decided that paper bags will be used instead.

You are correct. Not that many years ago, these same buffoons were crying save the trees. Well, we saved them, and now those same trees will theoretically end up as grocery bags. I say theoretically, because Chinese companies are already lining up to offer their product to Los Angeles markets. Council members are hoping that markets will purchase made in USA bags. Ironically, there was a plastic bag manufacturer in town, but those folks will now lose their jobs because of this action. The ultimate goal is to have Angelenos bring their own bags to market and pack their own groceries. As an incentive, the paper bags will cost shoppers 10 cents a piece. Hit ‘em where it hurts.

Used, filthy, even diaper bags will now be setting on the same counter we will be placing our groceries. Whether that was an unintended consequence or even bandied about at all is anybody’s guess. At the same time-as I’ve said before, this is what the people want. These are the folks that are voted in again and again. They know what they’re getting, but their either don’t vote at all, or re-install the same bunch of jerks that come up with ideas like this.

This is the same city council that passed a resolution condemning violence against Muslims, even though that demographic enjoys even fewer hate attacks than American born Christians. They condemned Arizona for passing SB 1070, they passed Special Order 40 that prohibits police from inquiring about immigration status, they stepped in to defend illegal alien hotel workers in the city when they felt the illegal weren’t getting a fair shake working their American jobs. And the list goes on.

Just one more day among the kooks, crackpots, socialists, nanny’s and self-destructive boobs in the once great state of California.

If you recall, the so-called Arab spring started with a spark in Tunisia, and like a virus quickly spread across the Middle East. Barack Obama couldn’t hide his giddiness as formerly suppressed hardline Islamists were now free to spew their vituperative rhetoric. Anyone with even a little common sense could see that this wouldn’t end well, and we can see that happening now. What Obama didn’t plan on was Islamists telling the world what they really think of him.

Shouting Allah akbar, the rallying cry of Islamists around the globe, thousands of Tunisian Sufi’s rallied in the name of…apprarently the Islamic caliphate that has been the plan since the 10th century. They took their shots at the Jews, and also at Barack Obama. If you thought slavery was abhorrent in this country (and it was), it pales in comparison to what happened in the Middle East, and apparently, their view of blacks is the same as it has been for centuries. In the name of political expediency, Obama is passing himself off as a black man, hardly post racial, but then, he never intended to be, if his auto biography is an indicator. whether it is what he is, or what he would like you to think he is, the Salafi’s have a response.

“Let us all cry ‘Allah Akbar’ together!” a speaker cries to the roaring crowd, “so that Obama the ape can hear us! All together now!”

American prisons are full of young black men converting to Islam, theoretically as an alternative to white Christianity. Do they know the history of Islam? Do they know that it is Muslims that wreaked the most havoc on the black race?

I venture to guess they do not know the history, and Barack Obama is either in the same boat or thinks he can rewrite history. Guess again Barry. These clowns have been at this for centuries, and if you think you can just Johnny come lately and liberate the closed minds of Islam, well…you got your response from the Salafi’s. They hate you Barry, and they hate us. Give and inch and they’ll take a mile. You see what that mile looks like. That’s just the tip of the iceberg. The Muslim Brotherhood in Egypt, al-Qaeda in Libya, CAIR working on behalf of the Muslim Brotherhood in the United States, and you and your regime is facilitating the whole mess.

The next president, assuming it isn’t Barack Obama once again, will have this to untangle as well. We hear all about the economy, but this issue won’t take a back seat to anything.

It seems a shame that we only take out one day a year to honor our fallen troops, and also just a day for our fighting men and women that went to hell and back and lived to tell the tale. I’m not very good at tributes or memorials, so I’ll just impart my thoughts for this memorial day.

We went to the park this weekend, a lovely place with a small lake and a bike path where the children rode without a care in the world. As I looked around at the barbeques, kids of all ages having a ball, good friends talking over a few beers, it struck me that all of this was possible because of what our troops sacrificed. This was it. This is what they fought for. Freedom to go to a beautiful place, bring the kids, and not have to worry about a thing. They did the worrying for us.

Yes, it’s the least we could do, to give our fallen heroes one day while they gave us eternity. I’m sure most readers of this blog understand, but I’ll say it anyway. If there are those that are willing to die so that others may partake in the bounty of this country, then the least we can do is to put up some kind of fight to make sure that their sacrifices were not in vain.

Vin Scully, the great Los Angeles Dodgers announcer recited this poem today between innings. I thought I would share it.

In Flanders Fields
Canadian Army
In Flanders Fields the poppies blow
Between the crosses row on row,
That mark our place; and in the sky
The larks, still bravely singing, fly
Scarce heard amid the guns below.

We are the Dead. Short days ago
We lived, felt dawn, saw sunset glow,
Loved and were loved, and now we lie
In Flanders fields.

Take up our quarrel with the foe:
To you from failing hands we throw
The torch; be yours to hold it high.
If ye break faith with us who die
We shall not sleep, though poppies grow
In Flanders fields.

I don’t think anybody actually believes anything Harry Reid says, although there are those that want to believe the rhetoric. Reid would like to turn America into another Nevada, which holds the dubious distinction of having the highest unemployment rate in the nation. He blames Republicans, and specifically the tea party for holding things up. You may have something there, Harry.

Harry Reid, the disastrous senator from Nevada whose democratically controlled senate is incapable of passing a budget is doing everything possible to make sure Americans will pay higher taxes. The so-called Bush tax cuts are set to expire this year, and unless Republicans bend to the will of the dems, all our taxes will rise. Of course, if the Republicans do wilt, our taxes will go up anyway.

Congress is facing a year-end intersection of the expiration of the Bush-era tax cuts, the $1.2 trillion spending cuts due to the sequester, and expiring payroll tax breaks, meaning that if Congress and the president do not act, American taxpayers could be faced with $310 billion in tax increases next year.

Which is exactly what Reid wants. All he has to do is nothing, and the American taxpayer gets belted with new taxes. What Reid proposes is to raise taxes on the so-called wealthy, those making more than $250,000 a year (sound familiar), ignore exploding Medicare costs until Obamacare gets it hands on it, and try to silence the citizens of this country, which he refers to as the tea party. Those are concerned citizens, but Democrats and RINO’s alike freely bash those that commit to eternal vigilance and dare to question and expose those in the Washington beltway.

I can see what Reid is doing because it’s already happening in California. Tax the job creators and there are ultimately less jobs. Less jobs means more people on the public dole. More people on the public dole means more taxes to take care of the folks that can’t find work anymore. The only logical conclusion to this cycle is to eventually tax everyone at 100 percent and have the goverment redistribute as they see fit. That’s not rhetoric, that is actually occurring as we speak in California. Eventually folks stop producing because they’ll get a government stipend regardless of what they do and the whole thing collapses. Don’t believe it? Look at Europe. They’re trucking in Muslims by the millions in an effort to get somebody-andybody to work in order to prop up the cradle to grave nanny state. We see it in action, and if Harry Reid just does nothing, America will take one more step towards oblivion. Of course, oblivion to some is social justice to others. To Reid it looks like a little SJ, and alot of power and control.

No, life ain’t fair. If I performed my job as badly as Harry Reid, I would be like one of the citizens of Nevada: Unemployed. He on the other hand, ends up as senate majority leader.

I’m starting to think that Mark Levin’s statement was a little more than tongue in cheek: Liberalism is a disease. They have to know their scheme is doomed to failure and will end up harming those they claim to care about the most. They must know that. Harry Reid will not compromise at all, even as he watches his own state go into the ditch. If he had his full mental capacities, he would see that his way is the road to perdition. He clearly does not though, and in his position, he has the power to inflict his mental incompetence on the rest of us.

If you want to see if socialism works, if social justice is a valid societal pursuit, you need look no further than California for the answer. What Barack Obama is implementing across the rest of the country is already entrenched in California, and the results speak for themselves.

It didn’t take a genius to figure out that when California legislators papered over the massive budget deficit last year that it would just pop up later on, just as big, just as bad. Well, it’s now later on, and California is looking at a $16 billion budget gap for the upcoming fiscal year. Try and wrap your mind around that number. After spending nearly $200 billion dollars-you saw that right, California is still short $16 billion. How could a single state manage to spend that kind of money and have it still not be enough? Well, we can start with exactly how much the state spends. Not even they know for sure. It’s in the area of $200 billion + though. Not knowing how much you need to have from year to year is a recipe for disaster, and California is proof of that.

Instead of whittling down the ridiculous amount of untenable spending, governor Jerry Brown has called for tax hikes in order to continue California’s slog in the gutter. Without them he warns, painful cuts abound for everybody.

Of course, like true politicians, the first things on the table are education, healthcare, and safety. Schools, medicine and cops are the first things on the chopping block. For California though, those aren’t the things that are the problem. It’s the leeches that have attached themselves to those institutions. If you want to know what unions could do to the United States, get a load of California. Legally binding contracts have union members living the high life, courtesy the California taxpayer. There’s only one problem though: The money isn’t there. For the unions, it doesn’t matter. A deal’s a deal, and California better not default.

Brown’s plan is to raise taxes on those making more than $250,000 a year. Sound familiar? It should, because that’s exactly Barack Obama’s plan for the rest of the country. In California, the tax hike would put the so-called rich into a 13+ percent tax bracket, the highest in the nation. With a dwindling tax base and growing entitlement state, this plan is doomed to fail.

It’s crazy, it’s insane-what state could possibly be stupid enough to actually keep this kind of failed ideology alive? The behemoth government taxing-and regulating for that matter is a proven failure, but if you happen to be the one getting government supplied freebies, or are sympathetic to those that are in line for a little social justice, then damn the consequences, redistribute like there’s no tomorrow.

However transparent Brown’s maneuver, polls show all the furor might actually drive acceptance of Brown’s tax proposal on the November ballot. Brown wants to combine a four-year, quarter-cent-per dollar increase in state sales tax with a seven-year surtax of 1-3 percent on Californians making more than $250,000. A recent Public Policy Institute of California poll showed 54 percent of Californians support the measure.

At the rate California is declining, there may not be a tomorrow. Of course, if Brown had his way, nobody would have their own money. The government would dole out a stipend for everybody. He’s on record. He never was clear on where that free money would come from.

So here in California, even the non-rich are looking at a sales tax increase and at the same time an expiration of the so-called Bush tax cuts on a federal level. The double whammy. I had visions of crates of tea going over the side, but not here, not California. This is what they want, and they’ll probably get it.

Score one more for Barack Obama’s reelection campaign. Instead of having a serious discussion about the state of the union, the left will throw out some bait and Republicans take it every time. Birth control, Medicare, religious freedom, and now this latest detour to throw the Repubs off their game. And throw them off it does. How do conservatives get sucked into a discussion on gay marriage? I bet even they couldn’t tell you.

When Barry decreed that insurance companies-and hospitals that administer the services thereof would have to provide free birth control by way of Obamacare, conservative pundits were up in arms. Not necessarily rank and file conservatives, but the ones making the most noise. Not only were they upset that an unnecessary-and even a non-medical service was being dictated by law, the fact that religious institutions that were philosophically opposed to such things would have to go along. Conservatives fell into a trap by ignoring the bigger issue: Obamacare. When that monstrosity goes into full effect 2014, birth control will be the least of our worries. But pundits talked about it as if this was one of the worst things to come out of the law. Anyone with just summary knowledge of Obamacare knows that there are far worse fates awaiting American citizens. Death panels, employers dropping coverage, extended waits to see your doctor, bureaucrats deciding if you get a procedure at all, and the list goes on. Not only was all that put on the backburner, but adding insult to injury was Rush Limbaugh being crowned the voice of the conservative movement after calling a leftist activist a slut for wanting free birth control. The king promptly apologized for what turned out to be nothing at all. Last I heard that woman was in Europe vacationing with her rich boyfriend. Conservatives fell for that one hard. A little research before scattering like cockroaches guys.

It’s so easy that the left uses the same formula over and over, and conservatives just keep playing along. How about the fair share argument? The Buffet rule? It would take 30 seconds to explain how ridiculous that is, but so far, noone has take the time. I’ll take the time. If you took the entire net worth of the 99 percent in this country-not this year’s income, but their whole net worth, it wouldn’t cover next year’s budget. The Buffet rule? He pays less taxes than his secretary? Buffet is not an employee. He makes his money with capital gains. That rate is lower than personal income tax. You want to raise it? Do you buy stock? Do you have a 401k? Could you possibly sell your home in the future? There’s a little something called capital gains you’ll have to deal with, and if Obama gets his way you’ll suddenly become the 1 percent. Yes, I think that took about 30 seconds to explain.

Now the latest conservative gaffe is Obama’s evolution on gay marriage. Every pundit I heard on the radio today couldn’t get off that. Heidi Harris, Hugh Hewitt and who knows who else were all immersed in Obama’s change of heart. Remember, this is the guy that decided to ignore DOMA. He rules by decree. Laws are too structured for a dictator, so by not having a law that allows gays to legally marry gives Obama room to rule as he sees fit. Look at immigration. He doesn’t need to follow any rules as is. An amnesty bill would tie his hands on several fronts. Hence, ignoring DOMA. Obama probably didn’t want this, but his goon Biden probably forced his hand. This is a campaign issue? This is going to sway an election?

Here’s the thing. The side issues being brought up take away from the bigger picture. That is exactly what Obama wants because anybody looking at his masterpiece would end up like Dorian Gray. You’re being forced to buy insurance-as dictated by the government. Not your own plan, but one designed by the likes of Ezekiel Emanuel. Obama wants to implement punishment taxes on successful people. You may be one of those people if it involves capital gains. If you’re a small business owner working 70 hours a week you may be part of the one percent living the high life. Obama has targeted you. Obama ignores laws. Obama insults the Christian leanings this country was founded on. Something he would never do to this beloved Islam. But conservatives get sidetracked from the bigger issues. They want to talk about the economy? Obama is fudging the employment numbers and we can’t get so much as a whimper from conservatives. All right, consider this a whimper. There are a few out there. That’s the problem, there’s just a few saying what needs to be said.

If all Mitt Romney can bring himself to talk about is the economy, at least he has some ammunition this month. I don’t know who is advisors are, but if you need help Mitt, give me a buzz. I’ll set your campaign straight in about five minutes.

The April job numbers are out, and we can formulate the spin from the White House even before Jay Carney opens his trap. The economy added 115,000 jobs in April, and the unemployment rate dropped to 8.1 percent. At this rate, unemployment could dip under 8 by November. Looks pretty good, doesn’t it? Not so fast. As with every jobs number report, there’s a dark side, and this one is no different.

Sure, the economy added 115,000 jobs. Most of those are in retail and cashiering. Better than nothing, but that’s about it. How about that drop in the unemployment rate? Even a bad job is better than no job right? Correct, but the unemployment rate dropped because in April-522,000 persons dropped out of the workforce, and are no longer counted as unemployed. Of course that will bring down the unemployment rate. Less people looking for work, less people unemployed.

This is awful news from my persepective. Mitt Romney should be able to shred Obama on this report alone. So far, I haven’t heard much from Mitt. I know he’s making the rounds, but the fact that a half-million people threw in the towel in a single month has to get his attention. You would think.

Barack Obama had two full years with nothing to impede him from implementing his agenda. He did just that. Obamacare, the stimulus fiasco, even the pork laden omnibus spending bill all breezed through tears in our government. Now, whenever there is the slightest bit of bad news that his pals at the MSM can’t coverup, he blames Republicans for blocking the way and wanting to return to the days of George Bush. I don’t know many that want to return to the Bush years, but it shows once again that it is the left that is dictating any discussion on the national level, and if Mitt Romney doesn’t get it in gear, he will become an accessory to Obama’s reelection.

Again, if you need campaign help, let me know Mitt. Nice to see you’re a gentleman and all, but if you don’t go hard at this fraud socialist, he’ll be reelected and will run the rest of the country into the ground. He’s already done enough damage, the kind that will leave a scar. Obama’s speeches are vapid. He can’t run on his record, and all it will take is the facts-again and again to drive him out of the White House. Give it a try Mitt. I’ve given you some material here today.

We’ve heard for years about good folks that just want to work, poor people who’s only crime was being here illegally. The reality tells a much different story. Social programs administered by states are buckling under the weight of illegal immigration. Jails are bursting at the seams. Entire neighborhoods-and even cities pledge their allegiance to other countries. The crime of identity theft has exploded, yet the line we get from apologists is that this is good for America. Well, it isn’t good for America-or any country for that matter, but is certainly is a boon for illegal aliens. And when it comes to Uncle Sam, no identity theft is necessary. The IRS will freely hand over your money to illegal aliens-and their relatives who have never set foot in this country.

When Republicans floated a bill that would end child tax credits for illegal aliens, it was immediately met with resistance by the likes of Harry Reid and company. The argument was that although the parents were illegal, the children may not be, and therefore cutting off the tax credits would harm American children. The 14th amendment is another conversation; this isn’t about American children at all.

Bob Segall, of WTHI (Indiana) went to some tax preparers to find out how bad illegal tax fraud actually was. What he found would make even the most apologetic open borders advocate blink. The child tax credit that is being abused is not only being claimed for children in the United States, but in Mexico as well. They don’t have to be sons and daughters either. Neices and nephews are claimed as well to the tune of thousands of dollars, and billions looted from the coffers of the United States. They even have illegal aliens copping to the fraud, with not guilt or even a worry of being caught.

One of the workers, who was interviewed at his home in southern Indiana, admitted his address was used this year to file tax returns by four other undocumented workers who don’t even live there. Those four workers claimed 20 children live inside the one residence and, as a result, the IRS sent the illegal immigrants tax refunds totaling $29,608.

It isn’t a matter of the IRS not checking; they just claim their hands are tied because it is Congress that has the power to change the laws, not them. The IRS has no choice but to accept ITN numbers, the number the IRS assigns if you do not have a social security number. And who wouldn’t have that?

As Obama talks about the wealthy paying their fair share, he ignores tax money being siphoned out of America with the full knowledge of the American government. Billions are being wasted and billions more are being literally given away. In the end, it’s all our money which we have no choice but to hand over. I wonder what would happen to me if I tried such a child tax credit scheme. Well, I don’t have to wonder. I would be audited for the last 10 years before they threw me in jail. Illegal aliens though are beyond the reach of the IRS though.

Yet another fixable problem in the United States, but without the will in Washington, nothing will get done. Of course not. It’s the goons in Washington that created this problem. They aren’t going to fix it. Yes, throw the bums out. The question is, are there enough Americans left that actually care or are paying enough attention to make that happen?
