With the most unfortunate and horrifying custodial death of 84 year old Jesuit Priest Stan Swamy, maybe it is high time to revisit the jail rules. It may be improper to detain people over the age of 80 in jails. Those who have to be kept in detention could be possibly placed under house arrest or in old age homes where their age related special needs are taken care of.

Prison ensures social isolation and confinement which can result in deterioration in mental and physical health through neglect and fear especially in the elderly and the vulnerable. Far from achieving the desired outcome of prison which is reformation, to lead law abiding and useful lives in prison and when they are released, their time in prison can be a retrograde step where they either suffer through ill health and even death and for those that survive, they will be more resentful of the prison machinery and society.

Prisons should only be used to reform and to protect the peace of the man in the street and for providing a sanction against very serious wrongdoing. The detention of people over the age of 80 in poorly kept prisons who through frailty or other illness is a sad reflection on society and a failure to deal with people humanely. It can also sometimes be a waste of taxpayers' money. Their reform and health must be cared for and addressed in a different and special way.

Almost everyone over 80 is grappling with serious health issues so the jails are not conducive for such aged people. Elderly persons admitted to jails require a different sort of health care. Concerns about the health status of older inmates and their chronic health issues has to be addressed in a special way and the inability of most jails to accommodate their special needs cannot be just overlooked.

Prisons have a duty of care towards all prisoners and must take all reasonable steps to keep them safe while in custody. The prison has a responsibility to ensure the safety of prisoners – which includes protecting those at special risk of injury or who are vulnerable.

The prison system must never be inherently unjust and inhumane. We should take heed of the wise words of Christopher Zoukis, a leading voice on criminal justice reform in America and author of many books on prison life, when he said 'If we treat prisoners like animals, the whole time they are locked up, that's what we will get when they are back on the streets. – wild, dangerous animals.' In the case of the elderly if they are lucky to be back on the streets, we will get a severely ill and demoralized human being staring tragedy through a lack of care. This cannot be a true reflection of a caring and progressive society.

This issue would be a fit one for the Chief Justice of India to Suo Motu take cognizance so that appropriate directions could be issued which would be applicable nationwide on the environment in which very elderly persons should be detained and taken care of.

Just released: Book on terror tactics of anti-terror agencies and their victims
New Delhi (11 July 2021): 11th July is remembered in India's at 7/11 because of Mumbai Train blasts in 2006. New Delhi-based publisher Pharos Media has just brought out "Innocent Prisoners", the English version of Begunah Qaidi authored by Abdul Wahid Shaikh, himself victim of a fake terror plot by agencies. The author himself was a victim of this ensnaring tactic who was acquitted by the Special MOCOA & NIA Court Mumbai while his co-accused rot in jail and their appeal is pending for the last six years in Bombay High Court.
Shaikh offers first-hand information about agencies and police tactics on implicating innocent people, fabricating false evidence against them and use torture of victims and the immoral pressure on their relatives to force them to confess to crimes they never committed or implicate other innocents.
The book is basically about the 7/11 Mumbai train blasts case but also covers German Bakery blasts 2010, Malegaon Blasts 2006, Aurangabad Arms Haul case 2006, Akshardham attack 2002 and the "Indian Mujahideen" plank used by agencies to fabricate cases. It also extensively covers police torture, fabrication tactics and various strategies police and agencies employ to implicate innocents and force them to make false confessions to prove stories concocted by the agencies and police.
This exposé offers startling details of the heinous games played in India by the State through police and agencies for decades in the name of "terrorism". This book unveils the ugly face of government and agencies, modus operandi of police, ATS and investigation agencies, their inhumane tortures, legal tactics employed and the secrets of court cases. Innocents implicated in terror cases will find courage to fight their legal battles through this book. The reality of the blast cases and the tall claims made by police and media are exposed in great detail in this book.
The author himself was a victim of torture and tactics of police and investigation agencies. He has narrated first-hand experiences of himself and some other innocent prisoners at the hands of police, investigation agencies and officials of the jail system.
This book is not just a testimony of the innocence of a person acquitted of all charges in an infamous "terror" case, it also showcases his unmoved resolve to fight the legal battle for his and other victims' freedom. The author, Abdul Wahid Shaikh is a teacher at a Mumbai school. He was the only person to be acquitted out of the 13 accused in the 11 July 2006 Mumbai train bombings case because till end he refused to sign a false confessional statement while his other co-accused succumbed to pressures and signed their false confessions which were used in court to sentence them to death and life imprisonment.
Shaikh completed his post-graduation and studied law during his nine years in jail. Keeping his promise to his co-accused, he frequently travels around the country talking about the truth. A Hindi feature film based on his life will soon be released. Even years after his acquittal, cops continue to harass him. [IAC#RG] IT WAS A GROSS ABUSE OF POWER BY HARISH SALVE

The Registration of Marriages in Goa is under the Portuguese Civil Registration Code, 1911 and this law being not contrary to any of the constitutional provisions still continues to be in force to date.

But the Goa Government headed by then Chief Minister Manohar Parrikar on 17^th January 2014 hurriedly issued a notification appointing all Sub-Registrars in Goa as "Marriage Officers" under Special Marriage Act 1954 without even that Act being extended to our State. It was done to solely facilitate the high profile marriage of former Solicitor General of India Harish Salve's daughter to be registered in Goa under that Act. On the strength of that notification on 24^th February that marriage was solemnized at now fugitive Vijay Mallya's then King Fisher Villa at Candolim in the presence of the Mapusa Sub Civil Registrar and a host of VVIPs.

The ulterior motives of the Government in acting so swiftly and issuing the notification in a tearing hurry in just one day was highly questionable. Even the Chief Secretary's views were not sought which was in complete breach of the Rules of Business, especially in a matter having widespread ramifications. To shield his friend Harish Salve, the then Advocate General Atmaram Nadkarni abdicated in his bounden duty by not placing the correct legal position before the government.

That notification was obviously issued to allow just that one marriage as the Goa Government over the last seven years has not permitted any other marriage under that Act. It would be prudent for the government to immediately withdraw that retrograde and now idling notification dated 17^th January 2014 and apologise to the people of Goa for having high-handedly and malafiedly tweaked the law to benefit just one person.

When will the government realize that nobody is above the law and that the law cannot be twisted and warped for a particular person's benefit, however rich, mighty or well-connected? And above all, Harish Salve should have acted responsibly by not making a request which was contrary to the law.

[IAC#RG] SELECTION PROCESS OF JUDGES MUST BE METICULOUS AND TRANSPARENT

The current selection process of Supreme Court and High Court judges is shrouded in total secrecy. It leaves room for friends and former colleagues of current and retired judges to manipulate their way through the system. This does not augur well for the Independence of the Judiciary which is the common man's last recourse to seek justice. Persons who cannot interpret the law inflict irreversible damage to the justice delivery system.

There needs to be total transparency in judicial appointments. The selection process has to be very rigorous and with stringent procedures in place to block the undeserving. This will ensure that only the very best and brightest are elevated as judges. It is imperative that politicians should have no role whatsoever, direct or indirect in the selection of Judges.

Only persons with very sound knowledge of law besides impeccable character and high integrity should be selected. For the rest there are many other options, Politics being one of the much sought after avenues.

We need to have the right persons selected as Judges with their salary and perks substantially enhanced so that only the best and brightest preside over the Temples of Justice. The Judiciary should never be manned by persons who are slanted or aligned to any political party. Judges should have the spine to crack on illegalities done by any politician, regardless of the party he is affiliated to and the high position he holds. If Judges cannot independently balance the scales of Justice, the Courts lose their very sanctity.

Over the years we have witnessed some extremely good judges but in anguish have also had to live up with those from the other end of the spectrum and on them less said the better.

[IAC#RG] JUDICIARY NEEDS TO REBOOT AND DELIVER

The COVID-19 induced disruptions have only further dented the administrations of Justice while adding to the backlog of cases pending, which have now reached alarming levels.

As on 15th April this year 67,279 cases were pending in the Supreme Court, 5.75 lakh piled up in High Courts and a mountain of 3.8 crore gathered in the subordinate courts across the country giving a very grim picture of India's Justice delivery system.

In view of the rising pendency of cases, the number of holidays could possibly be slashed and by ensuring that Courts sit for at least six hours a day. In the current pandemic there is no reason why with all the precautions in place Courts should not function hearing just 15 cases in each session. This would help ease the backlog. And for every litigant his case is urgent.

The Judiciary seems to be placed beyond the reach of the common man while the influential and wealthy Ambanis and Adanis wade their way through. Courts of law can never end up as Temples of Surprises, as every order passed must be based on very sound legal reasoning.

For decades, there has been a gross failure in administration of the judicial machinery. Many Judges highlight all this in their speeches at various functions but those only remain good to hear while nothing gets done to cure the situation.

Many do not see an end to the litigation in their lifetime as it can take 15 to 20 years if not more for the legal battle to end. So there is a need to identify problems grappling the Judiciary by finding some concrete but practical solutions.

The issue of easily obtained and indefinitely lasting stay orders needs to be addressed. Adjournments for the asking must also be done away with. As the years pass, memories fade, witnesses turn hostile and justice becomes meaningless. Widely spaced dates is another problem especially in criminal matters with the under trials in judicial custody denying them their fundamental right to life and liberty.

The problems faced by citizens in their quest for Justice should no longer be ignored. The Supreme Court being the overall court of Superintendence needs to invoke its administrative powers to remedy this unacceptable state of affairs. If immediate remedial measures are not put in place the Justice delivery system, if not already, may sadly collapse under its own weight.

Governors should not end up being mere rubber stamps as they constitutionally have a major role to play in overseeing that the State is well administered in accordance with law. They should be appointed on merit as the Raj Bhavans cannot end up being shelter homes to rehabilitate the deadwood of the ruling political party. It is imperative that the Governors should be truly non-partisan at all times. We need to reflect and consider whether there is a need to house a "spare wheel" at the state level?

[IAC#RG] TARUN TEJPAL’S POLITICAL PERSECUTION THAT HAS BEEN A FINANCIAL NIGHTMARE FOR GOA’S TAXPAYERS

Courts of Law are a forum to Prosecute and never to Persecute. The Goa Government should come clean making public the total expenditure incurred so far on the Tarun Tejpal Case which has been on for almost eight years. With the trial at the Sessions Court, the case on various issues traveled to the High Court and Supreme Court several times.

It is estimated that the government must have incurred expenses of approximately ten crores on this case which is yet to see its finality. With that money, the Government could have set up a state of the art full fledged Health center at the Old Ribandar Hospital with all the possible facilities to cater to the health needs of all instead of politically and vindictively hounding one individual. It is anguishing that the state exchequer has been drained on account of the witch-hunt waged by the BJP against Tarun Tejpal. Why should the tax-payer have to bear the brunt of such a wasteful politically orchestrated plot?

Will the government enlighten us as to in how many other cases it has Suo Motu initiated criminal proceedings and gone hammer and tongs as done in the Tarun Tejpal case by incurring such a huge mind boggling expenditure? Could we also know in which other cases the Goa Police has demonstrated such rare enthusiasm to investigate?

The financial pain faced by the tax payer on account of this case is far from over. The appeal now filed by the Government against Tarun Tejpal's acquittal will take a couple of years to be decided by the High Court and then the last round in the Supreme Court may also take long to see the last curtain drawn.

The ego of the BJP and its all-out vindictive battle to settle scores with the founder Editor in- Chief of Tehelka has been unduly burdening our cash starved State. And when this is all over besides the financial burden incurred we would have to also account whether judicial time was judiciously spent especially in view of the huge pendency of urgent matters in Courts. Was it all a criminal waste of precious judicial time?

Maybe the law needs to be amended to prevent any such future abuse by the government in Power which is hell bent on vindictive wasteful actions at the expense of the taxpayers. May such a sordid saga never ever repeat again.

You have made an interesting point Aires. May I remind you that in October, 2015 most NGOs working in the filed of RTI Act 2005 had boycotted the address of the PM Modi at the CIC Convention. on flimsy ground. As a result these same NGOs with their over inflated ego, just antagonized the very PM who could have helped us in making the Act stronger. What was the outcome from the boycott? Nothing.

In your recent mail you have covered all grounds. It is precise and to the point. So may I request you to approach the Govt. and all stake holders with the same letter / email and also mark a copy to the PMO?

This proviso in the law was enacted to reduce the need for filing individual RTI applications. But this mandatory duty has been blatantly flouted by the authorities with most government websites themselves dysfunctional or not updated. What is the use of right to freedom of speech when the people do not have their rightful access to information?

The Judiciary needs to step in to ensure that the Government complies with the mandate of the RTI Act. But with the Courts themselves also averse to parting with information and with its functioning largely under a veil of secrecy, we are stonewalled.

But we need to battle it out and cannot allow the RTI Act to be choked by the government to a slow death. Steps need to be taken to strengthen the transparency regime that was sought to be established as envisaged by this Act. Effective implementation of the RTI Act requires political commitment from the very top. Officials denying information or giving misleading and distorted information need to be severely penalized.

Governance by cloak of secrecy and opaqueness needs to be strongly resisted. It cannot be a hush-hush regime. We need to dismantle those walls of secrecy that continue to hound transparency and good governance. In those very words of Narendra Modi 'Sabko sanmati de bhagwan' (Let good sense prevail).

The post is a relic from our colonial past.

In the initial decades since Independence, it was meant to be just ornamental (at considerable expenses of ordinary Indians) - as testified by many of them.

In the later years, it started being used by the Centre to heckle, or even remove, state governments that it considered, for whatever reasons, bothersome.

After the celebrated Supreme Court judgement, in 1994, in the famous SR Bommai vs. Union of India case, things did improve for quite a while.

Now, it's, again, (nearly) back to the bad old days.

This unelected post - chosen completely arbitrarily and appointed unilaterally by the Union Government, goes against the very grain of spirit of federalism.

Needs be forthwith abolished.

CORONA CRISIS IN INDIA POINT TO NEED FOR POPULATION CONTROL

The recent decision of the Government of China to allow families to have three children has once again focused the global attention about the population policy of the governments. Alarmed by it's over population scenario, Chinese government ordered several years back that no family should have more than one child. With the dictatorial regime of China and known for it's readiness to impose draconian measures to implement decisions, people of China simply obeyed the government's directive to adhere to the one child family norm and the population growth steadily decreased. Now, the situation in China has undergone one full circle and the government finds that with the longevity of life due to medical advancement, the proportion of the aged population in China has increased, with the number of youth (working hands) reducing in the overall population, that could create a crisis in future.

The question is whether the population of a country should be compulsorily restricted and controlled ?

In sharp contrast to the scenario in China, India is a free and democratic country , where the decision of the government on any matter would be shaped by public opinion and preference of citizens.. India too has been discussing the need for checking the population growth for several decades now and many soft measures to check the rise in population have been introduced, which has not resulted in the desirable level of de growing the population.

There are also vague and confusing discussions in India about what is called a "demographic dividend" , which means that a higher level of population could mean greater number of working hands and consequently larger output of goods and services.

However, the ongoing Corona crisis in India has effectively repudiated the "demographic dividend" theory, which now appears to be an utopian thought.

During this Corona crisis, one reason that the second wave of Corona spread rapidly and uncontrollably in India has been due to the density of population. With such a high level of population density, the social distancing norm has gone for a toss and many people think that the lack of observance of social distancing norm is the biggest issue in tackling the Corona crisis in India today.

In such a scenario, discerning observers are of the firm view that any idea questioning the need for population control is absurd and counter productive.

While under population could create some manageable problems, over population inevitably causes economic and social stress and serious public health issues. This is the biggest problem faced by India today due to it's high population density.. With such a crowd of people all over India which is constantly growing , no measures taken by the government are adequate enough to meet the needs of the people and the society. This has become very evident during the Corona crisis.

Some people tend to compare the size of the USA and it's population with that of India . Such people seem to conclude that even with the present size of India ( which is less than that of USA), if India were to have only the population level of the USA, then India could be as prosperous a country as the USA, particularly considering several natural advantages that India has.

In any case, the ongoing Corona crisis in India is a clear pointer to emphasise the fact that overpopulation with high density is the primary problem in tackling the Corona crisis today. Now, the debate on over population versus under population has been firmly decided in favour of controlling the over population, even if it would lead to under population.

Indian Prime Minister Narendra Modi, during the last seven years of his governance, has taken some extraordinary and innovative measures to implement economic and social reforms in the country. Some positive results have already been seen and several other measures are in the work in progress stage.

What causes concern is that while Mr. Modi has taken several proactive measures, he has not paid attention to the adequate level to check the population growth in India. In the absence of Mr. Modi speaking about the need to control the population, the population control strategy is not a subject of national discussion today in India.

I hope that in the next three years of his present term of office, Mr. Modi would stress on population control and effectively explain to the people that the Corona crisis proved difficult to overcome only due to over -density of the population of the country. He must convince the people that the larger family size is not only an economic issue but also a health issue of serious proportion.

As judicial independence of Judges rests entirely on maintaining an incorruptible detachment from the government of the day, it cannot be allowed to be morally compromised by lobbying for cushy post-retirement sinecure postings. We have earlier also witnessed instances where Judges have fixed their retirement nests much prior to even demitting office.

The highest standards of judicial independence must be ensured by warding off even the faintest trace of governmental influence on the judiciary. The loyalty of every single Judge in our country has to be only to the very sacred Constitution of India.

[IAC#RG] INSTEAD OF RIBANDAR THE AYUSH CENTER CAN BE AT MANIPAL HOSPITAL RUN BY GOA’S BABA RAMDEV

The Old Ribandar Hospital which is Asia's first Medical school has a very glorious history. It was an excellent hospital and many of us were born there. The heritage structure was designed for it to house state of the art medical facilities which people from across Goa benefited.

The Old Ribandar hospital was an allopathic one and must so remain. It is deplorable that our Ayurvedic Chief Minister Pramod Sawant at the instance of Union Ayush Minister Shripad Naik with oblique motives wants to have a needless Ayush Center there.

That proposed Ayush Center can be instead hosted in the Manipal Hospital at Dona Paula which is better known as a BJP hospital. The Ayush work there can be entrusted to the head of the BJP's Medical cell Dr. Shekhar Salkar, who illegally masquerades as an Oncologist though not qualified as one while the Indian Medical Association strangely has taken no action against him while allowing the lives of gullible patients to be in peril.

Needless to add Dr. Shekhar Salkar has also had an outstanding good financial bumper crop at the Goa Cricket Association and also at National Organization for Eradication of Tobacco (NOTE) which he heads. Those gross financial irregularities of he chewing public funds was even debated in the Goa Legislative Assembly. This known Cancer quack also doubles up as Goa's Baba Ramdev.

In recent years, almost every patient I have known who has been to Manipal Hospital at Dona Paula has faced a hell of a nightmare. Most of those patients have landed up in the morgue, with their families lumbered with massive and extremely exorbitant bills. For the family of someone already going through the pain of illness, it is added agony to being financially ripped off with very inflated bills. This anguish faced by the family members is heart breaking to have to collect a dead body and paying up that huge bill landing them in a deep financial hole.

Manipal hospital seems to be lacking any Code of ethics. A concern for the well-being of the patient is never there, while they merrily secure and pursue their commercial interests. The government ought to order an immediate inquiry into the dubious affairs at Manipal Hospital and the probe has to zero in around Dr. Shekhar Salkar who runs the commercial show there. He neither has a degree nor even a diploma in either Oncology or Oncosurgery.

Three weeks ago a 85 year old pious gentleman and close friend from Ribandar miraculously escaped from being butchered by Dr Shekhar Salkar who was all set for another five lakh windfall to operate on my friend who had a growth on his intestine. Luckily my friend who timely smelt a rat and the doctor's devious game plan, hastily sought discharge from the Manipal Hospital within hours of his admission there. Fortunately my friend sought immediate alternate medical advice and is keeping well after being successfully operated elsewhere.

Dr Shekhar Salkar has been grossly misusing his position as Head of Goa BJP's Medical cell to illegally and unethically rake up huge financial benefits for Manipal hospital while also enriching his own pockets. He should not be allowed to inhumanely and immorally gamble with people's lives. There is abundant documentary evidence to the effect that the politically well-connected Dr Salkar has been unduly interfering and sabotaging the working of Government hospitals as well, only to benefit his Manipal Hospital.

Let us hope that our Health Minister Vishwajit Rane orders a prompt thorough inquiry into the blatant misdeeds and wrongdoings at the Manipal hospital. This financial exploitation of patients cannot be allowed to go on unpunished. We also need to know as to how that building on free government land which was a Goa Cancer Society hospital landed in the soiled hands of the Manipal Hospital entrepreneurs.

Instead of going to this Manipal Hospital, a patient may be well advised to die in peace somewhere else. At least the family's life savings would not be swallowed by this proven vulture of a hospital. The family will also be saved the financial ordeal and trauma they would have to go through after losing their loved one there, at Dona Paula.
