The pros and cons of Direct Taxes Code

The revisions have been made on the basis of the representations received from various stakeholders on the draft released in August 2009.
Importantly, even as the new version accedes to the demand to continue concessions in many areas that were originally proposed to be withdrawn, it does not propose to expand the personal income tax brackets to Rs 10 lakh (Rs 1 million) and Rs 25 lakh (Rs 2.5 million), and, thus, avoids losing a substantial tax base.

The revised draft makes a number of changes in the draft Code and in the process will have lesser scope for expanding the base.
On personal income tax, it continues the EEE regime for permitted savings on the grounds that there is no universal social security and the change would entail many administrative, logistical and technological challenges.
The proposal to tax perquisites has been substantially pruned and, in particular, the proposal to include the market value of rent-free accommodation given by the employer has been given up. Inclusion of notional income from the owner-occupied house has also been abandoned.
The revised draft proposes to include long-term capital gains from financial securities, but take only a portion of the gains.
For non-profit organisations, it allows carry over of up to 15 per cent of their surpluses or 10 per cent of gross receipts, whichever is higher, to be used within three years. The Code proposes to grandfather area-based exemptions, but allows profit-linked exemptions to the developers in SEZs only up to the unexpired period.
On corporate taxation, the proposal to levy MAT based on the gross assets has been given up and the tax will continue to be levied on the basis of book profits.
The revised Code follows the international practice of considering companies as residents if their "place of effective management" is in India [ Images ].
It clarifies that in case of differential interpretations between the Code and the double-taxation agreement, the one which is more beneficial to taxpayers will hold, unless the anti-avoidance rule is invoked.
On wealth tax, the proposal to levy the tax on the value of unproductive assets has been abandoned and the tax will be confined to the value of productive assets. It also clarifies that the General Anti-Avoidance Rule whenever invoked will be within the scope of the Forum of Disputes Redressal Panel.

The government must be commended for adopting the consultative approach to finalising the Code.
Besides making the reforms acceptable, the approach will make politically difficult reforms feasible over time.
As the finance minister mentioned in his 2009 Budget speech, tax reform is a process and not an event.
Therefore, even after the adoption of DTC, further simplification and rationalisation will be needed suiting to the requirement of the times. Furthermore, DTC is only a part of the reforms in the tax system.
Reforms in tax administration and information system, including induction of technology, are equally, if not more, important.

There is a larger issue of how far the government should reduce the effective tax rates.
In the Laffer curve formulation, revenue increases with the tax rate up to a point, but thereafter, increases in the rate will cause decline in revenues. There is an implicit belief in all those who argue for further reducing the rates that we continue to be on the declining part of the curve.
Thus, Surjit Bhalla, in a recent article, has argued that reduction in the effective rates of tax due to widening of the brackets proposed in DTC is very desirable, but alas, the finance minister does not intend to expand the brackets in the revised Code!

Bhalla's contention is that the sharp increase in revenues since 1997-98 was due to the Laffer effect and stagnation in revenues in the last few years was due to steady increase in the "effective rate" of tax.
Therefore, the government's decision to reduce the "effective rate" of tax by 6 percentage points in 2008-09 and a further 2.6 percentage points in 2010-11 is sensible and this is rewarded by Mumbai [ Images ] TDS yielding 18 per cent higher revenue this year!
First of all, between 2002-03 and 2007-08, contrary to his contention that the revenues were stagnant, the personal income tax revenue recorded an unprecedented annual average growth of 30 per cent.
It is only due to this that the so-called "effective rate" in his calculations showed an increase.
In other words, his "effective rate" can increase or decline simply due to revenue increases, which may or may not be due to changes in nominal rate. Second, the decline in the "effective rate" in 2008-09 was not due to any decision of the government, but simply due to lower tax payment by small businesses.
It must be noted that the personal income tax category includes individuals, Hindu undivided family, association of persons and small businesses. In fact, the population that paid the tax in 2008-09, the last year for which audited figures are available, was 32.7 million which was lower than the previous year by 3 per cent.

Tax compliance is a function of tax rates, probability of detection and penalty rate. Surely, reduction in the marginal tax rate in 1997-98 could have had a favourable impact on tax compliance.
However, it must be noted that reduction in the rates was accompanied by administrative measures to expand the scope of TDS.
The revenue from TDS, which constituted just about 20 per cent in 1996-97, increased to almost 67 per cent in 2000-01.
Since 2003-04, the single-most important factor that increased revenue productivity (and thereby Bhalla's "effective rate") was the institution of the Tax Information Network.
In 2002-03, less than 25 per cent of those who were supposed to deduct the tax at source actually submitted the returns and this increased sharply since TIN was put in place.
Consequently, revenue from income tax increased by about 30 per cent per year from 2003-04 to 2007-08. Of course, tax rates matter, and so is tax administration.
Reducing the rates without improving administration and information system to increase the probability of detection is a recipe for disaster. Fortunately, tax brackets and rates are not a part of DTC in the revised Code.

UGC NATIONAL ELIGIBILITY TEST FOR JUNIOR RESEARCH FELLOWSHIP AND ELIGIBILITY FOR LECTURESHIP – December, 2007

The University Grants Commission announces holding of the National Eligibility Test (NET) on 16th December, 2007 (Sunday) for determining the eligibility of Indian nationals for the Award of Junior Research Fellowships (JRF) and eligibility for Lectureship in Indian universities and colleges. UGC will conduct NET in 77 (seventy seven) subjects (listed under item no. 9) at 66 (sixty six) selected University Centres (listed under Item no. 10) spread across the country.
The result of the UGC-NET held on 24th June, 2007 and the one to be held on 16th December, 2007 will be made available on the UGC website : www.ugc.ac.in and shall also be published in the Employment News as and when it is declared. The candidates will not be individually intimated about their result.

The Candidates who qualify for the award of Junior Research Fellowship are eligible to pursue research in the subject of their post-graduation or in a related subject and are also eligible for Lectureship. The universities, institutions, IITs and other national organizations may select the JRF awardees for whole time research work in accordance with the procedure prescribed by them. The award of JRF will depend on the performance of the candidate in NET. The qualified candidates will also be eligible for Lectureship. However, the candidates qualifying exclusively for Lectureship will not be considered for award of JRF.

Candidates appearing in NET should clearly specify in the prescribed Application Form whether they are applying for both JRF & eligibility for Lectureship OR only for eligibility for Lectureship. Candidates who qualify the Test for eligibility for Lectureship will be governed by the rules and regulations for recruitment of Lecturers of the concerned universities/colleges/state governments, as the case may be.
Scheduled Caste (SC)/Scheduled Tribe (ST)/Visually Handicapped (VH)/Physically Handicapped (PH) candidates will be given such special concessions as may be decided by the Commission.

i) OFFLINE Application Form and Information Brochure can be obtained from the GATE Office, IIT Bombay, on payment of non-refundable application fee of Rs.990/- (Rs.495/- for SC/ST Applicants) by crossed demand draft in favour of IIT Bombay payable at Mumbai. These can be collected personally at the GATE Office counter, or can be obtained by post by sending a request letter along with DD. Two address slips should be enclosed along with the request. Service conditions of Defence Personnel are extremely exacting, tough, rigorous and peculiar to the Services. To maintain a fit and youthful profile, defence personnel, particularly of the lower ranks, are retired at a young age with limited pension, saddled with pending domestic responsibilities. The Army’s engagement in counter-insurgency operations in J & K and the North East has also resulted in casualties every year, leaving behind widows and children in need of support. To encourage higher technical and professional education for the wards of widows and ex-servicemen of Armed Forces, it has been decided to introduce a new scholarship scheme known as the Prime Minister’s Scholarship Scheme from the Academic year 2006-07.

UK education fair

MORE than 50 institutions of higher learning in the United Kingdom will be taking part in the Education UK Exhibition to be held in Penang and Kuala Lumpur.

The exhibition will be on at the Traders Hotel in Penang on Oct 3 and at the Kuala Lumpur Convention Centre on Oct 6 and 7.

Five Malaysian universities and colleges will also highlight their range of UK degree programmes, available via 1+2 and 2+1 twinning programmes and 3+0 programmes.

The British Chevening Scholarships for international students to study in the United Kingdom will see a two-fold increase in the number of awards available for Malaysians.

It is hoped that 40 scholarships will be awarded to exceptional students for short-term tailor-made professional courses and long-term postgraduate academic programmes in UK higher education institutions.

The closing date for sending in applications for the 2008/2009 academic year is Oct 15.
Advisers from the British Council will also be on hand to help students with all aspects of education, including application procedures and pre-departure information.

The Commonwealth Scholarship Commission in the United Kingdom (UK) is offering scholarships to Commonwealth students to primarily pursue postgraduate study towards a Master’s or Doctoral degree in the UK from October 2008.The scholarships are intended for persons of high intellectual promise who may be expected to make a significant contribution to their own countries on their return from study abroad.

Through its participation in the Commonwealth Scholarship, the UK seeks to make higher education available to students of the highest ability with the potential to make a real contribution to their home countries. Awards are available in the following categories: one year taught master’s courses or equivalent degree; six months of clinical training in medicine or dentistry; doctoral degrees, of up to three years duration; and one research on a split-site basis towards a PhD registered at a university in the candidate’s home country, if appropriate.Eligibility requirements are as follows:

Candidates should be Commonwealth citizens, refugees or British protected persons permanently residing in a Commonwealth country other than the UK.
 Candidate should hold, or expect to hold by October 2008, a first degree of at least upper second-class honour level or a degree of second class and a relevant postgraduate degree, which will normally be a Master’s degree.
 Be available to commence their scholarship in October 2008.Interested persons who meet the requirements may obtain further information and application forms from the Ministry of Education and Culture, Central Administration Building.

All applications must reach the Ministry on or before Friday, November 30.

With a munificent benefaction from the Bill & Melinda Gates Foundation, the Gates Cambridge Trust has established, with effect from October 2001, a scheme of Gates Cambridge Scholarships for scholars of outstanding academic merit and leadership potential from every country of the world (excluding the United Kingdom), who are committed to serving their communities, and who gain admission to the University of Cambridge. Since 2001, the Gates Cambridge Trust has supported 620 Scholars from 78 countries.

The Gates Cambridge Trust intends to offer a substantial number of awards annually, which will cover the costs of studying at Cambridge for the following courses of study:

Research leading to the degree of PhD
One-year postgraduate courses of study
Second bachelor degree as an affiliated student (see the Undergraduate Prospectus)
Clinical Studies MBBChir degree (see the Medical School webpage)
Some of these awards will be for students from the United States of America; but students from all countries, including countries of the European Union (but excluding the United Kingdom), will be eligible to be considered for a Gates Cambridge Scholarship. As well as being of outstanding academic merit, candidates for these awards must show evidence of leadership potential and a commitment to serving their communities.

The Gates Cambridge Scholarships will cover:

University Composition Fee and College fees at the appropriate 1 rate
a maintenance allowance for a single student (£11,500 for 12 months for 2007–08)
one economy one-way airfare from the scholar's normal country of residence to the UK at the beginning of the course of study or research; and one economy one-way airfare from the UK to the scholar's normal country of residence at the end of the course of study or research.

* The University Composition Fee varies for different types of students and applicants should see 'The costs you will incur' for full details about precise amounts. Where an applicant from overseas has been successfully nominated for an ORS award, the University Composition Fee will be paid at the home rate. Where a student from the European Union has been successful in gaining a fees award from public authorities, the Trust will not pay these fees.

The Sir Ratan Tata Trust awards scholarships to students studying in India covering tuition fee, at the undergraduate or postgraduate level. Hostel and other fee are not covered under the scholarship.
