<p>Below is a summary of a presentation by SCCAW President Dick Cumiskey on February 21, 2013</p>
<p>Why are you here this evening? I know why I am here. For some time now I have been stewing over Utah’s decision to steal one of the greatest assets we have here in Sevier County Utah – our fresh air. You have a God given right to this air. You can purchase bottled water if you don’t like what pours from the faucet. What choice do you have if the air you rely on is suddenly polluted? Bottled air? Imported air? Designer air? That is exactly the dilemma we face if UDAQ is to grant Sevier Power the right to destroy our air. There is no substitute for clean air.</p>
<blockquote><p>Forget the idea of jobs – they will be scarce. Forget tax revenue – that can’t purchase your health. Take the stand that this air belongs to you. Let no one take it away from you.</p></blockquote>
<h3>UDAQ Approves a Pollution right to Sevier Power Company despite public hearing and written comments.</h3>
<p>April 2012 was the publication date for the draft of the Intent to Approve by UDAQ for Sevier Power Co. SCCAW immediately filed to have a public hearing on the draft which was soon scheduled for the end of May. It takes a lot of work to prepare for a hearing of this type as we have to deal with all of the legal ramifications of the order. You well know that one just can’t stand before the hearing board and say “I don’t want a power plant.” No matter how serious you are, that does not constitute a legal argument. The Board of Directors asked each of you to prepare a comment, either in writing or verbal. The BOD prepared both. Many of you either spoke before the hearing board or submitted written comments. For that we thank you.</p>
<p>On May 28, 2012 Sevier Citizens for Clean Air &amp; Water filed comments on the Intent to Approve with the Utah Division of Air Quality covering nine separate challenges to the draft Approval Order. These comments were in addition to the comments made before the Public Hearing which was held the final day of May, 2012.</p>
<p>It was anticipated that at least some of these comments made either at the public hearing or in supplemental written format would have some impact upon the final decision of UDAQ prior to the issuance of an Approval Order. At that time we did not seek to have the Approval Order withdrawn, or even to seek “major modifications.”</p>
<p><strong>Much to our surprise,</strong> the final Approval Order, when issued on October 21, 2012 was nearly “word for word” with the original draft order. We were surprised, shocked and disappointed to say the least. UDAQ effectively threw us into the gutter. The Board of Directors of SCCAW met soon thereafter and it was decided <strong>a protest would be necessary to the Approval Order</strong>.</p>
<p>The Board decided that we might be able to undertake this appeal with the aid of an experienced attorney.</p>
<h3>SCCAW history on appealing to Local Government, UDAQ and Higher Courts</h3>
<p>Going back to 2008 or maybe earlier, probably to when Cindy Roberts and Jim Kennon started to question the viability of the coal plant in 2001. With all of the expertise that was developed in those early years of protests, SCCAW gained recognition and credibility from some of the largest national environmental groups. Grass roots is always the preferred approach with national groups and they liked what they were seeing here in Sevier County. History indicates the local approach is often more effective than a high profile national campaign. SCCAW got the attention of some of the big players. Several of these groups started conversations with us, I’m sure to get a feeling of our dedication and level of expertise. Confidence in our organization encouraged a few to help our cause both with money and legal assistance.</p>
<p><strong>Were we thinking about the Supreme Court at the time?</strong> No. We focused first upon District Court and challenged Sevier County over their land use designation called a Planned Unit Development to Sevier Power. It seemed like the logical place to start. Well, our hopes were dashed! After the brusque brush off we obtained in District Court, we stiffened our resolve and decided we could not drop our rightful claims and just walk away from the situation. Together we resolved that we would appeal the Air Quality permit to UDAQ’s hearing board. That turned out to be a prolonged battle encompassing numerous trips to SLC. We argued the permit together with the <a href="http://www.sierraclub.org/">Sierra Club</a>, each selecting what we believed to be our best and soundest arguments. For those of you who attended and saw the alignment of attorneys and “expert witnesses” opposing us, it was an eye opener.</p>
<p><strong>After being turned down on all points by UDAQ and their board</strong>, we decided to appeal this decision to the Utah Court of Appeals. Even though we lost at UDAQ, we felt confident enough to proceed. It was at that point we began the search for experienced attorneys. You heard the results earlier. Now we were really stepping into the unknown. We would do whatever it took to gain our appeal a fair hearing. Jim commenced working 60 hour weeks, confident that we would prevail. I was developing strategy while Jim was doing most of the research to substantiate our claim.</p>
<p>The Utah Court of Appeals, recognizing that this was both a time sensitive situation and that any decision would be appealed, wisely moved it upstairs to the Supreme Court.</p>
<p>We, of course, fought that appeal to a <strong>successful completion before the Utah Supreme Court</strong>, perhaps the crowning performance for the two of us. It’s hard to describe our feeling when the final decision to remand the Approval Order to UDAQ was announced. “Finally its over. There will be no power plant”</p>
<p><strong>Well, we were wrong again</strong>. Sevier Power came back with a proposal for a natural gas fired plant. By this time Jim Kennon had left this life and I became the president of SCCAW. Now what am I getting myself into was my thought of the day.</p>
<p>Since the proposal for a new gas plant was first made through Sevier County, I felt that our best chances of obtaining a facility that we could live with would be to work with the county in processing the permit. Collectively, the SCCAW Board of directors was not in the mood for an out-and-out rejection of the plant, nor did we believe the local citizens would be that opposed to one. Many were tired of the fight.</p>
<p>The first step would be the Planning Commission. It was apparent from the outset that they were determined to approve the project as submitted and just send their recommendations upstairs to the County Commission. Other than Evelyn Nielson asking what color Sevier Power intended to paint the picnic tables, no recommendations for change were made to the application.</p>
<p>Fortunately the County Commissioners were more amenable to suggestions and SCCAW made quite a few to them. Many of these recommendations were subsequently incorporated into a Sevier County permit, issued in November, 2010. We were at least mollified.</p>
<p><strong>Next up would be the application and Notice of Intent to UDAQ for an air quality permit.</strong> It was then, and only then, that we began to realize the <strong>application for the natural gas fired power plant would be for double the electrical output of the original coal – fired plant</strong>. Why we hadn’t focused on this before is anyone’s guess but that presented a new realization. Now what should we do?</p>
<blockquote><p> While a natural gas plant secretes approximately one half the pollution of a coal plant its equivalent size, doubling its size puts us right back where we were several years ago. The county would not rescind its permit so we had to go after the air quality permit.</p></blockquote>
<p><strong>I initially offered to work with UDAQ</strong> to frame out a permit that might be acceptable to the citizens of Sevier Valley but it did not take long to realize that my input was neither welcome nor would be considered. Foiled again!</p>
<p>Now to return to where I started. In meeting with Marcus Taylor, a well respected local attorney, he agreed to do the legal paperwork to mount a legal challenge and I agreed that SCCAW would undertake most of the strategic research. The formal request for adjudication was filed and I began to develop strategy. Now I am deep in research. My estimate is that 30 hours of my time per week is going into this appeal.</p>
<h3>Current UDAQ situation, State of Appeals</h3>
<p>Since that date of filing, three things have happened – all of them at UDAQ.</p>
<ul>
<li>First, our filing was superseded by a slightly earlier filing by Utah Physicians for a Healthy Environment over the issuance of a permit to expand the oil refineries in Woods Cross, UT.</li>
<li>Second, UDAQ has been unable to complete its required work under an EPA mandate to implement PM 2.5 regulations. These were due in mid-December and are unlikely to be completed before early summer.</li>
<li>Third, the worst winter inversions in decades have befouled the Wasatch front air making it the dirtiest in the nation. You can well imagine how UDAQ is being besieged.</li>
</ul>
<p>Add to that a new process at UDAQ for hearing appeals. No longer will the Air Quality Board directly hear an appeal. Under new legislation, the appeal will be heard by an administrative law judge. To date, no one has been named to this position. Even after someone is named, all the rules and procedures will have to be ironed out. Only after the appeal has been heard and ruled upon by this administrative law judge can the appeal be taken to the court system.</p>
<p>How long will this take? Your guess is as good as mine. My current thinking is that the initial appeal of UPHE will be heard sometime during the summer at the earliest. SCCAW’s appeal could be heard after that.</p>
<h3>SCCAW&#8217;s Appeal to UDAQ and beyond</h3>
<p>There are nine separate items in the appeal.</p>
<ol>
<li>Air monitoring data for Sevier Valley is older than the one year called for in regulations.</li>
<li>After allotment of pollution increments to SPC, there will be little left for future economic development.</li>
<li>The prevailing and dominant, southerly winds in Sevier Valley will impact Utah County disproportionately. Utah County is already “non-attainment.”</li>
<li>Frequent, and persistent, inversion conditions in Sevier Valley will cause entrapment of air borne pollutants. Not accounted for in the Notice of Intent.</li>
<li> There are already an above average number of residents with heart and breathing disorders and a large number of people on oxygen. It will only get worse.</li>
<li>Rocky Mountain Power’s Integrated Resource plan does not call for any added generating capacity to be built in Utah.</li>
<li>There is no demonstrated need for additional generating capacity in central Utah.</li>
<li>The Governor’s Energy plan stresses efficiency, conservation and demand response over new construction.</li>
<li>A unique challenge invoking the Civil Rights Act of 1964, the Clean Air Act and the Americans with Disabilities Act.</li>
</ol>
<p>How is all of this going to play out? We don’t know at this moment. What we do know is that we want someone in the State to take the citizens of Sevier County seriously and listen to our reasoning. We believe we are right and will continue to believe so until proven otherwise.</p>
<p>So what does all of this mean to you? The air you breathe is public property. The purpose of the Clean Air Act was to both protect the air and to prevent further pollution of it. That is the very purpose of SCCAW’s challenge to the Approval Order for Sevier Power. Should two people from Bountiful be allowed to change our lifestyle forever (Sevier Power Company)? When 20,000 of us will have to breathe the consequences? If you value clean, healthy air as much as some of us do, you will get involved with new vigor. Many of us either moved to Sevier Valley or remained here because of its pristine air, water and healthy environment. This is our air!</p>

<p>Now what is the current status of Sevier Power Company?  I understand they have been seeking a way to get natural gas piped from Scipio to Sigurd, Ut, the proposed natural gas power plant site. I have heard quotes of about $45 M as a price. There is no permit or commitment yet for a pipeline to power the proposed power plant. Still no application to hook up to the Sigurd substation or use Rocky Mountain Power’s transmission lines to distribute electricity. Of course they can’t designate where the power is going to until they have a customer. So much for transmission. Rocky Mountain Power’s Integrated Resource plan does not call for any added generating capacity to be built in Utah and there is no demonstrated need for additional generating capacity in central Utah.</p>
<p><strong>Funding and finance outlook</strong></p>
<p>Needless to say there will be no source of funding until a customer is secured. A mortgage lender will only act with a 40 year commitment in hand from a guaranteed customer.</p>

<p>References for this analysis were taken from research done and released through the <a href="http://www.uphe.org/">Utah Physicians for Healthy Environment</a>. This document was compiled for an air quality public hearing in Richfield, UT  and includes the expected adverse health effects from predicted emissions from a proposed 580 MW, combined-cycle, natural gas-fired power plant located near Sigurd, Utah.</p>
<p>Using the below cited published, peer reviewed scientific/academic study findings, and the UDAQ model predictions of emissions (available <a href="http://www.seviercitizensforcleanairandwater.org/wp-content/uploads/2012/06/UDAQ-emissions-for-sevier-power-copy.pdf">here</a> on page 3), I compared the health effect per X pollution factor with the UDAQ predicted emissions and came up with these statistics.</p>
<p>A legal challenge to the UDAQ notice of intent to approve the relevant permit is this plant’s emissions are not consistent with the “adequate margin of safety … requisite to protect the public health” (as required by the Clean Air Act,42 U.S.C. §7401 et seq. (1970) due to the projected adverse health effects outlined in the below summary.</p>
<p>Expected health effects which could be directly attributable to the proposed 580 MW, combined-cycle, natural gas-fired power plant located near Sigurd, Utah:</p>
<p><b>Deep Vein Thrombosis. Increase risk: 560%</b></p>

<p>Increase of 10 ug/m3 PM 10 increases risk of DVT 70%.  The current standard of 150 ug/m3 PM 10 leaves a person at an increased risk of 1050%</p>

<p><b>All causes mortality rate: 10.6 % annually</b></p>

<p>Based on the above statistics, validated by relevant published scientific, peer reviewed studies, the pollution permit being considered should be denied on the basis the expected emissions are not within the “adequate margin of safety … requisite to protect the public health.” as required by the Clean Air Act, 42 U.S.C. §7401 et seq. (1970).</p>
<p>The Utah Department of Air Quality failed to respond to this properly submitted oral and written presentation.</p>

<p><strong>Time and Place:</strong>  Thursday, May 31, 6:00PM in the Sevier County Administration Building, 250 N Main, Richfield.</p>
<p>We have heard many of you say “I don’t know what to say.” For you, we have drafted a number of short speeches that can just be read into the record at the hearing. They will be on hand at the entrance door Thursday.</p>
<h3>Our primary objections to the permit are:</h3>
<ul>
<li>The proposed site is within 1-3/4 miles of 183 homes.</li>
<li>We are in an enclosed valley , surrounded by mountains, forming a bowl to trap pollutants</li>
<li>There has never been an “air quality study” performed in the valley to establish a baseline</li>
<li>We have as many inversions in Sevier Valley as you do along the Wasatch front</li>
<li>We now have nearly <strong>800 residents on supplemental oxygen</strong> – all in a population of just 20,000</li>
<li>We still suffer a very high cancer rate as a result of the “downwinder” exposure 50 years ago</li>
<li>PM 2.5 and PM 10 will be blown north directly into Utah County, already a non-attainment area</li>
<li>This would be a merchant plant – supplying power to someone out of state – leaving the air pollution for us to consume</li>
<li>The plant would needlessly consume pollution increments that might be better allocated elsewhere</li>
</ul>
<p>The closing date for sending written comments to UDAQ is June 7.</p>
<p>Your comments and protests must focus on the content of the Intent to Approve (ITA) which, in turn, is focused on the Notice of Intent (NOI) originally submitted by SPC. <p>This is the text of an announcement SCCAW ran in this week&#8217;s Richfield Reaper</p>
<h2>It&#8217;s Your Air, Not Sevier Power&#8217;s</h2>
<p>Remember, once we let Sevier Power Company sully our clean air – we won&#8217;t get it back. We have existing air pollution in the valley – the exact amount has not been measured. The newest output proposal for SPC&#8217;s power plant will add tons of air pollution each year, according to our Utah Department of Air Quality. This state agency&#8217;s efforts have traditionally protected industry over human health, and that needs to change.</p>
<blockquote><p>Are you aware that the footprint of the proposed natural gas-fired power plant will be nearly twice the size of the ill-conceived coal-fired power plant that was nixed by the Utah Supreme Court? Like it or not, this proposed plant will become the visual focal center of Sevier Valley. Day and night, this will be the image people remember about our valley. Our beautiful night skies will be gone along with our clear air.</p></blockquote>
<p>When the wind blows from the north during the winter months, we all notice the dirty haze that envelops the valley. It remains here, trapped by our surrounding mountains. Where do you think the pollution from Sevier Power&#8217;s proposed plant will go when there is no southerly wind to clear our skies?</p>
<h3>Threat to our tourism</h3>
<p>For many years, we&#8217;ve welcomed riders from across the nation who enjoy our scenic vistas on the ATV Trail. Will their experience be ruined by a blanket of brown haze instead of our beautiful, colorful valley itself? Will winter thermal inversions increase the morbidity in our county?</p>
<p>For those of you who have driven to Disneyland or the Rose Bowl, you know what it is like to descend from the Colorado Plateau into the atmospheric soup of the Los Angeles basin. It could very well be the same descending though Salina Canyon or Clear Creek Canyon. Is that how we want visitors to be introduced to our county?</p>
<p>Many of our neighbors, young and old alike, have health concerns and many will develop pulmonary and other, related illnesses in the near future. It is estimated by Utah Division of Air Quality that 84% of the allowable air pollution as NOx* will be reached soon after the plant&#8217;s operation begins. These amounts are close to the quantities currently exhibited along the Wasatch front. Is this what you want?</p>
<p>Sure, everyone wants, needs and uses electricity, but this plant will not be furnishing it for the citizens of Sevier County. Our power is provided by Rocky Mountain Power / PacifiCorp and RMP has indicated they have no interest in Sevier Power&#8217;s &#8220;merchant plant.&#8221; Someone, somewhere may get the electricity while we are stuck with the deadly, dirty air. Other than the developers, who will benefit from the power generation is still unknown as SPC has yet to announce a customer.</p>

<p>While gas- fired facilities may typically emit half of the air pollutants of a coal-fired plant, <strong>by doubling their output SPC will be emitting the same amount of pollution as their coal-fired plant would have</strong>, minus the airborne mercury associated with burning vast amounts of coal. So, absent the mercury pollution, Sevier County could still experience a massive increase in other air pollutants with inversions in a valley much smaller than that of the Wasatch Front, Utah and Salt Lake Counties.</p>
<p>Our Sevier Valley has frequent and severe atmospheric inversions in numbers almost identical to those occurring in the Salt Lake valley. Our inversions are not as noticeable as Salt Lake City&#8217;s due to far fewer pollutants in our air, at least for now.</p>
<p>This is verifiable and factual information, but the Utah Department of Air Quality does not seem to want be aware of this or to care at all.</p>
<ul>
<li>Air modeling for Sevier Power&#8217;s permit application was done using data from Salt Lake and Utah Counties, Cedar City and Grand Junction, Colorado.</li>
<li>There were no monitoring stations calibrating or benchmarking any data in beautiful Sevier County.</li>
<li>The non-resident industrialists have simply found a new, clean place to do their dirty deeds.</li>
<li>As for local jobs, there will essentially be none. Construction jobs for the facility will go to traveling contractors who specialize in this type of plant construction. Plant operators will be specially educated and highly trained professionals from elsewhere.</li>
</ul>
<p>On Wednesday, April 11, the Utah Department of Air Quality is expected to publish the amount of air pollution in tonnage that they will allow Sevier Power to relentlessly belch and spew into our air 24 hours a day, seven days a week. All so that a very few investors can profit at our expense.</p>
<p>Join the farmers, ranchers, miners and mothers who oppose the permission of any additional air pollutants into our pristine valley. The public comment period will begin anew.</p>

<p>SPC has filed their application with Utah’s Division of Air Quality (UDAQ) on September 9. You may access the application at <a href="http://www.deq.utah.gov/businesses/sevierpower/index.htm" target="_blank">http://www.deq.utah.gov/businesses/sevierpower/index.htm</a>  Latest feedback from UDAQ indicates the department will conclude preliminary approval of the permit on or about the end of February. Following that will be a 30 day Public Comment Period. Public Land Managers have the first opportunity to comment. The entire process could take anywhere from 3 &#8211; 6 months. Please come and see what you can do to monitor this process and make your comments be heard. <strong>When this process is complete we want to assure ourselves that we have been granted the most stringent air quality standards achievable for our communities.</strong></p>
<p>Sevier County Commissioners <strong>NEW MEETING DATES</strong> Second and fourth Monday of each month, all starting at 1:30 PM in the County Administration Building, 250 N Main, Richfield. The Sevier County Planning and Zoning Commission meets the second Wednesday of each month Sevier County Administration Building, 250 N Main, Richfield, 5:30 PM.</p>

<p>The more I think about the natural gas industry, I&#8217;m realizing the bigger picture.</p>
<p>First, the Mining, and Oil/Gas industries supply not only fuel but hydrocarbons for manufacturing so much of what society is consuming. The supply chains feeding plastics, chemical companies, construction industries, the military industrial complex, and more are all based in fossil fuel sourced infrastructures. All these companies have huge market capitalization and have an integral corporate presence keeping the US and World economies going.</p>

<p>Natural gas exploration and drilling mania is feeding and propping up corporations all the way up the supply-to-product and fueling a our massive and growing population. It is eerily similar in structure to economic bubbles past.</p>
<p>Simply changing the source for hydrocarbons to CO2 (something theoretically possible on a massive scale converting CO2 to methane, Ethels and eventually other fuel and manufactured goods using energy from Thorium) would cause such a massive temporary economic disruption due the failing market capitalization of affected corporations, it&#8217;s no wonder the &#8220;free&#8221; market hasn&#8217;t produced the obviously more sustainable alternative.</p>
<p>The inertia to change over to truly clean, safe, cheep and plentiful electric power like <a title="How Thorium makes Fossill Fuels Obsolete" href="http://www.seviercitizensforcleanairandwater.org/blog/how-thorium-makes-fossill-fuels-obsolete/">Thorium</a> (not traditional solar or wind) would literally pop the bubble inflating out dated fossil fuel based corporations. Talk about too big to fail.</p>
<p>Converting to what is going to sustainabley fuel the world population for the next 1000 years will definitely disrupt things as they are. But it doesn&#8217;t have to be fiery cleansing, I&#8217;d like to think it could be accomplished similar to how the Internet came onto the scene. It would create whole new economies and markets. Existing corporations might feel some pain but they have the organization to change over themselves and exploit these emerging markets. I mean, Id rather have this type of job creation than more drilling jobs. Sounds more effective long term to me.</p>
<p>We shouldn&#8217;t be so scared to disrupt things so massively, resurrection into a Greater manifestation is Good right?</p>
