Consistent with the appellant's pleas, a military judge found the appellant guilty of indecent acts and providing alcohol to a minor, in violation of Articles 120 and 134, UCMJ, 10 U.S.C. §§ 920, 934. The military judge sentenced the appellant to a bad-conduct discharge, 30 days of confinement, and reduction to E-1. The convening authority approved the sentence as adjudged. The records shows that the appellant stipulated as fact that he possessed seven images of actual minors engaged in sexually explicit conduct. The child in five of the possessed images has been identified by the National Center for Missing and Exploited Children as being 13 years old at the time she was photographed. Describing these five images, the appellant told the military judge that in three of the images the young girl is nude, her breasts and genitals are exposed, and that some of the photographs are "bondage type" that show the girl "on the floor [with] her hands bound above her head." CORPUS CHRISTI, Texas - An indictment was unsealed on Wednesday, January 5, 2011 charging a Navy lawyer stationed at the local Naval Air Station with receiving and distributing child pornography via his home computer. This indictment was announced by U.S. Attorney José Angel Moreno, southern District of Texas, and acting Special Agent in Charge John Connolly of U.S. Immigration and Customs Enforcement's (ICE) Homeland Security Investigations (HSI).

Lt. Cmdr. Mark Tilford, 43, a Corpus Christi resident and active duty Navy lawyer, was charged in a nine-count sealed indictment returned by a Corpus Christi grand jury on Dec. 20. The indictment was unsealed Jan. 5 after Tilford was arrested at his home by special agents with ICE HSI and the Navy Criminal Investigative Service. Tilford had his initial appearance and arraignment before U.S. Magistrate Judge B. Janice Ellington the same day. The case has been assigned to U.S. District Judge Janis Graham Jack; it has been set for jury trial on March 2. Tilford has been ordered temporarily detained in federal custody pending a hearing on the government's motion to detain him without bond pending trial set for Jan. 7 before U.S. Magistrate Judge Brian L. Owsley.

The indictment accuses Tilford in nine counts of receiving and distributing child pornography via his home computer between July and September 2010. The child pornography allegedly consisted of images and videos of minors engaged in sexually explicit conduct.

The investigation leading to the charges against Tilford was initiated by ICE HSI with the assistance of the Corpus Christi Police Department in July 2010. It involved an undercover Peer to Peer download of child pornography from a computer in Tilford's home.

Both receiving and/or distributing child pornography carry a mandatory minimum term of five years imprisonment up to a maximum statutory punishment of 20 years imprisonment, a $250,000 fine and up to a lifetime term of supervised release, upon conviction.

This investigation was part of Operation Predator, a nationwide ICE initiative to protect children from sexual predators, including those who travel overseas for sex with minors, Internet child pornographers, criminal alien sex offenders, and child sex traffickers.

Mark Tilford has been sentenced to 125 months in federal prison for his convictions of receiving and distributing child pornography, United States Attorney José Angel Moreno announced today. Tilford, who at the time of his indictment and arrest was an active duty Navy JAG Lt. Commander, pleaded guilty on March 17, 2011.

At the time of his guilty plea Tilford acknowledged that in July 2010, a detective with the Corpus Christi Police Department (CCPD), while acting in an undercover capacity, conducted an investigation into the online activities of persons distributing child pornography via peer to peer software. On July 26, 2010, the detective downloaded multiple files of child pornography traced to a computer at Mark Tilford’s residence. As a result, a federal search warrant obtained by federal agents was executed on Tilford’s Corpus Christi home on Oct. 1, 2010. Agents seized several computers and other electronic storage devices. Subsequent forensic analysis of those devices led to the discovery of 266 images and 98 videos of suspected child pornography on two computers, many of which have been identified as containing known victims by the National Center for Missing and Exploited Children.

Tilford has been in custody since his arrest on Jan. 5, 2011, by Navy Criminal Investigative Service (NCIS) and Immigration and Customs Enforcement – Homeland Security Investigations (ICE-HSI), where he will remain pending his transfer to a Bureau of Prisons facility to be determined in the near future.

In sentencing Tilford to the 125-month term of imprisonment, Senior United States District Judge Janis Graham Jack stressed the need to protect the public from Tilford and to discourage others from engaging in similar behavior. Judge Jack also sentenced Tilford to a lifetime term of supervised release and ordered Tilford to register as a sex offender for the remainder of his life. Judge Jack also ordered Tilford to pay $100,000 restitution to his victim.

United States Navy Captain Scott R. McClelland engaged in divers acts of sodomy with a patient who was dependent on him for critical psychiatric treatment for a diagnosed panic disorder who he diagnosed as a sex addict.

Dr. McClelland also attempted to enter into a sexual relationship with another of his patients, CJ. She was the newly married wife of a Marine sergeant, and the appellant had been treating her for bulimia, an eating disorder.

While serving as a psychiatrist at the base mental health clinic, he developed a sexual relationship with his secretary, LD, the wife of a Navy enlisted man. The appellant began by giving LD informal counseling sessions relating to difficulties she was having in her marriage.

McClelland served as the director of clinical services and as a psychiatrist at the Naval Hospital at Marine Corps Base, Camp Lejeune, North Carolina. The case is here.

Defense Department officials launched the Pentagon's newest initiative April 15, 2011 to support victims of sexual assault. The DOD Safe Helpline allows service members to click, call or text for victim support services for themselves or others.

The resource is free, anonymous and confidential. Those who need the service will connect with live sexual assault support professionals. It is live 24 hours a day, every day.

In addition to improving victim care, officials designed the Safe Helpline to be secure and confidential to encourage victims to come forward when they might not otherwise.

"The under reporting of sexual assault poses a serious challenge to military readiness," said Clifford L. Stanley, the undersecretary of defense for personnel and readiness. "We believe the Safe Helpline will provide DOD sexual assault victims with a variety of support outlets, which will lead victims to report sexual assault, seek needed information and receive care."

The Safe Helpline offers three access options designed for service members. Users can go to http://SafeHelpline.org to receive live, one-on-one confidential help with a trained professional through a secure instant-messaging format. The website also provides vital information about recovering from and reporting sexual assault.

A second option is to call the telephone hotline at 877-995-5247 to speak with Safe Helpline staff for personalized advice and support. Safe Helpline staff also can transfer callers to installation-based sexual assault response coordinators, on-call victim advocates, civilian rape crisis centers or to the Suicide Prevention Lifeline.
The third option is for users to text their location to 55247 inside the U.S. or 202-470-5546 outside of the U.S. to receive automated contact information for the sexual assault response coordinator at their installation or base.

Information On 2004 Military Sexual Assaults Released

The Department Of Defense says that in 2004, 1,700 allegations of sexual assault were reported to military criminal investigators from members of the armed forces worldwide. According to the DOD SARP, 1,275 of these cases involved a service-member as a victim and 1,305 incidents involved a service-member as an alleged offender.

This means that 425 of the victims in 2004 were civilian women, children or men.

"Sexual assault is the most under reported crime in American society," said Capt. Michael Landers, 38th Combat Support Wing sexual assault response coordinator.

"We don't want anyone that commits this crime or supports this behavior in our military. Our goal in the KMC is to prevent sexual assault through continuous education and prevention."

Military members who are sexual assault offenders are required to register as sex offenders, to include posting their name, address, picture and offense, on state and local Web sites. Though frequently they don't register and the military does not follow through to ensure registration is completed with civilian authorities.

Offenders are required to notify neighbors, potential employers and landlords of the conviction. Furthermore, states can restrict where offenders are allowed to live, according to the U.S. Air Forces Europe SARC.

U.S. Disciplinary Barracks at Fort Leavenworth Riot Results In Charges

Thirteen inmates at the U.S. Disciplinary Barracks at Fort Leavenworth face charges for their roles in an August 2010 uprising in the prison's special housing unit.

Army spokesman Jeff Wingo said Wednesday the incident occurred
when two inmates in the maximum security wing who were out of their cells for recreation overpowered a corrections officer.

The men then took the keys and unlocked the cells of 11 other inmates. The rest of the 450-inmate prison was locked down without incident while guards regained control of the unit. The inmates involved in the disturbance include six men sentenced to death.

The inmates involved face a several charges, including mutiny and kidnapping.

Four of the inmates have completed general courts martial resulting in sentences of 40 months to 15 years.
