According to the law blog, Criuse Ship Law run by the firm of Lipcon, Margulies, Alsina and Winkleman, two United States Navy seamen stationed in Japan have been accused of rape. Christopher Daniel Browning and Skyler Andrew Dozierwalker, both 23, were arrested after allegedly raping an Okinawa, 27-year-old civilian woman in front of her apartment building, on October 16, 2012.

As a result, Stars and Stripes has reported that a military curfew has been put in place, with no military personnel allowed out from 11pm to 5am and hotel bars and restaurants being considered off-limits.

Seaman Christopher Browning and Petty Officer 3rd Class Skyler Dozierwalker were both sstationed at the Fleet Logistics Support Squadron 59 at the Fort Worth Naval Air Station. The two reservists came to Okinawa from Naval Air Facility Atsugi on Sunday, had to stay overnight due to flight rules and were scheduled to return to the U.S. on Tuesday morning.

The duo were arrested by officials in Japan who say the woman's neck was slashed after the two seamen exited a bar, she ignored their advances and they followed her into an empty street and attacked her.

Browning says he was too drunk to remember what happened, according to the Japanese newspaper Daily Yomiuri Online. The newspaper reports that Dozierwalker told a lawyer both of them committed the crime and that Browning took the woman's belongings and threw them away, after the rape, assault and robbery.

Reports form KTUL say Skyler Dozierwalker, who is from Muskogee, Oklahoma confessed to raping the woman. Browning is from Athens, Texas and says he's innocent.

Of course, we will be watching this case closely and will update when there is any news. If convicted of the aggravated rape, though the crime took place in Japan, both men would likely have lifetime sex offender registration in the states, once they get out of the disciplinary barracks at Fort Leavenworth, Kansas.

"The photographs revealed that Lavena, a small woman, barely 5 feet tall and weighing less than 100 pounds, had been struck in the face with a blunt instrument, perhaps a weapon stock. Her nose was broken and her teeth knocked backwards. One elbow was distended. The back of her clothes had debris on them indicating she had been dragged from one location to another. The photographs of her disrobed body showed bruises, scratch marks and teeth imprints on the upper part of her body. The right side of her back as well as her right hand had been burned apparently from a flammable liquid poured on her and then lighted. The photographs of her genital area revealed massive bruising and lacerations. A corrosive liquid had been poured into her genital area, probably to destroy DNA evidence of sexual assault. Many, if not most sex offenders are not listed in the public database. Megan's Law requires a public database, but doesn't tell the states how to decide who is seen in the public database. SORNA specifically allows the states to decide which sex offenders the state wants to include in the public database.

Jessie K. Timmendequas had two previous convictions for sexually assaulting young girls. In 1979, when he was 18-years-old, he pleaded guilty to the attempted aggravated sexual assault of a five-year-old girl in Piscataway Township, New Jersey. If there was a sex offender registry at that time, Timmendequas would have been a Level One sex offender by today's standards. He would not have been listed on the public registry. He was given a suspended sentence but, after failing to go to counseling, he was sent for nine months to the Middlesex Adult Correctional Center.Still, Timmendequas would have been a Level One sex offender.

In 1981, Timmendequas pleaded guilty in regards to the assault of a seven-year-old girl, and was imprisoned at the Adult Diagnostic & Treatment Center (ADTC) in Avenel, New Jersey for six years and a half years. He had waited in the park for an hour looking for a victim. Two little girls age 7 appeared. When he tried to lure them away, one got on her bike and ran home screaming. Timmendequas had lured the other little girl into the woods with the promise of giving her some firecrackers. He choked her until she turned blue and passed out, saying later that he thought she was dead. The families living in this neighborhood wouldn't have known he was a Level One sex offender by today's standards. His identity would have been protected before this second victim.

He was charged with five felonies including kidnapping and attempted murder. Again he was allowed to plea out in spite of more than enough evidence against him. This is where the anger of Kanka's parents and all parents should be placed. He plead guilty to attempted sexual contact and attempting to cause serious bodily injury, which would get him a Level One sex offender rating in most states, because the crime was only an "attempted sexual contact", not an actual sexual contact. He would have still been hidden on the public registry, if there had been a sex offender registry, the family of Megan Kanka, for which Megan's law was named, still wouldn't have known he was a sex offender.

These are the offenders being protected from public view, which dishonors Megan Kanka and the intent of Megan's Law.

In many states, Level One sex offenders are not listed in the public database. In numerous states, Level Two sex offenders are not listed. In one state, sex offenders who targeted children are NOT listed. Many of these crimes were horrendous, but due to plea deals, were reduced to lower offenses, that qualify the offender for Level One or Level Two monitor and reporting.

When children are involved, plea deals are often reached. This is because the trial further traumatizes the child and because children are unreliable witnesses and cases may be lost as a result.

In the state of Massachusetts, only Level Three sex offenders are listed in the public database, a serious corruption of justice for victims.

The average American believes that the sex offender registries, both national and state, will keep them informed so they can protect themselves and their children. Nothing could be further from the truth.

Every level three sex offender was once a level one sex offender, though he/she may have never been caught. Hiding level one or level two sex offenders from public view, gives the public the highly incorrect impression: 1. The number of sex offenders in their town are very low. 2. There are no sex offenders living next door to them and their childen. 3. Sex offenders are not members within their employment or members of their organization, where children may be present.

All sex offenders need to be on the public registry, in every state, not just the state we live in, so that families traveling can be aware of those sex offenders living in tourism communities they visit.

US Marine Corps Sexual Crime Report For 2011

While some may be surprised at the following report, the log of reported sex crimes in the United States Marine Corps is not really a suprise. The 'unrestricted" report covers adult crimes with the Corp, just those actually reported. We know the amount of sexually-base crimes reported in the civilian sector, is a small fraction of those crimes that actually take place.

We also know the range of alleged crimes is diverse in the civilian sector when it comes to adults reporting the crime, including crimes that involve alcohol or range from an accident of a hand on the shoulder to violent rape and everything in between. There are cases where the alleged assailant says the act was consensual and others were guilt is admitted. Then, there are those cases that are flat out lies, the 'victim' admits the report was fiction.

In the military, we also know that officers and investigations try to persuade some victims to retract their statement or not report the crime for reasons that are unique to the military. The big difference between military crimes and civilian crimes as a whole, is that the crime is reported to the employer, who also investigates the crime and is responsible for taking the case to trial then housing those who are convicted. There is plenty of incentive for the employer, to make cases go away.

That said, if you look at the report below, the range of reported crimes is typical for civilian crimes, as far as diversity. For fiscal year 2011, unrestricted crimes in the USMC, male and female victims, there were 242 official reports. While I won't go on record as saying the USMC is doing all they can to prevent sex crimes or getting convictions, if you take at face value as being fact, you can begin to see the USMC and the military as a whole, face a challenging duty to get convictions, given what they have to work with, when it comes to case details.

Brigadier General Jeffrey A. Sinclair Forcible Sodomy Charge

Brigadier General Jeffrey A. Sinclair has become the highest ranking United States Army officer to be charged with a violent sex crime. The Fort Bragg, North Carolina officer has been charged with a list of crimes and is facing an Article 32 investigation after alleged sex crimes against subordinates.

The charges include alleged forcible sodomy, wrongful sexual conduct, attempted violation of an order, violations of regulations by wrongfully engaging in inappropriate relationships and misusing a government travel charge card, violating general orders by possessing alcohol and pornography while deployed, maltreatment of subordinates, filing fraudulent claims, engaging in conduct unbecoming an officer and a gentleman and engaging in conduct prejudicial to good order and discipline, or of a nature to bring discredit upon the armed forces.

Sinclair was sent back to Fort Bragg in North Carolina from Afghanistan several months ago while serving as deputy commander of the 82nd Airborne Division headquarters.

When I first heard a general was charged with the violent sex crime of forcible sodomy, my gut told me some how, Fort Bragg was involved. I was right. Fort Bragg has one of the worst records for violent crime among military bases. This topic has been covered, here.

If the Army makes an example of Sinclair, gets a conviction, throws the book at him on the forcible sodomy charge, I'm sure the Pentagon will be thrilled. The Pentagon has been under fire for not doing enough to protect military personnel from male sexual attacks, which are mostly on women and for covering up the sexual attacks that do take place.

On February 15, 2011, a class action lawsuit was filed at United States District Court for the Eastern District of Virginia at Alexandria (1:11-cv-00151-LO -TCB ) against Donald Rumsfeld and Robert Gates et all which alleges the military is not doing enough to prevent sexual assaults and when reported covers them up or targets the victim for reprisal. Then, December 9, 2011, the motion to dismiss was granted largely under the grounds that, “ congressionally uninvited intrusion into military affairs by the judiciary is inappropriate”. March 6, 2012, a new class action lawsuit was filed by Ariana Klay in Washington, DC (1:12-cv-00350-ABJ KLAY et al v. PANETTA et al) The defendants listed are: LEON Edward Panetta, Robert M. Gates, Donald Rumfeld, James F. Amos, James T. Conway, Michael W. Hagee, Raymond Edwin Mabus Jr., Donald C. Winter and Gordon England. The listed class action litigants are: Ariana Klay, Elle Helmer, Nicole McCoy, Robin Kahle, Lamanda Cummings, Rebecca Blumer, Erica Dorn, Mariel Marmol, Janet Galla, Carla Butcher, Eric Pratt and Christian Everage. The complaint was amended to add Janet Galla and Carla Butcher on June 3, 2012. All alleged being retaliated against after reporting their rape or sexual assault.

Ariana Klay entered the United States Marine Corp as an officer and alleged she was gang raped at her private residence located one block away from her Marine barracks during a mandatory drinking event sponsored by the command. The entire complaint is here

The motion for dismissal claims qualified immunity and further says that all but four of the complainants are suing for incident that took place outside the three year statute of limitations for Washington DC, a legal, but unconscionable defense for rapes. If nothing else comes of these class action lawsuits, they make sure all levels of federal government are aware of the problem among enlisted as well as officer service personnel.

At the same time, there is push for an official military sex offender registry. A central database was mandated back in 2010 and has yet to be launched. Those pushing for a public database may be disappointed with the results as the database may not become public and instead used by law enforcement.

North Dakota will not put those who offended against children on the public registry.

United States Air Foce Staff Sergeant Christopher D. Guleff confessed to possession of child pornography. The records shows that the appellant stipulated as fact that he possessed seven images of actual minors engaged in sexually explicit conduct. The child in five of the possessed images has been identified by the National Center for Missing and Exploited Children as being 13 years old at the time she was photographed. Describing these five images, the appellant told the military judge that in three of the images the young girl is nude, her breasts and genitals are exposed, and that some of the photographs are "bondage type" that show the girl "on the floor [with] her hands bound above her head." CORPUS CHRISTI, Texas - An indictment was unsealed on Wednesday, January 5, 2011 charging a Navy lawyer stationed at the local Naval Air Station with receiving and distributing child pornography via his home computer. This indictment was announced by U.S. Attorney José Angel Moreno, southern District of Texas, and acting Special Agent in Charge John Connolly of U.S. Immigration and Customs Enforcement's (ICE) Homeland Security Investigations (HSI).

Lt. Cmdr. Mark Tilford, 43, a Corpus Christi resident and active duty Navy lawyer, was charged in a nine-count sealed indictment returned by a Corpus Christi grand jury on Dec. 20. The indictment was unsealed Jan. 5 after Tilford was arrested at his home by special agents with ICE HSI and the Navy Criminal Investigative Service. Tilford had his initial appearance and arraignment before U.S. Magistrate Judge B. Janice Ellington the same day. The case has been assigned to U.S. District Judge Janis Graham Jack; it has been set for jury trial on March 2. Tilford has been ordered temporarily detained in federal custody pending a hearing on the government's motion to detain him without bond pending trial set for Jan. 7 before U.S. Magistrate Judge Brian L. Owsley.

The indictment accuses Tilford in nine counts of receiving and distributing child pornography via his home computer between July and September 2010. The child pornography allegedly consisted of images and videos of minors engaged in sexually explicit conduct.

The investigation leading to the charges against Tilford was initiated by ICE HSI with the assistance of the Corpus Christi Police Department in July 2010. It involved an undercover Peer to Peer download of child pornography from a computer in Tilford's home.

Both receiving and/or distributing child pornography carry a mandatory minimum term of five years imprisonment up to a maximum statutory punishment of 20 years imprisonment, a $250,000 fine and up to a lifetime term of supervised release, upon conviction.

This investigation was part of Operation Predator, a nationwide ICE initiative to protect children from sexual predators, including those who travel overseas for sex with minors, Internet child pornographers, criminal alien sex offenders, and child sex traffickers.

Mark Tilford has been sentenced to 125 months in federal prison for his convictions of receiving and distributing child pornography, United States Attorney José Angel Moreno announced today. Tilford, who at the time of his indictment and arrest was an active duty Navy JAG Lt. Commander, pleaded guilty on March 17, 2011.

At the time of his guilty plea Tilford acknowledged that in July 2010, a detective with the Corpus Christi Police Department (CCPD), while acting in an undercover capacity, conducted an investigation into the online activities of persons distributing child pornography via peer to peer software. On July 26, 2010, the detective downloaded multiple files of child pornography traced to a computer at Mark Tilford’s residence. As a result, a federal search warrant obtained by federal agents was executed on Tilford’s Corpus Christi home on Oct. 1, 2010. Agents seized several computers and other electronic storage devices. Subsequent forensic analysis of those devices led to the discovery of 266 images and 98 videos of suspected child pornography on two computers, many of which have been identified as containing known victims by the National Center for Missing and Exploited Children.

Tilford has been in custody since his arrest on Jan. 5, 2011, by Navy Criminal Investigative Service (NCIS) and Immigration and Customs Enforcement – Homeland Security Investigations (ICE-HSI), where he will remain pending his transfer to a Bureau of Prisons facility to be determined in the near future.

In sentencing Tilford to the 125-month term of imprisonment, Senior United States District Judge Janis Graham Jack stressed the need to protect the public from Tilford and to discourage others from engaging in similar behavior. Judge Jack also sentenced Tilford to a lifetime term of supervised release and ordered Tilford to register as a sex offender for the remainder of his life. Judge Jack also ordered Tilford to pay $100,000 restitution to his victim.

Raymond Paul Olafson was found guilty of rape, indecent liberties with a female under the age of 16, and two specifications of indecent assault in violation of Articles 120 and 134, Uniform Code of Military Justice, 10 U.S.C. §§ 920 and 934. United States Navy Quartermaster Troy B. Jenkins was tried by a general court-martial composed of a military judge sitting alone. Consistent with his pleas, the appellant was convicted of rape and forcible sodomy. Contrary to his pleas, the appellant was convicted of committing an indecent act by engaging in sodomy with the victim of the rape and forcible sodomy, while in the presence of another person. Navy Captain Dr. Scott R. McClelland Has Sex With His Psychiatric Patients

United States Navy Captain Scott R. McClelland engaged in divers acts of sodomy with a patient who was dependent on him for critical psychiatric treatment for a diagnosed panic disorder who he diagnosed as a sex addict.

Dr. McClelland also attempted to enter into a sexual relationship with another of his patients, CJ. She was the newly married wife of a Marine sergeant, and the appellant had been treating her for bulimia, an eating disorder.

While serving as a psychiatrist at the base mental health clinic, he developed a sexual relationship with his secretary, LD, the wife of a Navy enlisted man. The appellant began by giving LD informal counseling sessions relating to difficulties she was having in her marriage.

McClelland served as the director of clinical services and as a psychiatrist at the Naval Hospital at Marine Corps Base, Camp Lejeune, North Carolina. The case is here.
