DUI in Arizona - Ten Things You Must Know About DUI Law...Before You Get Stopped

2009-10-27T01:31:00.000-07:00

Arizona and every other state has DUI laws that are meant to stop drivers from getting behind the wheel of a car after a few glasses of wine, or beer, or alcohol. The limit in our state, sometimes ironically called the "legal limit," is .08%. The best advice any attorney can give you is don't drink and drive. Period. Imagine how many cab rides you can pay for with the money you'd spend on fines and attorneys' fees in a DUI case.

So, let's say you've left the party thinking you're okay to drive only to have the flashing red and blues greet you. How to handle the DUI stop? First, stay in your car unless the officer asks you to step out and if you have your seat belt on, leave it on! Second, know these ten things:
6 - Take a breath, blood or urine test if one is offered. When your driver's license was issued, you agreed to take such a test if you were ever pulled over. It's called the Implied Consent Law and even if you don't remember agreeing, you did. If you don't take the test, your license will be suspended for a minimum of one year, even if you are not convicted of DUI. If you take the test and the reading is greater than .08%, your license will be suspended from 30 to 90 days.

After the investigation on the street, the officer will usually take you to the station or to a testing site. Some cities will offer you a blood test, others will offer a breath test. If your test shows your blood alcohol concentration (BAC) to be less than .08%, you may not be charged. If you are, you might be able to later have the case dismissed. If your BAC is .08% to .14%, you will be charged with DUI, and DUI with a BAC over .08%. If your BAC is .15% or more, you will be charged with DUI, DUI with BAC over .08%, and Extreme DUI.

7 - After completing the test, the officer may give you a form that asks whether you want to preserve a sample of your test or waive a sample. NEVER waive! Always ask that a sample be preserved if you are given that choice.

8 - As soon as you are released, go to a hospital, a lab, or call your doctor to arrange to have your own test done immediately. If that test shows a lower BAC, you can use it in your case. If the level is the same or higher, you need not provide that information to the prosecutor.

9 - If you don't want to lose your license, ask for a hearing at the Motor Vehicle Division within fifteen days. The officer will give you a form when he or she takes your license. This Admin Per Se/Implied Consent Affidavit has a paragraph telling you how to request a hearing.

If you are charged with DUI, you are not required to have an attorney. In some cases, a court will appoint one for you. At any stage in the process, you might choose to hire an attorney to help you with your case. If you understand intoxilyzers and how they operate, you can handle the case yourself. If you can interview police officers and question witnesses at trial, you can handle the case yourself. Or if you just feel better walking in and pleading guilty, you can handle the case yourself.

10 - If you decide to hire an attorney, find one who has experience with DUI cases. Hire a qualified attorney you trust, an attorney you meet in person at your first consultation. A good attorney will personally appear in court on your behalf, interview the officer, gather records, prepare motions, and negotiate with the prosecutor. A good attorney will keep you informed about the progress of your case, but don't expect a daily call! Beware of attorneys you don't meet until your first day in court or who aggressively go head to head with the prosecutor during pretrial negotiations. You need an advocate who won't alienate the other side and paint you into a corner.

There are minimum mandatory fines and jail for DUI convictions:

Charge: DUI

Proof: Impaired to the slightest degree

Minimum Mandatory Sentence: 10 days in jail with 9 days suspended if you complete alcohol education; $250 fine plus 80% surcharge plus other fees (usually around $600 total; attend an alcohol screening and education

Maximum Sentence: 6 months jail, $2500 fine plus 80% surcharge and other fees; 3 years probation

Charge: DUI with BAC of .08% or more

Proof: BAC of .08% or more

Minimum Mandatory Sentence: 10 days in jail with 9 days suspended if you complete alcohol education; $250 fine plus 80% surcharge plus other fees (usually around $600 total; attend an alcohol screening and education

Maximum Sentence: 6 months jail, $2500 fine plus 80% surcharge and other fees; 3 years probation

Charge: Extreme DUI

Proof: BAC of .15% or more

Minimum Mandatory Sentence: 30 days jail with 20 days suspended if you complete alcohol education; $250 fine plus 80% surcharge plus $250 assessment fee plus other fees (usually around $750 total; attend an alcohol screening and education; equip your car with an Ignition Interlock Device

Maximum Sentence: 6 months jail, $2500 fine plus 80% surcharge and other fees; 3 years probation

Do you really need to take a cab after only one drink? No, not after one ounce of alcohol. Generally speaking, your blood alcohol level rises about .025% for each drink you have. The actual percent is based on your weight, sex, and other factors. Your body eliminates alcohol over time. And now there are relatively inexpensive devices to test your alcohol level. Local stores and catalogs carry breath testing devices for under $50. Since all devices have an error factor, don't drive if yours reads .05% or over. But remember, the state doesn't have to prove you had a .08%, you are guilty if your ability to drive is impaired to the slightest degree.

The safest bet is to drive sober always. You're more likely to get where you're headed without that stop at the police station! You're less likely to need an attorney, pay fines, go to jail, pay higher insurance rates, and lose your driving privilege. . . or you could always call a cab.

1 - Provide identification. The officer will ask for your driver's license and registration. How easily you find these items will be noted on the officer's report. If you fumble around for them, it will look like you've had too much to drink.

2 - Politely refuse to take field tests. Field tests for DUI are: walking the line, touching your finger to your nose, counting on your fingers, saying your ABCs, holding your leg up while counting, and HGN, the one where the officer asks you to follow a light with your eyes. When you do field tests, you are giving evidence that will be used against you. There is no law requiring you to do the tests. Some officers will tell you they will take you to jail if you don't do the tests. Don't fall for it. They were going to take you to jail anyway.

3 - If asked, politely explain that you will not agree to a search of your car. If the officer has to ask you to agree, it's a red flag. Just say no. If an officer has enough reason to get a search warrant, he or she will. If not, then why search? Usually the question will come at you like: You don't mind if I look in your car, do you? You don't have a problem with my looking in your car? I'm just going to take a quick look inside, okay? Say no--politely, but firmly--and don't explain. And hope your no makes it into the report.

4 - Politely refuse to answer questions. Usually the officer will ask you a few questions about what you've had to drink and then move on to more questions later at the station. Your best response is: "I can only answer your questions on the advice of my attorney." You don't have to call an attorney right then. The statement effectively stops any questioning of you by invoking your constitutional rights. Even when the officer reads Miranda rights to you, the answer should be the same.

5 - Cooperate, cooperate, cooperate. Cooperation means having a good attitude and being polite. It doesn't mean answering questions or doing field tests or talking. Your attitude, appearance and words all become part of the officer's report. Your disposition indicates your level of intoxication. This is not the time to crack jokes, cry, apologize or confess.

DUI Phoenix Arizona

2009-10-27T01:29:00.000-07:00

The following information about DUI and your driver license rights in Arizona was provided by a Tucson attorney, David Alan Darby.

If you find yourself arrested for Driving Under the Influence of Alcohol (DUI) in the State of Arizona, and you have submitted to a breath, blood, or urine test, and the results of the test reveal a blood/breath alcohol result of .08% or higher, or you have refused these tests, you can expect to be involved in two separate legal proceedings.

1.A criminal proceeding in court

2.A civil proceeding with the Department of Motor Vehicles (MVD) and the likely suspension of your driver license.

These two proceedings are mutually exclusive; the outcome of one will not affect the other. You could win both matters or lose both matters. How the MVD driver license hearing is handled is extremely important.

The Criminal Proceeding

Your DUI arrest begins your criminal proceeding. The consequences of this -- plea of guilty, or a verdict of guilty following a jury or bench trial -- could result in mandatory jail time, fines, fees and assessments, supervised or unsupervised probation, as well as a criminal record.

The Civil Proceeding

The civil proceeding is conducted before an administrative hearing officer at the MVD. This proceeding deals with a possible suspension of your driver's license, or if from out of state, your privilege to drive in Arizona.

The arresting police officer will serve you with a "Notice of Suspension." If you have been arrested in Arizona for DUI and you take a breath, blood or urine test, and the results measured a alcohol concentration of .08% or more within 2 hours of driving, or you refuse to take the blood, breath or other chemical test, the arresting police will serve you with a 90 day driver license suspension notice, or in the case of refusal, a 12 month driver license or driving privilege suspension. The police should give you two copies of this form.

Arizona Residents

If your test results indicate a result of .08% or higher, the police will seize your Arizona driver license, and issue you a temporary license which is valid for 15 days, or, if you request a hearing within the 15 day window, until the hearing is conducted and the outcome determined. Since the police confiscated your driver license, the yellow copy of the suspension notice is your temporary driver license.

Non-Arizona Residents

If you are from out of state, the police cannot seize your driver license. They will serve you with a notice of suspension of your privilege to drive in Arizona. The suspension will take effect 15 days after service unless you request a hearing within the 15 days. If a hearing is requested, your privilege to drive in Arizona will not be suspended until the hearing is conducted and the outcome determined.

Refusal

If you refused to take the breath, blood or urine test, the police will serve you a notice of a 12-month suspension of your driver license, or privilege to drive if you are from out of state. This suspension becomes effective 15 days from the date of service unless you request a hearing. If a hearing is requested your driver license or privilege to drive in Arizona will not be suspended until the hearing is conducted and the outcome determined. If your refused to take a breath, blood or urine test, it is likely that the police obtained a search warrant and obtained your blood anyway. If this is the case, your driver license or privilege to drive will still be suspended for 12 months even though the police obtained your blood through the use of a search warrant.

How to Request A Hearing

A request for hearing must be submitted in writing to the MVD. Generally, the pink copy of suspension form, furnished by the police, is used to request this hearing. It is important to fill out the information completely and accurately on the back of the pink form. You must check the box indicating you are requesting an Administrative Hearing and mail it, within 15 days of service to you by the police, to: Arizona Department of Transportation, Executive Hearing Office, Mail Drop 507M, P.O. Box 2100, Phoenix, AZ 85001-2100. Do not select Summary Review; this will not get you a hearing, but merely a review of the paperwork submitted by the police.

Why Is This So Important

In the criminal case, if you plead guilty to the charge of DUI, or if you are found guilty, you will be sentenced in accordance within the present Arizona DUI sentencing guidelines. When the State receives notification of the verdict, your driver license will be suspended for 90 days. However, if you are a first offender, or you have had no DUI convictions within the past five years, and if you took the breath, blood or other required test, and if you have been found guilty in the criminal proceeding, or you feel that such a result is likely, then you may wish to agree to a suspension of your driver license prior to or at the MVD hearing.

Advantages of Agreeing to the Suspension

Agreeing to the suspension will entitle you to a 60 day restricted driving permit following a 30 day suspension. The suspension is still classified as a 90 day suspension. To obtain the restricted driving permit, you must apply at a local MVD office following the first 30 days of the suspension.

Agreeing to the suspension will generally resolve the civil proceeding sooner and oftentimes well before the resolution of your Criminal matter in court. This is advantageous as you get the suspension over with sooner and under less onerous circumstances.

Agreeing to the suspension will generally result in no further suspension of your driver license if you later plead or are found guilty of your DUI in court.

In the case of a stipulated suspension from MVD, there will be no requirement that you post proof of Financial Responsibility before your Arizona driver license or privilege is reinstated.

Agreeing to the suspension will allow you to select the day you want your suspension to begin, so long as the suspension start date is within 45 days of your MVD hearing date. This allows flexibility in arranging transportation to work or school during the initial 30 days of the suspension. NOTE: If you request a hearing and actually go through with it and lose, the only difference is that your will not be able to choose the day the suspension begins. You should still be eligible for the 30 day driver license suspension followed by the 60 day restricted driving permit.

Disadvantages of Agreeing to the Suspension

If you agree to the suspension, you do not get a hearing with the administrative law judge. You do not get to challenge the police officers or contest the evidence in the civil hearing. Sometimes this hearing may be important to gather critical evidence in your DUI case. However, this decision should not be made without first discussing your DUI case and individual circumstances with an experienced DUI defense attorney.

Disadvantages of Having the Administrative Hearing

If you have the Administrative Hearing and win, and later lose your DUI case, either through a plea or finding of guilty at trial, MVD will suspend your driver license for 90 consecutive days. There is no eligibility for a restricted driving permit following the first 30 days of the suspension.

Further, if you are convicted either through a plea or finding of guilty in court you will be required to provide proof of financial responsibility (insurance) for three years by filing with the State of Arizona either a $40,000 cash deposit, or Certificates of Deposit (CD's) totaling $40,000 or a Certificate of Insurance (SR22). This Financial Responsibility requirement could have significant cost implications for you, depending upon your selection of acceptable Financial Responsibility filings and/or your insurance carrier's underwriting requirements.

Final Thoughts

Prior to or during the MVD hearing, you may ask the administrative law judge any questions that you may have concerning these suspensions and their effects, but remember that the Judge cannot give you legal advice as to what you should do. The administrative law judge works for the State of Arizona, and is not necessarily there to help you. In all instances, it is important to understand your legal rights. Only a qualified and experienced DUI defense attorney can explain these rights to you.
