										<content:encoded><![CDATA[<p>California State Parks Division of Boating and Waterways has a new requirement for persons who operate any motorized vessel on state waterways, including powered sailboats and paddle craft to carry a boater card.</p>
<p>Each year after January 2018, a new age group will be added to those who are required to possess a valid card. By 2025, all persons who operate on California waters will be required to have one. Once issued, the card remains valid for a boat operator’s lifetime. California Harbors and Navigation Code Section 678.11(b) contains the following phase-in schedule based on operator age:</p>
<ul>
<li>January 1, 2018 – Persons 20 years of age or younger</li>
<li>January 1, 2019 – Persons 25 years of age or younger</li>
<li>January 1, 2020 – Persons 35 years of age or younger</li>
<li>January 1, 2021 – Persons 40 years of age or younger</li>
<li>January 1, 2022 – Persons 45 years of age or younger</li>
<li>January 1, 2023 – Persons 50 years of age or younger</li>
<li>January 1, 2024 – Persons 60 years of age or younger</li>
<li>January 1, 2025 – All persons regardless of age<a href="http://californiaboatercard.com/about-the-card/">http://californiaboatercard.com/about-the-card/</a>Copies of “A Course for Safe Boating” with exam materials are available in the Marina office.</li>

										<content:encoded><![CDATA[<p>Due to several vessels becoming snagged on torqued tires and environmental concerns, beginning October 1, 2013, the San Francisco Marina Small Craft Harbor will no longer supply tires and chain for securing vessels to center fender pilings. All berthodlers that wish to tie their vessels to center fender pilings, either in the West Basin or the East Basin, must purchase the approved “Tidemiders” product. Tideminders can be purchased at West Marine or online at <a href="http://www.tideminders.com">www.tideminders.com</a>.  These are a series of positively buoyant balls with a hole in the middle to string your mooring line through, which allow the line to safely move up and down the piling without becoming snagged. The Tideminder balls can be captured in the desired place on your mooring line with figure 8 knots.</p>
<p>If you wish to have a line holder installed on your piling, the Marina will install the line holder at no cost to you. However, you must purchase the approved line holder from West Marine for $11.99, Dock Edge, Dock Line Holder, model #4603767, manufacturer #91-409-F. You can also purchase the line holder online at <span style="text-decoration: underline;">www.westmarine.com.</span>  After purchasing the line holder, simply drop the line holder by the Marina Office and Marina Staff will install it at your desired height based on your vessel freeboard.</p>

										<content:encoded><![CDATA[<p>Phase 2 in-water construction is currently underway.  The Contractor completed demolition or C and E Docks [those accessed off the West Mole] during the first two weeks of April.  Intense construction activities in the vicinity of the West Mole will continue throughout the month.  Work in the area will include the installation of the new masonry cap at the termination point of the West Mole, removal of the Mole&#8217;s below water foundation, and preparation for the installation of the new concrete docks which will begin to arrive on-site toward the end of the month. Quality rip-rap extracted from the mole’s foundation will be reused to shore-up the eroding south face of the jetty east of the Golden Gate Yacht Club.</p>
<p>Work on the harbor building is running several weeks behind schedule.  The Contractor is now working toward an early May deadline to reopen the office, shower facilities and restrooms.  Other land-side work underway this month include the installation of the new fire water line at the intersection of Marina Blvd. and Scott Street, the construction of the trash enclosure east of the harbor office, and continued work on utility installation on both the north and south sides of the harbor.  Boaters should note that parking stalls in the vicinity of the harbor office may be temporarily unavailable due to utility trenching that will take place over the next several weeks.</p>
<p>Boaters are reminded that during the driving of piles and installation of new docks in the inner-basin, access to vessels moored off the Marina seawall may be restricted due to the presence of construction equipment and silt curtains. Our Contractors will do their best to provide clear passage for vessels entering and exiting the harbor. However, boaters in the inner-basin should expect periodic delays during weekday working hours over the course of the next several months. Whenever possible, we ask that boaters moored in the inner-basin contact the Harbor office prior to scheduling a trip to confirm that the fairways will be clear of construction vessels and equipment. Again, we appreciate your patience.</p>
<p><em>For your information</em>, this spring a number of capital projects unrelated to the harbor renovation will begin in and around the Marina Green.  You may have noticed that work is already underway at the intersection of Marina Blvd. and Yacht Road. Construction crews are in the processes of modifying the ‘4-corners’ intersection in preparation for of the soon to be completed Doyle Drive bypass.  The Department of Public Works has recently completed the paving and curb-cut installations along Marina Blvd. between Yacht Road and Scott Street  DPW crews will continue to work their way eastward through the end of the month.  Finally, in the coming weeks construction of a new restroom structure on Little Marina Green [along Yacht Road] is scheduled to begin.  The new structure will replace the aging clay-tile roofed structure, housing new restroom facilities and support space for RPD operations [including more space for harbor staff].  The project is funded through the 2008 Clean and Safe Neighborhood Parks Bond Restroom Replacement Program.</p>

										<content:encoded><![CDATA[<p>March is set to be an exciting month in the Marina.  Beginning March 17, the first lot of newly constructed docks and slips will be opened for boat occupancy.  During the course of the last two weeks of the month, the Harbormaster will begin directing boaters toward new, temporary slips assignments in anticipation of the start of Phase 2 dock construction.  Some lucky boaters will receive temporary assignments in one of the new, upgraded slips constructed under Phase 1 of the project.  Boat movement in March will focus on vacating all the existing docks located west of the Harbor office and accessed off the West Mole [Docks C and E].</p>
<p>Phase 2 in-water work will begin with the demolition of all the existing wood docks immediately north and south of the West Mole.  If boat relocation goes smoothly, the Contractor’s barge should pull up and begin working in the area on March 26.  Boaters should be aware that during demolition of docks and pulling of piles in the inner-basin, access to vessels moored off the Marina seawall may be restricted due to the presence of construction equipment and the silt-curtains.  Our Contractors will do their best to provide clear passage for vessels enter and exiting the harbor.  However, boaters in the inner-basin should expect periodic delays during weekday working hours over the course of the next several months.  Whenever possible, we ask that boaters moored in the inner-basin contact the Harbor office prior to scheduling a trip to confirm that the fairways will be clear of construction vessels and equipment.  We appreciate your patience.</p>

										<content:encoded><![CDATA[<p>As a result of overwhelming community feedback, the Marina Operating Policies Project timelines have been extended by thirty days.  As communicated in previous communications, including the Dec. 7<sup>th</sup> and Jan. 25<sup>th</sup> public meetings, a community process has been developed with a goal to engage the public and potentially affected stakeholders in a constructive policy dialogue on (1) updating the Marina Rules and Regulations; and (2) developing a berthing assignment policy to populate the west basin post-renovation.</p>
<p>To that end goal, the Department continues to tap on the collective views of all potential affected stakeholders.  In addition, the Department is currently  exploring the spectrum of issues associated with public access to San Francisco’s Marina and best management practices for the management of our public asset.  The competing and conflicting viewpoints are being distilled, as postulate by community feedback.</p>
<p>It is the Department’s intent to formulate general non‐binding recommendations for the Recreation &amp; Parks Commission to consider in their decision‐making. The recommendations will be made available for public review on our website no later than March 26<sup>th</sup>, 2012 (<a href="http://www.sfrecpark.org/">www.sfrecpark.org</a>).</p>

										<content:encoded><![CDATA[<p>The West Harbor construction site was relatively quite during the month of January.  Crews continued work on the Harbormaster Building and subsurface utility trenching and installation on the North Jetty and around Scott Street.  Demo of the end of the West Mole was completed down to the waterline.  Demolition down to target depth will resume when the in-water work window reopens in June. </p>
<p>February will see much of the same type of work.  Water and utility lines serving the docks east of the Golden Gate Yacht Club is next on the schedule.  Crews will try their best to keep the narrow drive out to the club open to vehicles, but users are asked to be patient and whenever possible park by the trailer and walk when you see equipment performing work.</p>
<p>Some of the more anticipated amenities of the renovation project are starting to appear.  Gangways, dockside transformers, fire hose boxes, dock boxes, pile-caps and gates are arriving on site for installation throughout the month of February.  Electrical pedestals will begin arriving on site in late February and installation will be ongoing into March.  Final float adjustments, system testing, and inspections will begin around March 1.  After sign-off the Harbormaster will begin populating the new docks to make way for Phase 2 construction.</p>
<p>Looking ahead to March, boaters on docks served off the West Mole will be temporarily relocated to make way for demolition and construction of new docks on both the north and south side of the mole.  If all goes as planned, the renovated harbormaster building, with freshly renovated boater showers, will reopen toward the end of the month.</p>

<p align="center">RULES AND REGULATIONS OF THE</p>
<p align="center">SAN FRANCISCO MARINA SMALL CRAFT HARBOR</p>
<p>&nbsp;</p>
<p>SECTION 1 &#8211; DEFINITIONS</p>
<p>Whenever any of the words hereinafter defined are used in the Rules and Regulations, they shall be construed to mean the following:</p>
<p>&#8220;San Francisco Marina Small Craft Harbor&#8221; shall include both the East Basin and West</p>
<p>Basin, and entrances thereto, and hereafter referred to as &#8220;Marina&#8221;.</p>
<p><del datetime="2012-01-19T08:13">Marina Manager </del>&#8220;Harbormaster&#8221; shall mean the Marina Manager of the San Francisco Marina Small Craft Harbor.</p>
<p>&#8220;General Manager&#8221; shall mean the General Manager, Recreation and Park Department of</p>
<p>the City and County of San Francisco.</p>
<p>&#8220;Berthholder&#8221; or &#8220;Owner&#8221; shall mean the owner of the vessel named in the Berthing Agreement.</p>
<p>&#8220;Charter Vessel&#8221; shall mean any vessel carrying passengers for hire.</p>
<p>“Vessel&#8221; means any boat, watercraft or other vessel in, entering, or departing the Marina.</p>
<p>&#8220;Person&#8221; means any person, including an Owner, using theMarina.</p>
<p align="left">&#8220;Berth&#8221; means a berth or mooring in theMarinaand (if applicable) a storage place ashore within theMarina, and the word Berthing shall be construed accordingly.</p>
<p align="left">“Berthing License” means the contract under which the Owner is granted the right for his Vessel to occupy a Berth in theMarina.</p>
<p align="left">“Hot Work” means any activity generating a naked flame, spark or hot gas, and includes the use of BBQs and other cooking apparatus on the deck of a Vessel.</p>
<p align="left"> </p>
<p>SECTION 2 &#8211; <del datetime="2012-01-19T08:16">Marina Manager </del>HARBORMASTER: AUTHORITY</p>
<p>The <del datetime="2012-01-19T08:16">Marina Manager </del>Harbormaster, acting under the orders and supervision of the General Manager, subject to the approval of the San Francisco Recreation and Park Commission, shall have full authority in the interpretation and enforcement of all Rules and Regulations pertaining to the Marina, and all orders given in the performance of his/her duties shall be obeyed.</p>
<p>Every boat entering theMarinashall immediately become subject to the authority and direction of the<del datetime="2012-01-19T08:16"> Marina Manager</del> Harbormaster.</p>
<p>Every boat shall be berthed in the space assigned by the <del datetime="2012-01-19T08:17">Marina manager </del>Harbormaster.</p>
<p>All Persons shall comply with the Harbormaster’s instructions that relate to the safe, efficient, and peaceable operation of theMarina.</p>
<p align="left">Persons shall at all times be attentive to their own behaviour and to the behaviour of their family and guests, and shall not allow anything to take place at the Marina that is illegal or which might reasonably be expected to cause annoyance, nuisance, or offence to nearby property or to other Persons (e.g. loud audio equipment, inconsiderate or anti-social behaviour, bad language, disrespect to local custom, inappropriate modes of dress).</p>
<p>&nbsp;</p>
<p>SECTION 3 &#8211; BERTHING</p>
<p>A. <del datetime="2012-01-19T08:04">There are two classes of berth rentals in the Marina: permanent and transient. </del></p>
<p><del datetime="2012-01-19T08:04"></del><del datetime="2012-01-19T08:04">1. Permanent rentals are made to owners desiring to berth their boats for a period </del><del datetime="2012-01-19T08:04">one month of longer. </del></p>
<p><del datetime="2012-01-19T08:04">2. Transient rentals, as available, are assigned to owners desiring to berth their boats </del><del datetime="2012-01-19T08:04">for less than one month. </del>There are four classes of berthing licenses in theMarina are: Annual (365 days), Seasonal (3 to 6 months), Monthly (1 to 3 months) and short term (Daily).</p>
<p>B. Applications for berths in the Marinashall be made to the <del datetime="2012-01-19T08:19">Marina Manager </del>Harbormaster on the form furnished by him/her. Berth assignments will be made according to the Waiting List Procedures adopted by the San Francisco Recreation and Park Commission unless the provisions of paragraph D of this section are invoked.</p>
<p>C. Each boat shall be berthed in the space assigned by the<del datetime="2012-01-19T08:20"> Marina Manager</del><ins cite="mailto:John%20Moren" datetime="2012-01-19T08:21"> </ins>Harbormaster.</p>
<p>D. <del datetime="2012-01-19T08:22">An Owner, upon a bona fide sale of the boat berthed therein, with the prior approval of </del><del datetime="2012-01-19T08:22">the Marina Manager and the payment of the transfer fee, may assign the berth to the  </del><del datetime="2012-01-19T08:22">buyer of the boat; conversely, he/she may, upon approval of the Marina Manager, retain </del><del datetime="2012-01-19T08:22">this same berth assignment for another boat owned by him/her provided the latter boat is </del><del datetime="2012-01-19T08:22">within the classification of the berthing space assigned. </del>An owner, upon a bona<ins cite="mailto:John%20Moren" datetime="2012-01-19T08:46"> </ins>fide sale of the boat currently under Berthing License with the Marina, may transfer the Berthing License to a new vessel of proper size with the approval and inspection of the Harrbormaster if the new vessel is registered in his name. The berth may not be transferred to the new owner of the vessel. An Owner, upon a bona fide sale of his vessel, may be released from his Berthing License and the berth will defer back to the management of the Harbormaster, No refund will be given to the Owner that requests cancellation of a Berthing License due to bona fide sale of vessel. The Berthing License is valid only for the Owner and the Vessel named on it, and it is not transferable.<ins cite="mailto:John%20Moren" datetime="2012-01-19T08:51"> </ins></p>
<p align="left">An Owner may terminate his Berthing License at any time. Berthing License fees will not be refunded unless the circumstances are exceptional, and then only at the Harbormaster’s sole discretion.</p>
<p>E. Any sale, purchase or exchange of boats occupying permanent berths in the Marina must immediately be reported to the Harbormaster.</p>
<p>F. <del datetime="2012-01-19T08:36">The holder of a permanent berth assignment who desires to temporarily vacate his/her </del><del datetime="2012-01-19T08:36">berth for a period of six (6) months or less may, subject to the prior approval of the </del><del datetime="2012-01-19T08:36">Marina Manager, sublet said berth to another boat owner provided the vessel is within the </del><del datetime="2012-01-19T08:36">classification of the berth. The original Berthholder assigned, in such instances, shall </del><del datetime="2012-01-19T08:36">continue to be responsible for the payment of the berthage fee, and any taxes incident </del><del datetime="2012-01-19T08:36">thereto, including possessory interest tax. The Berthing Agreement shall continue in the </del><del datetime="2012-01-19T08:36">name of the original Berthholder. At the expiration of the sublet period, the Berthholder </del><del datetime="2012-01-19T08:36">and sublessee must relinquish the berth if the Berthholder does not return a vessel owned </del><del datetime="2012-01-19T08:36">by him/her to said berth.</del>While a vessel is assigned to a specific berth, the Harbor Master retains the assignment right at all times, and the Marina may for operational, technical, or safety reasons allocate an alternative Berth. When the Vessel is absent from its normal Berth, theMarina shall be entitled to use the Berth for other Vessels, and it may retain any revenue arising.</p>
<p align="left">The Owner must inform the Marina in advance if his Vessel is leaving its Berth for more than 24 hours, and endeavour to give theMarinaat least 24 hours advance notice of its return.</p>
<p>G. The berth assignment of any Berthholder, who occupies his/her assigned berth, with his/her own boat, for a total of less than six (6) in any twelve (12) month period shall be cancelled. The only exception to this rule shall be an extended absence for a bona fide reason of which the <del datetime="2012-01-19T09:02">Marina Manager </del>Harbormaster has been informed in writing prior to the absence thereof. The <del datetime="2012-01-19T09:02">Marina Manager</del>Harbormaster may require reasonable proof of the continued ownership and location of the vessel from time to time during the absence from the Marina.</p>
<p>H. The holder of a permanent assignment of a specific size has no right to a larger berth in the event he/she purchases a larger boat, and must apply for the assignment of an appropriate berth according to the waiting list policy.</p>
<p>I. Berthing of a boat, the size of which is greater than that of the berth assigned to the Berthholder, is not permitted.                                                                                               Owners will ensure that no part of his Vessel (e.g. pulpit, anchor, davits, outboard engine) overhangs the pontoon, jetty or quay, or extends into the navigational fairways of theMarina. Vessel length is measured from stem to stern, actual length as it sits in the berth. Vessel length will not exceed the length of the finger pier.</p>
<p>J. The <del datetime="2012-01-19T08:49">Marina Manager </del> Harbormaster shall have the authority to move, or relocate in theMarina, any boat berthed therein, that is in violation of any rules and regulations and has failed to cure such violation within ten (10) calendar days following written notice from the <del datetime="2012-01-19T09:10">Marina  </del><del datetime="2012-01-19T09:10">Manager </del> Harbormaster of the nature of the violation and demand to cure, or if such relocation is required for the safety and protection of persons or property, or is appropriate in order to obtain optimum utilization of facilities available. Owner also appoints theMarinaas his/her agent for designating a place of storage and safekeeping at his/her expense in the event that theMarinadoes not want to store the boat described above on its own premises. Under the provisions of this contract, Owner shall also reimburse theMarina for the cost of removal and transportation to and from said storage facility. Owner hereby grants theMarinapermission to board the vessel for said purpose.</p>
<p>K. Unauthorized berth occupancy is prohibited and the Marina Manager is authorized to move or secure the boat until berthage has been assigned and fees have been paid. <ins cite="mailto:John%20Moren" datetime="2012-01-19T09:11"></ins></p>
<p><ins cite="mailto:John%20Moren" datetime="2012-01-19T09:11"> </ins></p>
<p>SECTION 4 &#8211; BERTHING CHARGES</p>
<p>A. All charges and fees shall be made in accordance with the schedule adopted by the Recreation and Park Department.</p>
<p>B. If a berth is assigned effective the first day of a month, then the full month&#8217;s rental is charged. If the initial period is less than a full month, the charge will be on a pro rata basis.</p>
<p>C. The first month&#8217;s rental plus an additional security deposit of one month&#8217;s rental shall be made upon assignment of a berth. At the time of the release of the assigned facilities, such deposit shall be applied against any unpaid rentals or other charges owning to the Recreation and Park Department, and the balance of the deposit shall be refunded if the required notice has been given.</p>
<p>D. A full month&#8217;s berthing charge shall be made for occupancy of a berth for all of a portion of the final month of occupancy. There shall be no prorating of the rent for the final month.</p>
<p>&nbsp;</p>
<p>SECTION 5 &#8211; NON-PAYMENT OF CHARGES</p>
<p>A. Any berth assignment, the fees for which are fifty (50) days delinquent shall be cancelled, and the berth shall be vacated.</p>
<p>B. No person shall remove or cause to be removed from theMarinaany vessel upon which charges for berthing or any other proper charges, are delinquent, without paying all such delinquent charges.</p>
<p>C. In accordance with the provisions of Division 3, Chapter 2, of the Harbors and Navigation Code of the State ofCalifornia, the charges for berthing fees or charges for services are liens upon a vessel, and when these are delinquent fifty (50) days or more, an action may be brought against the Owner or Berthholder to enforce payment of the lien by the<del datetime="2012-01-19T09:13"> Marina Manager</del> Harbormaster, and the vessel with all its appurtenances and furnishings may be attached as security for the satisfaction of any judgment that may be recovered in the action.                                                                                                                    If the attachment is not discharged, and the judgment is recovered, and an execution is issued thereon, the vessel and all of its appurtenances and furnishings may be sold at public auction and the proceeds applied in accordance with the above provisions of the Harbor and Navigational Code.</p>
<p>D. Berth fees are due and payable within fifteen (15) calendar days of the due date. Any Berthholder whose berth rent payment is delinquent on three (3) of more occasions within a three (3) year period shall be designated a &#8220;Habitual Late Payer&#8221;. The <del datetime="2012-01-19T09:14">Marina  </del><del datetime="2012-01-19T09:14">Manager </del>Harbormaster shall have the option to terminate the berthing agreement of any &#8220;Habitual Late Payer&#8221; on the occasion of any subsequent delinquencies of berth rent.</p>
<p>&nbsp;</p>
<p>SECTION 6 &#8211; RELEASE OF ASSIGNED FACILITIES</p>
<p>The <del datetime="2012-01-19T09:14">Marina Manager</del><ins cite="mailto:John%20Moren" datetime="2012-01-19T09:14"> </ins>Harbormaster shall be notified in writing of the exact date of release of an assigned berth.</p>
<p>This notice must be given at least fifteen days in advance of the effective date of release. Charges will continue until such written notice is received.</p>
<p>&nbsp;</p>
<p>SECTION 7 &#8211; DISPOSING OF REFUSE</p>
<p>A. No person shall throw, discharge or deposit from any vessel or from the shore or float any refuse matter of any kind whatsoever into or upon the waters of the harbor, or in, on or upon the banks, walls, sidewalks, or beaches of any waters within the boundaries of the Marina area.</p>
<p>B. No person shall dump or discharge oil, spirits, inflammable liquid or contaminated bilge water into theMarina.</p>
<p>C. All garbage must be deposited in receptacles furnished by the Recreation and Park Department for that purpose, or removed from theMarinaarea.</p>
<p><ins cite="mailto:John%20Moren" datetime="2012-01-19T09:16"> </ins></p>
<p>SECTION 8 &#8211; HAZARDOUS OBSTRUCTION PROHIBITED: BOARDING PLATFORMS</p>
<p>A. Floats, gangways, top of lockers and dock shall be kept clear at all times, of skiffs, tenders, miscellaneous gear, debris or other hazardous obstructions.</p>
<p>B. Any condition aboard or around any boat, float, or gang plank caused by the Berthholder, which, in the opinion of the <del datetime="2012-01-19T09:16">Marina Manager</del>Harbormaster constitutes a fire hazard, health menace, or danger to public safety, shall be corrected or removed immediately to the satisfaction of the <del datetime="2012-01-19T09:17">Marina Manager</del>Harbormaster. In the event of the refusal of the Owner to remedy forthwith the aforesaid condition, the <del datetime="2012-01-19T09:17">Marina Manager</del>Harbormaster or General Manager shall effect such correction or remove and may cancel the berth assignment of the Berthholder.</p>
<p>C. Boarding platforms or ladders on floats shall be permitted, subject to the prior approval of the <del datetime="2012-01-19T09:18">Marina Manager</del>Harbormaster, provided that any platform used for boarding shall not be over eighteen (18) inches in width and not over three (3) feet high, and shall be of lightweight construction. The platform shall not be used as a storage locker.</p>
<p>D. No person shall build or place in or about theMarina, any structures, such as walkways, gangplanks, float fingers, rubbing piles, dock boxes, etc. without prior written approval of the <del datetime="2012-01-19T09:18">Marina Manager</del>Harbormaster.                                                                                             No modifications of Dock Structures are permitted. This includes flotation systems, containment basins under vessels, fendering, antennas and any other additions at the discretion of the Harbormaster.</p>
<p>E. <del datetime="2012-01-19T09:23">Dock boxes (gear lockers) must conform to the following specifications: be triangular in  </del><del datetime="2012-01-19T09:23">shape, no larger than 36&#8243; x 36&#8243; x 42&#8243; in height, of fiberglass or plywood construction  </del><del datetime="2012-01-19T09:23">with nonferrous hardware. Only one box per berth is permitted. Any dock boxes that do  </del><del datetime="2012-01-19T09:23">not conform to the foregoing specifications shall be removed from the Marina. Location  </del><del datetime="2012-01-19T09:23">of dock boxes shall be subject to the approval of the Marina Manager. </del>No Dock boxes other than the ones supplied by theMarina will be allowed on docks.</p>
<p>&nbsp;</p>
<p>SECTION 9 &#8211; USE OF WATER AND ELECTRICITY</p>
<p>A. Charges for water and electricity under normal usage are included in berthing fees<ins cite="mailto:John%20Moren" datetime="2012-01-19T09:25"> </ins>for theEastMarinaBasin. In theWestMarinaBasin, where electric meters are installed, the Owner will be charged for actual usage according to Playground&amp;A posted KWH cost.</p>
<p>B. Continued use of water is prohibited except in the case of emergency. The existence and nature of the emergency shall be reported immediately to the <del datetime="2012-01-19T09:28">Marina Manager </del>Harbormaster.</p>
<p>C. Excessive use of electricity for heating, cooling, and other purposes is prohibited. If the <del datetime="2012-01-19T09:28">Marina Manager </del>Harbormaster is of the opinion that there is excessive use of electricity by Berthholder, he/she may attach a meter to the outlet for measuring actual consumption. Electrical consumption in excess of 264 kilowatt hours in any month shall be charged to the Berthholder and added to the monthly berthing fee. The Owner will ensure that his Vessel’s connection to theMarina’s electricity supply is safely fitted and maintained, and that the electricity cables are disconnected from the supply point before being disconnected from the Vessel.</p>
<p>&nbsp;</p>
<p>SECTION 10 &#8211; MAINTENANCE <del datetime="2012-01-19T09:50">OF FACILITIES </del></p>
<p>Repairs to and maintenance of a vessel may be made or accomplished while such vessel is at its berth, provided all such work is done within the confines of the vessel itself and is not carried on in any manner whatsoever upon floats, gangways or docks. All materials used in such repair or maintenance work must also be kept within confines of the vessel and may not be kept upon floats, gangways or docks. Spray painting is not permitted in theMarina.</p>
<p align="left">Owner will not carry out repair or maintenance work in the Marina(except of a minor nature). The Harbormaster<ins cite="mailto:John%20Moren" datetime="2012-01-19T09:37"></ins><ins cite="mailto:John%20Moren"></ins><ins cite="mailto:John%20Moren"> </ins>always reserves the right to order any work to cease if it considers that there is a risk of  damage, nuisance, or a health and safety hazard.<ins cite="mailto:John%20Moren" datetime="2012-01-19T09:53"></ins></p>
<p align="left">The Owner will maintain his Vessel in a clean and tidy condition, and sufficiently seaworthy so that it can leave the Berth in all normal weather and sea conditions.</p>
<p align="left"> </p>
<p>SECTION 11 &#8211; PUMPING AND LABOR CHARGES</p>
<p>If in the opinion of the<del datetime="2012-01-19T09:39"> Marina Manager</del>Harbormaster, a boat is in danger of sinking he may pump out water from the vessel and <ins cite="mailto:John%20Moren" datetime="2012-01-19T09:41"></ins><ins cite="mailto:John%20Moren">the </ins>cost of this emergency service shall be charged to the Berthholder, in accordance with the fee schedule established by the Recreation and Park. The Harbormaster may board, enter, move, or carry out emergency work on a Vessel for safety or operational reasons at Owners expense.</p>
<p>&nbsp;</p>
<p>SECTION 12 &#8211; UNNECESSARY DISTURBANCE</p>
<p>The Owner of the vessel is responsible for the conduct and action of his/her crew and guests and any unnecessary noise. Violation of this rule shall be cause for removal of the vessel from the Marina and cancellation of the berth assigned by the <del datetime="2012-01-19T09:44">Marina Manager </del><ins cite="mailto:John%20Moren" datetime="2012-01-19T09:44">Harbormaster</ins>.</p>
<p>Any Person (other than an Owner) who breaches these Rules may be ordered out of and banned from theMarina.</p>
<p>&nbsp;</p>
<p>SECTION 13 &#8211; VESSEL TRAFFIC WITHIN THEMARINA</p>
<p>A. All vessels approaching or within theMarinamust be operated in a safe and prudent manner and in no event shall the entrance to the Marinabe blocked by boating activities. <ins cite="mailto:John%20Moren" datetime="2012-01-19T10:01"></ins></p>
<p> B. The speed of any vessel within the Marinashall not exceed five (5) miles per hour, no wake, and minimum speed to allow for steerage.  <del datetime="2012-01-19T10:03">except under emergency conditions. </del></p>
<p>C. No vessel shall be operated in theMarinaexcept for the purpose of entering or leaving a berth and necessary maneuvering in connection therewith.</p>
<p>&nbsp;</p>
<p>SECTION 14- SWIMMING INMARINAPROHIBITED</p>
<p>No person may swim, bathe, or wade in any portion of theMarina; with the exception of entering the water to clean or maintain the bottom of a vessel. Parents or guardians shall ensure that children (i.e. under the age of 18 years) are adequately supervised.</p>
<p>&nbsp;</p>
<p>SECTION 15 &#8211; LIVING ABOARD VESSELS</p>
<p>No person may live aboard any vessel berthed in theMarina. This prohibition against living aboard a vessel shall not prevent the use of vessels in theMarinafor eating and sleeping purposes for a period not to exceed <del datetime="2012-01-19T10:11">seventy-two (72) hours in any seven (7) day period provided, however,  </del><del datetime="2012-01-19T10:11">that the Owner or operator of the vessel so notify the Marina Manager. </del>three days in any one week period or a total of seven days in any one month period. Such use shall be subject to the requirements and limitations of Section 16, following.</p>
<p>&nbsp;</p>
<p>SECTION 16 &#8211; SEWAGE AND SANITARY FACILITIES</p>
<p>A. It is unlawful for any person to discharge sewage in the waters of the Marina.</p>
<p>B. No person shall operate or berth in theMarinaany vessel equipped with a toilet unless such toilet is sealed or otherwise rendered inoperable or designed so that no human excreta can be discharged into the water of the Marina. <ins cite="mailto:John%20Moren" datetime="2012-01-19T10:16"></ins></p>
<p>&nbsp;</p>
<p>SECTION 17 &#8211; MINORS IN MARINA</p>
<p>No person under the age of sixteen (16) years may go, remain, or be upon any of the gangway, floats or vessels in theMarina, unless such person is accompanied by an adult.</p>
<p>&nbsp;</p>
<p>SECTION 18 &#8211; FISHING IN THEMARINAPROHIBITED</p>
<p>A. Fishing and crabbing, and the cleaning of fish on gangplanks, boats and floats is strictly prohibited within the Marina.</p>
<p>B. All fish caught outside theMarinamust be disposed of within twenty-four (24) hours from the time of catching. No person shall throw fish overboard at the dock or from a vessel within the Marina. <ins cite="mailto:John%20Moren" datetime="2012-01-19T10:17"></ins></p>
<p>&nbsp;</p>
<p>SECTION 19 &#8211; CHARTER VESSELS</p>
<p>All Charter Vessels must obtain a permit from the <del datetime="2012-01-19T10:17">Marina Manager</del>Harbormaster prior to the use of anyMarina facilities for the purpose of boarding or discharging passengers. Upon obtaining the permit, such vessels must use the area designated by the <del datetime="2012-01-19T10:17">Marina Manager </del>Harbormaster, must schedule their activities with the Marina Office, and pay fees established by the Recreation and Park Commission.</p>
<p align="left">No commercial activity shall take place at theMarina, including aboard any Vessel, unless the Harbormaster has first granted its permission in writing. In granting permission the Harbormaster shall be entitled to impose such additional rules or commercial terms as it may, at its sole discretion, deem appropriate.</p>
<p>&nbsp;</p>
<p>SECTION 20 &#8211; SOLICITATION, ADVERTISING AND SIGNS</p>
<p>A. Solicitation of patronage in the Marinawithout a permit is prohibited.</p>
<p>B. No person shall row, propel, navigate or maintain any vessel or float in theMarinafor the purpose of advertising, without first having received a permit for such purposes from the Recreation and Park Department.</p>
<p>C. No signs of any kind of description shall be posted anywhere in theMarinawithout receiving prior written approval from the <del datetime="2012-01-19T10:27">Marina Manager</del><ins cite="mailto:John%20Moren" datetime="2012-01-19T10:27">Harbormaster</ins>.</p>
<p>&nbsp;</p>
<p>SECTION 21 &#8211; MAINTENANCE AND CARE IN BERTHING, ANCHORING OR MOORING VESSELS</p>
<p>A. All vessels shall be berthed and secured with proper care and equipment, and such berthing or equipment shall be maintained at all times in seaworthy condition as so determined by the <del datetime="2012-01-19T10:28">Marina Manager</del>Harbormaster.</p>
<p align="left">Owner will ensure that his Vessel is secured in a seamanlike manner, with adequate lines and fenders to withstand all foreseeable weather and tidal conditions and the proximity of other vessels, and with separate lines for each function (e.g. bow, stern, springs and breast lines).</p>
<p align="left">Owner will ensure that whilst in the Marina his Vessel is controlled by an adequately trained and competent person(s) in a seamanlike manner, observing the speed limits, keeping wash to a minimum, and ensuring that no damage, inconvenience, or risk is caused to other Persons and Vessels, to nearby property, or to the Marina. </p>
<p align="left">All boats will be maintained at levels dictated by USCG and State ofCaliforniastandards. Vessel examinations for compliance may be executed at the discretion of the Marina Management. All vessels will be maintained in such a manner that they operate under their own power, and can be removed quickly from the slip in the case of Fire or other emergency. Ensure that his Vessel complies with all statutory requirements (e.g. registration with the port authority and the coastguard, the display of registration numbers, crew qualifications)</p>
<p>B. In the event that vessels are not maintained or secured properly, the <del datetime="2012-01-19T10:41">Marina Manager </del>Harbormaster may supply lines and fittings, or may care for the vessel in such a manner as to prevent damage to the vessel, docks or floats. A charge for this service and for any lines, fittings and materials shall be made, and payment shall be made in accordance with the fee schedule. Any lines, fittings and materials used and supplied by the <del datetime="2012-01-19T10:42">Marina Manager </del>Harbormaster to protect vessels are not returnable.</p>
<p>C. No person shall bring into or berth within theMarinaany vessel of any kind whatsoever which is so unseaworthy or in such badly deteriorated condition that it may cause damage to docks, floats or other vessels of which may become a menace to navigation, <del datetime="2012-01-19T10:42">except in  </del><del datetime="2012-01-19T10:42">cases of extreme emergency in which case the owner will be liable for any damage  </del><del datetime="2012-01-19T10:42">caused by such vessel.  </del>The Marina Manager shall be the sole judge as to the seaworthiness of the vessel, for the purposes of this section.</p>
<p>D. In the event a vessel or other craft is wrecked or sunk within theMarina, it shall be the Owner&#8217;s responsibility to mark its position and provide for the raising and disposition of such vessel or craft and assume all liability for damage toMarinaproperty or other vessels in the Marina.</p>
<p>E. Small tenders, dinghies and row boats must be stored on the vessel. Only one vessel of any kind is allowed in any berth. <del datetime="2012-01-19T10:43">are permitted to be moored, if kept by and for the use of the </del><del datetime="2012-01-19T10:43">Berthholder and berthed within the limits of the berth assigned. </del><ins cite="mailto:John%20Moren" datetime="2012-01-19T10:45"></ins></p>
<p>&nbsp;</p>
<p>SECTION 22 &#8211; COMPLIANCE WITH FEDERAL, STATE AND LOCAL RULES AND REGULATIONS</p>
<p>All persons using theMarinashall comply with all of the Rules and Regulations adopted by the United States of America, State ofCalifornia, and local agencies with regards to water safety requirements, operation and maintenance of boats. The <del datetime="2012-01-19T10:45">Marina Manager </del>Harbormaster is authorized to enforce all said Rules and Regulations and to deny use of the facilities at saidMarinafor violation of said Rules and Regulations. <ins cite="mailto:John%20Moren" datetime="2012-01-19T10:47"></ins></p>
<p><ins cite="mailto:John%20Moren" datetime="2012-01-19T10:47"></ins> </p>
<p>SECTION 23 &#8211; VIOLATION OF RULES AND REGULATIONS</p>
<p>A. An applicant for a berth assignment agrees by his signature on the application form, to comply with these Rules and Regulations.</p>
<p><del datetime="2012-01-19T11:44">B. The </del><del datetime="2012-01-19T10:47">Marina Manager</del><del datetime="2012-01-19T11:44">Harbormaster</del><del datetime="2012-01-19T11:44"> shall have the right to deny the use of the Marina and to cancel the </del><del datetime="2012-01-19T11:44">berth assignment and require removal of any owner, who in the opinion of the </del><del datetime="2012-01-19T10:48">Marina </del><del datetime="2012-01-19T10:48">Manager </del><del datetime="2012-01-19T11:44">Harbormaster</del><del datetime="2012-01-19T11:44">, fails to comply with the Rules and Regulations of the San Francisco Marina </del><del datetime="2012-01-19T11:44">Small Craft Harbor. </del></p>
<p>B. In the event of any breach of the Marina Rules by an Owner, the Harbormaster shall have the right to terminate his Berthing Contract in accordance with the following procedure:</p>
<p>     a) If the Harbormaster considers that the breach is serious then the Harbormaster may terminate without prior notice.</p>
<p>     b) Otherwise the Harbormaster will first serve a warning notice on the Owner, specifying the breach and requiring him to remedy it within 7 days. If the Owner fails to remedy the breach within 7 days, or if the breach is incapable of remedy, then the Harbormaster may at any time thereafter serve a termination notice having immediate effect, and may also require the Owner to remove his Vessel from theMarinawithin 7 days, or within such longer period as it may specify. </p>
<p>C. If an Owner fails to remove his Vessel from theMarinaafter being served with notice of termination (whatever the reason for the termination) then the Harbormaster may:</p>
<p>     c) Continue to charge him at the published daily/visitor rate for keeping his Vessel at theMarina; and/or</p>
<p>     d) Remove his Vessel and charge him for this move and for any subsequent storage or other costs necessarily incurred; and/or</p>
<p>     e)  Serve him 3 months notice of its intention to dispose of the Vessel at auction. </p>
<p>D. Disposal shall be in accordance with the following procedure:</p>
<p>     f) If an Owner has failed to respond to the disposal notice by paying all the amounts he owes to the Marina and (if applicable) by removing his Vessel from the Marina, then the Harbormaster may sell the Vessel at public auction at any time following the expiry of the said 3-month notice period.</p>
<p>     g) Within one month of serving a disposal notice the Harbormaster shall advertise its intention to dispose of the Vessel at auction in two regional or national daily newspapers and shall fix a copy of the notice to the superstructure of the Vessel.</p>
<p>     h) The Harbormaster shall be entitled to deduct from the proceeds of the auction any outstanding debt and any costs, including reasonable management costs, it has necessarily incurred. </p>
<p>E. In the case of <em>force majeure</em> the Harbormaster shall have the right to terminate a Berthing License or other services contract by serving the Owner with such notice as is reasonable in the circumstances.  <em>Force majeure</em> will apply if at any time the Marina is so badly damaged or affected by something beyond the Marina’s reasonable control that the Marina can no longer provide the Berthing or other services for a Vessel in accordance with its contractual obligations. </p>
<p>&nbsp;</p>
<p>SECTION 24 &#8211; REGISTRATION AND NUMBERING: FURNISHING INFORMATION TO THE <del datetime="2012-01-19T10:49">MARINA MANAGER </del>Harbormaster</p>
<p>A. Every undocumented vessel entering theMarinamust be registered and numbered as provided by the laws of the State of California, or the State in which it is registered<del datetime="2012-01-19T10:49">. </del><ins cite="mailto:John%20Moren" datetime="2012-01-19T10:49">.</ins></p>
<p>B. The owners of vessels entering theMarinashall furnish all information relating to the vessel and the ownership thereof as may reasonably be required by the <del datetime="2012-01-19T10:49">Marina Manager</del>Harbormaster. <del datetime="2012-01-19T10:50"></del></p>
<p><ins cite="mailto:John%20Moren" datetime="2012-01-19T10:50"> </ins></p>
<p>SECTION 25 &#8211; ACCIDENT REPORTS</p>
<p>A duplicate copy of any report of any accident occurring in theMarinashall immediately be filed with the <del datetime="2012-01-19T10:50">Marina Manager</del>Harbormaster.</p>
<p>&nbsp;</p>
<p>SECTION 26 &#8211; CONTINUOUS USAGE</p>
<p>All berthholders shall use their vessels on a regular basis and with sufficient notice may be required to demonstrate to the satisfaction of the <del datetime="2012-01-19T10:50">Marina Manager</del>Harbormaster that the vessel is capable of navigating under its own power.</p>
<p>&nbsp;</p>
<p>SECTION 27 – GENERAL RULES AND OBLIGATIONS OF THE OWNER</p>
<p>A.   All pets must be leashed at all times.</p>
<p>B.   Owner acknowledges that the address for the Owner shown in the Berthing License will be the point of contact for all official communications. Notices of violation, requests etc. will be sent to this address by certified mail. It is the responsibility of the Owner to make sure this is kept up to date.</p>
<p>C.  It is the responsibility of the Owner to secure and maintain insurance for his boat covering hull replacement and liability.Hullvalue will be based on the NADA or similar for the Marine Industry. The amount of liability coverage will be a minimum of $300,000.00, including Fuel Spill Liability. TheMarinawill be named as additionally insured, insuring that theMarinawill be notified in the event the insurance is cancelled after execution of the contract. The Harbormaster may request proof of insurance at any time. Any vessel found not to have proof of valid insurance coverage will be given 72 hours to provide proof of compliance, after which, his Berthing License will be permanently revoked.</p>
<p>D.  Owner will ensure that water hosepipes are fitted with spring-loaded nozzles so that the water supply shuts off when the hose is unattended.</p>
<p>E.    Minimize the risk of fire aboard his Vessel.</p>
<p align="left">     a) Not do any Hot Work unless the Harbormaster has first granted its permission;</p>
<p align="left">     b) Store fuel, pyrotechnics, and other flammable materials in a safe manner;</p>
<p align="left">     c) Ensure that gas supplies are turned off when not in use;</p>
<p align="left">     d) Maintain adequate fire fighting equipment aboard;</p>
<p align="left">     e) Refuel only at theMarina’s designated fuelling place.</p>
<p align="left">F.    Minimize the risk of pollution of the watercourse from his Vessel<ins cite="mailto:John%20Moren" datetime="2012-01-19T11:21"></ins><ins cite="mailto:John%20Moren"></ins></p>
<p align="left">     f) Not discharge any garbage, toilet effluent, dirty bilge water, or other pollutant;</p>
<p align="left">     g) Ensure that his bilge contains a bilge oil absorber;</p>
<p align="left">     h) Not operate bilge pumps unless they are fitted with oil-absorbing filters;</p>
<p align="left">     i) Store all fuel, paint, chemicals and other potential pollutants in a safe manner;</p>
<p align="left">     j) Use only bio-degradable cleaning materials;</p>
<p align="left">     k) Dispose of garbage in the designated places, or remove it from theMarina;</p>
<p align="left">     l) Refuel only at the designated fuelling place;</p>
<p align="left">     m) Discharge holding tanks only at the designated place.</p>
<p>G.   Owner, upon acceptance of a berth, agrees that the Berth and all other relevant parts of the Marina are adequate for his Vessel.</p>
<p align="left"> </p>
<p align="left">SECTION 28 – GENERAL INDEMNITY</p>
<p align="left">A.    All Persons enter and use theMarinaat their own risk and in doing so acknowledge and accept these Rules. </p>
<p align="left">B.    Except in the case of its criminal or excessive negligence or breach of duty under these Marina Rules the Marina shall not be liable for any death, injury, theft, loss or damage, including to vehicles or Vessels, arising from a Person’s use of theMarina.</p>
<p align="left">C.    All Persons shall abide by the Company’s Health &amp; Safety Policy. Copies available in Harbor Master’s office during normal operating hours.</p>
<p align="left">D.    TheMarinashall not be under any general duty to provide a safety, weather, or security watch for the benefit of any Person or Vessel and any liability or responsibility for these is expressly excluded. In the event of Emergency,Marinapersonnel may, however, perform services at Owner’s expense, at rates which exceed normal hourly rates.</p>
<p align="left">E.   All contractors and other service providers shall report to theMarinaoffice upon entering theMarinaand again before leaving. They are required to hold a Marina issued work permit and to maintain public liability insurance with a reputable insurer for a sum of not less than $500,000.00 and shall produce evidence of such cover to the Harbormaster, and must also either have evidence of Workman’s Comp coverage, or in the case of individuals, execute a Waiver of Workmen’s Compensation with the Marina. Subcontractors are only allowed onMarinaproperty during normal business hours.</p>
<p align="left">F.    Hot Work is strictly prohibited unless the Marinahas first granted its specific permission on each occasion in writing. Grills and other cooking equipment may not be used on dock surfaces.<del datetime="2012-01-19T11:39"></del></p>
<p align="left">G.    All visitors, crew and guests of an Owner shall report to theMarinaoffice on arrival.</p>
<p>     • Owner acknowledges responsibility for actions of his guests, family, crew and contractors.</p>
<p>     • Owner agrees to a Waiver of Subrogation</p>
<p>     •  Owner agrees to waive the Limit of Liability Act of 1855. Owner also agrees to a Waiver of simple negligence on the part ofMarinapersonnel and Management.</p>
<p>&nbsp;</p>
<p><strong>SECTION 29- VEHICLES and RESTROOMS</strong></p>
<p>A. All vehicles at theMarinashall be parked in accordance with the Harbormaster’s instructions.</p>
<p>B. Parking space is limited and theMarinadoes not guarantee that space will be available at all times.</p>
<p>C. No trailer, caravan or commercial vehicle may be parked at theMarinawithout the Harbormaster’s prior permission in writing.</p>
<p>D. If a vehicle is to be left unattended for more than 24 hours then the driver shall deposit its keys with theMarina. TheMarinashall be responsible for the keys but not for the Vehicle.</p>
<p>E. The Marina reserves the right to enter a vehicle (by force if necessary), and/or move it by lifting or towing, if it is parked in breach of the above, or if its alarm continues to sound for longer than 30 minutes. The driver of the vehicle shall reimburse theMarinaany costs incurred.</p>
<p>F. Restrooms and facilities at theMarinaare for the use of Owners and the general public.</p>
<p>&nbsp;</p>
<p>RESOLUTION NO. 16172</p>
<p>RESOLVED, that this Commission does hereby approve the revised Rules and Regulations for the San Francisco Marina Small Craft Harbor; and FURTHER RESOLVED, that the General Manager or his designate is hereby authorized to terminate the lease or permit for any berth in theMarinaif there is any default or violation of said Rules and Regulations, following the service of official notice to the Berthholder involved.</p>

<p><strong>January 16, 2012</strong></p>
<p>The following report is an assessment of the current Marina Rules &amp; Regulations in place at the San Francisco Small Craft Yacht Harbor managed by the City and County of San Francisco Recreation &amp; Park Department.  The assessment is conducted based on the marina industry best management practices and industry norms, as referenced by the <em>Marina Manual</em> 2<sup>nd</sup> Edition, a benchmark document designed for marina operators. Multiple documents have been provided for my review inclusive of: (1) current SF Marina Rules &amp; Regulations; (2) two examples of local San Francisco Bay area marina rules and regulations (Sausalito and South Beach).  Below is a summary of findings and recommendations for consideration; I would strongly recommend that the liability exposure issues be immediately addressed. </p>
<p><strong>PRESENT SITUATION</strong></p>
<p>Based on discussions with Mr. John Moren, San Francisco Harbor Master, it appears that former Harbor Masters have taken a path of least resistance in regard to marina management; specifically, the business relationship maintained between theMarinaand the boat Owners. Since the Marina’s West Basin is undergoing a major renovation, it would be a prime opportunity to create a business environment, which protects the investments of the City of San Francisco and those of responsible boat Owners in the Marina. My recommendation to create more effective business practices at the Marina is best envisioned through the consistent application and enforcement of rules and regulations that follow marina industry best management practices.</p>
<p><strong>RECOMMENDATIONS</strong></p>
<p><strong>Berthing Licenses </strong></p>
<p>The berthing license should be created as a contract between the Marina, as a function of the City ofSan Francisco, and the Owner, for the use of a designated vessel, identified by hull number, registration etc. Berthing licenses and any other type of contracts pertaining to provision of services at the Marina, access and berthing allowances should only be issued by authorized City Marina personnel, who have authority to enter into a contract for a public asset.  Below is a brief listing of issues, which I highly recommend to be included in any future berthing licenses:</p>
<ul>
<li><em>Subletting</em></li>
</ul>
<p>Owners cannot execute agreements with others to use the slip of a public or private marina. Also, theMarinashould reserve the right to use the slip in the absence of Owner’s vessel. Allowing sub-leasing of slips by bertholders places them in the position of controlling outcomes for the Marina and significantly increases the liability exposure to the City and the Recreation &amp; Parks Department.  </p>
<p>Most importantly, allowing subletting can be considered leasing of public goods and deriving personal gain by income generated thru the subletting of a public asset.  Allowing subletting significantly compromises the ability to professionally manage the marina.  It creates an unnecessary risk and liability exposure. For instance, Marina personnel have no contract with a Sublette as such any ability to enforce Marina Rules &amp; Regulations.  In addition, there is no information on record about the Sublette, such as contact and emergency information; accurate identification data for the vessel; authorized users, etc. Furthermore, the current San Francisco Marina Rules &amp; Regulations lack language and references to prohibit a Sublette to sublease the slip, yet again to an unknown individual. </p>
<p>The subletting practice should be ceased immediately.  I feel this is where the greatest liability lies. </p>
<ul>
<li><em>Transfer of Berthing Licenses</em></li>
</ul>
<p>For the same reasons stated above in the Subletting section of this report, it is critical that the transfer of berthing licenses not be allowed.  The berthing license should not be transferable with the sale of a private vessel, as it is public property.  Again, these types of occurrences may be in direct violation with the State of California’s agreement with the City for the management of the Marina, specifically deriving of personal gain by the income generated thru the transfer of a berth with the sale of a private vessel.</p>
<ul>
<li><em>Term of Berthing Licenses</em></li>
</ul>
<p>Berthing licenses should only be executed on an annual, seasonal or daily basis.  Berthing licenses are not made in excess of one year in duration and are not automatically renewing. The ability to berth at a marina should be based on the boat owner’s ability to follow rules and regulations, which should be evaluated on an annual basis.  At the end of the annual contract, Marina personnel must conduct an evaluation of the berthing license and other compliancy considerations, inclusive of a full inspection of the vessel and confirmation of the vessel’s current length. An automatic renewal severely hampers the ability to ensure compliance of Federal and State regulations. The term “<em>permanen</em>t” used in some of the documents should be removed in all instances.</p>
<p><strong>Vessel Considerations</strong></p>
<p>All vessels must be maintained at levels dictated by the United States Coast Guard and the State ofCaliforniastandards. Vessel examinations or inspections should be required annually with berthing license renewals or more often at the discretion of the Marina management. All vessels must be maintained is such a manner that they operate under their own power, and can be removed quickly from the slip in the case of fire or other emergency.</p>
<p><strong>Dock Modifications</strong></p>
<p>No modifications of Dock Structures are to be permitted without written consent of Marina management. TheMarina, at its discretion, can equip a portion of the facility with boat lifts which are owned and installed by theMarinaand leased to the Berth Holder.  This type of system works best with fixed docks rather than floating because of load considerations. Owners cannot implement these types of modifications themselves, as it creates significant liability exposure and may compromise the physical structure, as well as often times, create significant safety hazards. I highly recommend to immediately ceasing this practice.  </p>
<p><strong>Bottom Paint Issues</strong></p>
<p>The State of California has implemented some of the most stringent standards in the U.S.A. on the use of copper and tributyl tin based bottom paints. As such, vessels require bottom cleaning more often than ever before, at increased expense to the Owners.</p>
<p>Owners, left to their own means, have taken it upon themselves to come up with solutions to save money wherever possible. These cost reducing strategies include the use of constructed basins under the boats, which are filled with fresh water with the suspected addition of other chemicals, which certainly are not in accordance with the intent of the statutes, and may represent greater violations.</p>
<p>Similarly, Owners are constructing homemade lift structures to lift their hulls out of the water. Basically, in these situations, the Owners have no intent for their vessels to leave the slip for recreational use, making it more of a fixed residential structure.  These fixes should not be allowed at any time.  A more sensible approach would be to work with regulatory agencies to come up with environmental solutions that work.  A better alternative is to provide a hull cleaning program service on site.</p>
<p><strong>Insurance</strong></p>
<p>It is the responsibility of the Owner to secure insurance for his/her vessel covering hull replacement and liability.Hullvalue must be based on Blue Book or similar reference document for the marine industry. The amount of liability coverage can vary based on size of the boat, with $300,000 for the smallest vessels. TheMarinamust be named as additionally insured, insuring that theMarinawill be notified in the event the insurance is cancelled after executing the contract. Requesting oil spill insurance coverage is also highly advisable.</p>
<p><strong>Live Aboards</strong></p>
<p>Boating use varies greatly from region to region. Boats can represent a weekend getaway, a vehicle for fishing, skiing or diving, a seasonal migratory vehicle in the case of theAtlantic Intracoastal Waterwayon the East Coast, and in some extreme cases, a full time residence.</p>
<p>Full time live aboards have become an issue for marinas across the country. They greatly increase loads on Infrastructure (Parking, pedestrian traffic, Emergency access, etc.) and also Utilities (electricity for common areas and on board, sanitation, trash removal, potable water, internet, telephone, TV, etc.). Supervisory responsibilities and costs are also increased by having live aboards on site. Studies have proven that live aboards adversely impact the marina and marine environment.  In addition, many live aboards discharge overboard black water, which is detrimental to sea life.</p>
<p>I would highly recommend that the reference in your current Rules and Regulation of a 72-hours in a one week period be completely deleted and incorporate a reference of “no live aboard allowed”.  Also, strong monitoring by Marina staff is required in order to ensure compliance in this area.</p>
<p><strong>Legal Clauses</strong></p>
<p>The following is a listing of recommended terms to be included in legal clauses of Marina Rules and Regulations.</p>
<ul>
<li>Owner acknowledges responsibility for actions of his guests, family, crew and contractors.</li>
<li>Owner agrees to a Waiver of Subrogation</li>
<li>Owner agrees to waive the Limit of Liability Act of 1855.</li>
<li>Owner acknowledges that the address for the Owner shown in the berthing license will be the point of contact for all official communications. Notices of violation, requests etc. will be set to this address by certified mail. It is the responsibility of the Owner to make sure this is kept up to date.</li>
<li>Notification of Violation should be issued by certified mail to address of record, and the structure of termination, refund if any, removal of vessel, etc. should be carefully spelled out.</li>
<li>In the event of Emergency,Marinapersonnel may perform services at Owner’s expense at rates which exceed normal hourly rates.</li>
</ul>
<p><strong>Collections</strong></p>
<p>The best remedies for collection of past due fees are generally local or state in nature. In the event collections are sub-contracted out, “Reasonable costs of Collection” should be included in these clauses. A clause acknowledging a Maritime Lien for collection should be incorporated. This is a federal statute, and is more costly and cumbersome, but presents another remedy to collect.</p>
<p><strong>Subcontractors</strong></p>
<p>All subcontractors performing repairs onMarinaproperty must check in first at theMarinaoffice. They must have Liability Insurance coverage, and must also either have Workman’s Comp coverage, or in the case of individuals execute a Waiver of Workmen’s Compensation with theMarina. Subcontractors are only allowed onMarinaproperty during normal business hours. Activities such as spray painting, grinding and others which create airborne residue are not permitted onMarinapremises. Repairs which create unreasonable noise or disturbance are also not permitted.</p>

<strong>PROPOSED IN DRAFT FORM 1/20/12</strong><br />
<strong>AUTHORITY</strong><br />
The Harbormaster, acting under the orders and supervision of the General Manager, subject to the approval of the San Francisco Recreation and Park Commission, shall have full authority in the interpretation and enforcement of the 2012 Berthing Assignment Policy for the West Basin, all Rules and Regulations pertaining to the Marina, and all orders given in the performance of his/her duties shall be obeyed.</p>
<p><strong>PRIORITY BERTHING ASSIGNMENT PLAN</strong><br />
Berthing assignments will be renewed annually thru a berthing license in the following order of priority:<br />
1. First priority is issued to current West Basin Berth Holders.</p>
<p>2. Second priority, after all obligations are met to all current West Basin Berth Holders, will be issued to short term guests; up to 30% of the remaining berths will be retained for short term dockage.</p>
<p>3. All remaining berths will be issued to individuals on the current Wait List in order of the established seniority.</p>
<p><strong>RIGHT OF FIRST REFUSAL</strong><br />
Right of first refusal will be granted to current Berth Holders in the West Marina Basin based on seniority. Seniority is defined as the length of time that an individual has had a valid signed berthing license, previously referred to as a ‘rental agreement’, with the San Francisco Small Craft Yacht Harbor.</p>
<p><strong>BERTH SELECTION CRITERIA</strong><br />
The Berth Holder with the most seniority has the right of first refusal of berths meeting the following criteria:<br />
1. Berth location is defined as the West Basin pre‐renovation berthing site.</p>
<p>2. The berth must be currently available for reassignment.</p>
<p>3. The vessel’s dimensions must properly fit the berth length, beam and draft, as follows:<br />
a) Vessel cannot be longer than the designed berth length, which is the length of the finger pier.<br />
b) Vessel’s length is defined as “length overall”, stem to stern, as the vessel sits in the berth.<br />
c) The beam is defined as the maximum width of vessel at midship.<br />
d) A vessel will be assigned a berth with a beam of no less than sixteen inches greater than the beam of the vessel, eight inches on each side.<br />
e) Draft is defined as the depth from the water line to the bottom of the keel.<br />
f) The draft of the berth must be no less than one foot greater than the draft of the vessel at Mean Low Low tide.</p>
<p>4. The berth size will be equal to the length of the berth of contract prior to the renovation or the actual length overall of the vessel on record in the current berthing license, whichever is greater.</p>
<p>5. If desired, a Berth Holder may chose a smaller berth only if it fits the dimensions of the vessel on record in the current berthing license as previously defined under the aforementioned item number three.</p>
<p>6. Any vessels measuring over 90 feet or with a beam too great to fit in a 90 foot berth will only be offered a side‐tie in order to meet the designed capability of the new West Basin.</p>
<p><strong>PROCESS</strong><br />
The Harbor Master will publish and post a Seniority List comprised of the date of the current Berth Holder’s berthing license by vessel length of record. Based on the Seniority List, the berthing assignment process will be conducted as follows:<br />
1. Assignments will be conducted upon full completion of the West Basin renovation, tentatively scheduled for November 2012.</p>
<p>2. Assignments will be issued in order of Seniority, as previously defined, starting with the 30 foot berths continuing on with the next berth size until reaching the largest berth size of 90 feet.</p>
<p>3. Vessels will be measured and will undergo a full inspection to ensure seaworthiness and compliance with all Marina Rules &amp; Regulations. Vessels found to be non‐compliant will immediately lose their first right of refusal and the process of eviction will be enacted.</p>

										<content:encoded><![CDATA[<p>During December the project reached a milestone with the completion of the pile driving and installation of the Phase 1 docks, the installation of the north ADA gangway the completion of the sheet pile breakwater.  The harbor office has closed for renovation and the harbor staff has be relocated temporarily to cramped quarters in the construction trailer located nearby.   Landside utility installation has shifted to the area around the harbor office, and work has begun on the installation of dock-side power and water.</p>
<p>Continued fair weather has graced the project, allowing the construction team to move ahead quickly with land-side work.   During the month of January, the majority of construction work will be in the area of the West Mole and Scott/Marina intersection.  Crews will begin demolition of the end of the West Mole and continue work on the harbormaster building.  Installation of underground utilities around the intersection of Scott and Marina and the fire-water line on the North Jetty will continue through the month.   Boaters and harbor visitors should expect some minor disruption to vehicle access and parking in these areas.</p>
<p>Thanks to everyone who attended the RPD meeting held on December 7 at the Fort Mason Center.  A follow-up meeting has been scheduled for January 25, 2012, during which Department staff will report back on the results of our study of best practices of marina operations, the feedback we have received from you and other harbor stakeholders, and the policies now being considered as a result of this process.  All boaters and other marina stakeholders are encouraged to attend the follow-up meeting which will be held in the Fort Mason Center’s Fleet Room, beginning at 6:30 pm. Please note that the special email account set up to accept your input [<strong><a href="mailto:sfmarina.policies@sfgov.org">sfmarina.policies@sfgov.org</a></strong>] will be <strong>deactivated</strong> <strong>on Friday, 1/13</strong> in order to insure we have sufficient time to review and consider all the messages received prior to the 1/25 meeting.</p>

<p>November in-water construction activity focused on the installation of the Phase 1 docks.  A permit amendment was granted to extend the in-water work window into the first two weeks of December so that Dutra can wrap up pile driving.  By December 15 we should see the Contractor’s barges leave the harbor, returning in the spring for the start of Phase 2.   With the close of the in-water work window, the dock-side work activities will shift to the installation of the dock-side utilities including the dock lights, water lines and electrical pedestals.</p>
<p>December will see the completion of the landside work on the north jetty.  Utility trenching is almost complete and the new switchgear equipment located just east of the St Francis is now in place.  The new Playground&amp;E transformer will arrive on site in the coming weeks.  Landside work on the south side of the marina will ramp up in December with the renovation of the Harbor Office and work on the West Mole.  The harbor office, restrooms and boater showers were closed on November 28 and the harbor staff was relocated to the CM trailer located at the foot of Scott Street.  The work on the building will continue through December and into early January.  Again, we apologize for any inconvenience this may cause you.</p>
<p>The Recreation and Parks Department will be holding a public meeting on December 7, 2011 to discuss various issues, including the schedule and process for permanent slip assignments to be made at the conclusion of the renovation project.  All boaters and other marina stakeholders are encouraged to attend the meeting which will be held in the Fort Mason Center, Golden Gate Room <em>[please note change in meeting room], </em>beginning at 6:30 pm.  If you are unable to attend the meeting but have ideas or opinions you would like to convey to us, please send them via email to <strong><a href="mailto:sfmarina.policies@sfgov.org">sfmarina.policies@sfgov.org</a>,</strong> or simply stop by the temporary harbor office to speak one-on-one with the harbor staff.  Your input is important to us. </p>

										<content:encoded><![CDATA[<p>October in-water construction activity focused on the installation of the fixed sheetpile breakwater.  Reports received so far indicate that waters are noticeably calmer in the outer harbor since the breakwater was placed.  Work on the breakwater will wrap-up by mid-November with the installation of the concrete cap.</p>
<p>The first barge load of concrete floats and piles arrived on-site two weeks ago and no time was wasted getting started on their assembly.  With the in-water construction work window closing in just a few weeks, the construction crews will be going full steam ahead to make the deadline for the installation of the phase I docks.  The first dock sections were splashed last week and assembly of G-dock [big boat row] is now well underway.  Pile driving was a bit bumpy at first, but seems to be progressing steadily.  Once G-dock is complete, the crew will move on to I-dock, H-dock and finally D-dock [sailboat row].  Time permitting, the crew will close-out the in-water season with the driving of fender piles.  </p>
<p>Meanwhile on land, the last two weeks have seen construction crews working on trenching and laying of water lines and conduit for the upgraded electric service on the North Jetty.  This will culminate with the placement of our new electrical transformer and switchgear equipment on the grass just east of the St Francis Yacht Club.  At the end of November work should begin on the renovation of the Harbor Master Building.  Access to the West Mole may be temporarily interrupted [for a few hours] while the crews perform minor abatement work.  During the 4 to 6 week period when work is being performed inside the Harbor Master Building, the boater showers and public restrooms will be closed and the office of the Harbor Master will be temporarily relocated to the site trailer located at the foot of Scott Street.</p>

										<content:encoded><![CDATA[<p>The first half of September has been quiet around the SF Marina Renovation job site, but that doesn’t mean significant progress isn’t being made.  At the Kie-Con yard in Antioch, crews are working feverishly to form, pour and hand-finish the concrete dock sections that will begin arriving on-site for installation beginning next month.  I had the opportunity to witness the dock fabrication in action two weeks ago and was amazed at how labor intensive it is.  Crews consisting of dozens of workers participated in a multi-step process that resulted in the creation of just a single dock section.  The process goes something like this.  Crews begin with the assembly of sections of hand trimmed foam cores.  Individual core units vary in size based on the width and draft of the specific float section being fabricated.  The core units are lined up in a row to meet the desired float length.  Once the cores are properly aligned the crew sets the pull boxes and utility sleeves as-needed, and then wraps the foam core units from top to bottom with structural steel.  This is all done pretty much by hand.  Once the assembly is checked and double-checked, it is then boxed in with metal plates creating a giant casting form.  The form is then filled with poured concrete.  When the concrete has begun to set the top surface of the float is smoothed and then receives a hand applied broom finish.  After the concrete is fully set the forms are removed and the float is inspected for overall quality.  The whole process takes about one full day to complete for a single section of dock.  After several docks have been cast, the crew returns to correct any imperfections in color or finish.</p>
<p>As September progresses, we will see in-water construction activities ramping up.  Last week Dutra began pile driving for the 185’ fixed sheet-pile breakwater located perpendicular to the Marina seawall.  Forming and pouring of the concrete cap on the fixed breakwater will be done in the next two weeks.  Hazard markers will be placed at the ends of the new fixed breakwater as a temporary measure until the navigational lights are up and operational.  Boaters should be aware of this change in the marina conditions and be sure to keep an eye out when they enter and exit the harbor.</p>
<p>This month the marina welcomed its new harbor master, John Moren.  The renovation project team has been meeting with John to bring him up to speed on this project.  We welcome his knowledge and experience on marina operations.</p>

										<content:encoded><![CDATA[<p>I am sure many will be happy to hear that Phase I dredging activities concluded last week.  As previously reported, Dutra Construction secured a permit to perform dredging using 24-hour shifts.  This reduced the time that the dredge barge and scow were on site from a forecasted 3 to 4 months to only 6 weeks.   On behalf of the Recreation and Park Department, I apologize for any inconvenience the night work may have caused our harbor berth holders and marina neighbors.  If our permits to dredge the Phase II area are secured earlier than anticipated we may see the dredging equipment back on site for a short period in November. Otherwise, the balance of the dredging of the West Basin will be performed beginning in June 2012.</p>
<p>The next few months will be rather quiet on the site.  The project’s development will center on the fabrication of the docks and gangways, which is occurring off-site.  Representatives from the project team visited the Kie-Con factory last week to witness the casting of the project&#8217;s first concrete float.  The casting process will be ongoing over the next couple of months.  Delivery and installation of the Phase I docks will begin in the fall.</p>
<p>Beginning the week of August 15, the City’s consultants will be on-site collecting sediment samples for testing and analysis.  Samples will be collected from the inner channel and under the docks along Marina Boulevard, and from the area east of the Scott Street Mole.  In addition, cores will be taken at three locations near the end of the West Mole.  Access to the West Mole may be temporarily closed while the test pits are dug and the cores are taken.</p>
<p>A small number of parking spaces just east of the harbor master’s office and construction manager’s trailer will be temporarily closed during the week of August 15<sup>th</sup> while the Contractor relocates an existing catch basin.</p>
<p>Finally, boaters are invited to stop by the Dutra Construction Trailer located on the North Jetty where samples of the Eaton Power Pedestal and dock box specified for the project are on display.</p>

<p>On Tuesday, June 21 dredging of the now vacated areas of marina will begin, starting with the area just west of the Scott Street Mole.  Dutra Construction has secured a special permit to allow them to dredge over-night.  This will speed up the process and reduce the duration in which the dredging barge will need to be in the harbor.</p>
<p>During the week of July 4 the final step of the Phase I relocation of boats is schedule to occur when G-dock [aka as big boat row] will be detached from its piles and then reinstalled at a temporary location west of the Scott Street mole.   This is a major milestone that should be recognized.  The relocation process has been a challenge, and I want to thank all the boaters for their patience.  I also want to commend our acting harbormaster, Benny Jarvis, for making all the pieces come together in the end.  Thanks everyone.</p>

<p><strong>San Francisco&#8211; </strong> The first renovation of the San Francisco Marina in almost 50 years kicked off yesterday, June 8, 2011, as city officials and members of the boating community joined together for a ceremonial plank pulling to mark the beginning of construction on the Marina’s West Harbor.</p>
<p>District 2 Supervisor Mark Farrell and former District 2 Supervisor Michela Alioto-Pier were on hand to thank supporters and to help celebrate the milestone.</p>
<p>&#8220;The renovation of the Marina West Harbor is an exciting project that will provide long-overdue improvements for all who use and visit the marina,” said Farrell.  “Residents, boaters and visitors alike will soon enjoy a world-class marina that San   Francisco deserves.&#8221;</p>
<p>As an added bonus to the new harbor improvements, salvageable wood from the docks will be donated to the Crescent City (Calif.) Harbor, which was ravaged by tsunamis caused by a 9.0 earthquake in Sendai, Japan in March.</p>
<p>The $25 million project is expected to be completed in 2012, with Phase 2, which includes improvements to the East Harbor, to begin shortly after.  The entire project is expected to be completed in time for one of sailing’s biggest events.</p>
<p>“We share the boating community’s anticipation for the 2013 America’s Cup in San Francisco,” said Phil Ginsburg, general manager of the San Francisco Recreation and Park Department.  “As initial plans take shape for sailing’s most prestigious event, the Marina West Harbor Renovation Project couldn’t have come at a better time.”</p>
<p>The San Francisco Marina facilities have existed in their present configuration since 1963. The floating docks and gangways are made of timber and have degraded over time. The on-dock utilities have degraded as well as become obsolete.</p>
<p>Renovations in the West Harbor include:</p>
<ul>
<li>Two new breakwater segments</li>
<li>Removal of one breakwater      structure (mole) near the foot of Scott Street</li>
<li>Reconstruction of portions      of the degraded riprap slopes around the interior shorelines</li>
<li>Replacement and      reconfiguration of the floating docks and slips</li>
<li>Renovation of existing      pump-out facility</li>
<li>Construction of a guest dock      and hand boat launch</li>
<li>Maintenance dredging</li>
<li>Code upgrades to the harbor      office, restrooms and boater showers</li>
<li>Landscaping, site and public      access improvements</li>
</ul>
<p>Dock improvements will also include upgrades in electrical service, water system and fire protection stations, installation of new lights dock lights, and replacement of gates, ramps and gangways.</p>
<p style="text-align: left;">The San Francisco Marina is composed of two harbors, known as East Harbor (also known Gashouse Cove) and West Harbor. The East Harbor consists of 342 boat slips, the City Yachts sales and fuel concession, and parkland, which includes a restroom and two parking lots. The West Harbor consists of the West Harbor marina, the Saint Francis and Golden Gate Yacht Clubs, the Harbor Office Building, and parkland that includes restrooms, a concession stand, and four parking lots. The West Harbor currently includes approximately 326 slips.</p>
<p>The Marina Green, a part of the marina and a major city park, is situated between the East and West Harbors.</p>

<p style="text-align: center"><strong>Ceremonial Plank-Pulling Marks Start of Marina West Harbor Project</strong><br />
<em>Wood from SF Marina Project Being Donated to Tsunami-Damaged Crescent City Harbor</em></p>
<p style="text-align: left">San Francisco &#8212;  The first renovation of the San Francisco Marina in almost 50 years kicked off yesterday, June 8, 2011, as city officials and members of the boating community joined together for a ceremonial plank pulling to mark the beginning of construction on the Marina’s West Harbor.</p>
<p style="text-align: left">District 2 Supervisor Mark Farrell and former District 2 Supervisor Michela Alioto-Pier were on hand to thank supporters and to help celebrate the milestone.</p>
<p>“The renovation of the West Harbor is an exciting project that will provide much-needed improvements for all who use and visit the marina,” said Farrell.  “Residents, boaters and visitors alike will soon enjoy a world-class marina that this city deserves.&#8221;</p>
<p>As an added bonus to the new harbor improvements, salvageable wood from the docks will be donated to the Crescent City (Calif.) Harbor, which was ravaged by tsunamis caused by a 9.0 earthquake in Sendai, Japan in March.</p>
<p>The $25 million project is expected to be completed in 2012, with Phase 2, which includes improvements to the East Harbor, to begin shortly after.  The entire project is expected to be completed in time for one of sailing’s biggest events.</p>
<p>“We share the boating community’s anticipation for the 2013 America’s Cup in San Francisco,” said Phil Ginsburg, general manager of the San Francisco Recreation and Park Department.  “As initial plans take shape for sailing’s most prestigious event, the Marina West Harbor Renovation Project couldn’t have come at a better time.”</p>

<p>Weeks of May 30 and June 6:  Mobilization of the dredging barge and floating equipment barge,  utility capping and demolition of vacated docks along the north jetty and west of the Scott Street mole, and the pulling of piles remaining after dock demolition.</p>
<p>Week of June 13:  Dredging begins in the entrance channel and in the areas where docks have been removed.</p>
<p>On-going:  Relocation of vessels in the planned 2011 work areas is underway.  Vessels remaining along Sail Boat row will be relocated during June.</p>
