Of course, not all dodgy dealings on eBay are fraudulent. Some are just prankish. Others are by chancres, who perhaps reckon their victims won’t be bothered to pursue them.

So, a new seller fitting this profile may be someone who has perhaps been previously suspended and has registered another ID.

Although 1 day listing are used by genuine sellers who have more than one item or who want a quick sale, unfortunately this duration is attractive to fraudsters too. They sometimes use 1 day auction duration to gain a quick sale before their actions can be reported and acted upon. So, be extra wary on auctions with 1 day listing.

e) Invitations to trade off-eBay
This is a classic ploy of fraudsters. Having made some kind of contact with you or you with them, they will invite you to buy or to sell off eBay i.e. without using eBay’s auction services. The attraction here to the fraudster is that they can drive the transaction along the lines they prefer, whether that is escrow, PayPal etc. Another reason why trading off eBay is not a excellent thought is that you have to keep your own formal records of the transaction, and you forfeit any cover from eBay buyer protection and PayPal buyer protection. Plus, and this might be a minor point, but you will not be able to leave feedback to let others know your experience with this seller/buyer.

f) Payment methods with no recourse

Postal orders are similar although they are a well loved payment method among the genuine sellers as they require no clearance time. The email sent out, but authentic looking is fake and is designed to get you to part with your money or your goods. This applies equally to Square Trade and PayPal. They will never email you certifying the genuineness of anyone.

l)A PayPal warning
There are fraudsters who use stolen PayPal accounts to accept payments. To lower the possibility of this, check your seller’s location as shown in eBay, and then see if it is one of PayPal’s permitted countries by clicking here: http://www.workwinners.com/nlr701.htm. If PayPal don’t offer their service in the country that the seller resides, be very wary.

m) Passwords
Never have the same password on your eBay and PayPal accounts. Or indeed on any other financial or personal site. Change your passwords every 30-60 days on both eBay and PayPal.

If your seller questions you to use escrow, and proposes an escrow company they’ve used before, this is a clear indication they are fraudulent. There are many fake escrow sites which will take your money fraudulently. The only escrow site recommended by eBay is http://www.escrow.com. s) Shill bidding
Shill bidding is where people work in cahoots to inflate the bidding on an item. A seller has a “partner” who makes bids on the seller’s items with a view to bumping up the bid price. They have no intention of buying the item. Fortunately, shill bidders and their associated seller can be stupid. The shill bidder will usually makes bids on other items from the same seller. Here’s how to check to see if shill bidding is a feature of a particular seller. First, look at the seller’s closed auctions over the last 30 days. If most of the closed auctions have no bids, it is unlikely the seller has shill bidders working with them. If all of the closed auctions have bids, take a look at the bid history. See if the same bidder appears in the list of bidders, usually with aggressive bidding and normally at the start of the auction. If so, you may have uncovered a shill operation, so avoid that seller’s auctions.

t) Keep your transaction information
Keep your own record of the transaction when you’re buying. Don’t just rely on eBay. You want a record of the seller’s identification, the item description, and emails sent and received, plus the time, date and price of your bid.

u) “I noticed your bid….”
Never deal with anyone who contacts you after seeing your bid on another auction. They will say something like, “I saw you bidding on that digital camera. I have the same model available for sale. I don’t have time to list it on eBay. It has more accessories than the one you lost out on. You can have it for xyz.” If you bite, they’ll probably take you down the fake escrow route. Also, if you entertain this proposition, you’re operating outside of eBay and therefore have no auction protection whatsoever.

v) Changed eBay ID
Never deal with anyone who has a changed ID icon next to their name. This icon means they’ve changed their ID in the last 30 days. Few legitimate people change their eBay ID. When was the last time you changed yours? There’s a 1% chance that an ID change is genuine, but 99% that it is fraudulent. Why take the risk?

w) Changed email address mid-stream
If a seller or buyer changes their email address on you in the middle of a transaction, stop dealing with them. It is likely their previous email account was closed down due to some irregularity – such as a previous victim reported them. If you reckon about it, why would any genuine buyer or seller change their email address whilst corresponding on a transaction they wish to conclude expeditiously?

x) Complications
Never get involved in any transaction where the seller/buyer tries to introduce a third person into the financial arrangements. They might question you to pay xyz, who will then pay the seller, and you will receive a discount or commission for your co-operation. Such proposals are always fraudulent. They prey on greed. Don’t be tempted.

y) Time is of the essence
This is a scam which is has more potential for success than traditional phishing attacks, as it is time sensitive. The fraudster searches for high value auctions that have just finished. The bid history for an auction contains hyperlinks to each bidder. The fraudster checks to see if the winning bidder is selling any items of their own. If so, they go to that auction and embed a request for payment from the first auction within a question for seller. This works because winning bidders are expecting request for payment shortly after an auction ends. A variation of this is to offer a bidder a “second chance”. This time the “Question the seller a question” email pretends that the real winner has backed out, and offers the item at a lower price. The buyer, believing the tale, is lured into paying to whom they believe is a genuine seller. Many eBayers have heard of the second chance system, but have no experience of it. This unfamiliarity coupled with the fact that a few weeks might have passed, makes this an effective method for fraudsters. The moral of this tale is never get involved in any transaction which arrives in your inbox via the Question the Seller a Question feature.

z) EBay IDs
Never us your email address as your eBay ID, or part of your eBay ID. Fraudsters have software which monitors internet traffic looking for information such as this. In most circumstances, a judgment of divorce of a foreign national court has no independent force outside the forum’s territory. Thus courts will enforce their own judgments within their own national boundary.

As a general rule, a judgment of a court of one nation may be recognized and enforced in another nation if the courts of that nation are willing to accept the decree of the nation where the judgment was issued.

Recognition and enforcement of foreign judgments occur when a U.S. court relies upon foreign divorce ruling, on the ground that it has been previously litigated abroad. Thus recognition of foreign divorce judgments is akin to the domestic U.S. doctrines of res judicat (or claim preclusion, prevents parties of a claim from re-litigating the same claim), and collateral estoppel (or preclusion which extends the preclusive effort of a judgment to re-litigation of issues that were chose in a prior action.) The enforcement of foreign divorce judgment is typically sought by a plaintiff who has obtained a judgment in a foreign country.

In the United States, the judgments of one state’s court are routinely enforced in another state. Article IV, Sec. 1 of the U.S. Constitution requires that “Full Faith and Credit shall be given in each State to the public Acts, Records, and Judicial Proceedings of every other state.” Congress has implemented the full faith and credit clause by statutory enactment providing that judicial proceedings “shall have the same full faith and credit in every court within the United States…as they have by law or usage in the courts of such State…from which they are taken.” (28 U.S.C. Sec. 1738. 1982).

The Doctrine of Comity

Presently, in the United States, there is no federal standard governing the enforcement of divorce judgments rendered by foreign courts. Unlike state judgments, foreign judgments are not covered by the full faith and credit clause of the U.S. Constitution and other statutes. Nor are there any federal statutes to enforce foreign divorce judgments in U.S. courts. The United States is not party to any international agreement regarding the mutual recognition of divorce judgments.

With the absence of a treaty or statute upon this subject, the duty rests upon the judicial tribunals to determine the rights of the parties in divorce suits brought before them. In doing this, the courts obtain such aid for their judicial choice, from the works of jurists, commentators and academic scholars, and from the acts of civilized nations. Thus U.S. courts may give recognition to the judgments of a foreign nation as a matter of “comity.”

The “doctrine of comity,” in the legal sense, is not an absolute obligation; it is a courtesy, where the court may recognize a foreign court order, but is not compelled to do so. This extension or denial of comity is discretionary to the U.S. court

Indian nationals domiciled in the United States, initiate divorce in India. Many of them have dual US-Indian nationalities. They travel to India for the sole purpose of obtaining divorce judgments from Indian courts. Then they travel back to the United States and serve the other spouses with divorce papers. Do the U.S. courts extend comity and recognize the enforceability of those divorce judgments? Or do the U.S. courts assert their own jurisdiction on the divorce cases? The key concepts in this “conflict of law” in the United States are two: subject matter jurisdiction (or competence), and personal jurisdiction.

For a foreign court to have authority to adjudicate a dispute involving divorce, it must have jurisdiction over divorce issues. A divorce can be granted only in a court designated to hear matrimonial cases. It is well settled that U.S. courts will not enforce foreign judgments unless foreign courts possessed “competence” or subject matter jurisdiction under foreign law. Consequently, lack of subject matter jurisdiction is a basis for non-recognition.

Personal jurisdiction, known also as “personam” is the power of a court “to hear and determine a lawsuit involving a defendant by virtue of the defendant having some contact with the place where the court is located.” (See http://legal-dictionary.thefreedictionay.com/Personal-Jurisdiction). Personal jurisdiction is a basic pre-requisite for the enforcement of a foreign judgment. The foreign court issuing the judgment must possess personal jurisdiction and authority over persons within its territory. This includes: domiciliary, citizenship, place of marriage, etc.

U.S. courts generally, are able to choose divorce cases based on at least one of the spouses being domiciled or maintaining a habitual residence within the geographic jurisdiction of the court. Domicile is defined as physical presence and an intention to live permanently in a location. Such intentions are determined by where a person is registered to vote, filing state tax return, state issued driving license, which school the children go to, does he or she join a gym in the area of residence and where the home is located, etc.

Divorce cases involving multinational jurisdictions are complex. Foreign divorces may involve immigration matters, child custody, division of marital assets and support orders, which have their own specialized enforcement issues. In most cases attorneys and litigants consult with experts in foreign laws before determination.

SUPER BOWL HISTORY

The year was 1966, and war was raging in professional football. It was a bidding war for talent and it had been going on since the American Football League came onto the scene in 1960 to challenge the National Football League, 40 years its senior. At first, the battles were for college players, and the AFL scored an early victory when a court ruled in favor of the Houston Oilers over the NFL’s Los Angeles Rams after both clubs had signed Billy Cannon, the Heisman Trophy winning halfback at Louisiana State.

Although the leagues agreed to a “no tampering” rule on existing player contracts, the stakes became high for college talent. Bonuses went sky-high. The AFL’s New York Jets signed Alabama quarterback Joe Namath in 1965 to a $400,000 contract, the largest amount ever for a collegian. In 1966, the NFL’s Atlanta Falcons gave Texas linebacker Tommy Nobis a $600,000 package and the Green Bay Packers forked over $711,000 to Texas Tech running back Donny Anderson.

Meanwhile, veteran players were settling for small raises on relatively small salaries. For example, John Brodie, the San Francisco 49ers quarterback, received $35,000 in 1965 and was asking for a raise to $65,000 after leading the NFL in completions, completion percentage, yardage and touchdown passes. Then came a back-breaker. Buffalo placekicker Pete Gogolak, who had played out his option in 1965, signed with the NFL’s New York Giants. The “no tampering” code had been broken. The conflict was in the open, and it was time for action.

On April 7, 1966, peacemaker Joe Foss resigned as AFL commissioner and the next day Al Davis, general manager of the Oakland Raiders, took over. Davis was a hawk in regard to the NFL, and he had a plot. Davis organized an AFL war chest and urged owners to start talking to established NFL stars. The NFL had bragged of its superiority because of the caliber of its quarterbacks. Davis wanted to sign those quarterbacks for the AFL.

The Raiders quickly signed Los Angeles quarterback Roman Gabriel to a commitment starting in ‘67. Houston offered the 49ers’ Brodie $75,000, spread over 10 years, to sign a five-year deal with the Oilers. Reportedly, eight of the NFL’s starting quarterbacks were dickering with the AFL. The NFL had no choice. On June 8, 1966, two months after Davis became the AFL commissioner, a merger agreement was announced. There would be a common draft starting in 1967, interleague preseason games starting in ‘67 and regular-season play combining the leagues in 1970. Territorial indemnification of $18 million was to be paid to the 49ers and Giants over a 20-year period. Most vital, from the standpoint of football fans, was the immediate establishment of a championship game between the leagues. This was the AFL-NFL World Championship Game — which was popularized as the Super Bowl from its inception.

Gabriel never went to the Raiders and Brodie never left the 49ers, but Brodie collected a million dollars on the agreement he had made in his talks with Houston. Davis resigned as AFL commissioner a month after the merger. He clearly had won his battle.
