World Bank urges Cambodia to stop mass eviction

PHNOM PENH (AFP) – The World Bank called on Cambodia Wednesday to halt a mass eviction taking place in the capital amid mounting criticism over forced displacements in the country.
"We are deeply troubled and frustrated about the people who are being forced from their homes," World Bank president Robert Zoellick said in a statement.
A private company headed by a ruling party politician is filling in a lake in central Phnom Penh for commercial development, a controversial project that will eventually displace some 4,000 lakeside families.
Half the residents living on the shores of the Boeung Kak lake have already left, but they received only limited compensation from the company, according to a local housing rights group.
The remaining residents have held frequent protests in recent weeks, urging the company and the government to provide adequate compensation or allow them to stay in their homes.
The Bank is offering the Cambodian government "financing and technical advice to find practical solutions," Zoellick said. "We have repeatedly called on the government to end the evictions."
Cambodia has faced mounting criticism over a spate of forced evictions in recent years.
Last month the UN special rapporteur for human rights in Cambodia, Surya Subedi, said he was "deeply concerned" about land rights violations.
In 2009 alone, at least 26 cases of mass evictions displaced approximately 27,000 people across the country, according to a UN report issued last year.
Land disputes have been a major problem in the country since land ownership was abolished during the 1975-1979 rule of the communist Khmer Rouge. Many legal documents were lost during that time.
The World Bank started a land titling programme in Cambodia in 2002 to address these issues, but it failed to include the Boeung Kak lake residents.
The government cancelled the programme in 2009, saying it was "too difficult".
A investigation by the World Bank later found that the lake residents were displaced in violation of policies it had agreed with the government for handling resettlement.
The Bank recognised it had been too slow to respond to the evictions, however.
A spokeswoman for the Cambodian Ministry of Land Management refused to comment on the statement but said a government response was expected shortly.

Statement of ASEAN Foreign Ministerial Informal Meeting

At the invitation of the Chairman of the Association of Southeast Asian Nations (ASEAN), the Foreign Ministers of ASEAN and their representatives met in Jakarta, Indonesia, on 22 February 2011. The Secretary-General of ASEAN also participated in the meeting.

The meeting discussed recent regional and international development, including the recent border incidents between Cambodia and Thailand.

In this connection, pursuant to the earlier written communications, Indonesia, Chair of ASEAN, further briefed the Foreign Ministers of ASEAN and their representatives on the result of the visits by the Foreign Minister of Indonesia to Phnom Penh and Bangkok on 7-8 February 2011, as well as on the meeting of the Security Council on 14 February 2011.

The Foreign Ministers of Cambodia and Thailand further briefed the ASEAN Foreign Ministers on the issue.

Following extensive discussions among them, the Foreign Ministers of ASEAN and their representatives:

"Welcome and support the reiteration by both Cambodia and Thailand, of their strong commitment to the principles contained in the Treaty of Amity and Cooperation in Southeast Asia and the ASEAN Charter, including "settlement of differences or disputes by peaceful means" and "renunciation of the threat or use of force", as well as the principles contained in the Charter of the United Nations;

Welcome further the engagement of Cambodia and Thailand with Indonesia, Chair of ASEAN, in the latter's efforts on behalf of ASEAN;

Recall the support extended by the United Nations Security Council to ASEAN's efforts

Support Cambodia's and Thailand's commitment, henceforth, to avoid further armed clashes as reflected in the initial high level talks between the military representatives of Cambodia and of Thailand, the most recent of which was on 19 February 2011;

Welcome in this regard, the invitation by both Cambodia and Thailand for observers from Indonesia, current Chair of ASEAN, to respective side of the affected areas of the Cambodia-Thailand border, to observe the commitment by both sides to avoid further armed clashes between them, with the following basic mandate:

"to assist and support the parties in respecting their commitment to avoid further armed clashes between them, by observing and reporting accurately, as well as impartially on complaints of violations and submitting its findings to each party through Indonesia, current Chair of ASEAN";

Call on Cambodia and Thailand to resume their bilateral negotiations, including through existing mechanisms, at the earliest possible opportunity, with appropriate engagement of Indonesia, current Chair of ASEAN, to support the two countries' efforts to resolve the situation amicably;

Welcome in this regard the future meetings respectively of the Thai-Cambodian Joint Commission on the Demarcation for Land Boundary and the General Border Committee at a date to be further determined;

Request Indonesia, Chair of ASEAN, to continue ASEAN's efforts in this regard".

Ministers also exchanged views on other regional and international issues, as well as issues related to ASEAN Community-building and ASEAN's role in the region's architecture building, including the forthcoming ASEAN Foreign Ministers retreat on East Asia Summit to be convened in Thailand in March 2011.

Franco-Thai War

The Franco-Thai War was a brief interstate war that erupted in early 1941 when the nationalist military government of Thailand annexed parts of the French Indochinese colonial protectorate of Cambodia and then resumed again after the Second World War in early 1946 when the French forced their return.

Origins

The historical origins of the war lie in several centuries of Thai expansion at the expense of Cambodia and 19th French imperialism in Southeast Asia. France had granted the two provinces (Siem Reap province was then called Angkor province) to Thailand (Siam) in 1867 in return for the Kingdom of Thailand's renunciation of its partial sovereignty over the Kingdom of Cambodia, which then became a French Protectorate. The two provinces were restored to Cambodia in 1907.

1941

The Fall of France in the June 1940 and the Japanese military occupation of Vietnam emboldened Thai nationalists/irredentists who wanted to annex Cambodia and Laos. Thailand had been ruled by the miltiary since the 1932 coup d'etat that overthrew the absolute monarchy. The conflict began with the distribution by the Thai miltiary government of leaflets calling for the "return" of both Cambodia and Laos. Neither Cambodia or Laos had ever been under unambigious and complete Thai political control and the cultural connections between Thailand and Cambodia hardly made them one nation. Although most Thais, Laotians and Cambodias share a belief in Theravada Buddhism and much of the Thai and Laotian high culture began in the Angkorian Empire in Cambodia, Khmer (the Cambodian language) is not related to any of the Thai or Laotian dialects. Khmer is instead an Australasian language related to Vietnamese and Mon. Aggressive nationalism rarely needs to take account of the facts however. Among the leading Thai nationalists were Nazi German and Japanese imperialist sympthasizers and "partisans of dictatorship" in their own country.
The war included aerial bombing and strafing raids on cities and villages by both the Thai and French colonial air forces. The Thais bombed Stung Treng, Battambang, Siem Reap, Sisophon, Ream and Mongkolborey. The French bombed Aranya and Ouborn. Offers of money were used by the Thais to encourage Cambodian and Laotian colonial troops to desert with their weapons and defect. Much of the fighting took the form of bloody skirmishes along the Thai-Cambodian border.
The most decisive battle in the war took place took place at sea. On January 17, 1941 the French Navy smashed the Thai Navy off Koh Chang Island and either sank or drove aground the Thai ships Dhonburi, Sri Ayuthia, Songkhla, Chonburi, and several Italian built PT boats.
In Japanese mediated negotiations in Tokyo in 1942, French Indochinese colonial officials were forced to cede all of Battambang province and parts of the provinces of Siem Reap, Stung Treng and Pursat. This represented a major portion of the rice production of French Indochina, the Pailin gem mines and part of the Tonle Sap Lake fisheries. The lost territories were renamed Phibunsongkhram province. The Japanese were hardly neutral parties in the negotiations. The Imperial Japanese Army wanted to use Thai territory for its military operations. The formal agreement was signed on March 11, 1941.

1946

The British, who had helped restore French colonial rule in Indochina below the Sixteenth Parallel (southern Vietnam and the rest of Cambodia) at the end of hostilities against Japan, signed a declaration refusing to recognize the Thai annexations on January 1, 1945. Retrocession of the lost territories took place in 1946 following sporadic firefights between French colonial and Thai forces that may have included at least one naval bombardment of the Thai position at Svay Donkeo by a French gunboat on Tonle Sap Lake. The new border restoring the lost territories was signed in Paris on November 17, 1946.

Border dispute keeps Thai businesses away

RECENT fighting on the border between Cambodia and Thailand has had a minimal impact on the country’s economic interests in a direct, measurable way. But the fallout comes from the fear factor generated as a result of the clashes, a much more difficult outcome to assess.

Speaking on the sidelines of a press conference on Wednesday confirming that a Thai trade fair would go ahead in Phnom Penh next week despite the fighting, representatives of companies including Thai Airways and Siam Cement Group said they had experienced little or no adverse effects.

Thailand’s national carrier has seen only 100 cancellations on outbound flights to Bangkok for this month as a direct result of fighting, said Narinthorn Purnagupta, Thai Airways general manager in Cambodia, which represents just 1 percent of traffic.

Inbound flights had seen even fewer cancellations, he added, just 40 so far.

Siam Cement Group (Cambodia) Managing Director Patham Sirikul said the company’s joint venture Kampot Cement had not seen any impact. SCG imports construction materials mostly through the Poipet border crossing which has remained open throughout.

A few cancelled holidays by Thai tourists does not represent a major dent to business ties between Cambodia and Thailand, but tensions translate into a lack of economic development in the border area around Preah Vihear and a lack of enthusiasm among Thai investors who may have otherwise considered Cambodia.

“The first thing is the feeling of their security,” Jiranun Wongmongkol, Thailand’s commercial counselor in Cambodia, said of the main impact on Thai investors here.

In August last year B-Quik, a Thai vehicle service chain, announced it planned to delay opening its first outlets in Phnom Penh until the end of this year because the company’s senior management were concerned about the attitude of Cambodians towards Thais in the wake of border clashes.

Whether or not other Thai companies have decided against expansion into Cambodia for the same reason is difficult to gauge, but clearly the current tense climate does not bode well for investment.

Cambodia’s trade with Thailand climbed 54 percent last year to US$2.6 billion, a sign that the Preah Vihear dispute has hardly had an impact, but clearly other countries in the region such as Vietnam and China have much better business relationships with the Kingdom than Thailand.

From Cambodia’s perspective this is unfortunate. As the second-largest economy in Southeast Asia, Thailand as a neighbour of Cambodia should be much more involved in the domestic economy than it is at the moment.

The reason behind this stuttering economic relationship is obvious. Reluctance in doing business derives directly from tensions at Preah Vihear.

ជាថ្មីម្តងទៀតខ្ញុំមានកិត្តិយសសូមថ្លែងអំណរគុណចំពោះការអញ្ជើញមកជួបខ្ញុំកាលពីថ្ងៃច័ន្ទទី៧ ខែកុម្ភៈ ឆ្នាំ២០១១ ទាក់ ទិនទៅនឹងរឿងវិវាទព្រំដែននៅតំបន់ប្រាសាទព្រះវិហារ និងជំរាបជូននូវការវិវត្តទាក់ទិននឹងព្រឹត្តិការណ៍ដែលបានកើតឡើង ចាប់តាំងពីកិច្ចប្រជុំលើកមុនមក ។

ស្ថានការណ៍យោធាក្នុងអំឡុងពេល៤ថ្ងៃ នៃការវាយប្រហារផ្ទួនៗគ្នា ចាប់ពីថ្ងៃទី៤ ដល់ថ្ងៃទី៧ ខែកុម្ភៈ ឆ្នាំ២០១១ ទាហាន ថៃបានប្រើកាំភ្លើងធំ និងទ័ពថ្មើរជើងជុំវិញតំបន់ប្រាសាទ ដែលបណ្តាលឲ្យមានការខូចខាតយ៉ាងច្រើននិងយ៉ាងធ្ងន់ដូចមាន រៀបរាប់ពិស្តារខាងក្រោម ដែលសមនឹងពាក្យថា “សង្រ្គាមពិត” ដូចដែលបានថ្លែងដោយ សម្តេចតេជោ ហ៊ុន សែន។
បើទោះបីជាពុំមានការវាយប្រហារជាលក្ខណៈទ្រង់ទ្រាយធំ ចាប់ពីថ្ងៃទី៧ខែកុម្ភៈក៏ដោយ ប៉ុន្តែសភាពការណ៍នៅតែស្ថិត នៅក្នុងស្ថានភាពគ្រោះថ្នាក់ខ្លាំងនៅឡើយ ដែលនឹងអាចកើតមានជាការវាយប្រហារសារជាថ្មីគ្រប់ពេលវេលា ជាពិសេស នៅពេលដែលថៃបានបន្តបន្ថែមកំលាំងទ័ពនៅតាមបណ្តោយព្រំដែន។

អ្វីដែលជាក្តីបារម្ភនោះគឺ៖
- ការប្រើប្រាស់អាវុធ ដែលមិនគោរពច្បាប់ ដោយទាហានថៃ ដូចជា អាវុធចង្កោម និងអាវុធគីមី។
- មេរោគ ដែលឆ្លងតាមគ្រាប់បែកចង្កោម (M42 និង M46) ដែលជះឥទ្ឋិពលយ៉ាងខ្លាំងនៅតំបន់ស្វាយជ្រុំដែលស្ថិតនៅ ក្នុងតំបន់អភិរក្ស និងភូមិធម្មជាតិដែលជាភូមិទើបបង្កើតថ្មីដែលមានចំងាយ២០ គីឡូម៉ែត និងជាទីដែលប្រជាជនមកពី តំបន់ជិតប្រាសាទបានតាំងលំនៅថ្មី។
- ការយកទីតាំងរស់នៅរបស់ជនស៊ីវិល និងទីអារាម ធ្វើជាគោលដៅនៃការវាយប្រហារ។

ទាហានថៃចំនួនប្រាំនាក់ត្រូវបានចាប់ខ្លួនដោយកម្ពុជា។ ទាហានទាំងប្រាំនាក់នេះបានទទួលនូវប្រព្រឹត្តិកម្មដោយមនុស្សធម៌ និងស្របទៅតាមអនុសញ្ញាក្រុងហ្សឺណែវ ឆ្នាំ១៩៤៩ ស្តីពី ប្រព្រឹត្តិកម្មលើឈ្លើយសឹក ហើយបន្ទាប់មកត្រូវបានដោះលែង ជាបន្ទាន់ ។

ទិដ្ឋភាពវប្បធម៌ទន្ទឹមនឹងនេះដែរការវាយប្រហារបានបណ្តាលឲ្យមានការខូចខាតដូចខាងក្រោម៖
- ការខូចខាតគោបុរៈទាំងប្រាំនៃប្រាសាទព្រះវិហារ ដែលបានចុះក្នុងបញ្ជីជាបេតិកភណ្ឌពិភពលោក
- ការខូចខាតស្កាកសញ្ញាសំគាល់ដែលដាក់នៅប្រាសាទ ដែលសរសេរថា “សម្បត្តិវប្បធម៌ស្ថិតក្រោមកិច្ចការពារពិសេស” (យោងទៅលើមាត្រា១៧ នៃអនុសញ្ញាក្រុងឡាអេ ឆ្នាំ១៩៥៤ ស្តីពីកិច្ចការពារសម្បត្តិវប្បធម៌ក្នុងពេលមានជម្លោះប្រដាប់ អាវុធ)។
- ការខូចខាតយ៉ាងធ្ងន់ធ្ងរ ទៅលើវត្ត កែវសិក្ខាគិរីស្វារៈ ដែលជាគោលដៅវាយប្រហារទីមួយ នាថ្ងៃទី៤ ខែកុម្ភៈ។

ការចាត់វិធានការដោយកម្ពុជា ចាប់តាំងពីការវាយប្រហារ ថ្ងៃ៤ ខែកុម្ភៈឆ្នាំ២០១១

នាថ្ងៃទី៥ ខែកុម្ភៈ ឯកឧត្តមឧបនាយករដ្ឋមន្រ្តី ហោ ណាំហុង បានសរសេរលិខិតទៅកាន់ប្រធានក្រុមប្រឹក្សាសន្តិសុខ អង្គការសហប្រជាជាតិ ស្តីអំពីស្ថានការណ៍ផ្ទុះអាវុធ។

នាថ្ងៃទី៦ ខែកុម្ភៈ សម្តេចតេជោ ហ៊ុន សែន នាយករដ្ឋមន្រ្តីនៃព្រះរាជាណាចក្រកម្ពុជា បានធ្វើសារលិខិតទៅកាន់ប្រធាន ក្រុមប្រឹក្សាសន្តិសុខអង្គការសហប្រជាជាតិ ដើម្បីស្នើសុំធ្វើការកោះប្រជុំជាបន្ទាន់ ក្នុងគោលបំណងដើម្បីបញ្ឈប់ការឈ្លាន ពានរបស់ថៃ និងស្នើសុំឲ្យលិខិតនេះផ្សព្វផ្សាយជាលិខិតផ្លូវការ។

នាថ្ងៃទី៧ ខែកុម្ភៈ ខ្ញុំបានសរសេរលិខិតមួយច្បាប់ ទៅកាន់អគ្គនាយកអង្គការយូណេស្កូ (លោកជំទាវ Irina Bokova) ដើម្បីស្នើឲ្យអង្គការយូណេស្កូរៀបចំបញ្ជូនបេសកកម្មវាយតម្លៃ និងជូនដំណឹងទៅដល់ សមាជិកនៃគណៈកម្មាធិការប្រតិបត្តិ នៃអង្គការយូណេស្កូ អំពីមហន្តរាយយ៉ាងធ្ងន់ធ្ងរមកលើប្រាសាទ។ លោកជំទាវបានបញ្ជាក់បង្ហាញជាបន្តបន្ទាប់ពីការគាំទ្រ របស់លោកជំទាវលើសំណើនេះ ហើយកិច្ចពិភាក្សានឹងបន្តធ្វើ ដើម្បីរៀបចំបេសកកម្មនេះ។

នាថ្ងៃទី៧ ខែកុម្ភៈ ឆ្នាំ២០១១ ខ្ញុំក៏បានសរសេរលិខិតទៅប្រធានគណៈកម្មាធិការបេតិកភណ្ឌពិភពលោក ដើម្បីស្នើសុំឲ្យ បញ្ជូនប្រេសិតពិសេសមកប្រាសាទព្រះវិហារ។

នាថ្ងៃទី៨ ខែកុម្ភៈ សម្តេចតេជោ ហ៊ុន សែន នាយករដ្ឋមន្រ្តីនៃព្រះរាជាណាចក្រកម្ពុជា បានជម្រាបតាមទូរស័ព្ទទៅកាន់ អគ្គលេខាធិការអង្គការសហប្រជាជាតិ ដើម្បីស្នើឲ្យអង្គការសហប្រជាជាតិ បញ្ជូនអ្នកសង្កេតការយោធា ឬកងរក្សាសន្តិសុខ មកសង្រ្គោះប្រាសាទព្រះវិហារ ពីការខូចខាតផ្សេងៗទៀត និងដើម្បីធានានូវសន្តិសុខ និងសុវត្ថិភាពទៅដល់បេសកកម្មរបស់អ្នកជំនាញការ និងដើម្បីបង្កើនទំនុកចិត្តរវាងភាគីទាំងពីរដែលថា កម្ពុជាមិនបានប្រើប្រាស់ប្រាសាទធ្វើជាមូលដ្ឋាន យោធានោះទេ។ សម្តេចតេជោក៏បានថ្លែងទៀតថា ការដោះស្រាយបញ្ហាជាលក្ខណៈទ្វេភាគីលែងធ្វើបានតទៅទៀតហើយ។

នាថ្ងៃទី៧ ខែកុម្ភៈ ខ្ញុំបានជំរាបតាមទូរស័ព្ទទៅកាន់លោកជំទាវ Irina Bokova អគ្គនាយកអង្គការយូណេស្កូ ដើម្បីតាម ដានលើលិខិតរបស់ខ្ញុំដែលបានស្នើសុំឲ្យអង្គការយូណេស្កូ បញ្ជូនបេសកកម្មវាយតម្លៃ ជាមួយនឹងអ្នកសង្កេតការយោធាក្នុង ការជួយផ្តល់សុវត្ថិភាព និងជូនដំណឹងដល់សមាជិកនៃគណៈកម្មាធិការប្រតិបត្តិរបសអង្គការយូណេស្កូពីមហន្តរាយដ៏ធ្ងន់ធ្ងររបស់ប្រាសាទ។ លោកជំទាវបានបញ្ជាក់ជាបន្តបន្ទាប់ពីការគាំទ្រលើសំណើនេះ ហើយត្រូវពិភាក្សាលើបញ្ហាដែលមានជា ប្រចាំ។

នាថ្ងៃទី៨ ខែកុម្ភៈ ឯកឧត្តមឧបនាយករដ្ឋមន្រ្តី ហោ ណាំហុង បានជួបជាមួយ ឯកឧត្តមបណ្ឌិត Marty Natalagawa ប្រធាននៃរដ្ឋមន្រ្តីការបរទេសសមាគមអាស៊ាន ដើម្បីពិភាក្សាទៅលើស្ថានការណ៍ តានតឹង និងបង្ហាញពីការគាំទ្ររបស់ កម្ពុជា លើជំនួយរបស់សមាគមអាស៊ាន ក្នុងការដោះស្រាយស្ថានការណ៍។

នាថ្ងៃទី៩ ខែកុម្ភៈ ឯកឧត្តម ឧបនាយករដ្ឋមន្រ្តី ហោ ណាំហុង បានចេញនូវសេចក្តីថ្លែងការណ៍មួយជំទាស់ទៅលើការ ចោទប្រកាន់របស់ថៃ ដែលថា កម្ពុជាបានប្រើប្រាស់ប្រាសាទព្រះវិហារធ្វើជាមូលដ្ឋានយោធាដ៏រឹងមាំ ដើម្បីវាយប្រហារលើ ទាហានថៃ។

ខ្ញុំសូមសំដែងនូវការកោតសរសើរយ៉ាងខ្លាំង ចំពោះឯកឧត្តមដែលនឹងអាចពាំនាំនូវសភាពការណ៍វិវត្តន៍ថ្មីៗទាំងនេះ ទៅកាន់ អគ្គលេខានៃអង្គការសហប្រជាជាតិ និងទៅកាន់ទីភ្នាក់ងារអង្គការសហប្រជាជាតិទាំងអស់ ដែលធ្វើការនៅក្នុងប្រទេស កម្ពុជា។

ការបាញ់ផ្លោងឆ្លងកាត់ព្រំដែនបានបំផ្លាញផ្ទះចំនួន៧ខ្នង ឱ្យខូចខាតទាំងស្រុង និង២៨ខ្នងទៀតបាន ប៉ះពាល់ខ្លះៗ។ អាគារចំនួនពីរខ្នងនៅក្នុងសាលារៀនភូមិស្រល់ តំបន់សាវថុងចៃ ក្នុងស្រុក កាន់ថារ៉ាឡាក់ ខេត្តសីសាកេត បានខូចខាតផ្នែកខ្លះ ព្រមទាំងការិយាល័យរដ្ឋបាលតំបន់សាវថុងចៃ ក៏ខូចខាតផងដែរ។

គ្រាប់ផ្លោងរបស់កងទ័ពកម្ពុជាក៏បានបំផ្លាញចំការកៅសូ៥០រ៉ៃថែមទៀត។

អ្នកភូមិចំនួន២១,៧២០នាក់ និងព្រះសង្ឃ៨អង្គបានភៀសខ្លួន និងភៀសព្រះកាយទៅកាន់ មជ្ឈមណ្ឌលចំនួន៣៧ នៅក្នុងស្រុកទាំង១០របស់ខេត្តសីសាកេត។

មជ្ឈមណ្ឌលជួយសង្រ្គោះមួយត្រូវបានបង្កើតឡើងនៅស្រុកកាន់ថារ៉ាឡាក់ ដើម្បីផ្ដល់ជំនួយ និងកិច្ច ការសង្រ្គោះដល់ជនរងគ្រោះ។

FUNCTION: Established to ensure the implementation of the Agreements on the Comprehensive Political Settlement of the Cambodia Conflict, signed in Paris on 23 October 1991. Under the Agreement, the Supreme National Council of Cambodia (SNC) was "the unique legitimate body and source of authority in which, throughout the transitional period, the sovereignty, independence and unity of Cambodia are enshrined". SNC, which was made up of the four Cambodian factions, delegated to the United Nations "all powers necessary" to ensure the implementation of the Agreements. The mandate given to UNTAC included aspects relating to human rights, the organization and conduct of free and fair general elections, military arrangements, civil administration, the maintenance of law and order, the repatriation and resettlement of the Cambodian refugees and displaced persons and the rehabilitation of essential Cambodian infrastructure during the transitional period. Upon becoming operational on 15 March 1992, UNTAC absorbed UNAMIC, which had been established immediately after the signing of the Agreements in October 1991. UNTAC's mandate ended in September 1993 with the promulgation of the Constitution for the Kingdom of Cambodia and the formation of the new Government.

Your Excellencies Government Members,

Your Excellencies Ambassadors and Representatives of Development Partners

Excellencies and Ladies and Gentlemen!

Today, it is my great pleasure to attend this important gathering and make discussion together on the progress and action plan for decentralization and deconcentration process. I would like to convey my most warmly welcome and profound gratitude to all Excellencies, ladies and gentlemen for your attention and contribution to the importance of decentralization and deconcentration reform.

Taking this opportunity, I would like to thank H.E Sar Kheng for producing the progress report and action plan for decentralization and deconcentration and I would like to express my high appreciation for his effort in leading the decentralization and deconcentration reform since the establishment of the National Committee for Support to Communes/Sangkats to the establishment of the National Committee for Management of Decentralization and Deconcentration Reform and the National Committee for Sub-National Democratic Development at the time being. I would like to admire the active participation of Your Excellencies, ladies and gentlemen who are members of the above mentioned committees.

As we are aware that the National Committee for Sub-National Democratic Development has been established under the Law on the Administrative Management of Capital, Provinces, Municipalities, Districts and Khans, which is the Organic Law. I think it is the first time that we are able to discuss decentralization and deconcentration comprehensively since the inception of the National Committee for Sub-National Democratic Development, where I would like to welcome once again such an important occasion.

Moments ago, we were presented with achievements derived from the Organic Law and short-term, medium-term and long-term plans for future implementation. These plans focus on legal documents and requirements for the sub-national election in May, requirements for post-election operation, requirements for medium-term and long-term implementations of deconcentration and decentralization.

Despite facing difficult circumstances, specifically the global financial crisis, the Royal Government is still able to maintain macroeconomic stability and achieve 7% of economic growth as expected. In 2008, despite the inflation rate rose during the first half of the year due to external factors, such as rising oil, food and commodities prices along with some internal factors, however, it went down since mid-2008, thanks to timely introduction of coherent policies, including public financial management measures and monetary and banking policy measures. In particular, with regard to the banking and financial sector, commercial banks are still operating as usual, receiving insignificant influence from the global financial crisis.

In general, economic growth during this decade is strong, with annual average of 9.4%. During the 5-year period from 2003 to 2007, the annual growth averaged 10.8%, with the peak growth of 13.3% in 2005. The economic growth then eased to 10.8% and 10.2% in 2006 and 2007 respectively. The inflation rate, which stood at 19.7% in 2008, is predicted to decline until late-2009 to 7%. The exchange rate is generally stable, with average rate of 4,072 Riels against one US dollar. Moreover, by implementing prudential monetary policy and exerting all efforts, the Royal Government has increase its gross international reserves to more than US$ 2 billion, equivalent to 3-month imports of goods and services for domestic consumption.

Indeed, the financial crisis which is currently hitting the world, will leave unfavorable effects on Cambodian economy for few more years. However, with proper policies and strategies, along with non-stop dynamic leadership and management that will ensure political stability, reform progress, initiatives in the private sector, continued support from official development partners, and the flow of FDI, the Royal Government expects that the economy will remain sound and the target of slashing poverty by at least 1% per annum set in the “Rectangular Strategy” is still attainable.

In addition, the most important thing is that the economic challenge in the previous year will not steer Cambodia away from its concrete path of multi-party democracy. In such difficult circumstances, the Royal Government is bold and committed to successfully organizing an election which is regarded free, fair, and democratic by national and international sources. Through the election result, the Royal Government has assumed its position and introduced the “Stage-II Rectangular Strategy” for Growth, Employment, Equity and Efficiency with strong commitment to realize this strategy. The Royal Government is committed to implementing sharp measures to realize all 4 priorities by:

1. Ensuring the sustainability of peace, political stability, security and social order to enhance state of law, to protect human rights and dignity and democracy.

2. Ensuring sustainable annual economic growth of 7% per annum with broader growth base, better competitiveness, and low single-digit inflation rate.

3. Ensuring poverty reduction of more than 1% per annum and improvement of major socio-economic indicators especially in the education, health and gender equity.

4. Ensuring broader coverage and improved efficiency and quality of public services to gain public confidence.

Indeed, the above four priority points are the most ambitious goals, especially in this context when the global economy and global financial system are in deep recession. The Royal Government believes that the goal of reducing people’s poverty could not be achieved in a short period of time. However, base on the experiences, past achievements, unwavering commitments and sustainable coherent activities, the Royal Government believes that it could build a Cambodian society with full peace, political stability, security and social order, and sustainable and equitable development, with strict adherence to the principles of liberal multi-party democracy, respect for human rights and dignity.

In concern with the Decentralization and De-Concentration policy the Royal Government had issued a Decentralization and De-Concentration Strategy Framework in 2005 which consists all the strategy on decentralization and de-concentration. Nowadays, the Royal Government has adopted the Organic Law which determines the time of council election, and also established the National Committee for Sub-National Democratic Development. These are the keys for the process which start from now. We have selected this path to ensure a sustainable economic growth at a broader and more competitive level and strengthen the management and quality of public services in response to the people’s need and reducing poverty. In reality we acknowledge that the Royal Government has no abilities to provide enough quality public services around the country from the capital city of Phnom Penh to the rural area. Hence, with the implementation of Decentralization and De-Concentration policy we have actually altered the way people’s work. The Royal Government is creating a sub-national level administrative system to handover a variety of roles including the provision of services and financial resource, human resource, and other resources from the national to sub-national level of government.

The Royal Government is aware that in order to achieve this achievement it is necessary to have a suitable time frame to implement this Decentralization and De-Concentration policy and the Organic Law, thus the Royal Government is preparing an important national implementation plan called the National Program for Sub-National Democratic Development. This program will start from early 2010 onward which will invent strategies and practical programs for 10 years to cover the implantation of the Organic Law and long-term strategies to achieve Decentralization and De-Concentration goals.

Therefore, this national program is expected to be a package link which consists of policies and other important procedures to:

1. Implement long-term strategic framework of Decentralization and De-Concentration which can be altered if necessary.

2. Implement the Organic Law.

3. Define policy and other important strategies that connect with decentralization and de-concentration.

4. Identify and implement various projects to support capacity development, investment, service delivery, land, natural resources, and environmental management, as well as the development of the sub national level economic base.

5. Identify and implement a detail and sequential framework which includes action plan, the preparation of staffs and resources as well as technical assistance with a clear time frame.

The success of implementing this program depends significantly on what need to be done in a few months and years a head. Taking this opportunity I would like to highlight some key issues that need to be addressed in the future.

The National Committee for Sub-National Democratic Development has a general responsibility to ensure the implementation of the Organic Law and will be given a clear duty to review the “accountability, and roles of ministries, institutions, and the authority at all levels to determine the duty that need to be transfer to the sub-national level councils. This essential affair is the core of the reform implementation.

For the time being, the National Committee for Sub-national Democratic Development has the ability to cooperate with all levels of the management including the Ministries/Institutions and the council of the whole sub-national administration in order to achieve the shared objectives of building, enhancing and sustaining the democratic development. The structure and system of the National Committee for Sub-national Democratic Development has been well designed to fulfill this task and the capital is ensured to be given in order to ensure the effectiveness and efficiency of the on-going administrative work.

A number of key Ministries such as the Ministry of Economy and Finance and the Ministry of Interior have to play leading roles in preparing various strategic policies. These Ministries are required to closely cooperate to ensure the efficiency of the implementation. Other Ministries and Institutions have to also pay careful attention to the roles, responsibilities and various functions in the existing framework today and in the framework, in which these roles, responsibilities and functions will be changed under the reform process of Decentralization and De-concentration. The Royal Government expects that each Ministry will try its best to attach itself to the policy of Decentralization and De-concentration and the Organic Law and abide by high responsibilities in implementing this policy and law.

When the new council is set up these councils will be adhered to the policy of decentralization and de-concentration and organization law. These councils have to consider about their new roles and responsibilities as well as contributing to the discussion and the implementation of decentralization and de-concentration and national program. This new kind of working regulation requires those councils to consult and participate with the local partners including the private sectors and civil societies in an attempt to develop its vision and development. In this regards, various councils at the Sub-national level have to be ready in accepting new responsibilities and functions, which will be transferred with the proper intellectual resources. This to-be-filled procedure will tremendously influence the achievement of the Sub-national Democratic Development together with the provision of quality services and responding to the local needs. Along with that, the national program will suggest and support these councils for planning and implementing this work.

In order to achieve the above objectives in the future, a governance institution will be established to replace the governance institution in the Capital, Provinces/Municipalities, Districts/Khans. At the local level, in the future, there will be a council and governing boards, which are different from the current system consisting of governor. The Organization Law for Administration of Capital, Provinces/Municipalities, District/Khans have already illustrated about the relationship, responsibility and accountability of these two organizations. However, there are still a number of different interpretations, in which of this occasion I would like to re-emphasize the relationship between these two organizations. In the framework of democracy and organization law, the councils exercise judiciary and executive powers. The councils represent the local interest and are primarily accountable for the locality and the government. As for the governing board, they are just the officials who implement the job according to the decision made by the councils and have to be accountable for its council. Based on the law, the councils could actually ask for the reshuffle of the governing board if any of the governing board members have not implemented conforming to their roles. This is a new way of work arrangement at the local level in order to improve democratic development, requiring the change of habit and behavior in the upcoming future.

There have been questions regarding the abovementioned issues as where the work will be implemented by the councils and governing board. As I have already demonstrated above it is absolutely sure that the Phnom Penh City Hall, Provincial, Municipal, District and Khan Offices will be the workplaces for the councils and governing board. We can periodically extend those workplaces according to the ability of our resources.

Along with that, the re-distribution of the roles and functions from the central level to the sub-national level, especially relating to the service delivery is truly a complicated process. We have not only thought of transferring a number of substantial functions such as primary health or primary education, but also have been clearly thinking of what function is most suitable with what level of administration as well as how to prepare finance, human capital and other resources related to those kinds of functions and how to plan for the transferring functions and resources, consistent with the capacity of the responsible administration. If the administrative capacity is not sufficient we have to transfer the resources or capacity building to those administrative levels, which is the responsibility of the ministries in charge in order to ensure that this work can be achieved according to an appropriate date.

The above process will surely have the impact on the roles and responsibilities of the national Ministries/Institutions, which will be changed. During this process, various ministries will maintain the common responsibilities including the creation of policies, supervision of the legal documents, counseling and support, observing and evaluating the implementation of the council. The Sub-national level will have to be accountable for the Royal Government and be financially accountable through audit and other financial safety principles. In this connection, the National Committee for Sub-national Democratic Development has to supervise to ensure that the councils all over the country have implemented their work according to the law and legal framework and not contrary to the constitution.

Regarding the work of military and security, sub-national administrations including the Commune/Sangkat councils have been delegated a number of tasks in maintaining security and social order within their locality through the mechanism of Commanding Unit in order to contribute with the Royal Government in strengthening peace, political stability. This role and responsibility have to be further implemented by the councils and the governing boards under the principle of decentralization, not de-concentration.

During the process of further reform, we have to be careful in the process of creating councils and division of functions to those councils ensuring that it will not hinder the Khum/Sangkat affairs or have made any decisions affecting the rights of those councils. The significance of this administration level is that the members of the Commune Councils have been directly elected by the people and trusted by the people in their locality and are the people who take the lead in local participatory and democratic governance.

More importantly, we have to set up an appropriate system to ensure that the councils to be newly elected in the election in upcoming June will be fully accountable for their voters, meaning the members of Commune Councils. This ultimate fulfillment of accountability is most significant for the confidence on the whole sub-national election system including the efficiency of the service delivery and development at the sub-national level.

We must put in a lot more efforts, time and resources for the implementation of the decentralization and deconcentration reform, and we hope this reform will result in a democratic development framework which strengthen and expand the quality of public service delivery and especially to reduce poverty.

We also hope that this reform will provide fruitful results in the framework of good governance as well. The strategic framework of decentralization and deconcentration reform has emphasized the policies for democratic development at the sub-national level through re-structuring and reform of administration for the whole sub-national government level. The vision of the strategic framework states that “The development of administrative system at Provinces, Capitals, Municipalities, Khans and Districts are based on the principles of joint participation in a democratic manner”. This system will carry out transparently and accountably with the purpose of improving development and providing outreach public service in response to the people’s need and helping in poverty reduction in its own ground.”

Hence, this reform provides an opportunity for the establishment of an outreach administrative system which illustrates important principles of good governance including accountability, linking together with rules, transparency, participation, equality and response. Also, this reform must push forward a concrete application in two different aspects of good governance; which have often been overlooked, especially in terms of efficiency and effectiveness which we will attempt to acknowledge those aspects into the new councils.

Indeed, the decentralization and deconcentration policies; and the Organic Law also provides the opportunity to strengthen gender equality and women’s participation in decision-making process at the sub-national government level. This reform also provides chances in boosting youths’ voices in decision-making which prepare them to become future leaders at all levels.

I would like to re-emphasize that all ministries, institutions and all levels of administrative authority must participate in organizing and implementing the new program. In relation to this issue, I would like to urge all development partners to provide financial and technical supports in order to provide the government with the ability to implement this reform with success through guaranteeing that every current co-operative financing plans and programs have been closely trimmed with national programs.

I have also realized that the preparation of the Organic Law and its implementation, especially every preparation to ensure that the new councils which will be formed from the up coming May’s commune council election will be able to operate immediately is putting a heavy burden on the National Committee for Sub-National Democratic Development and its own secretariat along with Your Excellencies, ladies and gentlemen who are here today. Indeed, we are facing a very complex task which requires us to spend a lot of time working on this long part with detail works in this limited time frame. Presently, we are at the starting point of decentralization and deconcentration process. Although, it’s a fully engaged process, it is a historical pride that we altogether participate in this decentralization and deconcentration reform in Cambodia.

In the end, I would like to express my high appreciation to the active participation of Your Excellencies, ladies and gentlemen in the process of decentralization and deconcentration reform. I also would like to express my sincere thanks especially to all valuable support of development partners and to the National Committee for Sub-National Democratic Development which has put in tremendous effort in organizing this very important meeting. What is Teleconference?

A teleconference is a meeting or conference held via a telephone or network connection between participants in remote cities or work sites. Many types of teleconferences exist, with the simplest form involving the use of a speaker phone at each location to conduct an audio conference. More sophisticated teleconference meetings involve the exchange of audio, video, and data. The term teleconference can also refer to a live event that is transmitted via satellite to various locations simultaneously.

Although teleconference is a broad term that includes a variety of options, the basics for all teleconferences involve the use of telecommunication equipment, users at multiple locations, and collaborative communication between the participants. The basic audio conference is in essence a conference call. Audio graphics, another form of teleconference, allows participants to share graphics, documents, and video in addition to audio; and involves additional equipment such as electronic tablets, scanners, and voice data terminals.

Email is a common example of a computer teleconference. Through the use of additional equipment, primarily a TV camera, a video teleconference most resembles a face-to-face meeting, incorporating the ability to view the participants at all locations. Many businesses have a videoconference room permanently outfitted with the necessary equipment.

The many advantages of teleconferencing for schools and businesses include the savings in travel time and costs to get all participants to one location. In the event of an urgent matter, holding a teleconference can be much quicker than arranging a meeting. Another advantage is that, due to accessibility, a teleconference allows large groups of participants to feel included in meetings and decision making. If necessary, a school or business can encrypt the signals to ensure the security of communications during a teleconference.

When choosing equipment for a teleconference, consider several factors. If using a web camera, test it in advance to determine that the camera is at an acceptable distance. A wired phone line is best for clarity. If a cordless phone is used, be prepared to change frequencies in the case of interference during the teleconference.

Cellular and speakerphones should be used as last resorts. Cellular phones frequently encounter interference and speakerphones pick up background noise and often produce echoes. Microphones are helpful in reducing background noise.

A teleconference requires specific rules of etiquette. Each participant should announce when he or she signs onto and off of a teleconference. Those involved should speak clearly and slowly, avoid monotone speech, and describe any body language important to the conversation. Cambodia, in general, has 1 capital city and 23 provinces. Phnom Penh is the capital city of Cambodia with the populations of almost 2 millions.

Kampong Cham, a province situates along the Mekong River is the biggest province in term of the populations while Mondulkiri, a province in the northeast is the biggest province in term of the land area.

Official Results Give CPP 75% of Council Election Vote

The National Election Committee released the official results of Cambodia’s first-ever provincial, municipal and district council elections Wednesday. According to the official results, the ruling CPP dominated the proceedings, picking up 8,545 votes- about 75 percent of the total vote- at the provincial and municipal level, while the SRP finished in distant second with 2,317 votes, Funcinpec clinched only 236 votes and the Norodom Ranariddh Party even fewer at 231 votes. Out of the total 374 provincial councilors elected, the CPP swept the board, acquiring 302 of the positions, with women candidates making up just 9.9 percent of all provincial councilors. The SRP fared best in Phnom Penh, where it picked up 7 of the 21 available capital seats with the rest going to the CPP. At the district level, the CPP picked up 8,473 votes of the total 11,331 votes cast. The SRP mustered 2,332 votes with the NRP garnering a meager 264 and Funcinpec 262 votes. The results meant that the CPP picked up every single one of the 193 chief district councilor positions available. The CPP has a total of 2,249 district councilors, with the SRP registering just 518. Funcinpec has 55 and the NRP 39. According to the results, just 12.5 percent of all district councilors are women. (Cambodia Daily, May 28, 2009)

Four Parties Contest Up Coming Sub National Elections

Secretary General of the National Election Committee (NEC) Mr. TEP Nitha has told the press on Sunday that only the Cambodian People’s Party (CPP), FUNCINPEC Party, Norodom Ranariddh Party and Sam Rainsy Party have proposed to stand for offices in the upcoming May Sub-National Administration Elections. Through these elections the Commune and Sangkat Councilors throughout the country will elect their party’s members for the councils in the district and provincial level. The 11,353 commune and Sangkat Councilors will elect about 3,235 representatives. The CPP holds 7,993 seats, Sam Rainsy 2,660 seats, FUNCINPEC 274 seats and Norodom Ranariddh 424 seats within commune and sangkat councils. The Committee for Free and Fair Elections in Cambodia (COMFREL) predicted that the CPP will be receiving 2,436 seats within the sub-national councils which is more than 75% of the total seats and Sam Rainsy Party will be receiving 689 seats, Norodom Ranariddh 60 seats and FUNCINPEC 44 seats.

New Administration Structure in Cambodia

According to the Organic Law promulgated by the Royal Degree No. NS/RKM/0508/017 dated May 24, 2008, the administration structures in Cambodia have been reorganised. Now Cambodia has autonomous Capital City, Provinces, Municipalities, Districts and Khans. Those are called "The Sub-National Administrations". Each administratio managed by a council as legislative body and a board of governors as executive body. The council members are to be elected indirectly and the board of governors are to be nominated by the national governement.

Cambodian Government has issued a sub-degree No. 26 ANKR-BK dated January 29, 2009 to limit the board of governors for the Capital City, Provinces, Municipalities, Districts and Khans.

Follows are the list of the board of governors of those sub-national administrations decided by the head of the Royal Government of Cambodia:

Article 1- To limit the number of Board of Governors of Capital Phnom Penh and every province in accordance with article 140 of the Law on Administrative Management of Capital, Provinces, Municipalities, Districts and Khans as follows:

1- Capital City Phnom Penh: 7
2- Kampong Cham Province: 7
3- Kandal Province: 7
4- Battambang Province: 7
5- Prey Veng Province: 7
6- Siem Reap Province: 7
7- Takeo Province: 7

8- Banteay Meanchey Province: 6
9- Kampong Speu Province: 6
10- Kampong Thom Province: 6
11- Kampong Chhnang Province: 6
12- Kampot Province: 6
13- Svay Rieng Province: 6
14- Pursat Province: 6
15- Kratie Province: 6
16- Preah SiHanouk Province: 6

17- Preah Vihear Province: 5
18- Rattanakkiri Province: 5
19- Koh Kong Province: 5
20- Stung Treng Province: 5
21- Udor Meanchey Province: 5
22- Mondulkiri Province: 5
23- Kep Province: 5
24- Pailin Province: 5

Article 2- To limit the number of Board of Governors of municiplaities, districts and khans in accordance with the Law on Administrative Management of Capital, Provinces, Municipalities, Districts and Khans.

With the new arrangement, Cambodia has 1 Capital City, 23 provinces, 26 municipalities, 159 districts and 8 khans. The communes and sangkat remain the same in number -1621 communes and sangkats. The sangkats have been recently increased due to the changes of the status of the district in the provincial capital from district to municipality, therefore the previous communes have also been changed to sangkats.

There are changes to the current areas of some provinces recently due to the preparation of the up comming district and provincial councils. For instance, Kampong Seila (a district of Koh Koh) now has been merged to Sihanouk Province, 2 communes in Veal Veng District (Pursat Province) have also been merged to Battambang. Kep, Pailin and Sihanoukville municipalities now have been lowered to be provinces namely Kep Province, Pailin Province and Sihanouk Province.

Cambodian Pride

Cambodian pride can not be violated at last. Preah Vihear has now been listed as the newest world heritage of UNESCO during the UNESCO Quebec meeting on July 8, 2008.

As Khmer, I am very proud to be born as Khmer. More than this, I am really proud when seeing that the World is always supporting the Khmers.

Thanks to UNESCO and thanks to all Cambodian's loving countries.
