सभी मित्रो को नमस्कार, WP/1127/2013 की आज की सुनवाई मेँ माननीय कोर्ट ने जो फैसला दिया हैँ वह बहुत ही सकारात्मक हैँ लेकिन कुछ लोगो को यह फैसला बिलकुल नकारात्मक लग रहा हैँ ।

अधिकतर लोगो का मानना हैँ कि EOW को बहुत लंबा समय दे दिया गया हैँ । जब मेने भी यह फैसला सुना तो मेरे मन मेँ भी एक पल यही बात आई थी कि EOW को वाकई बहुत लंबा समय मिल गया हैँ । लेकिन जब मेने ठंडे दिमाग से सोचा तो मुझे यह फैसला बहुत ही सकारात्मक और सुकुन भरा लगा । क्योकि रोज- रोज की तारीख से अच्छा हैँ कि एक लंबी अवधि ही सही लेकिन एक समय सीमा तो तय हो गई । अब किसी को बार बार अपडेट के लिये परेशान नही होना पड़ेगा , अब सभी लोग जान चुके हैँ कि चार्जशीट 16 दिसबंर तक जमा हो जायेगी ।

इस आदेश से उन लोगो को भी जवाब मिल गया होगा जो अक्सर पुछा करते थे कि आखिर EOW चार्जशीट कब जमा करेगा और जो लोग कहा करते थे कि EOW कभी भी चार्जशीट जमा नही करेगा । कल तक चार्जशीट के प्रति संदेह की स्थिति थी और आज के इस फैसले ने अचानक हमेँ चार्जशीट के लिये आश्वस्त कर दिया हैँ । अब यह बात हर कोई जान चुका हैँ कि चार्जशीट 16 दिसंबर तक जमा होना निश्चित हो गया हैँ । कुछ लोग कहते हैँ कि 16 दिसंबर 2013 को तो चार्जशीट ही जमा होगी फिर 2014 मेँ ट्रायल शुरू होगा फिर डेट डेट का सिलसिला शुरू हो जायेगा, फिर कभी वकील अबसेँट कभी जज । ऐसा करते करते 2014 खत्म हो जायेगा फिर 2015 फिर 2017 और फिर 2021.... इसके जवाब मेँ, मेँ यह कहना चाहुगाँ कि यह सिर्फ और सिर्फ आपकी नकारात्मक विचारधारा की देन हैँ जो आप लोग ऐसा सोच रहे हैँ क्योकि कीकत यह हैँ कि स्पीक एशिया के मामले मेँ आज तक जितना भी विलंब हुआ हैँ उसकी सबसे बड़ी वजह जाँच ही रही हैँ । जब तक किसी भी मामले की जाँच पूरी नही हो जाती तब तक उस पर कोई भी चार्ज लागु नही हो सकता । इस विलंब मेँ जो लोग स्पीक एशिया को दोषी मानते हैँ क्या उन्हे नही पता हैँ कि अभी भी जाँच पूरी नही हुई हैँ और कोर्ट मेँ चार्जशीट भी जमा नही की गई हैँ । और इस पूरे मामले मेँ स्पीक एशिया ने जाँच अधिकारीयोँ को हमेशा पू दिया हैँ । दुनिया मेँ कोई भी व्यक्ति या कंपनी अदा मेँ तब तक नही जीत सकता जब तक की उस पर कोई चार्ज ना लगाया जाये ।

स्पीक एशिया भी इसी वजह से आज तक जीत नही पा रही हैँ क्योकि आज तक कंपनी पर कोई भी चार्ज नही लगाया गया हैँ , तो भला कंपनी अपने आपको निर्दोष साबित करे तो करे कैसे..? जिस दिन कंपनी पर चार्ज लग जायेगेँ उस दिन कंपनी कंपनी अपने आपको निर्दोष साबित कर के दिखायेगी ।

कुछ लोगो का कहना हैँ कि 16 दिसंबर को भी EOW कुछ बहाना बनाकर चार्जशीट जमा नही करेगा जबकि ऐस भी नही होगा आप लोग धैर्य रखे अब EOW कोई भी नया बहाना नही बना कोर्ट का लिखित फैसला हैँ सिर्फ मौखिक आदेश नही हैँ अतः EOW को इस आदेश का सख्ती से पालन करना ही होगा क्योकि EOW ने इस विषय मेँ स्वयं कोर्ट मेँ हलफनामा भी दिया हैँ । अब EOW को हर हाल मेँ 16 दिसबंर तक चार्जशीट जमा करना ही होगी । कुछ लोग कहते हैँ कि 16 दिसबंर तक जज बदल जायेगा जबकि यह भी सिर्फ कुछ लोगो की अपनी निजी सो हैँ ना कि जज साहेब की । 16 दिसबंर तक ना तो जज साहेब नौकरी छोड़ने वाले हैँ और ना हि वो सेवानिव्रत्त होने जा रहे हैँ और ना हि उनका तबादला हो वाला हैँ । कुछ लोग कहते हैँ कि ऐसा तो कोर्ट ने पहले भी आदेश दिया था जिसे EOW ने बहाना बनाकर टाल दिया था । जबकि हकीकत यह हैँ कि कोर्ट ने इसके पहले ऐसा कोई आदेश कभी भी नही दिया हैँ । ऐसा आदेश पहली बार सुनाया गया हैँ और EOW को हर हाल मेँ इस फैसले को मानना ही होगा । एक बार चार्जशीट जमा हो जाये फिर हमेँ जीत चंद कदमो की दूरी पर नजर आयेगी । और वैसे भी अब जीत ज्यादा दूर नही हैँ । हमेँ यह 4 महीने का समय लंबा लग रहा हैँ लेकिन कोर्ट के नजरिये से देखा जाये तो इतने समय को बहुत ही छोटी अवधि कहा जा । और वैसे भी जिसने करीब 3 साल इंतजार किया हो उसके लिये 4 महीने बहुत ज्यादा भी नही होते । अगर अभी भी यह समय लंबा लग रहा हैँ तो एक बार EOW से पुछो वो बतायेगा कि उसे कितना कम समय मिला हैँ । मेँ जीत के प्रति पूरी तरह से आश्वस्त हुँ और अब इसमेँ संदेह आपको भी नही होना चाह ।

The Hearing of Writ 1127 which have opened the gate of hope and bright future and living for all those people who have been dedicated with great unity and trust since a very long time

Today the matter which was heard about Data Sharing was kept in front of the Hon” Judge in Mumbai High Court.The investigation agency denied to share the data now because the Investigation is on and they have not completed yet which has been the main reason for not filing the Charge sheet.

Upon hearing the Hon Judge have passed the order of a deadline or a time limit or what we call as TIME BOUND to the investigation agency for filing the Charge sheet.

Once the Charge sheet is filed the Investigation will be OVER however till 16th Dec 2013 the investigation will be on as the investigation agency will be doing their work more rigorously and with pressure as directed by the Indian Judiciary.The main problem which was Filing the Charge sheet has now come to a time limit which is 16th Dec 2013

We can expect some great and happening news by January which is by New Year.The company materials can be given back and data sharing can be done then and once the payments starts which is again expected after 16th Dec the Criminality's which has been mounted over the company will VANISH…A Time for celebration can be foreseen at that time…

स्पिक एशिया मामले में आज एक अच्छी समाचार आ रही है। WP/1127/2013 की सुनवाई करते समय जस्टिस धर्माधिकारी ने आर्थिक अपराध शाखा मुंबई को फटकार लगाते हुए कहा की एफ आई आर नंबर 60 साल 2011 में रजिस्टर हुवा था, और अभी 2013 चल रहा है अभी तक चार्ज सीट क्यों नहीं फाइल हुई।

कोर्ट ने कहा की एक सप्ताह के अन्दर और चार्जसिट फाइल होने के पहले जाँच अधिकारी एफिडेविट फाइल करें। अगर जाँच अधिकारी एक सप्ताह के अन्दर एफिडेविट जमा नहीं करते है तो कोर्ट जाँच अधिकारी को दो सप्ताह के अन्दर चार्जसिट जमा करने का आर्डर दे देगा।

3 Though, it does appear that the applicant has not scrupulously complied with the condition to attend the office of the investigating agency, it also appears that whenever he attended he was not interrogated. Under these circumstances,instead of going deeper into the matter, what needs to be observed is that, the investigation is still in progress and, therefore, the applicant’s presence before the investigating agency for interrogation/investigation may be required.

4 Since some grievance is made that some of the other accused, who have been released on bail, are not available to the investigating agency for such interrogation/investigation, I am not inclined to cancel the requirement of reporting to the office of the investigating agency entirely. However, in my opinion, it would be sufficient, if the applicant is required to attend the office of the investigating agency, once in a month i.e. on the first Wednesday of each calendar month till the completion of investigation, as may be signified by filing of a charge-sheet.

5 It is clarified that, this shall not prevent the investigating officer from summoning the applicant for interrogation/investigation, as and when required

6 It is agreed by the learned counsel for the applicant, on instructions, that, a notice or intimation requiring the applicant to attend before the investigating officer given by SMS would be sufficient in that regard.

Writ 1127 which has been filed by the company’s legal team which is for claiming the admin rights and server for which a scheduled date is kept in this month…Indian Judiciary will decide as to whom the server will be given between the two entity – SPEAKASIAONLINE or HAREN VENTURE PTE LTD whomsoever is the authorized person to claim the server…

Another most important thing that will be decided between the company and the Indian Judiciary that whether the entire payments will be cleared or just Exit payments will be cleared…for this Writ 1127 is important…

It has also been observed on 25th June hearing was taken place in which there were some sealed envelopes which was submitted in High Court…now what was inside that sealed envelope it has not been revealed yet…and the envelope shall be witnessed by the Hon judge who shall justify many thing on the basis of sealed envelope submitted

It has also been observed that all those big leaders or panelists who have earned Huge money from Speakasia have avoided the TAXATION and have been underground for long time which is also a major concern for DELAY for all of us …company …Indian judiciary and the investigation agency EOW in filing the Chargesheet…

However it is said and expected EOW to file its Chargesheet soon – ONLY EXPECTED not confirmed yet unless they gather all informations and catch those who have avoided the TAXATION part earned in Speakasia business

So Friends keep your spirit high…be positive as we did not do anything wrong…why to fear anyone…lets stay united and wait for the outcome from the Indian judiciary and we await the Justification for further proceedings in favor of all panelist and the company

ABA 554/2013 , Anticipatory Bail Application of Aman was heard In Bombay High Court yesterday and the same was withdrawn due to some technical reasons with the permission to file the same again. The fresh ABA with Registration No.4457/2013 has been filed today and is expected to be heard on Monday 27/05/13.
As we all know Aman has protection against arrest till 24/05/13. Aman moved an application in the Sessions Court Mumbai to extend this protection on the ground that the order of 17/05/13 was made available to him today itself. The Court has kindly granted the extension of the protection till 28/05/13.

I assure you all that every doubt will be cleared in a week. Very tough task is given by the courts to AISPA & Speakasia. But I'm very confident that maximum people will be satisfied at right time.

Allegations are coming from everywhere. People are getting restless, they want to know each & everything right here & right now. Legal teams are being dragged. No issues because it's a matter of our money, lives & social respect so the questions will arrive. One request to all that please don't be judgemental at your own & don't reach to any conclusion without listening other party. In our ongoing effort to execute the Exit policy announced by the company earlier, we had sent out two test batches of payments to a few randomly selected panelists. While the first test batch experienced some glitches, the second test batch was executed with relatively lesser number of obstacles. This has given us the courage to undertake the payment to all the applicants of the exit policy of the company.

As the company servers and database are still in the possession EOW, Mumbai, the company has decided to approach the Honourable Mumbai High court and to this end the company has filed a WRIT in the Mumbai high court with reference number WP/1127/2013 with the hearing dated expected on April 5, 2013. The company via this WRIT is requesting the Honourable court to direct the Mumbai EOW to hand over the database of the panelist so that we can execute the exit option at the earliest.

The latest news about Speak Asia Online Pvt Ltd management reveals that the website www.speakasiaonline.com will resume its operations within next one or two days. As announced earlier, the exit option will be functioning when the original website is operational within the next few days.

The EOW (Economics Offense Wing) has made significant progress on the investigations last week. At any time, it is expected they will release a positive statement with a set of guidelines to be followed in order to continue the survey program. There are no clues about what are those conditions and every one is eagerly waiting for the final hearing.

After the announcement of exit option by the SAOL management, there are both positive and negative opinion from the panelists. Those panelist who are confident about SAOL’s management, they say that once the operations are started with the modified policies (if applicable), the business growth may not be like the case earlier to the EOC incidence, but on a long run, this may not be a big problem to the SAOL’s vision. It has been noticed that many panelist has forgotten their sponser id details as there is nowhere an email or any document issued to the panelist with the sponsor id information. This has created a strange situation to lot of panelists and they necessarily need to login to their panel to fetch this information in order to apply for the exit option.

People who have joined the program recently who has got negative opinion about SAOL, may find the exit option very attractive. They may choose to exit from the program safely so that a major filtering will happen post the exit operation.

Hence, it is expected that all is happening is good for the welfare of both Speak Asia Management as well for the Panelist. The panelists have waited for so long, now the climax is just awaited in the next few days.

2. The learned counsel for the Company

was also heard and he stated that the Company

wanted to do away with intermediaries and bring

products to consumers directly from the

manufacturers. For this, the Company wanted to

undertake surveys in order to know the

requirements of consumers. Therefore, the

Company wanted to enlist panelists for

conducting such surveys. Now, since the

panelists were laymen, they had to be trained

into conducting such surveys. Therefore, they

were made to subscribe to an e-magazine, which

was mailed directly to those un-initiated

individuals in the art of conducting the

surveys. For this the panelists were required

to pay `11,000/- each to the Company. It seems

that if a panelist succeeded in enrolling

persons on the Panel List of the Company, such

panelist was to get some reward points. Also,

for every survey conducted, the panelist would

counsel for the Company intervenes and points

out, and usefully in my view, that the

subscription for the e-magazine was to go to

Haren Ventures, a sister concern of the

Company. This is all the more better since it

shows the ingenuous ways in which the Company

works. The panelists were to get their reward

points and it was also promised that every

panelist concerned would get a chance of

conducting two surveys in a week and in 52

weeks the panelist concerned would get

`52,000/- against his investment of `11,000/-.

3. According to the estimate of the

learned Special PP, twenty lac panels were

created by twenty lac panelists, each of whom

must have invested a minimum of `11,000/-. The

payments, which were promised, stopped coming

and the panelists got restive and one of them,

who is also present before me today and wants

to intervene in the matter, filed a report with

Nirmal Nagar Police Station, Mumbai, which was

eventually transferred to the EOW.

4. The matter had been carried by some

115 persons to the Supreme Court directly under

Article 32 of the Constitution of India by

filing a petition being Writ Petition (C)

No.383 of 2011. In the said writ petition the

Supreme Court passed an order appointing

Hon'ble Shri Justice R.C. Lahoti, former Chief

Justice of India, as the mediator. It seems

that the Company had deposited US$ 10-million

in terms of the earlier orders passed by the

Supreme Court. Eventually, by the order dated

19-9-2012, the amount which was deposited suo

motu was allowed to be withdrawn because the

writ petition was disposed of as the

investigation by the EOW was going on.

5. The learned counsel for the parties

also drew my attention to the orders passed by

this Court in Writ Petition No.3611 of 2011.

Initially, the prayer in Writ Petition No.3611

of 2011, which was filed by the applicant

amongst others, was to direct the respondent

not to take any action or carry out any

investigation against the panelists of the

Company. Subsequently, pursuant to the

observations of the Court, it seems that the

All India Speak Asia Panelists' Association, of

which the applicant is the Secretary, sought

relief of quashing of the FIR itself.

6. The learned counsel for the applicant

stated that the applicant is in fact a victim.

He has also suffered a loss of `64,000/-.

However, in order to avoid trouble, he took

lead in ensuring that the first informant was

paid `6,06,000/- by collecting it from various

sources, one of the sources being his own wife

Anju Agarwal. The learned counsel for the

applicant points out that various blogs on

which the investigating officer seeks to rely

have been posted on a website created by the

All India Speak Asia Panelists' Association.

These blogs invariably end with a slogan, “Jai

Speak Asia”. Yet, the applicant repeatedly

states, and is at pains to state that, he is

not associating himself with the Company. He is

the victim of the designs of the Company and

therefore he should not be subjected to any

custodial interrogation.

7. The learned Special PP is of course of

the other view and submits that the applicant

and others like him are in fact the persons

behind the whole business of the Company and

therefore their presence in custody is required

for the purpose of investigation. Since the

learned counsel for Company wants to file an

affidavit explaining as to how the Company

works and since the first informant, in-person,

also wants to file an intervention application,

list this application on 23-1-2013. Till then

the interim relief to continue.

8. As I part with this matter for the

day, I faintly remember that the law as to

trial for offences, as laid down in Sections

218 and 219 of the Cr.P.C., is that for every

distinct offence there has to be a separate

charge and a separate trial in which maximum

three offences of the same kind committed

during an year can be clubbed together for

trial. Of late, tendency of the investigating

agencies to join all the people who have been

cheated into one investigation and file a bulky

charge-sheet is growing. This first delays the

filing of charge-sheet and secondly, the

commencement of trial, leave aside its

conclusion. The learned Special PP submits that

Section 223 of the Cr.P.C. permits joint trial

if several acts of cheating or misappropriation

are committed in the course of the same

transaction. I am at a loss to understand as to

how cheating of the present first informant and

cheating of the other persons who also joined

as panelists can be said to be a part of the

same transaction. Each act of persuading each

individual to part with his money would be a

separate transaction. Let the investigating

agency not give an impression to the common man

by clubbing all these items of cheating

together and by over-loading the charge-sheet

to such an extent that the trial will never see

the light of the day, that the investigating

agency is also conniving with the fraudsters in

duping the common man.

9. The learned Special PP states that he

would explain to me the reasons by submitting

some confidential details.

आदरणीय स्पीक एशियन्स, कुछ लोग अपने निहित स्वार्थ के लिए कभी भी तथ्यों को स्वीकार नहीं करेंगे अपितु अपने अप्रसांगिक तर्कों द्वारा लगातार दूसरों को भ्रमित करेंगे एवं खुद भी भ्रमित रहेंगे। जो नासमझ हो, उसे समझाया जा सकता है परन्तु जो समझ के भी नासमझ बना रहे, उसका कोई इलाज नहीं। कहते हैं की मरे और मुकरे को कोई ठीक नहीं कर सकता। फिर भी एक प्रयास तो किया हे जाना चाहिए, जिस से कि इस अवस्था से अभी तक बचे लोगों को भ्रमित एवं रोग ग्रस्त होने से बचाया जा सके।

सबसे पहले हमें यह हमेशा याद रखना होगा कि भागने वाले भाग जाते हैं। अदालत में लड़कर कोई नहीं भागता। चलो मान लेते हैं कि स्पीक एशिया भाग ही जाना चाहती है। तो फिर उसे देश के सम्मानित वकीलों को लेने की कोई ज़रूरत नहीं थी। किसी भी वकील को ले के यह लड़ाई आसानी से हारी जा सकती थी और कह देते कि हमने तो बहुत कोशिश की, अब क्या कर सकते हैं? लेकिन ऐसा हुआ नहीं, कंपनी ने एक से एक वरिष्ठ वकीलों की सेवाएँ लीं।

उदाहरण के तौर कुछ companies के नाम लेने ज़रूरी हैं जहाँ लोगों का पैसा और इज्ज़त दोनों गए।

1. सिटी लिमो
2. स्टॉक गुरु
3. राम सर्वे
4. यूरेशिया
5. बिड वर्ल्ड
(इन नामों में बहुत जल्द 2 नाम और जुड़ने वाले हैं।)

अब इन में से ऐसी कौन सी कंपनी है जो अपने मेंबर्स के लिए लड़ रही है? किसी को कुछ अता पता है इनका?जबकि इनके मेंबर्स ही इनके खिलाफ जा के शिकायत दर्ज करा के आये थे। कभी इनसे पूछना की आजकल क्या चल रहा है और इनकी मैनेजमेंट क्या कर रही है, इनके लीडर्स कहाँ हैं? कोई चमचा तक नहीं दिखता इनका?

इसका कारण यह है कि इन कंपनियों में ईमानदारी नहीं थी, इसी लिए यह भागे याँ दबा दिए गए, ना इनके मेंबर्स कभी भी संगठित हो पाए और ना तो कोई इनका लीडर सामने आया और ना ही कोई चमचा। एक बात यहाँ यह समझने वाली है कि सारी शक्ति सत्य, ईमानदारी और मजबूत इच्छाशक्ति में ही छुपी है। प्रशन खड़ा करना हमेशा से ही आसान रहा है, उत्तर देने में शक्ति की ज़रूरत होती है। आरोप बहुत आसानी से लगाये जा सकते हैं, आरोप सहने में शक्ति लगती है। घर बैठ कर खिड़की से तमाशा देखना बहुत सुहाता है, तमाशा खुद बन जाने में शक्ति लगती है।

कुछ लोग यह इलज़ाम लगाते हैं कि हम क्या समझें आम पनेलिस्ट का दर्द। मेरे भाई, दर्द समझा है, खुद पर भी झेला है। इसी लिए आज भी डट कर खड़े हैं। हम पॉवर एडमिन को किसी ने trained नहीं किया। हम में से तो एक भी torch bearer meet में भी नहीं था। आधे से ज्यादा admins ने कभी कोई सेमिनार तक अटेंड नहीं किया, कईयों ने एक पैसा तक नहीं कमाया। 1-2 को छोड़कर कोई आजतक तारक जी यां मनोज जी से कभी मिला नहीं, उन्हे कभी देखा तक नहीं। हम अपने स्तर पर ही हर खबर पता करते रहे, अदालतों के चक्कर काट काट के और अपने सब भाइयो, बहनों को बताते रहे, क्यूंकि उस वक़्त ना तो ऐस्पा प्रकाश में आई थी और ना ही कोई ब्लॉग था। अदालत की वेबसाइट पर भी जा कर किसी को देखना नहीं आता था, किसी के पास कोई केस का नंबर तक नहीं होता था। जब ऐस्पा का गठन हुआ तो अशोक बहिरवानी जी के विडियो अपडेट आने लगे, कभी देखा था किसी ने ऐसा कहीं भी? उस वक़्त यही लग रहा था की बस कुछ ही दिनों की बात है, जल्दी ही सब ठीक हो जायेगा। लेकिन नहीं पता था कि इतना वक़्त लग जायेगा। और इस देरी में कुछ लोग टूटते गए, कईयों के साथ छूटते गए। मगर इन सबके बावजूद पॉवर एडमिन लगातार 18 मई 2011 से सबको बराबर खबर देने का और मनोबल बनाये रखने का काम करते आये हैं। अगस्त 2011 में हमें ऐस्पा का भी साथ मिल गया और हमने ऐस्पा के साथ मिल के इस काम को जारी रखा।

मैं आज यहाँ सबको पॉवर एडमिन की वर्तमान स्तिथि के बारे में बताना चाहता हूँ। हम आज की तारीख में कुल 7 लोग हैं। कोई भी कहीं पर कोई दूसरी mlm नहीं कर रहा और ऐस्पा याँ कंपनी की तरफ से कोई भी आर्थिक सहयोग भी नहीं ले रहा। कंपनी से पैसे के लेन देन का कोई मतलब ही नहीं और कोई सवाल भी नहीं उठता। यह हमारी खुद की इच्छा से चुनी गयी लड़ाई है। ऐस्पा के पास कुछ पैसा है नहीं और वैसे भी उनसे भी लेने का कोई सवाल ही नहीं क्यूंकि हम मुश्किलों के एक ही जहाज़ में सवार हैं।

1. श्रीमान आनंद प्रसाद - कार्गो की एजेंसी - घाटे में। वाहन बेच कर काम चलाया। कोई और काम नहीं।
2. श्रीमान दीपांशु वार्ष्णेय - कोई नौकरी नहीं है। कुछ बचत है, जिस से थोडा बहुत काम चल रहा है अभी तक।
3. श्रीमान अमन आज़ाद - कोई काम नहीं। कोई बचत नहीं। कर्ज़ा सर पर। टोटल राम भरोसे।
4. श्रीमान संदीप गुप्ता - कार्गो की एजेंसी - घाटे में। कोई और काम नहीं। कोई बचत नहीं।
5. श्रीमान संजीव खन्ना - चार्टर्ड अकाउंटेंट - नौकरीशुदा - आमदनी अठन्नी, खर्च रुपइया।
6. श्रीमान विनीत तिवारी - कोचिंग क्लासेज - ठीक ठाक स्तिथि। अपना खीँचतान के पूरा करना होता है।
7. श्रीमति शैली सूद - कंसल्टेंसी - स्तिथि ठीक नहीं - बचत कुछ नहीं।

यह अगर चाहते तो कहीं और से बहुत कमा सकते थे, लेकिन इन्होने अपना पूरा समय इस लड़ाई में दिया सिर्फ इस भरोसे में कि हम जीत कर ही मानेंगे। हमने कभी किसी को काम करने से रोका भी नहीं अपितु जितना सहयोग बन पड़ा, उतना दिया भी। यह वो लोग हैं जो किसी भी हाल में एक दूजे के साथ हैं। कभी पीछे नहीं हटने वाले और इस लड़ाई में हमें बहुत से अच्छे और सच्चे स्पीक एशियन्स का भी समर्थन प्राप्त हुआ। आज बहुत से पनेलिस्ट्स और ऐस्पा एडमिन समेत श्रीमान अशोक बहिर्वानी और श्रीमान मेल्विन क्रेस्टो की भी कमोबेश यही हालत है जो इस लड़ाई में लगातार अगुवाई कर रहे हैं, सहयोग दे रहे हैं, यह चाहत और जुनून की ज़िद है, किस्मत की नहीं। कोई ज़बरदस्ती नहीं । क्यूंकि हम जानते हैं कि स्पीकएशिया वापस आएगी और ऐस्पा एक ईमानदार संगठन है।

(कुछ लोग इसे भी झूठा भाषण ही कहेंगे। लेकिन जो लिखा है, दिल से लिखा है और एक एक शब्द सच है। मानो यां ना मानो। विचार आपके, जीवन आपका।)

वो ना समझ पाए मेरे जुनून की हद को....
इसे दग़ा का नाम देकर, वो मशहूर हो गए...!!!

Dear Panelist,

Further to our last update on the execution of the exit policy. we wish to inform our SpeakAsia community that we have finished analysing the results of the first test batch of payouts that were sent.

We have identified certain roadblocks such as multiple claimants to the same panelist id or bank details not matching with the ones submitted at the time of applying for the exit policy, because of which not everyone got the remittance in their accounts.

We are at this moment addressing those issues and hope to have a resolution to them by the end of this month. Once we have the resolutions in place we will then send out a second batch of test payouts. On successful completion of this second batch we will commence the payout as per the exit policy.

We understand that there are delays in the process. One of the main contributor to this delay is the fact that we have had to do all the transactions and checking manually as our old automated systems are still under the custody of EOW Mumbai Police. We appeal to all the SpeakAsians to remain patient and bear with us as we work feverishly towards attaining our goals.

2 The learned counsel for the applicant points out that though

the learned Special P.P had consented on the last date of hearing

that the applicants interrogation by, or interviews with the

Investigating Officer would be video recorded, actually the

applicant was not called at all thereafter for interrogation.

Mr.Gharat submits that the applicant was called yesterday i.e. on 16

December 2012 and that the applicant, at that time, came to the

office of the EOW along with the videographer and submitted that

the chip of the recording would be taken by the applicant.

According to Mr.Gharat, therefore, the Investigating Agency now

does not agree that the interrogation or interview of the applicant

by the Investigating Officer should be allowed to be video recorded.

3 Mr.Gharat also does not agree to the suggestion that the

recorded chip may be kept by the Investigating Agency in a sealed

cover and submits that he had agreed for the video recording of the

interrogation in the peculiar facts and circumstances as existed on 7

December 2012, and now the Investigating Agency no more agrees

for such a suggestion. Thus, in other words, the investigating

agency is now not ready to keep a record of the interrogation in the

form of video recording.

4 Mr.Gharat also submits that the Company 'Speak Asia Online

Pvt.Ltd' would have no say in the matter. In this regard, it may be

observed that when a prayer that he be allowed to give a notice to

the said company was made before the Court on the last date, the

Investigating Agency had not objected to such a course being

adopted. In any case, it would be for the Court to decide whether

hearing the said company would be necessary for a proper

determination of the present Anticipatory Bail Application. It

cannot, at this stage be said that a company should not be given any

audience even if it voluntarily comes forward to make submissions

on certain relevant aspects, on the basis of notice given by the

applicant.

5 In spite of these differences between counsel for the applicant

and the learned Spl.P.P, they both agree that the final hearing of the

application may be deferred, and that in the meantime, the

applicant shall not be arrested.

6 Stand Over to 9 January 2013 for final hearing.

7 The applicant shall continue to attend the office of the

Investigating Agency, as and when required by the Investigating

Officer. The Investigating Officer agrees that the applicants shall

not be arrested in the meantime.
