O R D E R

In pursuance to the directions of this Court dated 6th February, 2012, respondent Nos. 3 and 4 have deposited an amount of US $ 10 million by way of a bank draft bearing DD No. 037002 dated 20th February, 2012 drawn on State Bank of India, Singapore Branch in favor of "The Registrar, Supreme Court of India" in the Registry of this Court.

Learned counsel for the respondent Nos. 3 and 4 submits that this amount be deposited in a fixed deposit for a period of 91 days initially with the UCO Bank, Supreme Court Compound, on an auto renewal basis. This request seems to be reasonable and we order accordingly.

We also direct the Secretary General of this Court to invest the amount today itself in the UCO Bank, Supreme Court Compound for a period of 91 days on auto renewal basis.

With these directions, this application stands disposed of. However, it is made clear that the disbursement of the amount would be subject to further orders of this Court.

Learned Additional Solicitor General undertakes to file an affidavit. She may do so within a period of two weeks. Reply, if any, thereto be filed within two weeks thereafter.

Speak Asia's case signals need for a regulatory body for MLM

The much awaited 9th January ,2012 when the supreme court of India is expected to give some sort of clear judgement on the SAOL case is finally going to arrive tomorrow. Though it may or may not be the final judgement on this case, but certainly it is going to be a very important one which will decide the future course of action. Few arrests have happened in past, of SAOL officials and the company was completely at the receiving end of media wrath but it is important to note that all ‘panelists’ of SpeakAsia are with the company.The company has the support of 20,00,000 members, which is showing complete solidarity with the it. Neither the arrests nor the show of solidarity point to the criminality or innocence of SpeakAsia as the case may be. However, these two extremely polarised views on the issue definitely point towards a gaping hole in the regulatory framework.

It is not for the first time that a company that sells its products or services using an MLM framework has got involved into a controversy – Amway, QuestNet, Japan Life and many more have courted controversy and legal proceedings in the past. Given the way regulatory framework operate for these businesses, such controversies would keep cropping up unless the regulatory framework changes from being reactive to being pro-active.

Typically, in multi-level marketing (also known as direct selling using network marketing) a person gets rewarded not only for selling the goods and services by himself but also for referring other members to join the business and for the further referrals by that other member and so on. Innumerable companies offering multi-level marketing schemes that present lucrative opportunities to their participants to make quick money have come up time and again and many a time questions have been raised on the legality.

Apart from general view that such schemes are fraudulent, the business organised on the lines of multi-level-marketing is often perceived as a money circulation scheme and thus in violation of the Prize Chits and Money Circulation Scheme (Banning) Act, 1978 (“the Act”).

The issue whether a business model based on MLM or network marketing by its very nature of organisation is bad in law or not came up for judicial scrutiny in the case of RMP Infotech Private Ltd. v. Apple FMCG Marketing Private Ltd. A Division Bench of Madras High Court opined that MLM schemes cannot be declared outright illegal, unless the scheme in question has elements that render it illegal.

As regards the elements that render a particular scheme illegal, the Supreme Court in the case of State of West Bengal v. Swapan Kumar evolved a two-pronged test that finds basis in Section 2(c) of the Act. To hold a particular scheme illegal in law, (a) it must be proved that the scheme is for making quick and easy money and (b) the chance or opportunity of making quick and easy money depends upon the enrolment of members into the scheme.

The test laid in the Swapan Kumar ruling has been applied subsequently by courts in adjudicating upon the legality of different multi-level-marketing schemes. Surprisingly, the only two cases where the courts evaluated MLM schemes in details came to the conclusion that schemes in question were bad in law. One such decision was by the Supreme Court [Kurianchan Chako v. State of Kerala] wherein the scheme in question was held to be a ‘mathematical impossibility’. The other decision of the Andhra Pradesh High Court [Writ Petition nos. 20470 and 20471 of 2006] wherein scheme of Amway India was viewed as “so ingeniously conceived that the inducement for aggressive enrolment of new members to earn more and more commission is inherent in the scheme.

Thus, as far as law is concerned, the principles are well laid down and position is very clear and ideally in such a scenario there is very little scope for confusion or controversies. However, the sole reason why we have had repeated controversies concerning such schemes is the way and manner in which the Act is implemented.

The Act is a central legislation and the States have been empowered to govern it. The Act bestows on Police the power to search any premises that may be suspected to be used to promote or conduct any money circulation scheme, seize all things found in these premises and to take into custody all such persons that are concerned or against whom the complaint has been made.

The problem with the scheme of implementation of the Act as far as multi-level marketing is concerned is that the Police more often then not is approached only after the crisis has reached its crescendo and as the nature of business involves a network of persons, the number of complainants or complaint is generally huge. Thus the Police is required to act under tremendous pressure and there is no time to first determine whether the multi-level marketing scheme in question is a money circulation scheme or not – a prerequisite required by the Police to take any action under the Act. What follows can be best described as a 'knee-jerk’ reaction.

A possible solution to this problem lies in the Act itself. The Act in its transitional provision envisage a role for the Reserve Bank of India as the specialised agency in consultation with whom the States were required to wind-up chit fund and money circulation schemes prevalent at the time the Act came into force. The Act also provided for States to frame rules in consultation with the Reserve Bank of India for the purposes of carrying out the provisions of the Act. It is pertinent to point out that the Act was enacted pursuant to findings of a study group constituted by the Reserve Bank of India to examine in-depth certain provisions of the Reserve Bank of India Act, 1934.

Thus when the Act was enacted the RBI had an important role in the formulation of policies or rules under the Act. However, in practice RBI does not figure anywhere in the determination of the issues as to whether any multi-level marketing scheme has elements of money circulation scheme or not. As the issue largely hinges on the financial model followed in the scheme, ideally RBI as the specialist body should determine this issue and this determination should not be left to the Police or the Courts.

Unfortunately, RBI instead of taking a pro-active role chose to take a back seat and came out with a Circular in 2003 eliminating its role in the implementation of the Act. This act of RBI was discussed in the 8th Lok Sabha though in a different context [(proceedings other than questions and answers) Title: Shri S. Jaipal Reddy called the attention of the Minister of Finance and Company Affairs to reported illegal schemes of Japan Life of India and steps taken by the Government in regard thereto.]

Today we have several multi-level marketing schemes operating in the country with no certainty whether these schemes conform to the Act or not. Further, many of these schemes are operational in more that one States. This may lead to a situation where the company running a multi-level marketing is subjected to multiple prosecutions. There could also emerge a scenario where the same scheme is held good in law by one State and bad in another. In case of Speak Asia complaints were filed in more than one State.

As any popular scheme involves large number of individuals who earn their livelihood from such schemes and a subsequent finding of the scheme being illegal may adversely impact them, it is important that we move from the present reactive to a pro-active determination mechanism. In order to achieve this and also to overcome a situation of multiple prosecutions being launched against the same scheme by different States, the following is suggested:

1. RBI shall frame general rules under the Act on multi-level marketing schemes which may be notified by the States at their option;

2. The rules shall require all multi-level marketing companies operating in the States that has notified the rules to get their scheme evaluated by the RBI before commencement of the business;

3. For the already existing schemes, the rules shall provide for a two year window to get the scheme evaluated by the RBI

These steps will go a long way in ending the uncertainty that multi-level marketing business model currently faces and will reassure many who earn their livelihood by being part of such business. This will also ensure that no money circulation scheme camouflaged as genuine business will be able to dupe lay investors or members. Further, this will bring succour to the promoters of multi-level marketing schemes from any Police action that may be initiated at the behest of disgruntled members of the scheme and competitors.

They never say an outright NO. It is always a MAYBE, or let us consider in DUE COURSE.

Yet, undeniably they have delayed and deferred our ability to continue business as usual.

They have delayed our payments to you, they have delayed our clearance of the products that are to come to you. They have put a spoke into our working by harassing our staff , distributors and panelists and have indulged in an unjust, unfair and malicious rumor campaign that has seriously dented our public image. They have effectively halted the operations of our company.

Who are they? They are a product of misguided thinking, unbridled envy, and a desire to destroy what they cannot build. They do what they do with a clear understanding that their victory lies in imposing impossible delays, so that the enthusiasm, the dedication and the morale of our team suffers. They are a set of people with deadly intent. They seek nothing less than the destruction and permanent stoppage of our business.

They are the opportunity deniers.

They are supported, cheered on and encouraged by certain vested interests like our competitors, some corrupt politicians and unscrupulous NGOs who have jumped into the fray to take advantage of our vulnerability.

Remember : The hunter is always the bravest when the hunted is at its weakest.

This concerted campaign has resulted in several Government agencies deciding to investigate and probe into the affairs of our Company as an honest arbitrator for settling the issue once and for all.

The delays through which they sought to deny earning opportunity to SpeakAsians

We are not in a position to make any payments into India as all payments sent by us to panelists and suppliers have not been credited to them. As a result payments to TVC, our importer for mobile phones used to meet our rewards obligations have been returned many times. Delay and denial.
Accounts of distributors are frozen and cannot be used for making any payments. Block and deny.
28500 Television sets ordered by us as rewards and for sale to the panelists are lying at Mumbai port and we cannot make custom duty payment. Delay and denial.
We are under constant threat due to frivolous complaints lodged by certain interested parties in some locations. Harassment and Denial

Our application for starting Permanent Establishment (PE) in India has been submitted to the RBI through Bank. We are awaiting the fate of this application. With this being approved we will be in a position to offer an "Exit Option".

The Exit option : Panelists will have a choice to get payment of reward points by TT from SpeakAsia Singapore account or migrate with their reward points to India centric website and continue business with terms applicable for Indian business . Waiting …

We are sure that during their probe these agencies have realized that our Company is working strictly within the laws of the land in both letter and spirit and has been diligently complying with every law. However, in this highly charged environment and constant pressures of various quarters most of these agencies would have found it difficult to give a "clean chit" in writing. We were left with no option but to approach the judiciary and present the facts for a clear decision.

We have got some moral vindication (for instance) the High Court of Hyderabad restrained harassment or arrest of any official or employee of our Company against a complaint made by an NGO (Criminal Petition 5626/2011) . The High Court in Mumbai directed the Reserve Bank of India to give us a hearing to understand our business model "expeditiously" (Writ Petition (L) No. 1365/ 2011 - SAOL & Ors. vs. Reserve Bank of India).

However our operations are still far from being normal and the delays continue.

So, what are we doing amidst this siege like condition- how are we responding?
In the "Them v/s Us" situation the following is what we are doing to right the wrongs, and re-establish as quickly as possible our commercial relationships with our team members, distributors, and panelists.

নিঃস্ব বেদুইনঃ ইন্ডিয়াতে ধুকতে থাকা Speak Asia এখন তাদের সকল কার্যক্রম বন্ধ করতে বাধ্য হচ্ছে । ইন্ডিয়ান সরকারের চাপে এখন Speak Asia india প্রায় তাদের শেষ প্রহর গুনছে। ঠিক সেই সময়ে মিঃ মনোজ কুমারের সাক্ষাতকার Speak Asia গ্রাহকদের মনে একটু হলেও শান্তির পরশ বুলিয়ে দিবে ।

মিঃ মনোজ কুমার (COO of Speak Asia india) আবু ধাবিতে এক সাক্ষাতকারে Speak Asia এর বিভিন্ন বিষয় নিয়ে আলোচনা এবং বিভিন্ন মন্তব্য করেন । তার সাক্ষাতকারের মূল অংশ টুকু তুলেধরা হয়েছে এখানে । তিনি বলেন, বাংলাদেশ সরকার আমাদের বাংলাদেশে কাজ করার অনুমতি দিয়েছেন । তারমানে Speak Asia এখন বাংলাদেশে কাজ করবে যেটা আগে ছিলনা (আগে যে সব গ্রাহক বাংলাদেশি স্পিক এশিয়ান ছিল তারা আসলে ছিল ইন্ডিয়ান গ্রাহক ) কিন্তু এখন এর সেই রকম হচ্ছে না । কিন্তু দুঃখের ব্যাপার যেখানে বাংলাদেশ সরকার আমাদের বিজনেস প্লান এ্যাপ্রুভ করলো সেখানে ইন্ডিয়া সরকার আমাদের ইন্ডিয়াতে কাজ করার অনুমুতি দিচ্ছে না । যেখানে বাংলাদেশ সরকার আমাদের প্ল্যান বাংলাদেশ সরকার পছন্দ করেছে এবং UK/ England –এ আমরা আমাদের ঐ একী প্লান জমা দিয়েছি এবং আমি খুব আশাবাদী যে আমরা ঐ সকল দেশে আমাদের বিজনেস প্ল্যান নিয়ে কাজ করতে পারবো । তার কথা গুলো ছিল এই রকমঃ ইন্ডিয়ান সরকার আমাদের কাজ করতে দিচ্ছে না । কিন্তু আমাদের কাজ আমাদের প্ল্যান ছিল নতুন এবং কঞ্জিউমার দের জন্য ভিন্ন । যেটা অন্য কোন দেশে হলে গভঃ আমাদের পুরস্কৃত করতো আমাদের দেশের নায়ক হিসেবে ঘোষণা করতো । এই বিজনেস প্ল্যানতা মডেল হিসেবে নিতো । কিন্তু আমাদের সাথে সব কিছু উল্টোই হোল ।

সবশেষে তিনি বলেন, আমরা আশা করছি আমরা খুব দ্রুত বাংলাদেশে আমাদের কাজ শুরু করবো, এর উপরে খুব যোরেসোরে কাজ চলছে । এবং অফিসিয়ালি শুরু হবে ডিসেম্বরে । এবং আমরা ইন্ডিয়াতে কাজ করার আসা এখনো ছারিনি । ইন্দিয়াতেও কাজ করার জন্য সকল অনুমোদন আদায়ের চেষ্টা চালাচ্ছি ।

Speak asia সম্পর্কে mlmnews24 – এ বেশ কিছু দিন ধরেই স্পিক এশিয়ার বাংলাদেশে প্রত্যাবর্তন সম্পর্কে বেশ কিছু নিউজ প্রকাশিত হয় । এবং তা সম্পূর্ণ সত্য এবং স্পিক এশিয়ার বাংলাদেশের অফিস থেকে সংগ্রহক্রিত । কিন্তু তারা আমাদের কাছে বলা কথা এবং ওপেনিং ডেট ঠিক রাখতে পারে নি অনিবার্য কারনবশত ।

৭ তারিখে শুরু হওয়ার কথা থাকলেও শুরু হয়নি স্পিক এশিয়ার বাংলাদেশে এর অফিসিয়াল কার্যক্রম । কিন্তু অনেকেই বলছে এই মাসের ১৫ তারিখের মধ্যে সার্ভে ফর্ম আসা শুরু করবে এবং নতুন ওয়েবসাইট কাজ শুরু করা থেকে শুরু করে ঠিক হায়ে যাবে সব কিছু । স্পিক এশিয়ার বাংলাদেশের অফিসে গিয়ে মিঃ মঞ্জুরুল ইসলাম শান্ত নামের একজন স্পিক এশিয়ান জানতে পেরেছেন, আগামি ১৫ থেকে ১৭ তারিখের মধ্যে সার্ভে ফর্ম অবশ্যই আসা শুরু করবে এবং আগামি ২১ থেকে ২৭ বা ৩০ তারিখ পর্যন্ত ট্রেনিং চলবে এবং সকল গ্রাহক তাতে অংশ নিতে পারবে ।

এদিকে সকল খতিগ্রস্থ গ্রাহক চায় স্পিক এশিয়া যত দ্রুত সম্ভব ফিরে আসুক । তারা অতন্ত কষ্ট এবং অনিশ্চয়তার মধ্যে দিন পারকরছে ।

আজ (৭ই অক্টবার ২০১১) থেকে Speak Asia Online তাদের নতুন ওয়েব-সাইট চালু করে বাংলাদেশে নতুন করে ব্যবসা শুরু করার ১০০% আশ্বাস দিয়েছিলেন। এ ব্যপারে Speak Asia Online বাংলাদেশের মিরপুর অফিস থেকে তিন-চার দিন আগেও ১০০% নিশ্চয়তা দেওয়া হয়েছিল যে, Speak Asia Online বাংলাদেশে ৭ই অক্টবার ২০১১ থেকে নতুন ওয়েব-সাইটে শুরু করবে। কিন্তু এ নিউজ লিখা পর্জন্ত Speak Asia Online বাংলাদেশ মেনেজমেন্টের পক্ষ থেকে নিশ্চিত কোন আপডেট, খবর পাওয়া যায়নি।

এদিকে অনেক Speak Asia Online গ্রাহকের সাথে আমরা কথা বলে জানতে পেরেছি তারা চায় যে, খুব দ্রুত Speak Asia Online চালু হোক এবং তারা খুব হতাশার থেকে মুক্তি চায়।

কিছু ভিন্ন মতামত, মতামতটি MLM NEWS 24 এর স্পিক আসিয়া মতামত কেন্দ্র থেকে নেওয়া ; Speak Asia Online এর সকল panelist দের কিছু কথা বলতে চাই। প্রথমতঃ গত ২৪-২৬ আগষ্টের চীন মৈত্রী সম্মেলন কেন্দ্রে যে অনুষ্ঠান হবার কথা ছিল সেটা শুনে আমিও গিয়েছিলাম দেখতে আসলেই কোম্পানী কোন অনুষ্ঠানের আয়োজন করেছে কিনা। বলা হয়ছিল এর entry fee ২০০ টাকা। কিন্তু আমি আমার মত আমার এক বন্ধুকে বললাম যেখানে কোম্পানী এখনো বাংলাদেশে officially registered না সেখানে তারা entry fee নিয়ে program করলে তো illegal হবে, এতো সাহস বা দুঃসাহস করবে না বাইরের কোন কোম্পানী। ঠিক ই অনুষ্ঠানের কোন বালাই দেখতে তো পেলাম ই না বরং কেউ কোন authentic news ও দিতে পারলো না এই সম্পর্কে। আর এখন শুনছি মিরপুর আর বনানী অফিসের কথা। Speak Asia Online (BD) নামে ২০১০ এ যে কোম্পানীটি registered হয় chittagong এ সেটি মাত্র একমাসের মধ্যেই নাম পরিবর্তন করে যা জনাব রাজু ...... এর নামে registered ছিল। জনাব তো বেশ কিছুদিন field এ থেকে টাকা পয়সা কামিয়ে চম্পট দিয়েছেন, সমস্যায় পড়লাম আমরা, আমার মত সাধারন কিছু পরের দিককার panelist। সেই এপ্রিল মাস থেকে এদের কাউকে যারা নিজেদের upline leader বলে পরিচয় দিতেন এবং নিজেদের প্রয়োজন মত টাকা ও ডলারের মধ্যকার রেট ঠিক করতেন, তাদেরকে এই এত দিনেও সাধারন panelist দের পাশে দেখাতো যায় ই নি বরং মোবাইল ফোন বন্ধ পাওয়া যায়। কোম্পানী india তে যে আইনি জটিলতার সম্মুখীন তাতে তাদের main business area, India এর চিন্তা বাদ দিয়ে যে বাংলাদেশের কথা ভাববে এটাই অস্বাভাবিক। তার পরও এটা সত্য যে বাংলাদেশ থেকে কিছু সত্যিকার ভদ্রলোক Singapore গিয়ে ম্যাডামের সাথে দেখা করেন আর বাংলাদেশে এই ব্যবসায়ের ভবিষ্যত নিয়ে কথা বলেন এবং যার ফল বেশ আশাপ্রদ। সরকারের সাথে আসলেই ব্যবসায় প্রতিষ্ঠা নিয়ে Formalities সম্পন্ন করার চেষ্টা করা হচ্ছে। এখন কথা হল, বাংলাদেশে যদি সরকার অনুমতি দেন তবে mass media এর কল্যানে আমরা অবশ্যই জানতে পারব। তার আগ পর্যন্ত দয়া করে কেউ কোন ভুয়া খবর যেমন ছড়াবেন না, তেমনি ভুয়া খবরে কান ও দেবেন না। আমরা ভাই এমনিতেই প্রতারিত হই প্রতি পদে পদে। তাই একটু সাবধান। সবার প্রতি আন্তরিক শুভেচ্ছা। ভাল খবর আসবেই ইনশাল্লাহ, রাতের শেষে সূর্য উঠেই।

এখন পর্যন্ত যত নিউজ বাংলাদেশ এ speakasia এর কার্যক্রম সম্পর্কে এসেছে কোনটার ই ভিত্তি নাই, যার যা মনে হয় তাই বলে, সেটা india 'র কোন নিউজ সাইট হোক বা এদেশের। প্রথমে ভারতে এদের কার্যক্রম সম্পর্কে বলি, কোম্পানী যদি পালাতে চাইত টাকা মেরে তবে অনেক আগেই পালাতে পারত, এত কাঠ খড় পুড়িয়ে, জেলের ঘানি টেনে, কোর্টের দরজায় ঘুরে বেড়াত না। আর বাংলাদেশে কখনো রেজিষ্টার্ড হয়নি বলে প্রেস ব্রিফিং এ বলতে পারেনি যে তাদের অফিসিয়ালি বাংলাদেশে অপারেশন আছে। কিন্তু সত্য হল, কোম্পানী কারো টাকা মারবে না। এদেশে এই ব্যবসা(এমএলএম) এর উপর কারো বিশ্বাস নাই কারন আমরা বাঙ্গালীরা প্রতিটি ব্যবসায়ের নামে মানুষকে ঠকিয়েছি। কখনো ডলারের দাম কিনতে ৫৫টাকা লাগে, কখনো লাগে ৭৫ টাকা। বিক্রয় করতে গেলে কখনো ৬০ টাকা, কখনো ১৩টাকা। এখন যখন কোম্পানী সত্যি সত্যি বাংলাদেশে তাদের কার্যক্রম অফিসিয়ালি শুরু করতে যাচ্ছে তার আগেই সব ভুয়া খবরে দেশ সয়লাব। কখনো চীন মৈত্রী সম্মেলন কেন্দ্রে অনুষ্ঠানের কথা বলে টাকা হতানো হচ্ছে, কখনো বা মিরপুর বননীর অফিসের কথা বলা হচ্ছে। সত্যি যদি হয় ও কারো কোন সমস্যা তো নাই বরং ভাল। আমরাই ব্যাবসা করে দুই পয়সা কামাতে পারবো। কিন্তু কিছু শুরু হবার আগেই যদি তার বাঁশ দেই তবে শেয়ার মার্কেটের মত গুটি কতক লোক ছাড়া বাকি সবাইকে পথে বসতে হবে। আর দোষ যত সব কোম্পানীর, আরে ভাই আমরাই একটু সমঝে চলি না কেন? শুরু হলে খবরের কাগজ হোক বা নিউজ চ্যানেল, জানতে তো পাবই, তাই একটু ধৈর্য ধরে থাকি না আমরা আর কটা দিন? আল্লাহ আমাদের সহায় হোক।

Speak Asia Bangladesh Ltd. has completed their registration in Bangladesh. And also hopeful that they will run in Bangladesh in from month's first week. To run this business in Bangladesh they have taken two new offices in Bangladesh. The head office is in Banani, Dhaka and the branch office in Mirpur12, Dhaka.

The Branch office, which is in Mirpur 12, is about 2,000 - 3,000 Sqfts. and decoration also completed. And other hand the the head office is in Banani is also opening soon. So this is a big hope for Speak Asia Bangladeshi Panelist.

The latest news about Speak Asia Online Pvt Ltd management reveals that the website www.speakasiaonline.com will resume its operations within next one or two days. As announced earlier, the exit option will be functioning when the original website is operational within the next few days.

The EOW (Economics Offense Wing) has made significant progress on the investigations last week. At any time, it is expected they will release a positive statement with a set of guidelines to be followed in order to continue the survey program. There are no clues about what are those conditions and every one is eagerly waiting for the final hearing.

After the announcement of exit option by the SAOL management, there are both positive and negative opinion from the panelists. Those panelist who are confident about SAOL's management, they say that once the operations are started with the modified policies (if applicable), the business growth may not be like the case earlier to the EOC incidence, but on a long run, this may not be a big problem to the SAOL's vision.

The possible scenarios in case panelists chooses to EXIT will be as follows:
1- NO Reward points (henceforth referred as RP ) earned after becoming a panelist:
If you have recently subscribed to the E-Zine and have not participated in any of the SAOL activities or no RP’s have been credited in your account then you can opt out of your association with SAOL by agreeing to these terms and conditions and filling up the attached form. By doing so you will a refund of your entire subscription cost less the registration amount to your bank account mentioned in your profile. The e-zine subscription shall cease to be sent to your mail ID and you will no longer be associated with SAOL.
2- RP’s Earned lesser than Subscription Cost:
In case you have en-cashed or used RP’s, whose total value is less than the subscription cost, these RP’s shall be deducted from the cost of subscription and the balance will be credited in to your bank account. There have been a news all over that today there was a meeting regarding Speak Asia. So following are the points which were discussed there. Go through them:

1. Speak Asia won't be inaugurated in this month. (Haren Decision)

2. After EID there will be a grand opening ceremony in Bangladesh. (Haren Decision)

3. In month of September the surveys & transactions could start.

4. Survey RP can be transferred to Bank accounts but Binary RP will be only used in purchasing the products & generating the pins.

5. Every Speak Asian can open maximum three accounts. They will have to provide a verified photo, Mobile number, E-mail, Finger Print and TIN Certificate.

6. There will be 1 million (10 Lac) fixed panelists in Speak Asia BD.

7. Two days before EID we may see a advertisement in Newspapers.

8. Survey monitoring section has been opened for qualifying survey.

There have been no official authentication for this news but let's hope for the best.

Good Evening Speakasians,

After many days, a day, full of GOOD NEWS. After many days we had multiple successes and I take immense pride in reporting as follows.

GOOD NEWS #1: Mr. Rahul Shah the poor victim of the high handedness of the Authorities and an example of subversion of facts was today released on bail, by the Quila Court. To quote the companies Counsel Adv. Ponda this was “A classical example of picking up a wrong man in a wrong case”.

The faith of 20 lakh panelists has once again been imposed in the legal system when the Hon. Magistrate Esplanade Court released, Mr. Rahul Shah, employee of M/s Tulsiyant Info, a company no way connected to SAOL, on bail. Details of the order are awaited; I will post the details ASAP.

GOOD NEWS #2: Mr. Tarak Bajpai our inspirational leader and beloved COO along with the other three officials, none of whom is a SAOL official, were granted unconditional Bail, by the Magistrate in the Thane Court on a surety of Rs. 25000/- only per head. This order was pronounced in court only around 6.00 pm and as such our COO and the three others will have to spend yet another uneasy night on the floors of Thane Jail.

My heart bleeds to see this man who has led the speakasian family to great heights, who has been the architect of change in the standard of living of lakhs of families, sleeping on the floors of Thane Jail, fighting for the panelists, and still smiling.

TRIVIA:

1. The Domain name of your Association website has been confirmed and hopefully the site should be operational within the next 7 to 10 days.

2. The initial proposal of the PR agency has been received and has been circulated amongst the committee members for their opinion and suggestions. We should be able to finalise this soon and the panelists should see the PR exercise taking shape soon. I will share with you the details as they keep getting firmed up.

3. The Association has mooted the idea of setting up a call centre for better verbal communication with the large panelist family.

RUMOURS & UNSUBSTANTIATED REPORTS:

Without going into the details of the forum or the website where the stories were germinated, I attempt to clarify on “HOT” news items of the day.

SAOL has started paying their employees: A false statement to the core, without starting payment of the panelist the company will not pay the employees. All the employees are willing to stand by the company along with their leader Shri. Tarak Bajpai. The company is duty bound to first pay the Panelists followed by the vendors and finally the employees.
The State Government is going to go in appeal against the order of Mr. Tarak Bajpai and others bail order: This is a normal action in the legal process. An aggrieved party will always appeal to the next available medium available to them. So this does not come as a surprise to me as this is the established route available to the authorities.
Zee news report on Mr. Moilly referring the matter of SAOL to SFIO:

I have not seen this news item and as such cannot substantiate the same.

Allow me to comment on this tomorrow, I would like to study this in detail.

As is evident from the above we are moving in the right direction. Things are happening in our favour. On such a large scale, with Govt. Authorities involved we cannot decide the speed, but we can smell victory.

Dear viewers,

At this point of time its a very good thing that we the 20 Lakh panelists of Speak Asia have formed an association named "All India SpeakAsia Panelists Association" which is representing our case in judiciary, government and various concerned institutions. Please go through the following updates from the Secretary of our association:

When Will the Payouts Start?

This is a million dollar question and I am sure almost all the panelists including me are eagerly waiting for the payments to restart. I wish to draw your attention to the fact that the company has been approaching the RBI on various occasions but the pleas have fallen on deaf ears and the required permissions have not come through. Our Global CEO Ms. Haren Kaur has written to RBI once again on 19^th August, 2011 and we again await some positive response.

I wish to draw your attention to The PIL filed by your Association before the Hon. High Court at Mumbai wherein one of the main prayers is that the RBI be instructed to withdraw the circular issued by them to all banks cautioning the banks against speakasia. It is also prayed that the company be allowed to pay out over 2000000 Speak Asians whose requests are pending for payment.

In summation I wish to submit that come Wednesday 24^th August, 2011 this question will be better answered once the Hon. High Court has heard the PIL.

When will the Surveys restart?

We are all aware that the servers of the company are being investigated by the EOW. This is the reason why the portal is not fully operational. As soon as the EOW finishes the investigation they will hand over the portal back to SAOL and the surveys and the EXIT option will be activated.

The PIL of your Association pleads before the Hon. High Court to fix a time frame for the authorities to complete investigations of the company. Once again this question will be clarified after the hearing of the PIL.

When will the PE be established?

This question will also be answered after the hearing of the PIL filed by your Association on Wednesday i.e. the 24^th August, 2011.

Where is our CEO Mr. Manoj Kumar and our Global CEO Ms. Haren Kaur?

Friends both of them are safe and sound and monitoring the entire defence operation in all probabilities. I am sure they have not returned to India on the advice of their Legal counsel. We should be hearing from them soon. Maybe they are waiting for things to get clarified in the matter of Tarak Sahibs detention matter.

Why is our COO Mr. Tarak Bajpai being arrested again and again?

Mr. Tarak Bajpai was first arrested on 29^th July, 2011 under the FIR resulting out of the order passed by the Hon. High Court in the criminal PIL filed sometime in July 2011. After serving the mandatory 14 days remand Mr. Bajpai was finally released on Bail Yesterday i.e. 20^th August, 2011.

Once Mr. Tarak Bajpai was a free man he was once again arrested in yet another FIR filed at Mira Road by the EOW Bhayander. To counter this menace of multiple complaints in, if at all, one crime against SAOL the company management is in a huddle with their legal team. On a positive note I would like to inform you that Mrs. Renu Sharma wife of our CEO Mr. Manoj Kumar Sharma, was released from detention without being arrested, yesterday itself, because they could not find any reason or case against her, which in itself is a huge testimony to the fact that the EOW has not got any substantial material against SAOL.

Dear SpeakAsians,

As you all are aware that the Court has given Bail to Our COO Mr. tarak Bajpai & 4 others yesterday who were under police custody for interrogation for last couple of days. This was a relief for the company and all the panelist and firmed our faith in our judiciary. Further Mr. Manoj Kumar CEO (India) was planning to come back to India in the next week; this was to facilitate payments to the panellist by having a meeting with RBI and end the current stalemate.

Today (19th August) morning his wife & son (minor son) who were with him in Dubai for a holiday, returned to India. They were detained by the Police at the Delhi airport on instructions of EOW Mumbai. This action of the EOW is a little surprising as firstly they were returning back to the country and second Mr. Manoj’s wife happens to be a house wife having no involvement in the business of Mr. Manoj and his son is a minor.

Mr. Manoj has assured that he is committed to resolving the current situation and start the payout process of the panellist at the earliest.

Pass this information to all the managers, Distributors and Panelist.

The delays through which they sought to deny earning opportunity to SpeakAsians

We are not in a position to make any payments into India as all payments sent by us to panelists and suppliers have not been credited to them. As a result payments to TVC, our importer for mobile phones used to meet our rewards obligations have been returned many times. Delay and denial.
Accounts of distributors are frozen and cannot be used for making any payments. Block and deny.
28500 Television sets ordered by us as rewards and for sale to the panelists are lying at Mumbai port and we cannot make custom duty payment. Delay and denial.
We are under constant threat due to frivolous complaints lodged by certain interested parties in some locations. Harassment and Denial

We are not allowed to pay salaries and other expenses to officials and employees of our Company. Delay, deny and demoralize.
We do not even have freedom to move freely due to the constant threat of arrest on account of certain frivolous complaints. Harassment and Denial
Our application for starting Permanent Establishment (PE) in India has been submitted to the RBI through Bank. We are awaiting the fate of this application. With this being approved we will be in a position to offer an "Exit Option".

The Exit option : Panelists will have a choice to get payment of reward points by TT from SpeakAsia Singapore account or migrate with their reward points to India centric website and continue business with terms applicable for Indian business . Waiting …
