So I am a small online developer that mainly makes free widgets and tools to make peoples lives easier on the net. I saw the commercials for Unlimited Sprint Wireless Broadband Service that are all over the TV and net and thought, " Alright! Sounds good!"

At Almost $80 bucks a month this was really, really steap (My phone company offers service at $30) but I thought, hey, why not, unlimited wireless service is sweat!

So I went to the local Best Buy and talked to the rep;

Sprint Broad Band Service; Unlimited KB Useage!
You have 30 days to return the item!

Then after about 30 minutes of him signing us up and after we signed the contract we are told;
Oh ya, by the way, Unlimited Service MEANS 5 GB A MONTH! Of course I freak out and instantly want to return it, only to be told that the 1st month there are no overages to keep it and try it.

So then I ask what the heck are overages, the service is unlimited! I am told that it's either 5 or 25 cents (forget) a MB!?!?!?! over 5 Gigs!

So as a developer I use maby 1 GB a day! Thats not very much. I do zero p2p and at most stream radio music through my toolbar (which is awesome! check it out here). I also want to note that Verizon and Cricket claim all the same things, and advertise unlimited services...

Following are my email correspondence demanding to know what is unlimited about Sprints Plans;

I am sorry for the incomplete information given to you regarding the usage of connection card during the first month. As the Best Buy is a third party mobile phone vendors and they might not have thorough information regarding the usage of Connection card. Currently, the $59.99, Connection Card Data Plan is active on the account. Under Connection card plan, the maximum limit of data usage is

5 GB (including first month).

In future, if you require any clarifications regarding any products or services related to Sprint then you can feel free to reply and we will be glad to assist you further.

Notice they use the word UNLIMITED TO ADD VALUE TO THEIR SERVICE!

My Reply (2nd email);

Your marketing is clearly deceptive and misleading advertising. How do you think you have the right to use the term "Unlimited KB included" on my account page? I have included photos of various areas published by Sprint that clearly attempt to miss lead us consumers. I have paper pamphlets the in big bold letters falsely claim unlimited data useage.

I understand saying something and then worming your way out of it in fine print, but this clearly is false advertising as defined by most accepted law books;

"Utilizing words such as descriptive terms or location terms to increase the perceived value of a product."

You also clearly violate the "Advertising at Maximum" internet technologies ruling of Scotts Valley company vs. Seagate Technology and Users vs.

Western

Digital...

By using the term "Unlimited" as the backbone of your point of sales displays, you clearly attempt to put "value" in the word "unlimited".

Per your line of text, "Effective July 13, 2008. Sprint reserves the right to limit throughput speeds or amount of data transferred; and to deny, terminate, modify, disconnect or suspend service if usage either exceeds

(a.) 5 GB/month in total or (b.) 300MB/month while off-network roaming."

My question is,

1. "How can you clearly advertise Unlimited KB included, when NOTHING AT

ALL about your services are Unlimited in the least?"

2. Though you reserve the right to limit usage, where in your fine print

does it say you reserve the right to make false claims and use deceptive

advertising methods?

I have included photos. I have full page photos for my records showing urls,

times, and dates. Looking forward to your answers.

I apologize for the inconvenience faced by you due to incorrect information published regarding the usage of the connection card.

Sprint has reviewed the usage pattern of the customers and has put this cap (5 GB) as the upper limit. Now let me explain that this policy has been implemented for the benefits of the customers like you. Few customers use their phone as a modem for commercial usage and download heavy data. When someone is downloading a particularly large amount of information over a long period of time, repeatedly, it can slow down speeds for other users like you who might just be checking their e-mail or browsing online. So to make sure Sprint service is fair for everybody, Sprint is encouraging the right kind of use on the network.

I have forwarded your feedback to the appropriate department so that proper actions could be taken against the incorrect information regarding the usage of connection card.

Sprint is just shooting themselves in the foot as most of the people who create the buzz on this stuff are people like us who use the Internet aggressively. We are the same people who make larger decisions within major corporations.. One RSS feed reaches MILLIONS FREE

I asked you 2 questions, not comments...

Here are my comments...

TRUTH- There is "buzz" going back since the inception of this service

complaining about unfair marketing and false advertising. UNTILL YOU GET

SUED NOTHING WILL CHANGE.

TRUTH- You compete at the minimum level as Verizon and Cricket

TRUTH- Sprint will say anything to close a deal, including falsely and

blatantly lying about the usage amounts. So if you PAY EXTRA you can do

Sprint must efficiently manage its wireless network. Heavy data usage by some customers impacts availability for other customers and generates large operating expenses for Sprint. Sprint?s actions to offer metered plans allow users who exceed 5GB to pay for additional usage at a low rate.

I am sorry that we cannot add the unlimited connection card plan as we do not offer it now.

You advertise, clearly UNLIMITED USAGE, not 5gb, unlimited usage. I

have photos on my account (THE MAIN PAGE) that clearly show that I have

unlimited usage. I want unlimited usage. I want what you clearly advertise as the

"value" in your product. At the time of signing the contract your

advertising clearly stated Unlimited Usage.

According to your legal print, "data limitations may apply."

May... According to you the term unlimited is totally false, you admit

it. 100% false advertising, 100% bait and switch, 100% lie. I have found others like me and we are banding together to fight these lies.

Again I have included a photo that clearly states that my plan, not a

discontinued one, is unlimited one. This is also what your physical

documentation (advertisements) state at the point of sale.

ADVERTISEMENTS WHEN NOTHING IS UNLIMITED. I want a reply from your management, not a customer service rep.

So I got a link that refers me to a Nextel page. Maby I should host all my business contracts off a site that has nothing to do with my customer's purchases... But then that’s totally dishonest isn't it?

SPRINT LIES! Their Service Is Not Unlimited And It Is Our Jobs As Consumers To COMPLAIN! This is how our socity got to the point it's at, we let marketing dictate our lives and then take it in the ASS quitly! WHY! With RSS this blog will be all over the net in hours!
