Sue, it is apparent that we have a difference of opinions regarding the definition of an association and a business. Association is an organization of people with a common purpose and having a formal structure. Business is an organization engaged in the trade of goods, services, or both to consumers. Both of these, associations and business, have different purpose and goals; therefore needs a separation of funds and management in order to archive these purposes and goals. Let me clarify; management or employees can not be expected to wear the hats of two completely different operations the size of SCSCAI and the commercial business. Another point, it would be a lot easier for the Board to provide the required oversight needed for our community's membership.

Well, that's enough of my rambling. Like I said before, if I can be of any assistance to you or our community, do not hesitate to call on me.

[the health of SCSCAI's assets are the responsibility of management and the BoD are responsible for the oversight of the management performance.

I don't understand your comment on the ED. Should that person do the financial plan or not do it? [my understanding is that the ED is the professional that is responsible for the day to day operation of SCSCAI] It seems that past EDs have had no incentive to reduce expenses because they were not given goals. [what is the $100k+++ used for?] Isn't up to the board to give goals? [this should have been well defined in the employees contract ] Last year the Board tried to message the budget after it was done and since it is done so late, they did little in order to meet time constraints set by NRS116 . Bottom line...a poor way to run anything.

You are right on all counts. I had a retail business of over $13 million dollars and I could not or would not spend a cent without a 3 year business plan and I updated the current year constantly based on trends, advertising and other changes. I would even plan the holidays season by day and obviously goals and bonus were attached to those plans. I thought it would be easy to get a 3 year plan for SCSCAI. WRONG!

First off, the employees use their annual budget as something static, make no adjustments for unforeseen expenses (until this year..Barbara cut as expenses rose) and they don't use it as a planning and goal tool. The past Boards were unwilling to give direction or demand a bottom line number and often use committees and subcommittees as excuses to not make decisions on large items and projects. Worse, everything moves so slow because the Board meets most months once.

Example: I brought a motion forward that the Board require this next year's budget based on no increase in assessments. I could not get it passes until I changed the word require to recommend, yet the board is responsible for the budget according to NRS 116. How can the Executive Director do the budget if there is no goal. I thought I could set that goal by limiting assessments. If you only have so mush income, you have to budget accordingly.

I know why we only have a budget 2 months before the year begins, because we do a bottoms up process, which is time consuming and almost impossible to do for 3 years. The process should be a top down process, looking at large cost items such as payroll, health benefits, and utilities (74% of entire operating budget). Those can be apportioned by department based on history, needs and anticipated increases or decreases. The reserves must always be funded first since we do have a 5 to 10 year plan when it comes to reserves. The reserve can not be used as a balancing tool to the operating budget!

I know what needs to be done and the Board needs to take a stand, so our residents know their anticipated costs for 3 years at a minimum. Whether this is worked on by the Executive Director, the finance committee or a new subcommittee it does not matter, but it needs to be done. Control is needed over the budget not balancing it by assessments.

SCSCAI does things because we have "it has always been done this way" or " it is a waste of time because we tried this before" or "we did a study 5 years ago".
I have huge faith in our Executive Director, Barbara Cogar to look at everything in a new light and I will work with her in every way to accomplish real plans for SCSCAI, while improving our amenities to keep Sun City the community and resort like living it has been for so many years.    I will be proposing an open business planning meeting to be held monthly to keep the board and community apprised of issues by department. It would be a scheduled meeting with a broad departmental agenda where no decisions would be made, just discussion.This should stop the feeling of secrecy and keep all the board members apprised of all the issues. Legal, personnel and individual resident issues would not be discussed due to privacy rights.

I am sure you have all heard this before, but I feel all parts are coming together to make it work this time. We have a committed board, a strong Executive Director and a new controller.

I have been following the communications here in Sun City for fourteen years and what I hear has been much the same; excuses for the wrong doings and wait till next year for the solutions, we are hard working volunteer's doing the best we can, everything is wonderful.

I have a forty-five year business background and realize the importance of having a Business Plan. When I was made aware of the losses and that SCSCAI did not have a basic Business Plan and treated golf and food & beverage business as an HOA amenity that mingled funds with the general budget I became very concerned. In the beginning I was misled by the BoD and management that there was a Business Plan, only to find out none existed. Many members including myself have questioned, why not? and received no answers.

Sue, for the last ten years I have shared this same message with many on the BoD and every Executive Director however, SCSCAI is no closer of having the accountability of a Business Plan than ten years ago. I have posted many of my communications, including my last one to Ms. Cogar, on My Sun City Blog. Also I would like to [comment] on the highlighted items in your post to Bernie Silver.

I too wish to preserve the Golf Courses and I guarantee it will be looked into this year if [SCSCAI has yet to provide a professional approach, this can't be preformed by a committee] I have to bring it up every meeting!

This has included having an outside Management Company and considering the rotation of one course
to be idle for a while. NO RESPONSE!!
As far as the restaurants are concerned, I personally do not believe they will ever break even because just cannot compete with other establishments in the near distance area. Snack bars for golfers that serve real simple food such as 2 eggs and bacon should be the limit and that could be provided by the Golf Management Company. One short order cook and self serve.
I do not believe that you know or recognize how our Boards in the past and the Standing Committees
Golf Oversight and the Finance have had members who did not perform as Fiduciaries and betrayed
the community with Conflicts of Interest.

You are right in the fact that many things have been done by previous Board that are questionable p0-9and today may look like mistakes. It is up to current and future boards to correct or change them. It is obvious that continuing to talk about golf rangers is a waste of time because the situation was corrected. Losses in golf and restaurants does need to be addressed and I have and will continue to push for a plan with options, but realize every golf course in Vegas and across the country are facing the same problems that we have. Do we fund it and keep it beautiful and playable, do we close 1 or all or do we sell it and/or contract management. This is above my pay scale and above most who are on the board. We need expert analysis and then leave the options to town hall informational meetings and a vote by all in our community.

Key employee contracts is not up to our CPA auditor to comment on. It is up to the board to decide what to do. A previous Board decided to payout Ron Winkel from payroll funds. That can not be changed or fixed. Let's move on.

As far as the duo that you claim blackmailed a previous Board. Is a letter different than what is said on chat lines? Every resident has a right to their opinions. It is free speech. No board can change that. Opinions, name calling and open challenges come with the territory of being a Board member. What would you like to happen to Stan and Sheila? It's over and time to move on.

The missing files are missing and no one knows when the theft happened. Every employee (still employed in March) swore they know nothing, heard nothing and saw nothing as does every Board member swear to the same. Short of water boarding, I don't know what can be done. HR was moved into the main building and is now alarmed. The executive director office is now alarmed and current Board members can only see files with someone else present. It is like locking the barn door after the cow got out...but it is something! It is over, let's move on.

As far as the restaurants and golf director are concerned: The new Board will take action when the Executive Director makes a recommendation or takes control of her budgeting process. As of this moment, there is not a restaurant manager working here and the golf director still runs the restaurants.

I know you love Sun City and want to see things done correctly. I believe that is my intent and I see that intent in every current board member and everyone who is running for the board. You have to allow for differences in opinions, as there are on every subject. I like that you push and ask questions. Let's just push on current and new issues, not ones that are old, done and over! We can't change the past so let's work on the future.

While what you state below is for the most part a rational analysis, be reminded that basically in the beginning, that is when many of us moved into this CIC, the Boards had to copy from the very nebulous management system that was O.K for the developer, but not O.K. for the majority of unit owners. Whereas Del Webb saved and made money, by having their own sales staff their greatest selling instrument. They also did well in selling to buyers that here we had low cost golf and annual membership fees. Yes, I am being repetitive, but the facts are that succeeding Boards have failed, regardless of prompting by lay unit owners to address the problems which create the losses.
Regardless of whether it is called a Financial Plan or a Business Plan, I claim that the majority of prior and certainly the current Board have failed as 'Fiduciaries'.
Even when appropriately asked questions have been asked, the trend has been to avoid reasonable and accurate responses. We the CIC unit owners have been exposed to unwarrented liability risks
from at least three known situations.
At one time at an open meeting, even our outside auditor would not provide a direct response to whether our accounts included a contingency fund for any separation contracts with employees.
I understand that this auditor at one time agreed with our recently resigned Comptroller that the Rangers should be employees as was decided by the Board in 1998. So, why didn't the Board
make the correction for 12 years?
Why did the Board ignore taking the appropriate action against the McCanna\Bjonerud duo when they, in writing, threatened the Board regarding a pending action to dismiss the Exec Dir? This appeared to me to be a huge play to keep a key employee, the Exec Director from being replaced. Just what did this rebellious duo have in mind in such a forceful play?
Why did the Board vote to not investigate the problem of the 'missing documents' after the HR Director resigned and the key to the files was given to the Business Manager?
Why did the Board give the Golf Director, an additional task, Food & Beverages, along with a new title, Business Manager and a substantial raise, and then tolerate the continuing losses? Now that the function of managing the restaurants is being taken by hiring a new manager, will there be a compensating adjustment in remuneration?
Sue, all in all the message that I give is this:
All Directors must perform as 'Fiduciaries' and operate in the open unless they meet for legitimate purposes under Executive Session standards.
All Directors do not have to be in agreement on any specific issue before them; they should encourage the expressions of perhaps a minority differing view.
All Directors should be working together to stay away from interfering with the key employees by establishing at the Board level, clear written directions to the Exec Director.
Bottom line, I do agree that the time is ripe for some new Directors, and I believe it would be appropriate for a couple of the old ones who created, or tolerated, some of our current
problems, to be replaced.
We must have some changes.

I find all these emails and chats on the history of past disputes very interesting and I am sorry for all of you who had to live through these troubles that caused so much bad blood and anxiety between residents. So much anger and pompous chest beating is a waste of time, when we should all be happy to wake up every morning to another day of sunshine and enjoy the activities and our friends here in Sun City. Last night's Resident Forum's presentation of the candidates is that future and gives us all a good choice of candidates to move SCSCAI toward the goals that are important to you. I thought it was a good turn out of interested residents and I was happy that it was very civil. Let's move on and be happy that we have live to see another day.

Dear Don;

I consider you my good friend, neighbor and you have my full support. As you know I retired and moved to Sun City for the active adult lifestyle this community offered, it has been a disappointing fourteen years due to control of our community by a small self serving group.

Don, I have a different view regarding the apathy of this community. Several members have pointed out the past BoD disregards of the governing documents only be attacked and vilified by this small self serving group representing the Board. This small self serving group blocks all accountability of the financial health of our Sun City. (focus on the money) Accountability is a absolute must when you are responsible for 7700 members dues and assets.

Thursday, July 14, 2011 I posted a reply to Re: [SCBuzz] Where are the Millions Going??? in regards to what is needed to establish the accountability that all members deserve.

Needed:

Independent professional investigation (US Attorney) insures Rule of Law

Independent professional forensic auditing insures accountability.

Support by the membership needed for a Total Recall can only be accomplished after an independent investigation/audit has been completed.

Don, any responsible elected Representative would welcome an independent investigation/audit for their own protection. If I can be of any help or assistance do not hesitate to call on my.

Thanks for the support. It is a shame that the members of this chat line are so
unwilling to get involved. Most never even comment. You and I have been
providing a lot of information and that is good. What is not good is a bunch of
people who do nothing expecting anything to change.

As for the ES meetings I have made it clear that if we do not have the recording
secretary taking the minutes I will use civil disobedience to make sure there
are no more ES meetings. I find this Board to be totally incapable of doing the
job as required by the CC&Rs. I also find them to be arrogant and non
representative i.e., Fiduciaries required to act in the best interests of the
Association.

I have been informed by Mr. O'Connell that he (evidently he thinks he has the
responsibility to do everything and anything) has submmited the Affidavit
accusing me of a breach of my Fiduciary Duties to the NRED. I will let everyone
know as soon as I am officially informed that he has taken this reckless action.

p.s. An update on the Fire Station. I believe that the Fire Station will have
a Paramedic but will not have an ambulence. That means that if they respond and
the party needs an immediate trip to the hospital it might not happen
immediately. Probably a very small probability but I believe the Board is
irresponsible not to provide a full explanation of why this has occurred. We
bent over backwards to supply land (it should have been a long term lease not a
gift) and the city has spit in our face. As I understand it, we wouldn't even
have a station (they would still have the land) if Mt. Wilson hadn't been
deleted. Frankly I think our Board allows themselves to be taken advantage of.

Dear Barbara,

I believe you should be made aware of a positive action taken by our HOA. Last May I asked President Joe O'Connell to revisit the ongoing problem of errant golf balls creating hazards to our property and personal safety. Mr. O'Connell reviewed previously documented information I had sent to the Board and golf Staff the past few years. After Mr. O'Connell was made aware of this situation, he set the wheels in motion to rectify the cause of this problem by realigning the t-boxes. This project was completed the first part of September. I am happy to say this change has made all the difference in the world.

Barbara, more importantly is the neighborly manor that this matter was handled opposed to owners concerns being ignored and denied.

Pass on a special thanks, from my neighbors; Charlotte Kuklin, Patti Thomas, Judy Bearns and my wife and myself.

You, I and many other Sun City home-owners have asked these questions over and over again only to be met with silence. It is obvious this and past Boards refuse to be held accountable to the membership. Simple logic would explain that any elected Board member that refuse an independent audit of millions $$ of home-owners funds has the appearance of wrong doing.

Joe this is the second time I have written you on this most important issue, and to date I have not received a response to this very important issue.   Some may ask why
is the issue so important, so its best I respond.    With the initial home purchase contracts, Del Webb made it known that SCSCAI residents with the purchase package would receive the imenities with the purchase, that is as Del Webb stated, except for golf and the restaurants, which purchasers were clearly told, would be paid for seperately by those who used either or both, this being the SCSCAI golf plan and/or the restaurants.

No doubt the golf program has gone downhill, with the golf rounds going from what once was 180,000 rounds to now near 85,000 rounds annually.    Along with this and the result of this decrease, there is only near 6% of the SCSCAI residents using the SCSCAI golf program.    With that data, the breakdown for three golf courses, is only near one and one half per cent using Eagle Crest.   Yet Mr. O'Connell, the result of all this has been a SCSCAI Board these recent years to search for additional income and quite frankly they did a good job in finding that needed golf income to cover what since Del Webb left, has been near $9,000,000 in SCSCAI golf program losses.   The Board in need of golf income, decided to maintain three golf courses, not asking the many fine SCSCAI seniors, but ordering the fine seniors to pay for golf even if they never step on the golf courses - - - - Joe just imagine such fine treatment for the many fine seniors who are asked to vote for you at Board election time!

In addition to all this Mr. O'Connell, how about some more of the SCSCAI FACTS!
Various Sun Cities have been hit with declining golf results and income, and have taken what are fair choices to overcome the income loss.   Do you think changing the SCSCAI golf policy without a formal announcement to the many fine residents was a fair thing to do?    Just imagine any purchaser being told that whether you play golf or not, you are still expected to pay for golf - - - just think how that goes when
purchasers find out???

With all this said President O'Connell, again I ask to respond to why this policy change never was fairly updated with the many SCSCAI seniors.    In my previous message on the same important subject, you never responded to the issue, and I once again fairly give you that chance to do so now.

I await the requested response, this prior to questioning the developer why their promise when selling homes was broken, in that SCSCAI residents now are
odered to pay for golf as part of their annual assessment?????

P.S.    Mr. O'Connell, along the same lines, besides myself being the party who
          implemented both the SCSCAI gaming plan, as well as the NORA plan, which
          have added much dollars to SCSCAI, I also have for now nine years
          recommended and written a much needed SCSCAI financial plan, yet to date
          the Board has turned down any proper financial plan for years!    Maybe you
          will explain that with financial losses in the millions, why does not SCSCAI
          need a proper financial plan???

I am very disappointed in the support we get at Board meetings. If our
side is not willing to show up as often as the opposition and take as
strong a stand as the Bjonerud group we can not win. I agree a RECALL
is the best vehicle to get the truth out unfortunately there will be no
independent investigations but we need none.
Steinman has not won and Marilyn has not lost. The Concerned Citizens
are astute politicians and had no problem pulling together. It is not
clear what caused the initial split but it is over. Bjonerud and
Company will continue to dominate every Board meeting. If those who
believe as we do refuse to get involved even a RECALL will do nothing.

Gentlemen,

In order to better understand the workings of this community's HOA I have followed the actions of the BoD for many years. It is obvious the Board is controlled by a one party political group that call themselves The Concerned Citizens. It is also obvious this group is now splintered due to a power struggle between Stienman and Bjonerud with Stienman winning out and now he is in complete control of SCSCAI. The only loser is the home-owner. I realize that, over the years, several home-owners individually have tried to point out and rectify these injustices that has been done to SCSCAI, only to fail.

After comparison of the attached documents, I have made several observations and conclusions, I would like to share them with you.

OBSERVATIONS:

All three documents were authored by the same person or group of people.
Hand printed comments on the Aug 20, 2010 Village Voice/DRAFT (attached) served as a work sheet for the 2010 Anonymous-letters.
There are two factions that are struggling for control of the Board, Stienman and the Bjonerud group, Stienman being the winner.
Steinman & BoD fail to expose a Blackmail/Extortion plot directed at the SCSCAI Board.
Has the appearance of smoke & mirrors (DOG & PONY SHOW)
Eight members of the Board continue to do business as usual, refuses to be held accountable for their actions/lack of actions all under the guidance of the CAI.
Board refuses independent investigations or audits
Communications controlled by the Board.

CONCLUSIONS:

This group has created a totalitarian dictatorial system in order to control the SCSCAI's millions $$ revenues.
Home-owner/members questions are ignored, then members are ridiculed by a Board appointed spokesman.
Dictatorial power trumps Rule of Law
Independent professional investigation (US Attorney) insures Rule of Law
Independent professional auditing insures accountability.
The only solution to this situation is total recall of the Board and to follow the intentions outlined in the original governing documents.
Support by the membership needed for a Total Recall can only be accomplished after an independent investigation/audit has been completed.

Now is the time for a TOTAL RECALL. Your comments would be appreciated.

Dear Sun City home-owner;

Background:
History: for the past 13-14 years normal maintenance on the Sun City golf courses has been treated by the Maintenance Dept. as stated by Joe Kelley as "special projects". Normal maintenance such as weed control, trash removal, mowing and irrigation systems should be scheduled on a live calendar not generated by the home-owner or to be treated as a "special project". In the past the home-owner was required to generate the w/o in order to bring attention to any repairs needed on the Highland Falls G C property bordering our homes.

Summary:
Please sign the petition and encourage others to do so and ensure the SCSCAI Board or Directors listens to people in Sun City Summerlin, and home-owners generally, and is left in no doubt about the very strong support for this vitally important neglect of high standard of care in providing for the repair, management and maintenance of said property in Sun City Summerlin.

Petition: We the undersigned, call on the SCSCAI Board of Directors to provide maintenance and management to the golf course landscaping as outlined in the CC&R's-ARTICLE X-MAINTENANCE. Re. your below postings.

I am beginning to believe that there is something very wrong with this Board that has not taken any action to discover where the missing documents are. They collectively refused to let the Association Secretary fulfill his duties and hire an outside investigator to recover the missing\stolen documents.

In my opinion, it is obvious that these documents that disappeared around the time that the Executive Director's employment was terminated and the time when the Board 'locked out' the then Human Resource Director have some relationship. Who had the keys to the Personnel Files?

Therefore, the suspicion created casts serious questions on the integrity of all Board Directors who voted against the Associations Secretary request for funding for the Investigator.

I believe that we as the members should not let this pass into oblivion.

How about we get a Petition from other members and contact the FBI for some advice and assistance. Also, how about the same Petition being addressed to our Association's Underwriters for the Directors & Officers Liability coverage? Without this coverage there would be far less desires to withhold information?

This type of action does not require any commitment of spending money by the Petitioners.

Let's have a little debate on this on our two chat lines.

Kathy, I have been following your string of posts and agree things are bad and something needs to be done. The SOP of the past and present Boards has been the same for 14 years that I have observed. I fully support Director Gelbman's efforts. However, I believe the only solution is a total recall and to start over strictly following the original governing documents.

You have said it all about this BOD and prior ones. They don't want any one rocking their autonomy and I believe unless some outside authority gets involved with our HOA of shame, nothing changes. I had already told the chat line (you are a member I believe) that I
would no longer post as a platform. Everything I posted was true and
could be backed up but there was nothing to be gained because the chat
lines, even this one have no real interest in politics and who can blame
them. If I think being on the Board is a waste of time I can imagine
what they think about reading about it. A race between 8 and 1 that is
not free and open is a little boring.

I will give you and the readers one example of why I have no respect for
any of you as Directors. Love you all, but respect has to be earned. I
had only one reason to be on the Board, our legal problems. I knew and
understood as well as last year's Board and its supporters that there
was not one Fiduciary in the whole bunch. Still I was hopeful that Joe,
David and Ken had had enough of the Boards violating the governing
documents for years.

I tried to get all the Board together and you know how that turned out.
With Joe, David, Ken, Jim and myself we had a majority. We talked
about the serious ED and Legal Counsel problem and I was assured in
words and body language that the four of them wanted the changes that I
knew had to come about if we were ever going to succeed as an Association.

My response to you is the result of that meeting. You suggested that we
break into small groups to look at all the problems and Joe jumped at
the chance to make sure that he never had to meet with everyone at one
time. He then appointed a commit tee of 4 to look at the legal problems.

At all times he himself alone was dealing with all of the attorneys
involved in current legal claims since we had no ED.

The committee he appointed never met since David who had been named as
chairman of said committee never called for a meeting. At the last
Board meeting we were told that the committee had not only met but had
decided on who our next general counsel would be. Happened to be a very
prestigious and expensive law firm that David had experience with.

Now my answer to your message that this Board is doing good and I should
quit complaining especially the way I do. The only time this Board ever
talks together as a Board is at the Board meeting. Those who oppose me
love to say that is the law and we must have open meetings. Of course
it is the law but it is not suppose to allow ANY board to operate the
way we do. Joe said it all when I asked him why I wasn't notified of
the meeting and invited to attend. He said in effect YOUR INPUT
WASN'T NEEDED.

I have no intention of doing what the 8 Directors are doing. You are
covering up very serious problems praying that last year will go away
and I tell you, you are dreaming. It will not go away and more
importantly it SHOULD not go away. Will anything change, probably not
this year. With people like myself and those who put me in office,
those who vote in favor of this Board's actions will eventually lose. I
believe it will be a court of law that finally exposes the lying and
cheating but I would settle for channel 13.

such areas and as to which the Association has not made such an election to maintain. Specific

areas to be maintained by the Association may be identified on subdivision plats recorded or

approved by the Declarant, right of way dedications in Tract Declarations and in deeds from the

Declarant to the Association, but the failure to so identify such areas shall not affect the

Association's rights or responsibilities with respect to such Common Areas and other areas

intended for the general benefit of Sun City Summerlin.

The Board shall use a reasonably high standard of care in providing for the repair, management

and maintenance of said property so that the Sun City Sutherlin development will reflect a high

pride of ownership. The Board shall be the sole judge as to the appropriate maintenance of all

Common Areas and other properties maintained by the Association. Any cooperative action

necessary or appropriate to the proper maintenance and upkeep of said properties shall be

taken by the Board or by its duly delegated representative.

Section 2. Assessment of Certain Costs of Maintenance and Repair of Common Areas

and Public Areas. In the event that the need for maintenance or repair of Common Areas and

other areas maintained by the Association is caused through the willful or negligent act of any

Member, his family, guests, invitees or designees, the cost of such maintenance or repairs shall

be added to and become a part of the assessment to which such Member and the Member's Lot

is subject. However, such charges shall not become a part of or be secured by the Assessment

Lien rights against such Lot, but may be recovered by the Association in an action at law

against such Owner(s), including reasonable attorney's fees and costs.

the event any portion of a Lot or Parcel is being used in a manner which violates this

Declaration or any Tract Declaration applicable thereto, or in the event the Owner of any Lot or

Parcel is failing to perform any of its obligations under this Declaration, any Tract Declaration, or

the architectural guidelines and standards of the Architectural Review Committee, the Board

may by Resolution make a finding to such effect, specifying the particular condition or conditions

which exist, and pursuant thereto give notice thereof to the offending Owner that unless

corrective action is taken within fourteen (14) days, the Board may cause such action to be

taken at said Owner's cost. If at the expiration of said fourteen (14) day period of time the

requisite corrective action has not been taken, the Board shall be authorized and empowered to

cause such action to be taken and the cost thereof shall be added to and become a part of the

assessment to which the offending Owner and the Owner's Lot is subject. However, such

charges shall not become a part of or be secured by the Assessment Lien rights against such

Kathy, I have been following your string of posts and agree things are bad and something needs to be done. The SOP of the past and present Boards has been the same for 14 years that I have observed. I fully support Director Gelbman's efforts. However, I believe the only solution is a total recall and to start over strictly following the original governing documents.

had only one reason to be on the Board, our legal problems. I knew and
understood as well as last year's Board and its supporters that there
was not one Fiduciary in the whole bunch. Still I was hopeful that Joe,
David and Ken had had enough of the Boards violating the governing
documents for years.

I tried to get all the Board together and you know how that turned out.
With Joe, David, Ken, Jim and myself we had a majority. We talked
about the serious ED and Legal Counsel problem and I was assured in
words and body language that the four of them wanted the changes that I
knew had to come about if we were ever going to succeed as an Association.

My response to you is the result of that meeting. You suggested that we
break into small groups to look at all the problems and Joe jumped at
the chance to make sure that he never had to meet with everyone at one
time. He then appointed a commit tee of 4 to look at the legal problems.
At all times he himself alone was dealing with all of the attorneys
involved in current legal claims since we had no ED.

The committee he appointed never met since David who had been named as
chairman of said committee never called for a meeting. At the last
Board meeting we were told that the committee had not only met but had
decided on who our next general counsel would be. Happened to be a very
prestigious and expensive law firm that David had experience with.

Now my answer to your message that this Board is doing good and I should
quit complaining especially the way I do. The only time this Board ever
talks together as a Board is at the Board meeting. Those who oppose me
love to say that is the law and we must have open meetings. Of course
it is the law but it is not suppose to allow ANY board to operate the
way we do. Joe said it all when I asked him why I wasn't notified of
the meeting and invited to attend. He said in effect YOUR INPUT
WASN'T NEEDED.

I have no intention of doing what the 8 Directors are doing. You are
covering up very serious problems praying that last year will go away
and I tell you, you are dreaming. It will not go away and more
importantly it SHOULD not go away. Will anything change, probably not
this year. With people like myself and those who put me in office,
those who vote in favor of this Board's actions will eventually lose. I
believe it will be a court of law that finally exposes the lying and
cheating but I would settle for channel 13.

I want to thank you for your prompt reply. By your reply labeling this as a "Special Project" I believe it is important to bring you up to speed on the nature and status of this project.

History: for the past 13-14 years normal maintenance on the Highland Falls G. C. has been treated by the HFGC Maintenance Dept. as you have stated "special projects". Normal maintenance such as weed control, trash removal, mowing and irrigation systems should be scheduled on a live calendar not generated by the home-owner or to be treated as a "special project". In the past either my neighbor (Mrs. Kuklin) or myself were required to generate the w/o in order to bring attention to any repairs needed on the Highland Falls G C property bordering our homes.

Mr. Kelley, as far as being (my choice of trim or replacement) this decision is not the home-owner's to make, this is the responsibility of management. As far as your suggested time line of November-December, let me remind you that this is another six to seven months looking at dead bushes, trash and weeds, remember your weeds are our weeds.

As a follow-up to our April 26th meeting and conversation regarding an approach to implementing a Business Plan for SCSCAI business. At that time I believed that Board support was possible if presented properly; I no longer think that possibility exist due to the following reasons.

It is apparent the SCSCAI business are managed by committee with co-mingled funds, this committee is chaired by a Board member therefore it is an extension of the Board. It is not possible for the Board to provide proper oversight that is required, therefore no one will be held accountable for the LOSSES.
The Board is not ready to relinquish controls of day to day operations and provide oversight to professional management as required in our governing documents.
No professional management team would tolerate being held accountable without a written Business Plan in place.

Barbra, I had high hopes for a change of direction for our Sun City after struggling through the 2010 fiascoes, maybe next year. At the present time I think it would be a waste of time under the circumstances, if you think differently or an opportunity opens do not hesitate to contact me.

Don Gelbman; poor management is the direct results of the lack of oversight by the past Boards. The Board or a owner of a business with roughly $4 mil in revenue & LOSSES of $2mil, equaling $6mil in negative cash flow would be insane to continue in the same direction. My point is the Board has failed the reality of math, they have failed to provide the accountability that a basic Business Plan provides therefore they have failed in leadership and oversight of this Sun City.

It would be a shame to make a judgement as to the best interest of the membership based upon dysfunctional Board members that are subject to bend with the wind. Like I have said before many concerned member homeowner have petitioned for a Business Plan in the past only to be ignored, WHY? Until the practice of Management by Committee and co-mingling of funds is rectified there will be continued LOSSES. I hope there would be consideration for intelligent business procedures before altering Sun City's assets and lifestyles.

It would be insane to close any of Sun City's golf courses because present and past Boards failed to provide proper oversight. The past thirteen years I have observed management by committee that has provided the same results year after year, continued LOSSES. Professional business practices would have utilized a Business Plan and not allowed co-mingling of funds, therefore providing accountability to the membership.

Many concerned member homeowner have petitioned for a Business Plan in the past only to be ignored, WHY? Until the practice of Committee Management and co-mingling of funds is rectified there will be continued LOSSES.

Joe, after studying your reply to our conversation we had before the 5/9/11 BoD meeting I got the impression you did not understand that my intentions were only to ask the Board to revisit my July 1, 2010 registered complaint sent to Ron Winkel-ED, SCSCAI Board and Joe Kelley-Director of Golf. This complaint was met with silence and ignored. As far as your other remarks, I have taken the time to make some minor corrections in [brackets]. I would be interested in seeing the Associations files associated with this and my adjoining neighbors complaints; this would clear up any differences of facts shown in the photos.

Bob Robey, I thought you would find Joe O's response interesting [my comments]. This response is a perfect example good neighbors being contaminated by the power of politics. Politics has replaced the intent outlined in our governing documents.

Bob, I think your idea of gathering some documents and going to the media has merit, where to start? Johnathan and your efforts appears to be making a difference on the State level. Don Gelbman is making a difference here in SC, however Don can not do it by himself, what he needs is a support network, how can this be accomplished? Is a recall a possibility? What is needed is a sense of Community-pride.

By the BoD's overwhelming silence, under your leadership, It is obvious that you and the Board
share Mr. Winkel's position that the CC&R's relieve any responsibility of SCSCAI for the health and welfare of this HOA members. This is inconceivable, I believe that health and welfare is a major responsibility of any elected Board of Directors. My understanding of governing documents, which includes the CC&R's, is to protect the homeowners health, welfare and community standards, not to shield Boards and management from their responsibilities.

Oh well! Here's what will happen May 11th: Chris Giunchicliani and Mitch Fox are going to appear on our Desert Vista stage in a living-room type of set - comfortable and relaxed. Although Mitch Fox will take Chris through all of the issues, and she will be able to address each at length and in depth, you will also be able to ask her your questions directly. I'm certain this format will allow you to better analyze the differences in philosophy, knowledge and ability to lead between the two candidates for Mayor of Las Vegas.

You will NOT need to pick up tickets for the May 11th event (as announced in the May LINK) since I'm not concerned about "selling out". I hope you will make it your business to attend both events and give plenty of thought to your vote in June.

A Note about the re-plumbing of the homes that were previously re-plumbed by Del Webb's sub-contractor prior to 2004. So far two companies have been assigned (there may be more coming in a while) - Rakeman Plumbing and Dynamic Plumbing. Although both companies may suggest you add the re-plumbing of the cold water lines to the attic at your expense,I concerned to know that Rakeman plumbing is selling it with a very heavy hand. They are telling our homeowners there have been "many" cold water leaks under the slab here. I have not heard of even two cold water leaks in copper under-slab pipes in more than five or six years. I can't know about every problem that happens here but it seems to me if cold water leaks were happening I would be aware of it. I sure hear about everything else.

If your finances are in good shape and you will be more comfortable having both lines replaced that may be a great idea. There's no way to know whether the cold lines may leak in the future. I don't mind the plumbing company giving the homeowner the choice but the way it is being presented is, to me, over-the-top.

If you are a retired educator or school administrator you will be interested in our June Forum program. I would really appreciate a note from you telling me about your background (briefly). We are going to present the many ways our residents can help our schools at the program. I'd like to have a group of Sun City residents who will help organize the many volunteers I expect to emerge from the program. There's a lot we can do. If you're interested and have ideas please drop me a note.
