1) Confusion over Specialist / Panel / CML Seniority, regarding.

The TNGDA for decades has stood by CML Seniority at all levels. In G.O:354 which was issued based on Praveen Kumar Committee report (in which TNGDA office bearers were members), certain confusions prevail among our members, officials, and others.

The TNGDA members of the Praveen Kumar committee during the deliberations have made it clear of the priority of CML Seniority in any Specialty. It was accepted to maintain STATUS QUO in this regard. More so, the committee and the consequent G.O:354 are basically a Finance GO. Hence, rules on promotion and seniority are always based on the situation in the parent department.

So the TNGDA in the State EC Meeting held on 25.10.09 at Trichy has resolved to get suitable Clarification / Amendments to ensure STATUS QUO (that existed before with CML seniority as superior).

The TNGDA will also fight against the controversial illustration 4 in the G.O. 354.

2) Release of Diploma Candidates to DME To DMS Side.

The TNGDA State Office Bearers has taken up the issue with the DME and the Govt to retain to all willing Diploma and MBBS candidates in the DME side itself and ensure Person Oriented Promotion (including PB IV) to them.

Those willing to continue in DME side are directed to give their option thro the Dean on the circular from the DME stating their willing ness to continue in DME side.

Those wanting earlier promotions shall opt to go to DMS side and they will get their speciality specific seniority and promotions there.

G.O. 354 – Highlights

An excellent G.O. in terms of financial benefit. As this is basically a finance G.O., all administrative orders, procedures in that can be changed any time in-future at the directorate and Health Secretariat.
Worth 118 crores + 30 crores as DA + 15 crores as allowances totaling 165 crores per annum.
165 crores per annum for our doctors
+ An increase in retirement benefits by 2.5 lakhs at present to upto 10 lakhs in future. + increase in monthly pension
No other association has achieved such large scale promotions and enhancement in basic pay as correction in an agitation in 50 years in any department in TN.
Pb4 possible max by 20 years. Minimum by 9 to 12 years (even 6 Y)
IAS in 13 YEARS they reach pb4 (Time bound).
UGC - After 12 years on vacancies, they reach pb4
Time bound Pb4 only for doctors and IAS in TN
By 20 years pb4. ie 1/3rd at any time. Every one some time.
10 out of 30 years in pb4 ie gross from 65000 to 80000.
The exclusive club of PB 4. Total TN officers 4000 in pb4.
3000 are doctors. 300 IAS/ IPS. Balance other dept.
Every doctor will reach PB 4 and retire. (irrespective of their qualification)
Every doctor will reach the maximum pension. (Upper limit)

Points of concern in G.O. 354:

1. Suggested release of Diploma and MBBS from DME side on first promotion:

By now the DME/ Health Secretariat/ Finance Secretariat have agreed to retain Diploma/ MBBS till CCS level.
This is same as pre-G.O. state.
TNGDA has resolved in Trichy State EC of this. Has sought an amendment to retain and promote them within DME as per the recommendation of Praveen Kumar Committee. (TNGDA formed a part of the committee.)
As of now, TNGDA has succeeded in persuading DME/ Health Secretary in retaining diploma/ MBBS doctors upto CCS level. Awaiting finance clearance.
DME himself has agreed to take it up as it would affect functioning of many departments.
Selfish criticism by certain people accusing this clause is meaning less. For the fear that it may affect them they start criticizing this. (All these years it was like this. Diploma/ MBBS moving out at SCS level promotion. Why such hue and cry now?)

2. Date of implementation:

Not from 1.1.2006. Only from 23.10.2009. Even personal representation was made with Hon’ble CM. Finance department objects to this.

3. Panel / Specialist seniority:

TNGDA always insist on CML seniority. TNGDA Demand: CML is fundamental for promotion and NOT to Panel or Speciality seniority.

4. VRS Cool-off period:

Those non-scarce doctors willing for VRS after 20 years of service before claiming pb4 pay will be allowed VRS. Once they claim pb4 they should stay for 5 years before VRS.

TNGDA to take-up this clause legally.

What do Service PGs get?

The service PGs will get regular increments (instead of paper increments)
Their PG period will be counted for time-bound promotions.
Almost all PGs will get atleast one promotion. First year PGs ie joined service in 2006 will be promoted to SAS and those who joined service before 2005 will be promoted as Civil Surgeons at the time of implementation (one time fitment has no minimum period.
To Sum-up - first promotion in 3^rd year and two promotions in 5^th year is unimaginable. Most likely the orders will be effected in a couple of months.
Is it true? Yes, sure.
How? Most people get confused with Person Oriented Promotions at 8, 15 and 20 years. (This POP is the maximum time for promotions.) Hence feel the first promotion will be only at 8^th year. But apart from POP TNGDA through the Praveen Kumar Committee has increased the promotions. (plz see table below). Through them the quick promotion is possible.

PHC doctors do not benefit by this… some so called organizations. Is it true?

These party based or Public Health Officials instigated forums are all motivated and have vested interest. Their only idea is to blame TNGDA.

But still let us see what would our PHC doctors get.

By person oriented promotions, PHC doctors are expected to get promotions in 8, 15 and 20 years. But on the recommendations of Praveen Kumar Committee the total posts are upgraded to various cadres and by this increased promotion opportunities,

All PHC doctors who have joined service in 2006 (including CMC batch) will be promoted to SAS
and those who joined service before 2005 will be promoted as Civil Surgeons next month (at the time of implementation)
Almost all PHC doctors who have put in 16 to 17 years will get pb4 scales.

Unbelievable. Yet true.

+ time-bound pb4 scales (Biggest achievement)
More allowances – PHC allowance, administrative allowance etc.
Central Govt. funded Rural Pay will also be extended to them later on.
The best scales for PHC doctor in any state across the country.
First time in the history, the PHC timings are reduced by 2 hours and practically NO CALL DUTY.

Let these people show better pay/ promotion scales for PHC doctors in any other state.

The salient points of the GO are

7. The Government have examined the proposal of the Director of Medical and Rural Health Services and the Project Director, Tamil Nadu Health Systems Project in detail and decided to accept the proposal subject to certain modifications.
8. (a) Accordingly the Government
(i) sanction 434 additional posts of Assistant Surgeon in the scale of pay of Rs.15600 - 39100 + G.P. Rs.5400 for a period of one year from the date of issue of Government Order at an estimated recurring
expenditure of Rs.21.99 crores per annum to meet the requirements in the current round of rationalisation of Director of Medical and Rural Health Services run hospitals in the State as a whole; and
(ii) notify all posts of Assistant Surgeon in Government Hospitals under
the control of Director of Medical and Rural Health Services, the
posts proposed to be sanctioned and the posts already sanctioned
under Tamil Nadu Health System Project as that of specific specialist
post or MBBS post.
(b) The Government also direct that
(i) the doctors with Diplomate of National Board (Dip. NB) qualification be considered as equivalent to Post graduate degree in the respective speciality;
(ii) the deputation of specialists working on Foreign service in dispensaries such as TNEB, Central Prison, Rehabilitation Home, Juvenile Home, Police Hospital etc., and ESI Dispensaries be revoked and all dispensary category posts be notified as MBBS posts and all posts in Government dispensaries and Mobile Medical Units be designated as MBBS posts;
(iii) all posts in Primary Health Centres be designated as MBBS posts with only upgraded Primary Health Centres to have one post that is designated as a DGO/Female MBBS doctor post wherein a DGO or a
Female MBBS Doctor be permitted to occupy the post subject to the condition that the MBBS posts shall not be filled up with specialists, unless that speciality has a surplus strength at the State level;
(iv) the process of earmarking of posts, identifying doctors in Government Hospitals speciality wise, as detailed in the Annexure-I & II (speciality-wise designation of posts in Government
Dispensaries, TB Centres and other institutions under the control of the Director of Medical and Rural Health Services) and Annexure-III (Designation of posts for foreign service institutions) to this order, counselling sessions and postings have to be completed first and the recruitment process be commenced only after that in a serial order and not parallely;

(v) the posts sanctioned under Tamil Nadu Health Systems Project be included as part of the overall sanctioned strength and
(vi) doctors having Postgraduate diploma qualification be transferred to the Director of Medical Education controlled Medical College and Hospitals only against the existing vacancy in their specialities until a doctor with Postgraduate degree qualification is found and posted accordingly.
(c) The Government approve the following counselling methodology in filling-up of both MBBS and specialists posts:-
i) At the initial stage, the posts earmarked for particular specialists will be informed hospital-wise publicly in the department and on a web-site so as to ensure that all doctors in the department are properly informed.
ii) In the first phase, the available specialists in each Government Hospital, depending on their willingness, will be accommodated according to station seniority in the sanctioned speciality posts of that institution.
iii) Then, a list of persons for whom sanctioned speciality posts are not available in their current / present working station will be prepared by the Director of Medical and Rural Health Services. Simultaneously, a list of vacant positions in each hospital will be prepared and notified on the website and in the Joint Director's office throughout the State. The list shall also be displayed in the Director of Medical and Rural Health
Services office. The list shall be displayed on the website as well.
iv) Following these preparatory steps, speciality-wise counseling based on service seniority at the state level will be carried out. In this phase, Civil Medical List seniority for those applicable and date of joining in service for others shall be the determining factor for being posted into an existing vacancy.
(d) The Government also approve
(i) the filling up of all vacancies that arise out of the proposed counselling immediately through Employment Exchange under rule 10(a)(i) in consultation with the Tamilnadu Public Service Commission and
(ii) the filling up of all Senior Civil Surgeon posts (including Dental Senior Civil Surgeon) with persons in the same speciality of a lesser rank in the event of non-availability of Senior Civil Surgeons till suitable persons become available from subsequent panels.
(e) The orders issued in the Government Order second read above, prescribing minimum three years of rural service for the candidates selected by the Tamilnadu Public Service Commission for the post of Assistant Surgeon in Tamil Nadu Medical Services as compulsory are hereby cancelled. The Director of Public Health and Preventive Medicine is directed to send suitable proposal to Government to delete the relevant rule from the Special Rules for the post of Assistant Surgeon.
(f) In supersession of the orders issued in the Government order first read above, the Government impose ban on diversion and re-deployment of specialists to institutions other than to which they have been posted to, with immediate effect unless there is a vacancy that is affecting the medical services of another institution as
compared to the institution from which a person is to be diverted.
(g) The Pay and Accounts Officers, Treasury Officers are directed to honour the Pay bills only if the doctors with the prescribed qualification for the sanctioned posts are posted in the respective posts by incorporating in the pay bill a certificate by the Pay Drawing Officer as prescribed by the Director of Treasuries and Accounts.

The Committee formed to study the demands of TNGDA ubder the Chairmanship of the Special Secretary Finance has submitted the main report on the time bound promotions (person-oriented promotion to those who do not get regular promotions by 8, 15 and 20 years), creation of extra cadres @ new scales to ensure better promotion opportunities and VRS on 31.7.2009.
The report has been accepted by the govt. – in health, P & AR and Finance.
The file is on circulation
Hope to get the G.O. by the end of first week on the above issues.
The supplementary report on our demands on allowances to our cadres is in the final stages. To be finalized shortly. (delay due to the swine-flu work)
After this the report is to be accepted by the govt. @ Health, P&AR and Finance.
After a mandatory circulation, G.O.s will be issued.
TNGDA Representatives in the Committee – State President and the State Secretary with the active involvement of the state cabinet members are actively following the progress in the issues with all dedication on day today basis.

Overall, the situation is positive. The govt. stands committed to the assurances in the agreement. Other details will be conveyed after the issuance of G.O.

AMENDMENT NOTIFICATION
New Delhi, the 21st July, 2009
No.MCI-12(2)/2009-Med.-22654 - In exercise of the powers conferred by Section 33 of the Indian Medical Council Act, 1956 (102 of 1956), the Medical Council of India with the previous sanction of the Central Government, hereby makes the following Regulations to amend the “Minimum Qualifications for Teachers in Medical Institutions Regulations 1998” , namely: -
1. (i) These Regulations may be called the “Minimum Qualifications for Teachers in Medical Institutions (Amendment) Regulations, 2009” .
(ii) They shall come into force from the date of their publication in the Official Gazette.
2. In the “Minimum Qualification for Teachers in Medical Institutions Regulations, 1998” , the following additions/modifications/deletions/ substitutions, shall be, as indicated therein: -
3(i)(a). In Schedule I, Clause (2), the words “The Heads of these departments must possess recognized basic university medical degree qualification or equivalent qualification” shall be substituted with the following: -
“Heads of departments of pre and para clinical subjects must possess recognized basic University degree qualification i.e. MBBS or equivalent qualification.”
(b) In Schedule I, Clause (2), the sentence “In the departments of Community Medicine and Pharmacology, Lecturers in Statistics and Pharmacological Chemistry shall possess M.Sc. qualification in that particular subject from a recognised University.” shall be substituted with the following: -
“In the department of Community Medicine, Lecturers in Statistics shall possess M.Sc. qualification from a recognised University.”
(ii). In Schedule I, the following shall be added to Clause (3):
“Dean / Principal / Director of Medical college/institution, who is head of the institute and the Medical Superintendent who is head of the affiliated teaching hospital can be incharge of a Unit but cannot be HOD in the medical college/institution. However, they can teach and practice in the Department concerned.”
4. The Teaching/Research experience requirements in all the subjects of Broadspecialities shown in Table - 1 shall be substituted as under:-
“(A) Professor:- (i) As Associate Professor in the subject concerned for three years inthe recognized medical college.
(ii) Minimum of four research publications in indexed/national journals.
(B) Associate Professor:- (i)As Assistant Professor in the concerned subject for four years in the recognized medical college.
(ii)Minimum of two research publications in indexed/national journals.”
5. The Teaching/Research experience requirements in all the subjects of Superspecialties shown in Table - 2 shall be substituted as under:-
“(A) Professor:- (i) As Associate Professor in the subject concerned for three years in the recognized medical college.
(ii)Minimum of four research publications in indexed/national journals.
(B) Associate Professor:- (i)As Assistant Professor in the concerned subject for two years in the recognized medical college.
(ii) Minimum of two research publications in indexed/national journals.”

Junior Doctors and TNGDA - Few Questions and Answers

Special TNPSC: It was TNGDA which got special TNPSC for these 10a1 batches every time – be it at 1990/ 2002 or 2007 (CMC batch) or 2008. The G.O. (D) No 1162 dated 07.10.2008 was issued on the behest of TNGDA – asking TNPSC to hold a special exam.

But unfortunately (based on a request sent to TNPSC from govt a year ago) a regular TNPSC exams were called for. This is an accident, totally unexpected.

TNGDA took the issue with the TNPSC citing the following justifications:

1. There will be double entry by the 10a1 doctors – both in regular and special exams leading to extra work and lesser recruitment than desired.

2. The seniors working as 10a1 in rural PHCs may lose their seniority to newly recruited juniors.

3. With less number of vacancies – doctors recruited by regular exams may oust and replace the 10a1 already working.

The TNPSC officials were firm in that by their rules – as the notification has been issued for regular exams (though accidental), they can hold special exams only after the completion of the regular exams.

As TNPSC is an autonomous body like election commission etc. – an association action will not possible. TNGDA requested the HM, HS to use their good offices for our demand. They assured TNGDA that NO one will be ousted at any situation. They would try to speed up the special exams.

Even on 7^th July (after the strike) the Hon HM rang up TNPSC Chairman in the presence of TNGDA office bearers – to speed up the issue.

Though TNGDA welcomes support from any forum, the suspicious behaviour of a non service forum (? offiliated to political party) in most issues were infact counter productive. Friends (very few numbers) in such forums should know that it is against conduct rules to have membership in political affiliated forums. (more so in an opposition related forums).

More so their ways – agitation against TNPSC – demanding special exams is nothing but a drama, infact counter productive. Many a time our request was not heard because it was messed up by our friends in such forums. Even the present CRRI/ Non service PG (though very genuine) issue is complicated and has reached Hon CM as instigated. (read CM speech in assembly).

Friends, TNGDA is trying its best to speed up the conduct of special exams.

Mobile doctors:

Mobile drs are just like any other 10a1 – timescale doctor. He/she can opt any post in transfer (as in recent transfer counseling). But their pay is from NRHM funds. Hence paid thro’ society.

But for all other administrative and other purposes, they will be taken on par with other 10a1 service. (for pre-PG mandatory service etc).

Though the salary is paid thro’ NRHM funds, the NRHM has turned down grant for pay commission arrears from its funds. TNGDA has taken up this with the govt. The govt. has agreed to pay the arrears (after getting finance concurrence) from govt. funds. (instead of NRHM funds).

The process has been started. TNGDA will ensure this. Every mobile doctor will get his full arrears due to him.

10a1/ CMC Batch demands:

TNGDA by principal is always for recruitment of assistant surgeons by regular TNPSC (as recruitment thro’ other methods can make members vulnerable and selection biased). This idea is just to ensure that there should be no harassment to our temporarily posted members and the recruitment fair. (some of our present state office bearers were 10a1 doctors joined in 1990).

· But once recruited, it was TNGDA which got special TNPSC for these 10a1 batches every time – be it at 1990/ 2002 or 2007 (CMC batch) or 2008.

· TNGDA got them regularized from the date of joining – 1990 / 2002 (also for CMC batch)

· TNGDA got a G.O. (later quashed in High Court) including the CMC period for calculating the mandatory 3 years for writing PG entrance.

· This year it is TNGDA which got the mandatory period reduced to 2 years from 3 years (Resistance to this reduction is gaining momentum in official side; and possibly this will be raised to 3 years next year – as done for superspeciality)

· It is TNGDA which got PHC doctors an extra mark in PG exams (benefiting juniors). Doctors in CEmONC, Casualty, difficult postings etc may be given this benefit next year.

CMC Batch – 2007 Special TNPSC exams Regularization orders:

As per the TNPSC the seniority from the date of passing the special exams. But as doctors of different 10a1 batches (1990/ 2002/ 2006 batches) wrote the exams, there was confusion over the date of regularization. TNGDA has represented that the date of joining should be taken up the date of regularisation for all batches. Few queries raised at the P & AR / Health depts. over the date of regularization for those 10a1 candidates joined in 1990 & 2002 (failed in earlier spl exams). The file is being processed. TNGDA assures issuance of order by the end of this month.
