  <p class="">I have a new book out! Here is what it is about:</p><p class="">Over the past century, national competition over global resources has been facilitated by cross border regulatory cooperation, with taxation a central focus. This cooperation has always been ostensibly for the mutual advantage of all participating nations, yet we continue to live in an unjust world in which resources and power are hoarded by a few, while many suffer under intolerable conditions. Against this backdrop, how should we understand the way that nations share power and resources in their dealings with each other?&nbsp;</p><p class=""><span class="sqsrte-text-color--accent"><strong><em>Tax cooperation in an unjust world</em></strong></span>&nbsp;demonstrates that&nbsp;the international tax system is key to answering this question.</p><p class="">In making our claim, we argue that the international tax system currently contributes to the extreme conditions of injustice in the world today, but it is capable of altering course. The scope of unmet need and attendant injustice visited upon the world’s most vulnerable populations is well-documented, and most visibly encapsulated in the Sustainable Development Goals unanimously adopted in 2015 by the 193 member states of the United Nations. As is clear by now, the COVID-19 pandemic has dramatically increased the magnitude of the problems to be addressed. That tax revenues are key to resolving these problems is uncontroversial—the main intergovernmental institutions including the United Nations, the Organisation for Economic Co-operation and Development, the International Monetary Fund, and the World Bank have expressed solid agreement on this fact. Yet the international community finds itself unwilling or incapable of centering its core tax cooperation efforts on such resolution.&nbsp;</p>

  <p class="">We see potentially significant barriers to changing course within the normative assumptions currently informing international tax discourse and practices.&nbsp;<em>Tax cooperation in an unjust world</em>&nbsp;therefore presents <span class="sqsrte-text-color--accent"><strong>two principles</strong></span> that should guide nations in their dealings with each other when it comes to tax cooperation.&nbsp;</p><p class="">The first principle is that nations are entitled to the economic returns to investment in their territories—<span class="sqsrte-text-color--accent"><strong>the&nbsp;entitlement principle</strong></span>. This is a principle already at work in international tax cooperation, but we aim to examine its core assumptions and demonstrate that it is more often than not misapplied in practice.</p><p class="">The second is that each nation is entitled to benefit equally from cross-border cooperation—<span class="sqsrte-text-color--accent"><strong>the&nbsp;equal benefit principle</strong></span>.   <p class="">Central to our task is answering the core normative question that has informed cross-border cooperation for the entirety of modern income taxation, namely,&nbsp;which states are entitled to tax what, and the related question of&nbsp;which should prevail&nbsp;if more than one is entitled to tax. Answering these questions in normative terms is one of the main goals of this book; demonstrating the feasibility of moving closer to a more just tax system is the other.</p><p class="">We open the discussion with an introduction of the entitlement principle. In a just world, the principle that&nbsp;nations are entitled to the economic returns generated within their territories&nbsp;is intuitively compelling, but in our unjust world, the principle is conditioned by the need to confront such injustice. We therefore introduce the equal benefit principle as a corollary:&nbsp;the&nbsp;entitlement principle cannot be fully realized unless the equal benefit principle is realized as well.</p><p class="">The two principles follow from a widely accepted conception of international justice that takes the existence of independent states of unequal affluence as morally justified and identifies only a limited set of principles as regulating their interactions. We can readily observe that the entitlement and equal benefit principles are deeply embedded in the ways nations act toward each other, even if each is violated in practice.</p>

  <p class="">In examining these violations, we make two distinct but interrelated normative cases for reform in international tax cooperation. The first of these is that relatively affluent and well-ordered states have <span class="sqsrte-text-color--accent"><strong>duties of assistance</strong></span> to help fulfill subsistence rights abroad, such that any nation’s entitlement to the wealth of its territory is&nbsp;conditional on it having discharged such duty. The second is that even if this first claim is not fully accepted, the existence of subsistence rights deficits has significant implications for what states can&nbsp;rightfully claim&nbsp;as part of their entitlement at all.</p><p class="">The duty of assistance is well explored in the philosophical literature and it is compelling. Yet, we understand that it also leads to perhaps uncomfortable implications with respect to nation’s obligations to one another. Some might reasonably reject the claim or find its implications beyond that which is practically applicable in our present world. In response, we show that even if states are not directly responsible for either the existence or rectification of subsistence rights deficits, this does not mean that they are entitled to all of the gain that is produced as a result of such deficits. In fact, they may be entitled to none of it, depending on the circumstances that produced the gains in question. Much of the book thus stands as a direct challenge to some comfortably embedded yet ultimately incorrect assumptions about national entitlements to wealth.</p><p class="">The book accordingly concludes with a&nbsp;call to action. Going into a third year of a continuously evolving pandemic, the dire consequences of ignoring the suffering from which those with the greatest resources financially benefit has perhaps never been more clear.&nbsp;Relatively affluent states&nbsp;cannot continue to claim their own entitlements to wealth while denying the same to others. The international community must confront the parameters and implications of the entitlement and equal benefits principles, lest the mistakes of the past continue indefinitely into the future.</p>

                <p class="">Prof. Willmott will share his working g paper, “Taxes, Taxpayers, and Settler Colonialism: Toward a Critical Fiscal Sociology of Tax as White Property,” forthcoming in the Law and Society Review. The paper traces the construction of taxpayer concerns and tax myths in order to demonstrate the importance of tax to settler colonialism and the shape of Indigenous-settler relations.                 <p class="">Prof. Alessandrini’s Colloquium talk is entitled “<strong>Why feminist engagements with value theory might matter for tax scholars</strong>”. Her talk will draw from her prior work on contemporary approaches to conceptual and normative understandings of the production of value in contemporary economies, and in particular her article “<a href="https://www.tandfonline.com/doi/full/10.1080/10383441.2018.1548332">Of Value, Measurement, and Social Production</a>.” The work interrogates claims that what creates value in an economy that is dominated by finance and financial innovation is essentially immaterial: “what gives a product, asset or economy its worth has become contingent, devoid of any substance and therefore beyond measure.” In the paper, Prof. Alessandrini asks, “What if, instead, value has always been contingent and yet measures are always instituting it? What resources do we have then to think about our ability to contest value-making processes, such as those brought about by ﬁnancial markets and innovations, without either invoking the latter’s parasitic nature or being content with merely exposing the contingency of value these instruments reveal?” In the colloquium, Prof. Alessandrini will bring this analysis to the challenges we are currently working out in domestic and international tax spheres, and explore the role that feminist value theory could play in (1) demonstrating how wealth is generated in the global economy including its close relationship to social inequalities; and (2) offering a normative argument for a different allocation of the tax base.</p><p class="">As always, all are welcome to join; please <a href="https://mailchi.mp/cc2448ccbef6/vk48n789yh">click here</a> to receive the zoom info.</p>

                <p class="">On Wednesday at 11:35 EST <a href="https://mailchi.mp/cc2448ccbef6/vk48n789yh">via zoom</a>, Cui will present his working paper, <a href="https://papers.ssrn.com/sol3/papers.cfm?abstract_id=3877854" target="_blank"><em>New Puzzles in International Tax Agreements</em></a>, which asks the question: why should countries cooperate on tax matters? Taking aim at the haphazard and under-theorized march toward a new multilateral agreement to implement the OECD-curated two pillar approach to taxing highly digitalized multinational companies, the paper examines the rationales for collective tax action in contrast to the WTO’s terms of trade approach. It argues provocatively that taxing multinationals effectively does not actually require global cooperation at all, and that the main impact of the two pillar approach will be to make life easier for multinational companies, mainly at the expense of lower income countries. </p><p class="">As always, all are welcome to join.</p>

                <p class="">Clair’s working paper, entitled <em>Intangible Assets and The Thunder of History: an essay in world-system fiscal sociology</em>, takes us on a journey that connects global wealth chains, global value chains, and the tax state. Quentin explores how capital and the state both try to capture value from global value and wealth chains, while labour seeks to interrupt the efforts of each. So far, capital is winning, and richer states benefit more than poorer states from this balance because they can turn to other sources for their revenue needs. Quentin ultimately argues for the development of a new, progressive international fiscal sociology to develop modes and methods to change the status quo.                 <p class=""><a href="https://www.osgoode.yorku.ca/faculty-and-staff/ozai-ivan/" target="_blank">Ivan Ozai</a> (Osgoode Hall Law School) will kick off this year’s Spiegel Sohmer Tax Policy Colloquium tomorrow at 11:30 EST via zoom. Ivan’s working paper considers whether it is possible to design a border tax adjustment to equalize carbon-intensive foreign goods and services with their domestic counterparts (“border carbon adjustment”), while also supporting development goals using common but differentiated responsibilities per the United Nations Framework Convention on Climate Change (UNFCCC). The paper examines some of the possible trade and non-trade goals and obstacles to such a plan. </p>

confounding moment for international tax.]]></description><content:encoded><![CDATA[<p class="">Yesterday the OECD released a significant announcement: 130 countries have in principle agreed to build a world in which some number of large multinationals face a minimum rate of income tax of at least 15% on a base of income that will be roughly harmonized in some fashion, and at least some rearranging of the tax base will occur according to where the consumer is located, though it is still not clear just how much at this point. As always the devil will be in the details and there will be a lot of devils.   <p class="">It is interesting that we now find out that when the OECD uses the term “consensus” this does not mean universal agreement. Nine countries either haven’t yet agreed or won’t ever agree. Those are Barbados, Estonia, Hungary, Ireland, Kenya, Nigeria, Peru, Saint Vincent &amp; the Grenadines, and Sri Lanka. Moreover many countries absolutely have a list of reservations but are included as agreeing in principle. And of course the United States will not be signing on to any multilateral agreement, as the report acknowledges when it describes the US unilateral regime ‘coexisting’ with the global one. </p><p class="">The US media and administration appears laser-focused on the minimum tax rate to the exclusion of the redistribution aspects of the plan. Some are characterizing the entire project as 130 countries agreeing with a proposal strictly conceived and designed by the United States, which is saying the quiet part out loud as far as inclusive frameworks and equal footings go. Secretary Mnuchin from France, Italy, Spain and the UK. It speaks of good faith bargaining over the construction of a fair and balanced multilateral solution—familiar themes of this work to be sure. But it also hints that a recalibration (read: weaker approach)  might be underway. The letter speaks of a “phased approach” that initially focuses on “automated digital services”. I didn't take note of it at the time but here is how the OECD defined automated digital services in its <a href="https://www.oecd.org/tax/beps/statement-by-the-oecd-g20-inclusive-framework-on-beps-january-2020.pdf" target="_blank">January statement</a>:</p><blockquote><p class="">businesses that provide automated and standardised digital services to a large and global customer or user base. These are businesses that, in general, are able to provide digital services remotely to customers in markets using little or no local infrastructure</p></blockquote><p class="">I am not sure that is a meaningful definition. As for a phased approach, this is the first I am hearing of it but it’s admittedly hard to keep up with the OECD.</p><p class="">The Ministers conclude with their commitment to collaboration and helpfully point out that unity among allied countries “cannot be achieved through threats and sanctions.” We shall see!</p>
