This may seem like a bit of a misnomer if you are planning your first production but let me assure you it isn’t, it’s vital to have a defined inventory of what you will require to create your film. Vital. You have your vision, you have your script, you have your storyboards and you’ve made the friends you’ll need to realise your film. Now you need to list exactly what you’ll need for the film, this inventory should cover; props (want your character to drive a car? You’ll need a car), costumes (per character, per scene) and necessary equipment (a whole article in itself) as a minimum. Be extensive and catalogue the location of all your necessary props (should you be borrowing them, which, chances are, you will be) so that you know what to collect, from where, at what time for which specific scene. This is where some filmmaking etiquette early on can help you in your filmmaking career, ask well in advance if you wish to borrow something, give them specific dates you wish to use it, promise to return it by a certain date and deliver on that promise. Getting yourself a bad name for losing or returning props or equipment late can get you a bad name early on meaning that people will be less willing to help you further down the line should you work with them on other projects or need to reshoot any scenes.

Location Scouting

This is a process that you will have a rough idea for when you are writing your script, you will obviously be writing scenes and those scenes must obviously occur somewhere. It is best not to aim too high on this front and there are a number of considerations which you must be aware of. For example; you set a scene in or around a school. Considerations; is it day or night in your scene? Are there children visible in your sequence? How long do you require the set for? If you’ve set your scene in the day then you will have to work around the school, they will not interrupt regular proceedings for your personal project. If there are children visible you will have to get permission slips from the parents for EVERY visible person under the age of 18, a massive logistical task which may best be avoided. Are the children audible? Shooting your scene at break time or recess will generate a lot of noise on your audio track; this is a consideration for shooting near schools as well as on the grounds themselves. Consider when you want the location, for how long and what you want to change about that location. Visit your potential locations regularly to see how they appear throughout the day as lighting may be good in the morning but bad by noon, a consideration pending on how long you plan to shoot there. Do you need to book your location? If it is public grounds then maybe not, if it is private property the owner may wish to see some insurance coverage before they allow you to film there. As with all things; be considerate. You may have found the perfect office block to film a chase scene through but will the company want you disrupting business? Keep your name clean in case you need to reshoot at any point or use the location for other projects.

Logistics

Ok so you’ve got your scripts sorted, production roles filled and your inventory is full of guns and wizard hats, let’s set up the camera now, right? Wrong. Now you need to create your production schedule, the itinerary for your production phase; this needs to cover exactly what or who will be needed when and where. The success of your production schedule will act as a good measure of how successful you are at fulfilling the role of producer. Organising all necessary costumes, locations and actors and getting them all to show up at the same time is akin to organising smoke and why a good production schedule is absolutely paramount. Once this is thrown out of whack the rest of the production will suffer so be sure to create it with leeway, book anybody, anything, anywhere well in advance of your planned shoot. Be considerate of your production team here also, chances are expecting them to film 7 nights a week will lead to bad morale and lower productivity as a result.

The U.S. Patent and Trademark Office has recently granted the electronics giant a patent to trademark the design and layout of its retail outlets. They were specific when they mentioned even the storefront and the façade. Also, the stools and the positioning of the video screens were taken into account. Apple applied for the patent in May 2010 but managed to only get it on January 22, 2013.

This could be due to the fake Apple store that was spotted in Kunming, China by an American who resided in the city which got a lot of media attention thanks to a published blog post by the same person. It was said to look very authentic and managed to fool even the employees of the store who thought they were indeed working for a real Apple store. Their shirts were the same color as the employees of Western branches, as well as toted lanyards that were the same design as the ones in other countries.  After the first store was found, Kunming authorities started a search for more copycat stores. They have found 22 counterfeit Apple stores in just one city in China. These shops have since been told to cease using the Apple logo because of laws in China that do not allow companies to have similarities in appearance with others without permission. It was unsure if the fake store was selling genuine Apple products from official distributors or from the grey market.

The design of the Apple store was an aspect that greatly interested the company’s former CEO, the late Steve Jobs. In the past, Apple was already granted a design patent for one of the characteristics in their stores: the floating glass staircases. This was in 2003 and Jobs was listed as an inventor on the patent. These days, this sort of trademark right over interior design is of great importance, dating back to 1992, when the U.S Supreme Court gave a chain of fast food Mexican restaurants to trademark its design and decorations. This trademark is called a trade dress, which is defined as:

“Trade dress is the design and appearance of a product together with the elements making up the overall image that serves to identify the product presented to the consumer. Yankee Candle Co., Inc. v. Bridgewater Candle Co., LLC, 259 F.3d 25, 38 (1st Cir. 2001).  In other words, trade dress is a product’s “look and feel.”  Trade dress may include features such as size, shape, color or color combinations, texture, graphics, or even particular sales techniques. Two Pesos, Inc. v. Taco Cabana, Inc., 505 U.S. 763, 765 n.1 (1992).” (Gough Shanahan Johnson Waterman)

For any company to succeed with their trade dress claim, it has to prove that customers have truly gotten confused and mistook a similar looking store for theirs, or vice versa. In this case, Apple has to show the court that their customers have confused a counterfeit store with one of their original establishments in terms of design. If you notice some companies share a few qualities, this is not exactly illegal. It is all a matter of how far another company can go with borrowing designs from another business without being accused of infringing.

Though Apple has managed to procure a trademark for their stores, it only applies to the United States. It seems to be only a matter of time before they get granted patents for stores outside of American territory.

1 – Thousands of bad plugins in the Community Repository

Not everybody can be an excellent developer, and not everybody writes software for fun. We have thousands of kids just out from their Computer Science University trying to get their tiny inexperienced hands on their choice of CMS (this mostly translated to the most profitable one). The thing is, they don’t really respect principles, standards, and plans. Solution:

Don’t let developers post new plugins or themes without testing them well. Have them fill out the forms:

• What are some features that don’t exist on other themes?
• What are some bugs in this release of the theme? (Moderators should review, and if the bug isn’t small enough to ignore, the developer should be banned, say a week from posting other content)
• What is so special about your plugin?

Developers should be forced to test and review their code (or better yet, have it tested and reviewed by a more experienced developer) and THEN be able to post.

2 – No Software Patterns Respected

A good content management system should respect a software pattern such as MVC. Unfortunately, WordPress has an unmanageable plugin system (add_action everywhere, are you serious?). OOP not so much, everything has a procedural feeling on it. It needs a complete re-design.  I really appreciated PyroCMS (based on CodeIgniter) everything was put in it’s place and structured.

Solution:

Either use a MVC implementation plugin from the community repository, or re-write the entire CMS.

3 – Badly structured Community Documentation

I can’t stress enough how much the community needs fresh, well-structured and put-in-place documentation. Everything is cluttered everywhere, and the community documentation writer’s need to stress unnecessary details simply pisses me off. They also have look like getting a kick out of pretending the readers are less intelligent than them. You can find something like:

“do_action() does an action”

Oh god! Thank you for telling me! I thought it just sat there, with a flier on his hand, wanting to take no action, until the world’s leaders solved global poverty and ecological problems!

When you are choosing for one, take these into account:

• Maintenance time & costs
• Resource consumption (which directly correlates to electrical consumption)
• Deployment and installation costs (You have to buy Windows for example)

The costs for Windows Server deployment (buying the CD, or the license) and installation (activation etc.) might have higher costs, but maintaining a Linux server may be much more costly when specific problems appear. But there’s no way a Windows Server will match the performance of a Linux server. FreeBSD tops these two guys even more with it’s TCP/IP implementation that reduces workload on the Ethernet/WiFi card. But they all have their problems in some parts, and are pretty powerful in some areas. Today’s goal is to lay both the qualities and bad parts out so you can choose the one that gives you the most pro’s.

Windows Server

Operating System produced by Microsoft For Servers. It’s considered a low quality implementation among the experts. Windows refusing to stick to an implementation that’s solid and modern at the same time, caused many problems for this OS.

Pro’s:

•  Easy installation and post installation set up
•  Easier to use than say, a Linux server or FreeBSD Server
•  Thousands of answers to problems online, tech support available world-wide

Con’s:

• Harder to debug for administrators
• Not Free
• Might cost more to maintain in a cluster

So the key areas here are that it’s easier to use and deploy. The problem is, it has many other problems. Not trying to be a fan boy here, but i would not choose it for a server that bases on performance.

Linux Server (LAMP,node.JS etc on Linux)

Linux Servers are the leading servers in the game. They make for the 80% or more of the market (check w3schools Server Statistics for more). My personal favorite, but not as fast as FreeBSD might be.

Pro’s:

• Extremely popular among the server, server administration and web development world
• Very Reliable
• Secure with the tens of security layers already in the kernel
• Free to modify, use and distribute

Cons’:

• You will need an expert if you don’t know much about it (There are tutorials for the learners though)
• Harder to deploy

FreeBSD Server

Fork of the 4.4BSD project, one of the most performant and securized Web Server operating systems.

Pro’s

• Extremely fast via the TCP/IP stack implemented (with TCP/IP originating on 4.4BSD, code still being used in Windows Systems)
• Thousands of forum posts – and users online ready to help you
• Well-secure

Con’s

• Harder than Linux to maintain
• Less stable than Linux systems – will need repairs from now to then

Overall, i’d opt for Linux. What would you opt for?
