RIGHT TO PARK IS NOT AN EASEMENTARY RIGHT The Delhi High Court on Friday, September 18, 2015 in Surabhi Gehlot Vs. Swarn Kanta Punj held that the right to park is not an easementary right. Such a right, in the absence of any inclusion as part of the terms of the lease cannot be read into the lease as an implied term of the tenancy. A bench comprising of Justice S. Ravindra Bhat and Justice Deepa Sharma observed that a tenant is entitled to only such rights that would be reasonably necessary for the enjoyment of the tenancy.

Right to Easement of Parking

A previous judgment of Delhi High Court in Shri Akesh Kumar Jain v. Shri Harmeet Singh Bakshi 2001(59) DRJ 734 also held to the same effect that the tenant would be entitled to only such rights that would be reasonably necessary for the enjoyment of the tenancy.

“The question is whether the requirement of parking a car in the drive way be considered as an implied term or a right of enjoyment of the tenancy? In our view the answer to the same is in the negative.”

The plaintiff urges her right to easement of parking by virtue of Section 15 of the Easements Act. Section 15 of the Act states as follows:

“15. Acquisition by prescription:- Where the access and use of light or air and for any building have been peaceably enjoyed therewith, as an easement, without interruption, and for twenty years, And where support from one person’s land or things affixed thereto, has been peaceably received by another person’s land subjected to artificial pressure, or by things affixed thereto, as an easement, without interruption, and for twenty years, And where a right of way or any other easement has been peaceably and openly enjoyed by any person claiming title thereto, as an easement and as of right, without interruption, and for twenty years, The right to such access and use of light or air, support, or other easement, shall be absolute.

Each of the said periods of twenty years shall be taken to be a period ending within two years next before the institution of the suit wherein the claim to which such period relates is contested.”
Allowing the appeal filed by the defendants the High Court held that while the plaintiff has a right to access the premises, there is no easementary right to park her car in the demised premises. The right to easement of parking, if such a right were to exist, asserted as acquired by prescription in the present case, is a particular form of easement.

In other words, it is a specific extent of a right of easement. Before the Court can answer whether there is such a specific right of easement of parking over the demised premises, the Court must first answer the more fundamental question, i.e. whether in the present circumstances, any right of easement can arise in the first instance. In other words, the right of an easement of parking presupposes that the core essentials for a valid easement have already been met and satisfied.

Contentions of Parties

The plaintiff alleged that the defendants put up an iron gate at the opening of the passage leading to the demised premises, thereby obstructing her passage to the premises by car and parking the same in the open space adjacent to the demised premises. The defendant/appellants argued that the plaintiff had in no way been denied access or impeded in her approach to the demised premises; only that she cannot access the premises by car and/or park her car in the open space.

The primary contention of the plaintiff in this regard is that her right to park is a right of easement by prescription by virtue of Section 15 of the Indian Easements Act, 1882. To this effect she filed an application, seeking an interim injunction that would have the same effect, i.e. restrain the defendants from interfering with her right to park in front of the demised premises.

Mr. Sudhir Nandrajog, learned Counsel for the defendant, contends that the plaint is liable to be rejected on two grounds; namely, Order VII Rule 11 (a) -i.e that it does not disclose a cause of action; and secondly Order VII Rule 11 (d), i.e that it is barred by law, specifically, the Indian Easements Act.

He argues that it is not the plaintiff’s case that a right to park in the open space was a part of the tenancy, but merely that this right had accrued to her absolutely by virtue of the Indian Easements Act. As a result of this singular ground of claim, he argues that the plaint must be rejected as it is a settled position of law that the right of parking cannot be termed an easementary right.

Further, learned counsel argues that the learned Single Judge erroneously allowed the respondent to lead evidence to project that the right to park was a part of the terms of the lease.

The defendant argued that since it is a matter of well settled law that a right to parking is a valuable right, and not an easementary right, the plaintiff’s insistence on claiming it as an easement, makes the plaint liable to be rejected on the ground that there exists no cause of action.

It was further argued that the suit averments nowhere set up a claim of exclusive use of the right to park; rather the plaintiff’s complaint is that the use permitted by the defendant’s predecessor-in-interest has resulted in an obligation to continue granting such permission.

It was also argued that there is no term in the lease document which entitles the lessee to claim use of the kind sought in the suit. Impugning the order granting the interim injunction, the defendants argued that (1) no right of easement can be asserted by a tenant against his own landlord, (2) that a right of access to the said premises can in no way be construed as a right to an easement of parking over the same (3) that the plea of accretion can also not be pressed against the landlord for the simple reason that the plea is with regard to land that already belongs to the appellants.

The claim for any term entitling the plaintiff to use any land for parking may not be part of a written lease between a landlord and tenant and the absence of a written document of lease placed on record by the plaintiff she can still prove it during evidence when the trial begins that the terms of lease included the right to park the car also at the open space outside her tenanted premises which also formed part of the tenanted premises.

When my parents came to Mumbai they became tenant first in Borivali, then in santacruz West and then in Bulsuroys colony Santacruz East. Finally they came in present buildings in around 1950 and my family lives here since then. Each time they found a more suitable place they handed over the earlier place to landlords. They always remained obliged and indebted to landlords who provided shelter to the migrants without any shade over head. No relative or friend was willing to keep them or provide any shelter for more then few days but the shelter providers the landlords. In the meanwhile my father also got allotment of a tenement in Unnat nagar ,Goregaon.My MAHADA grandfather had by then started his shop in Santacruz east in Saburi building ( then known as Dias building). He refused to shift. My father was offered on (black) money for illegally selling that quarter in Unnat nagar built by MAHADA. But he said what about hundreds of applicants waiting in queue for a roof over head. And as his principle was he surrendered the accommodation back to Maharashtra Housing board. And even renting out option since was illegal he did not encash same. In 1978 the landlord of Devi Asha building ( now known as Tholiya Bhavan ) wanted to get rid off the building as was a big headache as being a absentee landlord was not able to protect same and tenants started encroaching, carrying out illegal changes, some stopped paying rent and some filed cases for repairs ( which was not affordable as two and half decade before rents were frozen and so on. Poor fellow got tired and decided to sell. At that time we were the biggest tenant having more rooms in tenancy decided to purchase same from landlords as were aware that if v do not buy then new buyer if wants to remove us then v will be in soup. Better v buy. Since 1978 till today v maintain the building though v receive old rent which is as low as rs 30/- per month. The tenant Purohit having more than 5 cars and crores of rupees assets and keeping room unused and locked did not vacate. I filed my first suit of eviction against any tenant and that was on Purohit in 2004 which is now in high court appealing against decree.Shamelessly sticking to this one room not of use to him as he has migrated to Jaipur. Appeal court gave mesne profit as only Rs 1000/- for a room with attached kitchen and toilet and bathroom. It will be too long to give facts how his father was ruined while trying to make a film Subah ki manzil and my parents took care of him and his family. But this purohit for his bad habits and greed and lust joined hands with our sworn enemy , a drunkard, ever using filthy language, accusing and alleging worst ( finally I filed a defamation suit) . This purohits claimed in court that his daughters r now using the room. But actually were coming here for showing claim on room and had taken a flat on leave and licence @ 28600/- per month in near by locality. I can prove this fact.While still paying Rs 1000/- in court for a my room. Then they started parking a car in compound without permission and without paying a penny . I can narrate many more doings of some tenants. And there were many good tenants too. And only we still enjoy good relations and exchange of cordiality ( like going to each other on all sukh dukh occasions. These good tenants Shri R N Goyal, Shri N M Thakar , Smt Amrit Arora and their family have full contacts with us but none with mischievous tenants like Purohit and others. But it is important to tell here that all these three tenants left voluntarily our building but I had to pay the fair market price to them . As I hv told I can go on as it is a history of 6 to 7 decades and 2 buildings and multiple families but for want of time will give u one more instance. My father was a practising Cost accountant and in 1965 or so he started his practice from the office of Shri Shyam sunder ji Dharnidharka. He used this place as his office ( Tholiya and associates , Cost accountants, Room no. 76, Bombay Mutual Building, P M Rd., Fort , Mumbai 40001). He had there his shops and establishments, phones and all other proofs like bank account and so on of over 45 years. He ( my beloved father ) expired in 2011 and he had used this office genuinely full time for decades. But I vacated this office on 14 th day post his death ( after terevan) where as I had hundreds of proof to stick to that office as even world thought that this was my dad's office. But my heart and concious said it was great affection and love and relations with which great Dharnidharka family gave us their prestigious place in FORT / FOUNtAIN and in return I can't give them hell ( by making them run to police and court) and trying to misuse the present system. So I am grateful to all those who have done good to me and my family but I am specially thankful to my shelter providers ( called landlords) for giving my family a decent living space a and space to earn living or else my parents too would have been living in shanties and would have been earning by doing some business on roads and footpath. You will find that due to this draconian non visionary rent act thousands of advocates,doctors etc a sophisticated professionals besides millions of others doing their works from huts and shades illegally built as rental housing industry has been killed. The media and few few devilish tenants and landlords have given such bad picture of landlords that one forgets that first decent shade over their head in city like Mumbai was given to them by none other then landlords. Atleast I will remain indebted to our landlords the Dias family a very gentle and pious goan christians , the Brigadier General Umrao singh and Shri Dharnidharka family. May god bless these landlords and teach lesson to treacherous ones. As I am not a biased person I feel for and support all poor and incapable tenants but call upon rich and mighty tenants to have fair and honest look at your past and pay back to landlords who ensured that your parents are not sleeping on platforms and footpaths but in a room built with hard earned money of family of landlords.

As you all know that Honourable Chief Minister have decided to withdraw 'Un reasonable' Draft of Rent Act page from Housing Policy.

FRTWA along with Action Committee for Protection of Tenants Rights have decided to felicitate all party Leaders and Mumbai President of BJP Shri Ashish Shelar and his team for their efforts to draw CM's Attention of such unduly Landlord developer favourable draft where unreasonable power given to landlord to charge Rent at market Price in spite of several times 'Pagree' taken at market rate in last more then 50 years.
Good news is that CM and Housing Minister decided to withdraw the draft due to large protest of tenants started from Colaba.

I am openly inviting all of u the Tenants cause Messiah to visit my both building and judge for yourself : R there rich tenants and yet not paying Rent of Rs 125/- pm for 5 rooms. 2. Trespassers raping property but paying nothing and running commercial activities. 3. Illegally parking cars inside for free. 4. Be honest???? same tenants pay Rs 500/- for TV cable, new rate of petrol, vegetables, milk and so on. My tenant paid lacs of Rs for admission of daughters in management collage, gave them car ( he has several cars in Jaipur) but his advocate D C Mehta said in a appeal court that his client is a poor person and can't pay high mesne profit so same be fixed at Rs 500/- pm.. And court in his pocket passed an order of mesne profit to be Rs 1000/- . That too he did not deposit in time to delay the matter and asked for condoning delay in depositing rent in court. Where as it is in the court records admitted fact that he travels several time to US and other countries as he is a very big gems and jewellery exporter. And your Viren Shah and others are protecting such tenants. Find the fees of Ad Amin Nathani. And my tenant has hired him for last 24 years who specially comes from princess street to Bandra court for her. And she claims mercy on age and financial capacity. She is my tenant, she is a tenants of one Jariwala bungalow and of huge estate of Wadia trust. Still I hv no issues on that. But same lady has claimed exclusive right to terrace and without any supporting documents got injunction against me and now case is not even moved an inch. She can spend lacs on advocate but can not on maintaining the property and all her tenanted property are in falling condition. I am writing with names so let anyone file contempt, defamation if I am wrong.

Alok Tholiya Bhaskar ji all landlords are not bad and all tenants are not good. Nither all landlords are rich and nor all tenants are poor. I had to sell plot of land in Kandivali to sustain but not asked a penny more from tenants but they don't even pay water they drink. Millionaire Purohit has not paid for water. My three tenants and one trespasser have taken market rate as compensation ( in lacs) for surrendering their tenanted rooms. They wanted to go as they had bought either huge apartments or had shifted and these rooms were of no use to them. They took money in return while they had not paid any pugree. So pugree is a crime but taking pugree for vacating out of your own need is a obligation to landlord? Double standard........shame....

Alok Tholiya I Had an impression that our CM is a man of principles and ethics.But he is a gira hua unethical and sold out for votes soul. Even I do not expect good tenants to be removed or charged at market rate. But he did not hv courage to ask the tenants reps to even ask is it ethical to pay Rs 30/- pm for a room? He could hv asked what can be reasonable acceptable ??? Can't tenants pay atleast something more ??????? And those who move in posh cars and hv huge bank balance and multiple business interests. By seeing voters in large nos. he has loosened his pent as for money ......who does????? cant he call for joint meetings??? Cat he call for fair assessment. The proposed amendment was little too harsh but a midway was possible but is possible for a statesman and not for cowardly cheap vote seekers.

NAGPUR: Coming to rescue of a Bhaldarpura land lady who was allegedly harassed by her tenant not paying the rent arrears, Nagpur bench of Bombay high court has ruled that the tenant was liable to hand over the property if he failed to deposit the admitted rent as per Section 15 of the Maharashtra Rent Control Act, 1999. The petition came up for hearing before the single-judge bench of Justice Vasanti Naik.

Petitioner Fehmeeda Begum issued a notice under Section 15 of the Maharashtra Rent Control Act to Abdul Hafiz seeking the arrears of rent from November 1, 2002, to October 31, 2005. She demanded arrears at Rs 450 month, but Hafiz failed to respond. She then filed a civil suit in the trial court seeking arrears as well as possession of rented property. Though the court asked the tenant to pay the arrears, it rejected her claim for possession of property.

Hafiz then moved the first appellate court challenging this judgment and Fehmeeda filed a cross appeal. However, the appellate court ruled in tenant's favour on March 22 last year holding that notice issued by landlady as per Section 15 of the Act was bad in law as she had sought the arrears at Rs 450 per month when the agreed amount was Rs 200.

She then knocked high court doors contending that even the admitted rent was not paid by the tenant within 90 days from the receipt of notice as per Act or from date of receiving suit summons. She argued that the respondent had an option to even pay the arrears of admitted rent of Rs 200 per month but he failed to do so.

The respondent demanded dismissal of petition stating that notice under Section 15 was not issued according to law and the case seeking recovery of property's possession on the ground of non-payment of rent was not maintainable on the basis of such a notice. The issue before the court was to determine whether the notice under Section 15, demanding higher rent than agreed between both parties was bad in law or whether the notice would be valid and the tenant would be required to pay the rent arrears within 90 days from the receipt of the notice or the suit summons.

After hearing arguments from both sides and perusing different judgments of similar cases, Justice Naik observed that the appellate court was not justified in reversing the decree passed by the trial court in favour of the landlady.

LAWYERS are such that they incite you to file multiple and even often false serious cases on other party. With the result small misunderstandings become huge disputes dragging in courts for decades. With the result NEITHER tenants nor landlords are happy and none are harmony able to enjoy their owned or rented property. And advocates become millionaires.

We must create a board for TENANTS and landlords for ensuring peace and harmony between landlords and tenants. .......But who frams law in India ? Advocates or BUREAUCRATS and both are having vested interests and they want confusing non clear laws ............May curse fall on all those responsible for INHUMAN conditions of litigants. ...........No one tells you this except Alok.......for the first time in india Alok tholiya demands formation of board in the lines of canada and other countries not in the hands of criminals. .......Alok Tholiya

ABOUT THE BOARD AND THE RESIDENTIAL TENANCIES ACT

What does the Landlord and Tenant Board do?

The Landlord and Tenant Board (the Board administers the Residential Tenancies Act, 2006 (the Act). This law sets out the rights and responsibilities of landlords and tenant who rent residential properties.

One of the Board’s responsibilities is to provide information about the Act to landlords and tenants. In many cases, once landlords and tenants are aware of their rights and obligations they can resolve their own problems. However, if a landlord and tenant cannot resolve their problems, then another responsibility of the Board is to resolve these problems for them.

Landlords and tenants can file an application with the Board. Once an application is filed, the parties have an opportunity to have their problems addressed at a hearing. At the hearing, a Member of the Board will make a decision on the application based on the evidence presented by the landlord and tenant. Or, if both the landlord and tenant agree, a Mediator from the Board can work with them and try to help them reach their own agreement.

Who is covered by the Residential Tenancies Act, 2006 (the Act)?

The Residential Tenancies Act, 2006 covers most residential rental units in Ontario including mobile homes, care homes and rooming and boarding houses. However, there are some situations where a rental unit may not be covered by the Act or certain parts of the Act.

For example, the Act does not apply if:

the tenant must share a kitchen or bathroom with the owner, or certain family members of the owner;
the unit is used on a seasonal or temporary basis.

Many of the rules about rent do not apply to:

new rental buildings;
non-profit and public housing;
university and college residences.

But these units are still covered by most of the other rules in the Act, such as maintenance and the reasons for eviction.

The Act does not cover commercial tenancies.

Not easy to nail any scoundrel in India.My nuisance tenant Madhukar Purohit was an absentee tenant. ( Non user). But he had gas cylinder and once in awhile in a year or two he was getting refill. I visited the dealer and found that he was using benami connection with the collusion of a HP gas dealer. The name used was of some mehta. I wrote to HP gas and officers of HP gas that there is no Mehta in my building then how gas is delivered in that name in the room of Purohit. They did not act. I followed up and finally they investigated and canceled the connection but did not take any action on Purohit for using benami/ fictitious name gas connection. But surprisingly after a year or so when Purohit came from jaipur he did something so that the same HP dealer started ny delivering gas to Purohit in the name of Mehta. I followed up with RTI and other letters. They evaded. Life has too many other issues so I gave up my chase. So in corrupt system be it a gas co. you can never get justice. I hv a full correspondence file if some one wants to take up this further. So nailing anyone in India is not easy. You may get some success only If RTI is amended and CIC and SIC are forced to pass order with in a month and are compulsorily made to fine PIO then only you can get justice. But SIC in Maharashtra does not order for years and if orders then does not penalise PIO inspite of his purposely ignoring RTI act.

I am willing to participate any debate or TV show or discussion to explain that how sixty years landlords have been made to suffer and tenants , politicians never considered any relief to them as they are in minority and tenant are having more voting strength.

Firstly this proposed law protects small tenants. Even bigger tenants pay only small percentage of their declared income. So creamy layered tenants are not 5 lacs. And come and see facts of my two buildings where tenants do not pay rent as meager as Rs 40/- pm but give to dish antenna connection 500/- pm. There is a tenant Purohit with palatial bungalow in Jaipur, flies to US several times a year for gems and jewellery export business but to court he says he is poor and can't afford more than Rs 500/- per month as a mesne profit. This poor Purohit hired one of the costliest advocate D C Mehta. who wields lot of influence, Chadha has car worth Rs 10 lacs. Investment in shares for over few crores and claims he gets dividends more than Rs 10 lac a year. But does not pay rent for legally occupient 4 rooms for Rs 120/- pm and illegally erecting car shed , illegally covering common passage and so on. Mrs Bina Chowdhury filed a case in the year 1990 claiming that terrace too is tenanted to her. If she shows one single document which supports her claim then I will make her tenant of terrace too. But her influential advocate obtained injunction against me for terrace. Her advocate has ensured that case does not move an inch in 24 years and I am made to run to court for 24 years. She pays rs 138/- pm but occupies legally about six hundred square feet but claims she is tenant of entire floor consisting of common toilets and passage and terrace and space below staircase. She is also tenant of Wadia estate for over 15000 sq feet property and also tenant of another person for entire bungalow known as Jariwala building. She has huge investments but court is swayed by her old age, presentation and her advocate. Trespassers

Sandeep Jain I am fully with you in this matter.Please write a nice mail to the prime minister and the law minister asking them to change the laws. Even a slum dweller must be paying more than 500 to 1000 rs. per month. As I told you earlier sit on a dharna in front of the chief judge's office. Bring some media. Try to approach media houses like NDTv, Times now etc. We are not Salman Khan sir. We have to slog it out to get justice. That's the sorry state of our county today.

Jitendra Gupta I fully agree with ur point of view as a landlord, but remember, all these years property outgoings such as collector property tax, Khod lease rent, Municipality property tax r also freeze, for decades on all tenanted properties, and where recently some increase in municipal property tax has taken place for tenanted properties, landlord have increased the rend accordingly. Any relief if at all landlord receives if rent control act is released, immediate effect will be in increase out goings in way of increase property taxes by different departments. so finally landlord may end up at square one.I am sure u must be paying just in two figures as annual rent to collector for ur property and just three figure to Khod and municipality.

Alok Tholiya Dear Sandeep , a hawker near Santacruz East station pays rs 12500/- as monthly hafta /bribe to police and BMC for sitting on road in heat and dust and rain. In dirtiest slums rent for residential one small room with municipal common toilet ( hell) , noise of all kinds, stinking environment, q for water, hot like oven as shades r of cement or MS sheets and so on is Rs 5000/- . But rent in my best quality best maintained RCC building with garden, terrace, 24 hrs water , electricity and so on is Rs 40/- p.m. and that too 50% of tenants / trespassers do not pay. If u came and want to check all what I have stated then pl. visit me.

Alok Tholiya Dear Jitendra , Pl. note that never ever any taxes , water charges, electricity charges, gas charges, salary of sweeper, lift man, gardener, watchman were frozen. Cement and reti became 100 times more costly and rents were frozen in 50s for 2 years and r still same due to vote bank. All this made landlords living on rental income were made poor and hapless. No one could maintain buildings and buildings are falling. Rent has not increased but property tax has increased 200% to 300% . Same is recoverable from tenants but tenants do not pay that and going to court is further unviable. Besides there r several hurdles in recovering as calculation and area of tenant mentioned by BMC staff is disputable.

Alok Tholiya I paid bribe / bakshis to BMC staff for releasing wood for burning my father's dead body at crematorium. I paid speed money for death certificate. I paid huge fees to advocate for probating will and he in turn paid bribe to high court staff for speeding same. For name change of deceased city survey office asking for bribe of Rs 5 lacs. BMC staff for name change on shops and establishment, licences etc asking for 5000/- . as bribe. But as a landlord I have never asked single penny from dependants of tenant for name change . Come and verify same as same is illegal and immoral too.Use of I stand here for general public.

Alok Tholiya I pay parking charges everywhere I go. When tenants took premises they never had a vehicle and purchased years/ decades after. They immorally as they are who want everything from landlord for free ka, haram ka and so on park their vehicle forcibly inside. Polite request does not work. Fighting is unfortunately not taught by my parents ( learn about my parents from their samaj, neighbours, and groups they were associated) police refuses to take action as is a civil matter , and if u fight ( which I will not) then there is one landlord and several tenants and trespassers so physically they r powerful, I do not use abuses / bad words and a punjabi tenants uses it as a free flow ganga before all men women and children and so on. Advocate charged me consultation fees of Rs 5000/- which is double then my annual rental income and advised to keep watchman for 24 hours which will cost me rs 12000/- X 12 months which will take away in a year my rental income of life time or said that we will file a case but I will get justice after 30 years or in my next life. These are hard facts.

My take with my own story: I am willing to participate any debate or TV show or discussion to explain that how sixty years landlords have been made to suffer and tenants , politicians never considered any relief to them as they are in minority and tenant are having more voting strength.

Times of India is a bullshit paper. Does not study the facts, does not study the proposed laws, and gives biased. It seems TOI owners ( sick jains) themselves and few reporters are themselves tenants. Firstly this proposed law protects small tenants. Even bigger tenants pay only small percentage of their declared income. So creamy layered tenants are not 5 lacs. And come and see facts of my two buildings where tenants do not pay rent as meager as Rs 40/- pm but give to dish antenna connection 500/- pm. There is a tenant Purohit with palatial bungalow in Jaipur, flies to US several times a year for gems and jewellery export business but to court he says he is poor and cant afford more then Rs 500/- per month as a mesne profit. This poor Purohit hired one of the costliest advocate D C Mehta. who wields lot of influence, Chadha has car worth Rs 10 lacs. Investment in shares for over few crores and claims he gets dividends more then Rs 10 lac a year. But does not pay rent for legally occupient 4 rooms for Rs 120/- pm and illegally erecting car shed , illegally covering common passage and so on. Mrs Bina Chowdhury filed a case in the year 1990 claiming that terrace too is tenanted to her. If she shows one single document which supports her claim then I will make her tenant of terrace too. But her influential advocate obtained injunction against me for terrace. Her advocate has ensured that case does not move an inch in 24 years and I am made to run to court for 24 years. She pays rs 138/- pm but occupies legally about six hundred square feet but claims she is tenant of entire floor consisting of common toilets and passage and terrace and space below staircase. She is also tenant of Wadia estate for over 15000 sq feet property and also tenant of another person for entire bungalow known as Jariwala building. She has huge investments but court is swayed by her old age, presentation and her advocate. Trespassers Ranjit hotel and Dhobi pay nothing but run commercial activity for years. TOI has given biased sensational reporting. Some one must find out what is their vested interest? Incidentally TOI owners are too Jains as I am. But they have breached tenets and teaching of Jainism by lying in news reporting. I am using all names and places and anyone is welcome to check what I am saying and if wrong then can file defamation suit on me.rather hang me if I am lying as that will be better then dying suffering as a shelter provider ( called as landlord) , suffering in court for decades and having to live with such tenants who do defamation of worst kind ( finally I have filed with all evidence defamation suit in Dindoshi court against chadha but case lingers on) , encroaching tenants, non paying tenants, a.......and so on..Alok Tholiya , 9324225699,atholiya@gmail.com

Election officers everywhere are corrupt and take bribe and include names at multiple places so these fraudly registered show claim on properties. One Madhukar Purohit a millionaire gems and jewellery exporter in Jaipur wanted to show a claim in a room in my building. H was registered in Jaipur and Mumbai both places. He denied this in writing on oath to election officer who took bribe and continued his name in Kherwadi assembly constituency, Santacruz East , Mumbai. I produced finally certified election roll of Jaipur where this Madhukar Purohits name was there. Finally they had to delete his name but inspite of follow ups no action was taken on him as he could bribe them easily. Finally I made query thru RTI to collector ( suburbs ) as to what happened to my complaint. Nither PIO nor Appellate officer replied. And Shri Gaikwad SIC did not punish them and just asked them to give me copies of all records with them. They again did not do anything and shall I spend my whole life running about chasing rich culprits and conniving govt officials? If anyone wants to check complete file then he's welcome to my office. So voters list are inflated for various purposes by bribing.

Yesterday we went for PUC ( Pollution under control testing) of my car. The person sitting in mobile van did not even get down, did not connect testing machine and gave the certificate.

RTO authority gives PUC testing permit for a huge bribe or most of the agents are from RTO officers family.

The PUC was Rs 30 or less when introduced but today it is Rs 100/- per car. They earn over a 1 lac to 1.5 lac per month easily.

So any scheme started to improve quality of life, save nature, protect children, women, old, sick, poor and so on only becomes tool for bureaucrats to make money. And yet fools demand for more stringent laws and heavier fine. Which only means that you empower satan to loot you more and make you their slave.

The taxi, auto unions too bribe in lacs to get their fare revised upward drastically. For car parking allotment, towing van permit , toll collecting agency the bribe is in lacs. And u find that toll, parking charges, towing charges etc keep going up unreasonably and the bribe too keeps going up for getting these permit/ agency.

On the other hand since bureaucrats, judiciary, politicians can not make any money from landlords of old building so they do not allow increase of rent. So even today landlords of old buildings get Rs 30/- per room per month and one of my tenant says I drink liquor worth rs 15000/- per month. But he still does not pay rs 120 for 4 rooms as he know to recover that thru court I will have to pay lacs to advocate fees and will have to suffer in courts for decades.

while there is a board to allow revision of power tariff, for metro fare and so on but there is no such board for revising rent as reliance can bribe but landlords can not.

Govt staff can demand appointment of pay commission for increase in wages for can go on strike, even doctors can go on strike and let the patients die but landlords have no such ways and means.

If u do not pay for credit card, telephone, power, water etc then ur services are instantly blocked. If u do not pay for school fees, hospital bills etc then u r thrown out but landlord can not do any thing like that even if you do illegal activities, misuse, harass, do nuisance, do not pay as only remedy to you is go thru a court which your 3 generations will have to visit and even then there is no guarantee that you will get justice.

There is a heavy leakage on my shutter and entrance of office from the toilet of a tenant purohit. In spite of repeated request to Mahima purohit nothing has been done so far. My shutter is rusting. Plaster of Walls are deteriorating and painting is spoilt. Worst is my visitors clothes get spoilt and dirty water falls on them. How to solve this problem where a monied tenant who can bribe one and all and mischievously harasses landlord on purpose ? You can also see our costly wall paper getting damage due to seepage from the toilet walls of this Purohit. And my father and mother did thousands of favour this family specially on Nandkishore Purohit. But they are repay like this all favors. God alone can teach them a lesson.

THANE: A consumer forum in Thane has ordered a flat owner to pay Rs2 lakh to a resident on a floor below as cost of repairs for leakages.
The complainant, Nandakumar Rege, CEO of Thane District Housing Co-operative Federation, said his flat on the ground floor of a society in Vishnunagar in Thane had leakages owing to a defect in the flat above his belonging to one Milind Masurkar.
He said he had asked Masurkar to carry out repairs and plug the leakages, but the latter did not respond. Hence, he informed Masurkar that he would carry out the repairs and that he (Masurkar) should reimburse the cost, to which the latter did not respond.

Rege, in his complaint filed before the forum in 2010, demanded Rs1,23,000 as cost of repairs carried out in 2009, Rs1,26,000 as compensation, Rs2 lakh for physical suffering, and Rs5,000 towards legal expenses from Masurkar.
Masurkar dismissed all allegations. Thane District Consumer Redressal Forum president Umesh Jhawalikar and member ND Kadam, decided the case after hearing both sides.

How to handle negligent neighbour who do not stop leakage from their flats...

Frequently I hear from my friends that there flat has a water leaking from above floor and repeated request to the neighbour above has yielded no response. Even in some cases ugly fight has taken place but they cud not find remedy. In my building my tenants have neglected to maintain, done some illegal work and thus my rooms have leakage problem spoiling my interiors, paints etc and beside weakening of building. But I too had not read this remedy as given out in magazine " MSWA 's Housing Society review" in sep 2014 issue.

I thank Maharashtra Society Welfare Association for their good advise.
I wish if my Property owners Association had given similar advise then long back I cud have neatly handled the issue of leakage due to callousness of tenants and saved my property from damage.

Alok Tholiya I had reported to Kherwadi election office that Madhukar Purohit has enrolled his name in Jaipur as well as in Mumbai in my building. But they did not act. He gave false affidavit that his name is not there anywhere in India except in Kherwadi Mumbai. Then I obtained RTI info from jaipur election dept and asked Mumbai sub. Collector to take action against Madhukar Purohit but he evaded after taking bribe. I asked certain info from Kherwadi election office on this which they did not. They did not reply to my RTI. Finally matter went to Shri ratnakar Gaikwad but he did not take action and asked election dept to take action which they did not as they are all corrupt. They take bribe and include names of illegal migrants and also of those who r already enrolled in Rajasthan, UP, Bihar etc..

U r a granddaughter of tenant of Late N K Purohit who had abandoned the tenanted premises Room No. 2, Tholiya Bhavan on first floor. Sparingly this room was used by others in family or by guests. But during particular six month as submitted to small causes court in RAE suit no. 864 of 2004 this room was not at all used. We have won this case in trial court.

During pendency of case your mischievous father with a criminal intent Madhukar Purohit tried to create several evidences like reinstatement ration card, re-enrollment in election roll thru false affidavit, renewal of driving license, buying policy of LIC of India with several false claims and affirmations so on. All this with the eye on this small room??? And to further his greed and lust and for roping in additional evidence he moved you and Manavi to Mumbai to use this room.

Manavi is since married shifted to a leave and licensee flat in nearby locality.

Your family has and has had several cars and two wheeler in Jaipur but none in Mumbai. But in recent past you have taken benami car Santro MH01NA5284 which is being used by you alone and sometimes by your sisters who comes from her house all the way to pick and drop same.

You are hereby warned that do not illegally trespass in our building with any vehicle. You are neither allowed to bring in any car or vehicle inside the building nor allowed to park the same inside.

In case in spite of this notice given prohibiting u to park your car, you forcefully park your vehicle illegally in our compound then we will be compelled to put your car on the road using towing / outside services which will be at your risks and cost which you please note.

If this act of criminal breach and trespass is not stopped then I shall be forced to take legal action as advised by my advocates and same will be at your risk and cost.

Bombay high court order brings respite to tenants of shaky buildings

n what will build confidence among tenants/occupants of shaky buildings who refuse to leave their homes due to fear of losing them permanently, the Bombay high court has ordered Brihanmumbai Municipal Corporation (BMC) to take necessary steps to allay the apprehension.

The high court in a recent order asked the civic body not to issue commence certificate (CC) for redevelopment of the dilapidated structures in the absence of an agreement between landlords and tenants over providing permanent alternative accommodation to the latter.

The court gave the order as part of guidelines in connection with buildings which fall under C1 category (ones which need to be evacuated immediately in view of demolition) structures — both private and BMC-owned.

The order also applies to structures which have been served notice under section 354 of Mumbai Municipal Corporation (MMC) Act, 1888. The guideline was issued after the BMC approached the high court seeking directives in view of the difficulties faced by
it in implementation of notices served under the aforesaid section, given the absence
of specific provisions in the MMC Act for eviction of occupants from the dilapidated buildings.

According to the order, in case privately-owned dangerous buildings are demolished by the corporation in exercise of power under section 354 (read with the order passed), then the BMC shall, while granting sanction of redevelopment, impose a condition in intimation of disapproval (IOD) that no CC will be issued under section 45 of the MRTP Act, 1966 unless and until there is an agreement, either providing a permanent alternative accommodation in a newly-constructed building or a settlement is arrived at by and between the tenants/occupants and the landlord in respect of the said demolished premises is filed with the corporation.

"This guideline will help bring in transparency in the process of redevelopment of shaky structures. The court has also asked BMC to prepare a list of dangerous buildings and also measure the carpet area of their houses. This will help stop cheating of residents/occupants once the project is redeveloped," a senior civic official said.

As reported in dna earlier, the civic body has identified 543 C1 category structures in Mumbai ahead of the monsoon. The 'L' ward, which covers suburbs like Kurla, has the highest number of shaky structures, that is, 100. Some rickety buildings in the city include some of the known structures like Shakti Mills along E Moses Road and Campa Cola factory on BG Kher Marg in Worli.

The issue of rickety structures is of major concern to the BMC as 84 persons lost their lives in four major building crash incidents over the past one year.

A tenant pays rent of Rs. 40/- p.m. . Misuse common passages etc for storing his belongings. In the mid night he makes noise by throwing steel vessels ( for what he knows). He has kept surroundings very badly. There was a time when he would go up on terrace and piss in open. He does money lending business by keeping valuables of poor street hawkers etc who keep barging in on common passages on first floor residential areas affecting our safety.

Our mistake : My father gave him his own room without charging anything extra as he belonged to our own community from our hometown and was relative of a close well wisher.

I just got up and came out of my room this morning and Lo! he catches hold of me. He tells that the ceiling plaster has fallen and I must see that. He in the same breath adds that I must share atleast 50% of expense for repairs.

NOTE: I had personally appealed and then sent written request to all tenants to not to stop me on way and come to my office which is in same building for any discussion.

points to ponder:

1.I have been alone paying building taxes which are in thousands.
2. I am alone paying for common electricity bills, maintenance etc..
3. I am alone spending on maintaining common areas, terrace, and several amenities and have spent in lacs if last few years.
4. The shameless tenants pay only Rs 40/- p.m. but use much more the room, common toilets and parking illegally. Tenant Chadha does not even pay rent and has illegally settled a trespasser in building.
5. All hungry government staff specially BMC keep coming on some pretext and seek alms.
6. Even a child knows that building constructed in 1947 will now need major repairs and regularly.
7. They know landlord the shelter provider has no income to carry out any repairs atleast major and in their own rooms. Though I have been doing some urgent repairs of common areas as I know they will rape the building but will not contribute to maintain same.

Options:
1. Tenants have options of keeping good relations with landlord so their is team spirit but unfortunately all good tenants have left the building ( of course after taking market rate compensation) .
2. Tenants have option of persuading and cooperating with landlord for going for redevelopment but instead they do arm twisting by asking 3 times the area in return for giving cooperation. Why should a land lord succum to their blackmailing specially who are giving all sorts of abuses and troubles to landlord?
3. This tenant has always been on the side of most mischievous tenant and now seeks 50% share to repair his house which he used for 60 years by paying only Rs 40/- p.m..

Rent act laws r reasonable and just but judiciary is sick and delaying so approaching courts is like calling for more trouble and letting advocates etc loot you without giving any thing in return.

What are the rights of statutory tenant, lessee and licensee?

Letting out premises is a sensitive issue. Both landlords and tenants turn hawkish in any discussion on this. The battle of owners versus occupiers would turn less hostile if each understood their limits, claiming only that which is rightfully theirs. There can be roughly three kinds of occupation – statutory tenant, lessee and licensee. Described below are the rights of each of them.
1. Statutory Tenant: A tenant is a protected species under the Maharashtra Rent Control Act, 1999 and is often aptly referred to as a statutory tenant. He can be evicted only on the limited grounds mentioned in the said Act. The most common ground being “the premises are reasonably and bona fide required by the landlord for occupation by himself or by any person for whose benefit the premises is held.” It is justifiable that ‘destruction of the premises by the tenant’ gives the landlord the right to seek repossession of his property and end the tenancy. Change of use, as well as/or non-use of the premises by the tenant for a continuous period of six months, is yet another ground for eviction under section 16 of the Rent Control Act.
A statutory tenant pays a nominal rent. Upon his death, any relative residing with him at the time of his demise steps into the former’s shoes by law. No testamentary bequest can be made by the tenant in respect of his tenancy rights nor can he transfer, mortgage, sub-let, give on license basis, or otherwise part with his tenancy rights. A tenancy is a creation of the statute and lives as well as falls as by the provisions thereof. Any transgression may cost a tenant dear.
2. Lessee: In the hierarchy of possessory rights, the position of the lessee is far superior. Here, the Transfer of Property Act comes into play. It is a transfer of a right to enjoy property by the lessor/owner in favour of the lessee, so much so that, unless there is a contract or a local usage to the contrary, a lessee can assign, sub-lease, mortgage, or part with his interest in the property. A lessee does not live under the fear that, on the grounds of bona fide requirements his lessor will have him evicted from the premises. He breathes freer air. It is not unusual to come across leases for a term of 100 years or even in perpetuity. There is precious little that an owner can do once he has leased out his property.
3. Licensee: A licensee finds a place for himself at the bottom of the pyramid. He has no interest whatsoever in the premises. As suggested by the term ‘license’, a licensee occupies premises at the pleasure of the licensor/owner.
In wonderful legalese, section 52 of the Indian Easement Act, 1882 defines ‘license’ as follows. “Where one person grants to another, or to a definite number of other persons, a right to do, or continue to do, in or upon the immovable property of the grantor, something which would, in the absence of such right, be unlawful, and such right does not amount to an easement or an interest in the property, the right is called a license”.
This wafer thin right is therefore regarded as the safest option by premises owners in Mumbai. And why not: if a licensee refuses to vacate residential premises, under the Rent Act, a fast track Competent Authority can decide on matters governing eviction and mesne profits. Mesne profits can be as much as twice the license fee fixed under the agreement.

Alok Tholiya One Madhukar Purohit had his names enrolled in jaipur and Mumbai. Against my complaint to Kherwadi Assembly Election officer for deletion of name Purohit on oath wrote to election officer that his name does not appear anywhere except in Kherwadi assembly constituency. I furnished all records to prove that his passport, his business licences, his bank accounts , his mobiles, his phones, his club memberships, all 5 vehicles are all registered at his Jaipur address where he owns a palatial bungalow. First they continued his name. Then I gave them as proof copy of election roll of Jaipur where his name was appearing FOR YEARS.So I finally made two requests to Kherwadi Election Officer that not only now his name be deleted but also necessary action be taken on him for lying before quasi judicial body as well as for enrolling with full knowledge names at two places. They deleted his name but did not take action on his extra legal acts. Then I wrote to higher ups but heard nothing from them so I filed RTI. PIO did not reply. Then First appeal officer did not bother. Then I went to SIC. He asked them to give all papers in file but did not ask them to take action. But worst is he did not take action on PIO. When I made repeat complaint then he directed Election Commissioner to take departmental action. 10 moths have passed but no action has been taken by Collector Western Suburbs , Mumbai who is supposed to act. So RTI has been weakened by two ways one SIC delaying orders and second not punishing erring PIO's.
