Jane was quoted in the Coaster by Ed SALVAS my old radio friend from the good old days at WJLK in Asbury Park Ms DeNoble says she’s still unpacking in her new home but once she expressed an interest in becoming involved in the beautification effort, her realtor, Brenda Connolly, suggested she call the Chamber of Commerce and that call to Executive Director Shirley Ayers opened the door to her new community. Connolly also happens to be president of the chamber and Ms DeNoble attended her first meeting of the chamber’s Main Street Beautification Committee and was immediately welcomed.

DeNoble said she was looking for a home along the shore and wasn’t too familiar with Bradley Beach but immediately liked what the town had to offer.

“I can walk to anything,” she says and can ride a bicycle to Main Street or to the beach, “And it’s not on a barrier island.”

As for her work with the Beautification Committee just walk down main street and you can tell where she and her small group have been.

Giamano’s Outdoor Music Series has received an outpouring of support from both business owners as well as borough residents over the last week.
The support was in response to some complaints the Borough Council received last week about the music. At last week’s meeting the council put off voting on approval for the series until more information was received.
At the time resident Jane DeNoble said that she loses “the quiet enjoyment” of her backyard every Sunday. due to the music series.
“To me Sunday is a day of rest,” she said.
“I never had any intention of disturbing anyone with our “Outdoor Music Series,” said Rhonda Manno, owner and operator of Giamano’s, who was unable to attend the council meeting on May 12 due to work. “My full intention was to bring a truly festive occasion for the summer to Bradley Beach, which would allow people to come out and have a good time.”
Manno said that since the council meeting, some residents and business owners have reached out to her, expressing their support of the “Outdoor Music Series.”
“I have always believed it was a great venue for bringing more people to our town, which of course, not only benefits our business, but all the businesses in town,” Manno said.
Since holding the outdoor event, Manno said she has never received one complaint regarding the music being too loud. In addition, she said that in the future she would have the musicians lower their amplifiers. Manno also said that Giamano’s always makes sure to end the music at 8:30 p.m.
Bradley Beach business owners also offered their support to Giamano’s for the music.
“I love to stop by and hear the music,” said Angela DelPonte of DelPonte’s Bakery on Main Street. “It brings more people to town, which benefits us all. All the businesses in town are getting more exposure and we hope people will then return more often.”
Liz McAllister of The Buttered Biscuit on Main Street also expressed her support.
“I totally support this music venue,” McAllister said. “It is a good draw to bring more people to the town and it ends at a reasonable time.”
Jennifer O’Leary, a resident who lives directly behind Giamano’s, also shared her support for the “Outdoor Music Series.” She said, “I have been enjoying this music every summer since it began. This has never been a problem for me since it ends early in the night.”
Since the meeting, Mayor Gary Engelstad has received messages from over 20 residents through various methods. At the May 12 council meeting, he volunteered to knock on the doors of residents to hear their point of view.
When asked for comment on the results he has had so far, Engelstad said he would “rather give those results to the council first so they can factor them into their decision” at the May 26 council meeting.
“The folks who live in proximity to Giamano’s have been gratified to be involved in the process,” Engelstad said.“The results will be a good cross-section of people within a two block radius.”

AGE: 74 • formerly of Bradley Beach Herman Lubinsky, Jr. passed away in his sleep in Pine Twp., near Pittsburgh, PA on the evening of Sunday, Dec. 28, 2014, after a 4 year battle with lung cancer, comforted by his loving wife, Ellen Blair-Lubinsky. Herman was 74 years old. Born in Newark, NJ on March 18, 1940, he was the 3rd child of 5 born to Adaline Brunner-Lubinsky and Herman Lubinsky, Sr. "Dink" as he was known spent his early years playing stoop bowl on the city streets of Newark and much of his youth in Bradley Beach, NJ hanging around the board walk and attending the Bradley Beach grammer school. He loved listening to early R & B, Doo Wop, and pop music from the 1940's, 50's and 60's and his favorite film and radio D.J., Alan Freed, who he visited many times at the Brooklyn Paramount, and the NY Paramount theatres. In his 20's while starting his own family, Herman worked at his father's retail record store, The Savoy located under the family's recording studios and record label. Savoy records which featured Jazz, and early Gospel greats such as Charlie Parker, James Cleveland, Dizzy Gillespie, the Clara Ward Singers, Little Esther, Billy Eckstine, Miles Davis and many more. Herman, Jr. also worked with his father at NJ's first radio station, which was located in the attic of the family's Newark home. WNJ aka the voice of Newark. Dink also owned and operated Springwood Electronics in Asbury Park, NJ, Grannies Attic a vintage furniture store and T.J. Specialties a boutique electronics and vacuum tube business, both located on Main Avenue in Bradley Beach, NJ. He retired to south florida in 1980. For the last 15 years, Herman advised his youngest son, Terry "TJ" Lubinsky, as a music consultant and executive in charge of talent relations for many TV and live concerts, Do Wop, (50) Rock Pop and 70 soul superstars and many other tv series, specials and cd compilation albums, featuring original recordings from the 1950's, 60's and 70's. A loving father to his children and grandchildren, Herman always championed the efforts and independence of his children. Entrepreneur, Ricky Allen Lubinsky, and homemaker Laurie Lubinsky-Meyer, David Herman Lubinsky and Terry James Lubinsky. David became a professional Jai-Alai player with the encouragement of his Dad, and Herman inspired Terry's broadcasting career. TJ recalls the determination (of his father) from an early age,"there is an exception to every rule", my dad used to say to me when I was about 6 years old, "and you are that exception." "Never accept No as a final answer for something you believe in." Later when we were making the t.v. shows, reuniting all the old groups, I was always amazed how every performer loved him and how they laughed together, he was loved by so many people that knew him. Remembered as funny and caring with a warm outgoing personality, some of Herman's favorite joys came from his family, lifelong friends and from enjoying Three Stooges shorts, James Bond films, attending all the music concerts, rooting and watching his beloved San Francisco Giants on T.V. Herman's greatest love was his wife Ellen Blair-Lubinsky whom he adored and cherished every day during their 57 years of marriage. Herman's memory as Pappy will always be adored and cherished by his children and grandchildren, with whom he shared a special connection with his 9 grandchildren and 2 great-grandchildren. Private memorial service will be held for Herman's family and friends on Sunday, Jan. 4. On Monday, Dec. 22, 2014, our blessed Lord decided he needed another angel, so he opened up the gates of heaven, and brought home our beloved Robert (Bobby) DeNardo Sr.

This kind, gentle, humble man who loved God and his family more than words can describe, fought through unimaginable battles and adversities, in which he demonstrated his relentless strength and will to live. We were all very blessed to have him 8 years longer, after defeating pancreatic cancer. Bob was a quiet man but had a humor that surprised many when they least expected it.

A dedicated police officer for over 32 years, Bob rose through the ranks obtaining the position of Chief of Police of the Bradley Beach Police department in 1992. He was also a member of the Bradley Beach Fire Department, among many other civil organizations.

Born on Feb. 24, 1953, he is survived by his loving family; His loving and adoring wife, Donna Siciliano DeNardo; his children, daughter, Abigail DeNardo-Taylor and husband Nick, son, Robert Jr. and wife Johanna, daughters, Erin, Courtney, Sara Miller, and son, Matthew Miller, his grandchildren, Brayden, Makena, and Kai Noa Taylor, and grandchildren, Sophia and Jake DeNardo; brothers, George DeNardo and wife Joann, Anthony DeNardo and wife Patricia, several nieces and nephews; his close friends, Jim, Walter, Bob and Louie; his former wife, Patricia Oliver and husband Paul, and finally his best friend and faithful companion, Duro.

A viewing will be held from 4 to 8 p.m. Friday, Dec. 26 at the Ely Funeral Home. Mass and memorial service will be held at 10 a.m. Saturday, Dec. 27 at Church of Ascension, 501 Brinley Ave., Bradley Beach. There were over two hundred people enjoying the beautiful summer evening in the famous park on Main Street in the summer gem of the jersey shore. Business's along the main street reported a great night with all the people from the show showing support.

Union Beach Fire Fighter Robert Meyer, who passed while fighting a fire on Sunday. Fire Fighter Meyer was awarded the Carnegie medal in 2004 for the saving the life of a man trapped in a burning building. Robert Meyer actions will not be forgotten. We honor his memory and pray for his family during this trying time! We are ALL in this together!

Firefighter Meyer was a two hatter he was a member of both Union Hose and Belford Engine Fire Company. Station 3 of Middletown, NJ

So why is this on the Bradley Beach Tatler Yes, it is sad that a firefighter died in the line of duty, but in the United States about every three days a firefighter dies So what makes this case special well first it is in Monmouth County he was a firefighter just up the road. But the members of United Engine and Truck company of The Bradley Beach, New Jersey fire department are the way. on Saturday June 14th a group reported to the fire station to do something special to report with many other departments to cover the stations of the affected fire departments so they could not worry about their duty to the public but could pay their respect to their lost brother.

Today members of the Bradley Beach Fire Dept are on a cover assignment to station 10 MTFD along with an engine company from Marlboro and an engine and truck company from Manalapan as stars.10 mourns the loss of brother Firefighter Robert "HAWK" Meyer. Today I was talking to a friend at the beach and as we talked about our home town we keep going back to a fact that was very upsetting to me. Could Bradley Beach be a cancer cluster? We were saying we could name over 100 people who died in Bradley Beach of Cancer and over 200 who lived here who have had some type of cancer and our now in remission. So I as a good reporter called a couple of friends in the medical field and was told to look up "What does a cancer cluster look like?"

Cancer is a group of more than 100 different diseases. Each type of cancer has its own risk factors and causes. This is why true cancer clusters very rarely involve more than one type of cancer. For it to be considered a true cluster, it usually must have one of the following characteristics:

There are several cases of a rare type of cancer.
There are larger than expected numbers of a more common type of cancer.
It is a type of cancer that is not usually seen in a certain group of people (for example, children getting a cancer usually seen in adults).

If the excess cancer cases include many different types of cancer over a period of many years, it’s not likely to be a true cancer cluster. And it’s very unlikely to be caused by a single environmental factor or exposure.

It’s also important to remember that cancer is common. Millions of new cases are diagnosed every year. Nearly half of all men and a little over one-third of all women in the United States will develop cancer during their lifetimes. So, it’s fairly common for several people in a relatively small area to develop cancer around the same time.

For most well-documented cancer clusters that were found to be caused by a shared exposure, the exposure took place in the workplace, rather than in the communities where people lived. Workplace exposures may be more likely to cause disease because the level of exposure tends to be higher and last longer than in other settings. The length of exposure is important, because it usually takes many years after exposure for cancer to develop. Workplace exposures can also be easier to identify because the group of exposed people is better defined and easier to trace as compared to groups in the community. This is why the links between cancer and many cancer-causing agents (called carcinogens) are often first found in studies of workers.

Statistics can usually help figure out if a cancer cluster is strictly due to chance. But if the excess number of cases reported in a cancer cluster looks significant based on statistics, it does not mean that they are caused by something unique to that area. Some clustering of cancer cases happens by chance, but people tend to notice and report situations where rates seem to be above average.

Who investigates cancer clusters, and how is it done?

People concerned about a possible cancer cluster can report it to a local or state health department. Procedures vary by state, but most health departments will first ask for information, such as:

The type(s) and number of cancers involved
Any suspected exposure(s) that might cause cancer
The area and time period in which the cases occurred
Specific information about each person thought to be affected
Specific information about the cancers themselves

After reviewing this information, most of the suspected clusters (as many as 4 of 5) are determined not to be true clusters and no further investigation is done. According to guidelines, some factors that do not support the need for further investigation include:

Cancer cases within family members who are blood relatives (especially cancers known to be strongly genetically linked)
Different types of cancers not known to be related to one another
A few cases of very common cancers, particularly when the people involved are of the usual age and sex for those cancers
Cases involving people with cancer who didn’t live in the same place at the time an exposure would have to have taken place to cause that cancer

If the health department feels that the potential cluster should be studied further, they collect more information. They will need to make sure that the cases are cancer and that they know the specific diagnosis. For example, there are several kinds of leukemia, and it is important to know what kind each person has. They also may want to see what risk factors for cancer affect the people involved. This may involve contacting patients or relatives or looking at medical records. The health department will look at the number of cases in the affected area and those nearby to see if there are really more cases than expected. Scientists in the health department may also look at reports in the medical literature to see if other clusters like this have been noted in the past.

If needed, the state or local health department may ask federal agencies for help – they tend to have more resources. The Centers for Disease Control and Prevention (CDC) is the agency most often involved. Other agencies, such as the Environmental Protection Agency (EPA) and the National Institute of Environmental and Health Sciences (NIEHS), may also help investigate.

Federal agencies may do a more in-depth investigation, including getting more thorough medical histories. These agencies may also take and test samples from the environment (air, soil, drinking water, etc.), especially if there is concern about a specific toxin. They may also test blood or other body fluid samples from both affected and non-affected people.

Suspected cancer clusters can cause a great deal of concern and confusion in a community. It’s very important that government agencies keep members of the community informed from the start of and throughout the investigation. This should include giving people a realistic idea of what may or may not be found.

What are the possible outcomes of a cluster investigation?

It may not be a true cluster.

In many cases, investigators can determine that a “cluster” of cancers isn’t a true cluster. For example, the number of cases may not really be higher than expected when other factors that could explain the increase (such as age, gender, and tobacco use) are taken into account. Or the types of cancer may not be related to each other.

It is a cancer cluster and its cause is found.

Rarely, a true cancer cluster may be confirmed and a cause is identified. At that point, steps can be taken to address it.

A cancer cluster may be found, but no cause can be identified.

Even if investigators believe that it may be a true cluster, it’s important to know that a cause is found very rarely. There are several reasons why this is the case. For example:

Random patterns can form a cluster: Even if the number of cases in an area is higher than expected, it still may not be caused by a single factor or exposure. More cancer cases in the United States are expected in large population centers or in places where the population tends to be older. But even so, for the most part, cancer cases in the United States are spread randomly across the country.

As with any random pattern, there will be more cases than expected in some spots, and fewer cases than expected in others. The areas with more cases than expected are more likely to be noticed. But many of these will be due to the “bull’s-eye effect” (which is something like drawing a target on the wall after the darts have been thrown). Suppose you took a map of the United States and started drawing circles of different sizes in different locations. You would find that some of the circles would contain more cancers than expected, and some would have less. Some of the circles with more cases might be clusters caused by a single carcinogen, but most would be due to chance.

You can see this more clearly on a smaller scale if you look at balls on a pool table. Even if the balls are randomly distributed, there are sections of the table with more and other sections with fewer balls than the average for the whole table.

Random patterns are the most common reason for a cancer cluster with no identified cause.

It is very hard to figure out which of many exposures might be the cause: With rare exceptions, scientists don’t have a way of telling what trigger (if any) may have caused cancer in any one person, whether it’s part of a cluster or not. Humans are not like lab animals – their environments are not strictly controlled. People are exposed to many natural and man-made substances during their lifetimes.

Think about how hard it would be to test for everything you’ve been exposed to, even if you knew where to start. Investigators may have a few clear leads or starting points, but they need to look at all of the possibilities. Finding the one exposure that may be the cause can be like looking for the needle in the haystack.

There is usually a long delay between exposure and cancer: In clusters where the cause is known, mostly in workplace cases, the time between exposure to the substance and the development of cancer has been anywhere from a few years to several decades. Exposures are not likely to cause cancers right away. And again, it’s not easy to study people and their environments.

Suppose a group of people live in a community that has a higher than expected number of cases of a certain type of cancer. If there is a potential cause, investigators first have to figure out when these people were exposed to it. Was it a single event or has it been ongoing? Was it 5 years ago? 10? 20? And what did the people with cancer have in common during that time? Added to this, some people will have moved into the community, while others may have moved away. Should the cases of people who moved into town in recent years be included? And can the people who moved away be found?

The boundaries of the cluster area can be hard to define: Defining the geographic cluster area is not always as clear-cut as one might think it would be. Just how big should the “bull’s eye” be? Should it include only the local neighborhood where most of the cases were found? Or should it also include the larger community, or even nearby communities? These areas may have cases that may or may not be related to the others.

Not everyone who is exposed is likely to develop cancer: To make things even more tricky, people may be more or less prone to getting cancer based on their genes. It’s unlikely that everyone exposed will develop cancer. At the same time, there may be people who were not exposed who develop the same cancer by chance.

Questions may still remain

Scientists do their best to piece the puzzle together when there is a cancer cluster, but more times than not, they don’t find a likely link. This doesn’t mean that there isn’t one; it may just be that one can’t be found with the methods scientists have at the time.

Oftentimes there really isn’t a link, for the reasons noted before, but it’s hard for everyone to feel sure of that. This may be an unsatisfactory answer for people in a community being affected, but it often is the case.

What should I do if I suspect a cancer cluster?

Concern about cancer clusters most often comes up in schools, workplaces, and in certain areas of a community. If you are concerned about a possible cancer cluster, you may want to contact your local or state health department. If you don’t know who to call in your area, the CDC has a list of web links to local and state contacts at www.cdc.gov/nceh/clusters/statelocal.htm. (Also see the “To learn more” section.)

Some of your concerns may be relieved by making a phone call. If not, the health department will probably look into doing a brief investigation and then, if needed, will do a more complete review of the situation. For more complex or urgent situations, the health department may also call in experts from the CDC or other agencies to do a more in-depth investigation.

The investigators may be able to figure out with a fair amount of certainty that there is no true cluster, or that there is a true cluster and it is probably caused by a certain exposure. But in many cases, even when it seems there is a cluster, a single cause cannot be found.

Suspected cancer clusters often greatly distress those involved. It’s very important that these situations be handled openly, promptly, and professionally. Even though thorough investigations of potential cancer clusters rarely give clear-cut answers, it’s important that communities keep reporting suspected cancer clusters, and that health organizations respond to those concerns.

Hello friends in Bradley Beach today I am writing from a point of view shared with me by a close friend who wishes her or his name not used, I understand they are fighting cancer and do not wish anyone to just give them things out of fear of losing them.
It was a warm day today and the local group Mary,s Place By The Sea was holding a walk though Bradley Beach and Ocean Grove http://marysplacewalk2014.dojiggy.com/ng/index.cfm/a51e9aa/regPages/pages/?p=125111 so as my friend, lets call him/her clam digger 1 was sitting near the spot where digger first tried to understand the why of cancer also known as the fletcher lake ocean front area this group of well over 800 walkers went by digger was crying not out of pain, or anger but out of love for a group of people who digger did not even know. Digger was also sad because digger is from a town where they would not even paint a line down the street or put their name on a web site to say remember the fallen heroes of cancer as well as the friends who are surviving, diggers tears were heard by me today as I remember the friends gone and the friends who remain free today of cancer. As we get ready for a summer of visitors lets tell the Mayor and Council in Bradley Beach never again will we let them forget.

So this month, Gaza celebrated Pink October by launching an extensive awareness campaign, calling on women to get early screening and protection. The campaign also featured:

And we did! The organization behind this amazing initiative is called the Aid and Hope Program for Cancer Patients Care. It's led by Eman Shannan, a survivor of the disease. Running on a low budget provided by several Palestinian private sector institutions, the team (75% of the staff are patients or survivors of breast cancer) made the ribbon using a 1.4 kilo long pink cloth, breaking the Guinness Record, on the beach.

The entire Bradley Beach community mourns the loss of our former Mayor and Councilmember Julie Schreck.

Julie passed on Sunday, May 4^th after a long and courageous battle.
Julie served as a vital and energetic member of the Bradley Beach Board of Recreation from 2005 to 2007. She was elected to the Borough Council in May of 2007 and served on the council from July of 2007 until June 30^th of 2008. Julie was elected Mayor of Bradley Beach in May of 2008 and served as our Mayor until the end of 2012.

Julie was a fervent advocate for the arts in Bradley Beach, she founded the Bradley Beach Arts Council, she led the effort for the establishment of a permanent location for the Bradley Beach Historical Museum, she was a strong proponent for the continual strengthening of our critical beach dunes system, she strengthened the borough’s adherence to improved environmental standards and was the elected official who was the key driver behind the establishment of the Maritime Forest.

Julie demonstrated a passion for our town that was only exceeded by her passion for her family. Our thoughts and prayers go out to them during this difficult time.

For the past eight years, Pain the Town Pink has encouraged every woman, 40 and older, to have her annual mammogram. In 2013, Paint the Town Pink was in 23 towns in Monmouth and Ocean counties, with more business and community support than ever before. You can join the mission. Judge rules conflict of interest enough to overturn townhouse OK Planning board’s unanimous approval thrown out.

BRADLEY BEACH — Monmouth County Superior Court Judge Thomas F. Scully reversed the decision of the Bradley Beach Planning Board that approved the plans of borough developer John Naples, of JRN Home Builders, LLC, to build a three-unit townhouse on Mr. Naples’ property at 111 Ocean Park Ave. in his written decision dated Wednesday, March 26.
Judge Scully reversed the approval, and remanded for a new hearing of the entire application. In the new hearing, Michael Conoscenti, zoning board chairman, will not participate, because of the “inescapable conclusion” that there was, at the very least, a potential conflict of interest in Mr. Conoscenti deliberating on the case, Judge Scully stated.
The written opinion did not address the “substantive” issues related to the application, meaning the validity of the townhouse design plan itself, which required 10 bulk variances, because, Judge Scully stated, the matter has to be reheard entirely anyway by virtue of the conflict of interest.
Mr. Conoscenti sat on the planning board during the initial hearing of Mr. Naples’s application on Jan. 24, 2013, because an inadequate number of planning board members were present at the meeting.
Mr. Conoscenti sat at the second hearing on Feb. 28, when he voted to approve the plans. The approval was unanimous.
There has only been one other successful appeal of a planning or zoning board decision in the borough since at least 1994, according to Fran Sauta, current secretary of both those boards.

“It is very rare,” Ms. Sauta stated.
The other successful instance more than one decade ago involved property owner Rosemarie Sellick, who sought to subdivide her single lot at 300 Third Ave. into three, and to remove a house there, but was denied by the planning board in 2003. After three years in the appeals process, by county superior court order, the board approved Ms. Sellick’s request on Dec. 14, 2006, according to borough records.
A CONFLICT OF INTEREST
The planning board, prior to hearing Mr. Naples’ application, had requested that zoning board members sit on the applications scheduled for the Jan. 24, 2013, meeting, due to the anticipated absence of four of its members.
State statute gives permission for members of the zoning board to fill in, temporarily, on the planning board in the event there are too few members available for a quorum.
As per this request, Mr. Conoscenti and zoning board member George Bachar agreed to be on deck to serve as substitutes.
In advance of Mr. Naples’ first hearing, Mayor Gary Engelstad said he felt there would be a conflict of interest if he heard the case, and recused himself.
The mayor’s rationale for seeking to be replaced in this matter was his concern that Mr. Naples had previously made a $50 campaign contribution to his 2012 mayoral campaign.
The entire issue arose because Mr. Conoscenti was asked to participate because Mayor Engelstad recused himself, Judge Scully found.
Judge Scully wrote, “Ironically it is that concern [of Mayor Engelstad] for a conflict or perception of a potential conflict that initiated the involvement of Mr. Conoscenti in this application.”
Mr. Conoscenti’s prior business relationship with Mr. Naples involved significantly more money than $50.
Mr. Conoscenti and Mr. Naples were two of six members of 1014 Main Street, LLC, a limited liability company which purchased $2 million of real estate in the borough in March 2006 for the purpose of developing 20 condominium units.
As recently as August 2010, Mr. Naples, pursuant to a mortgage and note agreement, borrowed $100,000 from Mr. Conoscenti and the underlying mortgage was discharged in September 2011, according to the court ruling.
Mr. Naples used the loan to purchase one available retail space in the Sylvan Lake condos, which he now uses for his construction business, Mr. Conoscenti has said.
Despite their prior business history, which was formally terminated 15 months before the hearings, neither Mr. Naples nor Mr. Conoscenti brought this potential issue to the attention of any of the parties prior to the hearings.
“It is particularly troubling in this case that the response to the assertion of a claim of a conflict here is essentially that if they plaintiff were aware of such a conflict, it was his duty to assert it or be forever barred,” Judge Scully wrote.
If the mayor was concerned with a campaign contribution of $50, Mr. Naples and Mr. Conoscenti “should have been concerned” as well, Judge Scully ruled, considering the nature of their business relationship, geographic location of the projects they shared and the financial obligation thereafter.
The board’s approval of the three, three-story townhouses at 111 Ocean Park Ave. has been reversed and Mr. Naples’ application has been remanded for a new hearing.
As of yesterday, Mr. Naples had not refiled his application with the board, according to Ms. Sauta.
REACTIONS TO THE OUTCOME
Mr. Conoscenti and Mr. Naples declined to comment on the ruling and how they will proceed from this point.
“There is nothing I can say right now,” Mr. Conoscenti stated.
Lead plaintiff George Heflich, residing at 115 Ocean Park Ave., said he was “very pleased” with the decision, but dismayed that he and his neighbors had to take legal action to reach this end. The case cost Mr. Heflich, personally, $14,126 in legal and planning fees, he said.
“It has been a sad time for Bradley Beach when 19 townspeople have to sue their own planning board to protect their property rights. These are supposed to be secure in the borough ordinances enacted to safeguard us,” he said.
Mr. Heflich hired an attorney and planner to testify against Mr. Naples’ proposal during the second session of the hearing before the planning board. According to Mr. Heflich’s testimony that evening, his concerns included that Mr. Naples’ proposal was inconsistent with the character of the neighborhood and threatened the area with overdevelopment. He voiced disapproval for the quantity of variances requested to build townhouses in a neighborhood where the ordinances prohibit them because the lot is only one quarter of the minimum size allowed by ordinance.
Like Judge Scully, Mr. Heflich said he found the contention of the planning board that it was the public’s duty to root out and disclose the planning board’s conflicts of interest, and not their own duty, to be “very distressing.”
“Either the planning board and their lawyer are truly uninformed of these basic legalities, or they choose to ignore them. It is very distressing, either way,” he said.
Mr. Heflich called for the governing body to bring in new blood.
“We are now relying on the mayor and council to appoint new members to this board so that this never happens again,” Mr. Heflich said.
Mr. Heflich said he is concerned about potential changes to the borough’s master plan, which is currently undergoing re-examination, a process that occurs every 10 years.
“The town is additionally proposing an ordinance change to open up even more small lots for townhouse development,” he stated.
Mr. Heflich finished, “There have been positive results from all of this. Scores of residents have met and come together and we now attend town meetings to voice our concerns. We love our town and want to see it stay the beautiful, quaint Shore town that it has always been.”
Mayor Engelstad did not immediately return a call for comment.

14 Tourism-Related Organizations Were Awarded Destination Marketing Organization (DMO) Grants

A total of 14 tourism-related organizations were awarded Destination Marketing Organization (DMO) Grants totaling over $1.5 million to expand tourism marketing opportunities in New Jersey in Fiscal Year 2014. The organizations work with local entertainment venues, restaurants, retail outlets, and hotels to promote a municipality or region’s historical, cultural, and artistic attractions.
Destination Marketing Organization Grants were awarded to the following organizations:

Central Jersey Convention and Visitors Bureau in Middlesex County – $110,000
Greater Newark Convention and Visitors Bureau - $118,000
Hudson County Office of Cultural & Heritage Affairs - $82,350

Meadowlands Liberty Convention and Visitors Bureau - $132,000
Morris County Tourism Bureau - $130,000
Princeton Regional Chamber of Commerce - $112,000
Shore Regional Tourism Council - $114,000

Sussex County Chamber of Commerce - $90,000

A one-time supplemental award was also distributed to approved grant applicants based on additional marketing support needed in the aftermath of tourism losses as a result of Superstorm Sandy. Such awards were based on tourism spending by county, counties most impacted by Superstorm Sandy, according to the New Jersey Comprehensive Damage Assessment, and an applicants’ submission of assessment regarding Superstorm Sandy.
The one-time supplemental grants were awarded to the following organizations:

Shore Region Tourism Council - $25,000
Southern Ocean County Chamber of Commerce - $25,000
Southern Shore Region Tourism Council - $25,000

Each grant application is reviewed by an independent panel with granting, marketing, and/or tourism experience. Applicants must demonstrate quality work, a clear demonstration of how their project will contribute to New Jersey’s tourism industry, and how their project fits within the Division of Travel and Tourism’s priorities.

Winter Solstice: Blessing for the Longest Night

This week, in addition to preparing for Christmas Eve and Christmas Day services, many congregations will offer a “Longest Night” or “Blue Christmas” service. Usually held on or near the Winter Solstice, this gathering provides a space for those who are having a difficult time during the holidays or simply need to acknowledge some pain or loss they are carrying in the midst of this season of celebration. For you who are offering or participating in such a service, and for all who struggle in this season, I wish you many blessings and pray for the presence of Christ our Light, who goes with us in the darkness and in the day.

Blessing for the Longest Night

All throughout these months
as the shadows
have lengthened,
this blessing has been
gathering itself,
making ready,
preparing for
this night.

It has practiced
walking in the dark,
traveling with
its eyes closed,
feeling its way
by memory
by touch
by the pull of the moon
even as it wanes.

So believe me
when I tell you
this blessing will
reach you
even if you
have not light enough
to read it;
it will find you
even though you cannot
see it coming.

You will know
the moment of its
arriving

Pursuant to N.J.S.A. 40:49-5.1, the International Property Management Code, 2009, published by the International Code Counsel, is hereby accepted, adopted and established as the standard and guide in determining whether dwellings and properties in this municipality are properly maintained in accordance with and in the interest of promoting the health, safety and welfare of the public. A copy of the International Property Maintenance Code (IPMC) is annexed hereto and three copies have been placed on file in the office of the Borough Clerk and are available to all persons desiring to use and examine the same.

§ 350-2 Amendments to Code adopted.

The International Property Maintenance Code as identified above shall be hereby amended and supplemented to read as follows:

Section 101.1 Title. These regulations shall be known as the "International Property Maintenance Code of Borough of Bradley Beach," hereinafter referred to as "this code."

Section 102.3 Application of other codes. Repairs, additions or alterations to a structure, or changes of occupancy, shall be done in accordance with the procedures and provisions of the New Jersey Uniform Construction Code. Nothing in this code shall be construed to cancel, modify of set aside any provision of the Borough of Bradley Beach Zoning Code. Any reference to the "International Building Code," "National Electric Code" or the "International Plumbing Code," as found in the International Property Maintenance Code adopted herein, shall be construed to mean and be read in accordance with the New Jersey Uniform Construction Code. Any reference to the "International Fire Code" as found in International Property Maintenance Code adopted herein shall be construed to mean and be read in accordance with the New Jersey International Fire Code.

Section 103. This section, including all subparts, is deleted in its entirety.

Section 106.4 Violations and penalties. Unless otherwise provided in this Code, any person, persons, other entities, or their agents, who shall violate a provision of this Code, or fail to comply therewith, or with any of the requirements hereof, shall be prosecuted within the limits provided by state or local laws and upon conviction thereof shall be subject to the penalties set forth in Borough Ordinance Chapter 1, Article II, General Penalty. Each day that a violation continues after due notice has been served shall be deemed a separate offense. All summons issued in connection with the enforcement of this code, or any rule or regulation adopted pursuant thereto, shall be heard before the Municipal Court of the Borough of Bradley Beach in accordance with the rules of the Municipal Court, as adopted by the Supreme Court.

Section 107.7 No notice necessary. No notice of violation need be given to any person or entity prior to the issuance of a summons for the violation of any standards or provisions herein adopted and all requirements as to notice shall be read as being discretionary and permissive only.

Section 111. This section, including all subparts, is deleted in its entirety.

Section 112.4 Failure to comply. Any person who shall continue any work after having been served with a stop-work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be subject to a fine of not less than $200 or more than $2,000.

Section 302.3.1 Snow removal: sidewalks and parking lots. Snow and ice shall be removed from sidewalks and private parking lots within 24 hours after cessation of precipitation.

Section 302.4 Weeds. All premises and exterior property shall be maintained free from weeds or plant growth in excess of six inches. All noxious weeds shall be prohibited. Weeds shall be defined as all grasses, annual plants and vegetation other than trees or shrubs provided; however, this term shall not include cultivated flowers and gardens. Upon failure of the owner, the owner's agent, or other person having charge of a property to cut and destroy weeds after service of a notice of violation, said person shall be subject to prosecution in accordance with Section 106.3 and as otherwise prescribed by the authority having jurisdiction. Upon failure to comply with the notice of violation, any duly authorized employee of the jurisdiction or contractor hired by the jurisdiction shall be authorized to enter upon the property in violation and cut and destroy the weeds growing thereon, and the cost of such removal shall be paid by the owner or agent responsible for the property.

Section 302.7 Accessory structures. All accessory structures, including but not limited to, detached garages, sheds, outside showers, fences and walls, shall be maintained in structurally sound and in good repair.

Section 302.10 Depositing of snow or ice prohibited. No person or other entity shall throw, place or deposit any snow or ice into or on any street in the Borough, and no owner, tenant or occupant shall cause or allow such throwing, placing or depositing to occur, or cause or permit said throwing, placing or depositing of any snow or ice to remain in the street, it being the intent and purpose of this provision to prohibit all such persons and entities from throwing, placing or depositing snow or ice which accumulated on the private property or adjoining sidewalks into the streets of the Borough.

Section 304.1.1. This section shall be amended to delete any reference to existing International Building Code.

Section 304.3.1 Premises identification. Commercial buildings with rear doors shall have the name of any businesses, address number and unit identification, if applicable, on the outside of said rear doors. Numbers and letters shall be a minimum of three inches high with a minimum width of 0.5 inches.

Section 304.6.1 Exterior walls. All exterior walls, including masonry walls, shall be free of chipping, staining and deterioration of paint and all such walls shall be restored to a clean good appearance.

Section 304.14 Insect screens. Every door, window and other outside opening required for ventilation of habitable rooms, food preparation area, food service areas or any areas where products to be included or utilized in food for human consumption are processed, manufactured, packaged or stored shall be supplied with approved, tightly fitting screens of not less than 16 mesh per inch (16 mesh per 25 millimeters), and every screen door used for insect control shall have a self-closing device in good working condition.

Exception: Screens shall not be required where other approved means, such as air curtains or insect repellent fans, are employed.

Section 308.3.1 Garbage facilities. The owner of every dwelling shall supply an approved leakproof, covered, outside garbage container, and no option to this requirement shall be permitted.

Section 404.4.1 Room area. Every living room shall contain at least 120 square feet (11.2 m²) and every bedroom shall contain at least 70 square feet (6.5 m²) for the first person and 50 square feet for each additional person.

Section 602.3 Heat supply. Every owner and operator of any building who rents, leases or lets one or more dwelling units or sleeping units on terms, either expressed or implied, to furnish heat to the occupants thereof shall supply heat during the period from October 1 to May 15 to maintain a temperature of not less than 68º F. (20º C.) in all habitable rooms, bathrooms and toilet rooms.

	Exceptions:
	(1)	When the outdoor temperature is below the winter outdoor design temperature for the locality, maintenance of the minimum room temperature shall not be required provided that the heating system is operating at its full design capacity. The winter outdoor design temperature for the locality shall be as indicated in National Standard Plumbing Code currently adopted by the NJ-UCC.
	(2)	In areas where the average monthly temperature is above 30º F. (-1º C.) a minimum temperature of 65º F. (18º C.) shall be maintained.

Sec. 602.4 Occupiable work spaces. Indoor occupiable work spaces shall be supplied with heat during the period from October 1 to May 15 to maintain a temperature of not less than 65º F. (18º C.) during the period the spaces are occupied.

	Exceptions:
	(1)	Processing, storage and operation areas that require cooling or special temperature conditions.
	(2)	Areas in which persons are primarily engaged in vigorous physical activities.

9-11.1

Whenever there is snow covering on the streets or highways in the Borough, in the discretion of the Superintendent of Public Works or his designee, the following prohibitions will take effect:

Parking of all vehicles on the south side of the street on any street which runs east and west is prohibited until after the snow has stopped and the street has been plowed; then, after the snow has stopped and the south side of the street has been plowed, park the vehicles on the south side of the street on any street which runs east and west until the streets have been plowed sufficiently and to the extent that parking will not interfere with normal flow of traffic.

Parking of all vehicles on the east side of the street on any street which runs north and south is prohibited until after the snow has stopped and the street has been plowed; then, after the snow has stopped and the east side of the street has been plowed, park the vehicles on the east side of the street on any street which runs north and south until the streets have been plowed sufficiently and to the extent that parking will not interfere with normal flow of traffic.

Any vehicle parked in violation or abandoned on a public street shall be deemed to be a nuisance and a menace to public safety and any public safety officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of removal and storage of a vehicle before redeeming possession thereof.

This parking prohibition shall remain in effect until after the snow has ceased and the streets have been plowed for the full width as well as until parking will not interfere with the normal flow of traffic.

During a snow emergency, if off-street parking is available, any vehicle shall not be parked on any street.

Any owner or owners, occupant or occupants, tenant or tenants, building superintendent, rental agent or person in charge of premises abutting or bordering upon any public street in the Borough shall remove all snow and ice from the abutting sidewalks of such streets, or in the case of ice which may be so frozen as to make removal impracticable, shall cause the same to be thoroughly covered with sand or ashes, within 24 hours of daylight after the same shall fall or be formed thereon.

9-11.2

This section shall not apply to either Main Street or Ocean Avenue as to parking of vehicles. However, the regulations regarding sidewalks shall apply.

9-11.3

The penalty provisions of § 9-10 shall apply to a violation of this ordinance. In addition, the Police Department shall have the option of towing any vehicle in violation at the owner's expense.

9-11.4

Removal costs. In addition to the provision for penalties herein made for violations of this section, and in case such snow or ice shall not be removed from such sidewalks by the owner or owners, tenant or tenants, occupant or occupants, building superintendent, rental agent or person in change of any premises, as provided in Subsection 9-11.1F, the same shall be removed forthwith and under the direction of the Supervisor of Streets, and the cost of such removal as nearly as can be ascertained shall be certified by the Supervisor of Streets to the governing body. The governing body shall examine such certification and, if found to be correct, shall cause such cost to be charged against such real estate so abutting or bordering upon such sidewalk or street, and the amount so charged shall forthwith become a lien and a tax upon such real estate or land and be added to, recorded and collected in the same manner as the taxes next to be levied and assessed upon such premises and shall bear interest and be enforced and collected by the same officers and in the same manner as other taxes.

9-11.5

Depositing snow on street restricted. No person, firm or corporation, the owner, tenant or occupant of any premises abutting on any street shall throw, place or deposit any snow or ice into or on any street in the Borough, it being the intent and purpose of this provision to prohibit all such persons from throwing, casting, placing or depositing snow and ice which accumulated on the private property abutting the street or sidewalk on the sidewalks or streets of the Borough.
