&lt;br /&gt;
House Bill 350 seeks to remove HIV/AIDS training and education requirements for licensed service providers such as physicians, registered nurses, social workers, etc. Both organizations are opposed to the legislation because treatment options change rapidly, making it imperative that all health care professionals know the physical manifestations of HIV/AIDS. It is a matter of getting people in the proper care as soon as possible. This could be the difference in a healthy outcome or multiple misdiagnoses that would end up costing more financially either for the patient themselves or for the taxpayers of Kentucky.&lt;br /&gt;

"Treatment options change rapidly, therefore physicians or other clinicians that do not treat HIV/AIDS as a specialty would be hard pressed to know the best treatment options for their patients infected with this disease," stated Bobby Edelen, president of the Kentucky HIV/AIDS Advocacy Action Group.&lt;br /&gt;
&lt;br /&gt;
To compound the issue, Kentucky lawmakers allowed the Kentucky AIDS Drug Assistance Program to expire. "The fact that the Commonwealth also stopped funding the low-income Kentucky AIDS Drug Assistance Program in 2007 is inhumane, shortsighted, and threatens individual and public health," stated Kentucky Equality Federation President Jordan Palmer.&lt;br /&gt;

Gary L. Fowler, a special adviser to the Kentucky HIV/AIDS Advocacy Action Group, and Co-Chair of the Kentucky HIV Prevention Advisory Council (KHPAC) stated: "I would like to point out that surveillance training is necessary for us to have the best information available to stop the spread of HIV/AIDS. Kentucky has a high number of people infected with the disease that report unknown risk factors. If we do not have accurate numbers for who is being infected and what their behavioral risk factors are, we do not have a clear picture of where we need to target our prevention dollars."&lt;br /&gt;

Edelen continued: "House Bill 350 does a disservice to the citizens of the Commonwealth of Kentucky by lowering healthcare standards for service providers and should be defeated. But they are singling out the Manchester property. &lt;br /&gt;&lt;br /&gt;In May, California became the second state in the nation to allow same-sex marriage after the state Supreme Court ruled that laws banning it violate the right to marry in the state constitution. A court ruling in Massachusetts legalized same-sex marriage in that state four years ago. &lt;br /&gt;&lt;br /&gt;In November, voters get a chance to overturn the California ruling, if they vote for a constitutional ban under Proposition 8. &lt;br /&gt;&lt;br /&gt;Manchester is one of several San Diegans whose large contributions helped put the initiative on the ballot. Others include Mission Valley developer Terry Caster, who gave $162,500, and Robert Hoehn, owner of Hoehn Motors in Carlsbad, who has given $25,000. &lt;br /&gt;&lt;br /&gt;Fred Karger, who is helping to organize the boycott and is running an organization opposed to Proposition 8, said he is also urging the public to boycott Manchester's other hotel, the Grand Del Mar. &lt;br /&gt;&lt;br /&gt;“This is someone who is giving an exorbitant amount of money to write discrimination into the constitution for the very first time,” he said. &lt;br /&gt;&lt;br /&gt;Karger said he hopes the boycott will send a message to other potential contributors to the Proposition 8 campaign. &lt;br /&gt;&lt;br /&gt;“Our goal is to create a business loss for people who contribute,” he said. “We want to make it a little uncomfortable.” &lt;br /&gt;&lt;br /&gt;The results of the boycott could be watched closely. &lt;br /&gt;&lt;br /&gt;In the battle over Proposition 8, both sides will be trying to raise huge amounts of money, nearly $15 million each, to make their case to voters. In 2000, 61 percent of California voters approved Proposition 22, enacting a statutory ban on same-sex marriages. Contributor Pam Spaulding's home blog, Pam's House Blend, was one of two gay blogs issued credentials. The other blog? Towleroad.&lt;br /&gt;&lt;br /&gt;Towleroad is not known for racial diversity, trans inclusion, or its lesbian audience. It is a site for wealthy gay white men -- the HRC demographic. Their advertising info reads "News. Entertainment. Gossip. Media. Art. Life. Most Unique Users: 500,000; 95% male; 85% US; 52% earn $75,000+; 40% earn $100,000+" Where was "politics" in that description? Did they pick up on the lack of women? What about the lack of average American salaries? Towleroad's readers' average salary is almost double the median annual household income. Household. Not one person.&lt;br /&gt;&lt;br /&gt;It's not that I have anything against Andy Towle and the product he's built. It's damn good and he definitely has an audience; hell, I'm a regular reader. I am, after all, his target audience. But when was the last time you saw serious in-depth political coverage on Towleroad or committed coverage of an issue from multiple angles or guest posts from members of Congress and Presidential candidates? Bilerico has brought our readers all of that and more.&lt;br /&gt;&lt;br /&gt;At Bilerico Project we're committed to the diversity others give lip service. We asked for credentials for myself, Jerame Davis, Serena Freewomyn, Marti Abernathey, Monica Roberts and Eric Marcus. Two trans women from middle America (one African-American), two gay activists from Indiana, a lesbian feminist from Arizona, and a New York Times bestselling author and former television news producer from New York.&lt;br /&gt;&lt;br /&gt;Pam's House Blend also promoted diversity in their application by getting credentials for all of her regulars. Towleroad has a niche - upperclass white gay men; it's not that diverse. Maybe there are too many letters for the DNC to spell LGBT. When TBP first launched, Managing Editor Alex Blaze would often use the line, "Not everything queer is marriage, martinis and Madonna." Steve Beshear on Monday reversed several worker-related decisions made by his Republican predecessor, most notably by reinstating a ban on discriminating on the basis of sexual orientation.&lt;br /&gt;&lt;br /&gt;Beshear signed an executive order that bars state officials from making hiring or firing decisions based on sexual preference or gender identity.&lt;br /&gt;&lt;br /&gt;"Experience, qualifications, talent and performance are what matter," Beshear said in a statement.&lt;br /&gt;&lt;br /&gt;Democratic former Gov. Paul Patton signed an executive order in 2003 aimed at protecting lesbian, gay, bisexual and transgender state employees. The policy also bars discrimination based on race, gender, ethnicity, age and religion.&lt;br /&gt;&lt;br /&gt;But Republican Gov. Ernie Fletcher removed sexual orientation from the list of specifically protected characteristics as part of an executive order he signed on Diversity Day in April 2006.&lt;br /&gt;&lt;br /&gt;Beshear declined to answer questions about the policy change at a news conference shortly before it was announced.&lt;br /&gt;&lt;br /&gt;"I'm going to be doing something on that in the very near future," he repeated as his response to two questions about the subject.&lt;br /&gt;&lt;br /&gt;The move was applauded by at least two advocacy groups for gay and lesbian rights: the Kentucky Equality Federation, which started an online petition to urge Beshear to take that step, and the Kentucky Fairness Alliance.&lt;br /&gt;&lt;br /&gt;The alliance's executive director, Christina Gilgor, said the group was "thrilled" that Kentucky is back among the 27 states that offer such protections specifically to gay, lesbian, bisexual and transgender state workers.&lt;br /&gt;&lt;br /&gt;"This is a major victory for fairness in the Bluegrass State," said state Sen. Ernesto Scorsone, a Lexington Democrat and the state's only openly gay lawmaker. "The executive branch is setting an example of how to treat employees fairly."&lt;br /&gt;&lt;br /&gt;But David Edmunds, policy analyst for The Family Foundation of Kentucky, said his group is concerned that Beshear could expand other state policies to gay couples, such as providing state health insurance for domestic partners of gay and lesbian state employees.&lt;br /&gt;&lt;br /&gt;"It looks like this is the beginning of his pro-homosexual agenda," Edmunds said.&lt;br /&gt;&lt;br /&gt;Beshear, however, made no such campaign promises. He did repeatedly vow during last year's governor's race to veto any legislation aimed at barring public universities from offering domestic partnership benefits to their employees. A bill to do that passed the Republican-led state Senate this spring but died in the Democratic-controlled House.&lt;br /&gt;&lt;br /&gt;Also Monday, Beshear began his shake-up of state government by formally elevating the Labor Department to a full cabinet and by bringing back an advisory group on state worker issues. The group is aimed at opening communications between unions and the governor's office.&lt;br /&gt;&lt;br /&gt;The restoration of the Governor's Employee Advisory Council -- created by Patton and abolished by Fletcher in 2003 -- doesn't give state workers collective bargaining powers because that can be done only legislatively.&lt;br /&gt;&lt;br /&gt;State workers "do not have to join (a union). They do not have to pay dues," Beshear said.&lt;br /&gt;&lt;br /&gt;But public employees would be able to express workplace concerns to the governor through union representatives who are used to negotiating with executives, said Dave Warrick, executive director of the American Federation of State, County and Municipal Employees' council that covers Indiana and Kentucky.&lt;br /&gt;&lt;br /&gt;"The state employees are hungry for this," Warrick said. "They want a voice at work."&lt;br /&gt;&lt;br /&gt;About 10,000 Kentucky state workers signed up to be represented by AFSCME after Patton created the advisory group, but the union didn't get a chance to collect any dues from them before Fletcher eliminated the panel, he said.&lt;br /&gt;&lt;br /&gt;Beshear also signed an executive order creating the Cabinet of Labor, to be headed by former state Rep. J.R. Gray. That completes a campaign promise Beshear made last year.&lt;br /&gt;&lt;br /&gt;His reorganization of the agency provided some hints as to how Beshear might restructure all of state government in the face of a tight budget.&lt;br /&gt;&lt;br /&gt;The governor said he will eliminate three high-paying executive director positions -- two that come with salaries of more than $90,000 and one in the low $80,000 range -- to save money.&lt;br /&gt;&lt;br /&gt;The Labor Cabinet will share administrative functions, such as accounting, with its two sister agencies: an energy and environment cabinet and the financial regulation cabinet. All had been part of one giant Environmental and Public Protection Cabinet under Fletcher. Council on May 6 approved the addition of 39 new provisions to the city’s domestic partners law, bringing the law to a point where same-sex couples who register as domestic partners will receive most, but not quite all, of the rights and benefits of marriage under District law.&lt;br /&gt;&lt;br /&gt;“I’m not a percentage type person,” said Councilmember Phil Mendelson (D-At-Large), the author and lead sponsor of the legislation. “But I’d say we’re getting very close,” he said, to domestic partners receiving full parity with married couples under local law.&lt;br /&gt;&lt;br /&gt;D.C. Councilmember Jack Evans (D-Ward 2), who is a co-sponsor of the omnibus domestic partners bill passed by the Council last week, said the bill, combined with the existing DP law, amounts to a “de facto civil unions” law in the city.&lt;br /&gt;&lt;br /&gt;“We may have a provision here and there that still needs to be changed, but this bill is a major chunk of what is needed to be completed,” Evans said.&lt;br /&gt;&lt;br /&gt;Mendelson introduced two more domestic partnership bills earlier this year that he said will complete the process of providing same-sex partners with all of D.C.’s marriage-related rights, benefits and obligations.&lt;br /&gt;&lt;br /&gt;The earlier D.C. bills approved by Council added most of the better known rights and benefits associated with marriage, such as full inheritance rights for domestic partners, obligations to pay alimony and child support in the event of dissolution of a domestic partnership, immunity from court testimony against a domestic partner and the ability to file joint income tax returns for local D.C. taxes.&lt;br /&gt;&lt;br /&gt;The latest bill approved on May 6 changes a wide range of D.C. laws that touch on whether a city resident is married or single. Heathyre Farnham, a 16-year-old student at Spencer–Van Etten High School, was sent home in September because her shirt, which read "Gay? Unless and until the Legislature changes the wording, same-sex couples married in Massachusetts cannot get divorced in Rhode Island family courts, it said.&lt;br /&gt;&lt;br /&gt;Cassandra Ormiston, who married Margaret Chambers in Fall River in 2004 after Massachusetts became the first state in the country to legalize same-sex marriages, denounced the ruling, saying it discriminates against same-sex couples.&lt;br /&gt;&lt;br /&gt;"There have been people throughout history who have been discriminated against," said Ormiston, 60. "And they have fought the good fight and prevailed. The group still owes the city more than $100,000 for last year's events.&lt;br /&gt;&lt;br /&gt;Now serious questions are being raised about whether the LGBT center — whose director resigned this summer — will be up to staging a Pride celebration on Capitol Hill next summer.&lt;br /&gt;&lt;br /&gt;"It's tough all around for nonprofits, particularly gay and lesbian nonprofits," said Breanna Anderson, co-president of the LGBT center's board of directors.&lt;br /&gt;&lt;br /&gt;With rents as high as they are on Capitol Hill, finding a new home is the "fiscally responsible thing to do," she said. "So we're looking at a few options right now, including sharing space with other community organizations."&lt;br /&gt;&lt;br /&gt;Calls to other board members and the LGBT center's interim director, Dennis Poplin, were not immediately returned Wednesday, and the center's former executive director, Shannon Thomas, could not be reached for comment.&lt;br /&gt;&lt;br /&gt;Established in 1996, the LGBT center provides a range of support services to the local gay community.&lt;br /&gt;&lt;br /&gt;Last year, Capitol Hill businesses and activists, outraged with Out and Proud's transfer of the Pride parade from Broadway to downtown, asked the LGBT center to restore festivities on the Hill — a march along Broadway and a festival in Volunteer&lt;br /&gt;Park.&lt;br /&gt;&lt;br /&gt;Several sponsors of the original Pride celebration shifted their event support to the center. Anderson said those and other funds go into a general fund to pay center costs. It gets most of its money from private donors and about $16,000 from the city of Seattle to help run a hotline.&lt;br /&gt;&lt;br /&gt;"None of our money is earmarked," Anderson said.&lt;br /&gt;&lt;br /&gt;She said that in the spring, a burned-out Thomas told the board she was resigning but was talked into staying long enough to see the June Pride events on Capitol Hill through to completion.&lt;br /&gt;&lt;br /&gt;Thomas left shortly after and was compensated for significant paid time off that she had accrued, along with her last month's salary, Anderson said.&lt;br /&gt;&lt;br /&gt;The center reportedly owes about $30,000 to vendors that supplied lighting, sanitation and other services during this past summer's Pride events. It advised gays and their supporters to shop elsewhere.&lt;/p&gt;&lt;p&gt;Wal-Mart rated a red 40 on a scale of 100, down from a yellow 65 in 2006. It was among 54 companies that scored 45 or lower in HRC's 2008 Corporate Equality index, which assigns ratings to 519 large companies. Arnold Schwarzenegger signed last month, a first-ever appropriation for aid to lesbian, gay, bisexual and transgender (LGBT) victims of domestic violence.&lt;br /&gt;&lt;br /&gt;"These types of government and non-profit partnerships have for many years kept many Californians healthy, safe and self-sufficient, and for the first time the California budget includes such funds for LGBT-specific services," Geoff Kors, executive director of Equality California, declared after the budget was signed.&lt;br /&gt;&lt;br /&gt;There's no shortage of other issues to fuel the perpetual battle between pro- and anti-LGBT rights groups in the dying days of the session. If history is a guide, the pro side will pretty much have its way in a Legislature dominated by liberal Democrats, but the final decision will rest with Schwarzenegger, who sometimes supports the LGBT agenda and sometimes does not.&lt;br /&gt;&lt;br /&gt;The American Civil Liberties Union dispatched letters to its activists last week, urging them to pressure Schwarzenegger on this year's batch of bills and noting that during the last biennial legislative session, "Our top five pieces of (LGBT) legislation were vetoed by this governor."&lt;br /&gt;&lt;br /&gt;The biggest casualty was a bill to allow same-sex couples to obtain marriage licenses and marry. Schwarzenegger said in his veto message that he was upholding the expression of popular sentiment in Proposition 22, enacted in 2000 and aimed at restricting marriages to opposite-gender couples.&lt;br /&gt;&lt;br /&gt;The measure is back as Assembly Bill 43, again carried by Assemblyman Mark Leno, D-San Francisco, and is one of the most fiercely contested LGBT measures awaiting final action.&lt;br /&gt;&lt;br /&gt;Both sides, however, are also gearing up on Senate Bill 777 by Sen. Sheila Kuehl, D-Los Angeles, which would add sexual orientation to the conditions that schools must protect by prohibiting instruction or other action that "promotes a discriminatory bias."&lt;br /&gt;&lt;br /&gt;Kuehl and other proponents characterize it as protecting the civil rights and safety of LGBT students, but opponents such as the California Family Council see it as discriminating against those with religious opposition to homosexuality.&lt;br /&gt;&lt;br /&gt;"Passage of this bill would essentially silence students and teachers from the free expression of any beliefs and opinions contrary to a total and complete acceptance of all forms of sexual behavior," the council says in one of its call-to-action bulletins. The Capitol Resource Institute brands SB 777 as "homosexual indoctrination in schools."&lt;br /&gt;&lt;br /&gt;Another flash point is Assembly Bill 14 by Assemblyman John Laird, D-Santa Cruz, which expands the reach of the 4-decade-old Unruh Civil Rights Act, including sexual orientation. And still another is Senate Bill 11 by Sen. Carole Migden, D-San Francisco, which would expand "domestic-partner" rights now held by same-sex couples and opposite-sex couples over 62 years old to all opposite-sex couples over 18 years of age.&lt;br /&gt;&lt;br /&gt;Assembly Bill 102 by Assemblywoman Fiona Ma, D-San Francisco, would, among other things, allow same-sex couples registering as domestic partners to change their names, and anti-gay rights groups say it's another step toward legalizing same-sex marriage. Hillary Rodham Clinton of New York, Sen. Barack Obama of Illinois and former Sen. John Edwards of North Carolina, all Democrats, could beat their Republican rivals if the election were held today.&lt;br /&gt;&lt;br /&gt;Clinton, in a poll of 800 likely voters done Aug. 15-16 by Rasmussen, beat Sen. John McCain of Arizona by two points and former Massachusetts Governor Mitt Romney by 11 points. Neither GOP candidate supports civil unions.&lt;br /&gt;&lt;br /&gt;In earlier polls by Quinnipiac, NBC News and Fox News, Clinton also beat former New York Mayor Rudy Giuliani by an average of five points.&lt;br /&gt;&lt;br /&gt;Quinnipiac’s poll of 1,545 registered voters was conducted Aug. 7-13; the NBC News poll of 1,005 adults was done July 27-30; and the Fox News poll of 900 registered voters collected its data July 17-18.&lt;br /&gt;&lt;br /&gt;Giuliani’s campaign, which has long opposed civil unions that represent “the equivalent of marriage,” told the Boston Globe this month that the GOP frontrunner backs only domestic partnerships similar to those extended to couples in New York City.&lt;br /&gt;&lt;br /&gt;Joe Tarver of Empire State Pride Agenda said the city law, which primarily ensures benefits to the partners of public employees, does little for other gay city residents.&lt;br /&gt;&lt;br /&gt;“Unless you’re a city employee, you don’t get much of anything except a piece of paper,” he said. “And you may or may not be in a position to use that with your employer.”&lt;br /&gt;&lt;br /&gt;Tarver said the nation’s next president should support civil unions, if not marriage equality, and Giuliani’s stance comes up short.&lt;br /&gt;&lt;br /&gt;“It has been disappointing to see him pivot away from some of our issues,” he said, “particularly where he stands on recognizing our families.”&lt;br /&gt;&lt;br /&gt;Giuliani also comes up short in polls when pitted against Obama and Edwards.&lt;br /&gt;&lt;br /&gt;Obama and Giuliani tied in this month’s Quinnipiac poll. That poll also shows Obama besting McCain by four points, while a Rasmussen poll of 1,029 likely voters conducted July 16-17 shows Obama topping Romney by nine points.&lt;br /&gt;&lt;br /&gt;Edwards faired similarly. Quinnipiac’s poll shows him one point ahead of Giuliani and beating McCain by eight points. In last month’s Rasmussen poll, Edwards won by seven points against Romney.&lt;br /&gt;&lt;br /&gt;Dan Pinello, a gay City University of New York government professor, said it’s unusual for early polls to so heavily favor one political party.&lt;br /&gt;&lt;br /&gt;“Usually, you’re pitting the lead candidate of one party against the lead candidate of another party,” he said. “It seems that any Democrat is going to beat any Republican.”&lt;br /&gt;&lt;br /&gt;But not all Democratic candidates are celebrating the early polls.&lt;br /&gt;&lt;br /&gt;Rep. Dennis Kucinich, who supports marriage equality for same-sex couples, lost in a Rasmussen poll that pitted him against Giuliani. In that poll of 1,200 likely voters, conducted July 27-29, Kucinich lost by 14 points.&lt;br /&gt;&lt;br /&gt;Despite the favorable polling for civil union supporters, Pinello noted that a win by one of those candidates could represent only a symbolic victory for gay Americans.&lt;br /&gt;&lt;br /&gt;He said presidents have “no real power” over civil unions or marriages.&lt;br /&gt;&lt;br /&gt;“States are the primary sources of regulation of marriage and other related issues,” Pinello said. “So at most, the president can serve as the kind of figurehead or bully pulpit person, to be a voice of inspiration for others to act.”&lt;br /&gt;&lt;br /&gt;Activists, however, noted White House support would be a key step toward achieving expanded rights for gay couples. Solmonese said it’s therefore important that the leading candidates support civil unions.&lt;br /&gt;&lt;br /&gt;“To me, how they move us in the direction of marriage or civil unions or the benefits that same-sex couples would like to enjoy, that is a much more comprehensive conversation,” he said. “It’s about moving public opinion.”&lt;br /&gt;&lt;br /&gt;Tarver agreed. This is the latest:&lt;br /&gt;&lt;br /&gt;A group called Family Council wants to make it illegal for a couple living together - gay or straight - to adopt children, if voters approve the change.&lt;br /&gt;&lt;br /&gt;The wording on a proposed ballot measure that would bar gays and lesbians from actually adopting children has been submitted to the Arkansas Attorney General. The group, working out of Little Rock, wants to ban unmarried sexual partners who live together from adopting or becoming foster parents.&lt;br /&gt;&lt;br /&gt;If it is approved by Attorney General Dustin McDaniel the Arkansas Family Council would be able to begin collecting the 61,974 signatures of registered voters needed to have the question put to voters in 2008.&lt;br /&gt;&lt;br /&gt;“As we looked into this issue, we discovered that cohabiting heterosexual homes were not good places for children, either,” said Jerry Cox, president of the Family Council.&lt;br /&gt;&lt;br /&gt;Unlike a Family Council bill that lawmakers rejected in the recent legislative session, the proposed ballot initiative doesn’t target gays specifically. But gays and lesbians who live as couples need marriage equality, and want to grow families. The 2005 bid passed both the House and Senate - the second legislative body in the nation to approve a measure allowing same-sex couples to marry.&lt;br /&gt;&lt;/div&gt;&lt;br /&gt;&lt;div&gt;Schwarzenegger said in vetoing it that the issue should be decided by voters.&lt;br /&gt;&lt;/div&gt;&lt;br /&gt;&lt;div&gt;Called the Religious Freedom and Civil Marriage Protection Act it would amend the Family Code to define marriage as a civil contract between two persons instead of a civil contract between a man and a woman, and again reaffirms that no religious institution would be required to solemnize marriages contrary to its fundamental beliefs.&lt;br /&gt;&lt;/div&gt;&lt;br /&gt;California law allows same-sex couples to register as domestic partners, which gives them many state protections. However, domestic partnership remains a separate institution from marriage and shuts out same-sex couples from the universal recognition and consideration married couples enjoy, LGBT activists say.&lt;br /&gt;&lt;br /&gt;Meanwhile, the California Supreme Court will hear arguments later this year in three cases wrapped together on the issue of the constitutionality of preventing same-sex marriage.  On Friday attorneys in the case submitted answers to a series of questions posed by the court earlier this year.&lt;br /&gt;&lt;br /&gt;The justices sought the answers after both sides in the case filed their initial briefs in June, saying the briefs failed to address three key issues. &lt;br /&gt;&lt;br /&gt;First, the court asked for a detailed description of the differences between the legal rights accorded by domestic partnerships and those of marriage under California law. California has one of the nation's most inclusive domestic partner laws providing many of the rights of marriage, but not all.&lt;br /&gt;&lt;br /&gt;The second question asked for the lawyers' positions on what marriage rights, if any are enshrined in California's constitution. The question is important because only a constitutional amendment could alter those - not the legislature nor a voter initiative. &lt;br /&gt;&lt;br /&gt;That question led to the third, involving Proposition 22, an initiative passed by voters in 2000.
