Police says teens fabricated assault story, charged with filing false report

The following piece is actually the latest in a series of updates on the page (you can see the updates in the timeline as you scroll down the page at the link). It is encouraging to see that while the photo of the man was released for identification, he isn't named, and the police have been very proactive to make it known that he was falsely accused.

In Kingsport, Tennessee, three teenagers were charged with filing a false police report after claiming a man with a baseball bat attacked them at a Kingsport school, making sexual advances in the process.

According to Kingsport police, the vindictive juveniles had in fact been vandalizing a baseball dugout on the property, with the good Samaritan stepping in to stop them. The youths responded by snapping the man's photo, showing it to a mother, and concocting the story of an assault. The mother called police, setting off a brief search for the purported assailant before he was exonerated.

The juveniles charged were 13, 13 and 15 years old. They were jumping on a tin roof on the baseball field's dugout. The concerned citizen approached the teenagers and told them to stop, adding they could hurt themselves.

There were also reports of juveniles attempting to vandalize street signs in the area, striking them with a skateboard. The concerned citizen took a photo of the three youths at the ball field. The three juveniles left, then returned a short time later. They then used a cell phone to snap a photo of the man. One of their mothers was shown the picture — and fed the story that they had been assaulted and told to take off their pants. The mother called police, with all the teenagers allegedly relaying the fictitious account to investigators.

The violent and sexual nature of the claims were taken seriously by police. Police issued a public e-mail alert containing the man's photo. Here was the message:

"Police are attempting to locate a man allegedly involved in an altercation with three juveniles at a Kingsport school.

"One of the victims snapped a photo of the man with their phone, with police asking the public to help identify him.

"The incident allegedly occurred at approximately 3:20 Saturday afternoon at John Sevier Middle School, 1200 Wateree Street. Kingsport police say three children, identified as teenaged, were playing on school grounds when approached by the suspect.

"Anyone with information on the man, pictured above, is asked to contact Kingsport police at (423) 229-9429 or (423) 246-9111. The incident is under investigation."

Contents from the KPD message were subsequently distributed across area media outlets.

Police say the e-mail alert, and response it generated from the public, helped locate the man in the picture — and determine the minors' story was false. The teens were interviewed by police once again, allegedly admitting their original account was totally fabricated.

They have each been charged with filing a false police report and will go through the juvenile court system. Other charges may also be pending.

Police expressed gratitude to the man who stepped in to halt the juveniles' vandalism of the dugout. He said the man expressed no animosity towards police for releasing his photo while they were gathering information on the incident.

"He was doing what he was supposed to do as a good citizen," said a police representative. "And (the juveniles) retaliated in one of the worse ways you can."

Police probe false ‘rape’ claim at Barshaw Park

POLICE sealed off part of a busy Paisley park after they received a report that a young schoolgirl had been raped.

Tape was used to close a section of Barshaw Park, in the town’s East End, as an investigation got under way.

The alarm had been raised after a girl, believed to be aged 13 or 14, told a pal that she had been attacked by an unknown man at the park at around 10pm on Saturday.

The Paisley Daily Express understands that both girls had been drinking alcohol and the friend then reported the matter to police.

Cops soon arrived at Barshaw Park to cordon off the area in order to preserve the scene.

However, when officers quizzed the alleged victim on Sunday morning, she told them she hadn’t been attacked.

Police could be seen at the park for most of Sunday morning before taking down the tape later that day.

A spokesman has confirmed that a rape allegation had been made on Saturday night but, following an investigation, it became clear the girl’s claims had “no foundation”.

Officers will now be clamping down on anti-social behaviour at Barshaw Park as the summer months get nearer.

Inspector Eddie Gray, who is based at the Mill Street police office in Paisley, told the Express: “This was an incident that was blown out of proportion due to young people consuming alcohol at the park.

“As the nights get brighter, we are aware of a number of youths congregating at Barshaw Park to drink alcohol. It is something that we see every year and we’ll be using officers on plain-clothes patrol to target this behaviour.

“We’ll also be speaking to local licence holders in the area.

“We are confident that the shopowners would not sell to underage youths but we want to make them more aware of the possibility of agent purchases, which involves people over the age of 18 buying and providing alcohol to youngsters.”

Woman's report of sexual assault was fake, authorities say

A woman admitted Monday to fabricating a report of a sexual assault in an unincorporated portion of Santa Ana, authorities said.

A day after telling Orange County Sheriff's Department officials that she had been grabbed from behind, dragged to a dirt lot and sexually assaulted in the 18000 block of Ervin Street, the woman admitted to deputies that she had made up the report, said Jim Amormino, a Sheriff's Department spokesman.

Sheriff's deputies Monday contacted the woman, who they did not identify, on an unrelated matter when she admitted to the false report, Amormino said.

The woman was admitted into a hospital for a 72-hour mental-health hold, Amormino added.

In a few days, FRS will be getting a new name that is consonant with our mission, at a new address. We are also be adding new bloggers, and are shedding any hint of ideology. Although in the past we have tolerated some angry venting in comments from some readers, we are now adopting a zero-tolerance policy. We need to zealously disassociate ourselves from any hint of misogyny or hatred of women. If you think a woman has wronged you and are here for "proof" that women are in some sense evil, you've come to the wrong blog. Except for some truly disturbed individuals, awowed feminists do not support wrongful accusations and charges against innocent persons.

FRS decided last night that it will have an attorney examine what ought to be done, if anything, to remedy the SPLC's misapprehensions about this blog, which have been well-publicized here and elsewhere the past several days. At the very least, we need to make clear we can't tolerate our name being besmirched in this manner, by anyone, and we'll be examining our options. We will not be discussing this publicly.

For our part, we need to insure that we don't give our detractors even a little ammunition to smear us. That our message has become even a little controversial is my fault. It's very rarely what we say, but how we say it. We need to carefully watch both. We owe it to the wrongly accused, especially the young men who’ve told us they were falsely accused, and that our blog was instrumental in their decisions not to take their own lives.

We are very serious about our mission, and we realize that our mission is not popular. We have a responsibility to deal with these issues in a careful, serious manner, and will be watching more carefully that we do just that.

Three men cleared after rape charges proved false

On January 16th of this year just after 9:00 a.m.36 year old Lynnea Dawn Graves and 32 year old Jada Simone Holloway reported to police they were missing personal items and believed they had been drugged. They also told police they didn't recall what happened yet told police they believed they may have been sexually assaulted. The women said they had attended the Baby Bash concert at the Phaze bar in Loveland, on Sunday evening, January 15th and don't remember anything after leaving the bar until they woke up the following morning at the Hilton. Hotel surveillance images show they checked into the Hilton around 1:30 a.m. with three unidentified males.

"Since the original report we've done multiple interviews with people who have been involved and we've identified the three males," said Sgt. Kristy Volesky with the Crimes Against Persons Unit of the Fort Collins Police Department.

It was determined the parties had engaged in consensual sex.

"Based on all the interviews that we've done and the statements received the sexual contact that occurred was consensual," Volesky said.

As a result of the investigation, the two women were then arrested.

Lynnea Graves and Jada Holloway have been charged with attempting to influence a public servant and criminal extortion, and Jada Holloway's been charged with both of those crimes as well as with criminal tampering," said Volesky.

Police say that during their investigation the statements by the two women began to change.

"To a certain extent we've had them change their statements which has kind of played into the probable cause to charge them," Volesky said.

As a result the three men have been cleared of any wrongdoing.

"We presented the case to the District Attorney's office and determined there's not probable cause to charge the males with sexual assault," said Volesky.

Warrants were issued and the women turned themselves in to the Loveland Police Department on Wednesday, February 29.

A follow up to our story HERE. My only question is, why is it necessary to file suit to have the conviction overturned, and his name removed, on a proven false accusation? Shouldn't that be an automatic process? One would like to think that in the interest of fairness and justice, this would happen as soon as the individual was determined to be innocent.

The Virginia Supreme Court ruled Friday that a Virginia man falsely accused of rape in 2007 can sue to have his original conviction overturned and his name removed from the state’s sex offender registry.

The ruling represents a major victory for Edgar Coker, Jr. and his family. The family has fought for four years to have his initial rape conviction set aside. Coker, then 15, spent 17 months in a state juvenile facility after he plead guilty to raping a 14-year-old friend. His attorney recommended the plea rather than risk adult charges and a lengthy term. Soon after he went to prison, his accuser recanted.

In its opinion, the court said that the Stafford Court erred in 2009 when it said that it did not have jurisdiction to hear Coker’s claim that he received ineffective counsel.

On behalf of the Stafford Court, the state attorney general’s office argued in January that the Stafford Court was correct because when Coker’s lawyers filed the claim, Coker was on parole but had been released from prison. They argued that the court no longer had jurisdiction to hear his claim.

The court saw it differently. “Jurisdiction did not end because [Coker] was released from detention during the course of the proceeding,” the court wrote. The court also agreed with Coker’s attorneys that Coker still is impacted by the effects of the false accusal and conviction: He remains on the sex offender registry. As a result, he was arrested last year for attending a Friday night football game at his high school alma mater.

Friday’s decision clears the way for Coker, now 20, to have another day in court in Stafford. The family has long contended that Coker’s attorney, Denise Rafferty, failed to investigate the case fully and then advised him to plead guilty because, she said, there was DNA evidence linking him to the crime. But a lab report shows a DNA test was never conducted. Rafferty has said she did everything she could to help the family mount a defense.

Coker’s mother, Cherri Dulaney, said that after so much hard work she and her family were relieved that they will have another chance to help their son. “I was speechless, ecstatic in fact,” she said after hearing the news Friday morning. “We had a good feeling about [their case] but...it seems that the light at the end of the tunnel is getting a little brighter.”

Woman charged with falsely reporting kidnap, rape

If you see someone who looks like either of the men pictured, do not panic, and do not call the police. The men pictured were apparently concocted out of whole cloth by a woman police now say lied about being kidnapped and raped.

On February 16, 2012, Jennifer Marie Shipley, 32, of Marietta, Georgia, claimed she had been kidnapped and raped over the course of two days in January 2012. The police asked for the public’s help identifying two men wanted in the attack. These artist sketches appeared in the news report.

According to the news report: "Police said the attack began on Jan. 17, when the woman was walking along Windy Hill Road near South Cobb drive in Smyrna. About 8 p.m. that night, she was forced at gunpoint into a 1990s gold Chevrolet Caprice and taken to an unknown location, where she was beaten and sexually assaulted, according to police." Shipley claimed she wasn't released for two days.

One of the suspects was described as a black male with dreadlocks in his early 20s, 6 feet 2 and 140 pounds. The other suspect was described as a Latino male in his early 20s with short, black, spiked hair, 5 feet 2 and 150 pounds. Ms. Shipley is white.

Now police say the kidnapping and the rape never happened. Ms. Shipley has been arrested and charged with making the incident up. Police did not give a motive for Shipley's actions. Police say they have obtained evidence that led to Shipley’s arrest but did not provide details on the evidence. She was charged with one count of making a false statement.

An organization branded FRS a 'hate site' -- and here is its 'proof'

An organization called the Southern Poverty Law Center thinks this site is misogynistic. The only specific post of ours it cites to "evidence" this epiphany is this one.

By no rational measure could that post be considered inappropriate in any manner, much less "hate" speech. I hadn't looked at that post for a while, but I am laughing out loud now -- because someone who obviously didn't read it assumed it had to be hate speech. Why? Let us be brutally honest: that conclusion had nothing to do with that particular post. They've branded us haters because we have the audacity to give voice to persons wrongly accused of heinous sex crimes, and it doesn't fit their preferred narrative when we reveal that some accusers lie about rape. They can't attack our posts regarding the injustices to the wrongly accused because they'd look like monsters, so they latch on to anything they can find in order to brand us as haters, even if the thing they cite doesn't remotely support their conclusion. The SPLC's citation to that post only underscores the inappropriateness of including this blog on their list and raises serious questions about its honesty.

One of the SPLC writers treated Amanda Marcotte -- who has written some truly hateful things -- as a victim. See here. Compare Ms. Marcotte's statements in the link to our post that the SPLC found so objectionable, linked above, and then tell me, who foments hatred? The question scarcely survives its statement.

Anyone who bothers to read the post the SPLC cited knows that the gist of it was to gently chide the mainstream media (the SPLC says we "attacked" a woman, which is flat-out absurd, to put it charitably) for quoting, without comment, persons who claim women are better than men ("it takes a woman to get things done!"). That, of course, is as silly as saying "it takes a man to get things done." Our take is akin to liberal icon Bill Maher's observation that statements touting women's superiority often elicit applause, a peculiar and fascinating phenomenon I had never noticed until I heard Mr. Maher say it.

The Southern Poverty Law Center, self-anointed arbiters of evil, I am certain, will smugly dismiss our point here. But it should know that our blog has received emails from several young men who’ve told us they were falsely accused, and that our blog was instrumental in their decisions not to take their own lives.

It should also know that some extremist feminist bloggers seem eager, for reasons known only to them, to shut us down. See, e.g., here. I pray that if those extremists succeed in silencing us that the SPLC has resources in place to support persons wrongly accused of heinous sex crimes, because without our Web site, some innocent young men might make irreversibly tragic decisions.They have very, very few venues that even acknowledge their ordeal, much less support them. Hopefully they won't stumble onto one of those extremist sites that would happily treat them as rapists.

The libel by Southern Poverty Law Center is twisted beyond words, and I'm not sure what we're going to do about it yet.

Woman falsely accuses one night stand of rape after he forgot her name

Christine Jordan, 25, was convicted of perverting the course of justice and sentenced to two years behind bars after her rape lie caused an innocent 27-year-old man to be wrongly arrested for rape.

Jordan had consensual sex with the victim. The victim testified that he saw Jordan several days later at a pub, and when he could not remember her name, she gave him "an evil look." Within minutes, police arrived and arrested him on suspicion of rape. He was held in custody overnight.

Jordan falsely claimed that the victim had followed her home from a bus stop, and that, as she opened the front door, he forced himself inside and raped her.

It took a jury less than two hours to unanimously find Jordan guilty of perverting the course of justice.

The sentencing judge, Jonathan Howard, slammed Jordan's false claim as "a tissue of lies." He explained: "Because rape is such a repulsive crime false allegations of rape can have serious consequences. Most obviously for the innocent man who has been falsely accused. But it also has the consequence that you think genuine claims may be false. There is an enormous affect on probable convictions in genuine complaints. These are the reasons why the offence you have committed is so serious. It undermines the whole principles of justice in relation to an offence which is a repulsive crime. Your false claim in this case, made three days after the incident, was a complete tissue of lies. I have to take into account the gravity of the offence."

The victim's mother told a reporter after the hearing that "she [Jordan] deserved it, but the damage has been done. I am glad that the judge took it seriously. This has destroyed [the victim] and my family. [His] friends said he was always so happy, they have stood by him through this. He would never do anything like this. He is a very angry person still."

Jordan's defense counsel said Jordan had been bullied at school and would be vulnerable in prison.

Jordan is pregnant with twins to another man and will now give birth behind bars.

Southern Poverty Law Center Hurts Advocacy by Treating Amanda Marcotte as a Victim

In Arthur Goldwag's article about hate excesses of the so-called men's rights movement, he paints Amanda Marcotte as a victim. This is unfortunate, and detracts from whatever legitimacy Goldwag's piece might have had. The fact that Mr. Goldwag either doesn't know about, or overlooks, hateful, inflammatory statements Ms. Marcotte has made, calls into question either his research skills or his impartiality.

Baby P dad sues People over 'gravest libel imaginable'

The natural father of Baby P is suing the publishers of a Sunday newspaper for £130,000 damages for printing "one of the gravest libels imaginable".

A judge was told the father, who cannot be named for legal reasons, was wrongly accused in The People of being a sex offender convicted of raping a 14-year-old girl.

The newspaper's publishers, MGN Ltd, later apologised and offered to pay damages.

However the offer came late and was not enough to compensate the father, referred to as "KC", for the suffering and distress the "completely false" reports had caused, said his QC James Dingemans.

The allegations were contained in two paragraphs in a crime supplement about Baby P's mother, who had separated from KC. They appeared in The People on 19 September 2010 in an article entitled "Tortured to death as mum turned a blind eye".

Baby P, later named as Peter Connelly, was just 17 months old when he was found in a blood-splattered cot at his mother's home in Tottenham, north London, in August 2007. He had more than 50 injuries.

Tracey Connelly was jailed in 2009 after admitting causing or allowing his death. Her boyfriend Steven Barker and their lodger, Jason Owens, who was Barker's brother, were found guilty at the Old Bailey of the same charge.

Dingemans said the allegations about the natural father in the wake of the Baby P tragedy were "shocking and appalling". However MGN treated him "as if he didn't really matter".

Heather Rogers QC, appearing for MGN, told the High Court: "This was a mistake that MGN regrets and it has apologised to the claimant, and I repeat that apology on its behalf in this court."

However she denied KC had been badly treated, or that MGN had conducted any kind of "campaign" against him, or dismissed his legitimate complaint.

'Shocked beyond words'

KC himself said in a statement before the court: "I was shocked and upset beyond words. "I thought that the whole world would think that I was a really awful man.

"I could not believe that such an appalling, untrue statement had been published about me to the whole country, I feel that the defendant's whole approach has been to pretend I do not exist, because they did not contact me about the story, to treat me and correspondence on my behalf as an annoyance as not worth their time, and to belittle me and my feelings."

Dingemans said of KC: "He is a man of good character, with no previous convictions living with the fall-out (of Baby P's death) day-by-day, and never a sex offender - never guilty of rape."
The rape conviction had been imposed on Baby P's maternal grandfather, the QC told Mr Justice Bean.

The first offending paragraph in The People article read: "At just 16 she [Tracey Connelly] met the father of Peter - 17 years her senior - and the two were married in Haringey Civic Centre. Her new husband was a sex offender".

The second, further down in the story, read: "Peter's real father had also reappeared and had begun making frequent visits - something that would have set off alarm bells at social services as he had been convicted in the 1970s in Leicester for raping a 14-year-old girl.

The inaccurate reports appeared in the middle of care proceedings relating to KC's other children and, as a result, he was put in fear of losing them, said Dingemans. He added: "It is not sustainable to try and suggest this was a narrow publication."

The newspaper had a circulation of about 500,000 and a readership of about 1.2 million persons throughout the UK. The QC said: "This was a publication to the whole world that the father of Baby P was a sex offender and rapist. They were the gravest allegations one could possibly make."

An appropriate award was the sum of £130,000, Dingemans told the judge.

No deliberate delays

Dingemans said at the time the rape allegations appeared, the family court proceedings in relation to KC's other children were ongoing and it was "one of the most pressurised times" of his life.

The court-appointed guardian looking after the children's interests became aware of The People reports.

"KC did not know how she became aware of them or what the effect would be, which caused our client great concern and anxiety", said Dingemans.

Rogers said on behalf of MGN that the publishers had done nothing other than promptly acknowledge the error that had been made. There were no deliberate delays, and MGN was motivated by the wish to put the error right.

The words KC complained of were not published prominently but were in the eighth and 24th paragraphs of a crime supplement that focused plainly on Tracey Connelly. There was no repetition online or elsewhere.

MGN had given the published apology greater prominence in the newspaper than the article and set the record straight "beyond any doubt", argued Ms Rogers. The apology and correction vindicated KC's reputation.

He had been offered "a substantial sum of damages" over the publication, but he had refused it. KC was not named in the article, and, as his anonymity remained protected, there was no photograph or other image enabling people in the street "to point the finger" at him, said Rogers.

His uncle had been the first to telephone him about the article, but KC did not suggest that his uncle thought it other than a mistake.

It was to be expected that his family and friends would know that he had no criminal convictions.

The case was "nowhere near the top of the range" where very serious allegations had been made, repeated and unsuccessfully defended.

Reserving judgment, Mr Justice Bean said he would hand down his decision "as soon as I can".
