<p><strong>HUD TAKES ACTION TO SPEED RESALE OF FORECLOSED PROPERTIES TO NEW OWNERS</strong></p>
<p>In an effort to stabilize home values and improve conditions in communities where foreclosure activity is high, HUD Secretary Shaun Donovan today announced a temporary policy that will expand access to FHA mortgage insurance and allow for the quick resale of foreclosed properties.<span id="more-116"></span></p>
<p>The <strong>waiver will take effect on February 1, 2010</strong> and is effective for one year, unless otherwise extended or withdrawn by the FHA Commissioner.</p>

<p>WASHINGTON – Oct. 1, 2009 – A study of 24 million credit files by national credit bureau Experian and consulting company Oliver Wyman finds that homeowners with high credit scores are 50 percent more likely to deliberately walk away from a mortgage than lower-scoring borrowers.</p>
<p>The industry calls these “strategic defaults,” and their numbers grew to 588,000 in 2008 – double the total in 2007 and well beyond most earlier estimates.</p>
<p>The study determined:</p>
<p>• Strategic defaulters tend to go straight from paying their mortgages dependably to not paying at all.<br />
• Strategic defaulters are heavily concentrated in negative-equity markets like California and Florida.<br />
• Two-thirds of strategic defaulters have only one mortgage.<br />
• Most likely to default are homeowners with large balances and the highest credit ratings.</p>
<p>Piyush Tantia, an Oliver Wyman partner and a principal researcher on the study, said strategic defaulters “are clearly sophisticated” and look on the decision to default as a business strategy.</p>
<p>“Well, I’m $200,000 in the hole on my house, and yes, I’ll damage my credit,” Tantia says defaulters admit. But they see the credit hit as a less onerous choice to their long-term bottom line than continuing to own the house.</p>

<div><span style="font-size: x-small; font-family: Verdana;">Throughout my professional life as a software architect, information technology consultant, business owner and real estate investor I have had the pleasure of working with different types of attorneys in a variety of industries.  Like most people, I had to learn from the school of &#8220;hard knocks&#8221; when hiring an attorney. </span></div>
<p><span style="font-size: x-small; font-family: Verdana;">I can remember one time when another investor purposely tried to steal a deal from me but couldn&#8217;t because I clouded the title by filing an <em>Affidavit And Memorandum Of Agreement Concerning Real Estate. </em><strong>This simple, yet powerful document stopped them dead in their tracks and helped me win my case!</strong></span></p>
<p>Unfortunately, my real estate attorney made a major mistake in the settlement agreement that cost me $20k! When I approached him and asked him what he was going to do to fix it he said, &#8220;Absolutely NOTHING!&#8221;  He wouldn&#8217;t admit he did anything wrong.  What a bunch of crap!  I was so mad I wanted to rip his head off.  Of course I maintained my composure, learned the lesson, and looked at it as if I just attended another <em>seminar</em>&#8230; <img src='http://stevenjacksonblog.com/wp-includes/images/smilies/icon_smile.gif' alt=':-)' class='wp-smiley' /> </p>
<p>Have you ever tried to hire an attorney to sue another attorney? Good luck! Come to find out, this attorney had pending lawsuits against him.  What a shock!  If I would have only known this BEFORE I hired him&#8230;</p>
<p>To help you minimize and hopefully prevent this from happening to you I sat down in my thinking chair, evaluated all of my personal experiences with attorneys and created a list of questions to ask while interviewing an attorney you are considering hiring.</p>

<p>Florida home sales are up 30% statewide in March over previous year, up 33% from February, and Condo sales are up 25%.</p>
<p>California home sales are up 65% statewide in March over previous year and unsold inventory is now only 5 months. That is down 12 months for previous March.</p>
<p>Here is a possible indicator of things to come; the median price range of houses may be bottoming out.  According to the California Association of Realtors, the median price of homes sold was up 2.2% for the past month.</p>
<p>Thirty year fixed mortgage rate loans fell to an average of 4.6%.  Fifteen year rates average around 4.5% according to the Mortgage Brokers Association</p>

<div><span style="font-size: x-small;"><strong>One of the factors contributing to the collapse of the housing market was collusion between appraisers, mortgage brokers, attorneys, and brokers. They were inflating values and creating comparables.  A new law came into effect on May 1, 2009 is aimed at stopping that.</strong></span></div>
<p><strong> </strong><span style="font-size: x-small;">The Home Valuation Code of Conduct may have a huge affect on real estate investors. Typically, investors have long-term relationships with mortgage brokers and appraisers because they rely on quick and responsive service to purchase or refinance investment properties.</span></p>
<p>HVCC essentially removes the ability of a local mortgage broker to choose their own appraiser and moves the relationship management to appraisal management services or the central banks home office.</p>
<p>Here are some of the key points from <a href="http://lenderama.com/">mortgage blog Lenderama</a>:</p>
<p>1) Disables brokers from choosing appraisers or having any contact with appraisers, as these tasks are delegated to lenders.  This creates a bias that shifts power to large institutions.</p>
<p>2) Requires independent appraisers to join AMC&#8217;s (Appraisal Management Companies) where they are forced to pay 40 percent or more of their income to the AMC, ending the existence of independent appraisers.</p>
<p>3) Since appraisals are not in the broker&#8217;s name but the lender&#8217;s, if you or your client needs to change lenders, a new appraisal is required.</p>
<p>4) If consumers want to shop their loan, they must pay for a new appraisal; they can&#8217;t have an appraisal reassigned.  This creates a disincentive to shop for the best deal, which is never good for consumers.</p>
