HUD TAKES ACTION TO SPEED RESALE OF FORECLOSED PROPERTIES TO NEW OWNERS

In an effort to stabilize home values and improve conditions in communities where foreclosure activity is high, HUD Secretary Shaun Donovan today announced a temporary policy that will expand access to FHA mortgage insurance and allow for the quick resale of foreclosed properties.

The waiver will take effect on February 1, 2010 and is effective for one year, unless otherwise extended or withdrawn by the FHA Commissioner.

Scott Pelley from 60 Minutes reports on the mortgage crisis that’s far from over, with a second wave of expected defaults on the way that could deepen the bottom of the U.S. recession.

WASHINGTON – Oct. 1, 2009 – A study of 24 million credit files by national credit bureau Experian and consulting company Oliver Wyman finds that homeowners with high credit scores are 50 percent more likely to deliberately walk away from a mortgage than lower-scoring borrowers.

The industry calls these “strategic defaults,” and their numbers grew to 588,000 in 2008 – double the total in 2007 and well beyond most earlier estimates.

The study determined:

• Strategic defaulters tend to go straight from paying their mortgages dependably to not paying at all.
• Strategic defaulters are heavily concentrated in negative-equity markets like California and Florida.
• Two-thirds of strategic defaulters have only one mortgage.
• Most likely to default are homeowners with large balances and the highest credit ratings.

Piyush Tantia, an Oliver Wyman partner and a principal researcher on the study, said strategic defaulters “are clearly sophisticated” and look on the decision to default as a business strategy.

“Well, I’m $200,000 in the hole on my house, and yes, I’ll damage my credit,” Tantia says defaulters admit. But they see the credit hit as a less onerous choice to their long-term bottom line than continuing to own the house.

:: Top Tips on How to THRIVE in this Economic Downturn 1. Clearly define what inspires you. There’s a big difference between taking action out of inspiration versus desperation. Use this season as an opportunity to hibernate into the recesses of your own mind and define what you choose to create in your next spring.2. Control your focus. Energy flows where attention goes. Are you focusing on lack or opportunity?

3. Feed your mind. What’s your constant mental diet? Do you spend hours in front of the scare news or are you reading good books, attending more positive classes/seminars, watching uplifting DVD’s and listening to powerful CD’s?

4. Strengthen your body. Your physical health and vitality have a tremendous impact on your performance as well as your mental and emotional fitness. Exercise releases stress as well as strengthen your body and mind.

5. Inventory your friends. Doom and gloom attracts more doom and gloom. Surround yourself with opportunity seekers. Figure out, who you should enhance association with, minimize association with, or eliminate association.

6. Quiet your mind. Take time to meditate daily and to slow down if only for a few minutes. Ten to fifteen minutes of meditation will relieve hours of stress and increase creativity and resourcefulness.

7. Rid your life of escapist activities. Overindulgence in TV, sleep and alcohol only accelerates the problems you’re attempting to avoid.

8. Make a daily gratitude list. Focusing on all the good, gifts and God in your life puts you in the right line of thought, feeling and their subsequent actions, which will attract and create more good, gifts and God.

9. Change your attitude. Realize that everything that’s happened in your life thus far is here to serve you, teach you and help you grow. Find the lessons in your past results, forgive yourself for anything you could have done better and apply the lesson to move forward and create a better future.

10. Get resourceful. For the next seven days, go to a place where you can have uninterrupted time… Come up with 10 new ideas to grow your income, create new results and improve your life. You cannot leave your spot until you have 10! And no editing! All ideas are good ideas.

Now take your list of ideas and pick the three to five most powerful and leveraged ones to put into action. Pick these 3-5 based on: ease of implementation, rate of return and speed of return.

I can remember one time when another investor purposely tried to steal a deal from me but couldn’t because I clouded the title by filing an Affidavit And Memorandum Of Agreement Concerning Real Estate. This simple, yet powerful document stopped them dead in their tracks and helped me win my case!

Unfortunately, my real estate attorney made a major mistake in the settlement agreement that cost me $20k! When I approached him and asked him what he was going to do to fix it he said, “Absolutely NOTHING!”  He wouldn’t admit he did anything wrong.  What a bunch of crap!  I was so mad I wanted to rip his head off.  Of course I maintained my composure, learned the lesson, and looked at it as if I just attended another seminar…

Have you ever tried to hire an attorney to sue another attorney? Good luck! Come to find out, this attorney had pending lawsuits against him.  What a shock!  If I would have only known this BEFORE I hired him…

To help you minimize and hopefully prevent this from happening to you I sat down in my thinking chair, evaluated all of my personal experiences with attorneys and created a list of questions to ask while interviewing an attorney you are considering hiring.

2) How many clients have you served?
3) How many cases have gone to court?
4) How many cases have you won in court?
5) How many cases that did not go to court and settled out of court did you win?
6) Do you consider yourself aggressive? How so? Do others?
7) Do you leverage the “gray” area legally and ethically?
Do you have any pending law suits against you or any in the past?
9) Have you created a multi-million dollar business and sold it?
10) Do you personally invest in your own _____? (real estate, apartments, businesses, etc)
11) If you hire someone to work for you, how do you know when they have done a great job?
12) Why should I hire you or your law firm?

:: Industry News Real Estate Outlook: Sales Rising in Some Areas

Chicago home sales are up 38% in Cook County, 65% in Lake County, 51% in Kendall County.

Florida home sales are up 30% statewide in March over previous year, up 33% from February, and Condo sales are up 25%.

California home sales are up 65% statewide in March over previous year and unsold inventory is now only 5 months. That is down 12 months for previous March.

Here is a possible indicator of things to come; the median price range of houses may be bottoming out.  According to the California Association of Realtors, the median price of homes sold was up 2.2% for the past month.

Thirty year fixed mortgage rate loans fell to an average of 4.6%.  Fifteen year rates average around 4.5% according to the Mortgage Brokers Association

New Appraisal Law and How it Will Affect Investors

The Home Valuation Code of Conduct may have a huge affect on real estate investors. Typically, investors have long-term relationships with mortgage brokers and appraisers because they rely on quick and responsive service to purchase or refinance investment properties.

HVCC essentially removes the ability of a local mortgage broker to choose their own appraiser and moves the relationship management to appraisal management services or the central banks home office.

Here are some of the key points from mortgage blog Lenderama:

1) Disables brokers from choosing appraisers or having any contact with appraisers, as these tasks are delegated to lenders.  This creates a bias that shifts power to large institutions.

2) Requires independent appraisers to join AMC’s (Appraisal Management Companies) where they are forced to pay 40 percent or more of their income to the AMC, ending the existence of independent appraisers.

3) Since appraisals are not in the broker’s name but the lender’s, if you or your client needs to change lenders, a new appraisal is required.

4) If consumers want to shop their loan, they must pay for a new appraisal; they can’t have an appraisal reassigned.  This creates a disincentive to shop for the best deal, which is never good for consumers.
