There are at least three alternatives to resolve your issue, as follows: private dependency petition, guardianship of a minor or temporary legal custody.  A dependency petition requires, that you allege some type of abuse, abandonment or neglect by the parents.  A guardianship of a minor does not require consent of the parents.  However, the parents would have to be served the guardianship petition.  There would also be a hearing if the parents object or do not respond.  The guardianship petitions are filed in the Probate/Mental Health Division and require annual reports to the court that are not required with the other legal methods to achieve legal custody.  A temporary legal custody petition is with the consent of both parents and can be revoked by either parent.  Upon revocation, either parent could obtain the children who are in your care without your consent.  You should always consult with an attorney, especially if DCF is not willing to initiate dependency proceedings and the children are or could be at risk of harm with a parent or parents.</description>
