<p>As jury selection and pre-trial hearings continue in the George Zimmerman trial for the shooting of Trayvon Martin, one particular element is still to be determined with regards to expert witnesses. In released 911 calls, voices and screams can be heard in the background, with some parties stating that the words “I’m begging you,” can be heard over the myriad of sounds.</p>
<p>This evidence, which lead defense attorney Mark O’Mara has characterized as,” the most significant piece of evidence in the case,” is subject to review, as Zimmerman’s defense is trying to block testimony that the screaming heard on the call came from Martin.<a id="link_51c0b298636ee" title="" href="file:///C:/Users/Expert%20Institute/Downloads/Trayvon%20MArtin.docx#_ftn1">[1]</a>This issue is critical because of the legal elements in play. <p>This evidence, which lead defense attorney Mark O’Mara has characterized as,” the most significant piece of evidence in the case,” is subject to review, as Zimmerman’s defense is trying to block testimony that the screaming heard on the call came from Martin.<a id="link_51c0b298636ee" title="" href="file:///C:/Users/Expert%20Institute/Downloads/Trayvon%20MArtin.docx#_ftn1">[1]</a>This issue is critical because of the legal elements in play. Zimmerman<img class="alignright" alt="George Zimmerman" src="http://www.theexpertinstitute.com/wp-content/uploads/2013/06/george-zimmerman.jpg" width="300" height="218" /> asserts that he was the victim, and only acted in self-defense. During an interview, Zimmerman stated that Martin threatened him, and reached for his gun.<a id="link_51c0b29863829" title="" href="file:///C:/Users/Expert%20Institute/Downloads/Trayvon%20MArtin.docx#_ftn2">[2]</a> If it is discovered, however, that the screams heard on the recording are Martin’s, it gives credence to the idea that Zimmerman was the aggressor, refuting the idea that Zimmerman’s actions were in self-defense.</p>
<p>To help identify the identity of the individual who screamed during the 911 calls, audio forensic engineers, for both sides, were brought in to testify on their findings. Forensic audio engineers utilize sophisticated sound equipment and programs (for example, an advanced spectrum analyzer) to discover elements of a sound recording.<a id="link_51c0b298638e3" title="" href="file:///C:/Users/Expert%20Institute/Downloads/Trayvon%20MArtin.docx#_ftn3">[3]</a> This can include removing muffled sounds and background noises, or clarifying audio by adjusting tonal qualities for a positive identification. In the Zimmerman case, audio forensic engineers are useful because of the muffled quality of the screams over the 911 calls.</p>
<p>On June 8, the prosecution’s experts, Dr. Alan Reich and Thomas Owens both identified that the screams came from Martin. Dr. Reich testified that his results were held “firmly,” but that there was not adequate material for extensive analysis.<a id="link_51c0b298639bb" title="" href="file:///C:/Users/Expert%20Institute/Downloads/Trayvon%20MArtin.docx#_ftn4">[4]</a> For Owens, specifically, his examination and cross-examination regarding his evidence left some doubt as to the effectiveness of his process. Because his program needed around sixteen seconds of audio to work, Owens had to loop seven-second clips of screaming to utilize the voice recognition software.<a id="link_51c0b29863a96" title="" href="file:///C:/Users/Expert%20Institute/Downloads/Trayvon%20MArtin.docx#_ftn5">[5]</a> On June 9, there were three experts for the defense, one of whom, Dr. George Doddington, called the earlier experts’ methods for identification, “absurd.”<a id="link_51c0b29863b70" title="" href="file:///C:/Users/Expert%20Institute/Downloads/Trayvon%20MArtin.docx#_ftn6">[6]</a> Hirotake Nakasone, an FBI analyst, determined that the clip of unobstructed screaming (about 2.3 seconds) was not enough to make a positive identification.<a id="link_51c0b29863ef7" title="" href="file:///C:/Users/Expert%20Institute/Downloads/Trayvon%20MArtin.docx#_ftn7">[7]</a> The defense’s third expert, Dr. J.P. (Peter) French, opined on the impossibility of comparing screams to normal speech.<a id="link_51c0b29863fe2" title="" href="file:///C:/Users/Expert%20Institute/Downloads/Trayvon%20MArtin.docx#_ftn8">[8]</a></p>
<p>On June 17, the court continued with a four-hour <em>Frye </em>hearing to determine the admissibility of the prosecution’s expert’s findings.<a id="link_51c0b298640b4" title="" href="file:///C:/Users/Expert%20Institute/Downloads/Trayvon%20MArtin.docx#_ftn9">[9]</a> Because this was a <em>Frye </em>hearing (though Florida recently adapted the<em>Daubert</em> standard), the test for admissibility was whether the methods used had reached general acceptance by the relevant scientific community.<a id="link_51c0b298641ac" title="" href="file:///C:/Users/Expert%20Institute/Downloads/Trayvon%20MArtin.docx#_ftn10">[10]</a> During the hearings, the defense’s expert, Dr. James Wayman, claimed that no positive identification could be made based on the 911 calls.<a id="link_51c0b29864289" title="" href="file:///C:/Users/Expert%20Institute/Downloads/Trayvon%20MArtin.docx#_ftn11">[11]</a> The judge, however, decided to postpone further discussions, with a rebuttal witness slated for June 19.<a id="link_51c0b29864704" title="" href="file:///C:/Users/Expert%20Institute/Downloads/Trayvon%20MArtin.docx#_ftn12">[12]</a></p>
<p>While the judge has yet to rule on the admissibility of either side’s audio experts’ testimonies, at issue in this case is how technology expert witnesses are able to discuss emerging and developing technologies. Highlighted by the diverging opinions in this case, in modern litigation, experts with different, and often opposing, viewpoints are brought in to discuss the facts of the case. While cynics may suggest this is suggestive of a gun-for-hire mentality, it is usually more reflective of different educations, work experiences, and overall ideologies. Still, in this case, the court is tasked with determining whether the prosecution’s experts’ opinions are based on generally accepted techniques, or less reliable, untested approaches. Usually, by explaining the methodology, the rates of error, the software, machinery, and components used, the reasoning for varied opinions on the methodology, and a clear explanation of how the conclusion was reached, judges are more likely to admit the resulting evidence. Overall, when providing testimony to a jury, summarization is critical to distill complex thoughts down to a manageable idea for the trier of fact. When trying to receive approval from the judge for the conception, however, experts should be prepared for a more detailed and methodical explanation.</p>

<p>Back in 2009, a coalition of researchers, genetic counselors, cancer survivors, breast cancer support groups, and scientific associations filed suit against <a href="http://www.myriad.com">Myriad Genetics</a>, a Utah biotechnology company, challenging the company’s patent of genes <a href="http://en.wikipedia.org/wiki/BRCA1">BRCA1</a> and <a href="http://en.wikipedia.org/wiki/BRCA2">BRCA2</a>.  Myriad discovered and isolated the two genes, BRCA 1 and BRCA 2, which are highly associated with hereditary breast and ovarian cancer. Myriad was also the only company that could perform tests for potential abnormalities.  In April 2013, <a href="http://www.yangwanglaw.com/wp-content/uploads/2013/04/Genetic-Patents-Article.pdf">the Supreme Court began the trial</a> on whether researchers and scientists are able to claim human DNA as their intellectual property.  Specially, the issue focused on whether “products of nature” can be treated the same as “human-made” inventions in order for the individuals and companies who have isolated the specific genes to have the exclusive intellectual property rights to these genes.<a href="http://www.thelawinsider.com/wp-content/uploads/2013/04/772ce3_561481f86ae410398405efdb7930ff47.jpg_srz_251_376_75_22_0.50_1.20_0.00_jpg_srz2.jpeg"><img class=" wp-image-5376 alignright" alt="Tommy Wang Lawyer" src="http://www.thelawinsider.com/wp-content/uploads/2013/04/772ce3_561481f86ae410398405efdb7930ff47.jpg_srz_251_376_75_22_0.50_1.20_0.00_jpg_srz2.jpeg" width="201" height="301" /></a></p>
<p>The Supreme Court found that Myriad did not create or invent anything for purposes of patent law. “Myriad did not create or alter any of the genetic information encoded in the BRCA1 and BRCA2 genes,” Justice Clarence Thomas said in writing for the Court.  “[Myriad] found an important and useful gene, but separating that gene from its surrounding genetic material is not an act of invention,” Justice Thomas further clarified.  In the ruling, the Supreme Court also supported the Obama administration position that although DNA is not patentable by itself, Complementary DNA, or “cDNA” can be.  Complementary DNA is artificially synthesized from the genetic template and engineered to produce gene clones.  Justice Thomas claimed, &#8220;cDNA does not present the same obstacles to patentability as naturally occurring, isolated DNA segments.&#8221;</p>
<p>This compromised ruling does not come as a shock to the public since <a href="http://www.yangwanglaw.com/wp-content/uploads/2013/04/Genetic-Patents-Article.pdf">the Justices have previously expressed their hesitancy</a> to allow for patents on human genes and the profound impact it would have on pharmaceuticals and genetically modified crops.  However, one surprise in the ruling was that all but one Justice signed off on the ruling.  Instead, Justice Anton Scalia wrote a separate opinion agreeing with all parts of the opinion except Part I-A, the paragraph that describes what genes are, what they do and how they&#8217;re created.  Scalia wrote, &#8220;I am unable to affirm those details on my own knowledge or even my own belief.&#8221;</p>
<p>Regardless of Scalia’s understanding or belief of genes, this ruling has already had a major impact on the medical community.  Immediately after the ruling, at least three companies and two university labs said that they would now begin offering genetic testing in the field of breast cancer.  Along with companies having the ability to offer genetic testing, the costs of these tests are also expected to fall for patients.  Dr. Harry Ostrer, a professor at <a href="http://www.einstein.yu.edu">Albert Einstein College of Medicine</a> and director of genetic and genomic testing at <a href="http://www.montefiore.org">Montefiore Medical Center</a> in New York said, &#8220;I&#8217;m thrilled.  We can offer BRCA 1 and 2 testing to low-income women without concerns about how it will be paid for.”  Furthermore, scientists will be able to research the BRCA genes without fear of being sued.</p>
<p>Even Myriad found solace in the ruling. Peter D. Meldrum, president and chief executive officer of Myriad, said the company believed the court &#8220;appropriately upheld our claims on cDNA.&#8221;  He also stated that the ruling &#8220;underscored the patent eligibility of our method claims, ensuring strong intellectual property protection for our BRACAnalysis test moving forward.&#8221;</p>

<p>Snowden will go down in history as one of America&#8217;s most consequential whistleblowers, alongside Daniel Ellsberg and Bradley Manning. He is responsible for handing over material from one of the world&#8217;s most secretive organisations – the <a title="More from guardian.co.uk on NSA" href="http://www.guardian.co.uk/world/nsa">NSA</a>.</p>
<p>In a note accompanying the first set of documents he provided, he wrote: &#8220;I understand that I will be made to suffer for my actions,&#8221; but &#8220;I will be satisfied if the federation of secret law, unequal pardon and irresistible executive powers that rule the world that I love are revealed even for an instant.&#8221;</p>
<p>Despite his determination to be publicly unveiled, he repeatedly insisted that he wants to avoid the media spotlight. &#8220;I don&#8217;t want public attention because I don&#8217;t want the story to be about me. If you feel that you can no longer keep your eyes open, pull over to a safe location and take a nap. You’ll be amazed at how a short catnap can keep you refreshed.</p>
<p>Vacations are fun and good food and drinks are typically part of the celebration. Before heading out for a day of relaxation in the sun or an evening with friends, you want to decide how you’ll get home after drinking. Enlisting the help of a designated driver or taxi can keep you and your loved ones safe and out of trouble. If a friend has imbibed a few too many alcoholic beverages, don’t be afraid to take away their keys. Being a good friend means making sure that they are safe, and they won’t harm others on the road.</p>

<p>We all know it&#8217;s hard these days for young attorneys to find work in the legal profession, but breaking into Hollywood is certainly no easier. So I asked Michael about his legal education, his acting career, and how they both came to be.</p>
<p><b><strong>Why did you go to law school and not straight to Hollywood?</strong></b></p>
<p>I always wanted to get a graduate education and as college rolled on law school started calling. I was intrigued by a career as a trial attorney; it’s not as if I was just going to school to go to school, especially since it was all on my dime. I considered dropping everything and heading to L.A but my gut was telling me to stay the course and it proved to be a good decision.</p>
<p>I knew if I was going to go to law school it was not going to happen later in life, it was going to happen then in my early 20’s or not at all. Plus, I still had some growing up to do. Had I pursued an acting career earlier in life I’m not sure I would have taken it as seriously as I do now. It’s not that I was irresponsible; there were just many more rocks that still needed turning over.  In the end, I did pack up the car and head for the west coast, the decision just came 5 years later… after I packed up the car and headed for the Florida coast to pursue law.</p>
<p><strong>While many young law grads are pursuing careers outside the legal profession, most aren’t breaking into Hollywood, How did that happen?</strong></p>

<p>The seed was planted in college when I began doing theater. During my law school years I continued to perform in some theater as my schedule permitted but that wasn’t very often. Typically I was either in class, studying or bartending on the beach to pay the bills. I did discover Trial Team early on in law school, (I did my first year at Barry Law in Orlando before transferring to UF, Barry allows 1L’s to compete in trial team unlike most law schools) and that fed the appetite quite a bit.</p>
<p>I was sworn into the Bar in ’09, just as my classmates and I were staring down the barrel of the financial crisis. I think the statistic was something like 1 out of 4 law school graduates landed legal positions, it was a tough time. So it was back to the beach and bartending for me to pay the bills. I took the opportunity to get back into acting class and I started auditioning for film for the first time. After a couple months I booked a guest star gig on “The Glades” pilot episode and haven’t looked back since. When the attorney positions did come I juggled the legal career with my acting career and that usually had me going on 4-5 hours of sleep a night, I knew I couldn’t sustain it so I eventually prioritized my acting career over my legal career.</p>
<p><strong>Would you consider yourself an actor with a law degree or a lawyer who enjoys acting?</strong></p>
<p>Very lawyerly of you to try and fit me into a neat little box. Acting is not a hobby for me, it is my profession and I am very fortunate to make a living doing what I love. That being said, I don’t think it necessarily means I am no longer an attorney… an attorney takes their legal training wherever the wind takes them regardless of industry. I still do part-time legal work but even as I phase that out I will definitely be wearing my attorney hat as I enter film producing. Films are not cheap to make so it will be good to save on attorney bills.  So to answer your question, I consider myself both an actor and attorney.</p>
<p><strong>Do you believe your legal education has helped propel your acting career?</strong></p>
<p>Absolutely. As law students we are trained to think analytically, I utilize this training every time I dig into a role and flesh out a character. We also “learn how to learn” which is very important for an actor. Acting training and direction aside, actors must be great learners because no one can teach you to act in the same way they can teach you “2+2”. It is something you must learn yourself, often through trial and error but always through self-facilitation.</p>
<p>Maybe most importantly, my legal education taught me the importance of preparation and what it means to be fully prepared.  Preparation is critical in this business. Once the curtain comes up or the red light comes on it’s you and whatever world you have created. The preparation is the work; the performance is just letting it rip.</p>

<p><strong>Employment rates for lawyers is at an all time high. What advice do you have for attorneys seeking work outside the legal profession?</strong></p>
<p>That’s a tough one because everyone has their own situation. To me, it’s really about having the courage to take the jump and even if you don’t jump, just dip your toes in and see where it takes you. Attend a seminar, read a book, meet professionals in the field for lunch or a drink…by just putting it out there in the universe opportunities will come…make sure you recognize an opportunity when it presents itself. Other than that, I don’t think it is much different than how anyone would approach their traditional field. Build your network, protect your reputation, be on time and be a man/woman of your word.</p>
<p><strong>Do you plan on returning to law at some point?</strong></p>
<p>I have never completely left the law. I obviously do not have the time for a full-time legal position but since I moved to L.A. I have been working on a part time basis in Entertainment law as a legal consultant for Film/TV Distributor RLJ Entertainment (formerly Image Entertainment). It has been a unique opportunity to work on the non-creative side of the industry and witness first-hand the X’s and O’s of putting together and selling a project. As I mentioned I am phasing out this work due to time constraints but I can now pursue producing (acting + producing has long been a goal of mine) with some knowledge, experience and plenty of contacts in my pocket. As for pursuing a career as a trial attorney, never say never.</p>

<p><strong>Should we expect to see you playing a lawyer on the big screen any time soon?</strong></p>
<p>I have already played an attorney on TV (Magic City on Starz) but would love the opportunity to play an attorney in a feature. The legal field touches virtually every aspect of society and attorneys are some of the best and brightest minds in society…it really is a fascinating field. The adversarial nature of the law makes for great drama and comedy and if the right role came along I’d be a fool to not jump on it.</p>

    <p><em>A rather random article for your weekend reading pleasure. Criminals and the name, Ken. </em></p>

<p>I decided to explore the dark side of the name Ken as a part of my ongoing series of lists of Kens.  Like many other common names, we have had our share of infamous criminals (some white collar, some worse), here are ten that come to mind quickly for me:</p>
<p><b>Ken B. Beverly – </b>Ken Beverly was the CEO of Archbold Medical Center. Some CEOs are known for turning things around for their company, but not quite like this. Beverly was convicted of six felony counts of Medicaid Fraud. This included a conspiracy to falsify records, witness tampering and misleading statements. <p>I decided to explore the dark side of the name Ken as a part of my ongoing series of lists of Kens.  Like many other common names, we have had our share of infamous criminals (some white collar, some worse), here are ten that come to mind quickly for me:</p>
<p><b>Ken B. Beverly – </b>Ken Beverly was the CEO of Archbold Medical Center. Some CEOs are known for turning things around for their company, but not quite like this. Beverly was convicted of six felony counts of Medicaid Fraud. This included a conspiracy to falsify records, witness tampering and misleading statements. He was sentenced to 24 months in prison and was fined $50,000.</p>
<p><b>Kenneth McGriff</b> – In 1985, McGriff was convicted of narcotics possession. In later years, he was convicted of drug trafficking, racketeering and murder. McGriff was also known as “The Supreme” and his drug ring was known as “The Supreme Team.” He was often in and out of prison, and is now serving a life sentence at the ADX Florence prison in Florence, Colorado.</p>
<p><b>Kenneth Bianchi – </b>This serial killer, along with his cousin, raped and murdered 15 women between October 1977 and January 1978. He became known as “The Hillside Strangler” because he usually left the bodies of his victims on the hillsides of Glendale Highland Park. He is currently serving out his term of a life of imprisonment.</p>
<p><b>Kenneth Lay – </b>This white-collar criminal is known for his hand in the Enron fiasco. Lay was convicted and found guilty of six counts of conspiracy and fraud. As a result of his actions, 20,000 Enron employees lost their jobs. He died on July 5, 2006, just a few months before his sentencing was scheduled to take place.</p>
<p><b>Kenneth Allen McDuff – </b>This man, known as “The Poster Boy of Capital Punishment,” was sentenced to death, released from death row and then resentenced to death and finally executed. From early on, he was a bully to say the least. Teachers were unable to discipline him and his peers feared him. He was arrested multiple times and let off on parole more than once. The last time he was arrested, the Texas prison system made a major overhaul of their policies to ensure that criminals like McDuff could not be released on parole.</p>
<p><b>Ken McElroy – </b>“The Town Bully,” as Ken McElroy was known, committed several crimes throughout his life, including child molestation, rape, arson, burglary and more. At least one of his children seemed to be following in his footsteps. His son tried stealing candy from a local grocery store. The child was caught by the owner and an argument broke out. McElroy eventually shot the owner after stalking him and his family for a time after the incident. He did not end up killing the owner of the store, but was arrested and then let go on bail. The residents of the town were afraid for their safety, and one night, the town took a stand. Several citizens went to the local tavern where McElroy was and an unknown gunman shot him to death.</p>
<p><b>Kenneth I. Starr – </b>Starr was convicted of what’s called a “Ponzi scheme.” He had a total of 23 counts of fraud and money laundering, among others. He was sentenced in 2011 and is set to be released in 2016.</p>
<p><b>Kenneth Wayne Beck – </b>In January of 2013, Kenneth Beck admitted to killing his girlfriend Stacie Hough. Beck has since been sentenced to life in prison without parole. He said he never intended to kill his girlfriend; it happened while they were having an argument in their trailer. He strangled her with a hair dryer cord.</p>
<p><b>Kenneth Roberts – </b>While this is a fictional criminal, he’s still an interesting character. Kenneth Roberts was a bomber on the show “Criminal Minds.” It’s thought that this character was based on the Unabomber. His bombs killed few in the episode. At the end, he was arrested.</p>
<p><b>Ken Sigala – </b>In 2011, Ken Sigala and Barbie Alvarado ­– yes, Ken and Barbie ­– were accused of stealing iPads via Craigslist. They would respond to an ad showing interest in the iPad, meet to look at it and then drive off with the unpurchased iPad in hand. Several of the devices were reported stolen before Alvarado allegedly tried pawning one off, resulting in their arrest.</p>
<p>I’m sure most of us Kens would like any of these guys that are still alive to change their name, but alas we are stuck with most of them in our fraternity (I think of this every time I pass the Ken Lay YMCA close to my house that has since been renamed).  If you can think of any criminals that should have made the list, don’t hesitate to leave a comment below.</p>

Strict liability has now been removed for employers, meaning that they will not be held accountable for accidents or injuries unless there is evidence that they have been negligent. Employers will now be able to argue that accidents weren’t their fault and they will be able to avoid liability under regulations and laws which were put in place to protect their employees from danger.</p>
<p>The new laws have come into force as a result of the government trying to eradicate the ‘compensation culture’ which it believes to exist within Britain. During a debate on the issue, Jo Swinson, Business Minister, set out that ‘the government does not believe that it is justifiable to hold employers liable for incidents outside of their control that they could not have reasonably prevented’.</p>
<p>I would argue, in agreement with Mr MacDonald, that making workers responsible for proving negligence is wholly unfair and might also prove difficult. Overall, it must be remembered that health and safety laws and regulations were put in place in order to ensure that workers are safe whilst working.</p>
