Pennsylvania Judge Rules Vaccine Claims Preempted By Congress

PHILADELPHIA - Vaccine-related claims of design defect and failure to warn are preempted by the federal Vaccine Act, a Pennsylvania judge has ruled in a case of first impression that dismisses claims of injury from the mercury-based preservative thimerosal (Wright, et al. v. Aventis Pasteur, et al., May Term 2003 No. 3861, Pa. Comm. Pls., Philadelphia Co.; See August 2006, Page 4).

Polio Vaccine Maker Seeks Reversal Of Verdict Of $8.5 Million For Paralysis

ST. LOUIS - Vaccine manufacturer American Cyanamid Inc. asked the Missouri Supreme Court at oral argument on Sept. 4 to set aside a jury's $8.5 million award to a St. Louis teen who was partially paralyzed as an infant by the company's Orimune oral polio vaccine (OPV), saying a plaintiff's expert should not have been allowed to testify that the company's failure to meet regulatory requirements was a factor in the teen's injury (Cortez Strong v. American Cyanamid Company, et al., No. SC88890, Mo. Sup.; See February 2008, Page 5).

WASHINGTON, D.C. - The government has rebutted a complaint of unfair advantage by the Petitioners' Steering Committee (PSC) representing some 5,000 autistic children in the Omnibus Autism Proceeding (OAP) over expert materials favorable to its position from litigation in the United Kingdom, saying it began working to get those documents more than a year ago (In Re: Claims for Vaccine Injuries Resulting in Autism Spectrum Disorder or a Similar Neurodevelopmental Disorder, Various Petitioners v.

ROCKVILLE, Md. - The U.S. Food and Drug Administration on Sept. 12 expanded the conditions it recognizes as prevented by Merck & Co.'s Gardasil vaccine to include relatively rare vaginal and vulvar cancer caused by human papillomavirus (HPV) types 16 and 18 in girls and women ages 9 to 26. The FDA said the two HPV types cause 70 percent of cervical cancers and are known to also cause some vulvar and vaginal cancers, although the percentages "are not well defined."
