				<content:encoded><![CDATA[<p>This book will bring together a series of conference papers presented by international experts in the field of judicial dispute resolution at the International Research Collaborative (IRC) in Judicial Dispute Resolution. The papers will be presented at the International Law &amp; Society Meeting in Hawai’i, USA, in June 2012.</p>
<p>The book will introduce 12 key papers from the IRC discussing judicial dispute resolution, reproducing the papers in an extended format and concluding with outcomes of the IRC. The papers will report on quantitative, qualitative, critical and theoretical analysis of judicial dispute resolution from a comparative perspective. A particular focus of the IRC is surveying judicial activities regarding judicial dispute resolution in a number of countries, reflecting on that information and suggesting trends, aspirations and future developments.</p>
<p>By “Judicial Dispute Resolution” is meant the work undertaken by judges to engage in settlement processes for civil litigation, including judicial conciliation and mediation. In some jurisdictions, there is a long history of judicial involvement in settlements and facilitated discussions, which is viewed as an accepted and important part of the judicial role. In other jurisdictions, there is more discomfort with judicial dispute resolution and the role of a judge may be perceived as more appropriately limited to adjudication.</p>

				<content:encoded><![CDATA[<p>There have been significant changes to legislation and important case law developments in the two years since the previous edition of <em>Australian Commercial Law</em>. The 29<sup>th</sup> edition includes the following:</p>

<li>Consumer Protection (Ch 17) incorporates the changes made by the <em>Competition and Consumer Legislation Amendment Act 2011</em> (Cth) and a number of significant cases since the last edition, including the High Court decisions in <em>Miller and Associates Insurance Broking Pty Ltd v BMW Australia Finance Ltd</em> (2010) and <em>Insight Vacations Pty Ltd v Young</em> (2011).</li>
<li>Credit Law (Ch 19) has been completely re-worked, following the enactment of the new national  personal property securities regime by the <em>Personal Property Securities Act 2009</em> (Cth), which replaces the State and Territory registration systems. Recent legislative amendments to the <em>National Consumer Credit Protection Act 2009</em> (Cth) have also been included in this chapter.</li>
<li>The Law of Electronic Commerce (Ch 16) incorporates changes to the Commonwealth and State <em>Electronic Transactions Acts</em> necessitated by Australia’s accession to the United Nations Convention on the Use of Electronic Communications in International Contracts. It also includes the significant High Court decision in <em>Roadshow Films Pty Ltd v iiNet Ltd</em> (2012) on the liability of Internet Service Providers for peer-to peer file sharing and the Full Federal Court decision in <em>National Rugby League Investment Pty Ltd v Singtel Optus Pty Ltd </em>(2012) on the “time shifting” of television programs.</li>
<li>Changes introduced by the <em>Intellectual Property Laws Amendment (Raising the Bar) Act 2012</em> (Cth) are considered in Intellectual Property (Ch 30), together with the copyright decisions in <em>EMI Songs Australia Pty Ltd v Larrikin Music Publishing Pty Ltd</em> (2011) and <em>Telstra Corporation Ltd v Phone Directories Company Pty Ltd</em> (2010); and the significant patent decision in <em>Samsung Electronics Co Ltd v Apple Inc</em> (2011).</li>
<li>Restrictive Trade Practices (Ch 18) incorporates legislative amendments introduced by the <em>Competition and Consumer Amendment Act (No 1) 2011</em> (Cth).</li>
<li>Business Ethics (Ch 33) outlines the <em>Guiding Principles on Business and Human Rights </em>endorsed by the United Nations Human Rights Council in July 2011.</li>
<li>The 29<sup>th</sup> edition of <em>Australian Commercial Law</em> will include a completely new chapter on Employment Law (Ch 34).</li>

<p>This edition includes commentary on the impending attempts to procure uniformity in statutory regulation of lawyers across Australia. Relevant provisions in the proposed Legal Profession National Law are cited, and the avenues whereby the national model is proposed to be achieved are identified and explained.</p>
<p>This edition contains references to the most recent national model professional rules for barristers (which have already seen implementation in four jurisdictions) and to the Australian Solicitors Conduct Rules. Although the latter currently apply only in South Australia and Queensland, they are slated for introduction elsewhere in due course.</p>
<p>Changes to professional rules in other jurisdictions are noted, including the new United Kingdom rules, for comparative purposes. As always, the book is comprehensive, with detailed footnoting of relevant provisions and rules in each Australian jurisdiction, and evincing a truly comparative perspective with other common law countries.</p>
