It has come to the attention of the Bureau of Internal Revenue (BIR) that text messages and news reports are circulating that President Benigno S. Aquino III has ordered the BIR to conduct an investigation of the Iglesia Ni Cristo (INC).

The BIR categorically denies that there is such an on-going tax audit of the INC.

“No such order was received from the President. And there is NO on-going investigation of the INC as of this writing,” said Commissioner of Internal Revenue Kim S. Jacinto-Henares.

Typhoon Sendong : Report Business Losses within 45 days

December 17, Sunday the intensity of Typhoon Sendong brought the city of Cagayan de Oro, and Iligan to its knees.

Businesses affected by the recent typhoon Sendong should be reported to the Bureau of Internal revenue within 45 days after the event.

The BIR has previously issued Revenue Memorandum Order (RMO) No. 31-2009, dated October 16, 2009, which laid down the policies and guidelines for the reporting and claiming of casualty losses, in general. This was issued in aftermath of Typhoon Ondoy and Pepeng. (For annexes attached to this RMO click this links for Annex A and Annex B you will be ask to open or save to download file to your PC)

The destruction wrought by Typhoon Sendong is undeniably even greater than the previous typhoons. Businesses who incurred losses should report this to the BIR within the said time frame.

Who are allowed to claim for this casualty losses or business losses?

Only Taxpayers engaged in trade or business are entitled to claim deductions for casualty losses. Furthermore, the LOSSES should be incurred for properties ACTUALLY USED IN BUSINESS and were reported as losses in the appropriate declaration filed with the BIR.

For filing claims of casualty losses, a Sworn Declaration of Loss and other requirements deemed necessary to substantiate proof of loss(es) claimed shall be submitted within forty-five (45) days after the date of event causing the loss to their Revenue District Office (RDO) or LT Division/District Office where they are registered, as stated in Section 34(D) of the Tax Code and Revenue Regulations No. 12-77.

Sworn Declaration of Loss shall state the following:

1. Nature of the event that gave rise to such loss(es) and the time of its occurrence;

2. Description and location of the damaged property(ies);

3. Items needed to compute the loss(es), such as a) cost or other basis of the property(ies); b) depreciation allowed, if any c) value of the property (ies) before and after the event; d) cost of repair and e) lastly the amount of insurance or other compensation received or receivable.

Supporting Documents

The Sworn Declaration of Loss should be supported with Financial Statement for the year immediately preceding the event; copies of Insurance Policy(ies), if any, for the properties used in business.

Other Proofs for Losses being claimed

Photographs of properties before the typhoon and after, showing the extent of damage to the said properties.

Documentary evidence for determining the cost or valuation of the damaged properties, such as, but not limited to: cancelled checks, vouchers, receipts, and other evidence of costs.

Insurance Policy, if properties used in business are covered by it.

Police Report, in cases of robbery / theft during the typhoon and or as the consequence of looting.

All documents and requirements shall be verified by the concerned BIR office before the business taxpayer can actually claim deduction from his income tax.

Deduction of assets as capital losses must be properly recorded in the accounting reports, with the adjustment of the applicable accounts.

The restoration of the damaged property, or the acquisition of new property to replace the damaged property, must be recorded and recognized as either repairs expense or capitalized asset.

Affected taxpayers should comply with the requirements prescribed under Revenue Memorandum Order (RMO) No. 31-2009 guidelines to avoid the inability to claim such losses as deductions for income tax purposes.

BIR may eventually undertake audit of the affected years later on, within 1 or 2 years most probably and at that time, it will be too late to comply with the requirements.

Of all the images I've looked into on this most tragic devastation that came upon my hometown Cagayan de Oro City. I cannot help but feel the pain and utter sadness in my heart to see a father holding the lifeless body of his child in his arms.

Losing ones home and every belonging is surely very unfortunate but to lose love ones is just simply tragic and unbearable.

If we could have only been more vigilant when this type of weather comes to our vicinity. We could save many lives. We have been fairly warned many times over by disasters that came upon many parts of our country, but we usually would never think that our place would be subjected to the same intensity as others have gone through.

We should never be complacent to things happening around us. In our time, extreme weather anomalies is happening and will continue. We need to be wary if we are living near water ways. Especially if we have kids who depend upon our better judgement in times like this.

Take the immediate initiative to evacuate immediately even when the waters are still low rather than wait for it to rise were you have no longer any option to leave.

Local officials should prepare evacuation sites within 24 hours before typhoons hit land. Every barangay should inform their people to evacuate to higher ground sooner not later.

Every home should have large plastic bags to place their clothes and seal it properly to protect it from muddy waters.

It makes sense to have large drums or water containers to store water. Especially, in the aftermath.

We should always remember the price that was paid for this tragic lesson.

For our sake and the lives of our love ones we should always be prepared to do what needs to be done.

To people who have lost not only their homes but love ones please accept our most heartfelt sympathies and prayers.

The magnitude of this disaster is simply tragic.

First, know where your TIN is currently registered or which BIR Branch or Revenue District Office (RDO).

If you don’t know which BIR District Office you got your TIN Card. You can call the TIN Verification Office of BIR 926-8339 or the BIR Contact Center 981-8888 or you can EMAIL at contact_us@cctr.bir.gov.ph give them your full name and your birthdate. Just ask them that you want to know where your TIN is currently registered or which BIR District Office your TIN is registered.

Get the address of the BIR District Office where your TIN is registered. The BIR Form 1905 is what you will be using

Click this link so you can see the actual form BIR Form 1905. In part II of this form “REASON FOR REGISTRATION INFORMATION UPDATE” in section 4B “REPLACEMENT OF LOST / DAMAGED TIN CARD“.

The needed attachment for this application is an Affidavit of Loss duly notarized of course. You can get this service from a Notary Public near your area. The notary usually cost around 50 to 100 pesos. For replacement just present your old TIN Card.

Don’t forget to sign the backside of this form. After you submitted your application ask the BIR personnel when you can get your TIN Card.

Lastly, where do you file this? Submit this 1905 to the BIR District office where your TIN is currently registered. If you TIN is registered in BIR RDO handling Marikina then thats where you should file that request not with any other BIR district office. That’s it.

For new applicants for TIN card there is nothing to pay. But i came to know recently that they are charging for replacement. due to loss, around 100 pesos.

Registering Your Business with BIR

After Registration with the BIR ask for an orientation
to familiarize yourself on filing taxes.

For single proprietorship, the documents you will need before you go to a BIR District Office would be your DTI permit and business permit from the local municipality where your business is located.

Once you have this you can go the BIR District office who has jurisdiction over your place of business.

If you do not know where this is, you can call the BIR Contact Center 981-8888. Just tell them that you wish to know which BIR office you should go to register you business and where it is located.

Once you get to that office, go directly to their information desk for assistance. The BIR Form you will be needing is BIR Form No. 1901

For Partnership & Corporations or Associations/Institutions or Cooperatives, the document you will need is SEC registration and business permit from the local municipality where you business is located.

If you have this already same procedure as with the single proprietorship but the BIR Form you will be using is 1903.

Also you will need the BIR Payment Form 0605. Pay the Annual Registration Fee of 500 pesos using this form, usually paid to the Accredited Agent Bank (AAB) of the BIR District office.

Once you have done this do ask the person facilitating your application when you can get your Certificate of Registration (COR) or BIR Form 2303. It would be wise to get the name and contact number of that person.

Lastly, do ask revenue officer who evaluated the business you are opening the particular taxes you are liable to pay. Get the deadlines and BIR Forms you will be needing to file and pay your taxes. You might want to ask if your business is not yet operating and needs a bit more time to fully operate, are you still going to file?

The answer to that is yes. Just ask how you will be able to file without the hassle of being penalized for non-filing. The BIR needs to be informed. Once your business is registered it is considered fully operational. The BIR expects that you will file and pay the taxes indicated in your COR.

So again in cases where you are not yet operating the business and you are already registered you will still need to file. For more information regarding this you can ask the Revenue Officer who evaluated your business. Or you can get information from the BIR Contact Center 981-8888 or email at contact_us@cctr.bir.gov.ph.

Transferring Your TIN

Knowing where your TIN is the first step

If your new employer or current employer is requiring you to transfer your TIN. But your not sure how to go about it then this article is for you. And for corporations or companies who wants to assist their employees in transferring the TIN of their people. Especially if the RDO is quite far from their present employment.

This is what you will be using BIR Form 1905 . Just Click the hyperlink to see this form or better print it so you can have a hard copy and fill it out.

First, you should know where your TIN is registered. Most of you might want to guess based on where you are working or probably where your staying. Please it would be wiser for you to contact BIR TIN Verification Office at 926-8339 or the BIR Contact center at 981-8888 or email contact_us@cctr.bir.gov.ph, just make sure you provide your full name, and birthdate.

The information you need is to ask WHERE your TIN is registered. Or what RDO (which stands for Revenue District Office of the BIR). For example, RDO 40 handles the Cubao area or RDO 45 which handles Marikina Area.

Once you know this, take note this is where you need to go to submit the 1905 BIR form. In this form go down to “4E” and check no. “1″ TRANSFER OF HOME RDO.

Write down the number code of your OLD RDO. This is where your TIN is currently registered and where you will SUBMIT this form. The NEW RDO is where you want your TIN registration to be TRANSFERRED to.

Don’t forget to sign your name at the back portion of this form. So after filling out the necessary information YOUR NAME, TIN NUMBER, RDO CODE and the other things mentioned above. You can now submit this to BIR RDO where your TIN is currently registered.

Just remember to ask the personnel of the BIR when you can verify once the transfer has been done. Or you can also call the BIR Contact Center which was mentioned above. This is to just to verify if your TIN is now with your NEW RDO.

FOR CORPORATIONS or COMPANIES who wish to assist their employees in transferring their peoples TIN.

For the HR or authorized personnel who will be doing this. There is a way you can transfer the TIN of your employee from another RDO to the RDO of your company without having to leave the office or travel for that matter. This is especially helpful for TINs located in another province. Where it is very expensive to travel back to that province just to submit your request fo transfer your TIN. Or the hassle of asking your relative to do it for you.

You need to fax the BIR form 1905 duly signed by the employee to the Taxpayer Service Section (TSS) or Registration Section of the BIR Revenue District Office (RDO ) where the employee’s TIN is currently registered.

To know the fax number or telephone numbers of that particular RDO just call the BIR Contact center at 981-8888 or email contact_us@cctr.bir.gov.ph,

First, know the number of that RDO. Know the name of the personnel who will assist you on this. So that you can call them up for confirmation once the fax transmission has been completed. Yes, you need to fax both sides.

To Cancel an Existing TIN

Its prudent to ask first not later.

Use BIR Form 1905 for your application for Cancellation of TIN. Click this BIR Form 1905 to get a PDF copy of this form and print it.

So you can familiarize yourself with the said form. In Part I of that form fill out the information needed. If you do not know the Revenue District Office (RDO) Code or number just call BIR Contact Center 981-8888. They will ask for your full name, and birthdate or better provide them your TIN.

In Part II, check box letter “D” – “Cancellation of TIN”. Then go down to “4D”. Check box number “4” titled “Multiple TIN / Invalid TIN”. The effective date of cancellation is the day you filed this application.

So go to the back of this form. Print and sign your name on the provide space.

Again file or submit this form to the BIR Branch or RDO where your TIN is currently registered.

To know if you have TIN number under your name. You can call the TIN Verification Office of BIR 926-8339 or the BIR Contact Center 981-8888 or you can EMAIL at contact_us@cctr.bir.gov.ph give them your full name and your birthdate. Just ask them that you want to know where your TIN is currently registered or which BIR District Office your TIN is registered.

thru a full circle once you follow these steps

For those of you who have problems with the registration of your name and birth date with BIR. This post is for you. So read on.
Use BIR Form 1905 for this process. Click here to get a view of this form. So as we go along you can check which part of the form I am referring to.

So have this printed. Or you can read the instruction below and proceed to your RDO just be sure to bring a copy of your BIRTH CERTIFICATE. Your RDO has available 1905 forms.

Fill out PART I of this form with your TIN number and correct Name in the provided portion of the BIR Form 1905.

The RDO Code refers to the BIR branch where your TIN is currently under. This is where your will file this 1905 application form. No, you can't file it with just any other BIR office. So do understand this point.

If you do not know where your RDO (Revenue District Office) is and its code number. Just call TIN Verification Office of BIR 926-8339 or the BIR Contact Center 981-8888 or you can EMAIL them at contact_us@cctr.bir.gov.ph. Give them your name, birthdate or just your TIN number.

In Part II of this form check box "K" and write in the provided box space "Correction of NAME and BIRTHDATE".

Then go to the backside of this form or the second page and go to "4G" - CHANGE IN REGISTERED NAME.

In that portion of the form check box "Registered Name". Then write your CORRECT NAME in "NEW" and your INCORRECT NAME in "OLD". This will inform the BIR personnel to update and correct your registered name to the NEW name.

To correct the BIRTHDATE. Go to "4K" - "OTHER CHANGES". Specify or provide the details of the changes. Write down on the provided box to specify the correction of your BIRTHDATE.

Write down "CORRECTION OF BIRTHDATE -specify the correct birthdate according to your BIRTH CERTIFICATE."

So once all of this has been done. You may now go to your RDO just make sure you have a copies of your BIRTH CERTIFICATE as this is the required attachment to your 1905 application form.

Reporting Your Losses due to Calamities

Calamities brought about by typhoons, earthquakes, fires, or any other natural or unnatural disasters to which your business incurred losses should be reported to the BIR within 45 days.

Like the damage brought about by typhoon Ondoy and the recent typhoon Pedring that damage a lot of structures from homes to business. You need to report the damages. Photos of the damages and items that were lost.

For losses brought about by the recent typhoons, Large Taxpayers (LTs) and Non-Large Taxpayers with business, a Sworn Declaration of Loss and other requirements deemed necessary to substantiate proof of loss(es) claimed shall be submitted within forty-five (45) days after the date of event causing the loss to their Revenue District Office (RDO) or LT Division/District Office where they are registered, as stated in Section 34(D) of the Tax Code and Revenue Regulations No. 12-77.

The Sworn Declaration of Loss shall state the following: nature of the event that gave rise to such loss(es) and the time of its occurrence; description and location of the damaged property(ies);items needed to compute the loss(es), such as a) cost or other basis of the property(ies); (b) depreciation allowed, if any c) value of the property (ies) before and after the event; d) cost of repair and lastly the amount of insurance or other compensation received or receivable.

Proof of the extent of loss(es) claimed whether due to casualty, robbery, theft or embezzlement have different requirements.

For casualty losses the documentary requirements includes photographs showing the extent of damage; the condition or value of the property after it was repaired, restored or replaced.

For those pertaining to robbery, theft or embezzlement a police and/or an insurance report should be attached to the Sworn Statement.

The said documents and requirements shall be verified by the concerned BIR office before the business taxpayer can actually claim deduction from his income tax.

Commissioner Sixto S. Esquivias IV has advised all the Taxpayer Service Units and BIR Personnel to advice and counsel all business taxpayers regarding the requirements in filing their claims of losses due to the recent typhoons.

If you are an individual wanting to apply for a TIN for the purpose of employment the form you will be filling out will be the BIR Form 1902.

Follow or click on the 1902 link and download the file. There is a portion in that form where your employer needs to fill-out and must be signed by its authorized representative.

The documentary requirement or attachment for this form is a xerox copy of your birth certificate.

WHERE TO THIS APPLICATION SUBMIT: You can submit this to the BIR Revenue District office where your employer is currently registered or where they are filing their taxes.

REMEMBER: You cannot submit this to any other BIR offices. Only with the BIR Branch or Revenue District Office (RDO) where your employer's TIN is registered or the RDO/BIR Branch that handles the business address of your employer.

If your employer is located in Pasig there is a BIR Revenue District office located in that area, whether your employer is located in other areas the BIR has an office who has jurisdiction over such area. Thats where you need to submit this application.

TO KNOW WHICH BIR BRANCH YOUR TIN IS REGISTERED: You can check the BIR TIN Verification Office at 926-8339 or the BIR Contact center at 981-8888 or email contact_us@cctr.bir.gov.ph, just make sure you provide your full name, and birthdate.

Make sure you to ask the personnel facilitating your application on when you can get your TIN or who you can call to verify the TIN that will be issued to you.

We can only have one TIN

If you already have a TIN then you don't need to go thru this. Remember we can only have One (1) TIN under our name. If you are not sure you have a TIN under your name then read on.

To know if you have a TIN under your name just call the BIR Contact Center (BIRCC) 981-8888 or the TIN Verification Office 926-8339. They will ask for your full name and birthdate.

Use the BIR Form 1904. Documents you need to attached are a photo copy of your Birth Certificate and Barangay Clearance or NBI Clearance.

Where to file? You need to file this with the BIR branch which has jurisdiction over your barangay.

You can get this info thru the BIR Contact Center. Or you can search for it here. This has a list of barangays under each BIR Revenue District Office.

Once you know which BIR Branch or Revenue District Office your barangay is under then you can submit your application for TIN.

Ask the BIR personnel when you can get your number. It usually can be done within the day depending on the work load of that office.

Remember we can only have one TIN under our name. That TIN can be updated to an Employee TIN or Business TIN. When the time comes when you find a job or employer or decide to open up a business. You can use this TIN.

It will updated to the category or type you decide go, whether as an EMPLOYEE or SINGLE PROPRIETOR or SELF-EMPLOYED.

Notice that there maybe some BIR offices whose personnel do not know that the memo signed by previous CIR and previous LTO Chief is no longer honored by LTO people as they have a newly installed LTO Chief.
