New York's 'best restaurant' agrees to pay waitstaff $500,000 after investigation finds it withheld tips

One of Manhattan's most expensive restaurants, Thomas Keller's Per Se, home of the $310 tasting menu, has reached a settlement with the New York Attorney General to pay $500,000 to members of its waitstaff after an inquiry found it withheld their tips.
“Today’s agreement ensures that workers at Per Se will not continue to be cheated out of their hard-earned tips — tips that customers intended for them,” Attorney General Eric T. Schneiderman said in a statement.
The settlement was reached following a 2013 investigation, which found the restaurant had pocketed the 20% service charges on private banquet and dining customers' bills over a 21-month period in 2011 and 2012. Instead of going to the waiters — who, according to the AG's Action of Decision (AOD), make between $16.60 and $28 per hour — the service fees were used for operational costs.
A press release from the Attorney General's office states that a customer who emailed Per Se to ask whether the 20% service charge was, indeed, the waiter's tip was told that "service/gratuity is certainly included in the pricing.”
The AOD states that the restaurant changed the wording on private-dining checks to reflect the fact that service charges were for operational costs, not gratuity, in September 2012.
A spokesperson for Per Se gave the following comment on the settlement:

In an unintentional oversight, Per Se, unaware of a new state regulation, did not update the description of the operational charge in its private dining event agreement during a 21-month period in 2011 and 2012. Nearly three years ago, in September 2012, Per Se modified this contract language at its own initiative and has been in compliance since that time. We have reached an agreement with the New York State Attorney General’s office to resolve this issue.

Our employees were never short-changed and no monies intended for employees were withheld. Our employees are among the best compensated in the restaurant industry because they are the best in the business. The Attorney General’s office’s own findings state that the charge was used in part to pay Per Se’s workers their industry-leading wages — a waiter at Per Se, for example, including overtime and gratuities, makes approximately $116,000 a year.

This matter relates to the words that Per Se used to describe its private dining operational charge during a 21-month period three years ago. According to the Attorney General, Per Se should have made it clearer that this charge was not a gratuity. Per Se revised this language on its own, well before it ever heard from the Attorney General’s office, and has been in compliance for nearly three years.

In 2011, The New York Times famously called Per Se "the best restaurant in New York City."

American singer and songwriter Beyonce Knowles is allegedly upset with
husband Jay Z after aspiring rapper Rymir Satterthwaite claimed he is his father.

Last month, the 21-year-old alleged in a New Jersey court that his mother Wanda
Satterthwaite had an affair with the 45-year-old rap mogul, whose real name is
Shawn Corey Carter, in the 1990s and got her pregnant.

Adding on, the suit also alleges that Jay Z has been avoiding a paternity test
for the past four years.

According to Grazia magazine, the 33-year-old Halo singer is not happy
with the allegations.

"Beyonce is a mess right now. She's furious that she's been put in this position
once again. It's one rumour after the next. Jay Z says it's not true, but she
seems to feel humiliated and under a lot of strain. She's not in a good place,"
a source said.

"Beyonce feels overwhelmed and embarrassed. She's fiercely protective

Crowd Funding For Obesity After Thyroid Cancer

After being diagnosed almost twenty years ago, Ms. Edwards decided to perform a case study on obesity and autoimmune diseases, which sometimes develop after having major surgery to have the thyroid removed. Thyroid cancer survivor, DaVida Edwards, is fundraising to create awareness about thyroid issues and the health ailments associated with this type of illness.

As a result she started a fundraising campaign which will provide help to those with obesity and thyroid issues who want to get healthy and stay healthy. Starting with a small garden in her back yard she plans to expand her vegetable garden in order to supply much needed organic meals to families in the community who otherwise may not be able to afford them.

Since her diagnosis Ms. Edwards researched all healthy natural products that don’t include any harmful chemicals or hard to pronounce toxic ingredients. She plans to make those all natural products such as deodorant and shampoo, readily available to the public by launching a new website via this crowd funding campaign.

Upon being contacted by The Doctor Oz Show in regards her thyroid issues, Ms. Edwards decided to seek support among the medical community from doctors and dieticians who specialize in treating patients with thyroid issues, obesity, arthritis, high blood pressure, high cholesterol, asthma, gum disease, sleep apnea, diabetes, autoimmune diseases, depression and eating disorders. Facebook's Internet.org project is taking another step towards its goal of bringing the internet to people who are not yet online, launching an app in

The Internet.org app will give subscribers of

Zambia

's Airtel phone company access to a set of basic internet services for free. Users of the app won't incur the data charges that can be prohibitive for many people in developing nations.

Facebook has already been working with mobile operators around the world to offer its own service free of charge to phone subscribers - think of it as a gateway to the rest of the internet.

Online services accessible through the app range from AccuWeather to Wikipedia, a job search site as well as a breadth of health information. Facebook's own app, along with its Messenger service, is also included, as is Google search, although charges apply if people click on search results.

BRATTON ORDERS REVIEW OF NYPD TRAINING AFTER DEATH OF ERIC GARNER

-- New York City Police Commissioner William Bratton has ordered a thorough review of the NYPD's training procedures in the aftermath of the death of Eric Garner, the man who was held in an apparent chokehold and died as police attempted to arrest him last week. At a news conference Tuesday, Bratton said the NYPD will conduct a "top to bottom review of all of the training this department provides to its personnel, specifically focusing on force, how do we train our officers for a takedown, how do we train them to use the various levels of force that they're authorized to use." Bratton said he anticipates there will be a retraining of the entire 35,000 member force in the future.

He said when the retraining is done, the NYPD will have "state of the art" training for officers nationally. Bratton also met Tuesday with the FBI, which is now monitoring the investigation into the case and said he would "not be surprised" if the U.S. Attorney decides to open a civil rights investigation. Family, friends and community leaders held a vigil Tuesday night and demanded justice, gathering at a park near where police tried to arrest Garner. They marched to the Staten Island precinct Tuesday night chanting the last words Eric Garner uttered, "I can't breathe". Meantime, we are now learning more about the missteps taken by 2 EMT's who arrived on the scene when Garner was unconscious.

Two EMTs and two paramedics are now all suspended without pay by Richmond University Medical Center as the hospital conducts its own internal investigation. Critics now saying they didn't follow proper protocol. "I can't breathe," Garner is heard saying in a video shot by a bystander. They were the desperate words of 43-year-old Eric Garner as cops slammed his face into a Staten Island sidewalk seconds after officers, one using an apparent chokehold, wrestled the asthmatic diabetic to the ground last Thursday. Eyewitness News has learned that one of the NYPD sergeants on the scene later told investigators, "She believed she heard the perpetrator state that he was having difficulty breathing." But she also downplayed Garner's condition, saying, "The perpetrator's condition did not seem serious and he did not appear to get worse." A cell phone video appears to show a handcuffed Garner unresponsive as medical help finally arrives from Richmond University Medical Center.

The former director of New York City's EMS system sees problems from the beginning, starting with that apparent chokehold. Eyewitness News Investigative Reporter Sarah Wallace spoke by phone with Dr. Alexander Kuehl. "Reasons he could have been unconscious, because of a neck injury, a head injury, a lack of blood to the brain, a lack of inability to breathe while on the ground," Dr. Kuehl said. Dr. Kuehl was also surprised the first medical technician on the scene simply checked Garner's pulse. A few minutes later he was heaved onto a stretcher and then suffered cardiac arrest. "What she didn't do, oxygen, check his airway, put a cervical collar, she didn't do the routine of what she was supposed to do," Dr. Kuehl said. "The ambulance was right down the block, but the police said 'not yet,'" explained Giordio Dano. Dano just happens to be a registered nurse and was down the block Thursday afternoon when he spotted a commotion on the Staten Island sidewalk. Dano says he can't believe what he saw. "I would have flipped him over, checked his pulse and performed CPR, and get the ambulance here right away," he said.

The woman who shot the seven minute long video also expressed frustration. "He was on the ground for a good ten minutes, no response whatsoever. When they put him in the gurney and put him to the side, EMS was stopped right there because they were trying to work on him," said Taisha Allen. Witnesses say they pleaded with EMS workers to do more than check Garner's vital signs. "We even screamed at them and told them, why are they concerned with putting him in the ambulance when they can do CPR right then and there," said witness Ramsey Orta. Orta recorded recorded Garner's arrest and takedown on his cellphone. Several minutes had gone by before he says Garner was taken away on a gurney.

The mother of Garner's youngest child, who is just 3 months old, says she can't bear to watch the videos of the incident. "It's murder. It's murder," Jewel Miller said. New York City Mayor Bill de Blasio Monday told reporters that - as a layman - he thought a chokehold had been employed by a cop during the incident. "As an individual who's not expert in law enforcement, it looked like a chokehold to me. But I also emphasize you have a full investigation because all sides need to be heard and all evidence has to be looked at," de Blasio told reporters trailing him on vacation in Italy. Audio was provided to reporters in New York by the mayor's office. The mayor left on Saturday night, after postponing his departure for a day to deal with the developing firestorm over Garner's death.

Garner, an asthmatic, was pronounced dead an hour after his arrest. Authorities said he died of a heart attack, but autopsy results have yet to be released. Previously, the NYPD took the gun and badge away from the officer who placed Garner in the apparent chokehold. That officer, Daniel Pantaleo, an 8-year veteran, has been placed on "modified assignment," pending the outcome of the dual probes by the district attorney and Internal Affairs. Garner was confronted by police trying to arrest him on suspicion of selling untaxed, loose cigarettes on a Staten Island sidewalk, authorities said.

The 6-foot-3, 350-pound Garner became irate, denying the charges and refusing to be handcuffed. A partial video of the encounter obtained by the New York Daily News shows one officer wrap his arm around Garner's neck as he is taken to the ground. Asked about the ongoing probe and controversy de Blasio left behind in New York, the mayor said: "There's an internal process and I respect that process.

The fact is that Commissioner (Bill) Bratton acted, having looked at the facts. It's quite clear the chokehold has been prohibited for decades, but I leave the specific actions within the police department to Commissioner Bratton. I have absolute faith in his judgment. I think the actions that have been taken show that there is a serious commitment to a full investigation." In the video obtained by the Daily News, Garner, who has been arrested for selling illegal cigarettes numerous times in recent years, says he hasn't done anything wrong. "Every time you see me, you want to mess with me. I'm tired of it. It stops today," Garner shouts. "I'm minding my business. Please just leave me alone." As four officers bring him down, Garner is heard gasping, "I can't breathe! I can't breathe!" The video shows one officer using his hands to push Garner's face into the sidewalk.

Garner's family, along with Sharpton and his National Action Network, claim Garner repeatedly said he could not breathe while officers used excessive force to hold him down. Then he fell unconscious. Garner went into cardiac arrest and was transported by EMS to Richmond University Medical Center, where he was pronounced dead on arrival. A funeral for Garner, who went by the nickname Big E, will be held Wednesday at the Bethel Baptist Church in Brooklyn. Another rally on Staten Island is planned for Saturday afternoon. Beef, pork and chicken items were eliminated as the restaurant chain’s supplier OSI Group LLC recalled all products made at its Shanghai unit yesterday. “We are now only offering a limited menu in our restaurants around the country,” McDonald’s China unit said in an e-mailed statement today.

OSI is accused of repackaging old meat as new at its Shanghai Husi Food Co. unit, which supplies customers including McDonald’s, Yum! Brands Inc. and Seven-Eleven Japan Co.’s parent, all of which have halted sales of the company’s products. The scandal further erodes perceptions that foreign-owned companies in China have higher safety standards than locally owned rivals.

Calls to McDonald’s delivery dispatchers in Beijing and Shanghai today confirmed that fish burgers are the only sandwiches available. Hong Kong McDonald’s have cut chicken McNuggets, McSpicy chicken filet, fresh corn cups, iced fresh lemon tea, green salad and grilled chicken salad from its menu because those involved ingredients from OSI units in Guangzhou and Hebei, according to the restaurant’s website.

OSI was “compelled to withdraw all products manufactured by Shanghai Husi” and replace its management team in China, the Aurora, Illinois-based company said yesterday in a statement on its website.

Restaurants and convenience stores from Hong Kong to Tokyo initially halted sales Shanghai Husi chicken nuggets following a July 20 report on local TV showing workers repackaging and selling chicken and beef past their sell-by dates. The recall has now spread to all products made by the Shanghai unit, including beef and pork.

Authorities Investigate

Chinese authorities have ordered Shanghai Husi’s plant shut for allegedly selling expired products. The local police detained five people in connection with an investigation into the meat supplier, the Shanghai Municipal Food and Drug Administration said in a July 23 statement.

The U.S.-based food processor is recalling its Shanghai Husi products “to help rebuild the trust of our customers and consumers, as well as to cooperate with the official investigatory process,” according to its statement yesterday.

OSI said it had brought a new management team into China to ensure operations were run “effectively.” The foodmaker is also conducting an internal investigation into current and former senior management, it said in the same statement.

Whoever thought Jay Z would be attacked by his sister-in-law Solange? I'm sure Beyonce wonders how this video was leaked to the press. So do I. It's gone viral and makes you ask if there's trouble in paradise. Although there are many questions surrounding the reported altercation, Jay Z and Beyonce went on with their evening as if nothing happened. No one knows what led to the alleged elevator brawl. Afterwards they went on to enjoy the basketball game, which Jay Z has an ownership stake in the NY Nets team.

THE AFTERMATH SAGA Between Jay Z, Beyonce & Solange

Although some of us can't help wondering what was said or done to send Solange on a throwing, kicking, punching, slapping, and spitting rampage, some reports say this was not her first time. She obviously was not a happy camper, because other reports say that she went on to erase all but one picture of her sister from her Instagram account. Jay Z did not hit her back. He simply warded off some defensive wounds and was seen leaving the hotel, holding his face. Beyonce stood by and may have encouraged her sister to kick his but for some unknown reason. After all she stood there and remained calm. Following the fight, as you can see, Beyonce rode in the car with her sister while Jay Z rode in a separate vehicle. NY Times reports that Solange still has a younger sibling’s stubborn streak. While she has helped to write several songs for Beyoncé — “Get Me Bodied” and “Upgrade U,” among them — she has declined any professional help from her more famous sister.

This television interviewer was totally rude while speaking of or introducing Solange. He could've done a better job than that. He said, "No wonder she isn't the famous sister." and he called her a little brat. Her publicist made it abundantly clear that she did not want to talk about her family or her brother-in-law and they somehow managed to get a rise out of her by bringing it up anyway. She had to tell the interviewers again, "Please don’t tie me into family and my brother-in-law’s establishment,” while promoting her second solo LP, Sol-Angel and the Hadley St. Dreams, after an interviewer mentioned a controversy surrounding Jay Z's 40-40 Club back in 2008.
