HiGuys:
I'm new to the industry, only 8 months. I work for a Company in Salt Lake City (SWIFT) hERE IS WHAT HAPPENED TO ME.

I picked up a load in Cheyenne ,WY, from a LOWES DISTRIBUTION CENTER, to be deliver IN POCATELLO ID.
I ariived at the store in Pocatello with plenty of time. After showing the manager of the store that all 3 seal were intact, she told me to park the trailer in the receiving dock. I oppened one door and saw a big cardboar covering the merchandise, after oppening the second door all the freight at the back of the trailker came rushing to me burrying me againt the asphalt with over a thousand pounds of merchandise. Iwas laying in the floor covered with boxes of freight of different weigh and sizes. Lost conciousness, was taken to hospital. The rotator cuff tendon on my left arm was sherreded to pieces , my right knee has ligament damage, my recuperation time will be close to a year.
LOWES DISTRIBUTION CENTER never secured the load the way it was supposed to be done.No plastic wrap

My question to you guys is If I can bring LOWES to court for negligency. They never secure the load. What are my options?

Any info or advise, please contact me at : quiba@cox.net.
Thanks in advance.

In my terminal's coverage area there are 2 large intermodal terminals used for transferring containers/trailers from rail to road and vice versa. My terminal delivers parts/tools/supplies there as well. This afternoon I happened to be in the area of one of the intermodal yards and noticed quite a few UPGF bobtails as well as units pulling long trailers in the vicinity. These units weren't from my terminal, they were from the large hub in the region. I'm not sure how this is handled at other terminals but are Roaddrivers assigned to the railyard work or is it City Drivers? Is it right that another terminal is in our coverage area? I'm for everyone working and all, but my terminal has Roaddrivers on layoff, and cityguys that are on call...As well we were told at my terminal 7/3 was a non-service day, but this other terminal was running drivers to the railyard. I'm just curious about this.

We gave, We tried, We worked,We have been layed off /took pay cuts/more or less tried to save this company, but we can't save it from it's own failures and until they straighten out the mismanagement that has been apart of this cash-cow. I cannot give any more, I thought that this (these) companys would be around for a long time, but I was wrong and what really gets me is why we (the workers who made this freight machine what it was) the people that brought her to her knees are still going to be rewarded to the tune of Million Dollar Bonuses, I guess we did not learn our lesson from the Enron crowd. Stay strong, Happy 4th of July, I'm fed-up with this gross mismanagement and can no longer support the so-called life support system that is being called CONCESSIONS. Good-Bye cruel YRC.shitshitshitshitshit Zollars, Why must you feel you deserve the compensation you recieve for the lack of planning and being so unprepared for the conditions this company is facing today, if our hurt was to start in the last few months I could understand and would do my part to get through these tough times, but the demise of this company started right after this recession started mainly because of the OVER spending you were involved with in buying the competition to be the biggest, what a crock, most of us will recover, a few will not, but don't worry about the $$$ because in your mind you think you are entitled to it anyway, I think you are the FAILURE, not the YRC employees. To the I.B.T. negotiate the removal of Zollars and lets try again, until that happens I can't foresee another concession. Good-Luck:shift:
