The association also highlighted the importance of an ombudsman to resolve disputes and serve as a single reference point, and of uniform training for bankers and examiners.&lt;br /&gt;&lt;br /&gt;ABA further urged Treasury to make it easier for banks to rely on trusted third parties and other financial institutions for customer information, and to refocus the risk-based element in customer relationships to grant additional flexibility to banks. The new standard keeps the “pass-or-fail” opinion of the existing auditor&#39;s report. However, in addition to clarifying the auditor&#39;s role and responsibilities, the standard requires the auditor to communicate any &quot;critical audit matters&quot; arising from the financial statements.&lt;br /&gt;&lt;br /&gt;CAMs involve significant accounts and disclosures or other areas that are challenging, subjective or include complex auditor judgment. Under the new standard, the audit opinions of banks are expected to expand greatly, as typical CAMs that auditors will likely include are discussions of the allowance for credit losses, fair value measurements, derivatives, and purchase accounting.&lt;br /&gt;&lt;br /&gt;The new audit standard also requires disclosing the year in which the auditor first started serving a particular company. The new standard must be approved by the SEC. All the new provisions, except those related to critical audit matters, will take effect for audits on fiscal years ending on or after Dec. 15, 2017. The groups also noted that while the U.S. proposal is set to take effect Jan. 1, 2018, the European proposal would not be in effect until 2019 at the earliest. &lt;br /&gt;&lt;br /&gt;ABA previously criticized the U.S. proposal for the NSFR, which consists of the amount of available stable funding over a year divided by the institution’s required stable funding, with the numerator required to equal or exceed the denominator. Under the rule, the FDIC will use the failing bank’s systems, data and staff to calculate the insured and uninsured amounts for each depositor and place holds on portions of uninsured deposits. To comply with the rule, these banks will be required to collect and maintain more detailed depositor information and make upgrades to their IT systems to ensure that they are able to calculate many types of insured deposits within 24 hours of failure. &lt;br /&gt;&lt;br /&gt;In response to feedback from ABA and other associations, the final rule includes alternative requirements for a number of accounts, including certain trusts, brokered deposits and lawyers’ trust accounts for which it would be difficult to compel accountholders to provide personal identification information about the ultimate owners of the funds. The FDIC also extended the timeline for banks to comply with the rule, also in response to banker concerns.
