The Capital Area Food Bank of Texas, a 501c(3) nonprofit, is the largest hunger-relief charity in central Texas, providing food and grocery products, nutrition education and social services outreach to 300,000 Texans, including a high percentage of children in need, each year through a network of 300 partner agencies.

USFN’s latest charitable initiative in Austin occurred on June 6, with 30 USFN members and volunteers who spent the morning at the Food Bank.  The volunteers helped process 9,450 pounds of food, which amounts to 7,560 meals for needy individuals. Donated foods generally arrive at the Food Bank from supermarkets and local food outlets.  All collected donations are then distributed to the public by the Capital Area Food Bank of Texas.

“We were honored to spend the day alongside the dedicated team at the Capital Area Food Bank of Texas,” said Caren Castle, president of USFN. “The great work the team does with reaching out to families in need was truly inspiring to witness.  We also continue to be impressed with the commitment of USFN members to get involved through hands-on participation with outstanding organizations. Our USFN volunteers had a great experience at the Capital Area Food Bank of Texas, lending their assistance to food banks in fulfilling some of the basic needs of hundreds of thousands of individuals each year.”  Added Hultman, “We began this activity several years ago and have found it to be one that many of our attendees look forward to at each seminar.  We are pleased to play a small part in an important process.”

Haughton will be responsible for the development of educational programs, sponsorship management, advertising and event management for the organization.

Haughton earned a Bachelor of Arts degree from Knox College, is a Certified Meeting Planner (CMP) and has more than 10 years of experience in the planning, hospitality and management industries. She is an active member of Meeting Professionals International and the Hospitality Sales and Marketing Association International.

Prior to joining USFN, Haughton was the director of special events sales & marketing at the House of Blues (a division of Live Nation Entertainment) at Downtown Disney in Anaheim, Calif.  Previously, she worked as the Special Events Sales Manager of the ESPN Zone (under the Disney Regional Entertainment umbrella) at locations in Downtown Disney in Anaheim, Calif. and in downtown Chicago, Illinois.

The USFN charitable initiative took place in Charlotte, North Carolina on June 9, 2010, and over 40 USFN Members, Associate Members, and servicing professionals volunteered their time to the SHFBM’s Food Drive program. This service project took place at SHFBM’s main warehouse in Charlotte and consisted of inspecting and sorting incoming food donations and essential household products from both individual and corporate donors. The sorted food and products will later be distributed to thousands of families, agencies and local food pantries throughout 19 counties in North and South Carolina.

“Being able to assist the Second Harvest Food Bank was a rewarding experience for all those who participated,” said Hultman. “We are proud to have contributed to this outstanding organization, which provides millions of pounds of food and other essential grocery products to those in need. I continue to impressed by the enthusiasm and generosity of the mortgage servicing community and USFN members in their willingness to help others.”

The awards were presented during USFN’s annual awards ceremony on Saturday, November 14, 2009 in Key Largo, Fla. by President Richard Rothfuss (Lerner, Sampson & Rothfuss, OH & KY).

The following individuals were recognized for their commitment and volunteerism to USFN and to the mortgage servicing industry at large:

USFN Member of the Year Recipient:

Cynthia Nierer (Rosicki, Rosicki & Associates)

The USFN Member of the Year award represents the epitome of volunteerism and leadership among the members of USFN.  The individual selected for this honor is recognized for going “above and beyond” the high standards of participation and service to the industry and to his/her member-peers.  Especially in today’s atmosphere of high-volume, mortgage industry headlines and challenging work environment, the honoree exceeds the norm in service and commitment to USFN and the industry.

Cynthia Nierer, the directing partner of Closings and Evictions at Plainview, N.Y.-based Rosicki, Rosicki & Associates, could not better embody the spirit of a fully committed and devoted volunteer. In addition to authoring articles for many industry publications, Cynthia extensively participates on several industry panels and has readily devoted herself to the facilitation of virtually every USFN seminar since the firm has been a member.

Specifically, Cynthia was honored for her exceptional involvement with the REO/Eviction Committee, where she helped to expand and update USFN’s REO/Eviction Desk Guide following the passage of the Protecting Tenants at Foreclosure Act (PTFA). Taking initiative, she then spearheaded the PTFA portion of October’s USFN HAMP and PTFA workshop, with the goal of educating servicing professionals on the specifics of changing industry legislation.

USFN Committee Chair of the Year

Tom Dore (Membership Committee)

The Committee Chair of the Year award was established to recognize outstanding individual service to USFN as the chair of a standing or special committee or task force.  The award is given to a Committee or Task Force Chair who has shown dedication, ability and high accomplishments in meeting the goals established by the Board and the Committee.  This is a person who collaborates diligently with the USFN staff and the members of his or her committee to work on behalf of the members and the Board in a timely fashion, with creativity, professionalism and accuracy.

This year’s award was presented to Tom Dore, chair of the USFN Membership Committee, and longtime active volunteer on various task forces and subcommittees. Known for his dedication and willingness to lead objective review discussions on complex industry issues and considerations, Dore is a partner at his own Towson, Md.-based firm, Covahey, Boozer, Devan & Dore.

Associate Member of the Year

Robert Klein (CEO of Safeguard Properties)

The Associate Member of the Year award was created to recognize outstanding service and support of the USFN by an Associate Member Firm.  USFN’s Associate Members provide a valuable liaison and vendor resource to its Members and the industry. They supply needed expertise in their respective industry segments and bring this knowledge to USFN’s seminars and educational publications. This award honors an Associate Member firm that has gone beyond the norm in actively contributing to USFN and its activities on every level, including financial and program support.

Robert Klein is the chief executive officer of Safeguard Properties, a Cleveland, Ohio-based privately held field services firm.  The company specializes in REO services, valuations, title services insurance loss inspection and hazard claims administration. Especially valuable to USFN, Robert and his staff have been instrumental in their contributions to seminars, committees and task forces. Specifically with regard to the area of Vacant Property Registration, Safeguard has been a unifier and innovator, working towards developing lasting industry solutions.

Aside from his professional contributions, Robert donates both his time and financial support to aid the Cleveland-area housing market. Most notably, he was responsible for organizing a community effort to restore Fir Street Cemetery and its surrounding neighborhood to the heights of its former urban affluence before the foreclosure crisis.

Michael C. Barrett Industry Innovator Award

Mike Echevarria (Florida Default Law Group)

The Michael C. Barrett Industry Innovator Award was developed this year to commemorate industry legend Michael C. Barrett. Barrett was an innovator in the default servicing industry, an attorney that was certified across two states and admitted by the both the U.S. Supreme Court, district courts and court of Appeals of Texas for his outstanding work as a lawyer and businessperson. Recipients of the Michael C. Barrett Industry Innovator Award must inhabit the characteristics Michael was known for throughout his career: innovative thinking and performance; client advocacy; leadership in the industry or organization; strategic thinking and accomplishments; and significance and impact on the industry.

The inaugural recipient, Mike Echevarria, is a managing partner at Florida Default Law Group, a Tampa, Fla.-based full-service real estate and mortgage banking law firm. An associate and longtime friend of the late Barrett and a persona that fully demonstrates the work ethic so highly regarded by Barrett, Echevarria was a fitting and deserving first awardee.

“It was an honor to be able to recognize the spectacular firms and individuals that steer the development and prosperity of USFN, its Members and Associate Members,” said Hultman. “The 2009 award recipients have been examples of extraordinary support, volunteering their time, knowledge and tireless efforts to the advancement and betterment of USFN and the mortgage banking industry at large.”

USFN’s Board of Directors voted unanimously to support the respondents in the filing of an amicus brief in the United States Supreme Court case captioned, Jerman v. Carlisle, McNellie, Rini, Kramer & Ulrich, LPA. The sole question presented for review in Jerman is, “Whether a debt collector’s error in interpreting the law qualifies for the bona fide error defense under the Fair Debt Collection Practices Act (“FDCPA”), 15 U.S.C. § 1692.”

“The members of the Board were quick to recognize the far-reaching effects of a negative ruling in this case on all members of our organization, and in fact, on all practitioners in the creditors’ rights area,” said Hultman. “If attorneys are held liable for errors on issues that are “grey” or “muddy”, the question then arises as to whether a firm can still provide the best representation of a client when dealing with such issues.”

The brief was filed on its due date of November 30, 2009. An ongoing amici group, working on this issue for several months, developed the brief, led by attorney Rick DeBlasis of Lerner Sampson & Rothfuss in Cincinnati, Ohio.

“By next summer, the United States Supreme Court will decide whether lenders’ lawyers and other ethical debt collectors can be held liable to borrowers for good faith legal errors, possibly such as bringing a suit in the name of the wrong plaintiff or for a sum which is ultimately proven to be incorrect,” said DeBlasis.

Several members of USFN’s Board, whose firms have expertise in FDCPA matters and/or in filing Supreme Court briefs, also volunteered their services to the amici group to assist in this effort. As noted, oral argument will be heard by the Court on January 13, 2010.

The USFN Mortgage Servicing Leadership Award was presented to Mr. Womack, servicing manager at Fannie Mae, in recognition of his exemplary standards of service and dedication to the mortgage servicing industry. Always approachable and willing to discuss industry issues and challenges, Mr. Womack is an active participant in USFN seminar sessions, openly offering to discussions a wealth of industry knowledge and insight. As an industry veteran, he has consistently taken the initiative to guide and assist industry professionals from all aspects of mortgage servicing whenever possible.

Cambridge Place Investment Management’s Jason Bourdeau was the first recipient of the USFN Ambassador Award, created this year to recognize outstanding contributions to USFN and the servicing industry. The USFN Ambassador Award embodies an individual who is always at the ready to contribute time, knowledge and leadership to the efforts of USFN and the industry as a whole.  Mr. Bourdeau has long been active at USFN seminars, serving as a panelist on numerous occasions and lending his expertise in MBS and the securitization process to presentations on this complex area.

Held on June 4, 2009, 50 attendees participated in a special service project designed to contribute to those in need in the New Orleans area. The day began with an enlightening bus tour through some of the city areas most affected by 2005’s Hurricane Katrina, providing participants a first-hand glimpse into the havoc that was wreaked by the storm. After returning to the Red Cross headquarters, USFN attendees met with Southeast Louisiana Chapter CEO Kay Wilkins, who shared stories of the challenges faced by the city, immediately after the storm and continuing through current times. The group then assembled more than 330 comfort kits, which will be provided in the future to families who are displaced due to a disaster. The kits, 3,000 of which are distributed locally each year, include essential personal necessities, such as shampoo and toothpaste.

“To be able to assist the Red Cross in New Orleans was an extremely fulfilling experience for those who participated,” said Hultman. “This was only one event that demonstrates how our members and industry professionals give back. I am constantly encouraged by the spirit and dedication of the mortgage servicing community to support those in need.”
