Each piece of your property is then protected with "exemptions." The available exemptions are limited. For example, the motorized vehicle exemption in Georgia is $3,500 for a single filer. What happens if you have more than $3,500 of equity in your motorized vehicle? We would use the "wild card exemption," which is $5,600 for a single filer. Currently, there are three Hearing rooms for Chapter 7 cases and one Hearing room for Chapter 13 cases.  Your Hearing room is assigned at the time your case is filed and is disclosed on the Notice the Court sent to you, and in the email you received from Van Wieren Law Firm, LLC shortly after your case was filed.  Inside the Hearing room there is a table for the Trustee and approximately 10-15 chairs for you to wait until your case is called.  The Hearing rooms are not private, but are normally filled with people waiting for their case to be called by the Trustee.  When your case is called, we move to the table where the Trustee is seated.  &lt;br /&gt;

Once the value of the property is disclosed, we will use the allowable exemptions under Georgia law to protect as much of the property as possible. The legal effect of signing the Reaffirmation Agreement is that the personal liability that was released from you, by way of filing for filing for bankruptcy protection, reattaches to you.&lt;br /&gt;
&lt;br /&gt;
For example, say you have a car loan that was listed in your bankruptcy petition.  When your petition is filed with the court, the creditor can no longer sue you to collect on that car loan.  Of course, the creditor could repossess the vehicle if you do not make timely monthly payments, but the creditor cannot sue you for the balance on the loan.  &lt;b&gt;This is a huge benefit of filing for bankruptcy protection!&lt;/b&gt;  This benefit is extinguished if you sign a Reaffirmation Agreement, and that Agreement is filed with the court.  Why?  Because you signed (executed) and filed a post-filing contract, which reattaches liability to you.  If your car gets repossessed after you sign the Reaffirmation Agreement, the creditor now has rights to sue you for the deficiency on your car loan.  &lt;br /&gt;
&lt;br /&gt;
Our take on Reaffirmation Agreements is they only benefit creditors, &lt;b&gt;not you&lt;/b&gt;!  Remember the goal of filing for bankruptcy protection is to get you a "fresh start."  By signing (executing) a Reaffirmation Agreement, you are taking debt into your new financial life.&lt;br /&gt;
&lt;br /&gt;
The lesson of all of this is --- consult with your attorney before you sign any contracts after you file for bankrutpcy protection.&lt;br /&gt;

If you are filing under Chapter 7, the Trustee's narrow focus is the amount of equity you have in your property.  Equity is the difference between the amount you owe and the value of the property.  &lt;br /&gt;
&lt;br /&gt;
For example, if you owe $15,000 on your 2005 Toyota Corolla and the car is only worth $9,000, you have negative equity.  If you owe $15,000 on your 2009 Toyota Corolla and the car is worth $19,000, you have $4,000 of equity.  &lt;br /&gt;
&lt;br /&gt;
If you do &lt;b&gt;not&lt;/b&gt; have equity in your property, the Chapter 7 Trustee is not going to be interested in your property, for purposes of selling that property for the benefit of your creditors.  Why? Because there is no monetary benefit to your creditors by selling the property because there is no equity, or available money.&lt;br /&gt;
&lt;br /&gt;
If you &lt;b&gt;do&lt;/b&gt; have equity in your property, ask your &lt;a href="http://www.vanwierenlaw.com"&gt;attorney&lt;/a&gt; if the equity is below Georgia's allowable exemption levels.  If you have equity in your property above the exemtion levels, the Chapter 7 Trustee may attempt to sell your property for the benefit of your creditors.&lt;br /&gt;
&lt;br /&gt;
In Georgia, the motorized vehicle exemption level for a single-filer is $3,500.  What this means is if the equity in your car is less than $3,500. and your attorney uses Georgia's motorized vehicle exemption, your car is protected from the Chapter 7 Trustee's control, and you can keep your car.&lt;br /&gt;
&lt;br /&gt;
The best case scenario, for purposes of bankruptcy, is that you have negative equity in your car.  The standard for valuing your car in the Northern District of Georgia is using Kelly Blue Book, NADA, or some other similar online resource.&lt;br /&gt;

A creditor is someone to whom you owe money at the time of your filing.  If you owe your bankruptcy attorney money when your case is filed, he or she becomes a creditor.  &lt;br /&gt;
&lt;br /&gt;
The ultimate goal for most people who file for bankruptcy protection, is to get their debts discharged, or ordered uncollectable by the Judge.  When your discharge is ordered, the money you owe your bankruptcy attorney that was disclosed in your petition is uncollectable.  Which means, your attorney cannot ask or demand you pay the debt after your case is filed with the court.  If he or she does ask or demand that you pay the debt, you can sue your attorney for violation of the Fair Debt Collections Practice Act (FDCPA).&lt;br /&gt;
&lt;br /&gt;
Here are some other examples of practices by bankruptcy law firms that violate FDCPA, and would entitle you to a monetary award: (1) cashing post-dated checks after your case was filed; (2) sending you a collection letter after your case was filed; and/or (3) calling you and demanding payment after your case was filed.&lt;br /&gt;

16. Does anyone owe you money? Is the money collectible? Why haven't you collected it? Who owes the money and where are they? &lt;br /&gt;

17. Have you made any large payments, over $600, to anyone in the past year? &lt;br /&gt;

18. Are you the owner of any cash value life insurance policies? &lt;br /&gt;

Your hearing will be scheduled approximately four weeks after your petition is filed with the court.&lt;br /&gt;

&lt;strong&gt;What Time Should I Arrive?&lt;/strong&gt;&lt;br /&gt;
You should plan to meet your &lt;a href="http://www.vanwierenlaw.com/"&gt;attorney&lt;/a&gt; on the third floor of the Richard B. Russell Federal Building in downtown Atlanta at least 30 minutes before your scheduled Meeting Of Creditors hearing.&amp;nbsp; Plan to leave enough time to find a parking spot, and maneuver through security.&amp;nbsp; If your cellphone has a camera, leave it in the car to avoid additional delays at the security checkpoint.&lt;br /&gt;

&lt;strong&gt;What Do I Need To Bring With Me?&lt;/strong&gt;&lt;br /&gt;
Bring your state issued identification and proof of your social security number.&amp;nbsp; The best way to prove your social security number is with your social security card.&amp;nbsp; An original W-2 issued by your employer may substitute for your social security card.&amp;nbsp; You do not need to bring anything else with you, unless directed to do so by your attorney.&lt;br /&gt;

&lt;br /&gt;
Today, the loan modification company says the foreclosure has been removed from Tuesday's calendar, and demanded the&amp;nbsp;remaining balance&amp;nbsp;be paid in full.&amp;nbsp; Caller has been unable to verify the foreclosure sale&amp;nbsp;was removed from Tuesday's calendar, or rescheduled, and is refusing to pay the remaining balance until asserted results are verified.&lt;br /&gt;
&lt;br /&gt;
After researching this same loan modification company on the internet, I found they had numerous complaints published by consumers with allegations of no foreclosure prevention assistance, even after the company&amp;nbsp;was paid in&amp;nbsp;full.&amp;nbsp; Florida's Attorney General has received several complaints about this same loan modification company, but has not started a formal investigation.&lt;br /&gt;
&lt;br /&gt;
I'm always been skeptical of paying for loan modification services, when there are plenty of non-profit companies that will assist you for &lt;strong&gt;free&lt;/strong&gt;.&amp;nbsp; For example, consider &lt;a href="http://www.hopenow.com/"&gt;Hope Now&lt;/a&gt;, &lt;a href="https://www.naca.com/index_main.jsp"&gt;NACA&lt;/a&gt;, &lt;a href="http://www.atlantalegalaid.org/"&gt;Atlanta Legal Aid&lt;/a&gt;, and other smaller organizations based in some of Atlanta's neighborhoods.&lt;br /&gt;
&lt;br /&gt;
If you are considering applying for a loan modification, please be skeptical of any company that is charging you for a service that you can do, or can be done by a non-profit organization.&amp;nbsp; If you insist on paying for the modification service, verify their record of service with &lt;a href="http://law.ga.gov/02/ago/home/0,2705,87670814,00.html"&gt;Georgia's Attorney General&lt;/a&gt;, the &lt;a href="http://atlanta.bbb.org/"&gt;Bettter Business Bureau&lt;/a&gt;, &lt;a href="http://corp.sos.state.ga.us/corp/soskb/csearch.asp"&gt;Georgia's Secretary of State&lt;/a&gt;, and any other service you can find.&lt;br /&gt;
