This month in litigation news, one of our clients was involved in an auto accident that left minimal damage to her vehicle, but significant damage to her body. In early December she was rear ended by an individual who was not paying proper time and attention to the ahead traffic conditions. The impact left our client with immense pain to her neck, arm, shoulder, and chest. After three months of physical therapy and accruing nearly $7,500.00 in medical bills, it was time for her claim to be evaluated by Geico. However, the assigned adjuster contacted our office stating they were not going to pay anything towards our client’s bodily injury due to the amount that was paid out for property damage. Essentially claiming she couldn’t have been injured from the accident. Humans are not built to withhold the impact of another vehicle, especially when you have no time to brace yourself for the blow. After our Attorney, Ms. Theresa Teixeira tried the case, our client walked away with a verdict of $14,500.00. Needless to say, our client was more than thankful she chose Portner & Shure to represent her during her time of need.

On February 11th, 2017, one of our clients was involved in an accident where she was rear-ended at a stop sign. The impact left our client with unsettling pain to her neck, back, right arm, and her shoulders. On January 19th, our client was injured in a rear-end collision while stopped at a red light on Rt. 4. After several failed attempts of trying to reach out to the defendant, liability was denied because the driver was non-compliant. However, once our client was through with his medical treatment, our litigation team was able to track down the defendant to take to court. After liability was denied and Paramount Insurance wasn't willing to make any payments on the claim at all, we received a court verdict of $12,987.00 plus costs for our client. Needless to say, he was very satisfied with his final result and services rendered from Portner & Shure.

Join us in welcoming one of our newest attorneys, Theresa Teixeria. Ms. Teixeira received her undergraduate degree from University of Connecticut. She graduated from Quinnipiac University School of Law in 2007. Following law school, Ms. Teixeira was admitted to the Connecticut State Bar and worked as an associate where she litigated cases in both the State and Federal Courts. Her areas of practice include personal injury and Workers’ Compensation. After relocating from Connecticut, she was admitted to the Maryland Bar in 2016. Her current areas of practice include Workers’ Compensation, personal injury, traffic and criminal. This month in Litigation news at Portner & Shure, we received two trial awards after Geico had decided they were not going to make any offers on the claims. Two of our clients were injured after a Geico insured had rear ended them at an intersection. Due to Geico’s claim of minimal property damage, the insurance company came to the conclusion that the claim was not worth anything, of course we felt differently. After taking the case to court, our clients were awarded fair settlement verdicts and were extremely satisfied with the work of their Paralegal and Attorney.

Recently, Portner & Shure settled a case where two of our clients were rear-ended, leaving them both in immense pain. In an effort to treat their injuries they presented themselves to a hospital and followed discharge instructions to be seen by a chiropractor to ease the rest of their pain. After following their doctor’s treatment plan they were discharged and left with medical bills equaling over $6,000.00 each. After extensive negotiations with the liable insurance company, it was clear they were not willing to offer the settlement amount our clients deserved. Before going to court we were given offers of $7,700.00 and $6,600.00 to settle our client’s claims. However, after going to court we received the verdict of $15,000.00 for one, and $10,586.00 for the other. Needless to say, our clients were very happy with their court award.

This month in litigation news at Portner & Shure, our attorneys have realized that during settlement negations with Allstate, the insurance company believes they have the right to audit medical bills. When Allstate has medical bills audited they make major cuts to the total cost and make offers based on their reductions, even though our clients are still stuck with the full bill. Because of this, we have found that the insurance company generally loses in the court room due to the fact the judge feels as though the reductions are excessive. Our clients fighting against Allstate have been extremely satisfied with their settlement offers after going to court and getting the compensation they deserve from their accident.

Recently, Portner & Shure settled a rear-end accident case for $80,000.00. Our client was stopped waiting to make a left turn, when all of a sudden, she was hit from behind by a dump truck. As a result of the force of the collision, our client slammed her head against her steering wheel and suffered serious head injuries. Our client’s vehicle sustained significant property damage. Our client sustained a concussion and had total medical bills over $20,000.00. After extensive negotiations with the liability insurance company, an offer of settlement of $80,000.00 was extended. Our client accepted and was extremely happy with the result in her case.

This month in litigation news at Portner & Shure, we have an accident case where our client was rear-ended in a line of three cars in Montgomery County, Maryland. Liability was not an issue in this case, but the liability insurance carrier would not make a fair offer of settlement considering our client’s injuries and pain and suffering. Our client suffered injuries to her neck, shoulders, back, numbness in her leg, and a concussion. With nearly $10,000.00 in medical expenses, our client endured over 3 months of medical treatment for her injuries. Due to the insurance company’s failure to make a fair offer of settlement, our litigation team filed suit to battle this out in court. The trial Judge in the General District Court for Montgomery County awarded our client $14,949.79 plus court costs. This trial award was more than $3,000 higher than the top offer from the insurance company. Our client was extremely satisfied with this result, especially considering that the insurance company tried to settle the case for much less.

Recently, Portner & Shure settled a rear-end accident case for $41,500.00. This was not a typical rear-end accident where there was minimal property damage. This was a big impact rear-end crash involving a large truck slamming into our client’s vehicle in Charlottesville, Virginia. Our client’s vehicle was totaled and he suffered serious injuries to his back, right hip, and both arms. His medical expenses totaled more than $14,000. Initially, the insurance company made an offer of $23,000 to settle the case and were only willing to come up marginally higher. We then prepared to file suit in the case, but made one last attempt to see if the liability insurance adjuster would increase their settlement offer, which they would not. Our litigation team filed suit. Prior to trial, the insurance company increased their offer to settle, but it still was not a fair offer in our client’s eyes. After negotiating with the insurance company further, our litigation team managed to get an offer of $41,500.00, which our client accepted.

This month in litigation news at Portner & Shure, we have an accident case where our client was hit by a construction vehicle in Prince William County, Virginia. Liability was not an issue in this case, but the liability insurance carrier would not make a fair offer of settlement considering our client’s injuries and pain and suffering. As a result, we were forced to file suit in order to obtain the compensation our client was entitled. In this accident, our client suffered injuries to his entire left side of the body, his neck, and his back. He was treated in the emergency room immediately after the crash, and required chiropractic treatment for two months. After incurring more than $10,000.00 in medical expenses and with a settlement offer just over the total medical expenses, our litigation team successfully battled this case out in court. The trial Judge in the General District Court for Prince William County awarded our client $18,000.00 plus court costs. Our client was extremely satisfied with this result, especially considering that the insurance company tried to settle the case for much less.

This was a horrific accident that was caused by a drunk driver driving in the wrong direction on a one-way road in Loudoun County, Virginia. Our client’s vehicle was totaled and he suffered broken ribs, stitches on her right hand, and a dislocated shoulder.
