Taxation of Commodity Traders

Commodity Traders may be taxed under two different methodologies. One I refer to as the "Default Rule" and the other I refer to as the "Mark-To-Market Election Rule".

THE DEFAULT RULE
Under Internal Revenue Code ("IRC") section 1256, Commodity Traders are granted two major tax breaks:
Tax Break #1
60% of commodity gains are taxed at the long-term gains tax rate and 40% of gains are taxed are treated as short-term gains. This is known as the "60/40 Rule".
Tax Break #2
Commodity trading losses may be carried back three years, to offset prior years commodity trading gains.

In order to meet the definition of a Commodity Trader, for purposes of the above favorable tax breaks, an individual must be a member of a domestic board of trade designated as a contract market by the Commodity Futures Trading Commission (a.k.a. "regulated exchange"). The definition of a commodity under IRC section 1256 includes any regulated futures contract, any foreign currency contract, any non-equity option, any dealer equity option and any dealer securities futures contract. If you trade on a regulated exchange you are a "Commodities Trader" under IRC section 1256 and can avail yourself of the preferential 60/40 Rule.

When such Commodity Traders file their tax returns for the year they report their commodities gains and losses on Form 6781, which is attached to Form 1040 (Federal Income Tax Return for individuals). The gains and losses reported on Form 6781 are split into two groups: 60% long-term gains and 40% short-term gains. The next step is to move these two groups of gains/(losses) over to Schedule D and they are taxed accordingly (long-term gains/losses are netted against short-term gains/losses). If there is a net long-term gain this is taxed at the current favorable capital gains tax rate of 15%.

What I just described is the general rule of taxation of Commodity Traders and most Commodity Traders are taxed under this rule. Any expenses you may have incurred (such as margin interest expense) may only be deducted as an itemized deduction and, thus limited.

MARK-TO-MARKET ELECTION RULE
There is another tax option available to Commodity Traders, however. If a Commodity Trader meets the definite of a "Professional Trader" they are eligible to make the IRC section 475 Mark-To-Market election. This new optional rule came into effect in 1997 under The Taxpayer Relief Act of 1997, which gave Commodity Traders the ability to make the Internal Revenue Code ("IRC") section 475 Mark-To-Market election. When you make this election it allows Commodity Traders to do two things:

#1 Treat commodity gains and losses as ordinary income (loss). When you make the IRC section 475 Mark-To-Market election you are eligible to file a Schedule C and list your commodity business expenses. Under this election, commodity business expenses have more value as they are no longer considered itemized deductions but, instead, ordinary business expenses. These expenses can then be used to offset other income you reported, such as wages. When you make the Mark-To-Market election, a Commodity Trader is electing out of the 60/40 Rule and, instead, treats all gains and losses as ordinary. The 60/40 Rule is the default rule that is available to Commodity Traders who have not made the IRC section 475 Mark-To-Market election. Most Commodity Traders do not make the IRC section 475 Mark-To-Market election in order to preserve the favorable taxation of commodities (60% long-term gain treatment and 40% short-term gain treatment).

#2 Allow Commodity Traders to take deductions on Schedule C for business expenses associated with your commodity trading business. You can only take deductions on a Schedule C where you have a valid IRC section 475 Mark-To-Market election in place.

In order to be eligible for the IRC section 475 Mark-To-Market election a Commodity Trader must meet the stringent tax definition of a Trader. The "Trader" definition, for purposes of the Mark-To-Market election, requires an individual to seek to profit from short-term changes in the market. This trading activity must be substantial, frequent and continuous. You must be a full-time trader who is trying to capitalize on the momentary swings in the market each day. If you meet the definition of a "Trader" then you are eligible to make the Mark-To Market election, which must be made by April 15th of the current year if you want the election to be effective for the current year. Example: You make the election by April 15, 2012 for tax year 2012. Once in place the election allows you to treat all gains and losses as ordinary (reported on Form 4797, which is attached to your individual income tax return Form 1040).

Commodity Traders cannot take advantage of the 60/40 Rule and take deductions on Schedule C at the same time. It's one or the other. The 60/40 Rule is only available to Commodity Traders who DID NOT make the IRC section 475 Mark-To-Market election. The ability to take Schedule C deductions is only available to Commodity Traders DID make the IRC section 475 Mark-To-Market election.

The launch control button is instead designed to offer the best possible acceleration from standstill. To start using the Launch control, the manettino must be selected on race, CT or CTS setting. With the car still at standstill, the driver then needs to put the gearbox in manual, selects first gear, pushes the launch control, presses the accelerator pedal and then releases the brake pedal.

What was the significance of the Andrea Doria?
The SS Andrea Doria was an ocean liner for the Italian Line with a gross tonnage of 29,100 and a capacity of about 1,200 passengers and 500 crew. For a country attempting to rebuild its economy and reputation after World War II, the Andrea Doria was an icon of Italian national pride. Of all Italy's ships at the time, Andrea Doria was the largest, fastest and supposedly safest.

What happened after the Andrea Doria was struck by the SS Stockholm?
After being struck in the side, the list of the mortally wounded ship left half of Andrea Doria's lifeboats unusable, which might have resulted in significant loss of life, but improvements in communications and rapid responses by other ships averted a disaster similar in scale to the Titanic disaster of 1912. On the Andrea Doria 1660 people were rescued and 46 people died. The evacuated luxury liner capsized and sank the following morning.

Why is the Andrea Doria disaster so well known?
The incident and the aftermath were heavily covered by the news media. While the rescue efforts were both successful and commendable, the cause of the collision and the capsizing and sinking of the Andrea Doria afterward generated much interest in the media, and many lawsuits. The Andrea Doria was the last major transatlantic passenger vessel to sink before airplanes became the preferred method of travel.

What is the Andrea Doria's legacy?
There were several months of hearings in New York City in the aftermath of the collision. Both shipping lines contributed to a settlement fund for the victims. For the Swedish-American Line, damages were estimated at $2 million, half for repairs to Stockholm's bow, and half for lost business during repairs. The Italian Line sustained a loss of Andrea Doria's full value, estimated to be $30 million. The Bermuda Triangle, also known as the Devil's Triangle, is an area of the north Atlantic Ocean where it is popularly believed a significant number of ships and aircraft have disappeared under highly unusual circumstances. It has become popular through its representation by mass media as an area of paranormal activity where the known laws of physics are violated. It has even been suggested that extraterrestrial beings are responsible for some of the disappearances.

Where is the Bermuda Triangle?

As its name suggests, the Bermuda Triangle is approximately triangular in shape, with three corners roughly defined by Bermuda, Puerto Rico, and Fort Lauderdale, Florida. Its size is nearly half a million square miles. The Triangle marks a corridor of the north Atlantic stretching northward from the West Indies along the North American seaboard as far as the Carolinas. The Gulf Stream, an area of volatile weather, also passes through the Triangle as it leaves the West Indies.

How did the Bermuda Triangle receive its spooky connotations?
The area achieved its current fame largely through the efforts of Charles Berlitz in his 1974 book The Bermuda Triangle and its subsequent film adaptation. What about Flight 19's disappearance in the Bermuda Triangle?

One of the best known, and probably the most famous Bermuda Triangle incidents concerns the loss of Flight 19, a squadron of five U.S. Navy TBM Avenger torpedo bombers on a training flight out of Fort Lauderdale, Florida on December 5, 1945. According to Berlitz, the flight consisted of expert naval aviators who, after reporting a number of odd visual effects, simply disappeared. However, a more likely scenario indicate that the flight commander became confused and disoriented, ultimately leading his flight out to sea where they ran out of gas and ditched in stormy night time waters. And, although his student-pilots believed he was mistaken as to their location, he was the Flight Leader, and he was in command. By the time he took one of the trainee pilots advice to fly west, they were too far out to ever make landfall.

Is the Bermuda Triangle really a dangerous place?

The marine insurer Lloyd's of London has determined the "triangle" to be no more dangerous than any other area of ocean, and does not charge unusual rates for passage through the region. Coast Guard records confirm their conclusion. In fact, the number of supposed disappearances is relatively insignificant considering the number of ships and aircraft which pass through on a regular basis. Additionally, in an area frequented by tropical storms, the number of disappearances that occur are mostly neither disproportionate, unlikely, nor mysterious.

Instead of suffering through a fruitless collaboration, it's best - for both of you - if you drop that client, ASAP.

The non-paying client. This should be a no-brainer, right? But for writers who are eternal optimists, hope can blind us and keep us writing long after we should have moved on to another project. Too often we buy into clients' excuses:

"I'll pay you next month when I get my bonus."
"I've got some inheritance money coming in. Once I get it, I'll write you a check."
"I can't pay you right now, but when this book becomes a best seller..."

Run away! Don't accept such premises. There is no money, so don't waste your time. Politely explain why you must decline, and search for another project.

The client who changes his mind - a lot. To the point where you've made zero progress. First they want one thing. A week later, they change their mind and ask you to take a completely different direction. Five more days pass, and they present a revised outline that has nothing in common with the original project parameters.

At this point, it's clear they haven't thought things through. Since they have no idea what they want, and it may take weeks or months or longer before they figure it out, you need to politely leave the picture. Let the client know that once they've finalized their plans, you'll be happy to work with them. It's possible you'll never hear from them again - and that's perfectly ok.

The client who doesn't appreciate what you do. Most clients are thrilled by what you can do for them. They are pleased that you make them sound so good in writing. But now and then, a client comes along who does not appreciate what goes into improving a manuscript. They'll point to a passage and complain that, "All you did was tweak a couple of lines here, delete a few there, and replace some of the words. I think you charge too much for what you do." Never mind that thanks to your targeted edits, their manuscript now reads a hundred times better than before!

Perhaps they genuinely don't like your revisions. First, give them the benefit of the doubt. Work with them to determine what they really want. If it becomes clear, however, that they don't value your service or they're trying to browbeat you into dropping your rates, you'll need to part ways. They don't appreciate your work now, so you can be sure they won't down the road, either. Your collaboration, should you decide to keep it going, will be a rocky one every step of the way.

The client with the incomprehensible manuscript. Even your magic can't repair this so-called novel. There is nothing connecting the chapters. You can't fix the plot because the plot is missing. A character who dominates Chapter 2 never makes an appearance again. Events transpire with no seeming purpose or association. The author contradicts himself everywhere. What's a book editor to do?

You can do one of two things: either do your best to improve the manuscript and add a measure of coherency, or explain that they don't have a novel. They have a collection of short stories with no central theme or unifying force - if that. Maybe all they have is an incoherent stream of disjointed thoughts.

As always, be exceptionally professional, and kind, as you explain why they don't have a viable novel. Offer to write a detailed critique. If they return a year later with a manuscript that exhibits some semblance of order and sense, then you can do your magic.

Sad news, Marco Simoncelli dies after MotoGP crash in Sepang

When i see the news, i'm sad when i heard Marco Simoncelli was die after the accident in Sepang Malaysia, by the way this is the news i found from BBC Sport :

The race was stopped on lap two when Simoncelli's bike veered across the track at turn 11 into the path of Colin Edwards and Valentino Rossi.

The 24-year-old had his helmet knocked off and was hit by both other riders.

American rider Edwards also fell and dislocated his shoulder - while Simoncelli's fellow Italian Rossi was able to return to the pits.

Simoncelli lay motionless on the track after the impact, while the race was immediately red-flagged.

Medical director Michele Macchiagodena said Simoncelli suffered a "very serious trauma to the head, to the neck and the chest".

At first officials were looking to restart the race before the extent of Simoncelli's injuries became clear.

The race was cancelled amid confusion in the grandstand, with fans throwing bottles to show their initial displeasure.

The death is the first fatality in MotoGP since Japan's Daijiro Katoh died from injuries sustained at the 2003 Japanese GP while, last year, Japan's Shoya Tomizawa died in a similar crash to Simoncelli in a Moto2 race in San Marino.

Simoncelli's death comes a week after British IndyCar driver Dan Wheldon was killed in Las Vegas following a 15-car crash.
BBC MotoGP presenter Matt Roberts said: "Marco lost his helmet in the crash. The officials said that, when the track medics got to him, he was in cardiac arrest. They tried to resuscitate him in the ambulance and the medical centre.

"Both riders collided with him and the impact corresponded to him losing his helmet. The saddest thing is that Valentino [Rossi] and Marco were very close friends.

"Colin [Edwards] has a dislocated shoulder and is in a lot of pain. He and Valentino are absolutely devastated."

A MotoGP statement read: "On Sunday, 23 October, during the MotoGP race at the Sepang International Circuit, San Carlo Honda Gresini's Italian rider Marco Simoncelli suffered a serious accident wherein he sustained critical injuries.

"The race was stopped immediately with the red flag and Simoncelli was transported by ambulance to the circuit medical centre where the medical staff worked to resuscitate him.

"Despite their efforts, Marco sadly succumbed to his injuries at 4.56pm local time [0956 BST].

"Everybody involved in MotoGP extends its deepest condolences to Marco's family, friends and team at this tragic loss."

And Sepang circuit chairman Mokhzani Mahathir added: "This is a one-of-a-kind freak incident where the helmet came off and I am sure FIM [International Federation of Motorcycling] and MotoGP will be looking into this."

Honda rider Simoncelli entered MotoGP for the 2010 season and won his first pole position at the Catalunya race in June this year.

Simoncelli's first podium finish came in the Czech Republic in August when he finished third but he bettered that with a second-place finish at the Australian GP.

World champion Casey Stoner said: "As soon as I saw the footage it just makes you sick inside. Whenever the helmet comes off that's not a good sign."

British MotoGP rider Cal Crutchlow tweeted: "RIP Marco Simoncelli! A great rider and all round nice guy. My thoughts are with all his family & friends. I will never forget today."

Australian Formula 1 driver Mark Webber tweeted: "RIP Marco. A special talent that will be missed. Thinking of your loved ones and all the MotoGP paddock."

Major Italian sports events on Sunday observed a minute's silence in memory of Simoncelli, who was a big fan of football club AC Milan.

In their Serie A fixture against Lecce, Milan wore black armbands and came back from three goals behind to win 4-3.

You twist your foot. And then you feel a sharp pain in that area. You try to persevere, but you already see one of the outfielders throwing the ball to the first baseman. You run harder but the pain just becomes even worse.

Don’t push it.

Sometimes, you just have to learn when to give up. This is especially the case if you are injured. We have been taught that there is honor in persistence. And you will get your teammates’ nod for taking one for the team.

But always ask yourself, is it worth it? More often than not, the answer is no. You see, pain is your body’s way of telling you that there is something wrong with it. So do not try to push harder even if you think you still can. What you may not know is that you are only worsening your condition by trying harder.

When you find yourself injured, stop. It may not feel much at the beginning but it could be something serious, only that you are not aware of the severity of your condition yet. Sit it out. It is frustrating, of course, but do you really want to be sidelined for the rest of the season, even the rest of your career, for just one game?

'Gossip Girl' EP: Elizabeth Hurley's character like Heather Locklear on 'Melrose Place'

When Elizabeth Hurley joins "Gossip Girl," her character of Diana Payne may seem awfully familiar.

Executive producer Josh Safran suggested that Hurley, who plays a power-hungry media mogul, will remind people Amanda Woodward, Heather Locklear's character from "Melrose Place."

"When she says something, even though she may move the chess pieces around to get what she wants, she says up top 'This is what I want'," Safran says. "So if people don't comply, she'll move them to get what she wants."

Safran added he was ecstatic for Hurley to join the cast and she was his first choice for the role.

"She was our wish list. It sounds terrible, but when we saw that 'Wonder Woman' (a pilot Hurley had worked on) wasn't going forward, I was like oooh! Which is horrible because you want to like be very happy for other people's successes, but we just wanted her too badly," Safran says.

Hurley, like most of the cast, starts the season in Los Angeles. But when the crew slowly migrates back to their comfort zone of Manhattan, she'll be joining, Safran says.

Texas Tech president Guy Bailey gives insight into Thursday's Big 12 conference call

Texas Tech president Guy Bailey talked Friday morning about Thursday's Big 12 presidents with Chris Level and Aaron Dickens of Lubbock radio show 'Tech Talk' on Double T 104.3 FM.

Bailey's comments were subsequently transcribed and published on RedRaiderSports.com, Texas Tech's Rivals.com affiliate website.

While the decision to relieve Big 12 commissioner Dan Beebe stole Thursday headlines, the most important topic was discussing handing over media rights to the conference for a six-year period until the current ABC/ESPN contract expires.

"What that means is if you assign your rights to the conference and you leave, you leave your rights," Bailey told Level and Dickens. "There's a real incentive not to leave. We talked about assigning our rights to the conference for six years which is the period of the ABC/ESPN contract. Most of us have to go to our governing boards to get approval for that, but if that were to happen I think it would be the single most stabilizing factor for the conference."

Bailey suspects after the six-year period is up ABC and ESPN will insist the Big 12 teams hand over media rights for an additional period of time.

"I'm sure at that point ABC/ESPN would want us to assign our rights to the conference," Bailey said. "I'm sure they would probably demand it. They can't very easily do a contract with a conference that is not stable."

LSU football team's keys to victory today against West Virginia. The Mountaineers host the Tigers in LSU's Top 25 matchup in four games.

Tackle in space

West Virginia is LSU's third Spread-offense opponent this month, but different than Oregon and Mississippi State. The Mountaineers like to throw the ball around to many receivers and in all manner of routes. They won't go deep unless invited to. LSU defensive backs must tackle well in space and run to the ball in case the first defender misses. Expect to see defensive linemen and linebackers chasing down plays from the backside, because the field will be spread out. Mountaineers receivers and running backs aren't big, which makes them a little harder to pin down. LSU has to be careful not to overpursue on the pass rush because Geno Smith is a much better runner than Mississippi State's Chris Relf. The Tigers did a good job last season holding Smith to 119 yards passing on 14 completions, but the offense is a little different under first-year coach Dana Holgorsen. He may have some gadget plays to even the talent disadvantage.

Hammer the ball

West Virginia is less physical than Mississippi State because of a smaller defensive line, but the 3-3-5 Stack creates a different look that could cause some problems for the LSU line. The Tigers will probably work their physical running game and try to wear the Mountaineers down just as they did against Mississippi State last week, with Spencer Ware and Michael Ford pounding between the tackles out of two-tight end sets. LSU scored only one offensive touchdown last season against West Virginia but does have the tape to work from and an experienced line. Greg Shaw might get the start at left tackle if Chris Faulk can't go, and the line might struggle with the continuity. Constantly hitting the Mountaineers with the run will set up some passing opportunities later in the game, which worked quite well last week.

He's LSU's not-so-secret-weapon. Although he hasn't played, West Virginia will be ready for him based on last year's offense. Shepard gives LSU an outside threat it hasn't had. Expect Shepard to run some speed sweeps, and many of those bubble screens that have been going to Odell Beckham III will be going to Shepard. We are told Shepard is much improved, stronger, and it's about time for him to start living up to his promise. He has had more than two years to learn how to be a wide receiver but the point is to get the ball in his hands whatever way possible. His strengths are his moves, quickness and speed, which should make him dangerous in one-on-one situations. It's good that Miles wants to put him in the return game to give him another place to get touches. He'll probably be in on kickoff returns but not punts.
