The appeal to the higher court says the recommendation from the administrative law judge, Michael Malihi, was faulty and that he allegedly to this date has refused to follow the state’s requirements regarding the case.

The appeal has been filed with the Superior Court of Georgia for the County of Fulton by Van Irion, one of several attorneys who presented evidence at a hearing held by Malihi in January.

The city council is considering the ban after one home owner complained about smoke coming from their neighbors’ backyards saying it caused health problems for their kids. But before going to the city council, the family first asked their neighbors to stop smoking.

One couple agreed, according to their son. “They felt that there wasn’t any reason to put the household in any sort of health risk,” Eric Croslin said explaining his parent’s position.

“Do you think Santorum is a threat to your religious liberty? If you do, you are wrong,” Limbaugh told listeners this week, referring to the candidate’s now-infamous “Satan” speech at Ave Maria University. “Barack Obama has already shown that he is a threat to religious liberty. He has already indicated he doesn’t believe in it [by] mandating that Catholic institutions give away things related to abortion” (FREE audio).

Michael Savage

“Everyone is mocking Rick Santorum,” noted Michael Savage, “but the fact of the matter is, nothing he’s saying is false.”

He continued, “Everyone is saying this destroys Santorum’s chances. … Remember when the worst president in American history (until this one) was President Jimmy Carter?

“When Ronald Reagan came along, the Democrats said, ‘Oh, thank God! He’s a cultural conservative, so we can easily defeat him,’” Savage noted. “How did that work out for them?”

This fact was recently underscored by a study released by the Committee for a Responsible Federal Budget, a bipartisan think tank.

Newt Gingrich’s tax and budget plans would add $7 trillion to the debt over the remainder of the decade and Rick Santorum would do about the same.

Mitt Romney’s tax-cut and spending proposals would keep the deficit and debt on keel.

Ron Paul would reduce spending and slowly eliminate the debt by zeroing out a host of federal agencies. He would work to bring back honest money and sane economic policies by getting rid of the Federal Reserve – a prospect opposed by both sides of the establishment political party now ruling the roost in Washington.

Dozens of best-selling applications suddenly listed the same wrong publisher. It was as if Stephen King’s name had vanished from the covers of his books, replaced by an unknown author. Kytömäki realized the culprit was a piece of malware that was spreading quickly, and he posted his findings online.

Google responded swiftly. It flipped a little-known kill switch, reaching into more than 250,000 infected Android smartphones and forcibly removing the malicious code. “It was sort of unreal, watching something like that unfold,” says Kytömäki, who makes dice simulator apps. Kill switches are a standard part of most smartphones, tablets, and e-readers. Google, Apple , and Amazon all have the ability to reach into devices to delete illicit content or edit code without users’ permission. It’s a powerful way to stop threats that spread quickly, but it’s also a privacy and security land mine.

With the rollout of the Windows 8 operating system expected later this year, millions of desktop and laptop PCs will get kill switches for the first time. Microsoft hasn’t spoken publicly about its reasons for including this capability in Windows 8 beyond a cryptic warning that it might be compelled to use it for legal or security reasons.

As Mitt Romney prepared to deliver an economic address here on Friday declaring Mr. Obama’s three years in office a “failed presidency,” hundreds of union members gathered on the top level of a parking deck as a freezing drizzle fell.

“Thank you, President Obama!” shouted the union’s president, Bob King. He gripped a bullhorn as he exhorted the crowd, “Everyone!” They roared back, “Thank you, President Obama!”

It was the beginning of an effort by the U.A.W. and others in the labor movement to put their vast political organizations into motion behind Mr. Obama, testing their power in a difficult economy after years of declining membership. This is an election that both parties say could turn on their ability to win over working-class voters in the industrial Midwest, where battlegrounds like Michigan, Ohio and Wisconsin could determine the outcome.

But the uncertainty of this year’s presidential contest could give California a more decisive role when voters head to the polls in June.

When California pushed back its presidential primary to June to save money, the declarations came swiftly: The state’s 5 million GOP voters would be bystanders to a race that was widely expected to be decided long before then.

It was a variation on a complaint made for decades — behemoth California left with no voice while pipsqueak states have all the fun.

But now, as the Republican contest to take on President Obama has slogged on far longer than most expected, there is at least an outside chance that California could have a decisive role when voters head to the polls June 5.

And the presidential field is starting to notice. Though politicians typically flock to California to raise money from the state’s deep-pocketed donors, they are now coming to town for politicking as well, notably at this weekend’s state GOP convention.

But maybe not much longer.

A movement has been launched to wake up Americans and especially lawmakers to the fact people are not going to remain silent any longer. In fact, the “silent majority” soon could become the loud majority.

One religious leader, Damon Davis, says he’s tired of being “reactive” while watching America’s moral values decline, and he is asking millions of America’s faithful to join him in being “proactive” by sending a clear message to the countries leaders – “The once-silent majority of Americans are not happy.”

District Judge Mark Martin brought a Quran to court and told the alleged victim, American Atheists’ Pennsylvania State Director Ernest Perce V, “I think you misinterpreted a couple of things. So before you start mocking somebody else’s religion, you might want to find out a little more about it. It kind of makes you look like a doofus.”

The judge added, “I think our forefathers intended to use the First Amendment so we can speak with our mind, not to p— off other people and cultures – which is what you did.”

Andrew Kaczynski must be Barack Obama’s worst nightmare. While he and Nancy Pelosi try to find scapegoats for rapidly-rising gas prices, the BuzzFeed researcher is making Obama eat his own words … from 2008. When Obama ran for President, he attacked George Bush and John McCain for increased fuel costs and promised an end to reliance on foreign oil in order to bring prices back down.

While Ed has some additional examples of Obama’s 2008 ads that Kaczynski is highlighting, I’ll discuss the two favorites of my own in a moment. But first, with Tim Geithner now suggesting it’s time to tap America’s Strategic Petroleum Reserves, from August of 2008, here’s a round-up of then-Senator Obama’s many “forgainst it” viewpoints on the pros and cons of this decision:

In August 2005, Obama agreed with George Bush’s decision to release oil from the Strategic Petroleum Reserve in order to buffer the economy from the effects of Hurricane Katrina. However, Obama warned that such actions should only take place in times of real emergency (emphases mine):
