Mr. Garcia, candidate for LULAC president has led an active civic, legal and political career. He was born in Midland, Texas and grew up in Dallas, Texas. He received his B.A. in Political Science from the University of North Texas in 1980. In 1983, he obtained his Doctor of Jurisprudence degree from Texas Southern University in Houston, Texas. In 1982 he won a scholarship to study at the El Colegio de Mexico in Mexico City.

He obtained a Masters degree in International Relations.Domingo Garcia is a former Mayor Pro Tem for the city of Dallas and State Representative for Texas. In addition, he has been an editorial columnist and a successful trial lawyer for twenty three years.

Legal Career
After graduating from law school, Mr. Garcia worked as an intern in the District Attorney’s office in Houston, Texas. In 1983 he established his own law firm, The Law Office of Domingo Garcia in Dallas, Texas. He has tried numerous criminal and civil cases. Currently, he primarily focuses his practice on personal injury, wrongful death, employment law and governmental relations cases.

In 1995, Mr. Garcia won a 1.1 million dollar verdict for a man who had been hit by a drunk driver. He has won numerous settlements and verdicts in excess of millions of dollars. In 2004, he obtained a SIX MILLION DOLLARS ($6,000,000.00) settlement, one of the largest of its kind in the country, in the case of Esperanza Alvarado, a 14 year old girl who was electrocuted in an apartment swimming pool. He is a member of the American Association of Justice, State Bar of Texas, and the Northern, Southern and Western Federal Courts of Texas. In addition, ever since Mr. Garcia started practicing law, he has donated his time and talents to a legal clinic in West Dallas to provide legal services to the poor.

Political Career
Mr. Garcia believes that public service is the duty and responsibility of every American. He has served as a precinct chairman, campaign volunteer and voter registrar.

In 1988 Mr. Garcia was elected to the National Democratic Committee where he served for eight years. He was on the executive committee and was chairperson of the Latino caucus. In 1991, he was pro-active in the political fight to create single-member districts in Dallas. He ran for the Dallas City Council, was elected, and served from 1991 to 1995. In 1993, Mr. Garcia became the first Latino ever elected Mayor Pro Tem for the city of Dallas.

He ran for Mayor of Dallas in 1995 and despite a strong effort, lost his bid. In 1996, he ran for the Texas legislature and was elected. He served in the Texas Legislature from 1996 to 2002. As a representative, he served on the criminal jurisprudence and Judicial Affairs Committees. He passed numerous bills to help students go to college, prevent dropouts, as well as bills for law enforcement and civil rights.

On April 9, 2006, Domingo was the key leader and organizer of the largest march in Texas history, when over 500,000 people gathered in downtown Dallas to support comprehensive immigration reform.

Mr. Garcia is currently the General Counsel for LULAC, the nation’s oldest Latino civil rights organization. He is the founder of the Phoenix Project, a drug treatment program for youth. He has established the Domingo Garcia scholarship at the University of North Texas, sponsors the ATLA student law organization at Texas Southern University and created an endowment for law students at TSU's Thurgood Marshall School of Law.

Journalism Career Mr. Garcia served as a weekly editorial writer for the Dallas Times Herald where he wrote on current events and Latino issues. He is currently an editorial writer for Al Dia, Dallas' largest Spanish newspaper. He has been quoted in numerous national papers such as the New York Times, The Washington Post, the San Francisco Examiner, and the Associated Press. He is a regular guest on local, state and national radio and television shows and provides political commentary for WBAP 820 AM in Dallas, Texas.

The Editor: This is the response that LULAC filed with the federal court for this morning's hearing in the LULAC v Linda Chavez, Bea Martinez and Joey Cardenas case. The LULAC response is full of hot air. They blame the voiceofthemainland.com blog for having to be dragged into federal court this morning. They use as an exhibit a story that the Editor wrote about how LULAC would try to bar Linda Chavez, Bea Martinez and Joey Cardenas in future conventions, the Las Vegas convention was just around the corner. The Editor knows the minds of evil people. These same evil minds used the federal judge's ruling to bar Linda Chavez from running for the State Director's position for Texas LULAC in San Antonio. Had the convention continued, they would have used the same trick on Bea Martinez who was to be a candidate for Texas LULAC Deputy Director. The court received more damning information on the Voice of the Mainland, that the Voice of the Mainland had made bad comment about the federal judge himself, making reference to the judge as being a stupid Puerto Rican judge appointed to a federal court with the help of LULAC. The Editor puts two and two together. Of all places to file the lawsuit that LULAC filed against Linda Chavez, Bea Martinez and Joey Cardenas, the El Paso federal court. The judge assigned to hear the case was a Puerto Rican native, educated in universities in island Puerto Rico. Most lawsuits are filed in the residence of the defendants, Luis Texas, Austin, Texas or Dallas, Texas. Why El Paso? The Editor never felt that the federal judge would be a fair judge for Linda Chavez, Bea Martinez and Joey Cardenas. The Editor does not feel that the federal judge rendered proper justice in his ruling today. We almost had a riot in San Antonio because of how his ruling against Linda Chavez, Bea Martinez and Joey Cardenas was used by the LULAC attorneys. the judge should have reprimanded the LULAC attorneys. The LULAC attorneys do their penejadas and then they accuse the Editor of ruining their day.

The judge did not want to pass judgment on what happened in San Antonio, instead concentrated on the future, ruling that his original ruling should not be used to bar Linda Chavez, Bea Martinez and Joey Cardenas from being candidates for National LULAC office.

The LULAC response in preparation for Linda Chavez, et al's was full of hot legal air. LULAC's attorneys were today telling the court that National LULAC never intended to prohibit Linda Chavez, Bea Martinez and Joey Cardenas from being candidates for National LULAC office. If that was the case, why did they, Luis Vera, Manuel Escobar and Ray Velarde, not stop Maunel Ortiz, the other stupid LULAC Legal Advisor, from ruling that Linda Chavez was not qualified to be a candidate for the office of Texas LULAC State Director. If these LULAC attorneys screwed you one time, one would have to be a real pendejo not to believe that they would not screw you again. The Editor has better words to explain this juxtaposition.

The court basically said that going forward was the purpose of today's meeting. He ruled that his earlier ruling cannot be used to create a bar for Linda Chavez, Bea Martinez and Joey Cardenas to run for office for LULAC.

The Editor - Federal Judge in El Paso Overrules LULAC

The Editor: The federal judge in El Paso overruled the Texas LULAC Legal Advisor's interpretation of the court ruling regarding Linda Chavez, Bea Martinez and Joey Cardenas.

The court ruled that the legal interpretation rendered by Manuel Ortiz was wrong, that his original court order never meant to exclude Linda Chavez, Bea Martinez and Joey Cardenas from being officers in LULAC.

Today's El Paso ruling is a rebuke to Manuel Ortiz, Luis Vera, Manuel Escobar and Ray Velarde, who attempted to represent to the court in the Texas LULAC Convention in San Antonio and today, that their interpretation was correct.

Today's ruling effectively means that Linda Chavez, Bea Martinez and Joey Cardenas can be candidates for LULAC office and in that regard, be candidates for those offices whenever they wish to run for office.

It appears that Manuel Ortiz, Luis Vera, Manuel Escobar and Ray Velarde, finally met their match.

Thanks to Robert "Woody" Wilson, the attorney who represented Linda Chavez, Bea Martinez and Joey Cardenas at this morning's hearing.

The tragedy in today's ruling is that it was the wrong interpretation by LULAC's legal counsel and legal advisors that created a response from the delegates to the Texas LULAC Convention that Manuel Ortiz, Luis Vera, Manuel Escobar, Ray Velarde, Roger Rocha and Elia Mendoza used as an excuse to shut down the Texas convention in San Antonio. The stupid Legal Advisor has added insult to injury by declaring as the Texas Legal Advisor that Texas LULAC never convened and that the officers who served in Texas State elected LULAC officer positions will continue to serve in office until the next Texas LULAC convention in 2014.

Texas LULAC'ers should sue Manuel Ortiz, Luis Vera, Manuel Escobar, Ray Velarde, Roger Rocha and Elia Mendoza for the money spent to register, the money to transport oneself to and from San Antonio, meals and lodging. The lawsuit should be based on reckless negligence, asking the court to award the LULAC'ers triple damages, costs of court and attorney fees. If anyone is interested contact the Editor.

LULAC - Arizona LULAC Case

The Editor: The court did not grant the request for a temporary restraining order in the hearing that was held this morning in Maricopa County, Arizona.

The request came from LULAC members in Arizona who were denied the right to vote in the Arizona State LULAC Convention held last week.

A total of 29 LULAC councils were denied the be certified at the Arizona convention. The Convention did not have a place where certification of the delegates was to take place. The councils which were denied the right to vote had been chartered by National LULAC. Once at the Convention, the seating of the delegates was challenged on the grounds that the person registering the councils and its members was not registered by a LULAC person in good standing. It appears that if the person registering the councils for 2013 had not received his own letter certifying his charter, he would be considered by National as lacking good standing and that fact would be used to void the registration. Its the old Legal Advisor trick all over again. The person doing the registration has 13 years in LULAC and has served in different LULAC officer positions in those 13 years in LLAC. This ruling by the Legal Advisor vacated the membership of 290 LULAC members in Arizona and denied over 120 delegates from these councils to be seated as delegate to the Arizona State LULAC Convention.

The court did note that there were voting irregularities in the Arizona LULAC Convention.

LULAC attempted to have the case dismissed. The court denied that request.

The court admonished National LULAC that the Arizona LULAC delegates who were denied their delegate credentials in Arizona be permitted to be certified as delegates at the National LULAC Convention in Las Vegas. Manuel Escobar told the court that not being seated as a delegate in Arizona does not mean not being seated as a delegate at the National LULAC Convention. Escobar told the court that all of the Arizona delegates would be seated at the National LULAC Convention in Las Vegas.

The Editor: Elaine Ayala has one major error in her article regarding the upcoming LULAC Convention in Las Vegas. The article is posted next to this post. Ayala tells the reader that the court handling the case ruled that Domingo Garcia was ineligible to be a candidate. The rule has not made a final ruling on the case. All that the court ruled on was a request by Domingo Garcia to enjoin LULAC from alleging that Domingo Garcia was ineligible to be a candidate. The court said that they did not want to meddle in the business of an organization. As before the court ruling, LULAC can allege that Domingo Garcia is ineligible to be a candidate and Domingo Garcia can challenge the opinion of the LULAC Legal Advisor. It take 2/3's vote to override the opinion of the LULAC Legal Advisor. The docket for the LULAC v Garcia case is appended below so that you can see for yourself that a non-jury trial is scheduled for December 10, 2013. The court has, in the meantime, has ordered mediation in the case. A mediator has been assigned. The LULAC v Domingo Garcia case remains where it was when LULAC filed it's lawsuit. The court has not made any final determination in the Domingo Garcia case. The Editor's opinion is that LULAC filing the lawsuit was premature. The LULAC Constitution requires that the Legal Advisor's opinion be challenged before the General bar Domingo Garcia from being a candidate in the 2013 Las Vegas Convention, the General Assembly had not yet convened. The issue is ripe for the general Assembly to make a decision. If the General Assembly fails to overrule the Legal Advisor, the issue would be moot for further court adjudication. If the General Assembly overrides the Legal Advisor, it would then be likely that Domingo Garcia would also win in the election for National President. If Domingo Garcia wins for National President, he slate will also win. If Domingo Garcia and his slate wins, you know that the Legal Advisor will get fired, as will all legal counsel that LULAC currently has on board, Luis Vera and Ray Velarde. It would not surprise the Editor if a new National Executive Board would not correct the Luis Vera and Manuel Escobar generated transgressions in Texas and in Arizona.

The Editor say, "it's time to clean up National LULAC, once and for all, then we can return to the true LULAC saying, 'all for one, and one for all.'"

The Editor: LULAC has filed a lawsuit against Margaret Moran and Manuel Escobar for the sale of the Hacienda Senior Apartment property located in Corpus Christi, Texas. The case number is 2013CCV-61062-3 in Nueces County Civil Court at Law Number 3. The basis of the lawsuit is the fiduciary duty that officers of the board of a corporation have to the members of the organization. The principle of fiduciary duty is a legal concept in corporations all over the world. Corporations generally serve a larger body. They are normally run by a board of directors. The board of directors is legally acting on the board of directors for the benefit, for the good, of the larger body. In the private sector, they act for the investors who own share in the corporation. In non-profit corporations, like LULAC, they act for the members of the organization, when that organization is composed of members.

When the founding fathers incorporated LULAC, they created an organization which would have members. These members would elect its board of directors. Because the board of directors is acting for the benefit of the greater body, its members, the common law of contracts imposes a duty on the board of directors, that duty is known as fiduciary. Below is just the start of how fiduciary is approached by Wikipedia.

A fiduciary is a legal or ethical relationship of trust between two or more parties. Typically, a fiduciary prudently takes care of money for another person. One party, for example a corporate trust company or the trust department of a bank, acts in a fiduciary capacity to the other one, who for example has funds entrusted to it for investment. In a fiduciary relationship, one person, in a position of vulnerability, justifiably vests confidence, good faith, reliance and trust in another whose aid, advice or protection is sought in some matter. In such a relation good conscience requires the fiduciary to act at all times for the sole benefit and interest of the one who trusts.

A fiduciary is someone who has undertaken to act for and on behalf of another in a particular matter in circumstances which give rise to a relationship of trust and confidence.

A fiduciary duty^[2] is the highest standard of care at either equity or law. A fiduciary (abbreviation fid) is expected to be extremely loyal to the person to whom he owes the duty (the "principal"): he must not put his personal interests before the duty, and must not profit from his position as a fiduciary, unless the principal consents.
In English common law the fiduciary relation is arguably the most important concept within the portion of the legal system known as equity. In the United Kingdom, the Judicature Acts merged the courts of equity (historically based in England's Court of Chancery) with the courts of common law, and as a result the concept of fiduciary duty also became available in common law courts.
When a fiduciary duty is imposed, equity requires a different, arguably stricter, standard of behavior than the comparable tortious duty of care at common law. It is said the fiduciary has a duty not to be in a situation where personal interests and fiduciary duty conflict, a duty not to be in a situation where his fiduciary duty conflicts with another fiduciary duty, and a duty not to profit from his fiduciary position without knowledge and consent. A fiduciary ideally would not have a conflict of interest. It has been said that fiduciaries must conduct themselves "at a level higher than that trodden by the crowd"^[3] and that "[t]he distinguishing or overriding duty of a fiduciary is the obligation of undivided loyalty."^[4]

Fiduciary duty is a duty that the fiduciary owes to the larger body. In the case of Margaret Moran, it is the duty she owes to the members of LULAC and to the organization of LULAC.

The duty of the fiduciary is that of undivided care for the goods and well being of the organization.

There are many corporate heads that are in prison for breaches of this fiduciary duty, which can include, personal gain from their breach, insider trading, unauthorized conveyance of property, theft of the organization's goods, etc.

The lawsuit against Margaret Moran also includes Manuel Escobar as a defendant. Manuel Escobar is accused of a breach of his fiduciary duty to LULAC and to the members of LULAC. He is also accused of a breach of legal ethics, that of having a conflict by serving the interests of the buyer and the seller in a business transaction at the same time. Manuel Escobar is an attorney who represents the interests of the business organization, owned by Walter Martinez, that purchased the Hacienda property. Manuel Escobar is also the Legal Advisor for National LULAC. An attorney cannot serve the buyer and the seller involved in the same business transaction. This breach is actionable by third parties in civil court and by the State Bar of Texas on a complaint to the bar, by an interested or un-interested party. Manuel Escobar was paid $15,000.00 out of the sell of the Hacienda property. Who did he get paid by, the buyer or the seller, Walter Martinez or LULAC? Who did he represent, Walter Martinez or LULAC, or both?

The civil lawsuit seeks to recover from Margaret Moran and Manuel Escobar the value of the market worth of the Hacienda property that was not covered in the purchase price.

The property was sold for just over $1,700,000.00. Ten days after the sale, the Hacienda property was leveraging $10,000,000.00 in the commercial real estate market. Recklessness and gross negligence recovery in damages can triple the amount of exposure facing Margaret Moran and Manuel Escobar in this lawsuit.

This lawsuit is filed on behalf of LULAC, which includes its members, the LULAC members. Margaret Moran's breach of her fiduciary duties are a breach of the duty she owed LULAC and its members, the LULAC members.

The Editor: Right after the Texas LULAC Convention in San Antonio, Linda Chavez, Bea Martinez and Joey Cardenas filed a motion in the federal court in El Paso asking the court to grant them an injunction against National LULAC use of the original settlement agreement issued by the same court earlier this year.

As you remember, Miguel Ortiz, with the backing of the three other LULAC lawyers, Luis Vera, Manuel Escobar and Ray Velarde, disqualified Linda Chavez from being a candidate for State Director for Texas LULAC at the Texas LLA Convention held on June 2, 2013 in San Antonio. He disqualified her on the basis of his interpretation of the settlement agreement rendered by the El Paso court. Miguel Ortiz concluded that the settlement agreement barred Linda Chavez from ever holding an officer's position in LULAC, at whatever level.

In response to the motion, LULAC, through its attorney, Luis Vera, filed a motion with the court requesting an extension of time for the setting of the first hearing, a hearing for the court to consider a request for a preliminary injunction, an injunction that would effective as of the day of the hearing. A permanent injunction would be considered at a later hearing.

This injunction, if granted would permit Linda Chavez, Bea Martinez and Joey Cardenas to be eligible to be officers of LULAC at whatever level at any time, a status that all LULAC'ers enjoy.

The court agreed to an extension of time for LULAC, but then after the response from Linda Chavez' attorney objecting to the request for extension set the hearing for Wednesday, June 19, 2013 at 11:00 AM.

If the judge grants the preliminary injunction, Linda Chavez, Bea Martinez and Joey Cardenas could be candidates for any LULAC office.

The talk on the LULAC street is that Luis Vera has already approached Linda Chavez' attorney, Robert "Woody" Wilson, the same person whom Luis Vera, Manuel Escobar and Ray Velarde had ordered removed from the Convention floor by Constable deputies, that LULAC would be willing to enter into an agreement permitting Linda Chavez, Bea Martinez and Joey Cardenas to run for election in the Las Vegas LULAC Convention. Linda Chavez wants he day in court. It is possible that the judge is going to reprimand Luis Vera, Manuel Escobar and Ray Velarde for permitting the court order, the settlement agreement, to bar Linda Chavez from running for the office of Texas LULAC State Director. A reprimand from a federal court could be used by the Texas State Bar to take disciplinary action against these three attorneys.
