To whom it may concern:

My name is William J Dorsett, I have been an artist in the
harbor for many years. People know me as the San Diego Rose man. I do all kinds
of art work, from pen and pencil drawings, to acrylic paintings, aerosol can
paintings, and palm art. I have had to
jump through many hoops to keep doing the art that I love over the years. I
have had to get permits, suffer police harassment and have had my rights
violated on several occasions. In 2006 I was ran off repeatedly till I acquired
a free entertainers permit which was issued by the port, even though the 1st
amendment protects art, buskers, and performers. Even though I know that the permit is a
violation of my rights I continue to get it so that I can continue to do my
art. Then in 2008 someone at the harbor police tried to change the permit, to
fit their own needs as well as to remove the performers who worked in front of
Anthony’s Fish Grotto. This plan backfired. I got the media involved, and made
a few calls. I was told by Officer Frankie
that nothing like this would happen again.
I was in the process of getting aclu involved when it turned out, that a
lone port worker made this change to the port permits. So I dropped the case. (you can still read the article today on the
union tribune website by searching artist restrictions or by typing in the url
below. (http://www.utsandiego.com/uniontrib/20080124/news_1m24artists.html))

Then later in 2008 Officer Rich, revoked my permit “because
my supplies were on the ground and because I didn’t jump and clean up my mess (
a few scraps of palms) when he said
jump.” Thins angered me, so I contacted
the appropriate authorities and did what I could, which lead me to Officer Joiner.
After showing my research to Officer
Joiner, she agreed with me that officer Rich was violating my first amendment
rights. I was promised yet again, this
would never happen again. The port then,
stopped issuing entertainers permits, and I stropped my case against the port
once again. This makes twice I have backed down from suing the port, and the
Harbor Police.

Since then on several occasions I have been harassed over my
paintings because, “ they were not made in the harbor in front of people” I have at least one video from 2011 were I
actually caught a harbor police officer saying this on video. (Selective
enforcement in the harbor 2011 part 1 and 2 is the title of these videos that
is on youtube.com http://www.youtube.com/watch?v=07P3Btjg-C8&feature=plcp
) Art is 100 percent constitutionally
protected, unless it is deemed offensive.

Over the years I have attempted to get legitimate permits,
business licenses, and tax forms, and things that I could make enough money
that I could get out of street performing and street art. Yet every time I come
up with something new, the port authorities come and shut me down. I have lost
my residence on several occasions because of these forms of harassment.

I have done the research on many occasions and know that my
art is protected, not just my paintings, but my palm leaf art as well. If a balloon artist is protected, then so am
I. A balloon artist makes his art by hand, from balloons. A balloon twists,
folds, weaves and ties to make his art. He makes flowers, hearts, animals, people, and
other keepsakes. I make my palm leaf art by hand with palms. I twist, fold,
weave and tie palms to make my art. I
make flowers, hearts, animals, people, and other keepsakes. The only real
difference between a balloon artist and a palm artist is the material. Yet as
of recently, the port of San Diego has decided that my art is not protected.

The code the port of San Diego has created is illegal and
has many fallacies. It is a direct violation of the first amendment of the U.S.
and the California constitutions. Here
is a short list of fallacies:

1 Usage of the word carving,
in handicrafts, and in sculptures definitions. By doing this the definition of
handicrafts invalidates the definition of sculptures and vice versa.

2 Sculpture and visual arts are
protected according to the port code, but handicrafts are not protected. Visual
arts have been defined as well as handicrafts, but of the things listed in
handicrafts, my art is not mentioned, the closest thing to my art is the word,
weaving, which defined means, ““a : to form (cloth) by interlacing strands
(as of yarn);specifically : to make (cloth) on a loom
by interlacing warp and filling threads

interlace (as threads) into cloth

c : to make (as a basket) by
intertwining””

I can make baskets, but I only
make them by request, and only decorative baskets.”

The ports,

concept to others, are often mass produced

and often have functional

value they might have. Handcrafts

do not include Visual Art.”

Yet my art is purely visual, it expresses many things
from recycling, to San Diego culture to love of nature. My art is not of
limited variation, I make over 100 different things out of palm leaves, and the
variations are limited only by the color combinations and the combinations I
can make with combining any of the 100 designs I can make. Not to mention I am
only limited by my creativity. Of the designs that I make, only 10 of them were
things I learned, the rest I created myself.
The only thing of all my designs that is “ mass produced” is the palm
rose, yet even it has unlimited variation, not only can I make it with 1 up to
8 leaves, but each and every rose turns out different and unique. I have plenty of samples of my art on my
website, www.mindmagickcreations.com
and on my facebook, https://www.facebook.com/pages/MindMagickCreations/141027482623679

3 another definition from the port
code is “13. "Perform,"

generally leave the whole harbor with fans and people smiling. 1 out of 5

that tip me, tip me well and take many things that I make. I often get at least 1 10 dollar tip and one

times by the harbor police, since this ordinance has been amended. I have made
attempts to acquire a permit and have been told, that the permit does not
exist. Then told by an officer, that I went to the wrong place, to only be told
by quality coast, that the permit does not exist, but if you have a car, and 40
dollars a day you can rent and pick up a kiosk… (this applies to the permit
scheme being affordable and easy to acquire, which it is not, making the port
code even more illegal. Which is mentioned in one of the law case files above.)

The first on the 13th of October 2012 can be seen at this link http://www.youtube.com/watch?v=3H3Vnyg5BDs&feature=plcp
the 2nd on the 24th of October 2012 can be seen at this
link http://www.youtube.com/watch?v=yoifZzMX_lY&feature=plcp

first video, he denied anything I said, wouldn’t bother to read the evidence or
learn about the law. He persisted in following the port’s orders even though I
had evidence that the port orders were illegal. With the 2nd
officer, I had altered my art to include my signature on them to add further
protection, due to the code saying that sculptures must have a hand written
signature on them. And even though all my art was hand signed, the officer
still cited me, even though in the port code I am protected.

there as well. The person I spoke with at the port refuses to give proper
information. Has lied about the permit system, has given false statements and
ignores the facts presented to her. I have requested to speak with the ports
attorneys but have been given the run around with them as well. No one of real
authority will speak with me, or take the time to look at the evidence I have
acquired.

robbed, assaulted, and found that the spot I work supports my needs, for food,
water and restroom, as well as I have friends I can trust in the area that can
keep an extra eye on things. Also it is convenient for where I live. It is a
strait shot down the hill from my apartment.

I know that I am well within my rights to work the port,
regardless of the code, which is a direct violation of the 1st amendment,
and the 14th amendment. I have been trying to deal with this in
court, but the Police officers that cited me are not doing their jobs. I have
made several attempts to handle these citations and see a judge on them, but as
of yet neither citation has been turned into the court. The citation from
Officer Rich, I am due in court in a week, and yet it is still not in the court’s
system. This in turn is a violation of the right to a speedy trial. I cannot
even prove my right to be there via a court of law because Officer Rich is not
doing his job and holding up due process of the law.

and citizens review board of police, who in turn has got internal affairs
involved. I have gone through these guys before. They helped me with a case
back in 2009 when Officer Wies tried to run me out of Ocean beach for my 1st
amendment protected art. Which I have video of that incident too. http://www.youtube.com/watch?v=wU8U3hk6Z6g&feature=plcp

The Chief of Ocean Beach SDPD drove all over San Diego to find
me and apologized for his officers violating my 1st amendment
protected rights. I was told by the Chief that Officer Wies also was transferred
to north park and reprimanded.

police department and the city attorney knows all too well that busking is
protected by the first amendment and that violating such rights could hurt the
reputation of the city as well as get the city involved in costly legal
battles. I am trying to resolve this
matter without taking legal action against the city, but Its getting harder and
harder for me to continue in this way when the cost is already so high from
these violations. From losing my places several times over the years from, not
making ends meet due to police harassment and loss of income. To having late
fees and debt build this time around due to police harassment and loss of
income due to police harassment. Not to mention the fact that the port
authority and the SD Harbor Police have offended and slandered me, by saying
that I am not an artist. There are also issues of discrimination, years of harassment,
and blatant rights violations. My
attorney has already stated that I could be awarded in 10’s of 1000’s of dollars in damages should I
take it to the step of suing, and I am acquiring the money to retain him on
this matter right now as we speak. I am writing this in hopes something can be
done to keep me from having to take the next step which is litigation. If the
entities I am writing cannot help me resolve this matter a.s.a.p., then I will
have no other alternative than to retain my attorney and take all those responsible
for the violations of my rights to court. This will include the San Diego
Harbor Police, The Port of San Diego, and could possibly also include The City San
Diego, if the city does not take charge over the Port and SDHPD.

below my statements for review. Please take time to look ever all the evidence,
and the years of harassment. It is important that we squash these first
amendment violations before they get out of hand, and before other artists come
together and create a class action law suit. Thank you very much for your time
and many blessings.

AND OTHER

DEFINITIONS OF ART

The term art has many dimensions that vary according to the
context in which

the word is used. In broad strokes, art is associated with
the human ability

to create things from imagination and skill. Because human
thoughts remain

unlimited, the definition of art expands with technical and
other innovations.

We usually link art with a physical form, such as paintings,
drawings,

architecture, ceramics, sculpture, and photography. The arts
tend to be divided

into two primary forms of visual arts, such as those just
listed, or performing

arts like drama, dance, and music. Yet some art forms, like
film and literature,

comprise both elements. Books can be physically held and
observed, but they

may also be performed in a poetry slam or other dramatic
reading. Some people

even frame the covers of books they find artistically
intriguing. Presently,

people collect movies and play them in DVD or Blu-ray
machines as they

might assemble a group of oil paintings and display them on
their office walls.

This book focuses on the legal protection of the visual
arts. Although there

may be some references to the literary and performing arts
throughout this

text, the primary intent is to teach law students and
lawyers how to protect the

rights of visual artists and collectors.

A. General Definitions of Art

What Is Art? What Is an Artist?

Sweet Briar College Department of History Website*

Art has not always been what we think it is today. An object
regarded as Art

today may not have been perceived as such when it was first
made, nor was the

been omitted.

1person who made it necessarily regarded as an artist. Both
the notion of ‘‘art’’

and the idea of the ‘‘artist’’ are relatively modern terms.
. . .

Art lacks a satisfactory definition. It is easier to
describe it as the way

something is done— ‘‘the use of skill and imagination in the
creation of aesthetic

objects, environments, or experiences that can be shared
with others’’— rather

than what it is. The idea of an object being a ‘‘work of
art’’ emerges, together with

the concept of the Artist, in the 15th and 16th centuries in
Italy.

During the Renaissance, the word Art emerges as a collective
term encompassing Painting, Sculpture, and Architecture, a grouping given
currency by

the Italian artist and biographer Giorgio Vasari in the 16th
century. Subsequently, this grouping was expanded to include Music and Poetry,
which

became known in the 18th century as the ‘Fine Arts.’ These
five Arts have

formed an irreducible nucleus from which have been generally
excluded the

‘decorative arts’ and ‘crafts,’ such as pottery, weaving,
metalworking, and

furniture making, all of which have utility as an end. . . .

During the Renaissance, there also emerged a more exalted
perception of

art, and a concomitant rise in the social status of the
artist. The painter and the

sculptor were now seen to be subject to inspiration and
their activities equated

with those of the poet and the musician.

In the latter half of the 16th century the first academies
of art were founded,

first in Italy, then in France, and later elsewhere. . . .
Out of the academies

emerged the term ‘‘Fine Arts’’ which held to a very narrow
definition of

Supreme Court has interpreted the First Amendment's protection of artistic
expression very broadly. It extends not only to books, theatrical works and
paintings, but also to posters, television, music videos and comic books --
whatever the human creative impulse produces.

Two
fundamental principles come into play whenever a court must decide a case
involving freedom of expression. The first is "content neutrality"--
the government cannot limit expression just because any listener, or even the
majority of a community, is offended by its content. In the context of art and
entertainment, this means tolerating some works that we might find offensive,
insulting, outrageous -- or just plain bad.

The second
principle is that expression may be restricted only if it will clearly cause
direct and imminent harm to an important societal interest. The classic example
is falsely shouting fire in a crowded theater and causing a stampede. Even
then, the speech may be silenced or punished only if there is no other way to
avert the harm.”

see how people define "art", because art is often a subjective thing.
But there is no denying something crafted by hand, and created from a greater
vision of the person "The Encyclopædia Britannica Online defines art as
"the use of skill and imagination in the creation of aesthetic objects,
environments, or experiences that can be shared with others". By this
definition of the word, artistic works have existed for almost as long as
humankind: from early pre-historic art to contemporary art; however, some
theories restrict the concept to modern Western societies.[6] The first and
broadest sense of art is the one that has remained closest to the older Latin
meaning, which roughly translates to "skill" or
"craft."

...The word art can refer to several things: a study of creative skill, a
process of using the creative skill, a product of the creative skill, or the
audience's experience with the creative skill. The creative arts (art as
discipline) are a collection of disciplines that produce artworks (art as
objects) that are compelled by a personal drive (art as activity) and convey a
message, mood, or symbolism for the viewer to interpret (art as experience).
Art is something that stimulates an individual's thoughts, emotions, beliefs,
or ideas through the senses. Artworks can be explicitly made for this purpose
or interpreted on the basis of images or objects. "

It's interesting to see how people define "art", because art is often
a subjective thing. But there is no denying something crafted by hand, and
created from a greater vision of the person creating is in fact art. Mr.
Dorsett is, without a doubt in my mind, and artist.
If Pop art and street art sell for thousands of dollars in galleries, how can
you define what Mr. Dorsett does as not being art? I am an artist based out of
NY, I met Mr. Dorsett during a vacation to San Diego. The artists and
performers of the Bay add so much to the feeling there. Artists and creative
folk are often the vehicle for adding an enhanced experience for tourists and
locals. It takes away the magic of a place when you take away the
unexpectedness of seeing unique creations while strolling along the harbor in
San Diego.

Art adds so much to communities, it attracts people to a community who bring a
broad array of talents and experiences, further enriching it. Mr. Dorsett's
work is especially relevant, because it uses local materials in a different and
interesting way. After learning the basics of his art, he expanded on it,
adding his own visions of nature and religion. His creations are elements of
nature mixed with familiar pieces of peoples memories and life. It adds whimsy
and creates smiles amongst all who visit. But also, reminds us of our
environment, and the ability to transform.
The arts inspire even those who are not of the traditionally creative mindset,
for the person passing on a sunny day, it's a moment to see the world
differently, one small palm sculpture at time... each hand made, but each
unique. Every one an affordable piece of art.

Please don't take this experience from your community.
offering artistic wares at the port. I have been a long standing fan of
"The Rose Man" William Dorsett and his work. I am sitting at my desk
in Chandler Arizona looking at three of his roses as well as a palm heart
sculpture. I have a disabled daughter that lives in a care facility that also
has his work on her wall where she sees it every day. I am aware of some
ongoing controversy regarding him being classified as a "handcrafter"
instead of an artist by Port Personnel. I would have to disagree. If you look
at the scope of his wares, paintings, sculptures, weavings, I am hard pressed
to see a difference between his work and the offerings of folk art and
paintings available elsewhere at the Port. I see Mr. Dorsett and others like
him as an ASSET to the port experience, not something that must be legislated
out of view. Indeed, I make it a point to go down to the Port each February
when we come to celebrate our anniversary, take in the sites, see what new ship
are at the Maritime museum, eat at Anthony's, and SEE WHAT ROSE MAN has for
offer in the way of new art! Other cities promote and brag about their street
artisans and unique vendors. San Diego and the Port seems bent on running them
off, or corralling them into tightly controlled locales. In the long run, I
would see this as a counterproductive plan. Given his longstanding place and
position on the waterfront, I feel that the Port would breed good will and
public perception by Grandfathering Mr. Dorsett and others into the grand
scheme of artists and vendors at the Port. Allow him to get a permit
(REASONABLY PRICED), use him and others even if in passing as one of the
features that make visiting the Port as a fun and diverse experience. Here in
the Phoenix area, the city of Tempe Downtown area used to be a quaint old town
in the shadow of the stadium of of Arizona State University. Many mom and pops,
many street artists, musicians- truly a unique experience. Would take my family
down there to have a snack, buy a piece of art or two, and to be honest, sit
and watch "unique folks." A new mayor came to town, and his vision
was to throw out the old and bring in new. Gone were the mom and pops, HAM
HANDED POLICE ran off the vendors, and corporate America restaurants came in.
And the dollars LEFT. Tempe downtown has been crying because no one comes down
any more, they go to local shopping district now, and wonder why. Reason is
simple, the area was "Cleansed" to fit someone's vision of who should
not be seen, and who should. I do NOT go down there anymore and wont. I feel
that the Port may be using this "too much thinking" approach to
artist at the Port. Seems to me that there is a place for Mr., Dorsett and
others, in highly visible and affordable locations.

Thank you
for coming in to the Port administration building to discuss UPD Code Section
8.05. We have also reviewed and considered
the information you sent by email.
According to the ordinance, your activity constitutes the making of hand
crafts, which is not a protected activity. You have stated that you are a
“Performer”, however, UPD Code Section 8.05(a)13 definition of performing does
not include the creation of handcrafts.
While we are aware that previous UPD ordinances contained a different
definition of “performing” (performers were called “entertainers”), the new ordinance is very specific as to the
types of performances allowed. The new ordinance was also, very well researched
by Port staff and our attorney’s office.

In
reference to your request that the San Diego Harbor Police “ cease and desist “
from enforcing the ordinance until challenged matters are resolved, please be informed that after more than a
month of notice and education and a period of warnings, the San Diego Harbor
Police will continue to enforce the ordinance as applicable.

If you

think you have hit a stone wall. I did as she suggested and read the ordinance.
I agree that the ordinance does allow classifying your work as art, but it
would take a lawyer to get that through. They appear to want to get anyone off
the street and into a permitted spot in the district. Have you ever received
information as to where, when, and how much such a permit would cost? Without
some help, it seems you are going to have to make a major change. Have you ever
heard how to get a permit and what it would cost?

Hi Mr. Richards,

Thank you for taking the time to write to us about the new 8.05 ordinance. The
Port of San Diego does want to provide an active waterfront with attractions
that include performers and persons who create a wide variety of the approved
type items listed in the ordinance. The intent of the ordinance is to provide a
safe and fair environment on the waterfront that supports expressive activity
and regulates commercial activities, including the vending of handcrafts.

As for the grand-fathering of certain individuals to receive a consideration
not granted to others, it would be too difficult to identify who should be
grand-fathered. Any criteria used would be subject to claims of unfairness by
those who are not grand-fathered to receive permission to vend.

If you would like to review the ordinance, it is located at our web page www.portofsandiego.org,
go to Public Documents then to Ordinances and Resolutions. The ordinance is No.
2683 UPD Code section 8.05.

Thank you again for your inquiry.
Sincerely,
Department has had many Officers violate my first amendment rights, on several
occasions in the past 8 years. They have harassed me selectively over the
years, cited me, bullied me, and have made several attempts over the years of to
remove me from the harbor. As well as
the Harbor Police, do not turn in their citations in a timely manner. The lack of timely mailing citations in,
forces the accused to show up in court when it’s convenient for the officers,
not for the citizen. The citations
themselves state you may appear in court on or before the date, yet if the
citations are not in the system due to an officer not turning the citations in,
a citizen may not be able to address the issue set forth in the ticket. This may be legal, but is an abuse of
authority.

for their actions, and the city can become liable if nothing is done to reprimand

done, without need for costly court battles…

I was raised with love. My grandparents raised and taught me the importance of not only loving others, but of a humbled self love. They showed me that true love could exist and flourish just by example as their marriage lasted well beyond 60 years. They took the lines, "till death do us part" very seriously and followed through. Yet I have seen other examples of love, and how it can go south. I watched various family members, and friends through out my life go through divorce and breakups, all my life.. Most of these relationships that where ending, seamed to end very messily. Rarely does one hear tales of a relationship ending and the couple maintaining a friendship afterwords, especially when children are involved. What is it that defeats love the strongest force on earth, what is it that has gone so wrong that people in love cannot work it out? Somewhere along the lines, maybe it was just building up over time but love has died, maybe it wasn't meant to be in the first place, people together just to save face, to hide who they truly are. Sometimes relationships are built out of desperation and we really don't love the people we are with, we just go for them because of the fact that they want us, they show us attention, the crave us.
In my life time I have had many loves. some puppy love, some mild love, some hard core love, and some love, that was more like infatuation, or a strong like. I have thought many times I had found the one, only to be left alone with a broken heart knowing that what I thought was right, was oh so wrong. I have been with the girl everyone warns you about, and the one ya take home to mom, if only I had a mom to take her home to... I was born just like anyone else, with a mother, but was never able to develop that bond, due to her death of leukemia when I was 7 months old. This is probably why I get mixed up with the wrong types of women. This is why i find the ones who sets off my triggers and makes them worse... We all have our traumas making love that much harder to find as we must find those who compliment our own faults....

Nationally lampooned Vacation

So as the story goes, this palm weaving rose man needed a break, a vacation. Life was a hustle and a bustle, the rat race was strong even in a small city like San Diego. Several years in this lifestyle can wear a person down, and in the years I have been living as an artist I rarely allotted myself any sort of break. Now one might say, "you're a full time artist, and work your own hours, isn't your whole life a break.?".... The truth of the matter, is that it doesn't matter your profession, there are stresses that come with anything you do. Work is work, doing something you like doesn't change that fact it only makes the day go by quicker.. As a street artist, I have many stresses, "can I meet my own quota for the day in the time I have, or will I have to work longer? will the people walking by today notice my work and want some of it?. will they pay fairly?, as well as the anxiety and stresses to working in public with people all day.... Its no different from any other job. I live day to day....

So it just so happens that a friend of mine Dwayne was moving back to Texas and needed help with gas and driving the 1400 miles to Texas... So we plan and save, and prepare for the trip as best as we can, while dealing with the every day responsibilities life has dealt us and the days ran by to the day we where to leave. A couple of weeks before the planned date a mutual friend of ours, Summer, came into San Diego to help with the move as well. The night before we are to leave Dwayne And Summer pick me up in the Nation Lampoon Vacation car.... I post pics on facebook.... The lampoon begins.

The day we are to leave, we get up at 6 am and head to Dwayne storage. While there, Summers loyal dog that never wanders off, disappeared. So for three hours we look around the area, along with basically terrorizing the storage worker to see the video footage, because we where all convinced someone had stolen the dog. After 3 or so hours of being there, we decide that we are going to give up looking for the dog... And the journey begins.. We make it an hour from storage in Palm desert Ca, when the car overheats. We pull over and let it sit an hour to cool, then drive to a gas station where we patch the water pump after it sits an hour or so. Then we drive to Pep Boys and buy ourselves a new water pump, then start the long job of removing parts.... Luckily I had a digital camera with me to take pics after every two or three steps... Later while Dwayne was trying to just get the water pump out I walked around gathering desert palms. By the time it was midnight we had the new pump in but everyone was exhausted so we crashed out in the car the best we could for the night, but none one got any real sleep. The next day we finally get it all back together by noon. We stop at a medical club get enough meds for our trip and drive on our way.

We make it an half hour into Arizona when the car overheats again.. (we forgot to change the thermostat) So will sit an wait in the brush to get shade till the car cools down... This time we didn't have any drinking water. while we waited we stacked rocks and medicated to keep ourselves entertained.... An hour or so later we were on our way again... We made our way to Phoenix to a friend's house, and we stayed the night, caught up, and rested. the next day we spend a few hours in the pool before starting our journey again.

On our way out Dwayne wants to stop and see an old friend of his in Phoenix, and when we arrive at her house not 30 minutes away from where we stayed the night, the car overheats again. We sit an hour or so in the heat waiting for the car to cool down, then we start our journey up the 17 towards Sedona, and Flagstaff. About 2 hours into the trip and we overheat again and sit at a gas station till the car cools, for about an hour. Then we start up the hill, another hour into it and the car overheats again... We finally make our way into Sedona Just as it is getting dark. so we get dinner and sit and chill at the bell rock vortex for about 3 hours. The we start our journey again through Sedona up the mountain to Flagstaff.

Sedona was a beautiful town Full of creativity and spiritual energy, but the ascent up the mountain filled me with ecstasy. The air was filled with a pine smell and was cool and crisp, I had to put on my jacket. A couple of miles near the top a car was blinding me so I decided to pull off one of the turn off's, it had a hump I did not see and the car was low to the ground loaded with Dwayne's gear.. Turns out Somehow I had rapped the tail pipe around the rear axle, luckily Dwayne had a power saw, and was able to remove it an hour later. We make it to flagstaff stop and get gas, and continue our journey. By about 6 we make it to Gallup ,NM. The rest of the journey was less exciting. It was hot, dry, and tiring. Though we did stop and see the grave of Billy the kid in Ft Sumner, NM. We also stopped at the big Texan steak house and enjoyed a very tasty steak... We finally made it to our destination in ft worth Texas at 6 am on Friday... Our Trip took many hours longer than we had planned and it was a relief to arrive at our destination, which had seamed like an impossible task with all of the hell we faced on our journey. All in all though it was an experience and an adventure....

Weaving in and out of enjoyment

Work should be enjoyable, as a wise man once said, "do what you love and you'll never work a day in your life." If you are working in a field that you enjoy the time you spend at work passes more quickly and your job brings less stress and more quality to life... I have worked many jobs in my life, many job types, and of those types there have been but a few I really enjoyed. I stuck with the ones I liked much longer than the ones I did not like. I have been a cook at many fast food places, a cook at a dinner, and even a cook at a strip club. I have worked on a factory line, and worked at a machine shop, worked on car detail, and car auctions, been security and a pizza delivery driver. I gave away free vacations to a time share, canvassed for the clean air act, sold magazines, done various forms of telesales from pens, to insurance policies..

Yet with working all these things, the ones I loved the most where the ones that I had more freedom and less boss over my shoulder... I loved delivering pizza, the majority of my time at work was spent in my car, and I made decent money doing it. Working as a cook at a strip club was fun. I made lots of friends there from staff to patrons, but I found they made half of their money back on what I spent on beer after work every night... Yet at this job, good music all day, I met interesting people, and I was left alone by the boss usually...

I found I didn't much like sales, and I was not for mundane warehouse work. At most every job, there was but one problem, I found that I felt cheated out of life.. That each venture was a waste of my mind, a waste of my time. I felt I was meant for more than what I was doing. This feeling was overwhelming at times, and down right maddening at other times... It caused arguments with friends, family and various acquaintances. No one understood, what I felt, or what was going on... I am not one to be controlled. Working for others in the mundane, is not my calling... If I can't do something creative with my time i don't want to do it I kept saying to my friends and family... I lost jobs countless times because on my break i would do something create, and instead of clocking back in early I would take my full break to Finnish the creativity I was doing... I even remember as I was learning how to make roses out of palms leaves, the owner of my last real job would make fun of me for it... He stopped laughing when one weekend I brought in cash on a Monday, and it was triple what I was making a whole week at work, and I said to him, "yes this is all from palm roses." Then I told him I quit, and never looked back...

Since then i have been living as an artist full time for 6 years... I have been doing the roses total for 8 years now.... Since starting with the rose I have learned how to make over 100 things out of the palms, some from books, some from random people I have met working the harbor over the years, some from the internet, and some just from my own creativity. All along the way I learned various new art techniques with painting as well, including learning how to use spray paints...
The whole way seeing a trail of improvement, and a since of accomplishment.

The road has not always been an easy one, I have had to live day to day as an artist, and some days have been much better than others. Yet at work, I am generally happy. I find that there are few times I am bored and that is when there is not much of a crowd. Usually though I am entertained enough by the fact I am making things with my own hands. I meet lots of interesting people, on a daily basis, one out of 100 I have a decent conversation with, 1 out of 1000 I have a great conversation with, and 1 out of 10,000 I bond with and make a connection... Maybe one out of ten of those do I have a deep connection with.... With the combination of meeting interesting people on a daily basis, making a living off my own creativity, and having the freedom to do things the way I feel they should be done, I don't have much stress when it comes to work... Money on the other hand can sometimes still be a stressful thing.. Over all I make more than I have at any other job I have ever had... Yet I also live in an expensive city, I have never been good at holding onto money, and I live day to day... This sometimes can be a curse...

Yet through all the hardships I face, I truly feel that my work has meaning, my life has purpose.. Each day I brighten someones life. I do something that changes the way they where thinking a little bit. Often, I change someone from being into a bad mood and send them into a good mood, all with the simple task of giving them a hand made rose... I help to create a better over all experience for the people who are touring the harbor... All while doing something that I love, being creative, spreading art and love to random people... I am not rich, and I am pseudo famous, I don't have a nice house, nor am I driving a fancy car. I don't get to party at playboy mansion. But I have had some great adventures, met many awesome people, experienced and learned more things than I ever thought I could learn, and for the most part I can say I enjoy most of my life..

This is weaving in and out of enjoyment, you find what you love and do it, regardless of the hurdles or the speed bumps in your way. It wont always go the way you want, but if you keep with it, it will always bring you back to enjoyment. You may have some bad time and stress come from doing what you love, but you will find that the more you do what you love, the more you will enjoy your life.. Because a good portion of your life is what you do for a living why would you spend that time doing anything else than something you enjoy? I tossed out roses and no one was tipping. Needless to say I wasn't in the best of moods by the time the first hour had rolled around. at this point some people walk up and this one girl in the group asked, "do you have fun doing this." and I said, "fuck no this shit sucks", lO she comes back at me in 3 point 5 seonds and ays "way to sell yourself man" and I said ya I know sorry, its just been a rought day, I hve lots of fun when I am doing this and peope tip me for my roses, but alas no one has tipped me yet today. they just take and walk away." She gave back the rose I gave her and said, oh i am sorry w dont have any money, and I said look no I gave you the rose keep it, ten the guy with her and this other girl, says hey I have some herbs do you smoke, and i said hell yeah. so we go off and smoke a doobie, then they roll me another one that I can keep for later. total head change... So we walk back to the boardwalk, and she asked if I knew where she could fill up her water bottle. I showed her and when she came back from filling her water bottle she says, "you gave me my first orgasm of the day, by showing me the cold water. So afte they left I started making money. I was in a good money,m feeling light and fluffy. I raised the prices of my paintings to 20 each, or two for 30 and people actually bought my paintingts... its really strange how random strangers can walk into your ife whn you are feeling down, and without many words, or without much time spend they can come and lift up your spirits to help you make it through the day...

later on durring the day some people from austrailia came through and there was this guy he looked kinda like the guy from lost/ lord of the rings.... but he was just a head and a torso. yet this guy had the biggest smile I have ever seen. he was riding around on this wierd BMW box thing with wheels, and it seamed to move on hios thoughts.. very wierd machine, but it was cool... the coolest thing about this guy is that really all he has is his mind, yet he was this smoking hot girl riding on the bc of his machine, cuddling him like they where soul mates. she didn't care that he was just a torso, this girl loved this man with all her heart and you could plainly see it... Talk about a mind bender, here I am sometimes I am almost petrafied when I try talking to a woman, because of my own insecurities, thinking that my living situation would detour them, and some it would, but not all. and that's what I forget from time to time, but after seeing this, and seeing how this guy could have suck a beautiful woman... I have to say to myself, there is nothing to be insecure about.. nothing at all... anyways, they tipped me and we all chatte for a bit, then they went on their way. I was curious on if the guy was born that way or if maybe something happend to him, but I could not ask. all i could do was enjoy the fact that I saw probabbly one of the most positive people i have ever seen,. yet most people in his situation would be beggibng for a gun or some way to end, not thi guy he's smiling, rolling down the way on his b,mw box with a super hot asian/austrailian girl...

coincidentally I was telling my friend dash about this, and he said that sounds like this motivational speaker I have watched on you tube. so I look it up just now and what do I find, this is the same guy.... Hly shit man.... you gotta watch this guy.... he's famous. :) http://www.youtube.com/watch?v=v4uG2kSdd-4

the process of art

<img style="float:left; margin:0 10px 10px 0;cursor:pointer; cursor:hand;width: 256px; height: 320px;" src="https://blogger.googleusercontent.com/img/b/R29vZ2xl/AVvXsEhGg8qTnugj4zX_6yLcAVcwuFWWf9nc59qnNQ73K8xZnxA5c5TMhsyNym_Wu-T9erIKBKmXHKeT0pZd187lGKH2fnJL3VPfL7rsY4JqPfUXiwdDtEY1QMoPK4u6ocREy_9Z_nMEY-4yaw-N/s320/morphtron+back+1.jpg" border="0" alt=""id="BLOGGER_PHOTO_ID_5610425295975568962" />
<img style="float:left; margin:0 10px 10px 0;cursor:pointer; cursor:hand;width: 256px; height: 320px;" src="https://blogger.googleusercontent.com/img/b/R29vZ2xl/AVvXsEiJl8d9aUFSq8ijz6MsiMcQdOahgvZ0aaQOqYT7obHyzQmJ5NtrP8GGoxY3AZ8Kwy7N-y-Hwtdnru3LIeWDfYMIrB5HL1GM987gJ9Ehk28r-jCChTdV0RzXoTeuEwR-yOM2Gv_pFeJCC-e8/s320/morphtron4.jpg" border="0" alt=""id="BLOGGER_PHOTO_ID_5610425173841483650" />
Often I find that when I am creating something I just flash right through it, no real thought involved, I just go with the flow and it becomes something. Yet art has a process that most are unaware of, and I have become all too familiar with. There are times that art seems to take forever. You start with a blank canvas or page, and nothing ever comes out of it. You stare at it for hours adding one line after another, one color then the next, wondering why you ever started the project in the first place.
Sometimes you have to research, you have to find the best materials for the project at hand, and you have to go through many trials and errors before you find the best way to complete your project. Sometimes you get frustrated, put the project aside and just sit and wait till the right moment hits you. Other times you start a project but it was not within your budget, so you have to bid you time cursing the whole thing while you save every extra penny you can to get the remaining materials. When I wrote www.morphsuits.com, I offered to paint some suits, to get some free suits and to build a portfolio and a business base I thought I was just going to be flashing through some projects, with my usual style of strange but trip art. Which of course I did do a couple of designs like that, but I was challenged with a remake of a movie prop. A Morph"TRON: suit!!! At first I wanted it to be just like the tron suits in the movie, that light up. I Ordered a test piece of EL Tape, just one little piece that would maybe have done one side of one of the arms cost 35 dollars, and that's without the power up link, which for some reason I thought I could find a mod or something at Frys Electronics...Guess not... Oh well...
So that Idea was a bust, for a small sheet that I could cut into desings, I could pay 20 dollars, but I would have to order about 400 to 800 dollars worth to make the proper cuttings for the design. So I had to skip that option, So I tried testing El Wire. It broke when I tried to bend it how I wanted it, then on top of that it is not thick enough. So I thought I would try glow paint. That didn't work out too well at all. As I thought I have never been very symmetrical with painting. So I had one more option to try, glow tape. I ordered it with the remaining money I had left and ordered the wide kind, and ordered enough to make sure I had extra in case I made a mistake... When it arrived it appeared perfect, I cut off a test piece and attached it to the fouled up morph suit from painting, the adhesive wont stick to the suit...
So I went to Micheals and founds some fabric glue brought it home and tested it on the tape and the suit. The solution was found. So Then I began to mark the tape where it needed cutting and shaping, I cut it, then peeled off the backing applied the glue, and attached one piece at a time and let each piece dry before I added another. The process was tedious and long and often annoying, but I kept at it, and completed my task. Its not 100 percent perfect, but for my first time ever doing something like this I am ecstatic about how it turned out.

2nd chance

I met a man in the harbor on ash Wednesday just the other day who in 1971 was shot in the head with a double barrel shot gun at point blank. he said for a long time he couldn't walk and he couldn't talk, but then he got better and now he is a motivational speaker.
he had the scares but very well reconstructive surgery to prove it. I was mainly there to make extra money so I could buy lunch at work the next day and also to meet people and flirt with cute girls.
Is the real reason I learned how to make roses in the first place.
I can;t begin to tell you how many women over the years I have met face to face because of the rose. While working there one day a man walked up and said hey I can do that, you are doing it wrong. His name is Pablo.
He showed me how to make a different rose, and also how to make a cross and a heart, and from time to time we would work together.
After learning these things along with a couple of other little tricks I went to the harbor one day to see if I could find Cris the man who taught me.
he wasn't there, as a matter of fact there wast anyone there, that performed or signed for money either. So I decided why not and I weaved that day. I made 100 dollars, so I came back the next day and made almost 200 and then I came back again and made another 50 or so. I was stoked, as on the weekend I made more then I had working all week at my normal job.. Not long after this, I was given an ultimatum at my job, I told my boss he could shove it because I could make it on my own. I started working the palms full time.
I had many things to learn still, but due to a family member passing away I had to leave California for a little while and return home to Texas.
When I made it back to San Diego, I decided to try again, and have been living off making roses and other items out of palms for a long time. I also started displaying my art as I make it, paintings and such and selling art work as well.
Over the years I have met people from different parts of the world, and they showed me tricks of trade. I bought books and learned secrets from them, and I have seen pictures of things other people make online and some of those things I figure out just by looking at. I have even created a variety of my own things along the way.
I have also taught myself how to play guitar, and I have taught myself how to do the spray paint space painting art. All becasue I had a passion to move this way.
so let not you dreams be stopped by anything because if you believe in yourself you can make it through life. and if you let you faith in what ever you believe take you through life, nothing ca stop you. you may find times when things may slow you down, but there is nothing that is impossible if you believe and you try to find a way as there is always a way.

resolution revolution

my new years resolution for 2011. first a welcomed goodbye to 2010 (good bye!!good riddance 2010!) Hello and good morning 2011 and all that it brings, the good and the bad, the fun and the sad, may 2011 be the best year we can make it.

This year as a resolution, I have many plans and ideas that I want to make happen. Making dreams realities is my main resolution this year. The next i to try and take positive steps, for this years resolution I am not quitting anything or giving anything up. I am not doing anything of the sort. Those are pointless resolutions to make, we never stick with them when we make them.

Instead of saying I am quitting smoking or anything like that this years other resolutions are as follows.

To promote love, and kindness. I already do this, but last year I have been a little less myself in that aspect...So I plan to do this more. not because Christ told me to, or because some strange god in the night told me its a good idea, not because I read it in a book somewhere, and not because its the right thing to do, but I like it when people show me love and kindness, and there's a saying that if you give out you get back. and you can never get enough of either love and kindness so why not.

2011 new year of free love everyone, yay...

(hey get your minds out of the gutter that's not free, I have to at least get a cookie.) :)=)

I am going to try and be more active and proactive this year, get out and do things, go for hikes and do some sort of exorcising, why because I wanna be able to walk long distances if I have to, and it would be a lot easier if i was in shape LOL... and I just might want to climb a mountain sometime this year and in my current state of energy I don't think I could do it. then again I am a little hung over and its 10 am lol. I am going to do more things with my friends, travel more, and get out of San Deigo quite a bit this year even if i have to hitchhike to do it.

I am going to use my creativity to do more than just entertain people this year. I am going to use it to manifest my destiny. :)

and on the note of resolution revolution I leave you all with a story I am fond of a fried told me.

A monk was sitting with his pupil and his pupil asked if there was a hell waiting for evil people in the after life. and a heaven awaiting to good.

The monk replied. " heaven and hell are here and now. think of them as two rooms. the first room has a pot sitting in the center of the room, it is filled with life giving soup. there are people all around the pot, and there is one spoon that is long enough each of the people can reach the pot with the spoon. yet the people in this room are starving because the spoon is too long for them to spoon soup into their mouths and every time they try they spill the soup that is in the spoon.

the next room is exactly the same there is a pot sitting in the center of the room, it is filled with life giving soup. there are people all around the pot, and there is one spoon that is long enough each of the people can reach the pot with the spoon. Yet these people are full and happy. The reason is because these people learned that if they used the spoon to feed their neighbors instead of selfishly trying to feed themselves, and in this they learned by feeding their neighbors they where also feeding themselves because in order to keep alive you have to keep your neighbor alive in order for your neighbor to keep you alive.

This is the difference of heaven and hell

both can be achieved on this earth here and now.

The begining

I had moved to San Diego, Ca to start a new life, I was at my friend's house for 3 weeks in Alpine before he suggested that I stay with a friend of his in San Diego.
I had moved from Texas to look for work and to try and get my life on track.
I had been in San Diego, for about a month and had been working a telemarketing job, when I learned my calling. It was a cold October Sunday and there was a military ship viewing in the harbor that day. I decided I was going to buy some beer and walk around and look at the ships. So I headed to the harbor on the dreaded 2 bus, and stopped and bought some beer along the way.

I was walking around for almost and hour when I saw a man making flowers out of some sort of leaves. I stopped and watched for a bit then offered the man a beer. I sat and talked with him for an hour or so, then asked if he would teach me. He said he couldn't, I gave him another beer talked with him for a while longer and asked again. he said, " look this is my job and I can't teach you." I said, " look I don't need it for money I have a job, it would just be a great way to meet girls." He said, "ok buy me a case of beer and go to the beach with me and I will teach you."
So we walked to the trolley bought a case of beer along the walk, and on the way we came to a palm tree. He stopped and showed me what to cut from the tree and told me not to talk more than two fronds from each tree every 6 months.
We cut a couple of palms then made out way to the trolley.
on the trolley he showed me how to make the rose, but I just wasn't getting it, so I asked him to tell me the story he told a woman in the harbor, I had him repeat the story several times. The story is what made learning the rose easy for me.
By the time we got to the trolley stop I was already making roses myself without instruction. He told me to give one to a girl that was sitting a couple of seats in front of us the rose, he said that if she smiled then I passed the class.
She smiled and said thank you.

We then got off the trolley and got on a bus that took us to Ocean Beach.
It dropped us off near a taco stand, and he made a couple of crosses walked over to the taco stand and was able to get us both free carne asada burritos. We then walked to the beach and found a fire pit and opened the case of beers and started drinking. The whole time I was practicing how to make the rose, and every time a girl would walk by I would give one away.
By the time the case was empty Cris decided he was going to find somewhere to pass out and I was talking with a girl I had met on the beach. It was 2 am and all the buses stopped running, and coincidentally the girl I was talking to lived near me, so I caught a ride home.

The next day I went to work hung over, and after work was done I went to the gas-lamp area to practice folding roses. I ended up sitting in front of the downtown mall in the garden area. I met a few cool people while making roses, and somehow I made a few bucks. So I continued to do this every night after work which lead me to random adventures and meeting interesting people. Over the years I have learned a great deal of things and have met many interesting characters, and have some strange stories from all the things I have seen while being a weaver.
This is just the beginning....
