Hello my fellow group members,

My name is Robert Paisola and I created the group Sky Las Vegas and Taking back America. Our group has swelled to over 130,000 members. Thank you all for sending out invitations and being members of this group. I know that I always say this, but you stand as a voice for the unspoken majority in this country that believes in our traditional Christian values that built this country. With that in mind I wanted to share some thoughts on the meaning of the holiday we will be celebrating this weekend.

On July 4th, America's independence will be celebrated in grand fashion with parades, fireworks and backyard BBQs. Did you know that this year (2010), Americans will commemorate the 234th anniversary of the approval of the Declaration of Independence by the Continental Congress, the act that set the 13 American colonies on their road to national sovereignty?

Take a moment to watch this video that we have produced in association with our friends at The Free Capitalist Project and Founders University. This is an amazing historical image of what it takes to truly be free as Americans.

When enjoying this weekend’s festivities, have fun and be safe, but take a moment to remind yourself and your family what this day represents. This day stands in history as the day a group of our countries forefathers declared their freedom; freedom from tyranny, religious persecution and taxation without representation. That freedom has reigned on and continues to thrive after 234 years. Remember to think of all the blood, sweat and toil that has been sacrificed for us to be able to enjoy this weekend and when you can, say a prayer for our troops still in harm’s way that are still protecting our freedom to this day.

17 News discovered a youtube video of Kern County Sheriff's Deputies and a bail bonds enforcement officer entering a local woman's home after she told them they couldn't come in without a warrant and her consent. With the evidence she caught on tape, the law seems to be on her side.

"I don't need a warrant," the bondsman said as he appeared to enter on his own into the home from a back door on the youtube video.

There were also sheriff's deputies at the front door. Deputies and bail bond enforcement officials have different laws but a local bail bondsman not affiliate with this case said what happened in this case was against the law.... See More

"If you see the person go in, you can go in," Glenn Pierce, the owner of Gotta Go Bail Bonds said. "But you just can't go in randomly."

The woman who lived at the home told 17 News her name is Star. She said she is in hiding because threats were made against her. She also said deputies and the bail bondsman violated her rights by forcing entry into her home after she stated she was the only one there.

Attorney H.A. Sala says based on the video evidence, the Sheriff's Department could have a lawsuit on its hands because of the way they forced into the home without any knowledge of the wanted person being in the home. "They have to knock, state a purpose, say they have a warrant and give time for the person to surrender," Sala said.

Authorities were looking for Joseph Baker who was arrested for battery on a peace officer in September. They were also looking for a man named Alan Gjurovich because he co-signed on Baker's bail bond which Baker forfeited by not showing up in court. Gjurovich is in hiding but spoke to 17 News by phone. He said the sheriff's department is trying to stop him from filing a lawsuit against the county that could damage county judge and clerks' credibility.

"They're trying to scare us out of town and out of the county," Gjurovich said. "The message I was getting, they were giving us a 48 hour ultimatum--give them what they want on Joe Baker or they will personally come down and arrest me."

Sheriff Donny Youngblood confirmed the deputies in the video are from the Kern County Sheriff's Department, but he said he can't comment because an internal affairs investigation is being launched.

TruTV has recently aired a new show entitled Operation: Repo where moody redneck misfits get into a continuous series of fights with the people they try to repossess vehicles from. If you are fan of trashy television, it's fantastic, since it makes it look more like the video game Grand Theft Auto than a legitimate industry. In the one--alright, it was two--episodes I watched, I saw them mace teenage girls, flip cars over, reduce businessmen to tears, and get chased around by a rake-wielding farmer. It's all fake, but Jerry Springer would be proud. I wondered, was it really this exciting? Is this really what the repossession industry is like? I set out to find out.

It is dark, and I pull up next to a jet black Dodge pickup in an otherwise deserted mall parking lot. Inside the truck's cabin is a mounted laptop indicating a contract to pick up a car. There is a bounty on the vehicle, and I count three separate GPS systems now tracking a Spanish Fork address. Though it does not look like a tow truck from the outside, this souped-up one ton has a retractable "sneaker hitch" hidden in the undercarriage.
I will be riding along with one of the few local business that is thriving during the current financial crisis. I jump in with Tom and Rich Russon from the Lehi-based Quality Towing company, and tonight we are going to repossess cars.

While the rest of the country struggles financially to keep its head above water, Quality Towing is overwhelmed with work. Tom Russon is the owner, and he says he frequently has to work 16 hours days to the meet the ever increasing the demand for repossessions. His wife, Vaniece, also provides countless hours in the office and in the field. Their company accepts contracts from banks and car dealerships to bring back cars, trucks, boats, motorcycles, snowmobiles, and tractors from all over the state. It's a tough job, but someone has to do it.

Because repossession is costly and time-consuming, banks almost never want to repossess vehicles, and will only ever initiate it as an absolute last resort. Rich tells me that, "If you've lost your job or something, the banks just want to know. Most of the ones we end up with are because the banks can't reach the customers." However, most people don't realize this and all too often will fail to communicate with their lending institution who then has little choice but to try and repossess the vehicle.

Our first "repo" leads us to a flashy new suburb in Spanish Fork. We are looking a for car with six months of delinquent payments. No luck. We then head to West Jordan to an apartment complex. There is no car there, either. We then drive down to Salt Lake to another apartment complex--strike three. I begin to wonder how Quality Towing stays in business. We now drive back up to Lehi to a duplex in search of a white sedan.
This time we find it, but there's a problem: apparently the people knew we were coming, and they have barricaded the vehicle in with another truck. Since repo crews are not allowed to touch vehicles other than the one they have a contract for, they will not be able to take this one tonight. However, Tom points out that even though the owners think they're smart and may have won this battle, now that he has found the vehicle, a giant steel boot will ensure that he gets the car when they try to go to work tomorrow.

Our last contract for the night is back in Provo. We roll up to a tiny rambler, and sitting outside is our prize: a shiny 2007 Dodge Durango. Tom knocks on the door and a man answers. He looks relieved and hands Tom the keys. Rich says he wishes that they were all this easy and philosophizes over the nature of man and money: "What makes one person hide it and another give it up voluntarily?" Tom replies quickly, "Character."
The very nature of the repossession industry provides a peculiar ethical dilemma--one that Tom and Rich are quick to acknowledge. On the one hand, their job requires them to inflict a great deal of pain on a large number of people. However, without the option to repossess, lenders would suffer continuous, catastrophic losses and would inevitably go out of business. They remind me that keeping a vehicle that you don't pay for is a form of theft; as long as people refuse to pay for the things they buy on credit, the repossession industry must exist.

But this doesn't mean they are heartless thugs feasting on the misery of their labors. Tom tells me that he had a truck repossessed from him once when he was younger, and the experience was horrible. "The guy showed up on my doorstep carrying a baseball bat. I don't want to be like him. We actually care about the people. We're not trying to be vindictive." Rich agrees with brother, "It is much easier to deal with people on a professional level."

As we drive, they talk about the heavy emotional toll their work often takes on them. Though Tom is a veteran of Desert Storm, and looks tough enough to deter all but the most desperate clients, his exterior belies the heart of someone who feels deeply for the people he encounters. "We're sensitive guys," he says.
He tells me the story of one particularly heart-wrenching contract they had during the holiday season. The job was to repo a van from a family in Provo. As he pulls up to the house, he finds the vehicle is in the driveway; it is unlocked and the keys are still in the ignition. As he approaches, the startled owner walks out and confronts him. Tom quickly grabs the keys and prepares to drive off, but the confused owner just asks what he is doing. "I explained to her why I was there, and she started balling: all their Christmas presents were in the back of the car. The husband had gotten laid off two days before, and they were in really bad shape." Though it would have been well within his rights to just drive away, Tom decides to stay and help the family gather their possessions. "I remember standing there watching her and her kids unloading the Christmas presents. There were tears streaming down my face. I was the one taking their van away from them. I amost quit after that."

The catch of the day: a 4,932 lb Durango

Rich tells me that they have taken hundreds of vehicles with car seats, and they always go back to drop them off, once the vehicle is safely in their possession. Though their lives are thankfully not as exciting as Operation: Repo, they say that there have been times when they were punched, kicked, slapped, and had guns drawn on them, but they take it all in stride. "Nine times out of ten it will be a swing and miss," and they pass it off as just part of the job. Though they both have concealed weapon permits, they tell me that getting into fights or standoffs is that last thing that they ever want. "If the police come out, sometimes they don't know who called them, and we can end up in handcuffs."

As they head back to drop me off after a long night's work, I finally pose the question I have been gearing up all night to ask: "So, do you let your kids play Grand Theft Auto?" They both laugh and Rich tells me, "It's their favorite game."

Grand theft auto indeed.

The moral of this story is clear: if you decide to skip the next six or so months of your car payment without contacting your lender, consider yourself yourself lucky if these guys show up. Your ride is about to get jacked by the two nicest car thieves in the state.

When does a debt collector create an "initial communication" about a delinquent debt, triggering the Fair Debt Collection Practices Act ("FDCPA"), 15 U.S.C. §§ 1692-1692o? Is an actual letter or formal notice required? Does the filing of a summons in a debt collection case create such a communication?

In Frank Thomas v. Law Firm of Simpson & Cybak, et al. the Seventh Circuit Court of Appeals reversed a decision of the lower court dismissing Thomas's suit, which alleged that GMAC, its law firm (Simpson & Cyback) and their employees failed to send him a debt validation notice advising him of his rights as a debtor within five days of their initial communication with him, as is required by the FDCPA.

The Facts
Thomas was employed by GMAC. Thomas bought an SUV from a Chevrolet dealership, and the installment contract was immediately assigned to GMAC. When Thomas lost his job with GMAC about two years later, he went into default on the loan. GMAC sent Thomas a default letter. Simpson & Cybak brought suit on behalf of GMAC in Illinois state court to recover the vehicle. A court summons was issued to Thomas informing him that the law firm was a debt collector.

Thomas sued GMAC and its attorneys in federal district court under FDCPA, claiming neither defendant had sent him a debt validation notice advising him of his rights as debtor (under 15 U.S.C. 1692g(a)). The district court found that neither GMAC's default letter nor the court summons qualified as an "initial communication" that would have triggered the need for the debt validation notice; the Seventh Circuit Court of Appeals found that the filing of the summons constituted an "initial communication," reversed the lower court, and remanded the case for further consideration.

The Court's Ruling
The Appeals Court ruled

that GMAC was a creditor but not a debt collector under the FDCPA;

that GMAC's default letter could not therefore qualify as a "communication" under the FDCPA (a fact agreed to by all parties);

that GMAC's attorneys qualified as debt collectors under FDCPA, 15 U.S.C. § 1692a(3) & (6);

that the filing of the collection suit summons constituted an "initial communication" with Thomas concerning the delinquent debt;

that the ruling of the lower court is reversed; and

that the case is remanded to the lower court for further consideration of Thomas's claim.

According to the appeals court, the questions raised in the appeal had not been addressed by federal appeals courts prior to the Thomas case. The court took note of differing opinion at the district court level.

The court found no conflict between the "plain language" of the statute and the intentions of its drafters, and dismissed the defendants' contention that deeming the filing of a summons and complaint an "initial communication" would interfere with litigation by making debt collection suits more cumbersome for attorneys.

Judge Evans dissented from the majority opinion of the appellate court. His argument goes to the nature of the filing of a debt collection suit. He opined that such filings are not the dunning "communications" envisioned by the FDCPA. He further noted that the court footnoted its ruling, mentioning that the 108th Congress was considering a bill that would have specifically excluded formal pleadings from the "communication" definition in FDCPA. While the majority of the court opined that Congress's consideration of H.R. 3066 was an "indication that Congress considered the FDCPA's current definition ... to include the filing of a summons and complaint," Judge Evans argued that Congress's intent was to make explicit the implicit exception already there. It makes for some interesting reading . . .

In light of this decision, we imagine that creditors' attorneys will be reviewing their procedures to ensure that debt validation notices are delivered on the heels of filing debt collection suits -- at least in the Seventh District, or until Congress makes a change in the statute.

Today was another win for consumers in the State of Utah, as IGS Nevada, AGAIN broke the law on behalf of GMAC.

While on location, we received a call from a VIP Client of Western Capital stating that "Mr. Paisola, My wife is scared for her life" We need your assistance...

With that call, our team at Western Capital went into action in Salt Lake City and Las Vegas Nevada.

Our instructions were very simple and to the point. Start to take photos of the incident and start to videotape and DO NOT STOP. Our client did this.

"My wife was pulling into her garage in another car, and two men rushed her from a towing truck"

IGS Nevada had done it again. They had been retained by GMAC to reposess an automobile that had a disputed balance. IGS NEVADA is a company that has been investigated by multiple Attorney General offices around the nation. They have been sued in Federal and District Court OVER AND OVER.

Why, BECAUSE THEY WILL USE ANY MEANS NECESSARY, INCLUDING BREAKING THE LAW to violate the American Public.

What you see here is the reason WHY Attorney General Andrew Cumo of New York indicted Many debt Collection Firms as a result of our investigations. This is our story on the indictment

IGS Nevada had hired a company called QUALITY TOWING located at

to repossess an automobile in the small bedroom community, just outside of Salt Lake City, Utah. What they did not know is that the victim of this incident was a VIP Client of Western Capital. What they also did not know is that we are preparing to amass a Federal Class Action AGAINT them, their CEO James Snead and their shell cover debt collection operation in Las Vegas, Portfolio Recovery Associates.

With the videotape running our client was able to obtain raw digital footage of the company that "scared my wife to death"

He was also able to get very detailed images of the criminals who rushed his wife and refused to leave the property upon demand: This is one of the men

Notice the above suspect who is pictured here , as he DIRECTLY VIOLATES THE LAWS OF THE STATE OF UTAH on behalf of GMAC and IGS Nevada. He is INSIDE of the GARAGE of the victim after being told to leave!

This is one of the other suspects speaking to law enforcement who was immediately dispatched.

This is a photo of the Officers Examining the Fax that is pictured above that the towing company believes gives them the right to "forcibly trespass against a resident in the State of Utah" and to "Violate and Breech the Peace of the Property Owners" despite being told to leave.

We spoke to the detective that was onsite (We will be syndicating the live coverage) and were told that these two men would be charged with multiple criminal charges, pending screening, in the State of Utah for Trespassing and multiple violations of the law regarding how a reposession can and must be performed.

Notice that this is one of the people who violated the rights of the property owner, who, as our client is rolling HD VIDEO, as is his right and duty under Utah Law. Notice that he has his head turned, for fear of exposure around the world, as he screamed "This will be all over the world on youtube.com, and hid from the cameras"

The good news is that the men and women of law enforcement did their job. They told the victims who were rushed by these men that these two men on behalf of Quality Towing, IGS NEVADA, and GMAC would be escorted off of the property. They would not be permitted to take the automobile REGARDLESS OF THE REPOSESSION ORDER and They will be charged criminally. We will run the live footage as soon as it is avaliable on our satellites.

Listen Closely America.... YOU HAVE RIGHTS. THIS WILL COST GMAC MILLIONS and IGS NEVADA AND GMAC WILL NOW BE FURTHER INVESTIGATED IN A FEDERAL FORUM FOR THEIR BLATANT DISREGARD FOR THE RIGHTS OF THE AMERICAN PEOPLE.

Because this Client did exactly what he was told by Western Capital's CEO and President, Robert Paisola and our Corporate Attorney, the next photos you will see are booking photos of these two men who broke the law on behalf of Portfolio Recovery Associates and GMAC as the State of Utah states to the world "We will not tolerate this type of conduct against our citizens"

As many of you know, we receive hundreds of requests for assistance from around the world from consumers who are dealing with debt collectors. Today we had the opportunity to deal with a company called:

IGS Nevada, Inc.

IGS Nevada, Inc., is currently doing business as PRA Location Services, LLC states to Business Week Magazine that they "offers national skip tracing, asset location and collateral recovery services, principally for auto finance companies"

The company was founded in 1995 and is based in Las Vegas, Nevada. As of October 1, 2004, IGS Nevada, Inc. is a subsidiary of Portfolio Recovery Associates Inc, a licensed and bonded collection agency. We hope that they have very high liability limits.

One of our Western Capital VIP Clients called us and said that their 70 year old mother was being harassed as a result of a debt that was placed with this company. Elizabeth Mohlman stated that another agent VENICE called the debtors mother in law. We assigned a team of investigators, and you will not believe what was said. "THIS WILL CONTINUE UNTIL THIS IS RESOLVED"

The company told the debtors mother that THEY WERE GOING TO TAKE HIM TO JAIL and that if he did not return the car, that he CAN AND WOULD BE SENT TO THE COURTS TODAY.

As a courtesy, we asked to speak to the CEO, JAMES SNEAD, to give him an opportunity to respond to the recorded conversations as third party information was given. We were told by the collector Elizabeth Mohlman that they had the phone number of the debtor the entire time.

At 4:33 MST We spoke to Mr. James Snead and he stated that he would neither confirm nor deny that this was his company that we talked to on the recording that is being transcribed. We will also post our conversation with Mr. James Snead for your review.

They stated that they WERE NOT a collection agency and that they were "JUST A SKIP TRACING COMPANY" "We are NOT COLLECTING for toyota"

We are going to call James Snead, the CEO of IGS Nevada for a formal statement and then will broadcast this on our international network.

A Special Message from Robert Paisola this Holiday Season

As the holiday season comes upon us many in this country will be wondering what the new year will bring for them. The countless homeless, about to be homeless, underemployed and unemployed will be thinking about life before the crisis brought on - by self admission - by Goldman Sachs. At the same time, the employees of Goldman Sachs will be busy feasting, shopping and sharing, counting all the money they just made in bonuses on the backs of the American people.

Holidays - no matter what religion or beliefs you have - are typically a time to sit back, enjoy family and friends and just have a good time. Not this year or even the year before and probably not next year either. A very sad commentary on the state of the state of America.

As the new year approaches, I see it as a new beginning. An opportunity for Americans everywhere to stand up, speak out and take back control of "our" country. The message to our politicians, our administration and to our controlling "too big to fail" should be and is - we have had enough. We are the people of this nation. We are your bosses. You all work for us. We want justice and we want our freedom back. We want jobs and we want homes. We want food to feed ourselves and our children. We want our American way of life back. Not with the excesses that were allowed us by our government and financial institutions in recent years but the way of life we enjoyed prior. Sure, it did not work for all, even then, but that should have been our mission - to help those less fortunate then the majority. Instead, we walked many millions of people into a candy store and said, "you can have all you want...just take it". We were constantly reminded of this by television commercials from JPMorgan/Chase in their "I want it all and I want it now" campaigns.

Instead of helping those "less fortunate" we increased the numbers of "less fortunate" and increased the incomes and lifestyles of those already on the top tier of income and lifestyle.

So as this holiday and New Year season is fast approaching, let us all resolve to take action and let our rulers know just how we feel. You see, we still have one thing going for us here in America - we can still vote someone out of office. We can let them know our intentions. We're going to fire them and allow them their pensions and health benefits. A gift far larger then any they have given us in quite some time.

With a resolution of taking action and correcting the many wrongs that exist, perhaps, resolution by itself, can help us take the time out during this holiday season to enjoy our family and friends without the stress that exists.

Here is the main company used by the National Center for Missing and Exploited Children (NCMEC) to analyze pictures that are claimed to be child porn.

The program they have developed is quite interesting. Pay particular attention to my highlight, as that drives UP the number of images.

THE SITUATION:Specialized police departments are storing, accessing and utilizing databases containing hundreds of thousands images. Child abuse investigations typically involve the examination of high volumes of seized visual assets (on hard drives, DVD-ROMs, etc.).

The illegal, pornographic content found in these seizures is usually added to a centralized image database. However, the management, comparison, and search for evidence in these images is a time consuming and prohibitively large task that must be performed in situations where urgency is the key.* Image-based search within a centralized data center*

Content-based search within large image databases* Easy and intuitive access to visual assets* Identification of series of images using visual comparison techniques* Automatic comparison of large sets of images with a reference database

THE CHALLENGE Transform unmanageable visual libraries into strategic assets in the field of investigation. LTU was approached by several police organizations around the world to create a system to aid in the investigation of child abuse criminals and distribution rings.Since the content managed by those organizations is sensitive and prohibited by law, it is necessary to create an internal, restricted-access system to automate the comparison of current seizures with the organization’s thousands of confidential, documented images..

A system is needed which facilitates the correlation between the elements found in current cases (hard-to-describe, undocumented, unqualified) with images, clues, and evidence.

THE SOLUTION Implement LTU’s powerful image recognition application to increase the efficiency of the investigation process.

LTU implemented within several police organizations a specialized version of its LTU engine (Image-Seeker) application with an Autoscan function. These law enforcement agencies are now able to compare and match images, a task previously impossible with their manual procedures.The LTU system has improved the investigation speed and success rate by giving the investigator ability to:

Compare recently seized images, about which little or no information is known, to a police database of images and videos that have identifiers or characteristics attached. By comparing visual clues, the investigator is able to identify the source of an image, links between known criminals and suspects, details about the location a picture was taken, and sometimes the people within the images.

Match single images to a series of images or videos. Since images are often sourced from a roll or a video segment, there are rarely many stand-alone images. Investigators can now find and match a “missing link” image to its original series, or a similar series. This information provides investigators with insights into details about the camera used, the style of the photographer, and even camera angles which may reveal facial features not previously seen.

Link apparently harmless images of children to a series that has been documented and captured as illegal. For instance, a photo from a recent seizure of a child smiling might actually be part and parcel of a porn series, which would have otherwise gone unlinked without an image similarity recognition system.

Help identify similar features of images, such as clothing or backgrounds. This information allows the police to identify victims who have been abused repeatedly, but in different locations, for instance.

THE LTU IMAGE-SEEKER APPLICATION

Image-Seeker (now LTU engine) can be used for:

Direct implementation for organizations with large volumes of strategic visual data.

Integration with knowledge management and media asset management software via API's.

LTU can provide consulting expertise on the integration of its software with other applications.

THE BENEFITS FOR LAW ENFORCEMENT ORGANIZATIONS Improve the fight against child abuse activities and help in dismantling image distribution rings.Since several police organizations use the LTU system in current criminal affairs, the information that can be released to the public is restricted.

However, feedback is positives and indicates that LTU technology has been instrumental in helping solve many cases. In one instance, images found in the seizure of a suspect were compared using LTU’s system to the police database.

The results of the comparison revealed similar images, which contained the very suspect.

The specialized police department concerned was able, therefore, to charge the suspect not only on possession and duplication charges, but on criminal participation charges, as well.In current seizures, the police often capture more than 100,000 child abuse images in one location.

Previously, investigators would have been unable to sort through or pull information from these images manually, and the images would have gone unused due to time restrictions. With LTU’s technology, the automated investigation system is now able to extract incriminating evidence from these images regarding the suspect in question, and potentially other participants.

BopWatchdog has been in contact with ARS TECHNICA, the company that created this technology and was told that this finding could force the courts to reverse THOUSANDS of CONVICTIONS based on plea deals, convictions and sentences imposed, due to the faulty technology.

Stand-off Gunman Was Former Child Actor With Violent Past

EL MONTE-- Authorities say a man who was shot and killed by police after a standoff in which he took his 7-year-old son hostage Tuesday was a suspect wanted for the 2004 murder of his girlfriend in Hawthorne.

The suspect was identified by police as 38-year-old Manuel Benitez of Hawthorne, was wanted by the FBI since 2004 for allegedly killing his girlfriend Stephanie Spears, the mother of the 7-year-old.

Benitez had been a fugitive for four years until he showed up Tuesday during the standoff at Tai Pan restaurant in El Monte just after 3:20 p.m.

Benitez was apparently featured on the television show "America's Most Wanted" earlier this year.

The show said Benitez was a child actor who went by the name Mark Everett, one of several aliases known to police.

He appeared in commercials and in films including "Stand and Deliver" and "Pee Wee's Big Adventure."

Benitez allegedly bludgeoned Spears to death with a dumbbell inside their home during a fit of rage after a bad break-up.

He was supposedly trying to take their son after the break-up while Spears slept, but became enraged when Spears woke up and confronted him.

Benitez then allegedly fled with his son and mother, Elizabeth Velasco, to Cuba or Mexico. He was charged with murder and a California warrant was issued for his arrest in May 2005, according to the FBI Web site.

A federal warrant for unlawful flight to avoid prosecution was issued in March 2006. The FBI was offering $20,000 for information leading to Benitez's arrest.

Tuesday's incident, which involved the same boy, began around 3:20 p.m. when police responded to a report of a suspicious man with a child near the intersection of Ramona Blvd. and Santa Anita Ave. Officers arriving at the scene reportedly found Benitez armed with a handgun.

Officers told the man to let go of the boy, said El Monte Police Det. Ralph Batres. The man resisted and fled, pulling the boy with him.

With the boy in a headlock, and a gun held to the child's head, the man tried to enter the El Sombrero Restaurant, according to a restaurant employee

After several unsuccessful attempts to get into that restaurant, Benitez took his son into the Tai Pan Chinese Food restaurant, where he locked himself and the child inside a bathroom.

Authorities negotiated with Benitez for two hours, when a flash-bang grenade detonated at 5:30 p.m. followed by gunshots. There is no word on who fired the shots.

Two handguns in Benitez's possession were recovered following the shooting, according to police.

Officers pulled the boy out of the restaurant and he was rushed to County USC Medical with a gunshot wound to the thigh. He was reported in stable condition Wednesday.

LOS ANGELES (Reuters) - A man dressed as Santa Claus showed up at a Christmas Eve party at a suburban Los Angeles house and opened fire with a handgun, killing three people and wounding two, police said on Thursday.

The only suspect in Wednesday night's shooting in Covina, California, Bruce Jeffrey Pardo, 45, later committed suicide and his body was found at a relative's house in nearby Sylmar, police said.

"He died of self-inflicted wounds. We believe it was a marital dispute," said Lt. Pat Buchanan of the Covina Police Department.

The house caught fire during the shooting and was engulfed in flames when police arrived.

The two people wounded by gunfire included an 8-year-old girl and both were hospitalized with non-life-threatening injuries, Buchanan said. A third person was hospitalized with a broken leg, he said.

Police have not identified the dead yet, Buchanan said.

Witnesses among the 30 people attending the party told police that Pardo stripped off his Santa costume after the shooting and fled in street clothes.

Report: 1 In Every 99 Americans Now Behind Bars
U.S. Spent More Than $49 Billion On Corrections In 2007

NEW YORK (CBS/AP) ― Don't ask the U.S. prison system if this is indeed "the land of the free."

For the first time in history, more than one in every 100 American adults is in jail or prison, according to a new report tracking the surge in inmate population.

The report, released Thursday by the Pew Center on the States, said the 50 states spent more than $49 billion on corrections last year, up from less than $11 billion 20 years earlier. The rate of increase for prison costs was six times greater than for higher education spending, the report said.

Using updated state-by-state data, the report said 2,319,258 adults were held in U.S. prisons or jails at the start of 2008 -- one out of every 99.1 adults, and more than any other country in the world.

By contrast, in mid 2002 the ratio was 1 in 142, with the prison population surpassing 2 million for the first time.

The steadily growing inmate population "is saddling cash-strapped states with soaring costs they can ill afford and failing to have a clear impact either on recidivism or overall crime," said the report.

Susan Urahn, managing director of the Pew Center on the States, said budget woes are prompting officials in many states to consider new, cost-saving corrections policies that might have been shunned in the recent past for fear of appearing soft in crime.

"We're seeing more and more states being creative because of tight budgets," she said in an interview. "They want to be tough on crime, they want to be a law-and-order state -- but they also want to save money, and they want to be effective."

The report cited Kansas and Texas as states which have acted decisively to slow the growth of their inmate population. Their actions include greater use of community supervision for low-risk offenders and employing sanctions other than reimprisonment for ex-offenders who commit technical violations of parole and probation rules.

"The new approach, born of bipartisan leadership, is allowing the two states to ensure they have enough prison beds for violent offenders while helping less dangerous lawbreakers become productive, taxpaying citizens," the report said.

While many state governments have shown bipartisan interest in curbing prison growth, there also are persistent calls to proceed cautiously.

"We need to be smarter," said David Muhlhausen, a criminal justice expert with the conservative Heritage Foundation. "We're not incarcerating all the people who commit serious crimes -- but we're also probably incarcerating people who don't need to be."

According to the report, the inmate population increased last year in 36 states and the federal prison system.

The largest percentage increase -- 12 percent -- was in Kentucky, where Gov. Steve Beshear highlighted the cost of corrections in his budget speech last month. He noted that the state's crime rate had increased only about 3 percent in the past 30 years, while the state's inmate population has increased by 600 percent.

The Pew report was compiled by the Center on the State's Public Safety Performance Project, which is working directly with 13 states on developing programs to divert offenders from prison without jeopardizing public safety.

"For all the money spent on corrections today, there hasn't been a clear and convincing return for public safety," said the project's director, Adam Gelb. "More and more states are beginning to rethink their reliance on prisons for lower-level offenders and finding strategies that are tough on crime without being so tough on taxpayers."

The report said prison growth and higher incarceration rates do not reflect a parallel increase in crime or in the nation's overall population. Instead, it said, more people are behind bars mainly because of tough sentencing measures, such as "three-strikes" laws, that result in longer prison stays.

"For some groups, the incarceration numbers are especially startling," the report said. "While one in 30 men between the ages of 20 and 34 is behind bars, for black males in that age group the figure is one in nine."

The nationwide figures, as of Jan. 1, include 1,596,127 people in state and federal prisons and 723,131 in local jails -- a total 2,319,258 out of almost 230 million American adults.

The report said the United States is the world's incarceration leader, far ahead of more populous China with 1.5 million people behind bars. It said the U.S. also is the leader in inmates per capita (750 per 100,000 people), ahead of Russia (628 per 100,000) and other former Soviet bloc nations which make up the rest of the Top 10.

Dear Mr. Paisola I am a registered sex offender. In 1993 I was charged with ASSAULT WITH INTENT TO COMMIT MAYHEM, RAPE, SODOMY in California (Penal Code 220). I was at a party with a bunch of friends (approx. 20). A lady (with whom I had sex with numerous times) was there (she was 19 I was 20) and we started making out in the bathroom of the house party. Her friend came in and the lady pushed me off of her and lied, she said I was trying to rape her. This was the first time I had ever been arrested as an adult and I was terrified while I was housed in the county jail system and going back and forth to court to defend myself.
