The band isn't playing live shows right now and I had to cancel the next show in Portland at Plan B. I am working on a few things a couple of which are really killer ideas and the next couple shows just couldn't happen right now.

After last year, while working on the new release and then this year listening to the new cd "Who Wants Candy" when it was done, I decided the music and band needed to start focusing on some different things and the vibe had changed with the recording on the track, "Killer in Me". It made me think about the dedication of the concept I feel and playing out right now wasn't what the band need to do, is work on a couple killer ideas that have come out of the last recording, a piece called, "Soundtrack of A Murder", and changing the sound of the band into a closer personal look at a killer, a darker sound scape of what happens the moment life ends at the hands of brutality and how homicidal behavior co-exists within our every day life. Sean is getting ready to take a 3 month trip over the spring so he will be on a short break, however Nigel moved on to other things in his life over the past holidays. So it was the perfect time to move forward and evolve as a band and an artist. We are still headed to Wally's in Wenatchee, Washington the last part of March

The new CD is amazing and is available on line. I'm getting ready to start shooting some new videos late in March for some of those songs as well as working on some new material that is dripping with gruesome that will be out late summer of this year.

Wayne Gacy Trio – NEW RELEASE

Who Wants Candy? was recorded by the Wayne Gacy Trio in the autumn of 2011. Jon Dark, an engineer from Oakland California moved to the northwest and converted a barn in Sheridan, Oregon into Pyrate Llama Studios. In the summer of 2011, singer and founder of the Wayne Gacy Trio contacted Jon. They meet and talked about the overall stylistic feel of the band and about making the tracks sound like a Polaroid of something you shouldn’t see, and how they could get what the singer called “a soundtrack for the killer in all of us”

Who Wants Candy? kicks off with a song called “Playtime Surprises” and finishes with “News at 11”. The fifteen tracks on the album drip with imagery that is creepy and a cinematic feel connects Who Wants Candy? from start to finish. One listener remarked enthusiastically, “It’s a murder masterpiece!” The songs ooze an authentic garage sound—raw energy and music that at times rips through the listener like a freight train, and at others it’s almost like being inside a killer’s head. Who Wants Candy? makes you feel like maybe listening to it wasn’t such a good idea after all, like you’re hearing something that you shouldn’t, something dark that lurks deep inside everyone, including the listener.

The Wayne Gacy Trio’s songs delve into subject matter that is difficult for most people to handle. Some of the material is presented in a tongue and check fashion, but as the singer of the band says, “the beauty of the Wayne Gacy Trio’s music is that it’s about the truth and brutality of the dark side. There is a killer in all of us, maybe just deeper down in some than in others, but it is still there”.

Who Wants Candy? is the trio’s fourth release. They released an EP “Fuck & Kill” in 2011, Baby Unicorn Killers (cassette only) in 2010 and Rec Room Romance and Crawlspace Love Affairs in 2008

Happy Halloween,

with Halloween upon us, I have in possession two suits that were worn by John Wayne Gacy himself while he was on trial 30 years ago. They were sent to me by John Wayne Gacy's defense lawyer Sam L. Amirante and Danny Broderick co-author of the new book "Defending a Monster".

The suits will be here in Portland this weekend for our Halloween shows. I will be shipping them back to Chicago next Tuesday.

It all finally came to a end yesterday, after 12 months of being jerked around by Sean Skelding & Cheezy Flicks over some stupid contest. I have to say Ritchie Bristol fucked things up pretty good. Sean Skelding i'm sure one day he will get his, but we had to pass on suing him due to the fact Ritchie signed my name on a contract and if we had taken Sean Skelding to court he would have blamed Ritchie for everything and it seemed like Ritchie had gotten himself in enough trouble. Now Ritchie as I said did fuck up, but he finally started to get his head out of his ass and tried his hardest to make things right so I didn't want to make the guy get in more trouble. Ritchie and myslef meet yesterday and I had him sign an agreement, he handed me 250 cd's for the usage of our song in the movie and were all done, well other than this last blog about it all.

The agreement that I wrote made sure to state that no other agreement had ever been signed by myself and that Ritchie was the only one now given the right to place the song within the movie Stripperland. It also started that instead of the 10,000 in studio time from black Diamond that Jeff Allen agreed to supply as part of winning, that we received 2000.00 in studio time from Rex Post instead. Ritchie informed me yesterday he had since spoke with Jeff Allen and that he had agreed to let Rogue Shot which was one of the bands that cried and bitched about losing to us use the studio time as well as this other group that lost called Cellar Door, the singer from that band almost throw a hissy fit at the finals the night we won. He started yelling crap out loud, it was so funny. Now both this bands suck and really I think having them work with Ritchie and Jeff Allen is fitting. As for Sean Skelding well he tried to send me some crap from his lawyer who deals with animal rights about releasing the tracks and we could sign off and I would have to remove any and all mention of him and his company from the web, yeah right, suck my dick you fucktard.

Sean is starting to work with a couple other film guys in town and a company called revolution Media group. I warned one of them, but you know some people just see money and it makes their ears stop working. Anyone that deals with Cheezy Flicks or Sean Skelding after being informed about who he is deserves just what they get.

As for our CD's we got for the deal, I'm still trying to figure out what to do with them. This thing was never about the money for us it was about winning and about having companies steal music from musicians. Since this whole thing started I have gotten hate email, been threatened by other bands, called a cheater and every other name in the book. Been told to walk away, don't deal with it and it makes me sad that that's the way people would deal with it.

As for the singer in Rogue Shot, Mathew, and the singer in Cellar Door whatever the fuck that guys name is, well they are both fucking cry babies and they can suck my cock anytime they want. It is funny that the only guys that complained in other bands were the singers. I guess they aren't getting their rockstar polished enough. Funny how the bands that accused Ritchie of cheating are now working with him and Jeff Allen, the whole thing is a freak show with these people.

As for Jeff Allen, well he will always be Portland's very own dickblister, the guy is a full blown posers.

I think as for Sean Skelding well he has yet to get his. At least if people start to do a little research on him they may come across this and find out some things they didn't known before. I know some people want to blame Ritchie for the whole deal and while it is Ritchie fault the thing got fucked up, its Seans responsibility to take care of it as the owner of the company and really when it boils down to it thats the part thats wrong, when fat motherfuckers like this guy never take responsibility for anything and blames everyone else.

As for everyone that's every been fucked over by Cheezy Flicks or Sean, sorry. But never walk away and think its alright to be fucked over as a person, an artist, or a musician. Stand up for yourself cause no one else will.

Sean Skelding is a Lair

Yes the fucktard Sean Skelding has done it again. This guy must have something going on that allows him to think the crap he does is right. Check this out:

"Mr. Ritchie Bristol is not now, and has not been, an authorized representative for, or a legal agent or employee of, Cheezy Flicks Entertainment, LLC or Cheezy Flicks Productions, LLC."

WTF? This was just part of an email he sent out this past Monday. By some means he thinks because he wrote it, it must be true. Not only did Ritchie work for him, Ritchie was in change of the Stripperband contest, placing all the music in his movie Stripperland. Look up the movie online and Ritchie Bristol's name is all over it.

I sent Sean Skeldings lawyer an email stating this needed to happen:
They had to pay the balance of the studio bill to Rex Post which was $500.00, Ritchie Bristol had already taken care of $1500.00 of it.

Release those 5 tracks we recorded there as part of us winning Stripperband

Write us a check for $1300.00 to make up for the lack of remaining studio time and the other prizes that have not been awarded.

At that point I would sign an agreement so that our music could have been used within the movie and we could all be done. Sean Skelding wanted to release the 5 tracks to us and that was it, oh he also wanted me to take down my blogs about this fat mother fucker, yeah I'll do that, fuck Sean Skelding

Its a sad Cheezy Day

Today I was sent a forged document from an animal rights lawyer, now this has nothing to do with animal rights unless were talking about the pig that hired him. It seems as if the fine folks at Cheezy Flicks and Sean Skelding have somehow been unable to take care of awarding the prizes from their "Stripperband" contest back in July of 2010 for a movie titled "Stripperland" and then person that was in charge has been fired and I was informed by another email that he never worked for the company and now somehow there is a forged agreement stating that they have permission to use our music in their film, which is not the truth.

Think, an artist, a musician or a band that wins a contest by a company and then the company is unable to award those prizes and forge documents to use their music within the film that the contest was for . What can we do about it, sue them? meet them somewhere and throw skittles at them and yell "FEEL THE RAINBOW MOTHER FUCKER"? maybe just do nothing? I don't think so. Were a Murder Rock band, not a Steal Our Music and Fuck Us in the Ass Band.

This person Sean Skelding is a thief, and a liar. Seems he bullies his way through life, pushing and shoving people as he goes, well as for the Wayne Gcay Trio, fuck that, I push back. This guy can suck my cock and go to hell. If no one cares, that's the way it is, but I care and I'm sure others do as well and if they don't I care.

Anthony quit the band this week via email, yeah by email. We all have things that change in our life, but quitting by email?, yeah it's a pussy move. Over the past 3 years I have seen him do some fucked up shit. I always liked Anthony even though he complained alot, kind of looking back he whined more than most people I have ever know. After he quit, he blocked my email address cause I told him he was a pussy for quitting by email. I doubt I'll ever see young Anthony again, shame, but ya know sometimes people just burn a bridge and move on, I'm pretty sure that's what happens with Anthony.
He never said much about his past other than he had a drug problem, lived with 2 gay guys in San Diego, worked at a plant in Indiana making RV's and was from a town called Goshen, that was it. Never talked about his future at all. He stopped drinking for a while, I told him he had to or he could play in another band, he started again and tried to keep it a secret. He did get drunk one night and tell a few girls he was gay but afraid to let people know, well most everyone that ever meet him knew that he was. As for what he's going to do next, no telling, hope he gets his traction and starts to fix whatever is wrong with him, or finds a path to what he needs to be happy, after all you only get one life to live. I think when you live your life without being honest it really doesn't come out good and Anthony is a great example of that. Anthony is a nice guy and maybe one day it will all work out. Bon Voyage.

Soundtrack Adjustment

I do not like to participate in the online Drama Sensation Marketing Strategy, but How long can someone take abuse before they respond?

I'm not sure, It may be what Ritchie is upset about his inability. I'm sure when we entered the contest we were looking froward to waiting almost a year to get our prizes awarded, take some intern to court because he placed our music in a movie and on his cd. I wish it wasn't so, but when people don't use contracts this is what happens.

By Choice, A band’s Music has been removed from our project(s) even thou I posses over 3 Agreements/Contracts from the band allowing me to use their music.

Good thing when we when head to court next month Ritchie will be able to show everyone those finally. If that is indeed the case then by all means why did it get pulled, by choice, no it was pulled because Ritchie Bristol had no rights to use the music.

The Band uploaded Music onto our website, when entering the Projects Music Contest and agreed to the online entry agreement when doing so. Any Music that is uploading on to our server, by a band is prospect for use in the Project. Winners and Selected have the option to decline. The Accusing Band, Still to this day has NEVER once communicated they did not want included in project.(But quite contrary, Read:Bands Blog 1 February 2011 —Read: Bands Blog2 March 2011 a week before the Release)

We never uploaded anything to a web site, he was sent the file. He's wrong about the once thing, as we communicated it 3 times. If the company is unable to award the prizes in full we want nothing to do with the company what so ever.

The Band Provided Registered/Documented Delivery of The Specific Song Masters to Producer to be used for the Project, and provided a statement, stating that the Said Master is given to the Company for use on the Project.

No master was ever sent to anyone at Cheezy Flicks ever, a file was sent and once again Ritchie was informed if the company was unable to award all the prizes we would not be interested in having anything what so ever to do with Cheezy Flicks.

The Band Provided a Contract and Documented Statement of agreement for use of the Music Specifically for the Song in question.

No statement or agreement was every signed, one was sent by Ritchie and he stated " I was baked when I put it together and it is kind of messed up". I sent one back in Jan. and that agreement was never signed or amended. No contract = no song.

Further More, I have Sworn/Notarized Intellectual Property Rights Affidavits that protect my project under Copyright Law – Section 512, Sub Section G

If what Ritchie says is true doesn't it seem costly and a waste of time to have place the soundtrack online, then allow CD Baby to pull the soundtrack? If he did have the agreement as he claims the soundtrack would not have been pulled from CD Baby as he could have emailed them a copy, he was unable to do so. I guess it more of our dishonesty.

Hate Email? yes thank you Geoff Henderson

It's so funny when you read emails from people who hate you, take this guy Geoff Henderson. Just yesterday he sent me an email saying Rogue Shot should have won the Stripperband contest, I wish they had, but they didnt. Matthew the lead singer wrote me right after the contest, I have to say I like the band and Matthew really seems like a nice guy he was just upset they didnt win, if he knew what it was going to be like he would have thanked us for winning. Geoff went on to say I was a John Wayne Gacy lover, he wished I was one of John Wayne Gacy's victims, that I fixed the stripperband contest, that he hopes Cheezy Flicks sues me because they have money to do so. He was angry about all most anything he could throw out there. It's funny how these people who dont get it act. Talk about an ego, like I really care. He was trying everything he could to spew his small minded self absorbed bullshit. Fuck this guy, people need to start to do the right thing and if it makes people like this guy mad too bad, too bad, bring it.

Since this whole thing started, KUFO has changed formats and Jeff Allen lost his job. Shel Bailey says she left Cheezy Flicks for not being paid, but Ritchie claims she was fired, the radio station she worked at let her go and she has gone on to work for a Portland music web site doing sales. Ritchie Bristol, well he started a remodeling company with this guy named Andy. Sean Skelding, well we have no idea other than him still being a shitbag. His money comes from stealing peoples work and re-packaging it and selling it online. At this point he owes money to every studio that helped work on the soundtrack.

Winning the Stripperband? well that took playing 3 shows, what happened the next 6 months after that was anything but fun. It was put on by a company called “Cheezy Flicks”, they released a movie called “I Am Virgin”. What they really do is distribute old B-Movies for the most part, they were going to be shooting and making a new movie that was a spoof from the movie Zombieland, it is about woman who turn into stripper zombies. The contest was called Stripperband, the winners of the semi-finals and finals would have their music in the movie and the winners of the contest would have their music featured in the movie as well as whole host of other prizes.

The contest was held over a 12-week period starting in May of 2010, 40 bands played shows at venues all over Portland. Shel Bailey, former DJ at a local radio station called me up and said, murder rock, zombies, strippers, you have to do this. Sounded good to me. The first show we played was at Stars, a chain strip club place that really looks more kind of like the Denny’s of strip clubs. We went on first and had to leave right after our 30 min set to play another show. Later that night I got a text and it said we won, so off to the semi-finals, which were in about 6 weeks.

The next event we went on first again and had to leave once again before the night was over because we had another show to do, same thing I get a text and we had won again. The finals were held on a Saturday night, July 31st 2010. And we played last and then it was announced we won, right afterward they had to re-count the votes because people in Restrut were upset as well as a singer in the band Rogue Shot, and Jeff Allen the MC for the evening who has worked with Restruct. It was about how the whole contest was rigged and no way could we have won.

5 days later on that following Thursday night at 10:15 pm, I get a call. Up till that point no one had contacted me about winning the contest. After about Tuesday of that week I knew something was wrong. I contacted a few of the judges and they told me they were re-counting the votes, people were upset we won, the whole thing started sounding like maybe it was going to be not so fun. I had gotten some emails from the singer in Rogue Shot and here’s a small sample of those emails that started on that following Wednesday August 5th:

This is Matthew, Outwardly, you appear to be...well, very accepting of what I would consider to be abhorrent behavior. Yet you win graciously, and seem to have people figured out...a plan, so to speak. I want to hate you. I'm sure you run into this frequently, and even thrive on it. But I have to admit, your even keel reactions, and positive attitude, have me second-guessing my initial response. I couldn't honestly tell you how well you played, because I was angry at your premise. I still wouldn't knowingly let you near my kids. However, I wanted to wish you well. If you're going to find success, I hope it's worth the trouble you'll inevitably stir up.

You're right, I judged you without knowing you. On what you presented. Wrong or right, I saw a person who wanted people to think he was influenced by, and wanted to be like, a person who tortured, raped and killed, 33 young boys between 1972 and 1979. You were well prepared, original, and.. I could not stay objective. That said, I did write the station, and said, more or less the same things I started ranting about, the moment I heard about someone allegedly mimicking Wayne Gacy. I would not have said a word against either of the other bands, had they won. I thought about doing it anonymously, but decided I was not afraid to stand behind my statements. After corresponding with you, I feel like I MAY have misjudged you. However, you can be assured, if that's the case, I won't be the last one to do so. Furthermore, I suspect you're counting on it.

I have the same rights as you, to be able to speak my mind, even if you and everyone else, think I'm wrong. I've said nothing behind your back, that I wouldn't say to your mask/face. What's more, I don't care if you, your fans, the radio station, or any other bands, don't like me for doing it. I'll say what Ibelieve, and I'll say it without hiding behind a mask. I'm done complaining, I'm going to leave you alone. I would be fine writing back and forth with you in defense of my position. If that's something that interests you. cheers.

Ok so this guy went on to call the radio station, and everyone that would listen and then rants on to me for about 2 ½ days via emails, his band finally emailed me and said they were sorry, he was just upset about losing. Well the phone call did come from the people at Cheezy Flicks. That Thursday night at about 8 PM from the person who had been in charge of the event, Ritchie Bristol. He started yelling at me within 3 minutes of the phone call, telling me everyone thought the event was rigged, they couldn't understand how we won, that over the last few days he has had to work extra hard to defend the Wayne Gacy trio, for 20 minutes this guy is just going on and on. I final stop him and remind him, all we did was win your contest, that’s all, we did what we were told, when we were told, for how many minutes and that was it, we played in front of judges you contacted to be part of the contest, the other bands are mad because that’s what happens.

He told me he had to put up a web site and post all the ballots and have all the judges look them over and then sign off on them. After looking at the web page he posted, out of the possible 550 points total you could earn, 11 judges at a maximum 50 points each, we had received 477, 2nd place was 427 points.
The next day Friday August 6th, I contact Shel Bailey, I told her the following: I get this call last night, and Ritchie Bristol was yelling at me about how much extra work he has had to do and he is done with this. She then tells me he is getting fired and she will take care of it for me, her and the owner will get right on it and she is so sorry. She say’s “lets get a meeting together for next Friday” and I say great, thanks for helping.

When I get back and check my email Friday afternoon, this is what I had received from Ritchie Bristol:

A few more days went by and yes it was decided we won, that’s when it starts to get worse.
I was given some contact information for the sponsors and told to get a hold of them as soon as I can, as the person in charge of the event wanted to be done with it all and was so burnt out he was sorry he was even involved. 4 days later from Shel Bailey who send she was taking care of all this sends me an email:

Hi Tony. I'm not sure when this is going to happen. We have been working on the details of your prize package. I'm a little embarrassed that I brought you into this. Our film has been kindly covered by media outlets all over the country. I don't think anyone needs to be fired, especially since we r all doing it for points on the back end.

I will leave all further communication about this up to the owner he will be in touch with you. If you don't feel its in a timely manner and choose to pull out, that's fine. While the company is ready to live up to our obligation, we don't feel like dealing with your ungrateful and unprofessional attitude.

This was the last email from her as she decided that not being paid wasn't a good idea. She then went on to start stripping and was let go of her job as a morning DJ

Ok, now its a hot mess, I decide that I will start contacting everyone and just get done with it, after all they all were working together on the event so it should all good. After contacting the first sponsor I go down and pick up our gift certificates, they comment about how much they weren't pleased with everyone at Cheezy Flicks, then I contact Becky at Empire labs, they make the “Clone a Willy” and I come to find out she is none too happy with the movie company or Ritchie Bristol who is in charge of the contest. Then I am to contact the radio station for two reasons. One to get a hold of Jeff Allen, he owns the Black Diamond recording studio and host a radio show called Via La Luna on Kufo, we are to be featured on his show and get $10,000.00 in artist development from his studio, plus a possible record label deal with his label. He sets up a time to interview us after Rockfest.

A few days later I try to contact another sponsor from Rose City Music Management, Rick Scott. Rick’s partner Andy Self worked on the production of all the shows for the contest. I was to receive a consultation with Rick and a possible management deal. I noticed at first I wasn’t getting any emails back, so I wrote him and email and said if he wanted off the hook that was fine and I would understand if the band wasn’t his cup of tea so to speak. We finally spoke and he has been none too happy with Cheezy Flicks or the way he was treated and was also having some trouble with Ritchie Bristol. We talked for about an hour and a half and ended up getting along great. He liked the band, he did say it disturbed him, but he thought we were the best band, played the best and had the most interesting show out of all the bands. I spoke to him 5 days before Rockfest. I haven’t spoken to him since writing this.

Rockfest is another part of the prize package, it’s an event put on by KUFO a hard rock station, they seem to be all over the place with what they do and really have a shrinking market share at best. I have never listed to the station before. The prize is this, we are to open Rockfest featuring bands like Godsmack, Sevendust, Shinedown, Puddle of Mudd and so forth. I’m to contact a person named Ditch who is the program director at Kufo. It took Ditch weeks to get back to me, then I’m told I have to contact Bode, he takes about a week to get back to me, then I am told I have to contact this guy Ray from Florida who is the promoter of the show. As the days go by, I have no idea of where we are playing, where we load in or any information at all. I email Bode and Ditch and ask for some information once again. One week before the show I get an email from Bode and it says he will contact me next week, he does 3 days before Rockfest, only to let me know I need to contact the promoter and he will have all my answers for me.

We get together one night before rehearsal and I let everyone know this is all not going so well. I know where this is all headed, since we won a contest put on by a company that traded money for ad space and sponsorship through radio advertising for a show put on by another company, the promoters at the event are going to care less and the radio station has already been paid, upwards of 30,000.00 dollars, so it will most likely be we will just have to stay out of the way and do what we are told and be nice to everyone, easy for us to do.

On Wednesday evening August 25th I get an email from Ray the promoter in Florida and we are to be there by 11 am, on stage for our sound check at 12:00, gates open at noon and we go on from 1:00 – 1:10, we are to be on time and he includes a PDF of a site map. He also asked for a stage plot and crew list for the band. Both of which I had sent to Bode a few weeks ago. I send them off to Ray with some other questions and that’s that. We play our 10 mins and were all good to go.

What’s left is the studio part of the package. It’s 10,000 worth of artist development, which means not much really. I contacted the studio about half way through the stripperband thing and found out rates were at $65.00 per hour, after wards I was told that it was 175.00 per hour.

Jeff Allen contacted me, he owns the studio, the label and is a DJ on KUFO for a show called Via La Luna, he emailed me and said the studio stuff was on hold till he was paid by the person in charge of the Stripperband contest which is Ritchie Bristol. I sent Ritchie the email from Jeff and find out Jeff is to be paid by a venue where the finals were held and his check has been ready since the 2 of August, today is the 1st of September. Ok so if the guy owns a studio, label and is a DJ for KUFO, then you would think he would just take care of it and have us not be part of it. Wrong. So the studio time isn’t happening till this guy gets his 150.00 for Mc’ing the finals.

Finally Ricthie Bristol had arranged us to go into another studio Rex Post here in Portland. I have know the engineer Brent Rodgers for some years . I call and set up a time to meet to talk about the session and we move forward. We come into the studio on a Friday evening at 5 pm,. We record tracks on that Friday and Saturday, doing some mixing on that Sunday. A total of 30 hours are used up with a remaining balnce of 27 hours. It had been figured out that we would have 57 hours total and the company Cheezy Flicks would master the tracks as well.

A week goes by and I call Brent to see how the final mixes are coming along and he informs me that the studio has not been paid and that the owner will not be releasing the tracks to us until the bill is paid in full from Cheezy Flicks. That was around the 26th of November.

The Artist agrees to provide specific songs for placement in “Stripperland the Movie” soundtrack. All songs will be listed in writing from Artist, Cheezy Flicks Entertainment own the non-exclusive rights to use, release and distribute the following song(s) until October 1st, 2011 and Non-exclusive after.

PRODUCT:

Any Songs listed in this agreement, Production, studio work and Consulting done for Artist by Cheezy Flicks Entertainment is the sole property of Cheezy Flicks Entertainment until October 1st , 2011

Mixed and Master copies of the songs will be released to Cheezy Flicks Entertainment. Estimate Release Prior to April 31st, 2011. Copyright and Publishing agreement signed by all parties.

Tony Hughes and Wayne Gacy Trio will receive 5 pts Net per song

Artist reserves the right to distribute the song “Take Your Pants Off ” any in form they see fit with no financial obligation to Cheezy Flicks Entertainment. Cheezy Flicks Entertainment will continue to use, release and distribute after November 1st, 2011 while upholding this original financial agreement indefinitely.

Additional Agreements with Cheezy Flicks Entertainment needed if the original song is changed in any form. This agreement also includes any visual music video made by Producer for the artist to be the sole property of Producer. Cheezy Flicks Entertainment reserves the right to sell the rights to the song “__Take Your Pants Off _” as it sees fit for the financial gain of the Company, Artist, Writers, and Producers while upholding this original agreement without any further agreement.

Tony Hughes and Wayne Gacy Trio _ reserves the right to request all financial records involving the Stripperland soundtrack, and any/all related documents.

Any royalties to be paid out quarterly for the previous quarter earnings.

After trying to contact Ritchie Bristol he finally calls and sends me a contract around the last part of December 2010 to use our music in the movie. The contract isn't well spelled out at all and I call and ask he a couple things, at that point he tells me "I was really baked when I wrote it, so I know it looks all bad, but we can fix it" I tell him I will send a new contract over the 1st of the year and we can get this all worked out, however if the tracks are not paid for and the remaining prizes are not awarded I won't be able to allow or what any music to be used in the film. He says he understands and that the tracks will be paid for and move forward. I did and never heard back about this matter, or see a signed contact, so at that point I was under the impression no music would be used in the film or on the soundtrack.

In January, I contact Brent who works at Rex Post and was our engineer in the studio, and no money has been paid to Rex Post for the recordings and the remaining time has not been booked as the balance will need to be taken care of. The first hours came to 2000.00, I asked if Cheezy Flicks was unable to pay for the tracks what would our cost be, and he called a few days later and said it would be the 2000.00. He then went on to inform me they were working on trade out for printing and when a figure of 500.00 was reached they would release one track to us, and the remaining tracks, 4 & 5 at the same time. and so forth.

A few days go by and Ritchie Bristol sends me an email stating we can do trade out on the balance of the recording time unused in printing. I put together a list of items that we as a band could use. I then get a phone call from Ritchie and he explains that he is at this time unable to do any printing as he had made a deal with Phoenix Media that he would include their logo somewhere in the movie, and that when they had a premier, the owner of Phoenix Media went to see the movie and they had left out his logo and so his deal was off.

The movie premiered on Feb 2nd, we were never sent an invitation and had no idea was being shown. I contacted Ritchie Bristol and informed him we really needed to get this all taken care of,, he began to yell again and started to complain that he didn't have the money to pay for all this and the owner Sean Skelding wanted nothing to do with all this. I informed him, we really should see some kind of sch. for when things would be taken care of and this is what was sent 2 weeks later.

As your previous email, stating you want no part of any of the Stripperland Project,"and you were done" Additionally you stated you wanted to have the Stripperband project concluded ,
before reaching an agreement to be included on the Stripperland Project.

Therefore No agreement could be met, and obligations could not be fulfilled. No Footage, Audio, Depiction of anything containing WGT will be used.

A letter was sent 3 days ago to Black Diamond Studios and awaits a response.

Until other arrangements can be met, fullfilled or found, We will continue to make payments every 30 days assuming that is accepted by Rex ,tracks would hopefully be released every 60 days. Hopefully after 50% of the balance is taken care of all the tracks will be released.

I believe the time clock does not start, at the conclusion of the contest, but rather
over a month after the contest, when it was finally was determined that an alternative
needed to be found to provide the Sponsor Obligated Prize. From this point all communication should be done in email. A progress "report" will be sent to you by me monthly on the progress.

This is the best i can do for now unfortunately, I know we both want this concluded.
I would suspect my dream of conclusion is higher on the priority scale, then it is for you.

I think you may have misunderstood when I said I want no part of the stripperland contest, as we entered, showed up and won, we have indeed been part of you contest with the understanding of what the prizes were and expected, each and everyone of them to be awarded. As for the movie, no updated contract was ever sent over clearing the requested materiel as you promised.

I am sorry you were unable to make this all happen before the film is done and therefore not allowing us the opportunity to be part of the film, but no other compensation has been talked about to amend that portion of the prizes as well as the mastering of the 3 songs or the video, or the video, are you now unable to award those prizes as well? If so I think 3rd party litigation may be in order and if that is something I should pursue please let me know.

What would you like to outline?, what you are now not awarding as prizes?

Please go over the prizes that will be awarded at this point and when those will be taken care of.

Please feel free to email me any and all progress. You have given me 3 different times and or dates that the letter to Black Diamond was sent at this point. I will be open to any and all arrangements that have a timeline attached to.

As for when the prizes should have been awarded it should have been at the conclustion of the contest not 7 months afterward still having your company try to make that happen, which I'm sure wasnt your plan from the start was it. As for never having a meeting and time lines laid out that was by all means a mistake and has allowed for a very unprofessional approach in dealing with these matters.

2 Payments have been made, a third will be made soon and a Track will be delivered. There after is a Tiger Bar Showing of Stripperland, Heaven Forbid that 100 People show up, and I can pay for another track(2) March 1st. There After is a CD Release Party, Heaven forbid that 200 People Show up and I am able to deliver the remaining tracks to you March 18th. (Notice a relation between, you helping me-help you)
After this time we will be selling the CD, 10$ each, I will opt to pay for Rex prior to paying back my investors for the actual Replication and anything else.
Remaining hours
Even thou you turned Down Basset Audio Design as a replacement for the remaining hours. I move forward in trying to find yet another replacement that would deliver tracks Immediately like Basset, without budget.
I can do some of the Printing you requested, but am afraid and being honest that I might run into problems with on time delivery, stating that anything Related to Trade or Event paying Rex takes priority, but that is turned down, and not good enough? Therefore I believe it is at our best interest to put the Remaining Hours on hold, until after at lease 2 of your tracks are delivered and March 18th Cd Release. (FYI- I will secretly work on this anyway in the back ground, but believe it is best for it not to be an item for discussion)

My thoughts and hopes, and dreams is to Finish all this Prior to April 1st so I can move on to other things. This what i have been communicating, and if its not good enough for you, well sorry. It seems that we are back again to where we were weeks ago .

The contract was never sent back to me.

The 1st part of March, we finally meet, in fact this is the first time I had meet with anyone from Cheezy Flicks at all. The meeting was about shooting the video with Ritchie, his assistant and Tyler Benjamin who had something to do with shooting the Stripperland movie. We talk about ideas and dates and I am told by Ritchie the video needs to be done on the 19th of March as the company is busy and many things planned. I agree and then on the 16th I am told we won't be shooting and since that time I have been informed they will be shooting on the 5th of April.

In the middle part of March KUFO announced they were changing formats and Jeff Allen along with the program director and everyone we were involved with have been fired.

On Monday March 28th I started to try to contact Ritchie again and this was sent to me on
March 29th

Two Separate Payments were made to Rex,
You received One track.

Two more Separate payments were made to Rex,
You received your Second Track.

One Payment has been made,
after one more Payment you will receive your 3rd Track.

After You receive your 3rd Track, more payments will be made and you will receive more tracks.

I spoke to Ritchie Bristol about using the song within the film it was with the understanding that all of the prizes from the contest would be fulfilled and then the song would be released for usage in the movie. At this point no contract or agreement has been reached and the DVD of the movie is now being offered at locations through retail and online sales, the film has also been shown at theaters and the soundtrack has been manufactured and is being sold. To date March 30th 2011, one track has been released from Rex Post. The CD of the soundtrack is being duplicated at this moment and is listed on retail web sites for sale through at distribution deal with CDBaby.com, the CD is being duplicated at Cravedog in Portland Oregon. The movie is using the same song "Get Your Pants Off" and is being show at local theaters and is listed for sale through retail web site. The soundtrack is also slated to be available at retail locations such as Best Buys, Borders

On Monday I contacted my friend Hart Fisher in LA and asked for help on the matter. The song being used in the movie was not recorded as part of the prize package and was released back in 2009 on another CD that was paid for by myself. At no point have I been contacted by Sean Skelding, the owner of Cheezy Flicks regarding any of these matters. I have emailed him on 3 different occasions.

This is the email that was sent to Sean Skelding on March 30 2011:

Sean, Ritchie is unable to handle this is a professional manner and its time as the owner of the company you may want to step in. I have included you in a couple emails and have yet to hear from you. I think it's time we figure out how to take care of this and move forward. It's been 7 months since the contest ended and I would like to conclude everything. I'm sorry this has all turned out this way and wish I didn't have to contact you about these matters, but having Ritchie yell on the phone, call you and everyone else names isn't helping anymore.

I contacted my lawyer here in Portland on Thursday 31st of March, he informed me he has had dealing with Sean Skelding and he and his company have many problems with not paying people, doing business in a way that is less than good and he was looking forward to helping with the matter in any way he could.

This is the final email to Ritchie Bristol to allow him to take care of everything

Ritchie,
Neither you nor your company have been able to award the Wayne Gacy
Trio the prizes they won and are owed in a timely fashion, the contest
ended on July 31st of 2010, which was 7 months ago. Since that time we

have been awarded, the gift certificates from Taboo, the clone a

willy's, and one track of the studio, as well as opened Rockfest.

We have had countless conversations with you yelling and blaming

everyone else about all this, you have lied, tried to bully us, been
rude and done anything but be upfront. We have come to a place and
time where we now know we are unable to trust you or your company.

Due to the fact that neither you or I have signed a contract to use

any of our music in the movie or on the soundtrack and you were
informed that until all the tracks and studio time were paid for we
would not be interested in being part of the movie, you now have two
choices in this matter:

1.
By April 4th
All tracks must be paid for - balance of 1500.00
A credit of 1560.00 for us to use in printing from Phoenix Media or
the balance or time at Rex Post for the amount of 24 hours at 65.00
per hour
Send us a signed contract for usage of our music within the movie and soundtrack

2.
Remove our music from the movie Stripperland and the soundtrack.
If the remaining time of the studio and the tracks we have recorded
are not awarded to us within 30 days of today we will be seeking
litigation on these matters.

This should have been handled long ago, you are at this time in
violation of Federal copyright. I think at the cost of 3060.00 to
finish this instead of re-doing everything would be a wise choice, but
at this point that would be up to you and your company. The original

prize was 10,000 in artist development, this is anything but that. We

have meet once since winning the contest, you have been unable to make
every deadline you have set, we have never been contacted by the owner
of the company and your actions have been anything but professional.
You should be thankful that we are giving you the opportunity to make
good on this instead of filing charges against you for false
advertising, breach of contract and violating Federal copyright laws,
however if you are still unable to take care of this, these matters

will move into that direction as we have had enough of you and the way

you do business.

Each band will be allowed 30 minutes total for set up, performance and tear down.(For example: 5 minutes set up; 20 minutes performance; and 5 minutes tear down). Set up and tear down time will overlap with the bands preceding and following your own for less down time.
Note: WE will be responsible for keeping track of their time.The time will be visualized on a clock/countdown timer, that band will be able to see. Judges will also be keeping track for their records. Points will be deducted for playing over the time limit (3pts./1min).
Any band member who appears to be under the influence of alcohol, drugs, or other controlled substance will result in band disqualification. In addition, the person in question will be asked to leave the premises for the remainder of the competition.
