Do your executors know where to find your Will?

If we think about it, it makes perfect sense to store one's Will in a secure facility. We all take care of things that we treasure: we keep our money in the bank or building society, and jewels or other valuables perhaps in a safe, or strongbox at the bank. I know people who keep their passports at the bank. Even things like share certificates and Premium Bonds – which are of course replaceable in the event of loss or damage after the owner's death, unlike a Will - are kept in the proverbial "safe place".

Missing will..?

The difference with your Will is that, if it's lost or damaged after death, your estate might be dealt with under the terms of a previous Will or as if you had died intestate. Consider the case of Margaret Johnson. Margaret was a relatively wealthy and, charmingly, slightly eccentric single lady who had made more than a dozen Wills over the last decade of her life, each revoking the last. As she made each new Will, she was sure to destroy the one she'd written previously. The changes she made were not substantial – mostly modest low value specific legacies to her friends, who changed over the years – and the residuary beneficiaries of her estate (her cousin Susan, with whom she lived, and an animal charity) remained unchanged throughout her testamentary career.

When Margaret died, her last Will could not be found – nobody had a clue where it could be. Her cousin Susan didn't know where Margaret had kept her previous Wills but was convinced that she had been remembered in her last Will, because Margaret had always said so, and Susan's Will, stored with Kings Court, left her estate to Margaret should she survive her, based on the cousins' commitment to each other. Susan was of course deeply concerned. If Margaret's estate were to be distributed as on her intestacy, it would be her brother and her nephew and niece (her late sister's children) who would inherit – Susan didn't know them that well and Margaret had never really got along with them and had not left them anything in her Will. The risk to Susan was that she could end up being made homeless – just because Margaret's Will could not be found. Had Margaret's Will been stored in a secure facility, this situation would simply never have arisen.

Intestacy..?

When Margaret's brother took steps to apply for a Grant of Letters of Administration to her estate, in order to administer it in favour of himself and his and Margaret's nephew and niece, Susan became resigned to her fate. She asked a friend if her son, Derek, in his 40s, would be kind enough to come and help her clear some boxes from the loft of the home she'd shared with Margaret for thirty years. Margaret had always been in and out of the loft but Susan was slightly infirm and Derek, who had often done odd jobs for the cousins, was happy to help. As he was moving boxes of books, mementoes of long forgotten holidays and other ephemera, he came across what looked like an old bathroom cabinet, with a mirrored front. He moved some of the boxes around it out of the way and opened the cabinet door. Inside were three shelves, each bearing nine empty Marmite jars (Margaret had been keen on the stuff – Susan couldn't bear it). Behind the jars on the middle shelf was an envelope. In the envelope was Margaret's last Will.

Fortunately for him, Margaret's brother had incurred very little expense in his efforts to apply for Letters of Administration to her estate – he'd had a few conversations with his solicitor and little else – and he was, naturally, completely out of the picture as far as the distribution of Margaret's estate was concerned.

Safety first

The moral of the story is, of course, that one's Will should be kept in a safe place. Margaret's slight eccentricity had informed her choice of perhaps-too-safe a place – had she discussed it with Susan (or anyone else...) they would surely have suggested that the best thing for all concerned would have been to keep her Will in somewhere safer than behind some empty Marmite jars in an old bathroom cabinet in her loft and to let people know where it was.

Heather Bateman had to run the family finances after an accident left her husband in a coma; and thanks to the Court of Protection, three years of pain and misery followed

I shake as a large white envelope slips through the letterbox. My trembling fingers pull at the flap. I'm a grown woman with a family. I have done nothing wrong yet these letters make me feel like a criminal or a helpless child. The letters are from the Court of Protection.

Never heard of it? Lucky you. I hadn’t heard of it either until the moment when my whole life fell apart. In September 2003 my husband Michael walked across a quiet country road towards me and was hit by a car. He fell to the ground and never stood up or spoke a word again. In hospital he collapsed into a coma. The three-year nightmare began.

As well as experiencing the horror of seeing the energetic man I had loved for more than 30 years rendered immobile and lifeless, I had to deal with the everyday aspects of having a large family of two children, four stepchildren and six step-grandchildren. And I had to deal with the Court of Protection.

Michael and I were two independent working people. We had been married for 28 years. We had written our wills, both our names were on the deeds of the house we shared in London and the Norfolk cottage we had renovated over the years. We had separate bank accounts and most of the bills were paid from Michael's account. Now, to continue living in the way we always had done, I needed to access the money in his account.

Michael had been moved to the Intensive Care Unit at Addenbrooke's Hospital in Cambridge. "You need to get the right forms," the man at the Citizen's Advice Bureau at the hospital told me. "Where do I get the forms?" I asked. "From a solicitor," he replied. "There are plenty of solicitors in Cambridge."

I was in shock. I had witnessed the accident. I had seen the car knock Michael to the ground and I had held his hand and talked to him on the horrendous journey to the hospital. For as long as possible, I put off getting the forms.

The solicitor’s office I chose was Dickensian. The clerk, almost as ancient as the decor, handed me some forms and said, "Fill these in and get your husband to sign here."

I burst into tears, the first I had shed since the accident. And, once I started crying, I couldn't stop. The clerk looked at me uncomprehendingly.

"He can't sign," I sobbed. "He's in a coma."

"Then you need the Court of Protection," he said. I heard those words for the first time, words that represent an institution everyone should know about.

The Court of Protection brought me almost as much anger, grief and frustration into my life as the accident itself. Over the years that followed Michael's accident, I had to learn to accept a new reality, to settle into a different way of life. This I did gradually, lovingly, in my own way, feeling my energy and life-force change and keeping the family together.

But parallel to this I had to come to terms with the Court of Protection, an alien, intrusive, time-consuming and costly institution, which was completely out of tune with what we were going through. For almost three years it ruled my waking moments and my many sleepless nights.

We are advised to take out this insurance and that insurance but hardly anybody tells us to take out an Enduring Power of Attorney, which enables a person to appoint another to manage their financial affairs when they may be unable to act for themselves. Yet, in a case like ours, this is the only way to avoid the Court of Protection, also known as the Public Guardianship Office.

Here are just a few examples of how the Court acted under the guise of "protecting" my husband:

On the day the letter arrived confirming I had been appointed as Michael's Official Receiver another letter arrived demanding instant payment of £460; it threw me into a state of shock. Later, I was told this bill should have arrived a month later. However, this was just the first of many fees to be paid to the Court. They include a commencement fee (£240) and an appointment fee (£315), an administration fee (ranging from £190 to £240), an account fee (£100), various transaction fees (ranging from £60 to £540) and a winding-up fee (£290). To deal with the forms and additional accounts, I needed the help of an accountant, whose fees also had to be paid. Over the course of two and a half years, more than £3,000 was used up on the Court of Protection.

As Michael's Receiver I now had access to our accounts. But I was dismayed by the restrictions on my spending. I could write as many cheques as necessary up to £500. But if I needed to access more than that at any one time, I had to get permission from the Court – even to pay our daughter's university fees and accommodation. Similarly, when I needed building work done, I had to submit two estimates and justify my choice of builder; I then had to wait several weeks for the Court to give permission and release the funds.

The nerve-racking experience was exacerbated by the fact that each time I phoned the Court, I spoke to a different clerk. I had to explain my distressing situation anew and then wait at least two weeks for a reply. I visited Michael daily. The court also sent a representative to visit him. I found it humiliating. I was dealing with doctors, nurses and carers on a daily basis yet I could not help feeling that I was the one being checked up on.

But the most distressing incident concerned a strip of land in front of our Norfolk cottage. Before the accident, the local council had approached us to build a public footpath on it. The work was carried out while Michael was in a coma. But when it came to finalising the deeds and paying the agreed compensation, my role as Receiver was apparently insufficient. I was informed that the only way forward was to make someone else a trustee to the deeds of the cottage. The costs were almost equal to Michael's share of the compensation.

I was furious. If it weren't for the footpath, we would not have been in Norfolk that day and Michael would not have been hit by a car and would not now be in a coma. We had gone there to discuss the council's plans. Overwhelmed and intimidated by the Court, furious and exhausted, I eventually asked the council to keep the compensation money until Michael either died or recovered.

The Court of Protection, no doubt, has a part to play in the life of someone with no close family or friends, who is at the mercy of strangers. But in our case it was an interfering, terrifying body using legal forms and archaic language to protect itself at huge cost to us.

After almost three years, Michael died. When I eventually received probate, I cried with grief. A few months later, when I finally closed the Receiver's account, and my independence and self-respect returned, I cried with joy. At last I was free.

Yet all this could have been avoided - if only I'd known how.

Long Term Care Fees

In the UK nearly a million people were living in nursing, residential or long-term hospital care in 2005. The cost of caring for the growing army of pensioners is predicted to soar to nearly £30 billion by the year 2030. Women have a one-in-four chance of needing long term care, and men a one-in-six chance.

Whilst the government will pay those costs relating to nursing or medical care (the time spent by a nurse with the patient etc.), the individual is liable for the costs of residential and personal care, often called social care, which is means-tested.

If you have assets up to £23,250 you have to pay a contribution to social care costs. If you have assets over £23,250, you have to pay all social care costs.

These costs are likely to amount to £20,000 - £50,000 per year or more. However, the family home will be disregarded as part of that person's assets if it is occupied by a partner or other qualifying person, which means that the local authority will not include the value of the house when assessing the person's ability to pay care fees.

If a person has to go into care, then under the Health and Social Services and Social Security Adjudications Act 1983, local authorities can charge residential care fees to (ie. run up a bill against) that person's home. After that person's death, the local authority would normally expect the person's representatives to sell the property to pay the care costs. Furthermore, as a last resort a local authority can sell the deceased's property - if it obtains a court order - in order to meet the charge (or bill).

Your home could be under real threat if you have to go into care and your partner has already passed away. Liberal Democrat MP Paul Burstow estimated that 70,000 homes are sold each year (200 per day) to pay for care fees, meaning that the relatives of those people will not now be able to inherit the family home or the proceeds from the sale of the property.

In effect, if one of you dies and the surviving partner has to go into care, this can amount to a 100% tax on your estate above £23,250.

Therefore, to do nothing could be the equivalent of bequeathing your home to the local authority rather than to your family.

And a Solution?

The Property Protection Trust Will is particularly suitable for married, unmarried and same sex couples (who own their home) in the following circumstances:

Mature couples concerned about losing their home to pay for care fees
Couples where one or both partners have children from previous relationships
Couples who individually wish to ensure the inheritance of their children (or others) without forcing their partner to sell their home
Couples where there is a significant age difference between partners

MAKING A WILL is the only way to ensure that your wishes are carried out after your death. If you have not made these arrangements in a Will, the Courts will decide on the future of your children, and it may not be what you would have wished.

IF YOU are retired maybe you made a Will a long time ago. It probably needs updating to take into account things that have happened since; to avoid it possibly being Contested, or to put in place provision to reduce your inheritance tax liability.

Making your Will

Your Will needs to be understood by your Executors and most importantly, The Probate Court, to ensure that it is proved. The Consultants job is to take your instructions to create a document which accurately reflects your needs and wishes. You need to supply full names, addresses and telephone numbers for anyone you write into your Will.

There are some important questions which you need to consider before the meeting with a Consultant. By having many of the answers available it will leave more time to discuss the other important issues which may arise during the consultation:

The Appointment of Executors – Executors will deal with your estate after death. Ideally you should appoint 2, and where possible use family members (over 18 years). Where there is the likelihood of a Trust arising it may be best to appoint other 'professionals' to act as an executor or trustee of your estate.

The Appointment of Guardians - Only if you have minor children (under the age of18years) will you need to appoint guardians. It may be helpful to make at least one guardian a joint executor; they do have a right to money from your estate to help towards the cost of bringing up your children. If you wish to restrict the amount to which they are entitled, it may be wise to leave the money in trust, again your consultant will be able to advise on the suitability of such a scheme. If you have disabled children who are likely to require specialist care either at home or in the care of the Local Authority, a trust will be required to ensure that adequate funds are available for their future.

Setting up Trusts within a Will can be extremely valuable in Estate Planning for a number of different reasons.

When it comes to protecting assets and controlling the distribution of your Estate, Trusts are essential and Will Writers UK can provide a variety of different solutions depending upon your objectives.

The Elderly, the Disabled and the Infirm

Will Writers UK will always attend a client meeting with the view that the individual has sufficient mental ability or capacity to understand the topics to be discussed. If however it becomes evident that the individual is under stress, or is struggling to gain sufficient understanding to make an informed decision the Will Writer will suspend the meeting, and advice the need to involve others to assist the client.

It is New Leaf's policy to always recommend that family or friends are present and involved at all client meetings irrespective of the clients age, marital status or situation.

Prices

Our prices are extremely competitive even though we do provide high quality and personally tailored services to meet individual needs. As such you will find that Newleaf advisers do not offer a fixed price tariff, but prices are generally very similar. That said, individual advisers are always willing to propose solutions which accommodate their clients' available budgets and timescales. It is always our practice to agree our prices and payment method clearly in advance by way of a Letter of Engagement. Once agreed our prices are fixed and without hidden extras, and your adviser will standby that price, provided all relevant and pertinent information has been disclosed.

Payment

We always aim to be as helpful as possible but if we are to continue offering such competitive prices we must insist, as a minimum on a 50% deposit on agreement of work to be done, and the balance upon completion of the documentation. Payment of the deposit implies acceptance of our terms.

Changing tenancy - a change for the good?

Many couples believe they own 50% of their property each, and so upon death want to leave their half to their partner in their Will. In fact, the majority of homes are actually owned as 'Joint Tenants', which effectively means each partner owns 100%. So when one partner dies the surviving partner automatically becomes the sole owner. That may sound okay at first, but it leaves you no choice to whom you leave your share in your Will, as your partner will automatically inherit the property.

It is possible, however, to own a specified percentage of the property and this is known as 'Tenants in Common' Although typically it would be on a 50/50 basis, it does not have to be this way.

Each 'Tenant in Common' is entitled to leave their share of the property to whomever they wish in their Will.

What is the benefit of "tenants in common"?

If you wanted to avoid your share of the property, after your death, from being lost to your partner's new spouse, or swallowed up in expensive care fees, you can leave your half of the property directly to your children, but you would have to be a 'Tenant in Common' to achieve this.

Making the change

Making the change from Joint Tenancy to Tenants in Common is a fairly a straightforward procedure and is a service that Will Writers UK provide. You will also be pleased to know that changing the way you own your property does not affect a mortgage* or your ability to sell the property. (*it is worth noting that some equity release providers will not accept tenants in common, but this is changing)
