My Birthday is this month and the other day, I received an e-mail coupon from “Name withheld” ‘s Pizza, a local pizza place for a free Birthday Entree (see below). I mean, they’re known as a pizza place and pizza is a part of their name (see the mostly grayed out logo in the upper right of the coupon, I put a red circle around the word pizza in the logo). I’m looking forward to some free pizza for my birthday. That is, until I read the disclaimer and get to the last line “Not valid on pizza.” (Once again, I circled it in red near the center of the coupon).

So already I think this is a bad deal…But does this stop me from getting a free meal? Uh-uh, No, no, no, no, no. So I go in last night, a little later than the dinner rush because I’m by myself and don’t want to deal with the wait.

I get there and the host greets me and asks how many, I say one, he says go ahead and sit anywhere you want. I choose an area with not too many people and they all look like they’re near the end of their time in the restaurant. The host brings my menu and says my server will be right with me. Standard later in the evening restaurant stuff.

My server comes to the table and gets my drink order (a Mountain Dew, I know you were dying to know that), then gives me a minute to look over the menu. My server comes back and I order my entree.

“Would you like Soup or Salad?”

“Ah”, I think to myself, “This is better than I first thought it would be.”

“What’s the soup?”

“There’s Minestrone, French Onion or Chicken Tortilla.”

Not being one to rush into a decision, I pause for a few seconds.

“I think I’ll have the chicken tortilla.”

And off my server goes to put in my order and get my soup. My server returns pretty quickly with my cup of soup and a packet of crackers on the saucer, which strikes me as odd, but I don’t give it much thought.

Then I taste the soup and it’s pretty good and that’s when I notice there are no tortilla strips in the soup. Maybe they were put in the bottom of the cup before the soup, so I dig in the cup to the point that I’m practically shaving off ceramic I’m scraping the cup so hard and still, no tortillas. They must have run out of tortilla strips, that’s why they gave me the crackers. So I wait for my server to come back.

“How was the soup?”

“It was good…” And my server was gone with the cup before I could start the next sentence only to return almost immediately with a new table setting for my entrée. “But I have a question about the soup. Shouldn’t it have had some tortilla with it?”

“Oh, that’s just the name. I told them we should probably change it to chicken enchilada soup or something like that.”

“O, o-okay”

Now I start to see a pattern. Just because it’s in the name, that doesn’t mean I’m going to get it. And that’s when it hits me. This could be the perfect night. The night when everything was so wrong it was right. By this time everyone on my side of the dining room was gone, so the only way I could see, or hear anyone was if they were walking toward me and I see their reflection in the windows across from me or I get up and walk to the other part of the restaurant. I’m all by myself, literally and figuratively. But I’m also excited.  I mean the anticipation is building. You see, I’m hoping that there’s something essential missing from my entrée. In fact, I know there’s something missing and with no one around me, the anticipation is just magnified. It’s to the point that I’m so excited that time seems to stop because there’s no way it took as long as it seemed for that entrée to get to me. And just when it was to the point that I was exactly like every Wolf you’ve ever seen in a cartoon with a knife in one hand, a fork in the other, the napkin tucked into his collar, mouth wide open with his tongue lolling out one side and drooling up a storm that out of the corner of my eye, I saw it.  The reflection of the dish in the hand of my server. There was no one else that it could be for. I saw my server turn the corner and I knew that dish was for me and I knew that it was missing something, I KNEW it!

My server put that dish down in front of me and you know what? You know WHAT?!

There was both chicken AND parmesan in my Chicken Parmesan.

My heart sank. This had the promise to be one of my top five story of stories. I had the terrible trifecta in my grasp and it slipped through my fingers. I was beyond disappointed.

And the food? Well, the food was okay, it was good. Not as good as their…pizza.

Which is what they’re known for. And I couldn’t have.

For my Free Birthday entrée…

…Because I’m a valued customer.

Alex, I’d like clues for 1000.

One last thing. My server got a little more than 25% tip on what the bill would have been if the entrée hadn’t been free. Hey, good personal service is still good service. And another part of the reason was for being able to say “Oh, that’s just the name.” with a straight face.

Well, I had something to give away and it was the Eats Paste EP from Toy Block Music which is available throught the website starting 1 April. And don’t forget that a portion of the proceeds from the sale of the EP go to Pager to help with infant reflux disease.

But before I drew and announced the winner (yes, delayed gratification is the keyword here) I did a follow up with some additional information from last week’s show, regarding ReverbNation,  Audiolife (ReverbNation’s  partner in the Reverb Store)  and CD Baby.

This episode of With A Voice Like This is a very special interview with Joanna Quargnali-Linsley of Toy Block Music and Misery Loves Co. about the March 4th preview of the EP Eats Paste to be released April 1st of this year.

Joanna tells us about the overall project and how it came about, how the charity Pager was chosen to receive a portion of the profits from the sale of the EP and some of the different experiences. This episode of With A Voice Like This is all about the New Music Seminar that was held in Chicago on October 6, 2009 and it’s founder Tom Silverman. I’d like to thank Ariel Hyatt of Ariel Publicity and CyberPR for providing me with the opportunity talk with Tom Silverman during the Seminar.

I’m presenting the interview in its entirety in the show because I think it’s very important to hear it directly from Tom, but there are quality issues with the audio. Because of that, I have transcribed the interview and put it here in the show notes or you can download the transcript of the Interview in PDF format so you have it as you listen. There’s a lot of great information there, I hope you enjoy the interview as much as I did.

Transcript of the Interview with Tom Silverman

Jim Goodrich: I’m here with Tom Silverman, the founder of Tommy Boy Records and the New Music Seminar. First, I wanted to thank you for taking the time to talk with me. You started the New Music Seminars back in the Eighties and then for awhile it was dormant for about fifteen years or so, is that correct?

Tom Silverman: Exactly.

JG: What was the compelling factor to bring the New Music Seminars back?

TS: They…Just had a revelation about where the business was going and where the business wasn’t going and I thought it was time for us to do something about it, so that we can have a forum to discuss this. I go to so many conferences around the world and nobody’s talking about what we talk about here. Nobody’s talking about what’s going to happen next, nobody’s talking about what artists need to do and how artists can help establish themselves in this difficult world. Uh, everyone’s talking about label problems and label problems are almost irrelevant.

JG: Then the basic reason you’re doing this is you’re seeing it move more toward the DIY side, the Do It Yourself side. Is there going to be a place for a crossover, or do you see the labels becoming completely irrelevant and so you have to become your own everything, basically?

TS: No, I don’t think artists are going to be able to become their own everything just [be]cause recording, writing songs, recording and you know, touring and blogging and tweeting and the other things that artists have to do are all they can possibly do. I think that somebody has to handle all of the other stuff and it’s a long list of other things and that could be a manager, it could be a label or it could be services company, you can call it whatever you want to call it, but somebody has to do that. It could be ten different companies that do all the ten different things or it could be one company that calls themselves a label, but a label has to do, will have to do different things than they do now.

They’ll have to be involved in helping to develop and manage the relationship between artists and their fans and helping them best monetize that. And in exchange for that, they’ll get a share of that monetization depending on what deal they cut. Based on where the artist starts, you know and where they are in their career would depend on what that deal is. And the concept of how those deals will evolve is just in its infancy now because nobody’s even thinking that way. Everything is still album centric.

JG: I would think that you would feel that this is what the New Music Seminars is all about. How do you see this progressing, its role in doing this? Right now it seems to be that the role of New Music Seminars is to get people talking about it. Do you see the New Music Seminars growing into even more than that?

TS: Yes. I would like to think so, but I think we’re still a little ways away from it. As we get a little bit more clarity and all, and we get a little bit more momentum, they could turn into a lot more than that. They can actually turn into an active force for helping find the artists most on the verge of breaking. I believe there’s probably hundreds of artists that are stuck in the glut of releases, the hundred and five thousand albums that come out every year that can’t break through, even though they’re deservant of it. I believe there are Elvis’ and Beatles’ that are being stuck, that can’t get through because there’s not…The economic engine that used to go find them is going away, so nobody’s really looking there anymore and nobody’s helping pull those artists out, but…And some of those artists are getting somewhere with Pitchfork and other things on the web to a certain level, but they need help going beyond that and there’s nobody really there to help them. So we want to be, um, ones to help them and hopefully we can put together new technologies and, and new economic models that will help artists break out of that glut and break through.

It’s the great failure of the Internet; everybody talks about the Internet as the greatest things for artists and for consumers because it’s so democratic, anyone can put a record out able to make a record now. So, you know this year there will probably be a hundred and twenty thousand, up from a hundred and five thousand, up from seventy nine [thousand] the year before, up from twenty two thousand in 1992. So, where are we going with this? They predict three hundred thousand releases a year, like books. You know, that’s not necessarily a good thing for consumers. Especially with seventeen thousand of the albums that came out last year only sold one copy. Seventy thousand of them didn’t sell a hundred copies. So you’re really talking about um, a noise floor of just, you know, insects and gnats that may mean nothing, but still get in the way of legitimate artists from breaking through.

Once an artist gets beyond ten thousand and only two hundred did that last year for the first time or less, um, then they’re in a little different environment because there’re so few that get there. So now you’re only amongst a small group of two hundred. And some of them go on to sell half a million and some of them maybe only go on to sell twelve thousand. But even if they sell twelve thousand and they do all the things we’re talking about here to monetize their fan relationship, they can earn a great living. So all…Anybody who gets beyond ten thousand albums in this day and age can um, can quit their day job and you know, be rescued from the sea of obscurity. But, you can even be uh, quit your day job below ten thousand, we talked about some examples today of artists who don’t even sell that many, but are able to monetize their fan relationship enough that they can do this full time.

JG: From the, the seminar that we had today here in Chicago, what do you think is the top one or two takeaways that the people who’ve been attending should really come away with from here?

TS: Well, there’s two kinds of people that attend, there’s artists and then there’s all the people who serve the artists. As I said in the beginning, artists serve fans and everyone else serves the artists. So, the people…From the artists, they have to understand that it’s not going to happen by itself and that quantum events, uh, hoping that they’re going to win the lottery is probably not a good strategy. Putting together a strategic approach to growing their business and looking at what they do as a business, to find and build fans and differentiate themselves from the competition, identify ways that they become successful, in redefining their success, that’s what they can come away with. A new definition of success, a different paradigm for what the business, what business means today.

And then for the people on the other side, the business side, they have to look at the new paradigm too. How can we better serve the artist community in a world where we’re not record-centric anymore. Records may be part of it, but that part is going to diminish and however we monetize music, or don’t monetize music, we monetize fan relationships, so how do we do that? You know and what’s the meaning of a song in that world. Everything changes, so it’s so really hard when you come from a past mentality, almost everybody that’s in it worked at a record company before or has, brings baggage with them, mental baggage that they have to release. And the seminar is about trying to knock them out of that baggage and change the new paradigm. And it’s so funny, you talk with all these artists about this and then at the end of the day, they all come up and give me CDs to try to get me to sign them again anyways. [laughter] It’s a, it’s an interesting thing.

JG: To sort of bring this two together, you talked about the Internet and being more democratic, but not being everything that, that they need, so it’s not just the Internet, it’s not just the old school, the legacy system that’s been there, is it an amalgamation of all this?

TS: It’s not the Internet for two reasons. One, it creates more noise and two, it…People use the Internet as a filter to not hear anything they don’t want to hear and only hear the things they’re comfortable with. Whereas traditional Radio, people had to hear music they didn’t like the first spin, the second spin and then it grew on them. Nobody ever lets music grow on them on the Web, because if you don’t like it in twenty seconds, bang! You’re on to the next thing. See the Atlantic Monthly article from last year Does Google Make Us Stupid? It’s, you know with, you know, our time span is shorter.

I mean, I like to have a discussion with creative panelists “what about making songs, an album of songs that are ninety second long”? Let’s say “Okay, here’s a new genre, it’s like haiku for songs”. You know, you have ninety seconds to make your statement. Which is great because I could listen to ten times more songs that are ninety seconds long than are five minutes long. And I want to listen to a lot of songs. And guess what? If I like the ninety second songs maybe then I’ll buy the four minute version. And for four minutes maybe I’ll pay, maybe I should pay ninety-nine cents for an iTunes download of my ninety second song. If you want the four ninety-nine…You know four minute version you have to pay you know, $2.99 for that version. If you want the album it’s $9.99, you know? We can have all different pricing models. Or, it may all be free anyway. Maybe we give away the ninety second version and let them buy the four minute version.

Really, people don’t have that much time anymore; they’re used to getting things fast. You know, we talked about it in one of the Movements about a, a Flash intro. Nobody waits for a Flash intro. You see a Flash intro, if you can’t skip it, you even leave. It’s too late. So, you know, people want to get to the point and want to get there fast, you know. Google has taught us we have to find what we want and we get ‘X’ amount of keystrokes in ‘X’ amount of seconds to get there. If we don’t get there, we’re on to something else. So you know we have to make it quicker, we have to make it easier for people to buy music from you, for people to discover music. That’s something that the technology side has to improve. They have to be able to uh, do better uh, search. They have to do better uh, affinity engines, ways uh, you know uh, ways to, to track consumers’ tastes. We were talking about “scrobbling” earlier. So, Technology has their assignment, artists have their assignment and the music business that serves the artists has their assignment.

And we talk about all three of those areas here at the seminar. And we do it in a positive way uh, not trying to point fingers or complain, but we say this is the work that we have to do. And these are the opportunities because the people who get it right, whether they be artists or, or music business people, or technology people, they’ll become very rich. If they get it right.

• A few minor (but important) victories for YouTube in their class action suit  charging them with copyright infringement as seen in the cnet article. This doesn’t affect the Viacomm suit suit brought against YouTube directly, but does clear some of the infringement claims made.
• A Revisit to the Usenet issue. A member of the Podcast Gallery alerted me to the fact that AT&T was shutting off access to Usenet from their services on or around July 15 in this CrunchGear article. While in my opinion the article makes use of a little fact and a lot of fertilizer, it does let you know what’s happening with Usenet.

The National Association of Broadcasters (NAB) is the main proponent against the passage of this Act. I’ve seen articles calling this a ‘performance tax’ implying (and I think I’m being generous here by saying implying) that the money goes to the government, to the argument that it’s free advertisement for the performer. I’m just going to draw a straight comparison to broadcast television. Any performer on television, be it in a commercial, movie or television show, gets paid whenever their performance is broadcast, no matter how much they got paid for the initial performance. It’s called a residual and for that matter, voiceover artists that do commercials on radio get residuals as well. I wonder what SAG or AFTRA would have to say if broadcast TV tried to not pay residuals saying it was free advertising for the performers.

That’s just one part… the next part is the breakdown of payout. Based on the segment of episode 096 of With A Voice Like This at the 06:44 minute mark the payout would be 50% for the master owner (read record label) and 50% split between main performer and session musicians (45% for the main performer and 5% split between the session musicians was quoted in the show). Well, no wonder the RIAA backs this ACT, their cut is 1% shy of controlling interest payout. Not all Master owners are major labels, Alice Peacock is an independent artist and her own record label, so it benefits different people in different ways, but the question then becomes what’s the percentage of indie labels vs. major labels played on terrestrial radio. It does beg the question of what’s fair for the performers. Are performers a disparate group like a child first learning about money and just as likely to take four nickels instead of two quarters because four is more than two? Because afterall, something is better than nothing at all.

Come to think of it, who does handle the royalty payouts? Wouldn’t it seem a natural fit for pre-existing Performance Rights Organizations (PROs) like ASCAP and BMI to expand their current charter and duties to handle that? Maybe, but instead a new single entity, Sound Exchange was created for Digital Royalties, including all performance royalties under this Act. At the 25:59 minute mark of episode 096, Sound Exchange seems to be doing a great job of finding that information and tracking down performers, but unlike ASCAP and BMI and even SESAC, Sound Exchange collects all Digital Royalties regardless of whether or not a performer is registered with or a member of Sound Exchange. In episode 048 with Samantha Murphy at the 08:05 minute mark, Sound Exchange has some strong ties to the RIAA, but despite that, there’s the question of what happens to the collected royalties that aren’t paid out, because the performer isn’t registered or a member of Sound exchange, deceased performers where no heirs can be identified or performers from countries that don’t have reciprocal agreements with Sound Exchange? Does that money just revert back to Sound Exchange and is that the best that can be done? If it’s collected without registration or membership, why isn’t it paid out under the same conditions?

With Technology so far ahead of an dated protection mechanism like the current copyright laws that are so desparately in need of an overhaul, is saying HR 848 is not perfect, but better than it is now enough or should we expect more?  I don’t know, what do you think?

This episode’s guests were Paul Natkin, Interim Executive Director and Dan Lurie, Member of the Board of Directors of the Chicago Music Commission and is about the latest version of the proposed Event Promoter Ordinance as discussed in their March 3 Press Release and blog post. As stated in the show itself, this is not necessarily the final version of the Ordinance to be taken to the City Council for a vote, nor has there been a date set for the vote. …Why White Space gives me a headache

If you’re a musician or a speaker, or an actor, or a presenter and you use a wireless microphone system or wireless personal monitors (in ear) or a wireless guitar pickup and you don’t know whether or not it operates in the 700 MHz spectrum (698 – 806 MHz to be exact), you need to. You need to stop what you’re doing and check. You see, manufacturers aren’t making those systems in that range anymore and sooner rather than later, using that spectrum will be considered illegal. I know, tough language and a bit dramatic, but a real issue. The FCC has reallocated that spectrum and wireless systems won’t be allowed. And to make matters even more confusing to the little guy, it’s all based on Broadcast Television channels, channels 52 – 69. Take a listen.

So what do we do about it? If you have a professional sound person, most likely, nothing, they’ve got it handled. But if you don’t, that’s what this episode of With A Voice Like This is all about.

I’ll tell what I know of him, which isn’t much, but more than I knew most of my life because it just wasn’t a subject the family talked about. His name was Burdett, but they called him Bubs or Bubsy. He flew a P-38 Lightning for the 459th Squadron of the Army Air Force in WWII in Burma or Myanmar (that’s my Uncle with the pointer in his hand).

He was shot down and captured and was taken to a prisoner of war camp. He died there from dysentery and other digestive system issues within weeks of the camp being liberated. But the hardest, most life changing event for the family was that the plane that carried his remains crashed in Burma and haven’t been found to this day, though the search goes on through the Defense Prisoner of War/Missing Personnel Office (DPMO).

What I knew most was there was a machete in a black leather sheath with a smaller knife that fit on top of the sheath in my parent’s bedroom closet and a huge silver ring with this insignia on it in blue and red glass on the dresser that were my Uncle’s. The insignia reminded me of Captain America, even though it wasn’t round. The ring was a big, heavy kind of ring that would leave a mark on the jaw of the bad guy who got hit by it and meant power to boy and his daydreams. That was cool and that’s what I knew…That and the fact we rarely, if ever talked about him. Being the youngest child of the youngest child, and my Dad was over a decade younger than his nearest sibling, I never gave it a second thought. That’s just how it was.

A few years ago, that changed.  Some family survivors of others on that same plane went to the DPMO and started getting attention about the situation. And in the long run more information came out, including the pictures you see here and a lot of clarification of information. But more than that, I got a scan of a letter my Uncle wrote his wife the night before his first mission, in his own hand. It speaks far more eloquently and with a sense of urgency to a soldier’s plight than anything I could write. This  episode is a quick recap of just a few things that happened today and a little earlier in the week. It was a head-spinning day, so here’s what I talked about:
