I have signed a contract with a roofing company stating that they will be the contractors to replace my damaged from hail roof. I have signed the contract because the company promised me that they would pull a permit with the city and that they will provide me with a copy of the company workers compensation insurance. Now they are refusing to pull the permit and are threating us to court if we do not let them do the work. It is unlawful to replace a roof without a permit, can they sue me?</p>

My uncle got injured on the job   around 1030 pm at night he didnt go to the  emergency room until 930 pm the next night.. his back got  strained pretty bad he couldnt  bend over  and now the insurance  doesnt want to pay the bill since they said  he didnt fill the workers compensation with in 24 hours of the injury . Even though  the owner knew before hand 24 hours but  is the insurance company just scaring  him? And how long does he have to file  in the state of CA for workers compensation.></p>

<p><i>Answer by mbrcatz</i><br/>He is supposed to notify his supervisor, who has three days to notify the insurance company.</p>
<p>He needs to tell the insurance company, that they need to decline the claim in writing as soon as possible, so he can hire a lawyer and fight it.    He needs that written declination.  I have a feeling they won&#8217;t give it to him, as he DID notify the supervisor.</p>

We own a couple horses and a barn where we teach lessons. </p>
<p>I hire 5-6 employees over the summer time who help out and give lessons. </p>
<p>In August, we had 12 students on the property when 2 of the young male students started physically fighting with eachother. </p>
<p>One of my employees was present during the fight, and tried to stop the more aggressive boy from injuring the other boy. Then 2 of the other students aided her and untimately broke up the fight. </p>
<p>I was called at the office a few hundred yards away and told what was happening, and I immediately called the police. </p>
<p>The police took about 45 minutes to get to the barn, and by that time the boy who started the fight left on his own, and the boy who was injured was picked up by his parents. </p>
<p>The boy who got beaten up is very grateful to my employee who stopped the fight, however the boy who was doing the beating, and his parents are threatening to sue us because they claim the employee who tried to stop the fight was also acting violently against him.<br />
They claim the fight went to the gound between him and the employee, and he was defending himself because she was attacking him from behind, and toutching his private parts. </p>
<p>She admits to having tried to pull him off the other boy from behind, and also says she did in fact squeeze his testicles, at which time he stopped fighting, lost his balance and went to the ground, but she said she did NOT continue fighting with him after that.  </p>
<p>I wasn&#8217;t there, and the only people who were, are people who are involved. </p>
<p>I have never been in this situation, have any of you, and what are the possibilities here?</p>

<p><i>Answer by Señor Sñark</i><br/>Make sure you collect statements from all your employees and the other boy who was involved. If you&#8217;re confident about what happened, tell the parents to bring it on. Remind them that if you lose any business as a result of their punk child&#8217;s actions, like if the other child has to cancel a lesson because he&#8217;s injured, you could sue them for damages.</p>

I had a back injury at work. the mri shows bulging disks, stenosis, and something with bone hardening. I have numbness and tingling in both toes with outer side tingling on the right foot. The right calf also (on the outer part) and nerve pain and muscle weakness in the first and second toe of the right foot. It&#8221;s workers comp claim and i have asked for a mylogram to rule out and damage to the nerve but they say its not related. the neurologist stated the abnomalalities are more sensory and would have anything to do with the injury. I disagree. and now after a year am still trying to just figure out whats wrong with my foot.</p>

A friend of mine was diagnosed with Occupational Asthma resulting from becoming allergic to mice and guinea pigs which he works with on a daily basis in a laboratory setting.. This asthma was a direct result of his job and 2 doctors agree with this&#8230; Both doctors have written letters stating that he can no longer work with these animals because of risk of long term lung disease.. no other treatment options are available.<br />
His company&#8217;s occupational health and hr departments have not been particularly helpful or informative other than suggesting FMLA leave.<br />
What are his rights? Can or should he take Family Medical Leave (FMLA).. Workers Comp? Anyone with similar issues? Could be terminated?<br />

<p><i>Answer by Susan S</i><br/>He should leave the job and go on medical disability temporarily, or else unemployment insurance benefits, and look for another job. Having the doctor write a letter to the employer could be helpful.</p>

I have 3 or 4 bulging disks in my lower spine and can&#8217;t do much without pain. The mediation was supposed to happen in the morning but my attorney tried to call it off or postpone it based on they&#8217;ve &#8216;overpaid&#8217; my benefits by 100 dollars a week and wants to settle before they notice. So they first offered 3500 to which was basically laughed at. how much should I settle for? I&#8217;m now 23 and have never dealt with anything like this before. My attorny will be calling me back shortly what would be a realistic number I can give him??</p>
