A New Turn in Entertainment Industry

Throughout the years the Entertainment Industry has evolved into one of the most prominent working environments. It has interconnected globally through digital platforms and is currently a highly dynamic industry with numerous avenues of production. It is the industry that is known for putting on the big show. Described by many as an environment of mass media, the entertainment industry consists of the performing arts, film, gaming, music, comedy, radio, and theatre. Even though the fluctuation in the economy has affected global industries, in 2012 advertising media moved from $427.0 billion to $449.0 billion. That is an increase of 22 billion within one year.

“Global advertising media revenues were projected to be $427.0 billion in 2011, growing further to $449.0 billion in 2012, according to Magna Global, a unit of advertising agency leader Interpublic Group.” (2012, Plunkett Research, Ltd.)

The Entertainment Industry from its expansion in online media has developed other markets to expand and engage in international trading and outsourcing. It is through these expansions that have allowed for an increase in the global advertising media. Today, these expansions consist of broadband Internet for homeowners and businesses. This also includes the vast growth in mobile Internet devices and services. It is stated that the greatest factor for the Entertainment Industry is the millions of Internet subscribers. It is because of this factor that allowed the Entertainment Industry to have a new turn of opportunity for entrepreneurs and start-businesses. The online segment gives a larger mass market and a chance for a more competitive advantage. Thus, more and more companies are taking heed and advantage because they realize customers are becoming extremely acclimated to the Internet. It was stated that in 2011, the Internet advertising industry grew to $31.8 billion and is projected to steadily increase in years to come.

The Entertainment Industry will continue to rapidly change and evolve throughout the years. Because of this continuous growth and development there will always be great potential and opportunity in the Entertainment Industry.

A degree in Entertainment Business opens many doors for a business entrepreneur or individual who is just interested in the entertainment industry. There are career opportunities in: Artist Management, Artist Relations, Music/Record producer, Creative Services, Film/TV Producer, and the list goes on. The degree program itself educates the individual about an industry that is extremely lucrative and always changing. Because of technology and consumer wants, the entertainment industry operates like a business within a business. The industry is the most sought after that people would want to work in and also provides to the individual a chance to function on both sides of operation. In the world of entertainment business there are two sides of operation, business and creative. A degree in music business but more importantly entertainment business, allows one to understand both operations and how they are interconnected. With the entertainment industry being so vast and broad, a degree in this program offers understanding in various areas such as: Entertainment Law, Business Planning, Finance, Management, and Intellectual Property. Each of these business areas plays a critical part in the entertainment industry. In addition, in what scholastic program would a person learn how to manage or promote innovation, creativity, and art? An Entertainment Business Degree is one of the few programs that teach how to sell and produce something you love and make it unique. It is extremely hard to put a price to passion and it is harder working in a business that has great reward and huge risks. However, the opportunities are endless in this field. Ilans Music blog post stated,

“The successful creation of an entertainment product can make people happy and it can have a significant cultural effect. Working in the entertainment industry can enable you to play a part in the creation of products that you will hear people talking about and which you can feel proud to have been a part of.”

I found this statement to be extremely powerful. It explains an individual being more than a regular “8 – 5 worker.” He or she is uniquely diverse and is able to participate in something that may only occur once. These are the people in the entertainment industry that allow us to document moments such as the creation of the iPhone or Michael Phelps winning 22 Olympic medals.

The techniques and research information I have obtained throughout this Full Sail quest has been one of a kind. There has never been an occasion where I have been given the opportunity to learn so much in depth knowledge about the Entertainment Industry. Full Sail University has given me insight about: researching website demographics, SEO, learning how to properly prepare a Business Plan, and establishing yourself in the Entertainment Industry. In understanding and applying these concepts I will be able to better assist my company’s (You in Music, Inc.) economical growth in the Entertainment Industry.

Businesses and organizations that now operate in 2012 must function as a WEB based and be able to use social media networks to communicate and reach their target audience. Companies must now be able to compete by driving their target market to their website. Using search engine optimization allows business to manage and monitor their online presence in their industry. You in Music, Inc. will focus its marketing efforts on using social networks such as: Facebook, Twitter, LinkedIn, and YouTube. These networks will not only provide correspondence with potential and current customers, but also allow the company to better assist its target market.

You in Music, Inc. will also use Alexa.com. This resource allows the company to optimize its web trafficking and gage competitor companies. Alexa.com gives an overview of what tactics are being used to attract attention to a website. The resource also gives a snapshot of how many companies or businesses that are performing better globally and why they are to maintain a certain number visitors. In addition, Alexa.com also tells a company how many and what type of a visitors view a website. It gives the picture of whether the visitor was bounced to the website, spent several minutes on the website, and an idea of what pages were viewed the most.

You in Music, Inc. will also research thoroughly its industry. It is very important to know where and what you want to do. Through proper research comes through planning and preparation of a Business Plan. The business plan should have a projection of at least 3 years and outline in detail its management, business structure, and how it will aim to finance its products and services.

For this blog post, I decided to analyze Maureen Burke and Robert Kibble. The two individuals are experts in the field of examining business plans and giving financial advice to major businesses and entrepreneurs around the globe. Both individuals have earned prestigious positions professionally in education and business.

Maureen Burke is a faculty advisor at Yale School of Management and throughout her career has 20 years' experience in entrepreneurship and finance. She obtained her MBA in finance from Yale School of Management where she uses her degree as a lecturer at the Yale School of Forestry and Environmental Studies and consultant for clients such as: Johnson & Johnson Development Corporation and Conti Enterprises, Inc. just to name a few. Throughout her professional career she has written business plans and consulted for numerous industries that evolve around technology, environment, and medicine.

“Since graduating from SOM in 1997, her focus has been advising entrepreneurs and technology-based start-up companies. Robert Kibble was a former Director of the National Venture Capital Association and currently represents Mission’s leadership role. In addition, He has worked as a founding General Partner of Paragon Venture Partners for a period of thirteen years as well as serving as Vice President of Citicorp’s Merchant and Citicorp Venture Capital. His career has taken him in several markets working in Wall Street, banking, and business analysis. He has a Master’s Degree from the Darden School, University of Virginia.

After looking at the biography of the two experts chosen in business plan analysis, we now examine the key components that investors and experts that analyze business plans, are looking for. They examine information in the following order: Executive Summary; Financials; Management; Exit Plan, and Terms of Deals. These five areas are crucial because they are the most commonly asked questions. Most importantly the three areas that must spark an interest in the reader are the Executive Summary, Financials, and Management. In addition, these key components spell out exactly what the business is and what it is capable of.

Some of the major key players in the entertainment industry that have already fully engaged in the usages of mobile devices are: Apple, AT & T, Android, Blackberry, Motorola Droid, and Vodafone just to name a few. These major companies have not only lead how entertainment is distributed to consumers, but have also altered and changed the consumer purchasing habit. Watch Out Here Comes XBOX

When we look at the achievements and accomplishments of the XBOX, we see that the counsel is one of the leading counsels in the gaming and entertainment industry. The Xbox is listed in the top 3 gaming systems in the world: Xbox 360, Play Station, and Nintendo Wii. In the year 2013 and years to come, there is big talk about video games, television, and business focusing more on On-live and streaming systems. Just as we are able to analyze how Apple, Inc., affected the music industry Microsoft is now on the verge in following in the very same footstep. Apple, Inc. had introduced iTunes, the iPod, and the use of Mp3 files on mobile devices. This development caused record labels and consumers to rethink how music was produced, distributed, and consumed. Thus in the article 3 Ways the Next Xbox Could Change the Entertainment Industry Microsoft is engaging to focus on the areas of: Streaming TV, Television with a built-in gaming system, and having no use for used games. This means that the home entertainment would be more focused on live time experiences just as how the most watched TV programs are now reality shows.

The article states that Microsoft through the use of the Xbox is working on building partnerships with Disney’s ESPN 3 channel, Verizon, and Comcast. The device would then be operational as how consumers are now able to use Netflix through their cable provider. Microsoft has already established a partnership with News Corp. of which offers Fox, Fox News, and the Wall Street Journal to the game counsel. In addition, through the use of streaming games would create a differentiation of sales with most distributors. For example when looking at GameStop, one of the world’s largest retailers for used games, it was stated that 50% of the company’s profit comes from used-game sales. “Retailers like GameStop (NYSE:GME) have built empires on reselling games—used game sales accounted for nearly 50% of GameStop’s profits, $292 million in its second quarter alone—while publishers and console makers like Microsoft never see a dime” (Anthony John Agnello, 2012). Thus we see that with changes in the gaming industry or “Xbox” will have a spiral affect in the entertainment industry. Home entertainment and major retailers that are involved in the gaming industry are all going to be affected as more and more company’s follow in the direction of Microsoft to compete.

What’s To Come of Publishing in 2012!

The predictions are in for the year 2012. Looking at the past and present of print media, the industry is on an upward rise of e-books, self-publishers, price fluctuation, and major publishers making evasive changes. In looking at an article by Laura Hazard Owen, the author depicts the print industry as one that will be lead by digital formats. The author illustrates this concept by showing how consumers in the future will be more reluctant to focus on the quality of e-books and that their would be more innovative and proactive self-publishers.

“I hope we’ll see self-published authors experimenting with pricing as well, and pricing books higher in some cases. Ultimately, I’ll use the q-word here: I hope that readers will see the value of paying more for books of higher quality-books that are shaping the conversation, books that they want to read again and share with others-in digital formats.” (Laura Hazard Owen, 2011)

Another article by Jeremy Greenfield also describes the print industry in the future to come as one that will have an abundance of self-publishers using digital formats. It is said that the industry will turn to have more tech savvy workers such as app developers, e-book designers, and minimizing the sales and marketing departments. This is because with digital formats, the product is now easier to go through in-house production and distribution. For example online distributors such as Amazon and Barnes & Noble online presence are changing the way authors and writers look for distribution. This change in distribution will also cause major publishers to loose sale revenue in print publication. This is because as one side changes in infrastructure and production it creates a cause and effect to revenue sales. Mike Shatzkin, book-industry expert, stated, “Print sales are going to decline and e-book sales are going to rise and that is going to result in organizational changes.” In addition, Greenfield makes mention of flexibility in contractual agreements between authors and publishers. It is stated, that a flexible contract would allow authors to earn more financial reward for the intellectual property. David Weinberger, a senior researcher at Harvard’s Berkman Center for Internet & Society, an Internet research lab, stated “As the social and reputational value of works’ presence on the web increases, authors will become more frustrated that works are tied up by copyright licenses that cease to bring them any more financial reward.”

These predictions about the print industry are great opportunities for authors and self-publishers. Production costs are going to continue to decrease because of operational changes. In return authors and self-publishers will have more control of pricing for e-books or digital formats of print media. These changes will also force major publishers to change the standard of how a book must be presented. The advancement of technology has made the years to come and exciting time for the print industry.

An overview of the article: Advantages & Disadvantages of Self-publishing

When looking at print media in the year 2012, there are more self-publishers prevalent than there was years ago. This means there are more resources available and support in the publishing industry. As a self-publisher an author or writer has the ability to work at his or her own pace, total production is under the authors’ or writers’ control, and there are no contractual stipulations that concern royalties or exclusive rights. These advantages allow a self-publisher to compete against major publisher companies. The majority major publishing companies are not able to make evasive changes in production as of a self-publisher. In addition, major publishing companies are more reluctant to make the common flaws of redundancy than self-publishers. Self-publishers are mostly innovative, free of restrictions, and able to maneuverer easily through multiple formats. Studies have also shown that with the support of print-on-demand (POD) and social media, self-publishers are able to market and distribute more efficiently than that of a major publishing company.

Subsequently, one major challenge for self-publishers is credibility. In an article on Lulu blog, it speaks of how self-publishers have a hard time distributing their product in storefront companies. “It is difficult to get shelf space in a brick-and-mortar store like Barnes & Noble if you self-publish” (Nick, 2009). “Some people still stigmatize self-publishers” (Nick, 2009). This article illustrates that even though there are great advantages of self-publishing, that there are still some challenges that prevent mass growth.

Three (3) podcast examples on protecting Intellectual Property

The podcast examples that are chosen are giving tips on protecting domain names and prevention of copyright infringement. Our first podcast example is “Oprah gests sued for publicizing author’s work.” Podcast Episode 15 (http://www.entertainmentlawupdate.com/page/6/) The example speaks of global recognized Oprah Winfrey being sued by Charles Harris, a book author. The copyright infringement is over a booklet Mr. Harris wrote entitled, How America Elects Her President. This literary work was granted registration in 2000. In 2008, Mr. Harris requested Oprah Winfrey to endorse the product on the Oprah Winfrey Show. In addition, Mr. Harris also mailed 10 copies of the literary work to Oprah Winfrey. Subsequently, a receipt of arrival of the 10 copies was never given to Mr. Harris. The filed 2010 court order illustrates that Mr. Harris wanted Oprah Winfrey to use the literary work in the, at the time, Senator Obama’s campaign.

The podcast states that on February 2009, media mogul Oprah Winfrey, on the Oprah Winfrey Show, read or dictated questions directly from the booklet How America Elects Her Presidents of which is registered by Charles Harris. Mr. Harris was not given reference or credit as the author of the booklet during the discussion on the show. In a disagreement, the podcast states that the literary work seems to have been used in a sense of fair use. This position is also what the attorneys defending Oprah Winfrey are stating. In addition, there is the discussion that you are not able to plagiarize if you speak information that is not yours, but there is a copyright infringement if what is stated is not referenced or credited by the author. This case has not yet been resolved, but illustrates the importance of receiving a certificate of registration for literary works. In addition, this podcast example brings to the attention a very important fact in intellectual property. Always cite, reference, or give credit to intellectual property that is owned by another.

The second podcast is regarding a UDRP domain name issue with the franchise chain Taco Bell. “Taco Bell domain name issue.” Podcast Episode 8 (http://www.entertainmentlawupdate.com/page/8/) It is stated that Taco Bell in an add campaign used the slogan or trademark name “DriveThruDiet.com.” It is stated that Yum! Brands, the parent of Taco Bell, purchased a valid registration of the trademark DriveThruDiet.com. The dispute is that the company Georgia Weight Loss Center registered a similar trademark name DriveThroughDiet.com. Yum! Brands, was then pursuing to have the trademark by Georgia Weight Loss Center assigned over, claiming UDRP bad faith or cybersquatting. But in the podcast discussion it was stated that Taco Bell had not used the registered trademark until 2009. In addition, there is not enough evidence that shows Georgia Weight Loss Center using the trademark DriveThroughDiet.com in bad faith or to infringe against Yum! Brands (Taco Bell). Both companies are distinctively dissimilar. In this case, Taco Bell tried to claim that they had first use. However, Georgia Weight Loss Center registered the trademark DriveThroughDiet.com in 2007 and Yum! Brand (Taco Bell) acclaimed their trademark in 2008. Yum! Brands was denied request of transfer and will probably try to buy out the company for the use of the trademark DriveThroughDiet.com.

The third and last podcast is on “Photo Credit removal is DMCA breach.” Podcast Episode 22 (http://www.entertainmentlawupdate.com/page/3/) The case is between Peter Murphy and Millennium Radio Group, LLC. It is stated that the photographer, Peter Murphy, took a picture of two guys posing nude at a radio station for a magazine out of New Jersey. The picture was then taken or scanned from the magazine by the radio station, altered with the gutter credit being removed, and then allowed to be altered again by viewers using a photo image software. This act created a 1202 DMCA breach. A trial judge who dismissed the case first heard the case and stated it was fair use. However, the third circuit stated that it was an act of copyright infringement because of the removal of the gutter credit. It was stated that the gutter credit was the copyright seal of the photograph. The listed link (http://www.ca3.uscourts.gov/opinarch/102163p.pdf) gives the summary judgment between Peter Murphy and Millennium Radio Group, LLC.

The podcast examples are keen tips and concerns one must take into consideration when starting a business, registering a domain name, or using intellectual property. It is very important that credit is given at all times when dealing with intellectual property. In each of these cases there is an illustration of how minute or subtle of an alteration to a pre-existing intellectual property can create a cause infringement or arbitration.

2012 Intellectual Property Lawsuits

The three articles I chose to research and speak about are: “Trayvon Trademark? An ATL Debate,” “Fake Filesharing Lawsuits? Dang, That’s Devious,” and “Kenny Rogers accuses Capitol Records of failing to account for digital music sales.” I chose these recent articles because they speak of aspects that are needed for a startup business.

The first article is a trademark filling for Trayvon Martin. His mother secured the application for “I Am Trayvon Martin” and “Justice for Trayvon.” I found this to be very interesting and wise as a mother who has lost her son. Though the circumstance of Martins’ shooting ended with his death, his case has received national attention and is creating a movement amongst African-Americans and people of different race. In the article “Trayvon Trademark? An ATL Debate,” the trademark is described as a great strategy of preserving the memory of her son and preventing random people or companies from profiting off of his death. This action means a lot in the business field or Entertainment Industry because one of the first steps once a name is established or logo is established; is to have it trademarked so that its likeness is protected. Even though this case intention was not geared towards profitable gain, it provided a great lesson in understanding that what is unique should be protected.

The second article “Fake Filesharing Lawsuits? Dang, That’s Devious” expounds on a copyright infringement. The case alluded to how individuals are using false copyright lawsuits to impact the Entertainment Industry. This problem is rapidly growing and creating distrust in the Music Business. Just as piracy continues, this is another aspect that individuals are now using to get over the Entertainment Industry. It was stated that as the federal government ceased the site Megaupload in January, that a fake law firm began emailing people “…claiming there could be financial implications for those who used file-sharing site Megaupload for infringing activities. For the past several days a fake law firm claiming to act on behalf of entertainment companies such as Universal, Sony, EMI and Paramount has been claiming cash settlements from innocent victims.” This is a very interesting case because it shows how important it is to pay attention to details. Artist Kenny Rogers filed a complaint to defendant Capitol Records, LLC a division of EMI Music North America, LLC. The copyright infringement is concerning the case of the defendant not paying proper amount of royalties from the licensing of master recordings. “This action for breach of contract, breach of the duty of good faith, and fair dealing, unfair competition, an accounting, and a declaratory judgment against Capitol Records arises from Capitol Records‟ willful and knowing failure to properly account to and pay Kenny Rogers royalties, pursuant to written agreements, with respect to certain master recordings (the “Masters”) of the musical performances by Kenny Rogers.” He is requesting that Capitol Records pay an amount that equals up to 50% of their net royalties. It seems that from his first agreement in 1975 and the affidavit in 1977 with some of his greatest hits such as “The Gambler” and “Lady,” the record company was not properly paying out royalties. An audit request was asked from Kenny Rogers to Capitol Records on April 17, 2007 however, the company had refused to solicit “…cash receipts from all digital download and ringtone licensees during the [e]xamination [p]eriod.” In a preliminary audit it showed that Capitol Records was in underpayments of up to $400,000.00. This case just shows the importance to copyrighting intellectual property and ensuring to have clerical support.

Can Music Businesses Earn A Living in 2012, With The Lack of CD Sales?

I was searching on the web and stumbled across a video interview that speaks about the Music Industry in 2012. The interview was on Pat Bishop who is Director of the Entertainment Business Program at Full Sail University. She gives great detail about how the Music Industry could not be more striving and open for growth in the industry. The world is consistently being enhanced by entertainment and music. She mentions how students at Full Sail University are being prepped to enter the Music Industry as an artist, manager, utilizing music in the booming Gaming Industry, Publishing, Online or Digital presence and other areas.

So when I looked at the question to myself, is it possible for me as a Jazz musician to earn a healthy living even though CD or record sales or low. The answer is an astounding YES. The old business model showed that musicians or music entrepreneurs earned their revenue from record sales, publishing, merchandise and concerts. Now because of technology and the popularity and need for entertainment, there are numerous ways of bringing in income. Pat Bishop gives several examples. She speaks of the company Music Today strives and has attained sustainability because they provide services to the Music Industry in several different areas. Each area requiring either musicians like myself or business workers to operate the specific functions such as managing fan websites, building social networks or enhancing the digital presence and sound of an artist.

In addition, it was quite interesting to hear that today’s musician does not need a record label anymore to “Have Made It.” Studies have shown that numerous companies such as sports networks, TV programs, Radio shows and even the Gaming Industry need new music to enhance their product and brand. So is their hope for an artist or musician to earn a living, YES. The only thing is, we now have to think outside the box and look at the different industries that music is now affecting and enter into those markets.

When we talk about the music scene in the year 2012, some may say that it is on a down hill slope. However, it is just the reverse for independent artist. This could not be a more-better time for an independent artist to strive for their goals in the Music Industry. Statistics show that more than ever social networks have aided in the support of indie artists just as Major Record labels. A indie artist is able to appeal to management in the music industry because there fan base through social networks have enhanced their exposure, help artist work on their existing image, allowed indie artist to stay connected in trends, and the ability to create a name through less financial expense.

In addition, it depends on what city specifically an independent artist is currently focusing his or her career in the music industry. An article in Digital News gives statistics on the top 15 cities.

2011 was the year the song Nobody Greater took force on Gospel airways and networks. Vashawn Mitchell’s 2010 album Triumphant earned a total of six (6) Stellar Awards. The EMI Gospel artist was highly promoted on the star search shows Untapped and BET’s Sunday’s Best. EMI’s marketing team ensured that the song Nobody Greater would catapult his career.

Their steps began in October 2011, showcasing Vashawn Mitchell on TV shows, where the marketing team was prepared to release the deluxe edition of the 2010 album Triumphant. The package consisted of a CD/DVD, in addition to two new songs, My Worship is For Real and My Source. There was also an attached in depth interview of Vashawn Mitchell that spoke of his many accomplishments of obtaining a record deal with EMI, Grammy Nomination, and the privilege of being mentored and working and ministering with Bishop Larry T. Trotter.

Throughout his career, he has worked with Lonnie Hunter as an assistant music director and Minister of Music under Bishop Larry T. Trotter. As a songwriter, he has composed songs for Vanessa Bell Armstrong, Bishop Paul Morton, and Smokie Norful. He has been known to top Billboard Gospel chart where on April 5, 005, he peaked at number 26. In analyzing the tactics of Netflix, Inc. in their marketing strategy, we see that the company has made joint ventures to expanding the product. The article states that Netflix signed an agreement with CBS to expand their television network. This development will increase their number of active users and allow them to remain a competitive force in the market. Their aim is to convert their mail in clients to streaming clients and establish a working network between all Cable TV programming. Currently the company has a joint venture between Lions Gate Entertainment Corp., Warner Bros., CBS, AMC Networks, and Sony Pictures Entertainment. It is stated that the only challenge is with the exclusive rights. Netflix is limited or restricted to the launch date of allowing customers to utilize the products or titles within the joint venture. “The new deals with Netflix appear to have tighter restrictions such as when they can first be shown, for example. In The CW pact, older-season episodes of some shows, including "One Tree Hill" and "Nikita", will available Oct. 15 while others are set for January.” (Yinka Adegoke 2011). However, such restrictions are not deterring the company’s continuous growth in financial stability.

From analyzing the information given, we see how the company Netflix has used the Liquidity Ratio (examining its leverage over Cable TV), Quick Ratio (examining its liabilities – Example is the launch restrictions), and Probability Ratio. Most importantly it is through the Probability Ratio that the company Netflix is able to determine how well it is operating within the market; enable the company to keep track of product/service sales of the publication and being able to determine the ratio of people converting from DVD’s to online streaming. As an independent artist and the CEO of a music publication for independent artist and Music Business professionals, I found this article to be very inspiring. Even though this company (Only Much Louder) and industry is in a different country, the growth and downfall in the Music Industry may be compared to the industry in the Unite States. The company is setup as a one-stop shop. Only Much Louder provides services for concerts and festivals; it is a booking agency for independent artist and record label. When one analyzes the company Only Much Louder, we look at what the company has done for the country of India and how it differentiates its brand from others.

For example: Only Much Louder hosted the first music festival in India. The company has established itself as being the only music organization to focus on independent artist and the non-Bollywood sector in India.

“What differentiates us is that we’ve always focused on the non-Bollywood sector in India and that’s a pretty hard thing to do. Plus we’ve never really been limited to any genre; it’s just been about anything that’s independent, good, live, very flexible.” (Vijay Nair, 2010)

The company focused its aim entirely on empowering independent artists, musicians, and agents from being trapped by major record labels. One of the most innovative tactics used by Only Much Louder was the ability to increase CD sales. During the year 1999-2000, the company had burned 200 CD’s for sale and had started to encourage consumers to burn the CD’s themselves. Subsequently, this being a new idea to consumers of India had actually enforced consumers in buying the album.

“We took a lot of pride in that. And the more we asked people to do that, the more people ended up buying the album, which was really strange. We did the first two hundred albums like that, but we were actually mass-printing albums after that. We did about eight to ten thousand copies by the end of the year.” (Vijay Nair, 2010)

Another factor is that India being a larger market, allowed for greater potential. When compared to other markets in foreign countries, we see that India uses music mainly for the Film Industry. Ninety percent of all music made was put into film. This very same idea is what Only Much Louder focused on. The company used the fact that the film industry was dominant, and decided to capitalize on two or three percent of which was the independent music industry.

As we analyze the company Only Much Louder we can see it used the Law of Contraction (focusing entirely on a particular market) and the Law of Singularity (staying geared towards the independent music industry).

I hope to see my company You in Music begin to grow in the very sme business structure here in the Bahamas and United States as Only Much Louder was able to capitalize on the market in India.

The RIAA Involvement & Impact on The Music Industry

My association of choice is the Recording Industry Association of America (RIAA). In analyzing the RIAA, we first have to examine the history of the association. This association is a trade organization that supports and promotes the creativity and financial validity of major music companies. The members of the association consist of record labels. There primary objective is to create, manufacture, and disseminate music globally. As stated by the RIAA, the association currently operates 85% of all legal/copyrighted work in the United States.

In addition, the RIAA aims to protect intellectual property. The company protects against piracy of any recorded material or music. As stated by the RIAA, “because of the substantial losses to the recording industry as the result of piracy, the RIAA worked closely with the FBI to develop a new government seal and warning for placement on copyrighted music products in order to increase anti-piracy awareness”. Through protecting the rights of recorded music, the RIAA also operates through the First Amendment of the constitution. As stated in the constitution, “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances." – (First Amendment, December 15, 1791).

There are numerous more areas of which the RIAA operates in education, manufacturing/distribution, anti-piracy, and protection of artistic rights in music. For instance everyone is familiar with the infamous logo created through the RIAA – Parental Advisory Explicit Content.

The logo allows for consumers to better monitor legalized recorded material associated with minors or adolescents. In addition, it protects artists and record labels or companies associated with the Music Industry. The RIAA also provides vital information for those in the Music Industry about legal services such as: iTunes, Pandora, Rhapsody, YouTube, Napster, and many more. It is stated that there are more than 13 million legal tracks online. It is through the involvement & impact of the RIAA that record labels, artists, and music distributors are able to stay connected with their consumers and the Music Industry. In addition, the RIAA allows these vary same individuals access to searchable data of Gold & Platinum music. The RIAA has truly been aiding the Music Industry since 1952.

I recently attended a music forum, which included a showcase and lecture, at the Maxwell House Hotel, Nashville, TN on Friday, October 28^th, 2011 where professor and Jazz guitarist Stan Lassiter wowed the audience with his amazing technique and skill in music. He played a piece from one of his last performances Labyrinth from Roy’s Simplicity [http://wn.com/roysterbass7]. His style is one that is truly unique and defined. "Stan Lassiter is not only considered Nashville's premier jazz guitarist, his reputation now marks him as among the most accomplished young jazz pickers in the country." Guitar Magazine

He explained the different styles and how they related in the piece of music. It was quite interesting to have an explanation after watching the performance. He said that what also helps is that part of the psyche from passed experienced is accessed whiles playing which helps in performing fusion jazz. After watching such a performance I could tell that I was not the only listener who was truly satisfied and in awe.

So I asked Mr. Lassiter, being classified as Nashville’s premiere Jazz guitarist how did he get started in music? He stated that t began from watching his uncle and brother’s play. His first musical instrument was the trumpet, where at a very young age he was able to play a set with the Allman Brothers, he was 17 at the time. His career is one that has allowed him to tour the world playing Jazz-fusion and classical Jazz.

He stated that in order to be pleasing to someone, one must first recognize where their passion is derived from, the “Who am I.” He calls it the quest of finding, the invisible. “I use music as movement and feel…the mystery of it all keeps me moving, and when it stops being mysterious it then takes bravery to make the CHANGE.” Stan Lassiter

Well for one, they are one of the main innovators of promoting urban music in Nashville, TN. In short it is a high quality entertainment that utilizes live bands, poetry, visual arts, and other forms of artistic expressions. Their goal is to cultivate urban artists and make a positive change in the Nashville entertainment scene. Throughout Nashville, TN, locals know of the name LOVENOISE. So what Mr. Eric Holt did was take eight years of operation and publicity and put it to use in a new venture of distribution for the company. “Founded eight years ago by Eric Holt, Chip Hockett, Antoine Nunn and Bryce Page, Lovenoise has carved a niche within the Nashville music community — a cornerstone of our burgeoning urban arts community.”

Mr. Eric Holt stated that through analysis of the Nashville urban music market, he realized that there were not a lot of venues for “Hip-hop music”. This gave birth to a new idea. The company had already created an evolution of promoting urban music in Nashville, TN and now it has geared to provide distribution in more forums. Studies show that over time the music industry has taken a huge turn towards technology. From the birth of Napster, which created, the shift in control and accessibility of recorded music, to now the ability of being able to stream music. The Internet has truly become a bittersweet answer to the digital music distribution. Through great access and availability, the Internet has created a devastating problem of piracy. Through federal reports by the RIAA, it has been stated that for the past 15 years there has been a downslide or dwindle on Return On Investment. In addition, not only has the increase in piracy taken financial strain on the recording industry but as well as major search engines that utilize the streaming of music. Major search engines had to result in paying artists millions of dollars as a back payment of streaming copy written material.

Another major threat of social streaming is the major cooperation, Apple Inc. Through its innovative products, Apple has become one the most powerful players in the Music Industry. Through the use of the iPod & iTunes there sales in 2007 were stated to be 2 billion songs. With such power and control traditional retailers (giants of the trade) were finding it hard to compete with an online distribution.

Another factor is that online distribution eliminates overhead production. It is easier to execute and compete when you don’t have to worry about physical promotion, packaging, shipment, etc. In the past the average consumer would have to pay $10.00 - $20.00 for a single or album. But now a consumer is able purchase a single at the cost of $.99. Such changes empowers’ the artist and consumer, which causes the record label to be seen as inferior.

However, through all factors piracy remains to be the major concern. Streaming is the most used source for the consumption of digital recorded music through online networks, search engines, and social networks.

With the growth in technology and the rapid constant change in the music industry, releasing and recording music has become easier than never before. Before artists aimed to simply have their song played on the radio to make it in the music industry. However, now because of the instant demand of the consumer or listening audience an artist must now think of numerous ways of broadcasting. The advantage is that because of technology independent artists can now be more empowered with the use of social media and online distribution. Artist can use distribution systems such as press on demand, not having to worry about the big overhead cost in producing in bulk. In addition, the turnover time of a product is almost instant which allows the consumer or listening audience to be received immediately after tours, concerts, or showcases. This allows an independent artist to be more flexible and aim for a distribution deal instead of a record deal. Why such a drastic change in concept? What independent artists have found today is that the more you are able to control in the social market, the more strength you have in distribution. Subsequently, there is still the pitfall that mass promotion or production may not be achieved without a major record deal or being signed by a record label. But through operating through the social media and online distribution, an independent artist is more able to sustain and maintain a fan base, which gives the artist more leverage when approached by a Major Record Label.

Tell us about where you are from and how you got to this position today?

I was born and raised in Nashville, Tennessee. I started modeling and acting at the age of three. I was inspired to write my first song at the age of 9 when my grandfather died. It was such a traumatic and painful experience for me because he was my idol. So, I decided to put my feelings on paper and Roger Ryan (Grammy nominated) producer, helped me lyrically turn it into a song. After that my mom and I teamed up with Roger Ryan and CEO of Hitman Records Inc. C. Michael Brae out of San Francisco and learned the business. During this period they invested in me, and helped me complete my freshman album. I’m now working on my sophomore album.

Tell us about one of the hardest challenges you had to face in the industry?

Wow!!! That’s a good question…. One of the hardest challenges I’ve had to face was not having the support from some of the closest people around me. In this business everything cost, nothing is free. You give up and sacrifice a lot to have a great project and to have great people on your project. My mom has single handedly financially supported me in this industry. I owe it to her to do nothing less than my best.

What suggestions do you have for other artists like yourself? 

The one thing that I would suggest is keep your faith!!!!! You have to be a believer in yourself for people to believe in you. This business can rip you apart if you let it, and people can bring you down. You just have to be smart and position yourself around the right people, and that might mean to eliminate people in your circle that might not have your best interest in mind. As my granddad says, “sometimes old friends are like old coats you have to get rid of an old coat that you’ve grown out of and get you a new one every now and then”.

What are the best ways to sell your products as an artist?

The best way to sell your product is understanding product placement. If I only sell my CD at the venue where I just performed, I only limit my sales to just a few. But if I have distribution I can sell my music all over the world. The more stores that I distribute my music in the more accessible my music is to buy. I just didn’t want digital download distribution I also wanted physical distribution. That’s why I have distribution through Hitman Records Inc. I have distribution like any major artist signed to any major label. I also sell my download cards after my performances because that gives me the opportunity to have my sales reported to soundscan. One thing artists don’t understand clearly is radio. I have learned that if you don’t have distribution radio will NOT play your music! If listeners want to buy your song you have to have a store of some kind, it’s the professional side of the business. I’ve also learned from my PR consultant, Ingrid Fletcher, that first you have to understand that you are the product. That people are buying YOU (the product), if they are spending money to purchase your product (your music) then remember you are a walking advertisement of your product (YOU ARE THE BRAND). So, always remember to represent your product at its best.

What is one of your favorite ways to promote yourself and your music? 

Wow!!!! That’s funny because I promote myself everywhere I go. If I’m in the barbershop I break out in a song and the whole shop is singing with me. When I’m at the grocery store, at a party, picking up a pizza I’m singing. But on the real, I really make an effort to use every situation possible as a promotional opportunity. One thing I can say is that my computer is my best friend when it comes to promotions. I use Facebook, MySpace, Jango, YouTube, Twitter, Yahoo and my websites www.quintonmarcel.com and www.hitmanrecords.com. I love talking to my fans; my fans are my biggest promoters and supporters period. I still use traditional forms of promotions. With the right budget, I do include media buys on radio in my marketing mix for advertising my new releases.

Steve Jobs – An Innovator Who Revolutionized The Way We Consume Music

“Industry watchers called Jobs a master innovator -- perhaps on a par with Thomas Edison -- changing the worlds of computing, recorded music and communications.” – ABC News

Steve Jobs died Wednesday at age 56 (1955-2011). He was a man who was a leader in innovation. One in particular is the change and affect he had on the music or entertainment industry. With the creation of the iPod and the arrival of its companion iTunes in 2001, Jobs had transpired human conception towards the consumption of music. This one combination changed the way we consumed music, exacerbated the demise of both the compact disc and the brick-and-mortar record store, revolutionized the music business, and massively disrupted the major labels' dominance in the marketplace.

No one was able to create that signature elegance and ease of use that Jobs brought to his version of the portable digital-music device. His understanding of what the future consumer wanted always surpassed their expectation. From the iconic rotating wheel, simple scrolling menus and clean design of the first iPod, to later iterations such as the miniature Shuffle and the finger-swiping iPod Touch, Jobs pushed his design team to ever-greater heights of innovation. The iPod became the hot commodity that was seen everywhere. It was a device that revolutionized the MP3 player and became ubiquitous on college campuses and subway trains and in gyms.

In February 2010, the iTunes Store had legally sold 10 billion songs while revolutionizing the way every new generation buys, interacts with and experiences music. Though piracy is still evident, through Jobs innovation he has trained a constantly wired generation to legally download music on their iPads, iPhones and a myriad of other devices.

Independent Artists Using Social Networks For Marketing

In the independent music industry it is important to market your new music in as many places as possible. Typically the independent artist would market themselves on social media networks like Myspace.com, ReverbNation, Sound Click, etc. But in todays market those networks are already saturated with other independent artists doing the exact same thing. Chances are there are hundreds of artists who have been doing it longer than you, have more resources and time to put into it and have already built a following.

However, social media has also allowed for Independent Artist to now build and support one another through creativity, marketing, and network. Social networks such as Twitter, Facebook, and YouTube have allowed for independent artist to create a globalization of their musical work without the support of major record labels. One would say that social media has given independent artist liberty and freedom to create. Artists are also able to reach their market or listening audience from a more hands on approach. By personally building and connecting with there listening audience or fan base using social networks, independent artist are able to efficiently capitalize in their marketed area. Statistics state that 200 million people access Facebook via a mobile device and more than 30 billion pieces of content are shared each day. The same growing statistics are stated for Twitter and YouTube.

Social networks allow for a user-friendly E-marketing and access to online tutorials posted by independent artist. There are so many ways in today’s technological environment that independent artist have empowered themselves. Through social networks, independent artist are able to: tell the story behind their work, film and demonstrate the process of their musical production, share footage from openings or events globally, crate tutorials for fans or other independent artist, keep a log of recorded material, and review other independent artists work. The possibilities are endless.
