Urquharts Urchard Orcutt was born 1566 in Scotland, and died date unknown.

As legend has it, in the days when wild boar, wolves and bears still roamed the Scottish Highlands a mighty warrior named Conachar Mor ruled over a swathe of territory near Inverness, on the northwest side of Loch Ness. A scion of the Royal House of Ulster, Conachar became a hero in the folklore of the region for his strength and valour after he and his faithful, but aged hound An Cu Mor slew a ferocious wild boar that had long terrorised the Great Glen.

It is said that Conachar and his sword lie buried somewhere in what is today Glen Urquhart, and Conachar's feat is reflected in the boars' heads adopted as part of the heraldic achievement of the Chief of Clan Urquhart, who regards Conachar Mor as the founder of his clan.

Clan Urquhart took its name from Airchartdan or Urchard, as Conachar’s territory was named when St. Columba visited the area in the sixth century, bringing Christianity to a hitherto heathen land. Later a castle was built there, overlooking Loch Ness, Scotland's most famous loch. Urchard became Urquhart, and the area became known as Glen Urquhart. Today the remains of Urquhart Castle stand as an imposing monument to the past and a symbol of the ancient connection between Clan Urquhart and Glen Urquhart. The castle and glen serve as constant reminders to Urquharts throughout the world that their name had its origin here.

Kenneth Trist Urquhart, current Clan Chief, relates that "The first documented chief of the Urquhart Clan was one William de Urchard - a loyal supporter of Robert the Bruce during the Scottish War of Independence of 1296-1328. William is best known for his role in commanding troops against forces supporting the English King Edward I in the successful defence of the Mote-hill of Cromarty on the north shore of the Black Isle. The Mote-hill overlooked a strategic ferry landing at the mouth of the Cromarty Firth - a vital link in the land route running to the North - essential to royal control of the area. In 1358 William’s son Adam was made Baron and Sheriff of Cromarty and given the responsibility of defending and administering this important district. For the next three hundred years, the Urquhart clan chiefs held the Sheriffdom as hereditary property and the Barony of Cromarty was their principal seat."

The clan's loyalty to the Scottish monarchy was recognised when King James I knighted Adam's grandson William in 1416. Later, as Burke's Landed Gentry relates, King James III granted Sir Wm. Urquhart "the Mote and Mansion Mound of Cromarty, with licence to build a tower or fortalice thereon". Subsequently an imposing castle was built on the site by Thomas Urquhart, the 7th Chief. Unfortunately, the castle was demolished in 1772 and sadly today, only an artist's impression of this edifice remains.

Thomas Urquhart, builder of the castle, lives on in family legend for another reason. He reputedly fathered thirty-six children by one, clearly extraordinary, wife - she bore him twenty-five sons and eleven daughters. True to the family's loyalty to the Scottish royal family, seven of the couple's sons were killed at the Battle of Pinkie in 1547.

Memorials to Clan UrquhartSucceeding generations of Urquhart sons acquired other estates, becoming the lairds of Meldrum, Byth, Craigston, Craighouse, Kinbeachie, Newhall and Braelangwell. All of these estates have passed out of Urquhart hands except Craigston in Aberdeenshire, which is presently held by William Pratesi Urquhart, and a small portion of Craighouse containing the picturesque ruin of Castle Craig. Located on the north shore of the Black Isle overlooking the Cromarty Firth, Castle Craig is the last remaining symbol of Urquhart power in this area. It is the seat of the present chief of the clan who hopes to restore it and make it the centre of the clan’s activities.

Castle Craig was once owned by John Urquhart of Craigfintray, Tutor of Cromarty, who later built Craigston Castle in Aberdeenshire at the beginning of the seventeenth century. The Tutor, so called because he was guardian of his great nephew Sir Thomas Urquhart of Cromarty, was widely recognized for his "deep reach of natural wit and great dexterity in acquiring many lands". The Tutor administered the 11th Chief’s estates in an excellent manner, but, after his time, his great nephew soon got himself hopelessly in debt because of poor estate management and his support of the royalist cause. His son Thomas, who succeeded him in 1642, was unable to recoup his father’s losses and incurred further indebtedness because of his support of Charles I and Charles II. This Sir Thomas, the 12th Chief (1611-1660), was a great character - an eccentric, Scottish genius who is world-renowned among scholars for his outstanding translation of Rabelais - described by one admirer as "a marvellous production".

Sir Thomas is remembered for his service to the monarchy. A royalist officer, he was captured at the Battle of Worcester in 1651 and was imprisoned in the Tower of London. While in London, he wrote a book tracing his ancestry back to Adam and Eve, and authored works on mathematics, a universal language, and other erudite subjects. Before leaving Scotland in 1651 he commissioned a 5' 6" by 2' 8" carved decorative lintel for the great fireplace in Cromarty Castle. Called the Kinbeachie Stone, this celebrated sculpture depicts the arms of the Chief of Clan Urquhart and various emblems and inscriptions recalling the legendary history of the family. In the 1920s the stone was donated to the National Museum of Antiquities of Scotland in Edinburgh. Some seventy years later it was transferred to the new Museum of Scotland where it is today displayed in the section devoted to "The Seventeenth Century Challenge". Sir Thomas died unmarried in 1660, reputedly of mirth on hearing that Charles II had been restored to the throne.

Descent of the chiefship

The family's financial setbacks ultimately led to the loss of Cromarty and many other important Urquhart lands in the Black Isle. Yet support for the royal Stuart cause continued unabated. The 16th Chief, Col. James Urquhart of Cromarty took an active part in the Jacobite Rising of 1715 and later served as principal Jacobite agent in Scotland for the exiled King James, father of Prince Charles Edward, Bonnie Prince Charlie.

At the death of Colonel James in 1741, the chiefship of the clan passed to his cousin, William Urquhart of Meldrum in Aberdeenshire. From then until 1898 Meldrum was the seat of the chief. Kenneth Urquhart explains that "This came to an end at the death of the 22nd Chief of Clan Urquhart, Major Beauchamp Colclough Urquhart of Meldrum, an officer of the Queen's Own Cameron Highlanders. A bachelor, he was killed in action in 1898 at the Battle of Atbara during the Sudan Campaign. The chiefship then passed to his nearest male relative, his cousin, Rev. Edward William Urquhart who died in 1916; then it passed to Edward's cousin, David Urquhart of Braelangwell, head of a younger branch of the family.

"By the time David became chief, the house and most of the land of Braelangwell had been lost as the result of the extravagant lifestyle of his uncle, Charles Gordon Urquhart, an officer in the Scots Greys who was killed in1828 while serving as Governor of the Island of Karabusa during the Greek War of Independence. All that remained of the Braelangwell estate for David to inherit was the ancient little church and burial ground of Kirkmichael on the south shore of the Cromarty Firth."

Urquhart roots in America

By this time many Urquharts had migrated from Scotland to other parts of the world. Among those who had established themselves in North America was George Urquhart, ancestor of the present chief. Kenneth describes how, "in 1766, hoping to make his fortune in the New World, George Urquhart, a younger son of the Urquhart of Braelangwell line, set sail for what was then British West Florida, settling initially at the capital Pensacola and then moving to the Mississippi River in 1772. At various points in his career George served as a member of the Assembly of West Florida, a Justice of the Peace, Deputy Collector of Customs, and a Magistrate while becoming a successful indigo planter, merchant and businessman. When he died in 1779, his widow and two young sons moved to New Orleans, capital of Spanish Louisiana, the colony adjacent to British West Florida. Our line of Urquharts has remained there to this day.

"George's great-great grandson, Wilkins Fisk Urquhart, was my father. After establishing his identity as ‘Urquhart of Braelangwell’, he was recognised by the Lord Lyon as Chief of the Name and Head of Clan Urquhart in 1959 - assuming a role which had lain dormant since 1934 when the 25th Chief, Francis Fortescue Urquhart of Braelangwell - his cousin - died."

Kenneth Trist Urquhart, 27th Chief of Clan Urquhart

In 1974 Kenneth Trist Urquhart succeeded his father as 27th Chief of Clan Urquhart. Sharing a passion for history, father and son collaborated on a number of important historical and cultural projects. They were responsible for saving the Confederate Museum in New Orleans from closure and they also played crucial roles in the revival of the Louisiana Historical Association and its transformation into the leading historical association in the State of Louisiana.

Retired academics, the current Clan Chief and his wife, Mary Virginia, are now devoting much of their time to researching Clan Urquhart in preparation for writing a comprehensive history. Kenneth views the role of Clan Chief as very important. The living embodiment of the chiefs who went before him, he has the responsibility of leading and inspiring the clan. Much of his time is devoted to the preservation of the clan’s heritage, and to making Urquharts throughout the world aware of it.

Commemorating history
An important date that will undoubtedly go down in clan history is that of May 1994 when members of the Clan Urquhart gathered in Scotland for the first international family reunion in modern times. "This event", says Kenneth, “fulfilled the long-standing desire of the Chief and the Clan Urquhart Association that an international gathering of Urquharts be held in Scotland.”
Although he did not live to participate in the 1994 gathering, a major force in bringing it about was Major-General Robert Elliott ("Roy") Urquhart, a distinguished hero of WWII whose bravery as Commander of the British First Airborne Division at Arnhem has gone down in history and who was immortalised by Sean Connery in the film A Bridge too Far. General Urquhart was appointed Commissioner of Clan Urquhart for Scotland by the chief in 1982 and he took the lead, assisted by Bruce Urquhart of Craigston, in organising the British branch of the Clan Urquhart Association which had been established as an international organisation in 1976 by the Chief of the Clan. The British branch, under the leadership of General Urquhart’s son, Adam, was responsible for organising the 1994 international gathering.

At the 1994 clan reunion, family members from various parts of the UK and overseas joined together to renew their commitment to the heritage of their clan and to celebrate their pride in being Urquharts. They visited places of historical significance to the clan, being welcomed at Craigston Castle and visiting the town of Cromarty and the eighteenth-century Cromarty House, built on the site of the clan's old castle.

In 1999 a second international gathering was held, when the programme of events included the dedication of the Clan Urquhart Room in the old, restored Cromarty Courthouse located in the town where for centuries Urquhart barons and sheriffs officiated over the local population, maintaining the peace and dispensing justice. They also made a pilgrimage to the clan’s birthplace, Glen Urquhart, and visited Urquhart Castle on the shoreline of Loch Ness - home to a legendary and elusive monster reputedly first spied by St. Columba on his mission to convert the Gaels to Christianity.

Today members of the clan are widely scattered throughout the world. The 27th Clan Chief explains: "We Urquharts have become a worldwide family, Scottish by origin and Scottish by conscious choice; a family of members who, despite their diversity, view themselves as one; and proudly call themselves 'Urquharts'. We look to Scotland as our home and we have a special attachment to Glen Urquhart, Cromarty, and the Urquhart estates in Aberdeenshire.

"It is our hope that Clan Urquhart will grow and prosper and that its Association and its projects to preserve and promote the heritage of the clan will be successful. One of Clan Urquhart's great challenges in the twenty-first century is the restoration of Castle Craig, our historic hereditary seat overlooking the Cromarty Firth. The restored castle would provide a permanent clan centre and a base in Scotland for all members of Clan Urquhart. In pursuit of this end, as in all things, let us live up to our ancient clan motto: 'Meane Weil, Speak Weil and Doe Weil', which is surely as meaningful today as it has ever been."

The next international gathering of Clan Urquhart is scheduled for July 30-August 1, 2004 when it is hoped that an archaeological dig will take place at Castle Craig as a preliminary to commencing restoration work.

The Association now numbers over 500 members with families hailing from the USA, Canada, France, Australia, New Zealand, Germany and, of course, Scotland and England - a membership expected to increase substantially over time as further Urquharts are identified and located. Branches of the Association operate in the United Kingdom, the United States, Canada, and Australia/New Zealand. Through the Clan Urquhart Foundation, members' subscriptions have already enabled substantial contributions to be made to the Craigston Castle Maintenance Trust, the Cromarty Courthouse, Cromarty's historic East Church, the Ship Hector Foundation, and the National Trust’s Culloden Battlefield.

Membership in the Clan Urquhart Association is open to all Urquharts, their descendants, members of families having variations on the name Urquhart, such as Orcutt, Erquitt, and people bearing the name Cromarty, a sept of Clan Urquhart.

WOW!

I have to honestly say that I feel very blessed to have had a number of other genealogists assist me in my hunt for the Broderbund Family Tree Maker CDs!

I did not check the mail yesterday, so when I went to the postbox today to pick up the mail, I was ecstatic to learn that I had received not just ONE package, but TWO of the Broderbund Family Tree Maker CDs!

I will be updating the original file with all the "new" CDs I have received, located at the following link in just a few minutes!

Back in December of 2012 I had posted about the Broderbund Family Tree Maker / Family Archive CDs

Well, today I would like to revisit that post....

I am posting this in hopes that someone can help me out...

I am looking for 4 of the old Broderbund Family Tree Maker / Family Archive CDs -- specifically numbers 15, 18, 100 & 108...

Yes, I know this data is all online, but I am hoping to find these CDs regardless for their data and to check the accuracy of the records against that which I have on file and have found online, as well as to obtain more source documentation.

If anyone has these CDs still, I would like to rent or purchase them from you, or even provide you with some other form of compensation for the use of the CDs for even one day...

So....I got busy with research last night, and I had downloaded my favorite family group sheet, which I wanted to share with everyone here. It is from the New Zealand Society of Genealogists, their one page family group sheet.

THE MASON FAMILY

Eva (Orcutt) Mason was the first daughter of Julius & Emma Orcutt. She was born September 02, 1868 in Maquoketa, Jackson Co., IA and died August 22, 1955 in Storm Lake, Buena Vista Co. IA. She married Arthur Lawrence Mason April 5, 1888 in Odebolt, Sac Co., IA. They lived near Early, IA at Greenbush Stock Farm, where all their children were born and raised. Arthur was the son of Anderson Mason who had a farm in Boyer Valley, Sac Co.

Chester Mason is oldest son of Eva Orcutt and Arthur Mason. He was born June 19, 1889, Greenbush Stock Farm, Early, Sac Co., IA, and died December 24, 1954 at Early, Sac Co.

COPYRIGHT QUESTION:

So I have been searching through this website which was labeled in such a manner as to make me believe it may be out of copyright. On all pages, it lists "Copyright © 2003-2008 ------ All rights reserved."

So, I was wondering...does this mean that the website is now out of copyright or just that the page has not been updated since the last copyright notice was posted?

The reason I ask is because I am wondering if the information contained therein is now subject to the "Fair Use Doctrine"of copyright and intellectual property laws.

More over, I believe the creator of said intellectual property is deceased. I have found an obituary from 2011 for the person I believe to be the author, and it seems as if the content (roughly 1,000 or so pages) of online data has not been updated since 2008...

Hmmmm....going to have to research that further....

Ebenezer Orcutt Jr (b. 10 AUG 1727, Hingham, Plymouth, Massachusetts, USA; d. 15 APR 1833, ???)

m. 09 DEC 1753, Hingham, Plymouth, Massachusetts, USA, to

Jane Pratt (b. abt 1735, Cohasset, Norfolk, Massachusetts, USA; d. ???, ???).

Together, they had 12 children, 3 of whom were supposedly named MOSES ORCUTT.

The oldest Moses was born about 1754 and supposedly died before January 1762.

The middle Moses was born about 1762 and died before 16 May 1778.

The final Moses was born 16 May 1778; at this time I have yet to find a date of death for him...

HOWEVER,

He had supposedly and some how married one Sarah Keith (b. 15 July 1780, Chesterfield, Massachusetts) and had a child named Betsey Orcutt who had died in 1843, but not before she married a man named Howard Z. Lambkin and not before they had a baby girl named Susan Lambkin (b. 28 MAR 1836; d. 20 MAY 1921).

Susan Lambkin supposedly married Lewis James Irish (b. 8 MAR 1833; d. 23 APR 1909) and had 3 children with him between 1861 and 1870.

I hypothesize that it was NOT the eldest Moses, but more likely the youngest Moses whose family this had been, but I would need to do more research into this dilemma first...

The FOIA and how to use it to your advantage

I posted this on Facebook in response to a fellow researcher's question about it, but I thought that I should probably post it here too, that it may be beneficial for others who are searching and need to know what they can do to assist themselves and others.

In this case, a woman in her late 30's is looking for her birth mother, but she is hitting many brick walls, and she feels that the records are out there some where, and she was not sure how to go about having the records produced for her.

She knows her birth name (first and middle, not sure about last), what time she was born, what day she was born, and she knows she was immediately given up for adoption.

Normally, when adoptions happen, the adoption agency must release the records of the person's birth once the person reaches the age of maturity, normally between the ages of 18 and 21. This woman is now in her late 30's, and she STILL does not know who her birth parents were! To have been searching for her own personal truth for so long...my heart goes out to her...I sincerely hope that my response helps...

The FOIA can be used for darn near anything now. It's a really great "tool to keep in your back pocket", your "ace in the hole", so to speak...

Here is the link to the FOIA form: http://www.uscis.gov/files/form/g-639.pdf

In part 1, you will need to make sure the Privacy Act (PA) area is checked, that you are requesting your own records.

In part 2, you will need to check Other and specify what records you want released under the FOIA (example: "Complete and unabridged birth records, and all records relating to birth parents obtained by the hospital in connection with the event of my birth")

In part 3, obviously you would check All My Records, etc etc etc....

Just make sure to fill out all the parts that you can and make sure to fill in all the required information and they cannot ignore the request for information regarding births, especially if there are certain circumstances involved.

There is also another version, one used by ICE, but it's not the same as that which you would file with hospitals and such: http://www.ice.gov/exec/forms/foia-request/request.asp

The Freedom of Information Act has been used by people around the country for a myriad of reasons, from people in Phoenix, AZ, sending FOIA documents to the government for full disclosure of the "Phoenix Lights", to information about Area 51/Roswell, NM's, "weather balloon experiment", to people requesting immigration status of a someone...it's amazing how much information you can actually get from people or companies just by mentioning the FOIA! For example, I used it to obtain records from funeral homes a number of times, when they were going to give me a hard time for requesting any documentation they had on my family. As soon as the FOIA was mentioned (long name, not short), they seemed to want to cooperate quickly with me...I like it when that happens...lol...

My favorite quote from there is from the section entitled HISTORY:

Some circumstances over ride HIPAA and the Privacy Act (the Patriot Act, for one, but we'll not go there just now)...there could concerns about family medical conditions, which would severely limit or possibly impede the quality of life for that woman and any children she had (such as a family history of cystic fibrosis, cancer, epilepsy, etc.), which if brought to the attention of the courts, normally has the judge issuing the warrant for release and disclosure of documentation ASAP, especially when -- if a child is put up for adoption -- he or she has the right to have their birth parent's information revealed to them upon their state's age of maturity (usually between 18 and 21, but I know someone who had fought from the time she was 18 until the time she turned 28 to get her birth parent's information -- that person was my half sister)...depending on the state, you may need to check their FOIA policy because Federal FOIA may not prevail over the state's if the state's FOIA policy or form is more strict or stringent...

To cut to the chase, there are certain FOIA papers which a person can use before they go to a court house and obtain a subpoena for documents -- or "subpoena duces tecum".

Remember when submitting FOIA's for hospital records, court records, etc., it is best to have printed at least 3 copies and make sure to have the one that you are delivering to the place of records notarized and sent via some method that requires a signature confirmation of delivery (USPS Certified Mail, UPS, FedEx, etc.). You will want to make sure you receive confirmation that the documents have been delivered and verification of the accepting person's signature, so if you need to go back and say "yes, you did receive that on Tuesday, May 5th, 2020 at 2:20 pm EST; it was signed for by Miss Jones", etc., you can...

Accompanying your official form, you will want to make sure you write a formal letter (should also be notarized) stating your name, the purpose of this letter and the FOIA and give them a reasonable time frame in which to produce documents (anywhere from 30 to 90 days) before you are forced to pursue a subpoena for them to produce documents (FYI, anyone can file a subpoena for nearly anything within the bounds of the law, and all you need to do is pay the filing fee and the fee for the process server and you are done). Make sure to leave your contact information, cell phone, physical address, etc etc etc in the letter as well, so that if there are any questions or hiccups along the way that they should be able to call you.

So I just set up my Networked Blogs links and will be working on the website revisions tonight.

As I had wanted to do, I had posted the Zangari Genealogy website on November 3rd, but abruptly took it down after having it online for 5 minutes. It did not work as well online as it did locally, nor did it display correctly, so I took it down immediately. Currently, there is only a few place holder pages available, but I hope to rectify that soon.

I have begun the painful process of revamping the site once more, but after creating half of the site all over from scratch I am once more unimpressed with the results. Here is a screen shot of the current site which I am not happy with...

The page and the site are looking good, but looks don't count for everything. I am fighting with the presentation of the page width and having the page auto adjust using this style and page layout. And while I like how this page is progressing, the same cannot be said (unfortunately) for all the other connected pages and sub-pages. If you look at the title of the above page's screen shot you will see it reads "Family Information". While this is great, it does not suffice for my needs or desires.

I will be renovating the site for a few weeks once more, and hopefully by then I can reupload the site and be completely happy with the results. In the mean time, I hope everyone who stops by to have a read will also take the time to press that little button to the right that allows you to follow this blog or join this site.

I found an all most complete list of Family Tree Maker CDs / Family Archive CDs on THIS SITE, and I loved how comprehensive this list was. I also liked the spreadsheet formatting on this. I am going to have to go through and highlight which ones I have all ready and then add those which are not listed here, to make a more updated version of what I created back in July of this year.

I will eventually own the complete set, and by then I hope to have my other project (creating another viewer for these file types) completed.

I have some really good people and really good friends who have been working with me, and I want them to know their help and guidance is always much appreciated.

For the last 6 months I have been working on a research project; a report that details what steps I have gone through and which software I have used.

I am in hopes that when the project completes, I have a totally accessible database software, based on SQL, which will access the data on these CDs. I hope to release some really good news by the end of July 2013.

Much more research is needed previous to me saying anything further, but suffice to say that as a Genealogist I am excited at the prospects and thoughts of what is possible...

Introduction

The Archives, a division of the Office of the Secretary of the Commonwealth, is the repository for Massachusetts records generated by state government. Archives holdings date from the beginning of the Massachusetts Bay Colony in 1628 and document the settlement of lands in Maine and Massachusetts, the arrival of immigrants, and the development of state government. Public records are not in the holdings of the Archives because of inherent genealogical value. However, these documents can be an important resource for people engaged in the study of family history.

In addition to the archival records created by Massachusetts state agencies, the Archives has a limited selection of books and microforms to aid genealogists and other researchers.

Access to these materials is provided through the Reading Room of the Massachusetts Archives at Columbia Point. It is open weekdays, 9 to 5, except on legal holidays.

Passenger Lists

Massachusetts officials started recording the names of immigrants who arrived by ship to the Port of Boston in 1848, a procedure that continued until 1891, when federal record-keeping programs superseded those of the state.

These records are arranged chronologically according to the date when the ship arrived in port. Facilitating the use of the passenger lists is an alphabetical name index. Information available from the lists includes the name, age, sex and occupation of the immigrant; the country of birth; and previous residence. Also included are the name of the ship, and the date of its arrival in Boston. It is important to note that the passenger lists do not generally provide information about the county or town where the immigrant originally lived.

Over one million immigrants came through the Port of Boston between 1848 and 1891. With the invaluable assistance of our volunteers, the Massachusetts Archives is engaged in a multi-year project to convert this voluminous amount of information into a database, which is available on the Archives website:

As new surnames are entered into the database, the website is updated periodically to reflect these additions.

Vital Records: Pre 1841

City and town clerks in Massachusetts are the custodians of pre-1841 vital records for their respective towns. A list of all the city and town clerks in Massachusetts can be found at: Massachusetts City and Town Directory

Although the Massachusetts Archives does not have original pre-1841 vital records, we do hold two collections that can be utilized by researchers. An incomplete collection of the printed volumes of Vital Records Prior to 1850, which are organized by town, are available in our Reading Room and in many research libraries, including the Massachusetts State Library. The Archives also holds a miscellaneous collection of microfilm that has been deposited with the Archives by the Genealogical Society of Utah. We will not be receiving additional microfilm in this collection. While the types of records vary for each municipality, this film includes records normally found in the municipal clerks' offices. Among these are vital records, records of town meetings, as well as church and cemetery records.

Vital Records: 1841-1920

The Archives hold births, marriages, and deaths for all Massachusetts cities and towns, 1841 through 1920. Municipal clerks submitted these registration pages to the state annually covering the vital records generated by their offices. While there is some variation in this information, generally the books provide names, dates, residences, occupations, and parental information. From 1903 forward, death records also include the place of burial. The Archives also holds added entries and corrections to vital records for the same period. Certain amended volumes are available on microfilm in the Reading Room. Later records in this collection will be transferred to the Archives at five-year intervals.

Access to the information contained in the vital records registration volumes is gained by consulting index books. The index books are organized in five-year intervals; within each index, the names are listed alphabetically. Reference staff in the Archives will assist researchers in the use of these materials.

Vital Records: Post 1920

Vital records after 1920 are located at the municipal clerks' offices and the Department of Public Health, Registry of Vital Records and Statistics (150 Mount Vernon Street, Dorchester, MA 02125). Researchers may contact the Registry of Vital Records at 617-740-2600, or through the DPH website:

Indices of the DPH vital records volumes through 1971 are available at the Archives, although there are no copies of the actual records at the Archives. These indices can be used by visitors to the Reading Room.

Census Schedules

Massachusetts State Census

The Massachusetts Archives holds state census schedules from 1855 and 1865. Although the state conducted a census up to 1975, the 1855 and 1865 censuses are the only two surviving schedules. The information contained in the state census is similar to that of contemporary federal returns and is arranged in a similar manner. A name index for these schedules exists for many of the small towns in Essex, Middlesex, and Norfolk counties, as well as the City of Charlestown.

Federal Census

Federal census schedules date back to 1790. Recorded on a decennial basis, they constitute a major resource for genealogy. Originally a fairly simple list of the heads of households, the population schedules became more detailed and new schedules were added as the nineteenth century progressed. By 1850, the general population schedules list all individuals residing in a house and provide data on their age, occupation, place of birth, and value of real estate.

Additional schedules providing social and mortuary statistics and the products of industry and agriculture were also present by 1850. All of the schedules are broken down by counties and municipalities. Large cities are further subdivided into wards and enumeration districts.

The Archives holds microfilm of federal census population schedules dated 1790 through 1880, and 1900 through 1920. The 1890 population schedules were destroyed during a fire in Washington, D.C., in 1921. A special 1890 census of Union war veterans and widows of veterans is available at the Archives on microfilm.

Printed indices for census schedules dating 1790 through 1850, and the 1890 war veterans census, are at the Archives. Military Records

Military records in the Archives cover conflicts dating from the seventeenth through the twentieth centuries; those most useful to genealogists date from 1643 to 1865. The records can be used to identify the service of particular individuals but provide little background on the person's family or life.

Information concerning military service in the colonial wars (circa 1643-1774) can be gleaned from legislative records and a variety of military rolls and accounts. Similar rolls from the Revolutionary period document the service of soldiers in the state militia; there are also a limited number of Continental Army rolls. Additionally the Archives holds records of state pensions, bounties, and Maine land grants for Revolutionary War veterans, or their heirs, who were not eligible to receive federal pensions. Family relationships may be included in the pension records, as heirs tried to document their status. Military records from the colonial wars and the Revolution are indexed by name and are available on microfilm at the Archives. Revolutionary service is also referenced through the seventeen-volume set, Massachusetts Soldiers and Sailors of the Revolutionary War, created from documents held by the Massachusetts Archives.

Payrolls and other military records at the Archives may also be used to document the garrison on Castle Island in Boston Harbor. Following the Revolution, soldiers continued to be stationed at the Castle as a defense for the harbor. These soldiers guarded the state prison that existed there between 1785 and 1798.

Included in the Massachusetts Archives Collection (see following section) are records from Shays' Rebellion, a period of internal turbulence dated 1786-87, as well as records of the state treasurer and the commissary general. Letters, orders, warrants, petitions, special reports, military payrolls, service certificates, financial records, and oaths of allegiance provide extensive documentation of Shays' Rebellion. Partial indices exist with names of soldiers and individuals who supplied or housed the army.

Military records relating to the War of 1812 (1812-1815) are found in the records of the Governor and Executive Council; these are concerned primarily with the formation of militia units and commissions for officers. Records of the Massachusetts Militia in the War of 1812-1814 provides information on the militia regiments called out in 1814 in anticipation of a British attack on Massachusetts.

The most complete list of Massachusetts men who served in the Civil War is found in the multi-volume set, Massachusetts Soldiers, Sailors and Marines in the Civil War. Civil War records held by the Archives include a variety of muster, clothing and descriptive rolls, lists of assignments of recruits to particular town quotas, materials documenting the use of substitutes for draftees, and records of Massachusetts bounty payments to southern African-Americans who were recruited into the U.S. Army. Additional archival materials from this period include the records of the State Military Agent and the letterbooks of Governor John Andrew, an early and strong supporter of the war effort.

Records relating to the Spanish-American War (1898) include a small collection of letters and petitions for bonuses from veterans or their families to the state treasurer.

Those records relating to the Mexican War, Civil War, Spanish-American War, and World War I are maintained in Worcester at the Massachusetts National Guard Museum, 44 Salisbury Street, Worcester, MA 01609. The Massachusetts Archives Collection

The Massachusetts Archives Collection (or Felt Collection) is an important source of records for early Massachusetts, Maine, and New Hampshire families. Documenting the development of the Massachusetts Bay government and settlement of its lands between 1630 and 1800, the collection includes original records of the Governor, Council, the General Court, the state secretary, and the treasurer. These cover a wide range of topics of interest to genealogists: land grants; early records of divorces and contested estates; legislative papers relating to towns, including petitions and remonstrances; military records from 1643 through 1775; records of mercantile affairs; and tax valuation lists.

The records were originally bound into 328 volumes, generally arranged by topic. Most of the volumes have a table of contents and many have been indexed. Access to the collection includes a card catalogue for approximately one quarter of the collection, a calendar index, and a database that provides name, location, and subject access for eighteen volumes. Papers Relating to Maine

Maine was part of Massachusetts from the early colonial period through 1820, and there are many records in the Archives pertaining to the settlement and settlers of Maine. The Massachusetts Archives Collection contains a variety of Maine records dating from the seventeenth and eighteenth centuries; Maine records are not grouped separately within this collection. There are numerous records relating to eighteenth-century forts and Indian truckhouses (trading posts), especially for the one located at Machias. In addition, both passed and unpassed legislation contain petitions, remonstrances, reports, and correspondence relating to Maine from 1780 to 1820.

The Eastern Lands papers focus on the settlement of public lands in the District of Maine and its separation from Massachusetts as a state in 1820. Legal, survey, and financial records of the General Court, and records of legislative commissions and the Land Office are included in the Eastern Lands papers. Researchers will also find copies of deeds for land conveyed by the Committee for the Sale of Eastern Lands and the Land Agent, records establishing land titles in disputed areas, and extensive correspondence regarding road construction, land settlement, and the development of Maine's natural resources. The Archives holds indices to several volumes of the deeds, and to the correspondence dating 1783 through 1867.

Maine vital records are not part of the Massachusetts Archives holdings. Researchers should contact the Maine State Archives or the appropriate city or town clerk regarding Maine vital records.

Plymouth Colony Records

Plymouth Colony, also known as the Old Colony, existed as a separate entity throughout most of the seventeenth century; it was officially merged into the Province of the Massachusetts Bay in 1692. Plymouth Colony consisted of towns currently located in Plymouth, Barnstable, and Bristol Counties. The original colony records for Plymouth, including wills and deeds, are maintained at the Plymouth County Commissioners Office in Plymouth. The Massachusetts Archives holds manuscript transcriptions of these records, with accompanying name indices. Some of the Plymouth Colony records, along with the records from the Commissioners of the United Colonies, were published in a twelve-volume set, Records of Plymouth Colony, available at the Massachusetts Archives and the Massachusetts State Library.

Records of State Institutions

It is very important to note that per Massachusetts state laws, access to the records of state institutions may be restricted to preserve the privacy of individuals at the institution. Medical (Massachusetts General Law4§7(26)c, MGL111§70E, MGL123§36), mental health (MGL123§36), personal (MGL4§7(26)c, o, p, MGL6A§1), evaluative (MGL66A§1), and criminal (MGL4§7(26)c, MGL6§167) information is restricted according to state laws. Criminal offender information is open upon the death of the individual, but medical and mental health records remain restricted. Researchers MUST contact the Archives before planning a visit to use these records in order to determine what restrictions will apply.

The Massachusetts Archives holds the records of a variety of state institutions, including prisons, almshouses, mental health facilities, public hospitals and sanatoriums, and reform schools. These records were created by a number of state agencies, including corrections, youth services, public health, public welfare, and mental health. The records vary from institution to institution, but can include records such as case files and histories, records of admissions and discharges, and other records that provide information on the lives and families of people at these institutions. Massachusetts Supreme Judicial Court Archives

The Massachusetts Supreme Judicial Court Archives is a separate and distinct repository, collecting records from state, county, and local courts. Judicial records are an invaluable resource for genealogical researchers, and a small percentage of their holdings have been made available in the Massachusetts Archives Reading Room. These holdings include microfilm of select probate, naturalization, and divorce records, and some colonial era court records. Please contact Massachusetts Archives staff for additional information about this microfilm. The Massachusetts Archives does not hold the originals of these records, and all questions about judicial records and the Massachusetts judicial system should be directed to the Judicial Archivist.

The Suffolk Files

The Suffolk Files contain the earliest file papers of the Massachusetts Supreme Judicial Court and its predecessors, the Court of Assistants and the Superior Court of Judicature (1620-1800). There are also some records of the county courts and the Court of Common Pleas and General Sessions of the Peace. The records contain cases not just from Suffolk County, but from Massachusetts and parts of Maine and New Hampshire. This was the result of the circuit nature of several of the courts and the fact that most of the action brought before the upper courts had been appealed from lower courts throughout the region. Extensive indices of every person, place, and subject, as well as date and calendar indices were prepared. Naturalizations

The Judicial Archives holds naturalization records, which document the process of becoming a citizen, for those persons who were naturalized in the state Superior Courts and local District Courts. The records usually include the declaration of intent and petition for naturalization. Declarations filed after January 1930 generally contain a photograph of the applicant.

Information found in the declaration of intent and the petition for naturalization may include the name, address, occupation, and date and place of birth of the applicant and information regarding arrival in the United States; marital status and the names of children, along with their dates and places of birth. Prior to 1922, married women are included on their husband's petition. Minor children derived citizenship from their parents.

There is no statewide index to the naturalization records at the Judicial Archives, since each court was responsible for indexing its own records. In order to locate the proper court and date of naturalization for records between 1790 and 1906, researchers should consult the Soundex index to New England naturalizations, available at the Northeast regional branch of the National Archives in Waltham. Indices of naturalization records for specific Massachusetts courts, especially post-1905 Superior Courts, may be accessible on microfilm or by contacting the Judicial Archives.

The Massachusetts Archives holds abstracts of naturalizations from state and local courts, 1885-1931, filed with the Secretary of the Commonwealth pursuant to Chapter 345 of the Acts of 1885. These records have been microfilmed; they are arranged chronologically by year, and each volume is indexed separately, making them awkward to use. The abstracts provide the following information about the naturalized person: name, age, occupation and residence; also the name of the court and the date of naturalization. Although they do not provide much genealogical information, the abstracts are useful in directing the researcher to the location of the original records.

Additional information on Massachusetts naturalizations is available from the Northeast regional branch of the National Archives in Waltham. Its holdings include photostatic copies of state and local court records (1790-1906), which are indexed through Soundex index cards; U.S. District Court naturalization records (1790-1991); and U.S. Circuit Court naturalization records (1845-1911).

Divorces

Divorce cases have been heard in Massachusetts courts starting as early as 1639.

In the colonial period (1629-1692), divorce petitions could filed in a variety of courts, including the Court of Assistants, the General Court, and the county courts. Records of the General Court and the Court of Assistants have been published. Original records are located in the Suffolk Files, the Massachusetts Archives Collection, and the records of the county courts.

During the provincial period (1692-1775), primary jurisdiction for divorces rested with the Governor and Council, although six petitions dating 1755 to 1757 were heard by the General Court. Again, the original records will be found in the Massachusetts Archives Collection, the Suffolk Files, Council records, and county courts.

From 1775-1785 the Council had jurisdiction; records are located in the Massachusetts Archives Collection and the Council records.

In 1786, the Supreme Judicial Court was given jurisdiction over divorce cases. Records dating 1786-1796 are located in the Suffolk Files collection and recorded in the SJC record books. After 1796, summary information regarding divorces is included in the SJC record books, which are indexed and arranged by county. Case papers are also generally available.

Jurisdiction over divorce cases changed in 1887, when the Superior Courts were authorized to handle divorces. Records from this period are indexed in separate divorce docket books for the Superior Courts in the various counties.

In 1922, the county probate courts were granted concurrent jurisdiction with the Superior Courts, but since that date most divorces have been heard in county probate and family courts. Records since 1922 are maintained in the counties; an index for cases since 1952 is available at the Department of Public Health, Registry of Vital Records and Statistics (150 Mount Vernon Street, Dorchester, MA 02125). Probate

Probate records, including the administration of estates, probate of wills, and the appointment of guardians, have been under the jurisdiction of the courts since the 1630s. County courts and later, county judges of probate, were responsible for these functions until 1783, when the probate courts were established. In the nineteenth and twentieth centuries, probate and family courts were given jurisdiction over adoptions, divorces, name changes, and domestic relations.

These records are indexed by county; there is no statewide index available. Indices will provide docket numbers, and the docket books will provide access to the record books, which are contemporary copies of the file papers. Not all of the counties have both file papers and record books available through the Judicial Archives; Massachusetts Archives Reference staff has information on the specific records available for research on microfilm. Researchers looking for seventeenth-century probate records should also consult the Massachusetts Archives Collection, the Suffolk County probate index (for Essex County), the Suffolk Files, the Essex County Quarterly Court records, and the Middlesex Folio Collection.

Name Changes

Prior to 1852, name changes were administered by the General Court. Anyone interested in a legal change of name submitted a petition to the legislature requesting the change. The petition and resulting legislation are held by the Massachusetts Archives. Petitions that did not receive legislative approval for name changes are also maintained by the Archives.

Chapter 256, Acts of 1851, transferred jurisdiction over name changes to the county probate courts. Annual returns of name changes were sent by the probate courts to the state secretary's office until 1900. The returns were also published annually in the printed volumes of Acts and Resolves, 1852-1913. Name changes dating between 1780 and 1892, including both those enacted by the legislature and those decreed by the probate judges, were published in the volume List of Persons Whose Names Have Been Changed in Massachusetts. The book, which is thoroughly indexed, provides the following information: original name; new name; date of change; and the chapter number of the legislative statute or location of probate court.

It is important to note that the information provided above concerns only those name changes that were authorized by the General Court or probate courts. Many people changed their names informally, and did not record the change with the state government. The names of immigrants may have been anglicized upon arrival in the United States, or the spelling altered significantly, but these changes are not usually documented.

Adoptions

Genealogists should remember that many adoptions were never recorded legally. Children were frequently sent out of their families to live with other people, including relatives. Other children went to live with neighbors, but were never adopted as part of the family.

As with name changes, some adoptions prior to 1852 were enacted through the General Court. The petition requesting the adoption and any accompanying legislative papers are available through the Massachusetts Archives. Chapter 324, Acts of 1851, transferred responsibility for adoptions to the probate courts. Records after 1851 are either held by the Judicial Archives, or are maintained in the courts. The returns of name changes, and the List of Persons Whose Names Have Been Changed in Massachusetts note when names were changed as a result of adoptions. Access to adoption records may be restricted, so researchers will need to contact the Judicial Archives guidance to obtain such access.

Suffolk County Deeds

Deeds for property in Suffolk County (1629-1800) are held by the Archives. Typically the records include the grantor and grantee, and the location and description of the property being transferred. The deeds are arranged in volumes chronologically, according to the date and time they were filed. The Massachusetts Archives holds the grantor and grantee indices for these deeds (1629-1800 only).

Indices for these deeds (1801- Feb. 1924), which are vital for use of the collection, are located at the Suffolk County Registry of Deeds, located at 24 New Chardon Street, Boston, MA 02114. Suffolk County deeds from 1924 to the present are held by the Registry at their New Chardon Street location.

Deeds for all other counties can be accessed through the individual county registries of deeds.

African-American and Native American Resources

Many collections in the Massachusetts Archives are appropriate for genealogical research, regardless of the ethnic background of the family being researched. It is important to note that terms of ethnicity and color were recorded inconsistently in federal and state records. In addition to the collections noted in this booklet, there are additional archival records that would be particularly useful to people researching African-American and Native American families. These include the 1754 slave census, early nineteenth-century applications and registers of state-issued passports, and applications for southern travel (1842-1845, 1862). The records of the Guardians of Indian Plantations provide detailed financial records of land sales and poor relief for Native Americans living in Massachusetts. A census of the Mashpee Indians, taken in 1832, is also included in the records of the Guardians. Additional census information is located in the 1861 Report Concerning the Indians of the Commonwealth, written by J.M. Earle. The report on the 1870 census of Mashpee, written by Richard L. Pease, is not held at the Archives, but can be accessed at the Massachusetts State Library.

Additional Collections

Other collections held by the Archives, not usually associated with genealogical research, may also provide information on families or individuals. These include collections such as maps and plans, legislative papers, and photographs relating to the construction of the Quabbin Reservoir.

Many maps, especially those of towns in Maine, include settlers' names with their residences or lots. These maps are often associated with legislative action or material in the Eastern Lands papers.

Legislative records, available for passed and unpassed bills, may include petitions, remonstrances, and copies of local records, in addition to the proposed bill. This documentation may provide information about specific individuals, especially if the legislation concerned a land grant, or the incorporation of a town, religious society, social organization, or business.

Records of the Metropolitan District Water Supply Commission include photographs of real estate in the "drowned towns"of Dana, Enfield, Greenwich, and Prescott that were taken during the construction of the Quabbin Reservoir. The collection also includes photographs of gravestones in the town cemeteries that were moved away from the reservoir site.

Family Tree Legends has been purchased by MyHeritage.com; so, while the software is still free, you would need to find the installation file or compromise and use My Heritage's Family Tree Builder software (which I am not keen on, but I do like the reports it generates).

Since the old download link now leads to the My Heritage site, I thought it prudent to share this with the rest of the genealogical community.

In an effort to keep a great and simplistic piece of software readily available for everyone, I have searched the internet for everyone and have found the best download site for it:
