1. Pursuant to LAMC Section 151.05B (LAMC), Petitioner (Plaintiff) is entitled to writ of mandate because the City has a ministerial duty, under its Rent Stabilization Ordinance (RSO), to register or renew registration of Petitioner's four rental units on Petitioner's property, upon payment by Petitioner of the fees required to register four units and upon compliance with the requirements of LAMC Section 151.05B.

2. The requirement of registration under LAMC is a revenue measure, not a regulatory measure, the purpose of which i to fund the enforcement costs of the RSO by levying a tax or fee upon a landlord for each unit that the landlord wishes to rent.

3. The City does not authorize its Housing Dept (LAHD) to use the ministerial provisions of the RSO to force a landlord to comply with the City's building code. The building code is to be enforced by utilizing the enforcement provisions contained in that code.

4. LAMC has not been amended, remains in full force and effect, and still requires that the City issue to a landlord, upon the payment of proper fees and the furnishing of an emergency phone number, the registration of rental units.

5. The City cite no legislative enactment that permit City officers or employees to use the RSO to enforce building code. The building code itself has adequate enforcement provision for its enforcement. Nothing in this court's ruling deprives the City of its right to enforce its building code using the legislation enacted to enforce the code.

SUMMARY: Carmen Trutanich has been allowing the Los Angeles Housing Department to ILLEGALLY deny property owner registrations and renewals of their properties, for BUILDING & SAFETY CODE REASONS, when the court had to remind Mr. Trutanich, that the ONLY issue LAHD may concern themselves with is the fee itself. Adding that if the city wants to bust people on Building & Safety bullshit, they have to have the Building & Safety Department do that.

Greuel Calls for Increased Accountability in City Job Placement Program

LOS ANGELES – City Controller Wendy Greuel today released a performance audit of the Community Development Department’s (CDD) Workforce Investment Act (WIA) grant-funded programs and found that the City is doing a lackluster job of getting unemployed Angelenos back to work. Greuel urged for greater accountability in the City’s job placement program and for officials to adopt standards that go above and beyond the Department of Labor program requirements to help create more sustainable employment opportunities.

“Doing an adequate job does not cut it,” said Greuel. “As long as we have unemployed people in the City, we must not rest. Getting Angelenos back to work has to be a top priority and the City must go one step further by better connecting job training with job placement and retention.”

Greuel reminded City leaders that her audits provide an opportunity to re-envision how the City does business and how to get the maximum effectiveness out of the resources invested. The City’s WorkSource Centers are a prime example. Some of her audit findings include:

· Although the average cost to place a WIA client in a job is consistent for the years reviewed, the employment retention rate is actually decreasing.

· WorkSource Centers’ placement statistics do not demonstrate the most effective and efficient use of WIA funds; despite similar budgets, job placements ranged from 148 to 409 depending on the center.

· CDD does not report performance measures and outcomes in a manner that is readily understood by decision makers and program monitoring practices primarily focus on compliance with WIA guidelines, as opposed to reviewing the cost-effectiveness of the Centers.

· CDD lacks a comprehensive, integrated data system to collect WIA client program data and report results.

“I call upon CDD and the Workforce Investment Board to fully implement the recommendations in this audit to improve its preparation of the City’s workforce and to get the City’s unemployed back to work and trained to compete in the 21^st century global economy,” added Greuel.

This latest audit falls on the heels of Greuel’s review of the City’s grant application processes for the American Recovery and Reinvestment Act, which revealed that hundreds of millions in competitive grant funds were not pursed.

Controller Greuel has conducted 50 audits and uncovered $125 million that the City has lost to waste, fraud, and abuse over the last two years.

House investigators wrote the Port of Los Angeles yesterday to review the decision to spend almost half a million dollars in stimulus money on retrofitting a luxury yacht with environmentally-friendly engines.

"The Port of Los Angeles owes the public greater transparency about this project and a full accounting of the cost-benefit analysis used to justify spending on this type of project," House Oversight and Government Reform chairman Darrell Issa, R-Calif., wrote in a letter to the executive director of the port, Dr. Geraldine Knatz.

The Port of Los Angeles spent $489,000 of a $1.5 million grant from the Department of Energy to retrofit a city-owned yacht with "hydro-electric propulsion system," according to Issa's letter, rather than the diesel engines it already had in operation. The yacht is used to conduct tours of the port.

"This is the American people’s money that was borrowed in stimulus," said House Oversight and Government Reform Chair Darrell Issa in a local CBS broadcast. "It was supposed to create net new jobs. Could that half a million dollars have been used better? Was this really just show without substance?"

Zuma Dogg Presents MORE HARDCORE Constitutional FLAWS in L.A. City Attorney Carmen Trutanich's Venice Beach Ordinance 42.15.

QUICK SUMMARY: Friday, 12/9/11, Bill "Rosendope" Rosehdahl's Office sent out notice and the agenda item for 42.15, to be in council chambers (for a vote), this Tues, 12/13/11.

THEN, Rosendope's office believes they may have sent out the wrong link (not updated) and on SATURDAY, RE-SEND a NEW LINK to everyone...AGAIN...city does not do business on Saturday, and this is a BROWN ACT ITEM.

The City did not notify Zuma Dogg or his attorney. Zuma Dogg won a lawsuit in Federal Court, last year (still unsettled with L.A. City), and this ordinance affects ZD...and how funny they don't tell me or my attorney.

BUT OTHER PEOPLE DID -- AND ZUMA DOGG GOT EMAILS ABOUT IT ON SATURDAY, WHICH MADE HIM CRANKY. SO I TYPED THIS GENERAL REPLY:

This is all merely my opinion, based on five years of deep, day to day involvement (my entire life) regarding Venice Beach boardwalk Ordinance 42.15 (Venice Beach boardwalk regulations.)

After a round of local neighborhood council, commission and committee meetings; and after being continued from last month (Nov '11), the item is, once again, in Los Angeles City Council chambers (up for a vote), this Tuesday, December 13, 2011.

As many readers know, my rights were violated on the boardwalk, under previous drafts of this ordinance, and I had to sue in Federal Court to make them stop. (A Federal judge ruled in favor of Zuma Dogg, et al, against the City of L.A. and placed an injunction on the various illegal, 1st Amendment/Constitutional violations, this very country was founded upon. And it WAS the FIRST amendment.)

And ZD was not the only one impinged, harassed and illegally violated. Some people had babies and kids and lost them to foster care, when parents lost their income, when the city prevented them from LEGAL ACTIVITY in the U.S.A.

So as word is hitting the community that the Ordinance is in council chambers and up for a vote, Tuesday; some people are contacting me to make sure I am aware; and some are contacting me to ask me what I think will happen.

Here is an email I sent to one person. It makes a nice "Official Reply From Zuma Dogg Regarding 42.15, Up For An L.A. City Council Vote on Tuesday, 12/13/11."

Dear (Constituent),

In reply to the question in your email:

It was on agenda, last month (Nov) as you may have known. It was continued until Tues 12/13. So that WOULD be the 1st reading. But, ZD hears A LOT from inside sources.

1) Council HATES Bill. He interferes on their things like AEG Stadium deal/etc. They won't mind tripping him up, just to give him a black eye/payback.

2) AND, it's a BIG mess; Arts/Parks/Rec Committee Member & NEW L.A. City Council President, Herb Wesson not happy it's been 5 years, and doesn't want to be back here, next year, on this issue. City Attorney admitted in committee to Herb, "Yes, it's flawed/not perfect, but we have to do something." (Herb don't care that Bill is in a political hurry) AND, the other councilmembers are not going to put themselves at risk, by voting yes, on something they know stinks (flawed/problems/judge won't like seeing them in court, with Zuma Dogg, again.) Council HATES City Attorney Carmen Trutanich, more than Bill. And they know Trutanich BLOWS things, out of vindictiveness...so they ain't gonna do Rosendhal or Trutanbitch any favors/put themselves at risk, JUST CAUSE WEAKEST-CM ROSENDAHL & TRUTANICH WANT WRAP IT UP, THE WAY OBAMA WANTS TO WRAP UP HIS, "JOBS BILL" before X-mas.

3) BIG!: You probably haven't heard (cause it's a secret), the city made a decision and now considers the entire Venice boardwalk a "park," in an attempt to be able to do more regarding homeless removal/enforcement. They have decided they CAN go up and take your stuff if you are not there, store it for 30 days, etc. A LOT OF ISSUES THAT LAPD IS NOT READY FOR, THAT HAVE NOT EVEN BEEN FULLY DISCUSSED (regarding enforcement.)

Someone ZD trusts LAUGHED and said it would be PREPOSTEROUS to pass it on Tues. They don't even consider it an reasonable option.

SO WE'LL SEE HOW SHADY COUNCIL IS. It hasn't been officially continued...and you may think I am biased (hoping the city keeps making FOOLS of themselves, but I WANT the new laws passed already, for my own personal & performing interests as a long time Venice performer and Venice local)...but after attending/watching meetings for five years...EVEN ZUMA DOGG (WHO HAS SEEN IT ALL) WOULD BE SHOCKED IF THEY DID NOT CONTINUE IT.

ESPECIALLY AND MOST based on the last part about considering the boardwalk a park, and all these LAPD issues.

To paraphrase my attorney, "vague, ambiguous, irrational and unconstitutional distinction between 'creating visual art in its entirety' (which is allowed) -- and the 'completion' or 'partial' creation of visual art (which is not allowed). Visual art that is completed or partially created on the Boardwalk deserves as much First Amendment protection as visual art that is created entirely on the Boardwalk.

To put in it ZumaLease: This says you can't "decorate" or "customize" things. For example, you can't take a belt and "bedazzle" (customize) it. PRETTY RESTRICTIVE. And then the ambiguous task of LAPD enforcement/trying to sort it out. "Excuse me...I see you painted that statue of L.A. City Hall red, white and blue, like a flag. Did you MAKE that statue of city hall, yourself, or did you get it somewhere else, and then paint it?" Or, "Good morning. I see you have jewels on that paperweight. Did you MAKE that paperweight? Says, "made in China," on the bottom of the paperweight." This is what "partial creation" means. PRETTY RESTRICTIVE!

Likewise, visual art that is "mass produced" or "produced in limited variation" is not entitled to any less First Amendment protection than visual art that is created entirely on the Boardwalk. [Guess I have to make each Zuma Dogg bobble head or Carmen The Clown doll, by hand. Can't mass produce them -- and can't use other things to make them out of, as the canvas/medium. If I wanted to take a Kojak doll and stick an Afro on it, as a parody, ILLEGAL UNDER TRUTANICH! I HAVE TO MAKE THE KOJAK DOLL, TOO!]

In other words, you have to make EACH AND EVERY ITEM, by hand/can't be mass produced? So if I wanna sell Zuma Dogg "Bobble-heads" (or a "Trutanich The Clown" doll), you have to make each one by hand, and can't have them on cafepress. And, if I want to hand out, "DO NOT VOTE FOR CARMEN TRUTANICH," posters, I can't have them printed at Kinkos? The paper is just the medium, dude. It's not about the process of getting the ink on the canvas, BULLY!

Furthermore, the term "Handcrafts" is vague, ambiguous, irrational and unconstitutional. Why is the artistic expression involved in "weaving, carving, stitching, sewing and beading" (which is not allowed) entitled to less First Amendment protection than painting, sculpture and other forms of artistic expression (which are allowed), dumb asses? (THINK ABOUT OUT THAT??? "Clay is O.K.! Wood is no good?" INSANITY!!! Reminds me of some overseas country, we fight wars against, over these types of constitution, artistic expression issues. Maybe Trutanich should move to SOME OTHER country.)

Moreover, your latest loser version of 42.15 bans ALL "Handcrafts," yet it only finds that "most" Handcrafts are not allowed, over "nominal utility" issue, that I won't try to explain here. BUT DUMMIES...since the City itself admits that some Handcrafts do not have "nominal utility" (are not in violation), the absolute ban on ALL Handcrafts is vague, ambiguous, irrational and unconstitutional -- and a shady attempt to once again try to bamboozle the legendary icon and his constituents.

PLUS, it bans clothing. Zuma Dogg's Zuma Dogg T-shirts are clothing. TRUTANICH...you and you staff and Norm "Kuku" Kulla and you OUTSIDE COUNSEL...KNOW, the 9th Circuit has said...T-SHIRTS and HATS ARE IN! They are 1st Amendment expressions. A medium like a canvas. And, AGAIN...just like in 2006, I DON'T CARE THAT YOU DON'T WANT PEOPLE SELLING LAKERS SHIRTS! Enforce that under municipal code. Do you think you are ever going to find anyone who can generate buzz like this? It was all out of an empty pocket, mostly while homeless, as it all unfolded LIVE before the people's eyes on local cable TV, radio, newspapers and internet. (The world's most compelling REAL, reality show.)

STORY: Local public access TV personality, Zuma Dogg was told by City Hall he couldn't set up his amp or sell Zuma Dogg shirts, CDs & DVDs at Venice Beach boardwalk, anymore. ZD protested this 1st Amendment violation of the U.S. Constitution inside the chambers of L.A. City Hall, as televised LIVE throughout the city, and created more political backlash against them than any single voice in history -- and woke up the whole city to the fraud, waste and abuse that pushed the city to the edge of bankruptcy. On October 2010, a Federal Judge agreed with Zuma Dogg, who sued the city over this matter, and issued an injunction against the city as they prepare to pay Zuma Dogg for damages.

It's either an Academy Award worthy movie in the right hands or the biggest cable network talk show in television history. (Not second biggest, and biggest by a lot.)

(Still kinda early, and NO ONE is official a candidate on the ballot, yet. But I am as official and declared as any L.A. City Hall official who is running for office. I mention this, due to the headline reference.]

BOTTOM LINE: L.A. Mayor Anotonio Villaraiogsa better show Zuma Dogg the "SPECIAL EVENT" PERMIT that OccupyLA has applied for; and been approved for, or MOVE THE HOSTILE/DANGEROUS MOB OUT OF THE CITY HALL PUBLIC PARK SPACE! THE PEOPLE WANT THEIR OPEN SPACE BACK -- AND NOT HAVE TO ENDURE A MOB ATTACK ON FREE SPEECH. L.A. CITY HALL HAS ALLOWED A MOB TO TAKE CONTROL OF THE PUBLIC PARK SPACE AT CITY HALL. ZUMA DOGG DISCUSSES LEGAL PROBLEMS FOR CITY AFTER ZUMA DOGG WAS MOBBED BY OCCUPY LA CROWD WITH NO POLICE BACKUP ON L.A. TALK SHOW!

THIS SLICE OF LIFE INSIDE COUNCIL CHAMBERS starts off SLOW, but I go outside to OccupyLA crowd. GOOD WATCH FROM 5 minute mark, if you can forward video.

DAMN: The video got knocked off, but after ZD rustles up speakers for public comment, CITY COUNCIL MAGICALLY CANCELS THE MEETING! No meeting, means NO QUORUM, MEANS WHEN ZD BLOWS HIS STACK, LOUDLY, HE IS NOT DISRUPTING ANY PUBLIC MEETING. It's the same thing as shouting on the street. And you can use the "f" word, although they would prefer if you didn't. SO IN OTHER WORDS, after making people who showed up for an item on the agenda to speak (members of the public) sit through an hour of puppy giveaways and proclamation "pats on the backs," they announce they couldn't muster up enough councilmembers, getting paid $189K a year, plus benefits, perks and kickbacks to carry out city business. NOW, Tuesday's meeting will be jammed up with items from Friday, as well...and then they always have to rush through things, mistakes are made, then Zuma Dogg is following up on that. (I'M SURE THEY DIDN'T CANCEL THE MEETING CAUSE I SHOWED UP FOR THE FIRST TIME IN MONTHS TO TALK ABOUT THE FBI PROBE & OCCUPYLA [NO PERMIT] ISSUE...after I was outside rustling up comment speakers.) AREN'T YOU GLAD I'M STILL UNSETTLED AND BACK, NOW THAT I SEE IT WILL NEVER WORK OUT BETWEEN US!

VIDEO: Zuma Dogg is "attacked" by ANGRY OCCUPY LA crowd, as they try to prevent his free speech in a public park.

In this video from 10/28/11, Zuma Dogg set up his amp, to sing and deliver his political message (as protected by the U.S. Constitution). As soon as he began, he was quickly surrounded by an angry mob, who tried to prevent him from expressing his own message. The attempts to prevent the "Jackie Robinson" of Free Speech exercise (@ZumaDogg) included encroachment; shoving; pushing; shouting in close proximity/blocking his camera and movement; continually shutting off his amp; screaming to the speaker how to perform, and what her was allowed to do -- and how he was allowed to do it; stealing the power cord to his amp, at which time he was told he could have it back "IF" certain conditions were met; and you can hear, when he's finally allowed, fo a moment, to start speaking -- he is speaking in a calm/non-shouting tone...then the crowd further harasses and incites him, as he has to try to get on top of the mob that has gathered around. It is a big park. No reason my movements and expression had to be limited/impinged. A guy with brass knuckle gloves approached who identified himself as a "peacekeeper," there to protect the speaker. I guess he makes those discretionary decisions. (Is the brass knuckled glove "peacekeeper" official L.A. City Hall security?

L.A. MAYOR ANTONIO VILLARAIGOSA & LOS ANGELES CITY COUNCIL HAS ALLOWED AN UNSAFE ENVIRONMENT TO FESTER IN THE OPEN PARK SPACE ON THE LAWN OF CITY HALL BY FAILING TO REQUIRE OCCUPY LA TO FILE FOR, AND BE APPROVED FOR THE PROPER EVENT PERMIT.

Speakers were tied to the light post along the steps, with only two of the three speaker stand legs on the cement, while one leg hung over the ledge -- as the speaker stand was tied by string to the city hall light post, with wires across the steps. THAT IS WHY PERMITS ARE APPROVED! SO CITY STAFFERS ARE THERE TO MAKE SURE THING ARE CARRIED OUT SAFELY!

SO AN MOB SCENE IS ABLE TO FESTER...CAUSE CITY HALL HAS DONE NOTHING! AND HERE'S THE QUESTION: HOW COME THERE WAS NOT A COP IN SIGHT??? YOU HAVE A TENT ENCAMPMENT THAT HAS BEEN ALLOWED TO FESTER INTO A MOB THAT DID EVERYTHING POSSIBLE TO CHEW UP AND SPIT OUT ZUMA DOGG!!! I WAS SCREAMING FOR COPS!!! CITY HALL HAS CAMERAS MONITORING THE LAWN AND STEP AREA! WHY DID NO COPS COME OUT??? WHEN YOU WATCH THIS VIDEO THE ANSWER IS CLEAR: They did not want it to be on the national cable news and newspapers that cops had to be sent out to address the OccupyLA crowd.

So instead, Villaraigosa & City Council allow Zuma Dogg to fend for himself against an angry mob, and hope it doesn't turn out into Bryan Stowe Part 2 (LA City Hall lawn, instead of Frank McCort's parking lot.]
